There were two separate officers. This robbery does not relate to the initial contact between the officer and Michael Brown. The initial can tact between the officer and mr. Brown was not related to the robbery. Why did he stop Michael Brown . Because they were walking down the middle of the street blocking traffic. That was it. Having said that, chief jackson then gave the local paper and me yet another version. The officer he said actually did know about the robbery but was not aware that Michael Brown was a suspect, that is, not until he might have seen the cigarettes in browns hands. As you might imagine, neither the changing story nor decision to release the video is winning many friends here. Youll hear from the brown family tonight, from dorian johns johnsons attorney and more Surveillance Video from randi kaye. Reporter ferguson market and liquor saturday morning, what youre about to see is what police call a strongArmed Robbery. They say thats Michael Brown entering the store. White tshirt, long tan shorts and a red cardinals baseball hat. His friend Dorian Johnson right behind him. Its 11 52 a. M. And 58 corrects according to the Police Incident report. The surveillance camera shows four seconds later, brown is at the counter. Watch closely. See the store employee in the red shirt apparently coming from the restroom . She goes behind the counter. Just 12 seconds later, police say brown reaches for a box of swisher sweet cigars and hands them to johnson without paying for them. What happens next is a bit obscured by a display case but watch closely here. Police say there is some sort of confrontation involving brown, a struggle. Police say brown grabbed more cigars, he had been in the store now just 32 seconds. Seven seconds later, browns friend johnson puts the box of cigars brown handed him back on the counter returning them but brown just seconds later bends down to pick up some cigars he dropped and even looks a customer in the eye and then makes his way to the door. At the door, about ten seconds later, a store employee who appears to have a set of keys in his hand attempts to put himself between the man believed to be brown and the exit door. Still holding the cigars in his right hand, the man police say is brown grabs the clerk with his left hand and clearly shoves him back into a display rack. It all might have ended there, but take a look at what happens next, just about one minute into this. Police say instead of leaving right away, brown turns back one final time advancing on the store employee who tried to stop him. Towering over him, police say it was an attempt to intimidate the employee who quickly backs down. Only then does brown turn and exit at 11 54 a. M. Hes in and out of the store in one minute and two seconds, about ten minutes later, hes dead. Randi kaye, cnn, new york. All right. Randi, thank you very much. The releasing of the videotape driving protesters back to the stop, the qt, quick trip market. Some are having to stand under the over hang where people are usually pumping gas. People were upset by the releasing of the video. Were you upset by it . A little bit but i believe the truth will come out at the end and excuses are for people who make them and accept them. We as a community were not acre ceme accepting any evidence. If we are not easily accessible to it, we have a problem. Is it that much distrust for Law Enforcement . Right now yes. How i see it, if that were the case he commit add robbery, they would have had that on the 4 00 news, the 10 00 news that evening, the early news the next morning. They wouldnt have wait add week later to delegate or free their officer or give his name. They had to put together the pictures. They had to post together the video footage, made sure it was grainy so we couldnt see so we know the truth. Thank you very much. Im going to show the viewers around here because again, tonight here on the street, lets walk this way. Tonight here on the street protesters are gathering even within the rain. It put a little damper on it but really not much. As you can see, its backed up for miles as it has been every night. Tonight not quite as busy as it has been on other nights. The good thing is is that tonight it has been peaceful as it was last night, as well. Earlier i spoke with eric davis. Hes the cousin of Michael Brown and he talked about the release of that video and how his family is dealing with it on this day. Eric, thank you for joining us. Can i first get your reaction to the release of the videotape today . The release of the videotape put anger inside of me and my family because we feel its a distraction to get people turned away from what is going on and what happened. Its not about what happened at a Convenience Store. Its about what happened on canfeld when michael was executed by an officer on the ground with his hands in the air asking the officer not to shoot surrendering completely. Ben crump, the family attorney released a statement saying it is character assassination and essentially blaming the victim. What do you say to that . I agree. It is character assassination. We have not been happy with the investigation as it has been conducted by the Ferguson Police department. What do you think is going on to release it on the same day . What i think is going on as i stated, its an attempt to smear michaels character to get your eyes off what is really going on and focus on something else. Were not going to lose our focus. Well ask people continue to come out and peacefully protest. Well ask people to remember that this is not about what happened at a Convenience Store but more what happened when michael was executed. You dont think they have anything to do with each other . I do not. How do you think the community will react in response to this tape because now there is even more suspicion around the actions of Police Officers. I think that what happened with the chief releasing this tape at the same time as he released the name of the officer is just inciting the crowd and making everyone angry and fueled the distrust already out there for the Ferguson Police department. I think he just basically added fuel to the fire. Thats why were coming out asking the public, please come out and continue to protest but we do not want any violence to occur. Do not let them distract us from what our ultimate goal is and that is to get justice for Michael Brown. How is the mother doing . How did the mother react to this . Shes completely distraught because it has been very hard for leslie to raise michael in a neighborhood like we grew up in. I dont know if you understand but being a black male in a come mo community with high crime rates, its hard to keep your child away from those outside influences. None of us are latched to our kids 24 hours a day. They have to go out there and stand up for themselves and its been a very difficult task for her to get michael to even get to the point where hes graduating from high school. If you look at the Graduation Rates of African American males in that area, its not very high. What michael had just achieved was a great accomplishment for him. What do you think happens after this . Listen, the portrayal as ive said, michael has been a gentle giant, a kid never in trouble and never done anything and then for this video tape to come out on the same day, you say its character assassination. The country is watching and saying well, there he is, its him on the videotape. He did something, so what is the big issue here . The issue is its not what this case is about. Its not about what happened at a Convenience Store. Again, its what happened on canfield drive when my cousin had his hands up in the air, knees down on the ground asking the officer whose supposed to protect him not to shoot him. The officer didnt listen. The officer didnt respect that he had basically surrendered and he executed my cousin. What do you say to the chief . To the chief, i would like to say why didnt we release photos of the officer . We didnt have photos of the officer released today, why didnt we release any other information about the officer besides his name . Why dont we know how many times my cousin was shot . It says we can confirm that fbi agents working together with attorneys from the justice deputys Civil Rights Division and u. S. Attorneys office have already conducted several interviews of witnesses on the scene at the time of the shooting. Over the next several days, teams of fbi agents will be canvassing the neighborhood where the shooting took place to identify any individuals who may have information related to the shooting and have not yet come forward. And so again, tonight, were talking about changes in the narrative today and to some degree witness credibility. Dorian johnson we spoke to. Standing so close to big mike and the officer, i look in his window and see him and when he fired his weapon, i moved second s before he pulled the trigger. I saw the fire come out the barrel and i instantly knew that it was a gun. I looked at my friend big mike and i saw that he was struck in the chest or upper region because i saw blood spatter down his side, his right area and at that time we both took off running. That was Dorian Johnson on tuesday. That was the lawmakers in washington like to say revised and extended today by dorians lawyer freeman bosly. We spoke earlier. What is your clients reaction. Hes relieved. We need to make clear, several days ago, we met with the fbi, justice department, representatives of the Prosecutors Office and we laid all of this out to them. We met with them for over three hours. My client Dorian Johnson started from the beginning from when they woke up that morning, told them they went to the store, laid out for them the situation involving big make taking the cigarettes. This is not a theft. Its more of a shoplifting situation, but my client is relieved because he already knew they had done this. Theft and shoplifting is the same thing. Not robbery, robbery, its a difference. They are saying its a strongArmed Robbery. Were concerned about that label and concerned about the fact the chief continues to use that label. Its for of a shoplifting tape situation. Hes saying robbery because he wants people to think there is violence. Did you know they would release it today . No, lets talk about that. Did you know the governor came in and relieved ferguson of his duty of being the Police Department here . Did you know the governor release the st. Louis county of its duty of providing security. They like a bunch of kids acting up. They are mad so the chief decided to throw a hand grenade and laid this out and had to come back and add hit the stuff on the tape that the officer that had the confrontation didnt even know about the situation that happened in the store. So your client admits it was him and mike in the store . Yeah, he did. And he doid so from the beginning . He did with the fbi as well as the u. S. Attorneys office. On this program, your client was interviewed on this very program. Yes. And did not mention anything about a robbery, nothing about a qt, nothing at all. He mentioned a confrontation with police on canfield drive. Thats correct. It had nothing to do with the incident that occurred the officer didnt know they robbed let me take that back. The officer didnt know they had gone into the store and taken some cigarettes. He didnt know it. Isnt there a certain deception of omission. If someone asked you what happened leading up to this incident and you dont tell them, the interviewer on this program. Not lying is when you Say Something thats not true. Nobody asked him what did youall do before you came in contact with the officer . If you asked, we would tell you. We had the duty to tell that to the fbi and they got the full story. The authorities had the full story and got it two or three days before this came out. Was there any sort of deal made that your client would not be prosecuted or not be charged because they are saying we got the information today he would not be charged . There a deal made . When we had the meeting with the fbi, they said listen, we just want you to know that everything youre getting ready to tell us, we got all the information we wanted to know. The fbi and authorities knew about this incident. Was there a deal . At that time they said basted on what we know, you are not charged with any crime. You have not done anything wrong. Do you understand how people will say Michael Brown is not here to defend themself . According to your client, hes saying i dont steal, i dont do this, does it seem like do you understand it may seem like hes placing the blame on someone who is here who is not here to defend themselfs . Hes not placing any blame at all. It appears the media and chief attempting to place the blame. Youre saying big mike, that Michael Brown took the cigarettes, put them in the bag, your client put them back and said i dont do this. Im not saying the video says that. If you say the video, the video says that. Those arent my words. Those are your clients words. In audition to the pictures and the pictures verify what it is my client said. What happens next with your client . Have you spoken to anyone where the investigation goes, fbi . The next step is probably this case will be presented to a federal grand jury and hopefully well have an indictment. How is your client doing . Why cant we ask for an interview . My client is a federal witness at this point and as indication he should not be talking about a whole lot of other things. Through an attorney today, they called it a move aimed at assassinating their sons character. Thomas jackson is the chief of the Ferguson Police department and i spoke with him earlier. So there have been a lot of questions about the releasing of the video and the releasing of the offices name where it appears they are not connected but by doing so youre connecting them. Can you say beyond a shadow of a doubt that is Michael Brown who pushes the clerk and steals the cigarettes . I dont think i ever did say that was anyone. I said i was getting questions from the media about a robbery that occurred prior to the shooting. I wasnt commenting on that robbery and then i started getting freedom of information requests from various news outlets ask we sat on it as long as we could and reached the point where we had to release it. I felt it would be prudent if i was releasing that, it could be antiinflammatory if inflamato if i released that and not the video. Some are saying youre trying to discredit him, trying to soil his representation and trying to divert attention. Were not. We just tried to sit on this thing as long as we could. I didnt want to release it. I was told by my City Attorney that she was concerned that people were going to start filing lawsuits about it the if we didnt release the tape. Ill quote the family. They say its devious and youre assassinating the character of their son attempting to smear the character of the victim and essentially blaming the vehicle. What do you say to the charge . Thats absolutely not true. I had no intent, other than to compile with the freedom of information request. My heart goes out to her. I feel bad for her. Its a terrible tragedy all around. So everyone made the assumption that the two were connected, right, and you said the officer that shot brown, right, officer Darren Wilson had no idea brown was the one who robbed this store. The initial contact was simply he was coming from a sick case, saw two young men in the street blocking traffic and pulled up and asked them to get onto the sidewalk and as he passed them, i guess thats when he might have seen the evidence and connected it. But his initial contact was strictly pedestrian. What do you mean seen the evidence . There was a broadcast about a stealing and cigars stolen, couple boxes of cigars. When he initially confronted him or encountered him, it was just to get out of the road. Right. Lets talk about darron wilson, 26 years old, have you spoken to him since the information came out . Yes. What . He was aware it was going to happen and as a matter of fact, he was okay with it because it was something that felt may calm things down if his name was released. Is there some release some relief of the release or he did not want his name being released . He did not want his name released. He was okay with it if it would help. For people who say that you, they talked about transparency, the people in the community wanted transparency and wanted the name and how many shots, where he was shot. For people that said you waited far too long to do that, what do you say to them . Right now its five, six days later and you have everything, everything that i can release has been released, everything youve asked for has been released. There is nothing more that i can do. At the press conference we watched today, you seemed to get a little flustered. Is that because youre tired. I was looking for the word inflammatory. Ive been there. It happened to me today on a live shot. What is this like for you . Its heart breaking what happened to the community and the family thats suffering that loss. This is just the worst thing that ive ever seen in my career all around. Speaking of your career, do you think youll keep this job . Thats not my decision. Ill stay here to make sure we work through this and i want to be part of rebuilding the communit community, yes, i want to stay. Do you think you can regain the trust of this community . Yes. And the police can, your officers . Yes, i believe that. Do you regret at all releasing the information, the videotape on the same day as the officers name . I didnt want to release either one. If you could do it all over again. As you know, our thinking is if i have to release this tape, its really going to be inflamma the tory if i release this tape and not the name. If i have to release the tape, well release the name and that was our thinking. I dont think there was any good way to do it. Thank you. Okay. Not everybody is buying that part of story. Lets bring in your panel now. Im joined by mark geragos and then neal who is a general counsel for the st. Louis Police Officers association, Marc Lamont Hill. It is very loud behind me and its quite frankly a celebration mode here right now for some people. So just so you now, thats what youre hearing. Marc lamont hill to you first, the release of this officers name, the same time the surveillance tape is released allegedly showing a robbery by Michael Brown, you say it is convenient timing. What do you mean by that . Weve been asking for the name to be released for a week now, six days. We want to know who this officer is. They have protected it, covered it up. When they released it, they released this videotape, which it seems to me is trying to divert our attention away from this officer. We should be talking about someone who may or may not have stolen cigars a few hours prior. This is a slide of hand trick. So, mark geragos, it doesnt matter what happened before this, what may have precipitated the shooting of the officers, the officer at least looking for Michael Brown and his friend . It absolutely does, don. The officer, you can see what is evolving here and i use that word charitably. They are creating a defense. They kept the officers name kind of under wraps. The defense for this officer is going to be that he pulled up to get this guy out of the road, get michael out of the road, that he drove past, that he then saw the cigars, mind you, none of this was put out by the chief in the first press conference, and that then this idea, the suggest is going to be you saw in the video where Michael Brown was pushing the store clerk, well that was the same thing that happened with this officer that Michael Brown was pushing against that door as the officer was trying to get out, that thats going to evolve. I will guarantee you until he was reaching for the gun. When he was reaching for the gun, there was a struggle and then he at some point my prediction is the officer is going to say that he thought he saw Michael Brown reaching for a weapon and thats why he fired. That is going to be mark. Thats the script thats going to be told. That script was told from the very beginning when the police chief came out and said there was a tussle for the gun in the car. So i think youre right on about that. Neal, i want to say last night on this program, you said you were admittedly against releasing the officers name at this point because of safety concerns. What do you think now . Well, what weve got is a situation where they said release the name, release the name. They released the name. What questions did that answer . Now i do now from my own sources, there are people out in front of his house. There are people out in front of his parents house. What did that accomplish . Nothing. What we got again is a situation until we have all the of the information, how can you analyze this case . Mark, you and i are in agreement tonight. There is absolutely a situation where this is relevant. This tape is something that has to be looked at in the whole timeline but again, again, predictions and guarantees and promises, none of that means anything until we see all of the information and i think it was but neal i think it was remarkably insensitive to release only part of it because it only produced more questions. It didnt answer any questions. Under missouri law thats my question to you. Hang on, hang on, though. Sure. Do you find it a problem that the chief chose to put this tape out and then talk about this robbery at the same time and then not really clarify it in the press conference because it had most people at home and journalist thinking that the two were absolutely connected when it turns out they were not. Well, i do think they are connected. I dont think you can say that. You have to look at connected in a sense that the officer yeah, he said it wasnt. No, no, no hes saying the officer did not know when he rolled up on them be careful, though until he saw the cigarettes in Michael Browns hand. What im say sg be careful to put words in the Police Officers mouth because we havent heard from him and we wont until the reports are released. But neal, neal, the first right. Youve had the chief out there the first day, the chief was telling me on the first day what the officers statement was. He was the one who went out and said that on day one. And let me tell you something, that this lets stand by. I want you to the hold that thought because i need to get to a break. Well continue the discussion after this break and get a live report from here in ferguson on what is known about the Police Officer who shot Michael Brown. Well be right back. Were going to continue the conversation that we were having just before the break about the officer involved. First, some background because his story has gotten lost today. Ed here for us with the story. Ed, you went to the street where the officer lives. What did you find out about him . It was interesting, don, a lot of neighbors were reluctant to speak with us and were very worried in the attention in the neighborhood would bring bad things to the neighborhood. We did learn a couple things. They say they didnt know what was going on but in the moments and the days right after the shooting last weekend, they started noticing a heavier Police Presence in their neighborhood and residents put things together this might be where the officer involved in the shooting, Darrin Wilson lived and couple neighbors said a couple days ago they noticed Darrin Wilson left the neighborhood and havent seen him since. Do they talk about people, about safety . Were they concerned for their safety or for his safety, ed . Weve heard a lot of that. A great deal of concern for his safety and i think the few residents that would speak with us there in his neighborhood and this is a neighborhood, another st. Louis suburb about 25 miles away from ferguson and they were concerned that somehow there would be retaliation in the neighborhood and that sort of thing. From the few people we had a chance to speak with, thats what we heard from them. All right. Ed, thank you very much. So back with me again, my panel. So neal, it doesnt sound like a lot is known about officer wilsons time at his previous Police Department job and that was in jennings. That department is nonexistent anymore. We dont know why he left that department. Doesnt getting his name increase the chance some member of the public might know something if he has a record that should be highlighted . Let me tell you something. If you think getting his name out there enhanced it, i would ask where those people have been for the last week. There is no way in the world, unless they have been on another planet, they havent been paying attention. This isnt going to bring anybody out. This got so much attention in the media, anybody that was going to come forward is coming forward and not just talking about this officer, they are talking about every ferguson officer. There was question why is the chief doing what hes doing. This investigation is now being done by st. Louis county. Ferguson is for most purposes is really out of the picture. So again, in terms of the officer and his history, as i said, none of that should come out. That answers no question. This is to satisfy a blood loss and answers no questions. [ overlapping speakers ] yeah, i was go ahead mark geragos and then Marc Lamont Hill. I was going to say, neal, as we said last night, there is a double standard. If there were a civilian, it would be announced immediately and the police would say this is a person of interest, anybody in the public that has information, we want to hear about it and they would use the public as a tool, Law Enforcement tool and thats what they say when they announce it and i defended, as im sure you have, many a person who was never charged but came under that cloak of suspicion that Law Enforcement focused on them by announcing their name. So it is a double standard. The Police Officer should get some kind of heightened level of protection that anybody else in the public hang on, neal is beyond me. Hang on, neal. Let Marc Lamont Hill get in. He said what i would have said. Again, i dont want anybody to be in danger and if there is a sense of this officer being in a heightened danger, we should be aware of that. Its stunning we protected him for six days and when its released, we cloak it with the victim. Its not on the officer that shot the unarmed kid but targeting this young man this conversation about the videotape. Exactly. Let me let me respond to what mark said. Im not advocating a double standard. I dont believe a Police Officer should get more or better treatment than anyone else. They should get exactly the same, however and i dont recommend substandard treatment, either. A Police Officer has the same rights as everyone else. This isnt a question of were releasing everything. His name will come out. Under missouri law when the criminal investigation is done, Police Reports with all the information gets released, were just not there yet and there is a process you have to go through to get there and thats a process this requires these reports. Before we speculate any further, we should know what the ballistics report says and the mes report says. Those are things are things we dont have. I want to hear the 911 tape. When we say he didnt know, if there was a report of a robbery and made to 911, a dispatcher put this out over the air. These are things neal, they have put that out. There is so much happening here in ferguson, a lot of news breaking with the release of the Convenience Store video and the name of the Police Officer that killed Michael Brown. We wanted to take a moment and just focus on who Michael Brown was, a young man whose life is now over at just 18 years old. Jason carroll is here and he has that part of the story. Its important to focus on that. There are two narratives, one that the familys building, Michael Brown was a bighearted lovable guy gunned down by police and a second narrative coming from police he was allegedly involved in a strong Armed Robbery before he got into the altercation. The first moment Michael Browns parents faced the public to talk about their son, they wanted to make one point about him very clear. I dont want no violence, we dont want no violence. Because michael wouldnt have wanted no violence. Not helping, these images of the person seen on this Convenience StoreSurveillance Video captured less than an hour before browns fatal altercation with a Ferguson Police officer. Instead, these are the images browns family says reflects who he really was, a young man that loved playing games as much as he loved his family, telling a friend on facebook, if i leave this earth today, at least you know i care about others more than i cared about myself. He was my first born. Sweet, loving, dedicated. He worked hard to get through high school and we are so proud of him. His nickname, big mike. He was 64 and weighed nearly 300 pounds. He was a big guy in stature, but when he opened his mouth, he had a very, very quiet soft spoken voice. He was a gentle giant. He was big, he was loving, everything. I loved everything about this young man. Police say Dorian Johnson was with brown that day at the store. Police also say they are not charging johnson with allegedly committing a strong Armed Robbery stealing cigars. Donovan was friends with brown and on the eddington was friends. He didnt rob nobody. He wasnt that type of person. How can you know that for sure . I used to hang, went to school with him. He was a classmate of mine. We played on the same football team. He aint that type of person. Reporter browns mother says she will continue to fight for justice. Just because my son is a 64 black male walking down a city street does not mean he fit the profile for any anything other than just walking down the street. Well, its very clear which narrative the people out here are following tonight. The demonstrators are continuing to voice their anger, continuing to have their voice heard. Right now my colleague don lemon is in the middle of it all. Don, tell us what youre seeing from your vantage point. And jason, the reason you talked about Michael Brown and who he is, the reason that all of those people are here is because of him. And the reason that Convenience Store that you see, the qt, that it was burned out is because people were upset because they felt like an unarmed teenager was gunned down. Of course, people out here holding up those signs. This was a very busy, viable, and vibrant Convenience Store one week ago. Let me show you what is going on here. You hear people saying no justice, no peace. This young lady holding up her hands, saying hands up, dont shoot there is a drum circle that is going on. Lets quickly get through here so you guys can hear me there is a drum circle going on here. People are dancing. And as i mentioned earlier on the program, there is a festive atmosphere happening here as well as one, pardon me, sir, of one of seriousness. So under the awning here where people are usually pumping gas, thats more where people are being festive. Out here when you get closer to the street, it becomes much more serious. You get much more chanting. And this is where people are driving by. People are holding up signs that they have been doing for at least six nights here in ferguson. Young ladies, young men, people of all different ethnic backgrounds coming out, really, to lend support to the family members of Michael Brown. And also saying theyre tired of feeling as if they are intimidated or theyre under occupation. Why are you holding your hands up, maam . For justice, for mike brown. Justice and just to represent just the people and how peaceful we are out here. Were having a good time in the name of mike brown. There was some concern that there would be some violence out here this evening because of the releasing of the videotape. And no violence. No violence. I was concerned too. I didnt want to come. But im glad i did. Its history in the making. I love to see all these people, all races united. Its history. I love it. If you havent been here, get here. What would you like the country to know about ferguson and to know what about youre dealing with and what youre going through . Its tragic that it happened. I want everybody to know its not a race thing, its a right or wrong thing. Everybody needs to come and get unite and work on justice for mike brown. Thats the main issue. So that action that the officer Darren Wilson committed the other day, he should have been able to show more restraint because he is a trained officer.
