Middle of the pandemic pp that case comes one week after election day. Tonight dr. Anthony fauci revealing the white house is pivoting away from getting daily briefings, at Todays Supreme Court event there was no social distancing. And few masks. There you see them, hhs secretary alex azar was seen mingling without a mask, despite urging people to take coronavirus precautions seriously. Were monitoring the scene in louisville ken den where police are telling protesters out in defiance of a citywide curfew to disburse. Protesters are not letting up there well get to all of that, lets start with President Trumps rally right now in pennsylvania after he announced his Supreme Court pick. How is the Supreme Court nominee playing in this crucial swing state. Theres no doubt this crowd which is a key swing state nominating Amy Coney Barrett to the Supreme Court. The president should move ahead and nominate someone and have that person in place before the election, and when President Trump talked about Coney Barrett here tonight. It was wrought with enthusiastic cheers, take a listen. Ive just come from the rose guard ing at the white house, where i proudly nominated judge Amy Coney Barrett to the United States Supreme Court. Judge barrett is a brilliant legal mind and extraordinary scholar, you know that. Number one in her class. You know, they the professor, one of the most respected people, said the greatest student hes ever had. Thats pretty good, thats a little better than biden, won the you say . She should be running for president. It did not take long to dove tail into the campaign apparatus. The doors were open two hours before the president arrived. The crowd cheering in a big way to Coney Barretts nomination. 10 million in digital ads that are going to blanket social media. Theyre changing up the script that chain volunteers are using when they make phone calls to emphasize Coney Barrett and the fight she has ahead of her in the United States senate. There arent too many people who feel the coney nomination will be all that difficult. They view the fight over the Supreme Court a key part of his electoral victory in 2016, they want to remind conservative voters this time around. The fact that they can replace a liberal icon with a conservative like Amy Coney Barrett. A big part of that sales pitch to voters, particularly conservative voters who make up the trump base. Ryan nobles in middletown, pennsylvania. Thats the mood tonight on the republican side. Chuck schumer warning this evening, in his words just about every american will be hurt by judge barretts views. Justice ginsburg must be turning over in herchose seems undoing all the things that ginsburg did. I will strongly, strongly, strongly oppose this nomination. And we have this from joe biden. President trump has been trying to throw out the Affordable Care act for four years, republicans have been trying to end it for a decade. Twice the u. S. Supreme court upheld the law as constitutional. Judge Amy Coney Barrett has a track record of disagreeing with the Supreme Courts decision. She critiqued john roberts opinion upholding the law in 2012. Lets begin with ron brownstein, also with us our senior legal analyst. Good to see you this evening. Following todays announcement, this is all weve been hearing from democrats, theyre really zeroed in on health care and the future of obamacare, why do you think thats their strategy. There is a National Majority that is in favor of legal abortions. Even a state like pennsylvania despite all the cheers, theres a 56 majority in favor of legal abortion. Thats not as consistent across the battleground states. A pro choice majority as is support for the Affordable Care act. That is an issue on which democrats hold the high ground in every state. In a state like North Carolina or georgia is much more closely balanced. I think the statement from biden like the statement from harris, and like many of the others we heard. Democrats are going to focus on the threat that barrett poses the fact that a case is coming to the court a week after the election, to the aca, and as a reminder, that was the point of the speer. The single most powerful issue for democrats in the 2018 elections, promising to protect those elections in the aca. The president has made it clear one of the main reasons he wants this nominee to be confirmed, he sees the Supreme Court as playing a role. In deciding the election, should there be a contested election. Now you have democrats who are saying theyre going to push for her to recuse herself if the election outcome does end up in the Supreme Court. Do you think thats necessary . Of course, the president is assuming that the Supreme Court would be helpful to him, he misconceives what the Supreme Courts role was in bush versus gore, it wasnt about the way hes had a months Long Campaign of trying to undermine the integrity of mail in ballots or whether we can have some confidence in the way the votes are tabulated. Their role was far more specific. It was recounting certain ballots versus other ballots. I think he already misunderstands fund amtly what the role of the Supreme Court would be in that case. Its hypocritical to think were going to have nine justices now, when the last president ial election when he was the victor only had eight justices until he was able to have one go under the advisement and consent of mitch mcconnell. He already fundamentally misperceives what the role would be, having said that, his role has been about roe v. Wade as the precedent to overturn. Now hes trying to keep the precedent of bush v. Gore going. The president s message has been to set the stage to dispute the election. Hes gone to far as to say, the only way he loses is if the election is rigged. Hes refused to commit to a peaceful transfer of power after the election. What do you think were in for. Hes fueling it with gasoline and throwing matches on it every day. It is possible the time between the election and inauguration could be the most fraught since abraham lincoln. The president not only does he ov overly have an overly expansive view of the Supreme Court. He doesnt understand how difficult the situation becomes with the Democrats Holding the house and maybe the house and senate. Republicans held both chambers of congress at that point. And it limited the democratic options, the capacity of if the president can go to the ultimate nuclear option, to send their own electors to washington that you cant trust the official results, the ability of democrats in the house, to say no to that, if they have the senate to say no to that, it does change the potential for the Supreme Court to wray in here. Miele try to use the court to stop the counting of ballots. That may be difficult, the fact that democrats hold the house give them much more leverage than Many Democrats are fearful of at this point as they listen to the president s warnings. This could end up in an ugly legal battle. The American People reasoning the going to be shut down in this election. Theyre going to vote and theyre not going to be denied. Im confident all the irresponsible outrageous attacks on voting will have the response it always has. Do you think hes brushing over this, maybe a little naive to think of it in that way . Maybe a political optimist instead, thinking the American People and those who are part of the administration or republican members of congress would adhere to the norms of when someone loses an election, and they vacate the position. I share bidens confidence at least in the idea of their being integrity based Voting Rights here. We did not see at any time, widespread voter fraud. We saw ballots that were mailed to uniform and overseas businesses. On the battlefield. We can get them to voters at this point in time. We saw a process by which you were able to tabulate votes on election day. Whether it be provisional ballots as is the case and other places around the country. I share the optimism that the voters can get it done, and electoralism can function. Hes speaking to hes looking to the people who say, hold on, do i believe the sort of facebook postings, do i believe that there should be some reason and cause for concern. A post election day tabulation mean a fraudulent election. It has not meant that up until now, why would it be the case now . President trump said so. That cant be enough reason to undermine all that weve seen for decades with election what you. Im glad you point that out. That is where i was getting at, which is the point that we already know his messaging is working among his supporters. We shared the report with donie. This idea that people are going to accept the results, as much as we think they should, we know the process is legitimate. There is no widespread flawed when it comes to voting. The president is working hard to sow doubt in peoples minds. It almost feels like, ron, that were living in a time of almost like an episode of the west wing, to the point that the shows creator, aaron sorkin was asked, how he would drum ties the outcome of the election, and just note, he made these comments the day before trump actually was asked about committing to a peaceful transfer of power, and the firestorm that that sparked. Heres what aaron sorkin said. If i was able to romanticize the whole thing, heres what would happen. Donald trump would do what we all assume hes going to do, not concede defeat, claim the election was rigged, the democrats cheated. However, for the First Time Since the man was sworn in, his enablers march up to the white house and say, donald, its time to go, you will not ruin this country, you will not start a civil war. If he refuses to accept the results and he tries to stay in power, what do Republican Leaders really do . I think its really unclear, there are comments this week that are very revealing. They said, there has to be a peaceful transfer of power, they didnt criticize the president , they did not sanction him for openly extorting a Foreign Government to manufacture dirt on an opponent. Theyve not raised an eyebrow for the first time in american history, hes trying to manipulate the census to benefit one party. They havent complained about the postal service, about him intervening in criminal cases, theres no history of them showing any willingness, any of them, beyond maybe mitt romney or Susan Collins voting no on the aca, really, except for that, very little willingness to constrain him in any manner, you say you can say, well, of course, this will be a bridge too far, i guess i will wait and see. I think if it is close, there is the potential for a lot of republicans going down the line with him and trying to contest and undermine the results. Right now it doesnt look like it will be close enough for that to get off the ground. There are five weeks plus away from the election. I missed you both, i havent had a chance to talk to you in a long time. Exactly. Have a good night, guys, thank you. Thank you. It followed a rose garden ceremony this afternoon that weng the against cdc guidelines. Dr. Lena wenn is with us now. When you see these images from tonights rally or earlier from the rose garden ceremony, whats your reaction . Im very concerned, if i were to custom design a super spreader event. This is what it would look like, a lot of people coming from many parts of the country gathered together, no social distancing, not wearing masks, and in fact even flaunting this Public Health guidance. Its not just what they do during the event. These individuals are probably also not following Public Health guidance outside the event. Theyre returning home to wherever they came from, and spreading the virus to other individuals. Hold that thought about bars and indoor gatherings, im going to come back to that in a moment. I have to get your take on seeing alex azar today. He wasnt wearing a mask. He was fist bumping, in close contact with a lot of people at this event. Hes supposed to be one of the leaders of the pandemic response. What goes through your mind seeing this image . Theres the obvious, that he should be modelling the type of behavior that we expect everyone to have at this point. He represents all the agencies that fall under hhs. The cdc, the nih, all of these top scientists and Public Health officials, whats going through their minds as they watch the leader flaunt the advise theyre giving. He has a responsibility to represent that publicle th guidance to the president. This cabinet secretary in charge of health and Public Health is not following these very guidelines. The state of florida has the third highest case count. The governor is going to allow restaurants and bars to reopen, no state restrictions, and he also mentioned he wants a full Super Bowl Party by february. Is florida in a good position to take this next step . No. And lets remember where florida was just a few months ago, florida was in the position of having icus being filled. Hospitals having to divert patients to other locations and really in a crisis mode. Im glad that florida got out of the crisis mode. They should remember were heading into the winter season, when we could be seeing the confluence of covid19 and influenza, this is the time for us to be reducing these high risk situations as much as possible. Now we know that indoor bars are some of the highest risk places. It really is not going in the right direction. Its quite an irresponsible decision that Governor Desantis is making. It is the first time a high number of patients tested positive. New jersey also. That tells us we have to be on guard, covid19 is with us. This is a highly contagious disease. And these games that we made are very hard won. And so we should not be looking at opening, closing the economy as an on off switch. This was always meant to be a dial. You should be looking at what are the restrictions we need to be bringing back. Which is difficult for people to hear. We are losing still almost a thousand americans every day. And heading into cold weather where there could be far more infection coming our way. We should be doing everything we can now, wear masks, physical distance, keep up our guard. And stay strong. We have to keep at it. Thank you so much for your time. Thank you for all you do. Contact tracing revealing just how far the coronavirus can travel. Listen to this, a Summer Wedding in a tiny town in maine turned into a super spreader event. At least seven deaths have now been traced back to this wedding. A celebration they didnt even attend. Randi kaye has the story. It all began with an august 7th wedding which hadnt seen a case of coronavirus until now. As the couple celebrated i do, the virus was on the move. The virus favors gatherings, it does not distinguish between happy events like a wedding celebration or sad farewells like funerals. It is yev where. Everywhere indeed. 32 guests and staff were infected from the Wedding Service in east milanokic man and the inn. From there, contact tracers tracked the spread hundreds of miles away, including the Maple Crest Rehabilitation Center and the Calvary Baptist church in sanford, even though 62 people attended the wedding, there are now at least 177 people infected with coronavirus. And at least 7 dead. None of those seven individuals attended the wedding or the reception itself. There are now at least 39 cases of the coronavirus in madison, including 24 resident thes and 15 employees. Six residents have died. Maine cdc determined an employee from the center lives with someone who attended the wedding. The virus likely travelled from guest to household member to the maple crest rehab facility. Keep in mind this facility is more than 100 miles away from the venue. This woman did not attend the wedding, but tested positive. It was a selfish act that could have been prevented with a little more humanity and empathy and compassion for others. Our numerous calls to the rehab center were not returned. At the york county jail about 220 miles away from the wedding site, at least 83 cases, including 43 inmates, 19 people that work in the building that houses the jail and some of their family members. Maine cdc traced the outbreak to a jail employee who attended the wedding and brought the virus to work. All this started with someone who was asymptomatic. Prior to the august 7th wedding and reception, there had been no reports of positive cases among those in attendance. The venue Spokesman Says all guests had their temperatures screened. The virus also spread from the festivities to Calvary Baptist church in sanford, 345i7b, the cdc confirms 10 cases there, and says Church Members attended the wedding. That churchs pastor officiated at the service. He did not returning our calls or emails. Before this, pastor bell preached against wearing masks. This is the fourth night of demonstrations since a grand jury decided not to bring charges against the officers for the killing of breonna taylor. Shimon, earlier we heard that warning from police to protesters, it looks like they responded. They did. The police made several announcements. One of those, while we were on the air at around 8 30, telling protesters there was a curfew, and if they werent going to leave, they were going to be subject to arrest. And again, they made another announcement at 8 45 telling protesters to leave. And then all the protesters gathered around and they left. They left the park after vows for hours they would remain in the park in a potential face off with police, they all left. Moments before 9 00, the police started moving in, they moved in their heavily armored vehicles, National Guard troops came in, by that point the park had cleared, the police made an announcement that the park was closed. A lot of the protesters came to this church behind me, which has been used as a sanctuary, the church has allowed the protesters to come on their property past 9 00, so they could avoid arrests. Certainly a tense night avoided here, any kind of confrontation with police so far has been avoided here tonight, anna. Were just a few days away now, from the first president ia donald trump. Biden leads trump nationally in the polls, the race in the battleground states is much tighter. According to a new poll, florida and arizona are in a dead heat. The latino vote could be the key to victory. Especially in those states. Maria hinojosa joins us now. Shes an Award Winning journalist. The ceo of the futoro media group. Wungsz i was you, a memoir of love and hate in a torn america. Maria, its so good to have you here. I want to ask you about the latino vote. What are you seeing and hearing is the biggest motivator for latinos heading to the polls. Its hard to generalize. Were being attacked by one of the chains kind of consistently, that would be the administration, the trump administration. Theres also a sense of invisibility. And theres massive complexity. In terms of florida, Central Florida is a really important for the latino, latina vote. You would think it would be a progressive vote because theres so Many Puerto Ricans leaving the island after the hurricane. Theres a lot of antiabortion work right there in terms of the evangelical vote. Thats up for grabs, in terms of the south for the west, for example, we know that Bernie Sanders did really well there, he carried nevada with the latina vote, theres a votes that anxious for a much more progressive radical stance on all kinds of things whether health care to immigration. On the other hand you have latino moderates in texas, who im hearing are concerned that theyre saying that theyre concerned that biden might be too socialist. Its really broad, but what does have to happen is that the Biden Campaign needs to be doing massive outreach in these 38 days, so that the latino voter feels like theyre getting attention, right now i dont think thats the sense they have. Its interesting you say that, because i spoke with don leguizamo recently who said something similar, showing you care to the latino population, latinos are loyal, but you have to show your commitment to them, and theyll be loyal to you. Theyll ignore you. We know the president has paid attention to latinos and hes been trying to drive home this message. He spent a lot of friday in doral florida. The president is doing pretty well among venezuelan and cuban American Voters in miamidade specifically. His campaign has called biden a puppet to the castro drawing on that antisocialist anticastro sentiment. Biden is reacting this way. Listen. Trump is using socialism to distract floridians to a failed pandemic. Hes embraced dictators around the world, its ridiculous, i think people see very clearly the difference between me and donald trump. Trump is a trump is clearing protests in front of the white house that are peaceful, with the military. This guys more castro than churchill. Do you any that is an effective message with latinos, to combat trumps strategy tieing him to castro and maduro . It is effective. You have people who left cuba decades ago, who are in this ptsd reaction, and when they hear this, hes going to take things away from you, they get into that ptsd, and its very difficult. But again, you have to understand that theres another side of the latino electorate that is actually much more supportive of socialist ideas. Because as you started, anna, they got in touch with latina voters. I was talking to latina voters in nevada and south carolina, and they were and texas, we heard from tio verde, door knocking and text messaging. You cant blame the voter. You have to actually go and get that vote. This is transactional, these kinds of politics. Ive been covering politics for several decades and its always the same thing with the Democratic Party and the republican party. Except that maybe this time with the republican party, theyre going after that latino male vote that kind of can identify with an authoritarian stance like interrupt. They can identify with that which frankly is quite worrisome. I have to ask about your book, once i was you, you write about your own familys experience immigrating to the United States in the 1960s, you were just a baby, the youngest of four children. Family separation almost happened to you upon entering the u. S. , that has a scary connection to whats taken place during the trump administration, that was the beginning of your american story. Why did you decide to tell your story now, and what kind of impact do you hope it has . Anna, when i first found out that the story of my arrival, i was already in my 30s, what i thought had happened was that my mother just stood up to an immigration agent who was not being quite nice. It was my mother who calls me in the midst of the crisis of the children being taken when were hearing the voices of those babies and toddlers screaming, and it was my mother who said, my god, i would have been that mother. I said, what are you talking about . She said, you could have been one of these children. That immigration agent tried to take you, the year was 1962, i was in the Dallas Airport arr e arriving with a green card. There was a policy to look at mexicans and their bodies, and if we were considered dirty, we were taken. In this case, they were going to put me into quarantine. My mother stood up and owned her voice, thats what she had, it wasnt that my mom was speaking up, she told me, it was fight or flight. And she said, all i had was my voice. I have to tell you, anna, to discover this i was quite shocked. It was very very sad. And thats one of the reasons why i wanted to tell this story, we all have our arrival stories in this country. Whether it was 50 years ago, 10 years ago, a year ago or 100 years ago. We need to tell these stories with all of the fullness, the sadness, the happiness, the trauma. These are american stories, they are a part of our history, and theyre a part of who we are, and were so much more like each other than not. Thats beautiful. Maria hinojosa, thank you for being with us and sharing your story, and helping us sort through what we can with this election. The latino vote should not be taken for granted. She was a liberal icon, and she had a unique ability to bridge the political divide, including through an unexpected friendship. Susan malvo brings us that story. It was a love of music that brought them together. This is the two of us coming from an opera dinner. An unlikely friendship between seemingly polar open sifts. Eric mottly and ruth bader grinz burg. I was a black young man, just turned 30. Ruth bader ginsburg, this jewish intellectual urbanite, who had been appointed to the Supreme Court thrown together by surprise and seated next to Ruth Bader Ginsburgs husband martin who quickly learned of their shared passion. I love music. He got so excited, my wife and i love music. I said, im listening to bachs variations. He said, oh, my god, you have to meet my wife. He called her name across the table. They became fast friends, sharing their love of opera, history and music. Little did i know that would inspire a 17 year relationship around music and ideas. Ideas that sometimes clashed but led to a better understanding between them over issues around race, opportunity, and public policy. The notorious ruth bader ginsburg. The two also shared a personal joke, when would eric the eligible bachelor tie the knot. In her demanding voice, its about time. When eric found his love hannah, ginsburg offered to officiate their wedding. She said what do you mean go to the courthouse . I have the legal right to marry you. As the preparations were made and the excitement was building, ginsburg kept eric in touch of herrion going cancer treatments. Three weeks, daily radiation, with appreciation and love rbg. Eric got a surprising call two days before the scheduled ceremony, she would need to postpone. I was a bit numbed. On the scheduled day of their wedding, eric got a call from a friend. She said, weve lost ruth, and i pulled over on the side of the road and composed myself. It was friday september 18th, the evening was to marry eric and hannah when she died. All the emotions of losing a friend and feeling that at that very hour we would have probably been in the house. Eric and hannah joined hundreds of others at the Supreme Court. At the bronze door we left a single white rose. Eric left struggling to figure out what ginsburg would want him to do next. Im really struggling with where we are right now as a society. The issues of equity in this country, the challenges around race. Eric is determined to take ginsburgs advice, to never give up, always move forward. The wedding license with officiant Justice Ruth Bader ginsburgs name on it, now stand as markers of a moment. They also stand as a reminder of a beautiful friendship and a remarkable woman who would only want us to get married, to find the date as soon as we can. And to just get on with it.
