We know for a fact that previous rallies, trump rallies in tulsa and minnesota, because of contact tracing, have directly led to infections, perhaps even death. How worried are you about the president s plans to hold these rallies, multiple rallies across the country . Jake, this is even beyond asking for trouble. This is very selfdestructive and actual destructive behavior in terms of what they are doing. The Trump Campaign says that attendees are giving temperature checks and access to hand sanitizers and masks are available, although they are not required. If these events are going to keep happening, what measures would you like to see that would make you more comfortable that they dont serve as super spreader events, as fauci referred to that White House Supreme Court event a few weeks ago . Well, ideally you dont hold inperson events at this point. The numbers are going up and going up pretty precipitously. We were just at 35 thousand now new cases a day a few weeks ago and now over 50,000 and we are seeing this really serious rise in the Northern Midwest states, up in wisconsin, in the dakotas. Really across the north into montana and its just a matter of time before we now see this terrible fall and winter surge. This is going to be a horrible winter, jake. We may see numbers that wharf was we saw in april and the summer and i think we will see a rise of mortality. This will be one of the most troubling times in our modern history in terms of the public being frightened, Homeland Security being affected, people worried about going outside as the deaths mount. Yet, the president seems oblivious to it and the White House Campaign seems oblivious to it. Its as though they have no understanding of what is in store for the American People beginning in november and december and january where we could be reaching 400,000 deaths in the week after the inauguration no matter who wins. We are talking about a doubling now of cases during this lame duck period if that is what it turns out to be im sorry, doubling of deaths. Doctor, i know youre in texas where the rate of infection is going up and the rate of hospitalization is going up. What is going on . Lets keep it specific to texas. Why is the virus continuing to thrive in texas . Well, i think texas is actually, in some ways, doing a little better now in part because people are outdoors now. The weather is getting somewhat nicer. Where we are seeing the really steepest rise are up in the northern states. I think two things are happening. People are indoors more and, therefore, in the colder nights and, therefore, people are coming in to contact. But the other thing that happens is in that cold weather and the cold dry weather, the virus survives better. Its one of the reasons why it appears to be likely to be a winter virus as are many of the coronaviruses. Another piece to this. With that increased amount of virus, the dose of virus youre getting is higher. If you remember back in march and april in new york, the mortality rate was sky high. And initially i thought, many of us thought that was because we were learning how to take care of patients in the icu, we werent putting patients on medicine and ko ago atlantas and learned from that. A couple of papers showing out in the cold weather the dose of virus is higher and people are exposed to greater amount of virus and dying because that have. Not only do we anticipate a fall and winter rise in the number of cases, im worried about the deaths significantly going up and this is really keeping me up eight night. The president s doctor said President Trump tested negative for covid on consecutive days. I think it was that less reliable test, that one test but not the other one. Just as a general principle, is it safe or responsible for a 74yearold man who just, days ago, had a fever and needed supplemental oxygen because of coronavirus to be on such an aggressive travel schedule . If you were his doctor, would you be saying youre fine, youre out of the woods, go do what you want to do . No, absolutely not. Remember, he was having a pretty rapidly deteriorating course in terms of fever, low oxygen levels. We never got a full story out of the white house physician team. But it looked like he was starting to deteriorate and maybe that the antibody that he got really made a big difference. But, you know, if you remember, he was visibly short of breath standing on the balcony there. This is not somebody you want out and about on the campaign trail. Then there was a lot of worry whether he was actually still transmitting the virus. Remember there is no margin for error here because the president is interacting with so many people, he is surrounded by people. As he says, he now wants to start kissing them. Generally when youre doing a Clinical Trial of an experimental product and there is a pause it means someone in the trial has gotten sick with something. Thats all it means and it needs to be investigated. We dont know if they were receiving the active drug. That is something for the people overseeing the study the data safety monitoring board to look at the results and see whether the person who got that product was actually sick from it and then to make an assessment about whether to go forward. Its a standard part of Clinical Research and one of the reasons its important to do these controlled Clinical Trials. President trump got emergency humanitarian use of that regeneron antibody cocktail, more than one antibody. I think a couple that was mixed together. He was only one of ten people outside of the Clinical Trials to have been given that. How related is the regeneron antibody cocktail to the eli lilly antibody treatment . Should President Trump be worried . They are related in that they are both antibodies directed against the virus. Other than that they have a very different molecular structure. So far we dont have a pause on the studies of regeneron products. I would say he is several weeks. Several days, right. Time goes by fast these days. I think we will see it as the covid19 vaccine and treatment search goes forward in particular because the research is proceeding at a breakneck pace. The key is really getting ahead of it and avoiding the kind of super spreader events that are triggered by having large gatherings of people close together. There are football stadiums having games but they are filling the stadiums at 1 8th capacity. There is a lot of responsible dipping a toe into the water kind of approaches tobl this bu the only super spreader events youre talking about people gathering together and no masks and no distance that i know about are President Trumps rallies. Well, youre not going to be surprised to hear this since ive speaking on what have of infectious decease specialists right now but we do not recommend people gather in crowds like that under any circumstances. But Kamala Harris is a prosecutor. She is known for these sharp questions and she even had a little bit of a zinger the last time we saw her in this setting back in 2018 with Brett Kavanaugh asked the now Justice Kavanaugh are there any government regulations that regulate male bodies . Well, she seems to be following ironically is rule of no preview, no president clinton, no inhints. She addressed headon roe v wade in 1993 made her views well known. She would not give her thought process or rational what her thought process might be going forward. The answer of what would happen if the president of the United States tried to delay the election . That is not as she called it for a legal pundit to opine over. Its an act of congress otherwise the president has no action and no basis to delay it and she wouldnt answer that. She almost abided by this principle almost to a fault and not showing her hand at all. Frustrating a lot of the democrats. Judge barrett would not answer about how she might potentially rule in future cases, including on the Affordable Care act. There is a Supreme Court hearing on that on november 10th. On roe versus wade. Did you hear any hints in her answer that might signal how she might rule . Of course, you can go not only her answers but her writings. The Affordable Care act a big discussion between herself and senator coons about this issue. The Affordable Care act she talks about i cant address those claims because when i wrote about these things, it wasnt about the nuance that is before the court. Think about it. Its not a nuance about the issue on the line. The entire act is on the chopping block. Any writing she may have said criticizing a strain as she called it or a not natural interpretation by Justice Roberts is relevant. That almost showed to me she was unwilling to admit, even what she had written on the issues of the Second Amendment she went to Great Lengths to describe her views on heller and revoilcoile senator Amy Klobuchar asking for further discussion. Lets dive into the oos Affordable Care act. She wrote a book review basically not as a legal matter but as just as journalism, almost, in which she criticized Justice Roberts ruling and the majority ruling that basically said the individual mandate was okay for the congress to pass because it was a tax. Her argument is that this the issue coming before the court coming up has to do with whether or not, correct me if im wrong, youre the expert here if something in the Affordable Care act is found to be unconstitutional, whether or not that kills the entire Affordable Care act, is that right . That is her argument . Yes. Its an issue of what is called sever ability. Think of in terms of a lizard who can drop a particular limb and scurry away. Can the actual Affordable Care act exist with a very fundamental limb or tail missing is in the the entire reason that Justice Roberts look at the Affordable Care act and said this is a valid exercise of by congress because of the taxing power of congress. As long as you have this tax mandated penalty essentially, you were exercising under your constitutional power. Well, the Republican Coalition of attorney generals have come back to say now the penalty is now reduced to zero, it is symbolic and not a tax. If that is the only linchpin that kept this alive and floating it can no longer be held to be constitutional. A week after the election the distort has it figure out whether removing this penalty is enough to validate anything and can it be a lizard that can scurry without without a kojs li consequence watial limb. He was much clearer about this during the primary when he says he opposes the idea of expanding the court. Some of his rivals were in favor of this and now he doesnt want to talk about it. He said yesterday in ohio he is not a fan of it but has not said he outright opposes it. The reality they do not want to get locked in a position on this and trying to keep the parties at bay here.
