Three minutes before chauvin removed his knee from floyds neck. The prosecutor in the case says he anticipates charges for the other Police Officers involved, this comes as new video of the incident has emerged. I want to warn our viewers this video is graphic. It appears to start earlier than the video many of us have previously seen. You can see in the video that it looks as though three officers are holding floyd down, not just officer chauvin. Cnn has reached out to the Minneapolis Police department and the floyd family about the video. We have not yet received a response. We will bring that to you when we get one. Lets go straight to cnns sara sidner, live for us in minneapolis. Sara, were learning more about what happened from the charging document. Tell us more. Reporter look, you had mentioned it, i just want to kind of go through a bit of it for you, jake, the new details were seeing from these charging documents. But these, you can count out yourself. It says his defendant had his knee, and thats the Police Officer who was fired, Derek Chauvin, for a full two minutes and 53 seconds, mr. Floyd was unresponsive and the officer had his neon hknee on his neck the time. The charging documents revealed what the medical examiner has so far determined although the autopsy is not finished. He has said, this is something the defense will likely seize on, there is no indication that floyd died of asphyxiation or strangulation, so no indication of asphyxiation or strangulation causing his death, but, and this is important, the combined effects of mr. Floyd being restrained by police, his Underlying Health conditions, and hes putting any potential intoxica intoxicants in his system, is the likely cause for mr. Floyds death. Derek chauvin, the officer seen kneeling on George Floyds neck, is accused of murder. Has been charged by the Hennepin CountyAttorneys Office with murder and manslaughter. Reporter prosecutors say the other officers involved are also under investigation and will likely face charges soon. This after overnight protests left the police precinct, the neighborhood, and parts of downtown in ruins. The pain is real. The chapter thats been written this week is one of our darkest chapters. Reporter Minnesota Governor Tim Walz now vogwing solidarity. The ashes are symbolic of decades and generations of pain, of anguish, unheard. Reporter the twin cities tinder box set ablaze monday by this devastating scene. I cant breathe reporter now new cellphone video, first obtained by nbc news, shows chauvin and two other officers pinning floyd to the ground. He ultimately died. Were also now learning chauvin and floyd used to work security at the same local nightclub according to the owner. We were all working on the same team in that sense. Its horrible to think at this point that chauvin would take the life of anyone that was associated with our nightclub. Reporter thursday night police say more than 170 minneapolis businesses were looted, damaged, or destroyed. Protesters also erupted in colorado, new york, tennessee, kentucky, arizona, and ohio. It is so stressful at times just to be black in america. I still tense up, because i dont know if this is the day. And its real. Its not made up. This is real. Reporter this morning the nation shocked at another arrest. Cnns own omar jimenez arrested live on air. Do you mind telling me why im under arrest, sir . Reporter he and his team were inexplicably arrested this morning. They were held for some 90 minutes. Governor walz now strongly denouncing their treatment. I dont care at this point what the circumstance was, why they were arrested. It was unacceptable and we need to correct it. Reporter i want to give you a look at the scene right now. I want to give you a look at the scene right now. We were here all night, as the third precinct went up in flames. The state patrol is out here, again, the same department that arrested omar jimenez. They are standing so that nobody can get anywhere near the third precinct. You will see the building there, jake, that has the boards up all the way down. And then you see the target sign. The third precinct is there. You can see the fence bent over. But there are folks gathering again, and let me just give you a view of the folks gathering again. Why are they gathering . They say, the officer has been arrested and charged, they want to see the other three officers arrested and charged. They do not feel like justice has been served yet, jake. All right, sara sidner for us in minneapolis, thank you so much. Joining me is former federal prosecutor laura coates, the founder of the organization for officer accountable, cnns van jones, and cnns sanjay gupta. Laura, were getting a glimpse into the charging document for now former officer chauvin. It says, quote, the defendant, officer chauvin, had his knee on in floyds neck for 8 minutes and 46 seconds in total. Police are trained to this type of restraint with a subject in a prone position is inherently dangerous. So help us understand how that affects the case against him. Hes being charged right now with third degree murder and manslaughter. For third degree murder, it is about a nonintentbased crime. Its saying although you did not intend to actually kill somebody, you acted with such a disregard for human life that it was essentially inevitable or at least foreseeable. Thats the context of a third degree nonintentbased murder charge. Why this is relevant here and what you described here as the amount of time, which is just heartbreaking and repulsive to think that a time transpired with this officers knee on this human beings neck, thats when the clock will start, from the moment of, if the person resisted in any way at any point in time. That moment in time, at the very least in that moment of time, when he was no longer moving, when he essentially was rendered completely submissive and nonresponsive, and to have 2 1 2 more minutes go on, that indicates this may actually be enhanced to an intentbased crime with a further investigation, number one. It will also show that reckless disregard for human life. And it also shows you about the officers position of his hand. You see from a lot of the photographs were seeing, the officer has his hands in his pocket. If youre intending to defend yourself against someone, are your hands in your pocket or are they ready to be able to repel any force against you . Hand in pockets, nonresponsivive person on the ground, prone position, handcuffed, begging for air, the clock starts there. It really undermines, perhaps fatally, any claim of selfdefense, number one, or any claim that this officer was not fully aware that his actions could kill someone and did. And sanjay, i want to get your reaction to a quote from the charging document. Looking into the medical examination, it says, quote, the autopsy revealed no physical findings to support a diagnosis of traumatic asphyxia or strangulation. Mr. Floyd had Underlying Health conditions including coronary Artery Disease and hypertensive heart disease, the combined effects of mr. Floyd being restrained by police, Underlying Health conditions, and potential int intoxicants in his system, contributed to his death. Im a layman, but even if he had alcohol or drugs in his system, it seems pretty clear that the precipitating event was that the officers knee was on his neck for nine minutes. Why include that other information . I think with these autopsies theyre trying to be as complete as possible with regard to providing all the medical information. Theyre not sort of designed necessarily to answer all the questions about the circumstances. So oftentimes, with these autopsies, they also say, we want to have you put it in the context of the situation. You have to put these things together. I dont see that paragraph as being incongruous with itself. They may not have found a specific anatomical thing that suggested strangulation. That doesnt mean it didnt occur. You add in the context of what actually happened and i think it becomes pretty clear. Jake, to your point as well, start removing some of these mitigating factors, he had an underlying history of heart disease, yes. His lab results may have shown some intoxicants in his system. But it was the precipitating event. Clearly those two things alone were not likely to lead to his death at that moment in time. I think thats another thing that medical examiners will say, take what were giving you you, apply it to the situation overall. And the charging document lays out some of the discussions officers were having while george floyd was pinned down. One officer asking multiple times if they should roll him over. Another checked floyd for a pulse. What kind of insight does that give you of what the other officers, who are not currently charged, may have been thinking about the situation . They knew he was in distress. Theres no other reason for them to ask those questions or raise those kind of concerns unless they clearly understood from what the victim is saying that he was in deep distress. It is good today that Derek Chauvin has been charged for the sadistic murder he committed on camera. The next step is for him to be convicted. If we want to see things toned down around the country, thats whats required. But these officers clearly understood what was happening to the man, as did Derek Chauvin. Van, many people say are saying that this one arrest is not enough. What changes now that this officer has been charged . Is there at least some relief that perhaps there will be justice . No. No. Nothings changed. First of all, i just want to be very clear. Ive been doing police misconduct, criminal justice stuff as an attorney, an advocate, for 25 years. This particular medical examiners report reminds me of the 1990s, where there was this thing called sudden incustody death syndrome. Things just got so sudden that the person died. It almost began to feel like a collaboration or collusion between Law Enforcement and the medical examiners to come up with stuff that kind of watered down the role of the police. If hypertension is going to become an excuse for what happened here, africanamericans including myself have hypertension at epidemic rates. Youre basically saying youre going to look the other way. Thats the danger, thats the fear that people have, when they hear that kind of medicalexaminerspeak. The medical examiner is of course just doing their job but it can be used and abused. Ive been in communication with people on the ground there. People feel badly about the idea that this is manslaughter and third degree murder. It may be the smarter move, it may be easier to prove up, and that may be the right course. But the way it has landed is a slap on the wrist already. The assumption is youre going to plead down from that and that theres not any seriousness about this. Also, the other officers are accessories. If you or i did what is being described, if you or i held somebody down by the neck and other people told us to stop, we would be accessories to an a cri crime. So no, this will not end. Thats why youre seeing the cry going up to let keith ellison, the attorney general, get in this. He has ties to the black community, they want the state to step in, they dont trust this medical examiner. There should be an independent medical examination by the family. Nobody will trust the d. A. Until we see all four officers in handcuffs and charges. The document says he was unresponsive, mr. Floyd, for almost three full minutes of about a third of the time that he was under the knee, his neck was under the knee of the officer. Presumably the officer would notice that he was unresponsive, which is baffling. It is totally baffling. We dont understand why that would be. He would have noticed it. There were people around that would have clearly noticed it. I mean, that was just obviously, blatantly disregarding what you are seeing right in front of you. I dont even have to say its baffling, it seems really, really concerning that that would happen and that no one else flagged it. I could hear that people were saying things, but i dont know if he wasnt listening or what, but it was clear that he was unresponsive. Somebody who is right there would have absolutely noticed that. And reddit, the charging document says the officers tried to get floyd into the squad car multiple times but he, quote, struggled with officers by nextly falling donext intentionally falling down. Would that be included as resisting arrest . Why would this be included in the charging document . You could articulate that thats resisting arrest. But you can never equate what you saw the victim do on camera to what the response was from the officers that ultimately took his life. There were multiple opportunities, it appeared to me, once he was under the control of all four officers, to just pick him up and put him in the car. He was expressing his willingness to stand, he was asking to stand. So i think that is really a nonissue and it doesnt mitigate anything when it comes to prosecuting this case. What i am encouraged by, though, what i see around the country, that weve had this conversation now running for years, jake, is more and more Law Enforcement officers speaking out against this obvious abuse of power, from los angeles to new york, weve seen chiefs of police and other officers and people in the criminal Justice System condemning the vicious act that they saw on this camera. We need to see more of that. Ive always believed the change we need to see in this system, beyond the change, that we need to see throughout the nation relative to race and racism and institutional racism is that people inside the system and who have proximity have the opportunity to change the system from inside. Were starting to see more of that. Its very important relative to bringing cases like this, who your d. A. Is, who your circuit attorneys are. Here in st. Louis, for example, we have a circuit attorney, kim gardenn gardner, who has been aggressive in going after abuse of authority. We need to see more of that, because of course they come under attack from keepers of the status quo in Law Enforcement unions that never want to be held accountable for anything including incidents like this. Its a good point. I have noticed other Police Chiefs condemning this in a way that i havent in previous such incidents. And we should remind our viewers that what mr. Floyd was accused of having done is having used a counterfeit 20 bill. This wasnt a Violent Crime he was being accused of or asked about. Laura, let me ask you, the Hennepin County attorney in minnesota says he anticipates charges against the other officers involved but his office wanted to get the, quote, most dangerous perpetrator first. As you know, there is new video showing what other officers were doing when george floyd was being held on the ground. What kind of charges might they face . Well, oftentimes if people are acting in concert with somebody, they will be held to the same standard and liable for the actions that that person has taken. So for example in a felony murder, if you have decided to engage in an Armed Robbery and one of you ends up killing someone, well, get what, everyone who planned that army robbery is now liable for whats happened. A similar theme could be in play for these other officers, what role they played, either passive or active. Thats why theyre calling for other witnesses to come forward. Is there more indication this was an active participant or a passive person who simply was complicit by turning a blind eye . Well have to wait and see. I think all four people were involved and complicit in the cold, calculated, cruel killing of mr. George floyd. I am very pleased to hear of the arrests by the bca. I have made a request to the Governors Office to transfer the case from the jurisdictional purview of our Hennepin County district attorney, mike freeman, to the hands of our Minnesota Attorney general keith ellison. And weve just seen three nights of protests in minneapolis. Some of the protests of course turned violent. The citys Third Police Precinct was on fire last night. Officers have been responding using rubber bullets, tear gas and more. Whats your message to the protesters . I know that many of our protesters that have been out there trying to protect the sanctity of life through their voice and their actions are peaceful. Many of them indeed have participated in the actions and gotten hurt by our Minneapolis Police department. And that does not sit well with me. There will be, i would say, actions that the council will consider in the coming days and weeks to make sure that we are able to correct for those behaviors and those actions, because we did not want to see anybody tear gassed, we do not want to see anybody hit with rubber bullets. We have multiple reports from the ground where folks were indeed asking peacefully but would get hurt nonetheless. Thats different than the folks who i think are out there putting buildings into fire and threatening the life of renters who are sleeping in the middle of the night while their buildings are burning underneath them. Its different than the people who are continuing to go back to the businesses day after day to rob them of their property and their goods. And my main concern really is for the small and immigrant locallyowned businesses that we have been working so hard to elevate, to close the citys racial wealth gaps. Many of white house are working on these issues of Police Reform and police transformation, were unified and that we want Peaceful Demonstrations and we want a peaceful show of voice for accountability and we do not support the burning down of buildings. Right now lake street is in shambles. There could be irreversible damage done to our communities that will take years and years and years to bring back. So i do hope people take it to heart that its time to turn the page. Weve seen the grief come out of our community on monday night, on tuesday night. We have seen the physical impact of that grief on the structures around us. Crowds are gathering in minneapolis, the site of floyds murder. Redditt, now that there is an official curfew for the city of minneapolis, what might happen tonight . Legally people cannot go outside to protest but i dont know how much that will stop people who are understandably very upset. I dont know that its going to stop them either. I think it helps that an officer was charged, at least. But i was there several years ago when Fernando Castile was murdered. I remember sitting in the living room with his mother and other folks who were there to talk about steps Going Forward and how she was discouraged about the history of policing in that community and the lack of accountability behind abuses like what had happened with her son. And i think this community is so deeply wounded, as we are all over the nation, with repeated instances of officers murdering black bodies, unarmed people, with no accountability. And the expectation is initially we may seem going through the motions, we may see charges. But until you see a conviction and some prison time for an animal like Derek Chauvin, i dont know that the crowds are going to be calmed. I dont know that theyre going to be peaceful in the way that they approach react to ing to w they saw. And van, we heard activists say this afternoon that theyve been trying to warn city leaders for years that there were major issues between police and the black community. The governor acknowledged what he called decades of pain and anguish. How does a community so angry, so hurting, how would Community Leaders even begin to try to calm tensions . Well, you know, its tough. As you know, i was very Close Friends with prince, who was from minneapolis, from the twin cities area, never abandoned that small part of the world, did all of his great work from there. So i spent a lot of time in minneapolis. And the situation between that Police Department and the very small black community there is atrocious and has been atrocious. There is a longstanding fear in the black community that there are active white supremacist elements in that department. To give you a sense of how much tension there is, the bus drivers in that town are refusing Police Orders to move protesters because the bus drivers are that mad at the police, that they wont even transport. These are the kind of things im hearing from people on the ground. And so its a deep, deep wound. And i think that the problem is simply this. You know, if you speak up and youre not heard, you might yell. If you yell and youre not heard, then you might scream. If you scream and youre not heard, then you might throw something. And whats happening is, youve gotten an escalation of frustration so that now youre at the point where in order to even be seen as believable and complaining about this department, you have to have an eightminute videotaped lynching of a man. And so the level of frustration is very, very high. And what i think needs to happen is a couple of things. You know, Mental Health therapy, counseling, we need to get that in large numbers, the healing part has to happen. But you cant have healing until you have some kind of catharsis. People are not only risking arrest, theyre risking their lives to protest in a pandemic. Theyre protesting in the middle of a plague. Thats how much pain there is. There needs to be perspective and healing rushed in there. For the white community, this is a great opportunity to talk to your children about the history and present reality of racism. You do not have a society that has this kind of thing happen, at this level, without it being a very long series of dominos that have been falling that we have not attended to properly. And so by the time people are yelling and screaming and burning stuff, and we dont know whos setting these fires, thats the reaction to inaction for too long. And laura, i mean, we have you as an expert because youre a former prosecutor, but i believe youre also from this area of minnesota. I am. Is this what van jones just described, does that ring true in terms of your recollection and what you hear from your friends and family who may still be there in minnesota, about tensions between the black community and the police . Its hard to look away from the tensions or even to suggest otherwise when you have this close in time history of people like jamar clark, Fernando Castile, and now george floyd. Even if the experience over time had not been what van is suggesting, even if it had been even an iota of it, certainly at this point in time its hard to ignore. And everyone has been impacted and responding to it. But im really concerned this evening, of course, because weve already seen, when you institute certain curfews or certain laws and penalties to try to curb protests, acts of civil disobedience, rioting, looting, you invite the officers in many respects to now do a crackdown on the people and invite arrests when you still have three officers who have not even been charged, let alone arrested, for the killing and death of george floyd. It is a sad and unsettling day for the nation, with racial tensions and further reminders of the injustice far too Many Americans face day in, day out. Plus more than 100,000 lives lost because of the deadly coronavirus pandemic. And yet if americans were hoping that their president in a hastilyscheduled rose garden event might Say Something to try to calm nerves, soothe pain, or bring us together in any way, they were likely disappointed. The president instead focused today on the Chinese Government and announced that the u. S. Was withdrawing from the world health organization. The president took no questions, though we were told it was a press conference. And he made no remarks about the protests, though on twitter, the president did try to clean up what seemed to many to be an incendiary tweet that, quote, when the looting starts, then the shooting starts, referring to protesters as thugs. Though perhaps the president s reticence is for the best, given how he responded during a similar period of unrest in charlottesville and his infamous reference to very fine people. Cnns Kaitlan Collins joins me. Kaitlan, President Trumps political strategy, whether on peaceful nfl protests or wearing face masks, often seems focused on dividing americans. Reporter and this is a time when often people look to the president for a unifying message. And there was a question of whether or not thats what he was going to offer when he spoke to reporters earlier, jake, that had actually been the plan under way inside the white house since this morning, for the president to address what was going on in minnesota at that press conference this afternoon. You cant really call it a press conference because he didnt take any questions from reporters. But those plans were scrapped. He wanted to focus on china. And then he turned and left without taking any questions. In his tweets he said armed force could be used against the rioters, talked about bringing the military in, and the minnesota governor had already activated the Minnesota National guard. Later the minnesota governor said the president s tweets were not helpful. The president has not addressed this in person as he was expected to do just this morning. But kaitlan, the president did initially say he didnt like what he saw in the videotape. But obviously most of his energy has been about condemning the protesters and the lawlessness in the protests. In these situations, a u. S. President typically reaches out to the family of the victim. We know that the president s democratic opponent joe biden spoke to floyds family. As President Trump reached out to floyds family . Reporter its not clear. Weve asked the white house multiple times today whether or not that contact has been made. Yesterday the White House Press secretary was asked this and she said not to her knowledge had the president yet spoken with George Floyds family. Thats another thing about the president not addressing this at all in the rose garden which stunned several people, even ones who worked for him. Joe biden said he had talked to the floyd family and the white house has not addressed it. He is going to be meeting with industry executives here in this hour and there is a chance he may speak about this then, although its still unclear what his plans are. All right, Kaitlan Collins reporting at the white house for us, thank you so much. This is hardly the first time that President Trump has made comments criticized as racially insensitive if not just empirically racist. In fact, as Cnns Abby Phillip reports, this is just the latest example of the president of the United States seeming to stoke rather than attempt to heal our longstanding racial divides. Reporter downtown minneapolis. Engulfed in fire, days after a black man, george floyd, was killed following an arrest by police. Back in washington, President Trump responding with middle of the night tweets that once again fanned flames of racial tensions in the United States. Trump, condemning the fires and looting, but adding a threat. These thugs are dishonoring the memory of george floyd. Any difficulty and we will assume control. But when the looting starts, the shooting starts. That phrase appears to have its origin from this 1967 comment by a Southern Police chief threatening black protesters were violence if there was looting. When the looting starts, the shooting starts. Which we know is a reference to another racist time in the history of america where police abused our people. Reporter trump now facing reelection and making a push to appeal to black voters, touting his support for criminal Justice Reform and weighing in on floyds death. I feel very, very badly, thats a very shocking sight. Reporter but his own words, past and present, make that a tough sell. I said, please dont be too nice. No justice. No peace reporter in minneapolis, activists slamming trumps record on issues of race. He said, dont be so nice to them, hit them in the head when you put them in the car. These were his words.
