Should the senate vote to remove the president from office, and 51 say yes, and 45 say no. I wanted to show you some key demographics that are looking at how america sorts itself when it comes to the president s approval. Looking among the women, first, 59 of women in this poll say convict and remove the president. 42 of men say so. That is a significant gender gap, and again, we see it time and again in all polling related to President Trump. You will see a familiar pattern here with race. 86 of africanamericans vote to convict and remove is what they want to see the senate to do, and 65 of hispanic americans in this poll, and 42 of white americans in this poll, and age is also a telling factor. Take a look at the age divide here. Under 45 years old, 56 of those americans want to see the president convict and removed from office. 45 and older, only 47 want to see him convict and removed from office. And david, what is america thinking about whether witnesses should be included in the senate trial . This may be the most important number in the poll. 69 in this poll say, yes, witnesses should be included. Brianna, you know that 70 of americans dont agree on anything these days and this is a huge number, and look at it by party. This is fascinating. Look at this number here. 48 of republicans, of republicans believe there should be witnesses in the poll, and 44 of the republicans say no. This is the number right here is going to be a critical number as the democrats try to seek the four republican senators over to their side voting for the witnesses, and this is some political power to help them do so. And what is the American Public think about whether the charges against the president are true . I find this fascinating. Take a look here, the majorities for both articles think it is true. 58 said that he did abuse the power of office and 57 said that he obstructed congress as laid out in the articles and that means that this is including people who dont think that he should be convict and removed, but they are saying that what he is alleged of doing, he did. Brianna. All right. David, stick around, and so, we bring in the panel to discuss this, and bill crystal, there are 51 in favor of convicting and removing the president and this is compared to the 45 opposed. Does this surprise you . What do you make of it . The big picture is back in august when the ukraine story brokeb a brok broke, and there was a debate if Speaker Pelosi would go with impeachment, and we had debates and i had strong arguments with people who didnt like trump, and this is risky politically and look at what happened with clinton. So this going to be backlash, and backfire, and his Approval Rating is going to go up, and what is amazing is that it will go up. The numbers are not great for democrats, but the majority in favor of conviction and the approval is stuck at 43 , and 70 want witnesses, so it is interesting that the public is supportive as it is, and it is a huge victory for nancy pelosi. Anyone disagree . Yeah. Then there is this other question about how the democrats in congress are handling impeachment, and 40 approve and 50 disapprove and that is the Political Risk for the democrats and particularly they are under water on that. They were under water before impeachment. And if you asked if it was approved in congress, it would have been that way. So they have gotten away scotfree politically on this. I dont think that we know the answer on that, because what is going to mat ser the numbers of the marginal districts and if they look like that, that is a problem. Karen, if you are looking at republicans who are faring much worse which is an important thing to point out, and you were going to say. I was going to say that is part of why this whole thing of what the rules are, and how it plays itself out is so critically important, because, if you are a lisa murkowski, you want it to be a civilized, thoughtful process and you do not want, you know, the president pleading all over the place, and the republicans losing control of the process. So i think that i agree with what you are saying, but at the same time i think that how this plays out is going to determine where the numbers go. And remember last week we were having a conversation of what did nancy pelosi gain by holding on to the articles of impeachment, and here it s. Tis this is a very big win. What about you, david . I dont think that we know yet how it is going to play out. We are likely at the peak of democratic support, because now the essentially the republicans are going to be able to control much of the show in the senate, so i dont think that the democrats, and nancy pelosi is going to hurt them, but i think that i am not sure that they have this win, and so one of the things that they are doing is smart in this period is to put emphasis not on the facts of the case which we have heard so many times and so competitive, but to put the emphasis on the sense of fair, and there they are playing on the fair grounds to push that issue, and possibly come out of this even if they dont think that they win the issues, that i have a issue. And the polls bear it out, because 69 of those surveyed are in favor. Look at this 69 say that the witnesses should be included in this senate trial. 26 say no. Okay. So the other thing, jackie, is that 48 of the republicans say that there should be witnesses. Which is why you see the susan collins, and mitt romneys of the world saying, yeah, we would like to see the witnesses. Now there is caveats there, because after the case has been made. And then they will decide, and there going to be votes. So who these people are, that is also going to be a moment of contention. But that is why you see, you know, some of the republicans, and mitt romney is not a moderate, but he is known to think these things through, and they are taking these position, but i will say that the biggest variable of all of this is that Mitch Mcconnell can have as much control in the world, but he does not control the president or the twitter feed. So it is a free radical this entire time. And do we know what the process is . Is the vote on witnesses taking place and schumer is going to push it before they begin all of the hearings . Yes, schumer may try to make it happen, but mcconnell thinks that he has 51 votes to go ahead with the presentation of the cases and the managers and the Defense Attorneys and then go to a vote and then go to votes on the witnesses, but as jackie suggests, we dont know what kinds of votes or how many. And mcconnell can lose control once it is a court of impeachment and the senators can make motions and the chief justice can make determinations that can be overturned, and so it a little bit more fluid and unpredictable situation than we think. John bolton could be testifying live before the United States live, and this is a big wild card to have out there. And nancy pelosi has played the cards very, very well on this. I have to say that Mitch Mcconnell did one thing that is very smart and that is to veto what the president wanted to do which is to put the firebrands of the house on the management of the floor, and so that would have been a circus, and he has much more control of the tenor of the conversation without the jim jordans there. Yes, that is a good point. So when you are looking at the variables and hey, is john bolton going to testify . Will we see lev parnas . Hunter biden up . Will we see the witnesses right away, or is that going to be farther off in the future. So i wonder how critical you think it is, karen, to hear from the witnesses quickly which is what democrats want versus later which is more likely what is going to happen. It is becoming harder and harder for the republicans to deny witnesses, and evidence, because again, as much as they like to make the comparison to the clinton impeachment, and remember that ken starr was a multi year and multi person investigation and they had boxes and boxes of day and the people did come to testify. It is harder, also, the more other things are coming out. And lev parnas coming out and the gao report coming out saying that the president did break the law, and so the more outside factors coming in to play, it is harder to deny the witnesses. We will see what this says for the overall report for the president , and david chalian, what is it with impeachment hanging over President Trump . Yeah, it is rock solid and steady as it is with donald trump. He is at 43 approval in this poll, brianna exa, exactly wher was last month and 53 disapproval and take a look where he is stacking up now against all of the modern era predecessors in january of the election year. He is down here at the bottom of that list. You can see here that is not where he wants to be, right. He wants to move up here. Now we have seen people down towards the end, bill clinton and barack obama get elected to the second term, but donald trump is at the bottom of the list with the current 43 . And no, it is so key. I even have heard from democrats, and we have all have who realize which way this is likely going to go in the Senate Barring something huge, and something kind of nuclear, and unforeseen that happens, they expect that the republicans are goes to stick together and that they are not going to convict the president , and so looking there, that may be the big, and this may be the number they should be looking at, but will this help defeat President Trump, do you think . I think that normally incumbent with the 43 normally. Normally. Normally is put on the shelf. On the shelf. Fair enough. I will subside. I will subside after saying that, but normally 43 is not great, but it is a different era. And you can see it in the poll, that 45 of people dont think it is going to make any difference. There is not, and it is because of this president. But the interesting thing is not just that the 43 is rock solid, but it is that the 53 is also appears to be rock solid and if that is the case, the democrats are going in with a tenpoint advantage into the general election, and that is a big difference and harder to climb, and they have the argument that this is the first president in history who had been impeached in the first term and think of what the second term will be like. And we have more in the brandnew polls out, and what impeachment is going to mean for the reelection chance, and in the key battleground states and plus they call it a charade that could cause the grave damage, and the 100 pages that give us a sneak peek of the President Trumps defense. In the politics lead, the White House Legal Team is dropping a 110page defense of the president this afternoon, just hours ahead of the impeachment trial. President trumps lawyers argue that he cannot be impeached, because he did not commit any crimes, and claim it would have been appropriate for President Trump to bring up the bidens with the president of ukraine. As cnns Caitlyn Collins is reporting from the white house, the democrats are firing back previewing a testy start to the impeachment trial tomorrow. On the eve of his impeachment trial, President Trumps legal team is previewing the defense and calling on the senate to swiftly acquit him. In a 110page legal brief trumps attorneys are arguing that neither of the impeachment articles are valid, because they do not include violations of the law and they do not remotely approach the constitutional threshold for removing a president from office. And the brief says that the legal team is not going to just attack the articles of impeachment, but also his conduct toward ukraine and including floating a baseless and debunct theory that ukraine interfered with the election despite a former ambassador testifying. This is promulgated by the Russian Services themselves. Reporter in their brief, they said that the political benefit was for himself, and what is not known is whether the new trial will have witnesses. They say that the articles are valid is chilling and dead wrong. We are going to demand votes, yes or no, up or down, on the four witnesses that we have requested. Reporter but the president s legal team says that witnesses are not needed. It has to be fair and there has to be witnesses on both sides. It is simple reporter and trumps attorney robert ray did not answer whether the whole legal team has met in person yet. As one of the new attorneys, he says that he is not part of it, and despite trump personally asking him to join. I did not see the brief until after it was filed. Reporter Alan Dershowitz is reversing the stance of whether a president can be impeached without committing a crime. This is what he said in 1998. It certain will i does not have to be a crime. If you have somebody who is completely corrupting the office of president and abuses trust and who poses great danger to liberty, you dont need a technical crime. Reporter and now that he is rep senting trump without a crime, there can be no impeachment. Reporter and now the legal team returned to the white house after they went to capitol hill one last walk through before the senate trial is formally getting under way tomorrow. They also visited the Vice President s office up on capitol hill and that is where they are holed up over the next several days and potentially weeks as we see how long the trial will get. But we should note that Alan Dershowitz was not with the rest of the team on capitol hill just now. Thank you, kaitlan collins. And now, david, you a former adviser to president clinton and what do you make of the white house argument that President Trump cannot be impeached, because he did not commit a crime . Well i, i think that you bring in the lawyers and most lawyers will tell you that it has been well understood and accepted that you do not need to have a formal violation of the criminal lawarticle to be impeached. And Alan Dershowitz may argue that, but everybody else in the Legal Community says it is not true. It is interesting that in the briefs that the republicans filed over the weekend, they make that argument that it has to be a criminal violation to count. And we expect that hell be saying that abuse of power doesnt match the level, right, of bribery or treason. That is what they are trying to say, but remember, this is a president who said very early on in his own presidency, that if the president does it, it is not illegal and that is because i am the president and so i can do whatever i want. It is not a sound legal argument, but it is a rhetorical argument that they have been making for some time. And to go back to what we are talking about in the polling numbers, they understand that if you are not going to let evidence come forward or testify, you must be blocking something, stonewalling, and so people will understand as the process unfolds and there is a lot of pressure on mcconnell and the republicans to live up to what is a fair process, and i dont think that americans are going to buy the argument that it has to be a criminal conduct in order to impeach a president. I agree. And this is an interesting point the other day when alan said that there have been 15 impeachment proceedings in the senate, and including not just the president , but the federal judges and in every one of the 15, there have been witnesses and documents. It is a good point. There is a entire section of the defense of the white house titled it would have been appropriate for President Trump to ask president zelensky about the Biden Burisma affair, and burisma is the Energy Company that the Vice President s son sat on the board of, and this is suggesting that at the point, they are ready to defend the president s actions as far as ukraine and instead of attacking just the articles of impeachment, and what do you think about that . We will see how they do it. But you have heard it through the president s defenders as this entire thing has gone on, and if that is the case, why cover it up initially, and if it is so above board and why say Different Things and at one point it is about corruption and why it mattered. There are a number of stories on this and in terms of what has been said from the official channels of the white house, and the story keeps changing. I guess they have seltd ttled oe at that point, but that is my question. And john bolton who has been in federal government nor three decades told not one but two deputies the fiona hill and tim morrison to go see the white House Counsel and stay out of it and it is a drug deal. If this is so wonderful, why did john bolton who is not a liberal democrat in the white house and knows the law and a toughminded guy and known to push hard for the policies and why did he react in that way . That is the guy of bolton of all of people who could testify, and you were there in real time and what alarmed you . And the three of us worked in the white house, and it is unbelievable to tell someone, hey, this thing that the president is involved in, go see the white House Counsel, and that is not going to happen everyday, right . This is not in the normal times. And that is right. And we are retiring that word, and we talked about that. And so, the new cnn poll, and we actually asked the voters how the impeachment is going to affect President Trumps 2020 chances, and this is what they said 28 say that it helped him and 23 said that it hurts him, and 45 said that it doesnt make a difference. Jackie, i mean, this is what we were talking about this before that they are resigned to this not changing anything. Right. I think that when you are talking to people who are in various states, impeachment is not the first thing that you hear about, but it is health care. It is, you know, a bunch of things that affect their lives which is what this president is going to be judged on. Impeachment is such a political process, and so there is so much polarization, both out in the country and in washington that there is this feeling that the washingtondriven situation is not going to affect how people cast their votes. We are less than 24 hours away from the start of the impeachment trial and all signs are pointing to nothing short of a contentious battle on the senate floor and behind closed doors. Senate minority leader Chuck Schumer is preparing to offer one amendment to the impeachment rules in an attempt to get the witnesses to testify and documents now blocked by the white house to be turned over to the senate. And much of this is in closed session, and it is out of the public view. Cnns manu raja is on capitol hill and you have brandnew reporting of how this is going to unfold. Tell us. Yes, one leader Mitch Mcconnell unveils the Senate Resolution which is not released, but sets the parameters of the trial, the senate will begin what is going to be a contentious fight over the resolution. Now, we expected the beginning of that debate to be in an open session, to be public, and when that is debated, it is not the senators debating, but it is the impeachment management on the house side to make the case for democrats and the president s defense team making the case for the republicans. Now, once that resolution is concluded after two hours, then Senate Minority leader Chuck Schumer is going to offer the amendment to require witnesses and documents to be produced as part of the trial. This is something that is also going to be gadebated for two hours and then the vote goes down. The republicans are expected to reject it. It is uncertain if schumer could offer more amendments. He is allowed to do just that, but he does that, it could delay the opening arguments of the proceedings. And brianna, you mentioned that it the senators could move into closed session at virtually any time and 51 senators have to vote to go into the closed session, because the senators are not allowed to talk, and if they want to talk or debate, that is when they will go into the closed debate. So no question about it, there is going to be a fight at the beginning of the tomorrows highly anticipated trial, brianna. Do skruyou have a sense of h long this is going to last . Well, it is uncertain, because Mitch Mcconnell has not unveiled the exact resolutions he is going to put forward as late as tomorrow. But what we are hearing from the sources, republicans are looking at structuring the trial to essentially allow 24 hours on each side which is split into two days and 12 hours apiece on each side for opening arguments and after that, the senators would have 16 hours to question. And those questions will be done and write the questions down and the chief justice would actually say the questions, but democrats are expected to object if they move that, in those, the outline there, because under the clinton standard there were 24 hours, but it was split among four days, and this is potentially 12 days apiece, and unclear what Mitch Mcconnell goes that route, but if he does, expect a fight over that as well, brianna. The 12hour stretches and you said 12 days, but it is 12 hours. Yes, it is long and early afternoon to late at night potentially. Very, very late. What do you think in the defense memo submitted by President Trumps legal team that they insist that the president did not commit a crime and he was right to ask you crane to look into the bidens and burisma . Well, i have not read that in full detail. I have been studying the house managers report and i will start looking at the president s filed today. I dont think that he has a right to simply look into something that is to withhold congressionally approved aid. We have to look at all of the facts here, and see. I think that right now what we need to hear is the legal arguments from both sides and look at the facts and see how this picture turns out. I think that right now, you are just seeing that both sides are being advocates and well have to see how it shakes out. Would you support a rules package to allow the witnesses, but only later in the process and not the beginning which is what the democrats say they want . If it is just going to quote allow for a vote, i would not support that. I think they we neneed to do th the front end and i have been consistent and said that the president should not be blocking witnesses and help participating in this and the American People need a full, fair and complete hearing. I am not going to vote for a package that does not allow for witnesses on the front end, and so that the house managers and the president s team can start that process to depose the witnesses now, and to try to go as efficient as possible. One thing i worry about is that it is jammed in front of the American Public and all of the sudden, we will get an argument made, well, we just dont need the witnesses, because it is going to drag it out into february. That is not right or fair and the American People deserve better. If you do get to call the witness, as you are aware, the tradeoff could be that the republicans will get witnesses, and that would be an expectation and would you be okay with hunter biden testifying . Well, somebody has to look to see the relevance. I am okay with any witnesses that have relevance to the charges. Is he relevant . I dont know i dont think it is. That is just my opinion right now, and i think that the chief justice would be the first to rule on that. It does not seem to me that what is going on in 2015 with hunter biden is relevant to the underlying charge of what this president has been charged with. If others have a disagreement, then feel free to call mr. Biden, but i dont see the relevance. I think they there are witnesses, and even this, and the witnesses that the house managers want to call is going to be crossexamined by the president s lawyers and the president has complained that he has not gotten due process and that he could not participate even though he was invited to in the House Judiciary Committee and any witness now is subject to crossexamination by the president s enabled counsel. And that is the truth teller there that crossexamination is a tool to seeking the truth. And there is a poll that people in battleground states are eventually split. And 49 who say that President Trump should be removed from office. Your state of course is not a battleground state, and you won your seat by two points, and it is a giant surprise pretty much to everybody. Can you get reelected in a red state like that if you vote to convict and remove the president . I am going to get reelected regardless, brianna. It does not matter that. Whatever way i vote, i can go back to the people of alabama and do two things, explain my vote and justify it according to the oath and the constitution and ki point to the record of success. In two years in the United States senate, going on three in november, of success for the people of alabama. That is what folks are looking for. They are looking for health care. They are looking for Rural Broadband and looking to make sure that the hospitals are open, and workforce development, and looking for a fair shake of people, and not one alabama or for the rich and famous, so that is what going to carry me over the threshold in november. It is simply a lie that video that is going around. I am looking for his campaign to come forward and disown it, but they have not done it yet. Reporter sanders is defending the criticism of bidens record on social security. On the issue of social security, time and time again, joe biden has been clear in supporting cuts to social security. Reporter but biden is issuing a warning about how a sanders or Elizabeth Warren nomination could affect other democrats on the ballot come november. I am asking a rhetorical question, and bernie is atop the ticket in South Carolina or warren is on the top of the ticket, and how Many Democrats are down the line are going to win . Reporter a pair of rivals picked up a National Endorsement in an unprecedented move, the New York Times Editorial Board said they are backing Amy Klobuchar and Elizabeth Warren for president , and saying that the time to be open to new ideas is now, and that is why we are endorsing the most Effective Advocates for each approach. And soon four of the president ial contenders will turn their attention from the campaign trail to capitol hill. Senators Elizabeth Warren and Bernie Sanders and Amy Klobuchar and returning for the impeachment trial, and that will take them off of the Campaign Trial for a unknown amount of time. Thank you. And so, lets talk about the newspaper selecting both Elizabeth Warren and Amy Klobuchar and selecting them over biden and sanders that they are too old and it is time to pass the torch . It is a whole port of the endorsement is to pick one and make a choice. Help people make their choice. But if you are Amy Klobuchar, that is something to send out to donors and did not hurt Elizabeth Warren either. I cant imagine that bernie imagined liked being called old but he said it on a radio interview the other day. So i do think that one thing they pointed out about warren that is important is that she is a very effective advocate for her policy ideas, and even if you disagree with her, she has done an excellent job on the campaign trail in explaining what she wants to do and how she wants to do it, and so good to see her get some credit for that. What did you think . The old white guys, basically, too old and time to pass the torch . A ha and some people say that about the New York Times. So, you know, traditionalist and so on and so forth. Listen, i thought that it was a terrific break for her. She is still a very big long shot to win in iowa or early on, but she is coming out, and she has good debates, but one thing they think that it did do if she is not a nominee, she is on the short list for Vice President. I think that is going to be an article to help her a great deal in that. And particularly when she is going to be sitting as a juror, and you know, for we dont know how many weeks, so it is a test of the organization of these candidates that have already like have, planted in the state, and while you have other candidates running around like biden and buttigieg who are going to be able to keep having the facetoface interactions with the voters as time ticks by ever closer to the caucuses. Do you want to be the contrarian on this, and has the New York Times suffered unduly for this choice . In the spirit of the New York Times, i think that jackie and karen are mine, and i endorse them both, and david and brianna, and all of you guys. Kind of pathetic after all of the hoopla and the lead up to it. They represent a fundamental choice, and Amy Klobuchar is more moderate democrat and Elizabeth Warren is more of the standard bearer for progressivism, and that is weird. It is one of the major issues in the race is does the party go clinton democrat or progressive democrat. And the New York Times said they said yes.
