With the first full vote in the house of representatives related to the impeachment inquiry into President Trump, formalizing the impeachment inquiry process. House Speaker Nancy Pelosi today, presiding as every democrat who voted approved the measure except for two, both from districts trump won. The vote determined how the House Intelligence Committee will hold hearings going forward. It does not grant them subpoena power unless democrats agree. Republicans blasting their colleagues. Clearly there are people we serve with that dont like the results of the 2016 election. Reporter calling the inquiry a sham. When you look at this soviet style process, it shows you that they dont really want to get to the truth. They want to remove a sitting president. Despite calling for and now getting a full house vote to move forward with the inquiry, republicans say democrats have already compromised the process. This is a process that has been fundamentally tainted. The president has had no rights inside these hearings. They cannot go back and fix what is a fundamentally tainted and unfair record. Outside gop groups immediately going on the attack, targeting democrats who hold seats in districts won by donald trump in 2016. We take no joy in having to move down this road and proceed with the impeachment inquiry. But neither do we shrink from it. We have a lot less republicans than we did in the house of representatives but they are far more loyal, blindly loyal to donald trump. Let me ask you. The republicans, even some democrats would acknowledge, have a fairly effective message in talking about how the process has not been transparent, has been behind closed doors. We can debate those merits and we have. Now thats over. These hearings will be open to the public and they can try to subpoena witnesses. Will it be more substantive about the case, do you think . In fact, he asked him to look back on the watergate process and said what rights did the democrats offer. Nancy pelosi said previously we cant do this unless its bipartisan. Thats out the window. He did not raise concerns to the National Security council lawyer as a separate white house official Alexander Vindman did, who was also on that call, who was worried it could undermine National Security. Joining me from outside court, jessica, this first case involves don mcgahn. What happened today . A lengthy hearing to be sure. Its still happening, going on three hours now. Its showcasing a battle between House Democrats and the white house. Democrats have been trying to get don mcgahn in for testimony. He has been defying a subpoena. Theyre trying to get him in for testimony about whether the president obstructed justice, and stopped the russia probe. The white house has said as a former official, don mcgahn has absolute immunity. The judge has been listening to this argument over the past several hours, expressing great skepticism here saying i see former officials on tv, cable news, talking all the time. Why should it be any different for a former official going before a House Committee . Why should don mcgahn be able to defy this subpoena . Its not clear when this hearing will wrap up or when this judge will rule. Obviously, the ruling could have some big effects and ripple effects for all those former officials who are currently refusing to testify. Jessica, the other big court case is that of the former John Bolton Deputy National Security adviser. The two men share a lawyer. Kupperman refused to appear before the house this week. Reporter thats right and his attorney filed days before he was supposed to appear. He wants clarification from the court, saying who should kupperman listen to, House Democrats and their subpoena or the white house, who is claiming absolute immunity here . The judge here, richard leon, is putting this on a fast track. He knows that time is of the offense. Of course, it will be imperative on how he rules as to this witness, Charles Kupperman because of course, chuck cooper, the attorney here, represents john bolton. With john boltons testimony being requested next week and bolton subsequently saying he wont appear voluntarily, its likely his attorney, the same one representing kupperman, will put forth these same arguments and refuse to appear as well. Jake . Lets discuss with ross garber. If a judge determines he can testify, can he still refuse . Yes. Whats likely to happen, this judge is a district judge, trial judge. If he orders mcgahn to testify there will almost certainly be an appeal and a stay in place and then whoever loses at that stage is likely to ask the Supreme Court to get involved. While thats all playing out its very unlikely well see any testimony from don mcgahn. Ultimately, isnt there majority support on the u. S. Supreme court, especially now with two trump Supreme Court justices for a belief of very broad executive powers . Arent they likely to lose, the people trying to force mcgahn to testify . I think its dangerous for folks to game out the Supreme Court. This is an argument that is there is no Binding Authority on this argument about absolute immunity. It stems from the notion that congress cant force the president of the United States to come and testify. He also cant then force his Senior Adviser to come testify. Its taken by president s and department of justices in both parties but its untested. We dont know what the Supreme Court will do with that. I think theres the belief out there that executive privilege means that congress cant force anyone who works in the white house to testify, whether its don mcgahn or kupperman, National Foreign adviser. Is that wrong . At first theyre trying to assert something even broader than executive privilege which is absolute immunity. I have to disagree with ross a little bit. There is some precedent. In 2008 District Court judge soundly rejected the idea of there being this absolute immunity, specifically citing the nixon case, saying that nixon revised the authority for piercing that. And if you really go with this absolute immunity, in his words, eviscerates Congress Oversight ability. What about the fact that this entire impeachment is illegitimate, bogus and therefore they dont have to cooperate. Will any court find that a reasonable argument . At some point down the line you may see that play out in court. You think about the mcgahn situation. That subpoena was issued early this year. Before ukraine. Before ukraine and before, certainly, before todays house vote. I think youll see an argument that the president s advisers could be forced to come and testify.
