He is in federal court for his sentencing, facing up to 25 years in prison, which for a man who turns 70 next month could effectively be a life sentence. Charged with bank fraud and failing to pay taxes on millions for pro russian ukrainians, charges that stem from special counsel Robert Muellers investigation. Lets take a quick moment to acknowledge, however much weve gotten used to this wild era, that it is simply stunning. Former Campaign Chair for the president of the United States is a crook, about to go to prison, maybe even for the rest of his life. Shimon prokupecz, what are you learning about whats happening inside there right now . Were waiting for this to get under way any moment now. Paul manafort, his family, prosecutors are all in court now. Were waiting for the judge to take the bench so that this hearing can begin. Paul manafort was brought into the courtroom in a wheelchair, with a cane. Hes wearing his green jail jump suit. Weve seen Paul Manafort in court before, not in a wheelchair, in a regular suit, dressed with a tie. Today, though, a different look for Paul Manafort. He is in a wheelchair with a cane. Now were waiting for this hearing to get under way. And it just started, were told. He has the opportunity to speak in court today . Reporter thats right. Thats really the first time we would be getting to hear from him. He would have the option to certainly get up. If he could stand, presumably thats why he has his cane with him and will be able to address the judge and, as you say, ask for leniency. He is potentially, here, facing the rest of his life with the fact that hes 69, about to be 70, facing 25 years in prison. He could spend the rest of his life there. So, this will be, perhaps, his last chance where he could address the judge and hope to spare some time, some free time so that he doesnt spend the rest of his life in prison. Shimon, thank you so much. Well go back to you when you have news on the events in that courtroom. I want to bring in our senior legal analyst, ellie hoenig for the Southern District of new york, and former attorney for Paul Manaforts deputy, rick gates. Shan, let me start with you. Judge t. S. Ellis is known for his colorful courtroom quotes but dont always know what he will ultimately rule. He sided with the counsel, after scolding them, saying they were just trying to get President Trump. Can you read into any of ellis past statements about what might happen today . He is a judge who speaks his mind freely. That doesnt necessarily mean at the end of the day it will affect his conclusions. I do think, though, that those particular comments give us a little bit of insight, which is that he may be thinking that manafort, in some ways, has been more of a target for a more thorough and vigorous investigation than he might have, had he not been associated with the trump matters. That may factor in for him. I think my personal view is that were looking at a sentence thats going to be well below the guidelines range. Certainly manaforts team has been angling for that, by making arguments about the proportionality, whether you can come lower than what the guidelines would normally allow you to do. Ellie, in the special counsels reply to manaforts sentencing memo, prosecutors said, quote, manafort blames everyone from the special counsels office to the ukrainian clients for his own illegal effort. His efforts at misdirection are further proof he has not accepted responsibility for his criminal conduct, unquote. A lack of remorse, might that weigh in on his sentencing . Certainly, jake. Remorse and acceptance of responsibility are key factors at every sentencing. Thats one thing that this judge will be looking for today. Will manafort address the court . If i was advising him i would tell him, you are speaking and you are going to express genuine remorse for what you did. Judges put a lot of stock in that. That is absolutely fair play at sentencing. I do agree with shan, though. The sentence iing guidelines ra here, 19 to 24 years, thats advisory. Judges have to consider that. They do not have to sentence within it. 19 to 24 years is an extraordinarily high sentence, even for all of the fraud crimes that manafort has committed. I would look for something in the low double digits. Were told right now from inside the courtroom that it is packed, a packed courtroom with federal investigators and spectators and members of the media. Elie, the special counsel also argued that manafort shouldnt get mitigation for cooperation because he lied to the government and grand jury. Might that have an impact . Sure. Not only does he not get acceptance or responsibility, typically if a defendant accepts responsibility, he gets a threelevel reduction, which can result in several years. Not only is manafort not going to get that, he made it worse. He did about the worst thing that any defendant can do, which is try to cooperate, go in and intentionally mislead muellers team. Thats just going to pour gasoline on the fire here. Shan, manafort has asked judge for leniency in the past, saying he is sorry, arguing his health has deteriorated. Might that be a factor . It certainly will be. Those sorts of issues, age, lack of criminal record are already reflected in the guidelines. They have to gain further ground. Theres special consideration for him angling for a pardon. Thats not what his team is looking at. Theyre focused on this judge and figuring out what he can do to lower off that sentence with this judge. Well come back to you as news develops, when we get news from inside the courtroom, what the sentencing actually is. As we await word, it is worth underlying, again, how significant this is. This is the president s former Campaign Chairman. He could be heading to prison for the rest of his life. Pamela brown is digging into just how historic this moment may be. Astounding downfall for a man w who, three years ago this month, joined the campaign and soon ran the campaign of the man who is now president of the United States. However much the president attempts to distance himself from Paul Manafort now. He worked for me for a very short time. At the time trump all is sounded much different. Manafort was brought on to the Trump Campaign in march 2016 to help secure republican delegates, uneasy about trumps nomination. Manafort brought with him his deputy, rick gates, who ultimately testified against manafort himself. The Mueller Investigation stems from the overwhelming consensus within the u. S. Intelligence community that russia interfered in the 2016 president ial election. 26 russian nationals are spreading misinformation on social media or conspiracy to commit computer crimes. Distrust of the candidates and the political system in general. Reporter we still dont know why manafort shared internal Trump Campaign data with a man who mueller claims has ties to the kremlin. Muellers investigation has yielded guilty pleas from several people in trumps inner circle and so far entities, including russian nationals, have been charged with crimes relating to the probe. Waterga watergate, which resulted in the resignation of president richard inform ixon, is the only political scandal that produced more charges, at least so far. Manafort will learn his fate any moment now. His legal team argued to the judge in a recent filing he should serve less than the 25 years because he will be less likely to commit crimes given his age and the punishment the special counsel is asking for doesnt fit the crimes he committed. This is the first of two sentencing hearings for manafort. Jake . Pamela brown, thank you very much. First of all, just to make clear, he has not been charged with anything relating to conspiracy to interfere with the 2016 election. Right. Well hear no collusion. That is at least accurate when it comes to the charges and sentencing today. But do you think were kind of underplaying the nation and the media, the gravity of this . This is somebody who was very instrumental to trump winning. And hes going to be going to prison. I always remember that interview that he did during the campaign, where he was asked directly, do you have any financial ties to russia . And he stumbled and it was all very strange. And the reason he could not be honest with the public about his ties to ukraine and russia is because he had been so dishonest with the government in regard to his taxes, his lobbying, his baking for so many years. During the campaign, a lot of republicans werent against this. We knew there was a lot of questionable activity that Paul Manafort had been involved in and we questioned why he would be given such a prominent role in the campaign. The amount of arrogance displayed about the Trump Campaign who raised any questions, who said you dont have our interest at heart. We did. Peoples lives are ruined. Hes looking at life in prison. This isnt an i told you so moment. This is a sad moment. Kerstin, the probe has resulted in 199 overall criminal accounts against 37 people and entities, six Trump Associates have been indicted or pled guilty, Paul Manafort, rick gates, Michael Cohen, michael flynn, roger stone and george papadopoulos. Any other president , this would be splashing news anywhere if this had been Barack Obamas campaign manager. So it says something about the fact that this has become somewhat normalized, that somebody is being described as the prosecutors as a hardened, remorseless criminal, who they hoped would be able to help them somewhat on the russian probe because he had given this Campaign Data to someone who had ties to russian intelligence but they determined he was so d dishonest that they couldnt believe anything that he said. And President Trump, david, has not taken a pardon for manafort off the table. Take a listen. This is back in november. Its very sad whats happening to paul. Ive never seen anybody treated so poorly. Do you think a pardon is a real possibility . I have no idea. But what i do have an idea about, because i was there, is the involvement of Paul Manafort in the campaign. As you correctly note, none of these charges have anything to do with what bob mueller was sent there to find, right . Paul man i dont fort had been investigated by the fbi for years before the Campaign Even started, before this even got under way. And i think that they may have come to some conclusion they didnt have enough resources to prosecute him. For whatever reason, they didnt pursue it. Lo and behold, they have unlimited resources and go after manafort. Listen, the things that he did was criminal, wire fraud, bank fraud, tax evasion. Those are criminal and should be punished but we shouldnt conflat that they had anything to do with the campaign. Paul manafort went to cleveland. He organized the convention. He was prepared to fight a floor battle against amanamandas old boss, ted cruz. We werent worried about the russian. You werent worried about the russians. We were worried about john kasich. Im told that the judge in court, t. S. Ellis, just said this has nothing to do with russian collusion, which is the point we just made a couple of minutes ago. President trump has tried to distance himself from Paul Manafort. Take a listen. I feel badly about a lot of it. I think a lot of it is very unfair. I look at some of them where they go back 12 years. Manafort has nothing to do with our campaign. Paul manafort worked for me for a very short period of time. He worked for ronald reagan, bob dole, john mccain, his firm did. He worked for me, what, for 49 days or something . Very short period of time. It was five months, not 49 days, but in any case, thats been the attempt. He has his Campaign Chairman. Lo look, he was not as vital to him as, obviously, david urban or jared kushner. Michael flynn. But he played an important role. Who has also been indicted. Waiting sentencing. Right. So here is the problem. Im old enough to remember when al gore used a phrase no control in Legal Authority because the 96 Clinton Campaign was being investigated by aperhaps illegal contributions from asian fundraising sources. Imagine we found out that the chairman of the Clinton Campaign had been meeting with possible intelligence operatives from china at the same time they were being investigated. Do you think there would be this sort of like that had nothing to do with it . We dont know what this is all about . This is an outrageous scandal under any other presidency. If this is Hillary Clinton and we found out someone else in her campaign was doing this, we would not be so calm about this. Nothing else would be happening in washington. Nothing else. The United States senate would be shut down because the republicans would only be talking about this. Im not certain theres nothing else. Theres a Mueller Probe thats been going on for two years. The house is conducting oversight, which is needed and warranted, but maybe a little overbroad in this case. There are lots of things going on. Theres lots of outrage from republicans as well as democrats. However, some of it may be overreaching. The judge could sentence Paul Manafort any moment. I think thats okay for people to grow up and kind of or edge up and kind of learn how to speak in a civil manner in order to get legislation passed in the United States congress. Ive just got to say after watching the democrats condemn republicans for every ism known to man over the past few years, you would think they would know how to handle this internally. Bit of advice, life is easier when youre consistent. Do the resolution. The real issue to me is stripping her of the committee assignment. If she needs to grow up and learn on the job, she shouldnt be doing it on a committee that has jurisdiction over those matter. I didnt mean to say grow up. I misspoke. Other people have said that. I understand how advocates come in with their enthusiasms, but when you cross that threshold into congress, your words weigh much more than when youre shouting it at somebody outside. I tend to see it more the way he sees it. She wasnt speaking about jews having an allegiance as much as she was talking about members of congress being pressured into having an allegiance. If you look at the average proisrael member of congress today, theyre more likely to be a republican or an average person out in the country. Theyre more likely to be an evangelical christian or a republican. So its not necessarily talking about jews having an allegiance. Its talking about the fact that she feels like she should be able to make criticisms about israeli policy without being called antisemitic. Now she used the word allegiance. I dont think she should have done that. It does ignite fears that jews understandably have. And i think thats been explained to her. I am very uncomfortable with the way she has been singled out here. While we have a president who routinely makes racist comments about africanamericans iqs. He has made antisemitic comments as well and has never been condemned. Theres never been a resolution by anybody on the republican side, no resolution condemning him basically saying, you know, theres good people on both sides. So why is this woman being singled out in the way shes being singled out and having the weight of all of washington come down on her . I will just note steve king, there was a resolution ten years later. Come on, jake. Im not defending it. Im noting that he was taken off his committee. Even noting it no, steve king has been doing what he has been doing for nine terms. The most outrageous, racist insane things he has been saying, nonstop. They finally do a resolution, which probably they did it so they could be doing what theyre doing right now. Two observations. I think that her comments shouldnt be taken in a vacuum. Theres a huge rise in sentiment on campus, in the congress. Antiisrael . Antiisrael. And secondly, a group glaringly omitted from the antibigotry from that resolution, catholics. I think i did see maybe it was taken out. There was reference to anticatholicism against john f. Kennedy. All their recent anticatholic comments and hearings for judges. Theres a real that needs to be included as well. Throwing everybody in the kitchen sink in this resolution, democrats, to their own peril, ignore catholics coming up in the 2020 elections and rust belt states. Democratic congressman ted deutsch. One of our colleagues invokes the classic antisemitic language that jews control the world, that jews care only about money, that jews can not be loyal americans if they also support israel. This, too, must be condemned. And it feels like we cant say its antisemitism unless everyone agrees its antisemitism. Can i read a quote from donald trump . You probably agree with ted deutch on 99 of things. Yeah. Do you think hes being insincere . Let me read a quote from donald trump. Were talking about im just referring to what he said. His complaint. Donald trump told a room of jewish republicans, youre not going to support me because i dont want your money adding, quote, you want to control your politicians, thats fine. Republican coalition. Whats different than what he was just complaining about . I dont think he would defend that. Thats my point. Why is the first of all, she didnt say this. I mean, thats not what she said. If we look at what she actually said support for israel was all about the benjamins. Which she apologized for profusely and it was wrong. She did apologize for that. Donald trump has never apologized for this. And so my point is, she has apologized and i think she is learning, to jamals point. This is the second time. And members of congress have its not, amanda, because what she said as they did to steve king, finally. She actually said i want to talk about the political influence in this country that says its okay for people to push for allegiance for a foreign country. She questioned the allegiance of his colleagues. Thats why the colleagues want to take action. Not jewish colleagues. Thats the point. I think theyre included in that. Right but shes talking specifically about the fact she doesnt feel like she can talk about these issues without being called antisemitic. And she cant do it without and, as i said, she shouldnt have used the word allegiance. I agree with that. But i do think shes learning. Words matter. Right. And i think she is learning and for the first time we have these two Muslim American women in congress. And we need to be able to have a conversation and hear what theyre saying without immediately trying to silence them by calling them antisemites. Stand up for values of tolerance. There also has to be space to have dissent about the actions of a Foreign Government that typically is someone who is aligned with a community that is in conflict with that government, ought to be able to speak up and talk about it. Theres another minnesota congresswoman, democrat who is very critical of israel, much more so than congresswoman omar. She has managed to avoid the tropes. Good advice for everyone. Well continue to keep an eye on the house floor where debate still under way on that message that is more broadly an antihate bill. We are following two breaking news stories at this hour, Paul Manafort will be sentenced any minute and on the left, the congress is about to vote on an antihate bill on a story thats dividing democrats. Just in to cnn right now, in case you had any dreams that Michael Cohen and President Trump might somehow reconcile, our next story would crush that. The president s former fixer is now suing the trump organization, claiming it did not pay him or his attorneys fees for his work after he started cooperating with federal investigators. As republicans and democrats are outrage outraged over the idea that Michael Cohen may have lied to congress about whether he ever asked for a pardon. House Oversight Committee chairman elienjah cummings just said he would nail Michael Cohen to the cross . Yes. I spoke to him about the testimony where Michael Cohen said he never asked for a pardon from the president. Theres questions about that testimony and whether or not he was truthful in what he said. When i asked cummings about that, he told me he takes lying to his committee very seriously. I told him, i said, i will nail you to the cross. And i meant that. Ive got to make sure they are true inconsistencies and not outright lies and then i have to find out whether it meets even the threshold that doj would even want to look at it. Reporter hes saying he doesnt know if it was an actual perjury committed to his committee about that pardon talk. He wants to look at the transcript, review it further and decide whether or not it deserves a referral to the committee. He does plan to refer this to the justice department. So both aisles, democrats and republicans, pushing to go after this. Cohens lawyers brought up a possible pardon not just once but multiple times. Reporter there were multiple discussions between cohens attorneys and President Trumps attorneys last year about the possibility of a pardon. Theres a debate on both sides about who initiated the pardon and whether a pardon was actually on the table. Lanny davis, cohens attorney, said in his statement that cohen was open to the ongoing dangling of a possible pardon by trump representatives privately and in the media. He said he was referring to a period in whats involved in a joint Defense Agreement where they were all working together. As he turned and left that agreement he never wanted a pardon going forward. According to lanny davis, thats what he was referring to in his public testimony. Thats not winning any assurances here on capitol hill where republicans believe he was very untruthful in what he said there and also cohen has told congress, jake, he had conversations with jay sekulo, the president s attorney, about a possible pardon.
