Both during and after the battle to confirm Brett Kavanaugh. All coming less than one month from the midterm elections. Cnns political director, david chalian, at the magic wall with all of the results. David, President Trump up, down, or about where he was . No, hes up from where he was last month. Lets take a look at his overall Approval Rating, jim. Brandnew numbers from cnn conducted by ssrs, right now, 41 approve of how hes handling his be jo. 52 disapprove. But like i said, hes up. In september, he was at 36. So the president is up five points now. Thats good news. You want to be heading this way four weeks from an election. Heres the problem. Take a look at how that 41 stacks up in history, jim. Its at the bottom. Donald trump is matching where bill clinton was in 1994 after 41 . Hes at a historic low, and we all remember, in 1994, when bill clinton was at this 41 , his party got wiped out in those midterm elections. This is a concern that donald trump is this low four weeks out from the election. Brett kavanaugh also in these numbers. Hes been sworn in. How do americans feel about whether he should have been confirmed. Yeah, its a good question. A majority of americans do not think he should have been confirmed. 51 say no, he shouldnt have been confirmed. 41 said yes. And look at this over time. We asked this question back in august, before his hearings, in september at the time of his initial hearings. You can see what the allegations from blasey ford and others did. They really increased the opposition across the country to kavanaugh. We, of course, also asked about the allegations themselves, whether americans believe the women or believe judge now Justice Kavanaugh. Take a look at that. 52 of americans say on the accusations of Sexual Misconduct, they believe the women. Only 38 believe kavanaugh. Take a look at the gender divide here when you break this out. Among women, 61 , more than 6 in 10 american women in this poll, say they believe the women. Only 31 believe kavanaugh. Men, much more much more evenly divided. And then, of course, we asked about how the parties in the senate handled these allegations. Oh, im sorry. No, first, we asked about whether or not having two of nine justices facing Sexual Misconduct allegations, getting to the court. Is that a major problem . Nearly 6 in 10 americans, 56 of americans say that is a major problem. 16 minor problem. Only a quarter of americans say thats not a problem at all. And now we also asked about how the democrats and republicans handled themselves during the kavanaugh hearings. Jim, this did not wear well for either party. The majority of americans disapproved. 55 disapproved for republicans. 56 disapproved of how the democrats handled themselves. This process did not wear well on anyone. Not Justice Kavanaugh, not the democrats and republicans on the hill. Maybe save for President Trump, who i said his Approval Rating is on the way up. David chalian, thank you very much. To the panel. Kristen, if i could start with you, the one thing folks seem to agree on in this poll is that both parties in their view did not handle these hearings well. In a way, that finding doesnt surprise me. That was sort of a lot of the discussion that you would see after especially that thursday, where you had the morning, dr. Ford facing questions from a senate panel where the Senate Republicans brought in someone to handle the questioning. Followed by the circus that unfolded around when then judge kavanaugh himself came in. So it doesnt surprise me that you would see a lot of voters in the middle, kind of going a plague on both their houses. Another number from a poll from quinnipiac last week, even though those numbers looked similar to what the cnn polls show, they believed dr. Ford, more said they opposed kavanaughs confirmation than not. 49 said they felt kavanaugh had been treated unfairly in the process. So those numbers in many ways dont surprise me. So david, you have a situation here where both parties are claiming that these hearings were a motivating factor. And you see some of that in the numbers for women, no question. On the democratic side. But you also see it as kristen was saying, folks on the republican side, who think kavanaugh was treated unfairly. Who is going to benefit more, in your view, or is it bush . Look, at the end of this, be i think these numbers show that nobody wins in this. Its the old adage, when you wrestle with a pig, you get dirty and the pig likes it. So this is a losing situation on both sides. I think it could have been handled much better if senator feinstein and senator grassley would have before this all got started sat down and, you know, tried to get a hearing. Tried to i said before, have an fbi investigation for a week, and then you roll this out. And, you know, dr. Ford could have been heard. Might not have been as big a secretary ank spectacle and wouldnt have the acrimony you have now. The political gain, i think, if you look at some of the individual house seats, i think its going to be not great for some of these house members that you see the polling says that, you know, women who are extremely motivated or more motivated. Some of the house seats are going to tilt a little bit. And i think some of the senate seats may tilt further to the other side here. Theres no winners overall, but if youre looking at political score, its going to be a wash. Angela, ive heard some smart people say, smarter than me, that anger is a real motivator. In effect, in the end, the side that lost will be more motivated to vote in the mid terms than the side that in a months time, the news cycle is pretty fast in this environment. But in a months time, the democrats, because they feel they were wronged here, will be more motivated to come out and vote. Yeah, and i think that part of it for us, for the progressives among us, i think the real question has to be, and then what . So there were a number of people who were urging people to call their senators, to make sure they voted appropriately. And then i would say and then what, right . So Susan Collins is someone that people were hoping would remember her womanhood before she remembered her party. That didnt work. So the question again is, and then what . So you have to ensure that when you turn out to vote, youre voting for people who share your same values. This process has resulted in folks overwhelmingly sending in money, contributions to Susan Collins opponent, who does not yet exist, right . So the question really becomes, how do you stay engaged and motivated in ways that hold your elected officials accountable, not just to get your vote, but to also support your positions on policy priorities, which i think is the longer the longer term question we have to answer at large. No opponent yet, but susan rice floated as a name out there. And reneged. A couple years from now. I would love to see that. Jackie, the other head line number here is President Trumps Approval Rating going up five Percentage Points from 36, wihih was cnns low, now up to 41, more in the band of where his Approval Rating has lived, almost without variation or too much variation in the last couple years. Five points in a month. Striking because of the economy. Last week, New York Times story aside, was a very, very good week for him, particularly on trade. A lot of president s base. He has really made promises made, promises kept campaign. Novel no, that has been part of his brand. No, its great. Every rally. Right, exactly. So i think that in and of itself i think is why. And the economy is great. It continues to be great. And its striking that the president s numbers arent higher. Because of the economy. And while his party, particularly house seats, are struggling because of the economy. And in terms of when you look at the numbers for kavanaugh, i do wonder how that looks in red states. I do think its a much different picture in red states, particularly where these democrats are running and took some votes and know they might end up paying for. You mean different worse for democrats. I think it might be worse for democrats in some of these states where there are more republicans than democrats. And youve seen some evidence of that, for instance, in heitkamps race. Missouri, other swing heitkamp knew what she was doing going in. I think well see with joe manchin. That will be the litmus test. Whether joe manchin pays a price or not. To angelas point, what now. Do people show up at the ballot box in West Virginia . Democrats take him to task for it, or do people look the other way and vote for him . And do republicans keep up this energy, right . Because people usually dont go to the ballot box to say thank you. Judges, especially. They won. So can this anger and energy keep up for four weeks . Goodness knows what will happen. The president certainly hopes so. Thats been a consistent message. Talking about impeaching judge kavanaugh in the next term, if the democrats take the house. But the president has said repeatedly in his rallies, listen, look at this like im on the ballot. Basically making it about himself. Winning strategy . It lines up with what were seeing in a lot of polling. This is something ive seen, the Pew Research Center asks every midterm. How much of your vote is going to be about the candidate and issues or how much is it going to be about showing a sign of support or opposition for the president . And this time around, you have an enormous number of republicans, significant majority, who say their vote is going to be about support for trump. Not about the name of the person on the ballot. Not about the issues that they may be talking about locally. That its going to be about trump. And the same thing for democrats. Theyre saying, look, whoever is on my ballot, love him or hate him, im sending a message this is about trump. Which is why to the point about the house and senate being so different, thats bad for these House Republicans in districts Hillary Clinton won. And there are about 23 of them. Democrats only need 24 seats to take the house. Scary stuff for republicans in the house. But the senate, that map is so red with so Many Democrats who are having to thread that needle. Conventional wisdom, granted, wrong all of the time. But that you could have democratic gains in the house and losses in the senate. As an outcome. Yeah. Well see. You guys are both involved floridan involved in the florida race. Those are the kind of seats that are kind of on the razors edge and well see come election day what happens. I think another important piece of this, if they havent been voting before like in the florida primary where there were 150,000 new voters just in the democratic primary alone, that can very well tilt things. You might have some happy republicans who still get outvoted. You have seen a big uptick in democratic registration in the governors race, as well. Absolutely. Senate majority leader, Mitch Mcconnell, just moved the bar, saying that if another Supreme Court vacancy were to come up in a president ial election year, he might try to fill that seat. Are you saying that if President Trump the answer to your question is, well see whether theres a vacancy in 2020. Just two years ago, you may remember, mcconnell bragged about holding up president obamas nomination of Merrick Garland, because it was during a president ial election year. One of my proudest moments was when i looked at barack obama in the eye and i said, mr. President , you will not fill this Supreme Court vacancy. David irwin, can i get you to admit that there is some dirty political pool going on . Yeah. This is, you know, hard ball or sharpelbowed politics, right . I dont think there will be a vacancy. I dont think anyone is going to go. But Mitch Mcconnell could take pride in the fact that to the detriment of all other nominees that are waiting, 300 nominees waiting in the senate, he has put two Supreme Court justices on. 26 judges on the court of appeals. Ten were waiting to be confirmed. And 40some District Court judges. Unprecedented injunction with President Trump. And so hes rightfully so kind of taken a victory lap. And look where is his credibility . Completely understand. I think he feels pretty emboldened, and his legacy will be that this court the Supreme Court, the district the courts for the next generation will trend republican. They may not be able to move legislation, but theyre moving judges. Angela rye, your response. Yeah, i think that we already knew what Mitch Mcconnell stood for. I think he was very clear at the outset of of obamas tenure, and that was his primary focus, was to make barack obama a oneterm president. So, of course, he wasnt going to be useful for helpful in moving anybody along. I would take it further than Merrick Garland, who it took more than 400plus days to even get a hearing and still didnt get the hearing. Theres no surprises here. I think the reality of it is thats exactly why the poll numbers are where they are for republicans. Thats part of the reason why Donald Trumps Approval Rating is higher. And i think our reality is, you speak of sharp elbows in politics, its time for democrats, and sorry in this context im not using genderspecific, but its time to man up. Meaning we have to play hard if were going to move the needle politically. Where does this leave the court . I spoke to republican senator john kennedy last week, republican member of the judiciary committee, strong supporter of kavanaugh. And he said, listen, at the end of the process that americans equate the Supreme Court with politics by another means, where does that leave the institution . This has been sliding down this hill for some time. Now youre in a place, 5049 for a lifetime appointment, and the American People look at it from two very different ends of the spectrum. You know, but it cant go unmentioned that democrats typically dont vote because of the court. That is not a motivating factor in the democratic base. They havent been able to make them care about. The same way republicans do. Republicans go to vote, because the Supreme Court justices. Thats one of the reasons donald trump is president. Because thats something that publish the list. Right. Thats something if its right, wrong, that is right now, that is not i mean be, and you can if im wrong, please tell me. Its not a motivating factor right now. It hasnt been. Maybe it will be now. Perhaps. Well see. The changes of norms or im going to use the process to my advantage. The letter if not the spirit of the law. I dont think republicans actually paid a political price for Merrick Garland. And so theres no incentive in that case. If voters arent holding you accountable, if youre not getting voted out of office for that, why change . And i think the donald trump era has brought about a lot of shredding of norms, things that began before donald trump came the elimination of the filibuster for judges happened under harry reid. It didnt start with donald trump. But what donald trump has been able to effectively say to republicans is, would a more conventional Republican Administration maybe have backed off the kavanaugh nomination . Ooh, well, lets put somebody else. Where the trump style of how you do things is keep going and dont apologize. And that just put someone on the court. Any president has to get 60 votes for a justice or a judge. Youre going to have a more moderate nominee. And so as long as that rule stays in place, no matter who who the president is, theyre going to pick somebody that goes to either the left or to the right. You dont need to pick someone political incentive. There you go. What majority leader of either party is going to change it to 60 now theyre not. Youre going to want to revenge. Thats a huge problem. And its going to be i mean, no one has sort of learned that its not this sort of what aboutism. Right . And thats how the senate is right now. You did this, so were going to do this. And until someone makes that stop, which i dont see happening any time soon when that rule change is taking place, institutionalists from both parties went to the floor to bemoan the change. Democrats and republicans went to the floor to speak out against it. And unfortunately, it went through and passed. And thats the problem for america. With this, you have a whole host of decisions coming up to this court that affect peoples lives. Whether its gun control legislation, president s ability to avoid prosecution while in office, and crucially, roe v. Wade, possibly. How can you expect the American People to respect those or a large portion to respect those decisions if they imagine the court is purely just politics by another means . Its going to be problematic. And i think a lot of it is up to these politicians, how they cast the court. If you have a bunch of democrats going out there, after after this election and talking about the court not being legitimate, youre going to start hearing that reverberate through the base. I think were at a really pivotal time right now. John roberts, right . You often hear feels he wants to rescue the court from that. When most people are thinking about the Supreme Court, they think about highprofile issues, roe v. Wade, voting rights, et cetera. An awful lot of what courts do are not the headline grabbing issues. A line that stuck out to me, when she said then judge now Justice Kavanaugh and Merrick Garland voted together 93 of the time on the d. C. Court. So, like, i think that theres a lot that we talk about in terms of the courts about the political issues that are hot buttons. But a lot of what these courts do a lot of people dont see. 7 is crucial, because in one of the things that you didnt just mention is even like the collective bargaining issue that was just before the Supreme Court. Those are major, major issues. And i think we do have to start paying attention to them. To your point, i have no answer. The milliondollar question. Citizens united, redistricting. A few days ago, he thought he was going to be fired. Now Deputy Attorney general, Rod Rosenstein and President Trump appear to be bffs, according to the president. Do we know whether his future came up at all in that conversation . Reporter well, we know right now hes still the Deputy Attorney general. And according to President Trump, they had a great talk. The white house says the talk lasted for about 45 minutes. They discussed a myriad of issues, one of them being general doj business. We dont know if that means the russia investigation or the palm shell reporting that Rod Rosenstein debated wearing a wire when he met with the president. Right now President Trump is keeping the readout of that meeting to just one word. President trump putting the speculation about firing his Deputy Attorney general to rest today. Despite a dramatic showdown weeks ago, where rosenstein offered to resign, trump says he has no plans to oust the man in charge of the russia investigation. There has been no collusion, folks. No collusion. And but i have a very Good Relationship. Reporter amid a bitter fight over the confirmation of President Trumps second confirmation pick who hell reportedly swear in tonight, the president arguing calls to impeach Brett Kavanaugh are an insult to the American Public. The American Public has seen this charade, has seen this dishonesty by the democrats. Reporter after once saying he found professor Christine Blasey fords testimony compelling, trump now saying her allegations remain manufactured by democrats. It was all made up. It was fabricated. And its a disgrace. Reporter the president predicting democrats will pay a big price in the midterm elections. I think a lot of democrats are going to be voting republican on november 6th. Now were going to see the president make Brett Kavanaugh front and center during all of those stops hes got planned this week. Thats what hes been doing so far. Clearly seeing this as a winning political issue for him. But first, hes going to take one more victory lap when he swears him in during a ceremony here at the white house tonight. Just a reminder of some of the things hes said in the past about the Justice Department. One, the top leadership and investigators it of the fbi and Justice Department politicized the secret investigative process in favor of democrats and against republicans, something which would have been unthinkable a short time ago. Another one, the top leadership, i am being investigated for firing the fbi director by the man who told me to fire the fbi director. Witch hunt. , that a reference to a memo firing james comey. At the time the president said it was about the russian investigation. Is this a kiss of death to say we have a great relationship before the inevitable departure . I cant tell. Maybe they do have a great relationship. Maybe they dont. But youre right. Whenever he says they have a great relationship, that person is probably looking over their shoulder. But i think there is an assumption that after the mid terms, Jeff Sessions is gone, the attorney general. Will he clean house . Thats an open question. But certainly the kavanaugh hearings and all that went into it, bought rosenstein some time. David, this kind of thing happens when the president neils feels he halls the political fooding to do it. Energized by Brett Kavanaugh, and the economy, et cetera. He wouldnt have taken him on the train. As you have seen before, youre good until youre not. So i think that the notion hes going anywhere any time soon isnt realistic. The president realizes there is a whole bunch of people behind Rod Rosenstein. The solicitor general moves up. Theres lots more lawyers behind him. So i think hes fine with keeping him. Rod rosenstein simply at this point when the moul investigation wraps up, will probably hand it off to congress. Not a lot of discretion for him. Its the devil you know and the devil you dont. Kristin, listen to how he began his answer. I actually have a Good Relationship, other than theres been no loougs, folks. No collusion. His mind immediately went to the focus, or one focus, of the investigation. Sure. Thats busieiggest complaint. He said there should be no reason for it to continue. I have always thought that the New York Times report that sort of kicked off this latest round of drama around rosenstein about the did he say that we should invoc was it the 27th amendment . 25th. 25th amendment, sorry. Does he wear a wire . I always wondered, was there going to be a chance the Deputy Attorney general could sit down and go this is two entities the president has had lots of twitter anger for. Colliding with one another. I thought there was a decent chance he would come out in a f feud of the New York Times. Fair enough. That came on the heels of the New York Times oped, you know, anonymous oftnone oped. We know that those two things got under the president s skin, right . Has he forgotten . Can we believe that . I dont believe hes forgotten it, but he tends to be i am pe impulsive. Perhaps things are going his way when it comes to rosenstein. Maybe it lessons the danger for him. I think in the moment, though, it had perhaps the kavanaugh hearings gone a little more smoothie, i dont know. We might be in a different place. Its hard to say you have cant try to predict. A losing battle. Angela. I think the thing that we have to Pay Attention to here is, well, you talked about the layers of lawyers. There has to be some lawyer in the white house who told him not just optically, but criminally, this could create an issue for him if he were to release Rod Rosenstein. Its its not just the confirmation process. Its coming directly from the commanderinchief. Somebody had to flag that. Ive got to believe thats the thing. But hes gotten advice before and not necessarily followed it. The president has been very critical of both, you know, the attorney general and the Deputy Attorney general on twitter. But if he wanted to, he could have pressed send on a said, youre fired and sent him backing a long time ago. He doesnt done that. Beats him up with a baton and lets him remain in place, but hasnt canned either. And what signal does he take from the mid terms, if its a look, hes missed a chief of staff, Reince Priebus is fired by tweet im saying, he knows how to fire people when he wants to. All right. So well give him a couple weeks reprieve and check back in. Looking ahead, some potential 2020 democratic president ial candidates visiting some very key places across the country. That said, there is no question that cory booker is here in iowa. His first visit as a wouldbe president ial candidate to lay the ground work in case he does decide to run in 2020. And hes doing all the things here that you would expect of a possible potential president ial candidate, raising money for iowa democrats, campaigning with them. We rode along with senator booker and congressional candidate jd shulton, challenging steve king, and booker spent 45 minutes on the road instagramming, deejaying, having a great time talking about iowa. And they were on their way to an event in boone, iowa, with a bunch of farmers. And i want you to look at the reception cory booker got there when he talked about running for president. My chief of staff wouldnt let me come up here to iowa because he said people would be talking about president ial stuff. [ laughter ] reporter so a lot of laughter there from that crowd, and also, you might not have heard, a lot of applause that followed that, as well. Im not sure if you could see in that shot, jim, but the room was packed. I was told it was double capacity. People were literally in the rafters, wanting to talk to cory booker. A really positive reception for him there. By the way, as i mentioned, a lot of farmers there. Theyre getting ready for harvest here in iowa. You could see that cory booker is planting some seeds with his visit. Jim . Planting some seats. And in the midst of a trade dispute with china, theyre watching closely. Rebecca, thank you very much. Back with the panel. The folks in iowa, in the last week, only, cory booker, camilla harris. And Michael Avenatti in ohio last friday. Different places, jim. Ohio and iowa. But they are key states. Two northeasterners. But no, to your point. Those are also two states where there arent really Competitive Senate seats this cycle. Usually some of these other senators have been going and helping out gubernatorial candidates. Going where their Senate Colleagues might need a boost. These trips seem to be a little bit more about the future. And, of course, they are with house candidates. They are that is true. But theres a secretary of state race, too, in iowa. And i cannot think of her last name, but her first name is desiree. Historic she was an africanamerican who won in the primary. There is also that seat that normally we dont atpay as much attention to. You see folks clearly testing out messages for the 2020 campaign. Cory booker speaking specifically to Political Division in the country. Have a listen to his part of his stump speech. Im going to be continue to be a voice in this country for the love, bringing the nation together, not driving the nation apart. Trying to create a more courageous empathy in this country. Where republican and democrat, whatever our diversity is, we dont fall into tribalisms, we work together. Thats what america does best. Winning message for the democrats . I would like to just run cory bookers questioning of the Senate Judiciary committee backtoback on that piece right there. Look you should. I think it stands up. He was talking about trying to unite people. His questioning was not wasnt so conciliatory. Look, i think one of the things the democrats did learn from republicans this last election, there was a huge republican field. You had the big table and the small table during debates. And i think its clear that if you dont make the big table, youre never going to make president. Youre not going to be a nominee. All these candidates are wisely getting out, trying to get their numbers up early so when the early polls come out their numbers are high enough that they make the main debate. Early in the evening, theyre not on at 11 00 at night. Not on the fringes, right. I hear you. Although, listen, when you look at past president ial cycles, some prices came through. Would not have said obama was a front runner in 2008. Im saying how the rules are structured. I hear you. You have two tiers, a main card and under card and definitely on the main card. These folks are trying to get their numbers up. I get it. Kristen . If you are a democrat and ever thought once maybe, kind of, possibly about being president of the united states, now is the time theres no reason not to. You know, that you never know when youre going to wake up in the morning and President Trump has decided to point his twitter feed at you, which can put the spotlight on you, and perhaps lift you a couple poll points. This is such a such an i think open contest on the democratic side that there is no reason not to run. And ill say one nice thing about a democrat who his name has not been brought up, amy klobuchar. If there is anybody who came out of the whole kavanaugh process looking better, it might be amy klobuchar. He complimented her. He apologized and complimented her by saying thank you for asking good questions today. Youre right, i dont actually think that he is 100 the best messenger for that. But i actually think she could be, if america was looking for kind of a no drama president. Ive got to say, i really disagree with that. And ill say, before this what people are deeming as a 2018 prerun in 2020, he was saying the same thing on my podcast last year. I was trying to get him to let me say, i dont have to like the president if i dont think hes human enough, right . And he was like, no. Hes still human. Still a spirit of love. That is definitely his posture. He also has a right to be an advocate for people who dont have voices in a Senate Judicial nomination process. I dont think that makes him divisive. I think that makes him a candidate. And we would be remiss if we did not acknowledge the very Critical Role that Kamala Harris played in not just that nomination process but several others throughout the year. So not the antidote, but the flip side to cory bookers message, unity, love, et cetera, Michael Avenatti, who has recently announced his own aspirations for president. He talks a lot about how the democrats have to sort of, you know, sharpen their nails, as it were, fight back. Heres his tweet responding to cory booker. I have a lot of respect for cory booker, but we are very different. We have very different views as to how to solve the crisis of donald trump, and the Dumpster Fire of his presidency. Firewithfire. His argument, jackie, we have to take our gloves off just the way President Trump has. And there are democrats who think that. Now, traditionally, democrats arent big celebrity candidate people. No i mean, unless maybe oprah gets in, i dont know. But i think he has you hear that. You see that on twitter. You see it on you see it out there. But i just dont know if thats angela could speak to this more than i could. I dont know if fighting fire with fire is what democrats are going to want in 2020 in their nominee. So the critique this is a critique, there is no message. Youll have tom steyer, howard schultz, michael bloomberg, bernie sanders, elizabeth warren. A lot of folks we havent heard from yet. Big field. Yeah. I think that i would like to see fire fought with fire, but im not the only one, apparently. And i think that the reality of it is, there are some candidates where thats possible. Michael avenatti, probably because a lot of people are like who is Michael Avenatti. Im not sure there is anybody in america that says that any more. I think there are several you would be surprised if you talked to some folks that dont watch cable news as much as were on, david. But there are a lot of people and its no shade to the network. But there are a lot of people who dont know who he is. I think the other important thing for us to consider is people need to have a record. People need to demonstrate they can bring folks together and actually move the needle on policy that Americans Care most about. Avenatti did not have a particularly good last couple weeks when you get to the kavanaugh confirmation. Kristen, quick final thought. Yeah. I think Michael Avenatti is very popular among a segment of democratic voters who are very, very, very plugged into what goes on on this network and other cable news networks. Just moments ago, we heard an update from investigations into the terrible limousine crash that killed 20 people in upstate new york over the weekend. Miguel marquez is live in amsterdam, new york, where a vigil for the Crash Victims is scheduled tonight. Miguel, just a horrendous personal toll for the people there. We learned now that police have talked to the limo company that now seized vehicles from the company. Are they saying that the company is responsible . Reporter they arent saying that yet. They are looking into several different agencies from the fbi, ntsb, new York State Police, department of transportation, all looking into this. Department of transportation says that this company has been scrutinized before for its practices. The owner of the company has been located. Hes in pakistan. The company is cooperating with investigators. But this accident has just left an absolute hole through this small town in upstate new york. Just wonderful, kind, loving. Reporter family, friends, an entire town reeling after 20 people died in a single car accident. One of the couples killed leaves behind three children. All under 5. Just pray that theyll have lots of people to support them and remind them of how wonderful their parents were. Reporter 17 of the victims all from the same small upstate new york town of amsterdam. Young couples, some recently married, all now dead, after the modified Ford Excursion stretch limousine they rented sped through an intersection, hit a parked car and crashed into a ditch. The driver and two pedestrians also died. The 17 friends initially rented a bus from Prestige Limousine Chauffeur Service in new york for a daylong surprise birthday party. The bus broke down and the company sent instead a 2001 Ford Excursion that had been modified into a stretch limousine. A relative says the victims were suspicious from the start. My niece instinctively had thoughts that, geez, this is, you know, this is not good. You know, what they sent us. I guess the first vehicle broke down. And they sent them another vehicle. Reporter investigators now looking into the driver, the company that rented the vehicle, Road Conditions and the intersection where the accident occurred. State route 30 and 38 is a tbone intersection. Route 30 is a steep hill, leading to the intersection with only a stop sign. The driver may have been driving as fast as 60 miles per hour, when he went through the intersection, finally coming to a stop in a ditch next to a restaurant. We dont yet know the cause of the accident, if it was a vehicle malfunction, if it was a driver malfunction. Driver error. Thats part of the ongoing investigation. Reporter just last month, the vehicles chassis, suspension, brakes and overall systems were tested. It failed that state inspection, and the driver should have had a cdl or commercial drivers license. He didnt. I think the owner of this company has a lot of questions to answer. Theres an ongoing investigation. But is there a possibility of liability . Civil and criminal . Certainly. Reporter and now new York State Police say that criminal charges are certainly possible in this case. Investigators have the black box of the vehicle, also the module for the air bags, which should give them some information about how this took place. And autopsies on those 17 people that were in that vehicle are still ongoing. Jim . Just heart breaking. So many families involved. Miguel marquez continuing to follow that story. And the world could face disastrous levels of Global Warming if nations do not make drastic changes within the next 12 years. Cnns nick watt joins me now live. Nick, one of the most shocking parts of this report is just how soon these experts are predicting that we could see major changes. In effect saying time is running out to address this. Absolutely. Listen, jim, Climate Change warnings often seem far off and hard to imagine. But not today. This morning, the u. N. s Climate Change panel released what its authors claim is the most important Climate Change report ever published. And theyre telling us we need, quote, rapid, farreaching and unprecedented changes in all aspects of society. Deadly wildfires from california to greece, that recordsetting rain just dumped by Hurricane Florence on the carolinas, droughts crippling cape town, south africa, and heat waves turning europe brown. And now we have only 12 years to stop all this, getting much worse. Average temperatures have risen about 1 degree celsius since 1880. In paris, leaders pledge to keep the rise well below 2 degrees. This report now suggests we aim for 1. 5, a benchmark were predicted to reach by 2030. The message is that countries will need to cooperate. Yet President Trump is trying to revive the polluting coal industry here in the u. S. Hes also pledged to withdraw from the historic paris Climate Change agreement, and recently rolled back obamaera targets for cutting vehicle emissions. They really benefit a tiny group of fossil fuel companies at the expense of the American People. From the standpoint of getting the whole world motivated to actually make the changes that would be needed to meet the goal, we have an awful low long way to go. The arctic, already at record low ice levels, as seen in this nasa image, will be totally icefree on average once a decade instead of once a century. All of the worlds coral will completely disappear and wildfires and flooding here at home will be even worse. We havent heard any reaction to this report yet from the Trump Administration, but we did hear from former Vice President al gore, who said that the Trump Administration is, quote sorry, has, quote, become a rogue outlier in its shortsighted attempt to prop up the dirty fossil fuel industries of the past.
