This duty of congressional oversight. Supposed to be bipartisan. But all that said, in a move that republicans are calling odd at the very least the white house also chose today to send to those briefings chief of staff john kelly as well as this man emmit flooded. Kelly and flood. Flood as you may real a member of the team defending President Trump in the russia information. In fact, on may 2nd joining the White House Counsels Office Sarah Sanders said flood, quote, joining the white house staff to represent the president and the administration against the russia witch hunt, unquote. Sources tell me that kelly and flood attended the very tops of both meetings and left before classified matters were discussed. The White House Press secretary Sarah Sanders just issued a statement saying, quote, nearly kelly or flood attended the meetings and did make brief remarks before the meeting started to relay the president s desire for as much openness as possible but on capitol hill people are stunned. A staffer said the presence caused everyone to be sort of aghast. After all, flood is the lawyer defending the president. He has no oversight role when it comes to the case built by the fbi and special counsel mueller. Floods only job is to defend President Trump in this very case. And in fact, this afternoon Rudy Giuliani, another attorney defending the president in the russia probe, told politico that the briefings will inform the president s legal defense. Giuliani said, quote, we want to see how the briefing went today and if we learned a good deal from it, it will shorten that process considerably, unquote. Now, behind the scenes democrats are outraged by all of this and even some republicans are expressing a concern, one republican congressional staffer spoke to me about flood attending the starts of both briefings using language that parents, mute the televisions, a republican staffer told me its craziest shit i ever heard, unquote. We have analysts and reporters to discuss this and the president s shall we say norm challenging defense. First capitol hill and congressman schiff just spoke moments ago. Lets take a listen. Good afternoon. I wont be able to take any questions today but i have been asked to read a brief statement on behalf of leader schumer, leader pelosi, vice chairman warner and myself. Todays gang of eight briefing conducted to ensure protection of sources and methods. Nothing we heard changed our view theres no evidence to support any allegations that the fbi or any Intelligence Agency placed a spy in the Trump Campaign. Or otherwise failed to follow appropriate procedures and protocols. Thank you. Was it appropriate to have emmett flood at the meeting, sir . I want to bring in Cnns Phil Mattingly on capitol hill. Phil, are any of these lawmakers revealing what was said behind closed doors and are any of them expressing publicly what they have expressed prooitly ivately terms of how surprised they were the president s lawyer on the russia probe attended the starts of both briefings . Reporter yeah. This is the most we have heard from just about anybody in the meetings including the second one that just concluded and our colleague spoke to senator wa warner and said never seen a gang of eight meeting with a presence of the white house. Those individuals left before the substance of it. Unusual times. So, pretty much, jake, what you were saying, maybe less colorful and ive heard from aides and sources saying at one point in one of the meetings lawmakers didnt know who emmett flood was until he introduced himself and given no heads up he would be in the meetings themselves and a complete surprise. Now, as you noted he didnt stay for the classified portion and an interesting element, jake, im hearing more from republicans than democrats who are concerned about the appearance of this and what this will mean going forward. Behind the scenes, last 24 hours, Republican Leaders on capitol hill pressing the white house, pressing the Justice Department to have a second briefing to make it bipartisan. Senate Majority Leader Mitch Mcconnell said of richard burr instrumental to getting that second gang of eight meetings and leaders and the committees themselves and just the presence is enough to undercut the efforts, jake. All right. Phil on capitol hill for us. Now the Justice Department finding cnns laura jarrett. Youre the one that first spotted white house lawyer emmett flood at the first briefing there. Republican senator graham told pbs quote odd for the president s lawyer on the russian matter to be there and he wanted the know more about why that was, what the reason was that he was there. Whens the Justice Department have to say . Well, the Justice Department is radio silent here tonight, jake. But i have to say it was certainly a surprise spotting for all of the reporters gathered here at the Justice Department today. He was not on the list of invitees that was circulated late last night by the j. But of course, the guest list itself something of high drama. Changing hour by hour earlier today and the white house put out a statement saying theres nothing to see here. Flood an kellys attendance merely to ensure transparency. But of course, flood is not just any regular white House Counsel junior lawyer. Hes a key member of the president s legal team as the russia investigation progresses and of course the entire purpose of the briefing was to gain more information about a source that was used in the russia investigation and you have to wonder and legitimate questions are being raised on capitol hill, of course, tonight, about whether this was a congressional oversight activity or Something Else entirely, jake. All right. Laura jarrett on the Justice Department forus, thank you so much. Lets bring in my panel. Lets remind everybody and, Jeffrey Toobin rkt l, lets stah you, Rudy Giuliani told politico theyll try to find out as much information as they can about these classified briefings and use it for the president s legal defense. I was stunned when i heard that emmett flood attended even if he wasnt there for the classified part of it and heard the Congressional Republican staffer saying its craziest thing hes ever seen or ever heard. What was your response . Well, the fundamental question about this part of the investigation is, is this a good faith effort by congress to determine whether there was some unfairness in the fbis investigation of the Trump Campaign . Or, is this simply a political exercise to defend the president . Thats those are sort of the two poles of views here. If you have the white house chief of staff and the white house lawyer in charge of defending the president at this briefing, it sure suggests that this is much more of a political effort to defend the president rather than a fact finding enterprise. What is Rudy Giulianis comments even more so reflect that view. Josh campbell, let me ask you, moments ago senator warner, Senate Ranking democrat on the Intelligence Committee saying in an understatement, never seen a gang of eight meeting with a presence of the white house. Those individuals left before the substance of it. Unusual times. The gang of eight, congressional leaders that deal with intelligence. It is a four republicans, four democrats, four members of the house, four members of the senate and normally nobody from the white house would attend a meeting like that. What is your reaction to the fact not just somebody from the White House Counsels Office, one could make the argue that don mcgahn, you know, has a role of making sure that the Justice Department does its job, but specifically, flood brought in to fight the russia probe. What is your response . The white house and congress both have is a polarization problem, a perception problem. Start with polarization. If you look throughout history, you talk addnt it in the 1950s, the swampy nature of the city and then the 70s the Intelligence Committee established for oversight of the Intelligence Committees responsible for the sensitive operations and technically, you know, the norm was it was nonpartisan and that existed up until now and now you see both sides that cant look at the same piece of intelligence without coming to a different conclusion and as evidenced look at the memos. Nunes memo, schiff memo. Differing views there and not the way it should be. And fast nauforward to the perception problem. Learning anything we have to have the leaders together. We have to have them united and sitting in the same room and in the polarization, you know, time now and really going to be tough for the Intelligence Committee to do the job knowing that the leaders arent on the same page and the white house injecting themselves in this and even if this person not there for malicious or reasons that were, you know, improper, theres the perception and end of the day we need the American People to have confidence in Law Enforcement and congress and our leaders and we dont do that by taking a conflicted party whose job is to counter these allegations of russian interference and interject them in a room of highly classified information to be discussed. And, Jeffrey Toobin, why send emmet flood . Kelly could have gone to both meetings and said if the white houses explanation of what this was about is the truth and i realize thats a big if these days, but if its true and john kelly wanted to say the president wants there to be transparency, cooperation, whatever, fine. Why send the point man to defend President Trump on the russia investigation . Because of the reason Rudy Giuliani said. Because they view this as an attempt to gain facts that will help them exonerate the president. They are advocates. They are partisans. They are using every tool at their disposal, including information they can gather from this briefing to help xn rate the president. Thats the only reason i can think they were there and Rudy Giuliani told you thats why they were there, because they want to use this information to help the president. Of course, nobody in that room is supposed to share the information, josh campbell, although obviously the Intelligence Committee chairman in the house devin nunes republican of california very close ally of the president and not supposed to tell anybody what he learned. Thats right. His credibility on this issue is pretty much shot from the time of the infamous midnight run meeting with the source in the white house and injecting himself in the process. He is the chairman of the house Intelligence Committee, a powerful committee. He should not be inappropriately sharing information and again it goes back to perception. Even not doing something wrong the perception is bad in and of itself f. Youre krchristopher wray or Rod Rosenstein and meeting with members of congress, you have to go in there thinking anything that i say here may make it out into the airwaves by the time i get across the street to fbi headquarters. Thats not a place for officials to be in and inappropriate talking about sensitive methods and stay tuned to see if we hear rumbling of the meeting. Stay with us. Well have more on the story next. Welcome back to the lead this afternoon white house chief of staff kelly and lawyer flood in the white house to fight the russia probe, the two men joined the beginnings of two classified briefings by the department of justice concerning that fbi confidential source who spoke to members of the Trump Campaign in 2016. My Political Panel joins me now. Bill kristol, this is exactly how floods hiring was explained by press secretary Sarah Sanders may 2nd. Flood joining the white house staff to represent the president and the administration against the russia witch hunt unquote. Minutes ago the white house released a statement on the attending the briefings saying, quote, they did make brief remarks before the meeting started to relay the president s desire for as much openness as possible. I know there are a lot of people on capitol hill, democrats and republicans, stunned he showed up. What do you think . Well, its stunning but everything is stunning with this white house and the total collapse of norms and procedures that tried to preserve distance of the white house and the Justice Department, politics and law, between a president certainly one whos being investigated keeping his personal defense team separate from official government business. Senior congressman briefing the white house on things they have learned and circumstances where presumably in this case the president was parts of the team subjects of investigation, briefing the subjects on stuff he learned, this is nunes, in the house Intelligence Committee. This is an instance. In a way of sending i say the charitable interpretation, it started with trumps tweet over the weekend saying i hereby officially demand something. They kind of got him to back off that a little bit. Sounded luke a memorandum to Rod Rosenstein monday and do the things. It ended up being a meeting. Maybe kelly and mcgahn, the white House Counsel, to convince the president well go to the meeting and represent you strongly and maybe you could be charitable saying theyve managed to make this a tollerible version of what seemed to be something really inept that trump demanding or theyre sending a signal to the followers out there theyre beating up the Justice Department and this witch hunt and they have just further laying the predicate for discrediting anything mueller comes up with or firing rosenstein. Kerstin, press secretary sanders originally said no one from the white house to attend the meetings. And then, of course, now we have Rudy Giuliani telling politico that depending on what they learn from those meetings even though flood and kelly werent there for the classified part of it, it affects the defense strategy. Your reaction . This seems utterly corrupt to me. Defb nunes anywhere where devin nunes is, somethings not going right and basically a stooge of the white house. We saw that early on and, you know, hes repeatedly released the memo, we were talking about seems like 100 years ago and did the nunes memo. Right. Released and just prove all these things that it never proved and in fact it was said things that werent even true about the dossier and in terms of what was you know, the fisa court told. Donald trump tweeted afterwards he was completely vindicated and a game where they use devin nunes to go out and do their bidding. I dont know why. I havent figured that out why yet to say hes raising a ton of money off of it. In six weeks raised a couple Million Dollars and, you know, i dont know what his motives are but i dont think hes trustworthy and i think the fact the meeting started out today of being two republican congressmen and was a democrat added to it is itself sketchy. Why doing through this . Just get back to the fact of what are they investigating here . Nothing happened. Well, Rod Rosenstein said he was going to ask the Inspector General to investigate this, right . Rod rosenstein the Deputy Attorney general said after trump tweeted over the weekend, well, we will have the Inspector General look into whether there was wrongdoing or any way wi the fbi or within the Justice Department. Within that respect, this is all a pretty successful misdirection by the president. What is at issue is collusion in the campaign and obstruction of justice afterwards. That could be true or untrue regardless of the fbi made every decision perfectly in 2016 about what to say to someone who was part time telling them about some of their concerns about russian collusion. So hes got us talking about the fbi and instead of about the collusion an the obstruction of justice and in that respect this is success for trump. Exactly. All right. Everyone stick around. We have more to talk about. Part of the reason there were classified briefings today as kerstin was mentioning. Devin nunes. Thank you very much, devin, for being here appreciate it. Reporter California Republican in office 15 years and didnt gain notoriety until trumps Transition Team and then started making headlines as the head of the house Intelligence Committee. Thats where hes proven so value to believe the president amid the russia investigation. Nunes grabbed attention a year ago when he dramatically announced he had proof federal agents surveilled Trumps Campaign and promptly informed the president. I felt like i had a duty and obligation to tell him because hes been taking heat in the news media. Reporter critics suggested it was like given the police file to the subject of an investigation. Nunes walked it back a bit and not before widely sharing details. What i saw is has nothing to do with russia and nothing to do with the russia investigation, everything to do with possible surveillance activities. Reporter fellow republican mike rogers hit nunes fast saying when he was in charge of the same Committee Members worked to get facts in a bipartisan way. We didnt have press conferences about it and run out and say this happened or that happened. Reporter nunes stepped away from the committees russia investigation and pressed on in other ways, sharply suggesting the probe is a political witch hunt, pushing the idea that any real fault lies with Intelligence Services and digging for ever more information about the investigations. What they would like the information for is clearly service to the Trump Defense team and further the narrative they have. Reporter democrats responded with a scene from the movies. I dont think thats fair. Reporter erecting billboards accusing nunes of ignoring the people who elected him and when a newspaper asked of plans for any Public Meetings with his constituents, nunes responded. The other big breaking news story today is the world lead. Summit of President Trump and north Korean Leader kim jongun is off at least for now. Upset about comments threatening nuclear war with the United States and calling Vice President pence a political dummie, President Trump wrote earlier and scotched the june 12th singapore summit allowing that it is possible the summit still might possibly happen. President trump touted the military might of the United States threatening if things dont go well the u. S. Is more ready than ever before. Jeff zeleny from the white house for us right now. We are learning that a u. S. Delegation in singapore was stood up last week by the north Korean Counterparts . Reporter that is right. I came from a briefing here at the white house and a senior white house official walking through what he called a trail of broken promises in recent days about this. He said, one, secretary of state mike pompeo would not get the phone calls responded to by his counterparts there and was also talking about how the delegation was stood up in singapore to set up the meeting there. All of this is coming as the president left open the door to the possibility of that summit still happening but, jake, this senior white house official closed the door saying june 12th is basically ten minutes away. I believe that this is a tremendous setback for north korea and, indeed, a setback for the world. Reporter President Trump calling off talks with kim jongun today blaming the diplomatic collapse on north koreas hostility to the u. S. If and when he decides to engage in constructive dialogue and actions i am waiting. Reporter the president delivering the news in a onepage letter to kim citing tremendous anger and open hostility. The diplomatic words of disappointment followed by a blunt warning. You talk your nuclear capables, ours are massive and i pray to god they will never have to be used and the president expressing regret. Hopefully everythings going to work out well with north korea. And a lot of things can happen. Including the fact that perhaps and would wait its possible that the existing summit could take place or a summit at some later date. Reporter mr. Trump still clearly trying to keep alive the prospect of being the first u. S. President to sit down with the north Korean Leader but in recent week it is spectacle seemed to take priority over substance worrying many u. S. Officials. Never resolved questions of the commitment to abandoning the nuclear program. Still, the president spoke in measured tones keeping the diplomatic door open rather than returning to the roller coaster of red hot rhetoric on north korea. Starting with this. They will be met with fire and fury like the world has never seen. And then later belittling kim in a speech at the United Nations. Rocket man is on a Suicide Mission for himself and for his regime. Reporter but as the summit loomed, the president talked openly about winning a nobel prize. I would never think so. Reporter showering kim with praise after releasing three american prisoners. I think he wants to do something and bring our country into the real world. Reporter yet clear today that mr. Trump may not understand kim or his motives. Secretary of state pompeo who twice visited north korea to broker the talks said the counterparts fallen silent in recent days and voiced uncertainty of what comes next. Yeah. Some ways the situation normal. The Pressure Campaign continues. Jake, also, learning more information about that letter the president sent, that senior white house official whos briefing us earlier said the president dictated every word of that letter. At least thats what this official saying. One other point, also, the reason others surprised by this particularly allies in the region is that the u. S. Called them after that letter was sent and this is why apparently the secretary of state mike pompeo testifying on capitol hill this morning and wanted the letter out first and the news to hold and didnt share it with south korea or others until after they made it public. Jake . Jeff zeleny at the white house for us. Ivan watson in seoul, south korea, for us. And ivan, did the South Koreans have any inkling that the decision to cancel the summit was coming before it was officially announced . Reporter its certainly didnt look like it, jake. The president here moon jaein had to convene an emergency meeting of his National Security council shortly before midnight here in the hour after the news of the letter broke. And then shortly after that issued this statement, a statement expressing regret and saying it was unfortunate that the summit in singapore had been called off. Going on to write, quote, it is difficult to solve sensitive and difficult diplomatic problems with the current way of communication and urging all parties to improve their method of communication and recall that moon jaein, the south korean president , had just been in the white house on tuesday meeting with President Trump. These two allies urging President Trump to please go ahead with the meeting with kim jongun in singapore june 12th saying lavishing praise on him saying that he could be a man of history, a man of the moment bringing peace to the Korean Peninsula. But the South Koreans have been having own problems with the North Koreans ever since pyongyang cut off talks with them last week, jake. So theyre having a rough time with pyongyang right now, too. Jake . All right. Ivan watson in seoul, south korea, for us, thank you. Will ripley in north korea for cnn right now. One of a handful of western journalists at the apparent destruction of a Nuclear Test Site and the one who broke the news to north korean officials that President Trump had officially pulled out of the summit. Take a listen to will describing how that all went down. Reporter whip sitting around the table and i got the phone call and read out the letter from President Trump and i can tell you there was just a real sense of shock amongst the people that i was sitting with, north korean officials. Didnt give official comment but left and relaying the news up to the top. And imagine how theyre feeling at this moment given the fact that they just blew up nuclear site today as a sign they say of their willingness to denuclearize and to make a point as you said ahead of the summit june 12th with President Trump that until literally minutes ago they thought was still going to happen. Being inside this country hours after blowing up the nuclear site and learning of this, it was a very awkward and uncomfortable moment and we will have to see what happens in the coming hours and days on the ground here. Thats will ripley in north korea. The big now, of course, is this a negotiating tactic by President Trump, one that might actually work . President trump canceling the upcoming summit with north korea but leaving open the possibility of a future face to face feeting with kim jongun. Joining us is former ambassador to the United Nations Bill Richardson. He was the former governor of new mexico. Thank you for joining us. As always we appreciate it. What is your reaction to President Trump canceling the meeting . Well, big disappointment. Its going to be a setback for the peace process. Its going to increase tensions in the Korean Peninsula short term. I think the North Koreans overplayed their hand. This is how they always act, jake. Ive negotiated with them. Bluster. They threaten. They insult people. They should have kept their act together because what theyve always wanted is a summit with a president of the United States. And the president similarly i think has used as negotiating tact of walk away if you dont get your way and i think both sides had Unrealistic Expectations of what would come forth, end game, for the summit. Maybe it is a blessing in disguise. Do you fear now that north korea will ramp up its missile and Nuclear Tests because of the cancelation . I fear that. You know, they always overreact. Today they destroyed some of their nuclear facilities. You know, theyre going to say they released three american prisoners. That its okay to have military drills with south korea and then theyre saying, well, what have you done, the u. S. , to lessen tensions . This is how they think. They dont think like we do. I think short term they may do something provocative. Not serious. Provocative that would get a response from the United States or south korea. But this is not good. But i think long term this may be better because the u. S. Does not have consistent message. They should let secretary of state pompeo speak for the u. S. Because you had the Vice President , you had National Security adviser talking about libya, the response, kim jongun wont like that because gadhafi ended up dead after he gave up the nuclear weapons. So i think the administration will use this time hopefully to prepare, to be realistic about denuclearization. North korea was not going to denuclearize. They might be curbed the weapons, put a freeze on them, on missiles, but its still worth to pursue the summit from the top to the bottom as the two president s were doing. That would be my suggestion. Before all the talk of a summit, it seemed that the United States and north korea were headed towards a conflict of some sort. One hoped that it wouldnt come to that but bellicose. Are you afraid if north korea does something provocative President Trump might respond in kind and set the two countries back on an ugly path . Well, i worry about that because a lot of his advisers have talked about a bloody nose for north korea. Preemptive military strike. Thats not going to work and especially the biggest casualty is south korea. South korean president wounded politically with the cancelation of the summit. He worked so hard to make that happen. I worry about the president is very impulsive. I worry about his next tweet. I worry that we werent prepared for this summit adequately with a consistent strategy. Maybe if the summit is put off and i think cooler heads will prevail on both sides. They need to. Then maybe late in the year viable summit might take place but lower the expectations of what can be achieved but look. Ive been involved in this issue many years. Nothing has worked from the bottom to the top. The two president s meeting i gave the president credit for accepting the summit.
