Fact check, it is certainly not illegal and certainly the trump appointed Justice Department and Law Enforcement officials think that the investigation is warranted. The president also alleged today that a fbi informant on the Trump Campaign first revealed by the New York Times is a bigger scandal than watergate. Cnn White House Correspondent starts us off and the president asked about north korea and based on the tweets hes clearly focused quite a bit on the russia investigation, as well. Reporter he is. What answer you get, jake, depends on whether or not the president in public or private. In front of the cameras, the president offering very measured responses and in response to north koreas threat to call off that summit but in private the president seething about the investigation that he believes the a witch hunt. President trump expressing confidence and down playing north koreas threat to scrap the summit in singapore. Nothing has changed on north korea that we know of. If the meeting happens it happens. Reporter contradicting his National Security adviser while he was in the room after john bolton said libya could serve as a role model for disarming north korea. The libyan model isnt a model that we have at all when were thinking of north korea. This would be with kim jongun something where he would be there, running the country. Thats in place if we dont make a deal. Reporter boltons comments angered north korea. We may have the meeting. We may not have the meeting. If we dont have it, that will be very interesting. Reporter the president keeping the public focused on north korea as staff did their best to keep him from answering questions on special Counsel Robert Mueller on the oneyear anniversary of the russia investigation. The president will have press at the his event here shortly which is why we will have to keep it quick and short today and likely take a few questions at the event. Trump staying silent on mueller in front of the cameras but not on twitter fuming about the investigation calling greatest witch hunt in american history, bigger than watergate and despite all of that the most successful first 17month administration in u. Reporter just last week john kelly said it embarrassed trump when World Leaders came to washington, later saying the president is somewhat embarrassed, frankly, when World Leaders come in, the first couple of minutes to revolve around that kind of thing. Reporter now, jake, the president , the Vice President and aides publicly clamoring for the end of the investigation and reaching the oneyear mark today the aides privately realize that the longer it goes on the easier to dismiss it as a witch hunt. Lets start with the story that you broke with the white house taking stark measures in an attempt to cut down leaks and follows the leak thats one of the staffers kelly sadler made that sick joke about how john mccains vote against the cia nominees irrelevant because hes dying anyway. The argument made to me by a couple of people the meetings roughly 30 people or so. Canceled . They have been canceled. Daily coms meeting taking place as long as im aware, might have been one past monday and not for the rest of the week and a Smaller Group of about a dozen aides, more senior aides who meet and go over strategy. It is related to what happened last week. You know, there was that leak from kelly sadler and then sarah sanders, add monoirning the staff for the leaking and saying this will probably leak and a axios has a story. The president is frustrated about the leaks and talks about it and saying he has the Biggest Press shop an gets the worse press. Their fault, obviously. Not his. He doesnt seem to quite understand that the press is covering what he does and everything that they do is thrown by what he does. But i think you are going to see more of this kind of an effort Going Forward to try to streamline who is in what meetings. Clearly they think that the problem is not that kelly sadler would think its appropriate to make a joke about a war hero dying of brain cancer but that it leaked out. Right. Look. I think that they actually think that was not appropriate but i think the issue is they work for somebody who thinks that any acknowledgment of fault or of doing something that was mistaken or saying youre sorry is an exercise in weakness so i think even if people thought this was the worst thing to say in the world theyre never going to be allowed to apologize. However, people have the option of quitting. This is not compulsory work. Good reminder. Lets talk about the president s tweets today because this is the best direct line of the id to the rest of the nation. The president blasting the special counsels probe now heading into year two and noted theres no collusion and no obstruction. Do you think President Trump he constantly says this. We have no idea what mueller has and the conclusion will be but his repetition of this, almost like a mantra, do you think he thinks that he can convince the country of this if he just repeats it enough . Certainly some people. I spoke to a democratic pollster this morning told me in the surveys this person is seeing its convincing certain republicans, not just his base but a broader group. Theres planting a seed of doubt about this investigation. I dont think that he will convince everybody and i think that there are going to be people, obviously, his critics who believe even if nothing materializes related to him something but i think he is banking on a couple of things. I think he is banking on the idea of nothing shown to touch him personally an enif he keeps saying that it will color the issue one way or the other, talking about obstruction, thats the piece that mueller is very interested in on the president over the last year. Is whether he tried to obstruct justice. It is a main factor of why they like to interview the president because only the president in their rational as i understand it can speak to what was in the president s mind. The president also tweeted, quote, the obama fbi spied on the Trump Campaign with an embedded informant. Rudy giuliani brought this up. It started with the New York Times and quoted a government inform and met several times with two Trump Campaign aides, paige and papadopoulos. This seems like a fairly big deal and we should know more about this, this government informant. Is that the president calls it worst than watergate. Hard to make that argument. Hard to make any argument because theres a lot we dont know. Fantastic story by my colleagues, not my reporting. I dont want to speak too deeply about it. There are obviously unknowns related to it. I agree its something to raise questions for the president and the people around him. But he has always mixed in a leap to a conclusion and just nothing to support the conclusion. Something that the president if i were him to jump on it, too. Absolutely. And we need to know more about it. An then a third tweet calling the Mueller Probe disgusting, illegal and unwarranted witch hunt all part of the giuliani case making that the whole thing to be thrown out, trying to get it pressure on mueller before the president has forced in any way to sit down for an interview. Yeah. You have seen the strategy shift. The giuliani strategy is absolutely was giuliani pushing to get out the fact that the president reimbursed Michael Cohen. Did not thrill the president the way it was done and he did want that out and the president agreed. They are working on a strategy together. You will hear people close to the white house, close to the legal team say, you know, there are people who are doing the lawyering and then there are rudy and trump and that team is a pr war to your point. It is about coloring either the investigation or coloring peoples perceptions of it to try to put their thumbs on the scale about what happens with an interview. To be clear, might make people unclear because the president doing this and the president has not really strongly acknowledged that russia meddled in the election. Thats a nice way to put it. President trumps attorney Rudy Giuliani said hes assured that the special counsels office believe it is sitting president cannot be indicted and giuliani said trump cannot be subpoenaed the testify. Did mueller actually say that or might this all be a pr campaign to push the notion that the president cannot be charged and no need to sit down for an interview . Cnns sara murray joins me now. Giuliani saying the president wants to testify still, however. So many caveats, jake. The latest notion that the president cannot be indicted might be another excuse for the president s legal team to try to put off the special counsel sitting down with President Trump. Reporter a bold claim today from the president s lawyer. Rudy giuliani saying special Counsel Robert Muellers team has concluded it cannot indict a sitting president. All they can do is write a report. Right. How bad that is sure. We can write, too. Reporter giuliani telling cnn they cant indict, at least they acknowledge that to us after some battling. That conclusion from the special counsel likely based on longstanding Justice Department guidelines, not an assessment of the evidence of wrongdoing mueller collected. Observers wonder how much of the new push of Rudy Giuliani is based on attempt to get the president out of having to do an interview with mueller. Were demanding from him, tell us what you have to get from an interview you dont already have. Giuliani trying to lay the groundwork for the proposition the president doesnt have to testify. I dont think thats legally correct. Reporter at the oneyear mark, the special counsels team brought charges against the 2 people and companies, notched 5 guilty pleas and 1 person sentenced. A number of charges tied to russias interference in the president ial election and so far none of them extended to potential collusion of Trump Associates and the russians. Despite protests from trumps team. So its about time to get the darn thing over with. About time to say enough. We have tortured this president enough. Reporter theres little sign the investigation is wrapping up. Today, mueller filed a memo of federal court revealing just how broad his mandate is after the federal judge overseeing charges against former Trump Campaign chairman Paul Manafort demanded to see the document. But just how broad the scope of the investigation is thats for the judges eyes only. Mueller arrived at the nondisscript Government Office building this morning. The Team Continues to call in witnesses, covertly picking them up with a roving fleet of cars with tinted windows and whisking them out of the sight of the media. Now the Mueller Probe, of course, shrouded in secrecy and americans have differing views of the legitimacy of it and one thing overwhelmingly clear, looking at polling they want to know what mueller is up to and believe he should issue a public report regardless of what he finds. If President Trump cannot be indicted under this theory, can he still be subpoenaed and can he still be forced to sit for an interview . Of course he can, jake. Two very separate matters, if giuliani is to be believed that he believes that the only way to have a grand jury witness testify via a subpoena is if that same witness is going to ultimately be indicted you would never have a need for a grand jury. In fact, no grand jury witness would ever be somebody to testify because defendants dont testify in front of a grand jury. Only witnesses to support information or provide evidence in some way and so if you are to believe his really asinine remark then we should have no grand juries in this country whatsoever. Indictment is a very separate thing and its still an open question although the office of Legal Counsel has said that a sitting president should not be indicted. Opinions are not written in stone and the way that perhaps Supreme Court precedent may be. Binding until its not. It can be rewritten. Kenneth starr tried to do so with the clinton investigation and could be written of a focused inquiry and whether or not to indict a president or they simply not indictable. All right. The big question, of course, Rudy Giuliani, President Trump have this pr strategy while their lawyers and president s lawyers have the legal strategy. Is this a smart pr strategy . So were talking about Rudy Giuliani out there making the case very aggressively that since president s cant be indicted therefore president s cant be subpoenaed therefore President Trump cannot be forced to talk to Robert Mueller. Take a listen to Rudy Giuliani as part of this pr campaign. Tell us what you have to get from an interview that you dont already have because he has all the facts to make a decision. Smart strategy or not . Its a very smart strategy. Theres a reason hes doing that on fox news and not here with you, jake tapper, its friendly outlets to drum up support of the base and out in of thin air, either. Theres a memorandum from the office of Legal Counsel and Justice Department and while the president cant receive cant subpoena a president , you have the justification for pushing back on the subpoena grounded in what is the information that the subpoena looks for and the nature of the crime, so rudys not entirely correct. I mean, there is confusion about this and hes trying to drum up that confusion. In other words, with the base and the audience sensitive to the question of whether there is a justification for subpoena or not. But this wouldnt necessarily have any affect on Robert Mueller i would think. No. Not even a little bit. Look. The strategy of playing to the court of Public Opinion is one track theyre working on clearly but a limitation of sort of partisan media is solidifying the base and not creating a large swath of Public Opinion in your favor necessarily and the logics faulty with due respect to rudy who was a great prosecutor back in the day and clearly a precedent for president s subpoenaed. As laura made the case earlier, you cant indict a sitting president , be part of a criminal trial as president. Thats clear, not contested. Theres a question of watergate listing president nixon as an unindicted coconspirator. This is tricky territory and i have to call out one other thing because Rudy Giuliani said the facts dont support the extension of this prosecution. This investigation. First of all, watergate, irancontra, four years. One year is a short period of time. Reality check on that. Already we have had 22 people and individuals be charged. We have had five guilty pleas. Its been far from nothing occurring worthy of attention and marks on the board to say its a fairly worthwhile year. Laura . Talking about the watergate investigation is really important talking about here because the watergate counsel found that they could indict a sitting president and they knew that impeachment proceedings in the wing and basically politically speaking and not ultimately do with that particular president. Remember the most important thing to remember is clinton v. Jones case, another president that reminds people of whats going on right now. Supreme court said you cannot use things like youre too busy or you cant possibly be bothered to have to deal with the due process or anything like that to say that you cant be bothered. Part of a subpoena and part of the function is due process of lawyer to say you must be bothered with these things especially the head of the executive branch. Finally, you know what you have to be when you make demands . You have to be in the position to actually make those demands and have justification. Asking for all of the information outright is not only inappropriate, Rudy Giuliani knows its inappropriate. He was the chief prosecutor in new york. And one of the things thats interesting is President Trump through Rudy Giuliani seems to make the argument that the collusion is about whether or not President Trump himself personally had anything to do with the conspiracy. And that obstruction is silly. Take a listen to Rudy Giuliani talking about these two issues and what the president might say. The president wants to testify. Wants to he wants to give his side of the case. Which he believes is the truthful one and says to me i never talked to russians. What is this nonsense about russians . About obstruction of justice, what he says very simply is im just expressing my opinion. Now, obviously, part of the obstruction of justice charge is not just him expressing opinion and saying to Jeff Sessions attorney general you shouldnt have recused yourself, et cetera. But firing james comey. Threatening to fire other people. Thats not just an opinion. Right. I mean, theres obstruction of justice and also i mean, look. This is a good strategy. The reason rudys there spinning this up because also he is sowing the seeds of doubt in the case of a subpoena issue. To the base, to republicans. Exactly. Theres also a reality based standard. I mean, the president not an analyst or observer. He is a prime actor in this and may feel he has nothing to hide and i think he testifies for transparency and can be resolved one way or another. But, you know, so its clever in terms of playing to the base and not sure in the court of Public Opinion and will not necessarily translate to the court of law. I was going to say it might in this case, however, because you heard Rudy Giuliani say that the president said to me, the president told me. Its not an effective strategy because now you have a record of what the president says and you have the ability to contradict him through other testimony. You now have the exposure of him, Rudy Giuliani, potentially being a witness and being able to talk about this because removed the Attorney Client privilege telling everybody what the president told him about a sensitive issue about his role and intent and motivation behind what is investigated. There is this conflict of things happening in the court of Public Opinion and the court of law and when the strategies at odds like they are right here and cant be effective strategy for a longterm benefit to donald trump. One of the things interesting, sowing the seeds of doubt in the investigation, Rudy Giuliani seizing on the news broken by the New York Times yesterday about somebody, a confidential informant, in the Trump Campaign that had spoke within the fbi. Take a listen to Rudy Giuliani using that as the latest color on his palette to paint this entire investigation as illegitimate. Thats what you do maybe you shouldnt but you do it. Nothing illegal about that. And even if it comes from a russian or a german or an american, it doesnt matter. And they never used it. Is the main thing. Never used it. Rejected it. If theres collusion with the russians, they would have used it. That was not the sound bite im looking for. Im looking for question four and manafort. Can we play that . What they did with manafort, what they did with Michael Cohen, the illegitimate, possibly placing a spy in the Trump Campaign. Laura, as a former federal prosecutor, is that unusual, illegitimate for an informant in the campaign . Not necessarily. Informants are often voluntarily providing information and approach the investigators, as well. If they have a plant, synonymous term of willing to provide information and willing i guess a better term to snitch on the information and suggest theres somehow a that its not a mutual arrangement or one that was enforced and imposed upon somebody is i think not what happened in this case if it happened. Margaret . We know that carter page probably on the wrong side of the Law Enforcement and informing the fbi as a plea deal. Not to spin conspiracy theories. Rudy said at the end they write a report. Thats all they do. We have a separation of powers. Not jus a report written but a recommendation by the way congress can act on and the strategy of spinning up the base and sowing doubt is not a good one, especially when you have what looks like a blue wave coming towards congress and nancy pelosi or some democrat as the speaker of the house to do with a report that comes out . Right. Thats one of the resources here. Remember, this is different than previous investigations to report up to the Justice Department and constraints on them by previous opinions of president s and Justice Departments adopted but obviously a Mueller Report is damning and provide fodder for an impeachment proceeding. We dont know what the reporting would say and one mechanism to be resolved outside the court of law and important to keep that in mind and in the Clinton Jones case, a civil trial. Right . Thats a message trying to get. I think he got his gadhafi talking points confused. You dont think he disagrees with bolton and doesnt understand what bolton is talking about . I i think the end point is a denuclearized north korea and north Korean Peninsula and i give negotiators and mike pom p pompeo to negotiate and to make inroads and keeping you in power and make sure your country is safe and your reign is safe and you are a long young.
