Sources familiar say that the president s anger over the raids has reaped has reached a boiling point and the anger has surpassed previous anger over the investigation and some say this is a turning point for President Trump. In the days since the raid on Michael Cohens office and hotel room, weve learned the fbi wasnt just looking for records about payments to porn star stormy daniels, but also documents on a deal between former playboy play mate Karen Mcdougal and the owners of the National Enquirer to buy and bury her store with trump, an affair the white house denies. The president is clear hes addressed this several times. I doan have anything else to add. And weve learned the raid included a request for documents related to cohens ownership of new York City Taxi medallions. Rod rosenstein who was nominated by trump had to sign off on the raid. Trump wont answer questions but taking to twitter declaring attorneyclient privilege is dead and to call the investigation led by the Justice Department a witch hunt. It is a disgrace. Frankly a real disgrace. It is an attack on our country in a true sense. It is an attack on what we all stand for. Reporter trump again publicly turning on his attorney general Jeff Sessions who has the power to fire Robert Mueller but recused himself from the russia investigation. The attorney general made a terrible mistake when he did this and recused himself or let us know if he would recuse himself and we would have used put a different attorney general in. Reporter and firing a warning shot to mueller himself. Why dont i just fire mueller . Well, i think it is a disgrace what is going on. Well see what happens. But i think it is really a sad situation when you look at what happened. And many people have said, you should fire him. The threat of firing mueller has leaders in the president s own party sending warning of their own. I think that would be a mistake. He should be allowed to finish the job he was appointed to do. I think it would be suicide for the president to fire him. Reporter but when asked if the president believes he has the power to fire mueller, the white house said this. He certainly believes he has the power to do so. With trumps anger at a boiling point, the news of his canceled trip to south america and the departure of tom bossert, a source telling cnn there is a deep sense of anxiety and uncertainty in the west wing as aides wonder what is next. Cnn learned bossert was pushed out by newly installed National Security adviser john bolton, days after an appearance on television on behalf of the administration. I think the president has a point that is very clear and im going to reiterate that point reporter with his departure nearly half of top level staff inside of the Trump White House has turned over, according to a Brookings Institution study. And the president who shortened his trip to south america and has been grumbling that he didnt want to go at all is actually staying back in part to figure out the next steps that his department of justice according to sources familiar with the matter, the white house as you know has said that hes staying behind to monitor the situation in syria, but as you know last year the president made the decision to launch the strikes from maralargo. So it is unclear why he wouldnt be able to make any decision abroad. Jake. Pamela, just to underline this, you are hearing from a source that one of the reasons hes staying back and not going on the trip is so he could figure out what to do with his Justice Department . Reporter hes clearly fixated on the raid on his personal attorney and angry. All of this afact factoring in and figuring out the next steps and all of this is factoring into the decision on a trip the president didnt even want to go on in the first place. But again the white house is saying officially that all this has to do with syria and the president staying behind to monitor the u. S. Response to the apparent chemical weapons attack in syria. Thank you very much. My panel is here with me. Jeff zel annie and pamela and some other members of our team. The president has said to be in a state that people havent seen him in. And that is because its Michael Cohen. There is no one closer to this president than Michael Cohen. Potentially his children, but not even in that way. Michael cohen is an appendage of the president in every gamut. There is not one part of the president s life that Michael Cohen has not been involved in. The politics, the business, everything else. That is why hes furious. You could see the look in his face when he was sitting with his military commanders. Which was extraordinary in and of itself. It took many people in the white house by surprise he was saying that but there was no talking him off the a the lentil if you will. I am told he was as furious this morning and remains furious and the question is what will he do about it. He has been mad before and sieging before. Is this a different moment . That is what were still reporting out. But hes certainly being presented with a range of options including firing Rod Rosenstein, firing Jeff Sessions, something hes not been able to do, been willing to do and republicans advising him not to. Well see if he does anything. But that is the key question. What will he do about this. I do believe that is why hes staying here in washington, not going to south america on friday, several days between now and then, something hes considering something. And with the report that rosenstein signed off on this raid of Michael Cohens office, hotel and home, a lot of people are speculating that rosensteins job might really be the one that is in jeopardy. Sort of. But lets play this out. If he wans to take out rosenstein, what does the attorney general Jeff Sessions do . Say this is okay. What does the congress do . Because we know mueller doesnt report to the attorney general, he reports to rosenstein. So does congress say the only reason hes replacing rosenstein to put somebody in place that puts a clamp on the investigation. And anybody watching in washington will say if you take out comi, it is going to get i look at rosenstein issue and say i understand why somebody playi playing checkers would do that, avoiding the near term pain but if you take him out, the second dimension problems are more significant than he thinks. Let me play devils advocate, laura, what will congress and sessions do if he fires rosenstein . Nothing. And that is pretty much why everyone is looking at this and balking, thinking what will the recourse and domino affect of this. And you have to do the equivalent if you were to fire rosenstein and that doesnt bounce back to Jeff Sessions. It goes to somebody who is now an associate attorney general and then the head of the office of legal counsel. You have to assume if you are youre talking about control of the russia investigation. Control of the russia investigation. Exactly. So bouncing it off of rosenstein doesnt mean it goes back to the person already recused himself. You have to be betting if you were a gambling man like trump to say both of these two people in the line of secession will fire or clamp down on the Mueller Investigation. And mueller has a built in protection. Hes not there simply at the will or the pleasure of the president of the United States or Rod Rosenstein or who may be in a position to fire him. He has a good cause and dereliction of duty requirement to be fired and if that is found, Congress Gets to weigh in and say i see that you fired this person and it is in writing and the reason for doing so under the statute and i will now have a hearing to investigate whether good cause was found. And so youre exactly right while talking about the idea it on the would end and wont be the beginning of the end, but the start of a brandnew investigation and now congress will have its fingers in the president. And speaking of Jeff Sessions, he was at the white house just now. An event honoring alabama football and asked if he had spoken to President Trump. Take a listen. Have you spoken with the president today . Not today. Roll tide. But President Trump made is very clear about the special counsel mueller and whether or not he thinks he has the power to fire him. The white house said today that theyve been advised that he does and President Trump even spoke about this yesterday during that briefing that youre talking about. Its a disgrace. Its frankly a real disgrace. Its an attack on our country in a true sense. An attack on what we all stand for. And he goes on to say why dont i just fire mueller, i think it is a disgrace but well see what happens. Who is he mad at more right now . Mueller referred this case to the u. S. Attorney for the Southern District of new york but he actually didnt enact the search warrant, that was the u. S. Attorneys office. I believe hes the angriest at Jeff Sessions. This is the beginning of this. He never have forgiven him from recusing himself more than a year ago. I believe Rod Rosenstein is right there and the anger from people talking to the president today is more directed at those two gentleman more than Robert Mueller. But going back to the commend comments, the president was asked about firing mueller and he did the rest on his own, brought you have Jeff Sessions on his own sitting there with the top military commanders. To talk about a life or death issue, whether they will launch any sort of attack on syria. And many president s and advisers would sort of welcome a serious conversation as opposed to talking about politics. But the president started it with this. So this is what going through his mind. And now by him bringing up Jeff Sessions, hes still, i believe, advised from people on the hill he talks to and others that firing Jeff Sessions would be a bridge too far. Im not sure if Rod Rosenstein is in that same category or not. This is the president s decision. Im interested and you work for the fbi and the cia. The president described this raid on Michael Cohens office, hoax and hotel as an attack on our nation. And youre somebody who knows what an attack on our nation is. What was your take when you heard that. Two takes. First if you are in the line as i was at the bureau in the leadership position, you will say look, we have a job to do and that is whether you are the dog catchers, the mayor or the president , if you have probable cause to go into a Lawyers Office or resident, you will follow probable cause. If i or jake tapper did something wrong, we just step back and say this heartens me in terms of what the American Public did. On the other hand you say the president of the United States is suggesting that in a country where a sixth grader and eighth grader and 12th grader is taught were all born equal and all equal under the law that the president himself could say i think it is appropriate for me to determine where an investigation goes. But legal experts point out the move was likely signed off on by the highest levels of the Justice Department and fbi. Joining me now is joni ernst of iowa. She served in the iraq war and a member of the committee. And i want to ask you about a syria, but before we do, i the president called the raid a break in and attack on our nation. Do you see it that way. I would not describe it as that. I do feel that the president believes he was violated. But certainly i wouldnt describe it as an attack on our nation. The president also suggested that this is all being carried out by democrats who are against the trump administration. Obviously as a factual matter, the people heading this all include Deputy AttorneyRod Rosenstein and Christopher Wray who are both republicans and i could go on and on in terms of the u. S. Attorney for the district of new york or Robert Mueller being a republican. What do you say to constituents who hear this kind of falsehood and ask you, do you think that the deep state is trying to bring down the president . Well, i do hear from both sides on this issue. There are a lot of concerns out there. But as far as iowa is concerned, i let them know, let the investigation go where it will. Follow the evidence. And if there is evidence in another matter, then certainly that should be followed. But bottom line with the Mueller Investigation, what i want to know as a senator is what was russias involvement in our election process. Was there collusion. That is what we need to get to the bottom of. Lets let the investigation go. Lets see where it turns up. Speci certainly there has to be a conclusion to the investigation and i hope at that time the results are presented to congress so we can understand what happened in that 2014 election cycle. Your comments or 2016. Your comments to our constituents sounds like your fellow iowa senior senator from your state, the Senate Chairman charles grassley. Take a listen to him earlier today. I think it would be suicide for the president to fire him. I think the less the president said about this whole thing the better off he will be. And i think that mueller is a person of stature and respected and i respect him. Do you agree with senator grassley . I do. I agree with my senior senator. He is the chair of the judiciary. He is a very reasonable man, well respected by his colleagues and constituents alike. So i again will state that i think the investigation let it go where it needs to go. Follow the evidence. At some point, though, it does need to come to a conclusion and so we can understand the effects of russia in our process. And we have another election cycle coming up and we need to learn from what happened in the past and make sure it doesnt happen again. How concerned are you about President Trump firing either mueller or your former colleague Jeff Sessions, the attorney general or Rod Rosenstein the Deputy Attorney general . Honestly, i am not that concerned. I dont believe the president would do that. I think that many of us in the congress have stated that we do believe the investigation needs to continue. And i think the president does heed those words. It is ultimately up to the president. But i dont see him doing that. The president s tirade yesterday about Michael Cohen and the raid came during a meeting with his military team and the National Security officials to discuss a response to syria and the president vowed to respond in the next 24 hours. Take a listen to fellow republican senator lindsey graham. This is not an allout assault on assads capability to deliver chemical weapons. If it is not an effort to degrade his regime, it is a miserable failure. If at the end of the day, he doesnt pay a big price, then President Trump becomes weak and in the eyes of our allies. Do you agree with senator graham that not only does there need to be a military strike but one that is debilitating. What type of response would you like to see . I would tend to agree with senator graham. I do agree. What we have seen from the assad regime is unconscionable and we have seen innocent men, women and children killed through the use of chemical weapons. Assad is a war criminal and we do need to retaliate in some form and fashion and it needs to be swift and hard. And whether folks like it or not, we are leaders in Global Security and make sure we can stabilize that region is very important. It cant be done if the assad regime continues to use chemical weapons. Senator john mccain said that he thought President Trumps call to remove all u. S. Troops from syria had possibly or probably in john mccains view emboldened assad. Are you concerned with that at all . Well, i am concerned whenever a president or a leader would signal to adversaries a withdrawal plan. I think that is something that should be very close hold and something we should not be signaling to others who could use that statement against us. So i think that we need to follow our military advisers advice in this concern and if we maintain a presence there, certainly we should do it under their advice. If the president wishes to see a withdrawal, that would be fine as well, as long as it is done following that advice. This afternoon white house president secretary saers said that President Trump believes he does have the power to fire Robert Mueller and that the president thinks the special counsel probe has gone too far. The sources say President Trump is furious with Rod Rosenstein and Jeff Sessions and sara sanders referred to the comments in the press corp last night and do you think it is a matter of time before one or both of the men are fired. That seems to be every indication from people i speak to and in the white house and i think it is the belief of too many people on capitol hill. Republicans who are afraid that is going to come to pass. And were on the edge of a constitutional crisis. One thing that is very clear is that this president does not give a damn and it is a reptorial fact not an opinion or assertion about the rule of law and yesterday he once again declared war on the rule of law. This is not a witch hunt. There is no evidence of this being a witch hunt and if it were, there would be hell to pay at the end of muellers investigation. And there ought to be hell to pay if it were a witch hunt. But there is no indication of that. Trump is trapped. He knows that he is trapped. This investigation is closing in on him and the prosecutors in new york now have his lawyers computers and what is on them. That is a big fact here. It is certainly a huge moment in this investigation. And i want you to take a listen to sara sanders if she sees a distinct between between the raid on Michael Cohen carried out by the district in new york. Take a listen. I think certainly that they are separate investigations but i think that publicly they have been con flated quite a bit. Is it the president con flating it, carl . There is a relationship between the two. Because on those computers, if there is no privilege because there is a conspiracy between the president and his lawyer and, in fact, if there is exculpatory material on that computer relevant to the Mueller Investigation, the prosecutors in new york have the right and will send back to muellers investigation what is on those computers and other evidence that figures in the mueller russia investigation. And that is one more reason why donald trump is so exercised at this point and might probably going to be willing to once again put an end to this investigation if he can figure out how to do it. It is very difficult to do. It doesnt necessarily go away. If you fire mueller or rosenstein, but there is one other fact here. There really is a possibility and it is only a possibility that those computers can be somewhat the equivalent of the watergate tapes. There could be explosive information on them involving whatever conspiracy had to do partly with why a warrant was sought between the president and his attorney. But this is New Territory because of the legal vulnerability. And what has occurred and we can understand perhaps the president now seeing that he is in a place of vulnerability that he has not been until now and that a line of vulnerability has been crossed, not a line of legality. Carl bernstein, thank you. My panel is here with me. And to underscore this, laura, the idea of raiding the lawyer of the president , any lawyer first of all to begin with, that is a very, very high bar. There is something in the u. S. Attorney code about how it can be done. But to do so for the president , one would think that the evidence that either Michael Cohen was going to destroy evidence or was unwilling to turn over information that he had been subpoenaed or would be subpoenaed to get, must have been overwhelming because i cant imagine so sensitive an order. Youre right. The idea here is that you have to have the first threshold of probable cause and reason to believe there is evidence of a crime ongoing in the past in the locations you are telling the judge they are in. Thats the first for every person in the United States of america. The second is now it is an attorney who will have privileged information. That doesnt have an absolute definition here. Privilege has to still meet the requirements. It has to be between the attorney and client and about legal advice, it couldnt be in furtherance of a crime otherwise the privilege does not apply. So you have to meet a couple of thresholds and now the president s personal attorney who last week said talk to my attorney on air force one and told the people to do that. All of the bars were met in different degrees, all by people who are republican on the same team as the president of the United States essentially and so the idea of a witch hunt based on political or partisanship play is not really founded here in the evidence. But what was founded for a judge would be you must have something now that may not pan out. There is no requirement of beyond a reasonable doubt at this stage. If you have to find everything to link a crime, but there had to have been probable cause at the very least, jake. And phil, were told that among the information that has been seized in this raid, information dealing with the payment of hush money to stormy daniels, the adult film actress, with whom President Trump allegedly had an affair, and information about his relationship with Karen Mcdougal, the 1998 playboy play mate of the year with whom he had an affair. I dont know the crime there. And also the stuff about cohens taxi medallion business. Just to take one second to explain it, they are required to operate in new york city and a cap on the total number so they could be quite valuable and it is theoretically a way that money could be laundered. I have a taxi medallion and you charge somebody 150,000 for it. And this is why this is so significant. Believe it or not, i think it is more significant than the white house is making it for a reason. And you have financial crimes an the white house is trying to say this is mueller stuff, con flating it as sarah huckabeesanders, and this investigation is tainted. The reason it is worse is you have the Mueller Investigation around for now the background and the fbi investigation a couple of years. Leading not only to indictments but to pleas from different people. Now you have a separate set of investigators independently charged by rosenstein to look at this, fbi veeinvestigators say believe we not only have to issue a subpoena against the private lawyer, we have to go against his apartment and his office and his hotel room without preannouncing. That tells me they have a mountain of information that were not seeing. Both investigations simultaneously tell me the president is in even more trouble than he talked about last night. And the president is still in very frequent contact with Michael Cohen. He mentioned him last week. And again brought him up, referring reporters to him two weeks ago he had dinner with the president at maralargo. This is somebody who the president talks to all of the time. He stayed on the outside of the campaign for a reason, to help with a variety of matters and never came into the white house but in the early days he was around a lot and in washington a lot and someone the president speaks to a lot and there is a sense of urgency and the documents might have been clearly something that angered the president. You could see him crossing his arms. Im not sure ive seen him like that in all of the episodes weve watched him in. It was different to me. Speaking of urgency and this is not coming down to the off the cuff statements by the president on air force one. This has been in the works for sometime. That a imagine a magistrate and the information was not based on a few days or incidents on air or interviews of people that may have been paid by the president. This is in the works and so i do not believe the hype. This is an urgent and hasty matter taken to discredit the president and they decided this was an appropriate action to take and they did. You have to see the reaction President Trumps generals had on their faces when President Trump went off about the Michael Cohen raid when they were talking about life and death issues in syria. Are you going to make sure that youre not con fronting the russians and not inadvertently killing Russian Forces in the area. Jake. And during a meeting with his military leaders and National Security leaders when President Trump addressed his grievances against Jeff Sessions and rosenstein and Robert Mueller over the raid on the office, home and hotel of his personal attorney. What are folks in the pentagon telling you about the mood in the room among these National Security officials and generals. You only have to look at that video, everyone is saying it was very uncomfortable. You see several general officers there, four stars, just staring and keeping their faces expressionless or staring down. They are in a room with their commanderinchief talking about an attack on the country, but at tack is actually mr. Trumps personal political problems of course. These men and women are charged with defending the country and they are listening to what is essentially a political statement by the president. It is unprecedented in terms of putting them in an uncomfortable situation, politicizing the military. There is no question. It was an extraordinary moment, extraordinarily uncomfortable for the secretary of defense, the chairman of the joint chiefs and the chiefs and all of the major commanders, jake. Day one hearings brought on by the Cambridge Analytica scandal where personal information for as many as 87 million facebook users was shared with the data firm that President Trump used in the 2016 campaign. Cnn tech correspondent lori hill is on capitol hill watching this. Do the senators seem satisfied with zuckerbergs testimony. Reporter well at one point Senate Staffers held up signs with all of his apologies over the last years from 2006, 2007, but generally ill say this. The stock price closed up as soon as zuckerberg started answering the harder questions. So it looks like the general market reacted pretty well so far. And it is a huge moment for the ceo. I think a lot of folks had a lot of challenging questions for him given the news. He defended the companys business model. We knew he would do this but he said facebook is responsible for connecting the world. And this is an interesting newsmaking moment because very much on the company line and prepped for this. Im told he was prepped for a week with mock hearings for this. He he essentially said he was asked if about facebooks involvement in the Mueller Investigation. Take a listen. Have you or anybody at facebook been interviewed by the special counsels office . Yes. Have you been interviewed i have not. I have not. Others have . I believe so. And i want to be careful here because that our work with the special counsel is confidential and i want to make sure that in an open session im not revealing something that is confidential. I understand. I just want to make clear that you have been contacted and had subpoenas. Actually, let me clarify that. I am not aware of a subpoena. I believe there may be. But i know were working with them. A little color there. Angry facebook users who are lined up since 7 30 a. M. And i spoke to them, one dressed as a russiaon troll saying they were bringing the trolling to Mark Zuckerberg. And a lot of folks in there and there are some protesters here. And Mark Zuckerberg did say his biggest regret of 2016 and was essentially not getting on top of the russia interference earlier and be slow to that and he promised and vowed in front of senators today to make a big difference. Thank you so much. Lets bring back the panel. First of all, so zuckerberg was very prepared. He clearly been prepped. He is an expert team in corn bluthe and the team there. I dont think im going out on a limb so ta to say the senator didnt seem that family with with the product. And there is an age divide. There are senators in their 80s who are asking him questions and some may use it or be familiar it with it. And it wasnt a strategy they were going after. But one of the interesting things that he said going forward, i agree were responsible for the content. This is something that Mark Zuckerberg has not said before here. So that puts him in more of the publisher realm, something hes tried to stay away from. He wants to be on the platform, not the publisher side. So i think that is interesting in terms of possible regulation of things to come. Obviously one of the biggest issues here is privacy. Senator dick durbin had an intering exchange with zuckerberg about the issue of privacy. Take a look. Mr. Zuckerberg, would you be comfortable sharing us the name of the hotel you stayed in last night . Um ah no. If you messaged anybody this week, would you share with us the names of the people youve messaged. Senator, no, i would probably not choose to do that publicly here. I think that may be what this is all about. Your right to privacy. Phil mud. Time out here. There is 180 degree difference from an in terms of looking at this. As a former intelligence professional, it is right to hold zuckerbergs feet to the fire about privacy. There is a second question that doesnt have to do with data or have to do with facebook. A highly successful American Company is a subject of attacks from a foreign intelligence service. How about one or two senators who actually say is there something we can do to bring u. S. Government resources to bear to help you. To make sure this doesnt happen in the future, so that we can continue to dominate the social media realm around the world. These guys are all about attacking zuckerberg. There is a tougher question. Do we have a responsibility and believe me my intel friends in the business would not like to hear this, does the u. S. Government have a responsibility to say were in this with you. Can we help ensure that this doesnt happen again. And believe it or not, can we support you. Who is asking that question. It is part of a larger pattern. The idea that congress has this parallel investigation along with the criminal probe for mueller to legislative a solution to what we know is an ongoing problem and will be a problem in the midterm elections and potentially the next general election. And yet not only do you have the age divide but the information gap about what happened with Cambridge Analytica. I bet if you asked most people on the street, they have no idea how to articulate what actually happened. And looking to Mark Zuckerberg to explain that or to clarify the issue, and if they dont get it, how could we possibly legislative find a legislative way to solve this problem going forward. One thing that he did mention when testified, it is not just us, facebook. There are social media platforms being used and probably exploited and the fact that mueller is looking into all of these things falls right in line with what his charge is. To figure out whether there was any entity in america or citizen or anyone else about whether somebody was trying to unduly influence our elections and they are a vehicle for do that. That is no question that others have this problem, twitter and others, but facebook is the most successful. 2 billion users. If you talk to experts they say the fake news problem was big on twitter but not a comparison to facebook. And chris coons tweeted that on today of all day i found out there are two fake Facebook Accounts impersonating me and many of the friends are russian accounts. Facebook and mr. Zuckerberg, this is unacceptable and that is the issue here as phil pointed out, the russians a hostile nation is exploiting our freedom an our companies. Exactly. And that is one of the reasons he said directly, this is an arms race. I am not sure the hot seat was as hot as you are implying. I think it was cool. And well see what happens tomorrow in the house. I think it will be the same. And Mark Zuckerberg spent all day yesterday shaking hands and getting to the know the senators. Hes a celebrity in many respects. He has hightech firms that give money to a lot of people. Just by showing up he wins over a lost people. Im not sure if that solves anything. What does that solve in terms of the 2018 election. I dont me if anything. Zuckerberg said facebook learned in 2015 that the researcher who created the personality quiz for facebook gave the data to Cambridge Analytica and of course we only learned about that a few weeks ago. It is true that likely most people if you walk out on the street or poll dont know about this privacy issue, but it doesnt mean we shouldnt care about it of course. And everyone stick around.
