Good afternoon and welcome to a special edition of the lead. I am jake tapper. We just got a statement from donald trump. We are going to go live to our reporter on the scene, sarah murray, to tell us what the statement says. I believe it is about the judge. Sarah. We are not ready for sarah yet. Were going to bring that to you in a second. But let us take a moment, exactly eight years to the day after ending her first bid for the white house, Hillary Clinton tonight will declare she has enough delegates to be the democratic partys presumptive nominee for president. We now have sarah murray. Lets go to sarah murray to tell us this breaking news from the Trump Campaign. Sarah, what does the statement say . Reporter you guys jake, its a pretty lengthy statement. So stick with me. Ill come with the first part here. It is unfortunate that my comments this is from donald trump. It is unfortunate that my comments have been misconstrued as a categorical attack against people of mexican heritage. I am friends with and employ thousands of people of mexican and hispanic descent. The american Justice System relies on fair and impartial judges. All judges should be held to that standard. Trump goes onto say i do not feel that ones heritage makes them incapable of being impartial. But based on the rulings i have received in the Trump University civil case i feel justified in questioning whether i am receiving a fair trial. Over the past few weeks i have watched as the media has reported one inaccuracy after another concerning the ongoing litigation involving Trump University. There are several important facts that the public should know and that the media has failed to report. Now, hes going on here to explain a little more of this Trump University case, jake, saying throughout the litigation my attorneys have continually demonstrated that students who participated in Trump University were provided a substantive, valuable education based upon a curriculum developed by professors from North Western university, stanford and other respected institutions. The response from students was overwhelming. Giving courses high marks and expressing overwhelming satisfaction with Trump University programs. Now of course, jake, this trial is based on students saying the opposite feeling like they spent tens of thousands of dollars feeling like they were defrauded. This is a class action lawsuit. He goes on in the statement to list a number of people who felt like they did have a positive experience at Trump University. He touts a website where you can see some of those testimonials. He continues on in the statement to say for those students who decided that Trump Universitys programs were not for them, the company had a generous refound policy, talks about offering a full refund to any student. He continues on but gets back to the court case saying, jake, normally legal issues in a civil case would be heard in a neutral environment, however given my unique circumstances as nominee of the Republican Party and the core issues of my campaign that focus on illegal immigration, jobs and unfair trade, i have concerns as to my ability to receive a fair trial. He continues on im fighting hard to bring jobs back to the united states. And then talks again about how he feels like hes getting an unfair shake in this. Due to what i believe are unfair and mistaken rulings in this case. And the judges reported association with certain professional organizations questions were raised regarding obamaappointed judges impartiality, it is a fair question. I hope it is not the case. While this lawsuit should have been dismissed, this is something weve heard trump say over and over, it is now scheduled for trial in november. I do not intend to comment on this matter any further with all the thousands of people whove given the courses such high marks and accolades, we will win this case. So, jake, amazing to see donald trump saying he does not want to comment on this case any further. Amidst the uproar his comments have caused among members of his own party, weve seen paul ryan, weve seen Mitch Mcconnell, pretty much every leader of the Republican Party at this point try to distance themselves from donald trump on his remarks about this judge, jake. Donald trump issuing this statement. Do you think this will put this controversy to bed . We had even House Speaker paul ryan today say that the comments mr. Trump made were the definition of racist. Well, first of all, its certainly not textbook racism, first of all mexicans and ethnicity its not a its a little pedantic, call it bigotry. If youre calling someone racist at the end of the day this is what it boils down to people calling donald trump this making judgment on his character as a person. Thats a wrong claim to make. How would you characterize the remark he made . I think it was poorly worded. I think he had viable claims against the judge. I think he had reasons to suspect the judge were bias. If he truly were against a judge by virtue of his heritage, why then did two years ago didnt he Say Something . It was only after actions were taken, he struggled to find a reason for that, i think he never should have mentioned the heritage, but this is exactly what he needed to do, he came out and clarified, lets move onto issues Americans Care about. Mayor nutter. Jake, i think the only problem here is he caused the problem himself, he raised the issue himself, and then put together hes mexican, im building a wall. I mean, i saw your interview, he said it like 95 times. So he put himself in this position to raise all these questions about his mindset, about his view, then doubles down or maybe triples down with throwing when you asked about possibly a muslim judge that was john dickerson. The other interview. Yeah, maybe that too. I mean, you know, where is this going . He caused this problem himself. Dug his hole. Is now getting buried by his own party. And is trying to claw his way back out. Mary kathrine, let me bring you in as a republican and undecided voter, i believe. No . Yeah, who knows what im thinking. Who knows what youre going to do. Its a mystery to all of us. But do you think well, he says im not going to talk about this anymore. This issue is over. He will not talk about it until the moment he wants to talk about it again. This is the essence of donald trump and tells you who he is every day, a guy very selfinterested and interested in serving donald trump in that given moment and he will say what it takes to do that. Thats why he didnt say before he didnt point out heritage before because now it served his purposes for whatever that fleeting moment was whenever he said something about his heritage and now it does not serve his heritage, never mind im not going to talk about it anymore. Soonz he does hell talk about it again. The fact is its inescapable the man could not do his job because of his ethnicity. Thats the problem. Its very clear. He made it very clear. So everybody has to respond to that. I want to come to you in a second but let me give caylee a chance to respond to what youve heard so far. I think if he truly if at bottom he wasnt comfortable with someones heritage, two years ago said cant have this judge, hes of mexican heritage, that simply wasnt the case. He was inartful pointing out the heritage. He should have stepped back and said ive been issued unfair rulings, heres what they are. Why am i getting these rulings, perhaps its part of an organization antithet kal he didnt bring that up. Hes not a polished politician. Its his biggest attribute. Were always filling in blanks for him. I dont want to give him a pass for not saying it two years ago. He said it now. And as far as im concerned if paul ryan says its racism, he called it that, i didnt, if Lindsey Graham says its racism, thats good enough for me. But i think there are two things to point out. One is this case has nothing to do with immigration or the wall or anything. Its about his, allegedly, defrauding students at Trump University. And if you read the case, its a pretty strong case i think against donald trump. You know, it just goes on and on. He has if he wants facts of this case out and wants to make those arguments, guess who has the biggest platform to do it . He can do that. Gloria, theres actually some very big news just made john martin from New York Times tweeted it a second ago which is an incumbent republican senator mark kirk of illinois up for reelection, and we should not pretend that he isnt running in a blue state. He is. Illinoiss a blue state. He says hes not going to endorse donald trump. Thats pretty shocking. It is. And i think that you can draw direct line between what is occurring with Trump University and kirks decision here. Two things in trumps statement that are of interest to me. Number one, he tried to walk it back. Okay. There is a line. I do not feel that ones heritage makes them incapable of being impartial. So he clearly is listening to the people on the hill who have twisted themselves into pretzels to endorse him. And now were trying to find a way not to back off of it. So thats number one. Because hes trying to back off. But number two, he is a republican president ial nominee. And what we are talking about here is a civil fraud case. Uhhuh. And which he is involved as a businessman. His personal Business Issues are not the equivalent to me at least of a president to his president ial campaign. And yet it remains front and center, which gives you a large hint into the way donald trump is thinking. Because his Business Life is so important to him that hes kind of putting it front and center in a president ial contest. And that doesnt make his supporters in congress feel really comfortable at all. You pressed him repeatedly. A, asking smart followup questions, but, b, impressing him, isnt that the definition of racism, thats his opportunity to think about what he said and take it back. In this statement he said i do not feel ones heritage makes them incapable of being impartial. He said he believes this judges heritage made himm incapable. Will the real donald trump please stand up . This will be in Democratic Campaign ads from now until november. Okay, what are we doing right now . Okay, i want to bring in clinton supporter javier of california. Thanks so much for doing this. What is your reaction to statement, he does not think, quote, ones heritage does not make them incapable of being impartial but based on the rulings ive received in the Trump University civil case i feel justified in whether im receiving a fair trial in this case. Your response. Yajake, you can correct me i im wrong but a quick glance of what he said in the statement must be close to 500 words, probably more than 500 words. Nowhere in there does he say im sorry. Nowhere does he actually retract his racist remarks. And he tries to actually explain them again. Youve said the but, he says but. And so this is a guy who made a clearly racist statement, im not saying that by myself, republicans are saying that. And hes unwilling to retract it. And if he really believes that this judge, judge curiel could not be fair, then he would go through the normal motions in court to file a motion to remove the judge. Hes not done that, hes not yet said he would do that. Clearly this guy, donald trump, is saying that a respected jurist who was confirmed by a bipartisan vote in the senate is uncapable of serving because of his mexican heritage, mexicanamerican heritage. I think thats racist. I think we should call it that and any republican who says its wrong or offensive is simply allowing this guy to move forward because they continue to endorse. For speaker ryan to say its wrong and its racist, but yet say im going to endorse a racist for the white house, thats scary. This is an obamaappointed judge in your home state of california do you know him at all . I know of him. I know his cousin who used to serve in the Clinton Administration as an am baz dor, the curiel family is a distinguished family, worked their way up similar to my family of immigrant background. Im the first to get a college degree. I suspect most of judge curiels family also had to go through that rough road to get educated. He comes from indiana. I doubt that most people consider indiana the most latino state in the nation. And its unfortunate that in one fell swoop donald trump can encapsulate the hard work of a judge, all hes struggled to do by the way fighting drug cartels as a prosecutor, federal prosecutor, and this guy, donald trump, can somehow box him in by calling him mexican. I think its outrageous and its racist. Congressman, a few days ago i had the Senate Majority leader, Mitch Mcconnell, on my show. We were talking about his book. And in his book its a memoir, he talked about how even though he was a loyal republican, he did not vote for Barry Goldwater in 1964 because goldwater had voted against the civil rights act. And in the words of Mcconnell Goldwater in that act and in the nomination of goldwater by the Republican Party in 64 alienated africanamericans for generations. I said to mcconnell, are you worried that donald trump as your nominee is going to do that with latinos, and he said he was. Do you think its possible that donald trump as the nominee will alienate latino voters for not just this election but future ones as well . I dont think its just donald trump at this stage, jake. Three times senator mcconnell refused to answer your direct question, was that a racist remark from donald trump . And he tried to evade he did evade three times the direct question that you asked. And to me you can evade racism only so long. Youre either with them or youre not and in this country i thought we had pretty much decided that we would not make judgments about people based on their national origin, their racial heritage. And unfortunately we seem to see republicans putting party before country, party before constitution and party certainly before a lot of hard working americans whove earned their position as a judge. According to the news we are on the brink of a historic, historic, unprecedented moment. But we still have work to do, dont we . Now, her opponent, senator Bernie Sanders, has preemptively rejected this declaration of victory noting super delegates can change their mind. The problem is that the only super delegate has changed his mind flipped from supporting sanders to supporting clinton. As they fund raised off of the news so this just happened an email asking for donations reads, they also told supporters but this primary isnt quite over as the Campaign Urges voters in six states casting ballots today to give clinton a strong primary finish. Bernie sanders is neck and neck with clinton here in the golden state, and fighting to win as many of the 475 delegates as possible, criticizing clintons climate policies. It is a Global Crisis that is why we need a ban on fracking. And i sincerely hope secretary clinton will change her view on that issue and join us. Reporter despite clinton about to declare she has reached the magic number of delegates, the Sanders Campaign is not ready to concede the race just yet. Theres a long way to go between now and the convention. Reporter meanwhile, clinton picked up an endorsement from californias most prominent politician, House Minority leader nancy pelosi. Im a voter in california, and i have voted for Hillary Clinton for president of the united states. And proud to endorse her for that position. But i hasten to say its not over until its over. Reporter the first woman to be speaker of the house, pelosi also said she likes the idea of clinton picking massachusetts senator elizabeth warren, or another woman as her running mate. Had two men over and over again for hundreds of years. I think that two women who really may be that would be fabulous as well. But Hillary Clinton will choose a person that she feels most comfortable with. Reporter the Clinton Campaigns message to surrogates who will be talking her up today is to not call on Bernie Sanders to get out of the race, jake, at least not yet though they will be saying basically that he shouldnt take this all the way to the convention. We are expecting, weve heard from aides that she will try to extend an olive branch to his supporters. Bernie sanders we have learned will be going home to burlington tomorrow, perhaps taking some time to think about what his next steps are. And certainly some of those people around Hillary Clinton as the days go on may be pressuring him, but theyre hoping that if she does win california as well as new jersey there will be a lot of external pressure on Bernie Sanders. Its anticipated this evening Hillary Clinton will declare herself the presumptive nominee, if she ends up after the polls close aftering the majority of pledge delegates and majority of endorsements from super delegates and does add up to the number needed to clinch the nomination, what is the Sanders Campaign going to say . Well, jake, the truth of the matter is that super delegates as you know dont vote until the convention. So theres been a poll of super delegates, but its just a poll. They havent actually voted. In terms of the way the process works, we didnt establish the process but we are playing by the rules given to us in the beginning if you dont have 2383 in the pledge delegates, go to the convention and super delegates will decide. Even though somebody may be ahead they have not won if they have 2383 in pledge delegates, we have to wait to see what the super delegates do. Bernie sanders is a much stronger general election against donald trump. I think we have to get together and beat trump and Bernie Sanders is a much stronger choice to do that. You keep on talking about how you hope to get super delegates to switch their stated allegiance, you and senator sanders have been saying that for months. And only one super delegate has changed affiliation. And he went in the wrong direction. Hes now with clinton. Do you have any reason to think that super delegates are going to switch . Well, look the super delegate election is at the end of july. And like every voter super delegates take a hard look at the race as to when they actually have to vote. Evidence is mounting. Senator sanders has been much stronger in the second half of this race coming from 3 when he started in this race 2. 5 million individual contributors, over 10 million votes winning 20 states and obviously will probably win some more tonight. Its a pretty strong case given where the public polling is and the need to defeat trump and the republicans. But, jeff, the argument youre making is that super delegates should go against the majority of the poplar vote and pledge delegates, clinton has received a total of 13 million, votes, 55. 6 votes. Sanders received 10 million, which is 42. 7. Why should super delegates go against what democratic voters want . Well, jake, those numbers are a little deceptive because a lot of the states where sanders won were in caucus states. If you extrapolate the population of those states compare those to similar size states that had primaries, that number gets much, much smaller, the difference between the two gets much smaller by millions. But the problem is but still leads. This is the way the process was established. This is the way the democratic primary but super delegates have never gone against the will of the voters. Theyve never done that in the history of super delegates when they started i think in 1982. But that is their function, jake. Thats their function. Not to go against. They can vote however they want but not supposed to go against what the majority of voters want. Well, if they werent supposed to do that they wouldnt be there. Their purpose is to make sure the party at the end of the day im not saying this is the way we would have set it up burks theyre supposed to make a judgment alt the end of the process, if candidate hasnt gotten the overwhelming number of delegates 2383, which the secretary has not gotten, their job is to make sure they elect the strongest candidate in the fall. Youre actually making an argument youre actually kind of making an argument in favor of the way this used to be done in like the 50s with party bosses deciding what they want. Like Estes Ka Favre got more votes when he ran against add li stephenson but the guys in the smoke filled room picked stevenson. Youre arguing in favor of a typical similar type situation. Im arguing that the process in 2016 should play out according to the rules that have been established for this contest. This is not the 1950s rules thrks is the 2016 rules. Not established by us, but we are playing by them. Do you want to talk about changing them in the future . I think were happy to engage in that conversation, but thats not where we are right now. But just to underline it you will want super delegates to go against the will of the majority of voters assuming that Hillary Clinton has the majority when all the voting is over. Well, jake, how about this. Should super delegates from states where Bernie Sanders got 70 or 80 of the vote support secretary clinton or Bernie Sanders . I think when you do that math it actually ends up that Hillary Clinton still wins. Yeah, but youre talking about a principle here. You just articulated a principle and im articulating a principle back to you. Should super delegates in states that overwhelmingly went for Hillary Clinton or Bernie Sanders i didnt come up with your rules, but youre actually arguing in favor of something. Donald trump putting out a statement moments ago to try to quell the firestorm after he attacked an americanborn judge in the Trump University case over his mexican roots. Trump says his comments have been bmisconstrued. Also, mark kirk, one of the most endangered republican senators up for reelection in illinois this year Just Announced he cannot and will not support trump. Saying, quote, given my military experience, donald trump does not have the temperament to command our military or our nuclear arsenal. Kirk told our own manu raju he will not vote for clinton. Instead he will write in general david petraeus, who i dont think has the security clearance to be commander in chief, but okay well move on from there. I also spoke to former trump rival rand paul earlier today. He shared some similar concerns. Have you endorsed donald trump yet . You know, when i ran for the presidency, i signed a statement saying that i would endorse the nominee and wouldnt run as a third party, and i stick by that. So you support him becoming the next president . I support the nominee. I signed a statement saying i would do so. Theres varying degrees of enthusiasm and i may not be going doortodoor, and i think i have a distinct voice in the Republican Party and i want to keep that. So i havent said im going to be anybodys surrogate. Im not out there campaigning other than trying to make sure my voice is heard and that i win reelection in kentucky. What do you make his campaign against the judge . Calling him a mexican when hes from indiana saying because of his heritage he cant be a fair judge. I think its a mistake. I think we have all seen judges that are bias, and you can complain about their bias if you think theyre liberal or this or that, but huge mistake to categorize people based on their race. Thats have from a visit by the way we did with senator paul and some world war ii veterans who just made an honor flight to the world war ii memorial this week when we commemorated dday. And we will bring that to you tomorrow. Lets stick with politics right now. Our panel here, where does this leave the Republican Party where you have senator kirk saying he is not going to support donald trump, hes going to writein general petraeus. I think republicans who are looking to trump to see if he was going to change after all a lot of them came out, called this statement a racist, called it bigoted and essentially i think Lindsey Graham this statement gave republicans an offramp. Some saying if other republicans wanted to rescind their endorsement, this was all the reason to. I think for those republicans that were looking for an offramp, looking for donald trump to maybe give them a reason to stick by him, this statement didnt give them that reason. Here he is hes doubling down. Hes essentially saying the statement trump gave. The statement trump gave. Hes essentially saying this was a big misunderstanding. You know, i think you imagine paul ryan standing in a black neighborhood on the one hand saying here is our new poverty platform that hes going to put forward in the house, but also saying that donald trump said something racist. I mean, that is a dichotomy you cant really reconcile. I think its a real dangerous place for the Republican Party to be at, and donald trump doesnt seem to recognize that. I think in donald trump you have someone who has represented himself. He hasnt represented a constituency ever. And he isnt ready to make that turn where hes ready to represent a constituency and something larger than himself. David, youve worked for republican president s. What would you tell Mitch Mcconnell or paul ryan, the Senate Majority leader and House Speaker right now were you advising them and not handsomely paid by cnn. Save the house, save the senate at all costs. I think thats what theyre doing. I think Mitch Mcconnell has played this pretty well. How do you do that . How do you save the house and senate . I think you have to give people who need to distance themselves opportunities to do that and not expect them to stick with it because theres a growing feeling this donald trump is taking what was a fairly minor story and turned into a Public Relations disaster. And that means if you go and support him now, if you come out for him, look what happened to paul ryan. In the morning he comes out for him, that night he gets embarrassed by this whole controversy over the judge. So removes all the incentives. Let me say one thing about this, donald trump put out a statement today, but he did not put out the fire. He issued a statement that did not come to grips with the essential issue. He danced around it, but if he did not retract what he said. This does not boil down with all due respect to whether trump is a racist. What it comes down to is whether he believes that this judge by virtue of having hispanic heritage or mexican heritage is unqualified. His own lawyer, weve learned today, his own lawyers had said in may we looked at recusal, we dont think the recusal is appropriate in this case. Were not pursuing that. In fact, they just want this judge just gave them a big victory back in may. We all thought this case was going to come to trial here in the summer donald trump would be put on the stand and shoo schneiderman would like to put him away. This quote bias judge postponed it to after the election. Let me let caylee come in here now because youre a harvard law graduate. Certainly you as a lawyer would not make the claim that mr. Trump made. How can he be a biased judge if he just made this big ruling in may that was a ruling mr. Trump found favorable . And if the people out there want to make a judgment that were jerks, thats their right. Thats their right. To the important point his attorney said theyd looked at the possibility of recusal and they decided that was not appropriate. Right. Because this judge, okay, even in may was doing a good job. The attorney hasnt come out since then and filed a motion of recusal. So donald trump ought to shut up and listen to his lawyer. Well, you know, Chris Christie is a former a. And whats available to other people, other republicans who have said they would endorse the nominee that is not available to Chris Christie is Chris Christies not going to back off of his endorsement of donald trump. Nor is he going to tiptoe around it. Because he was out there first. And i was talking to a republican strategist today involved in a lot of senate and house races. And he said to me, heres what im telling my clients, i am telling them that you can renounce trump all you want as a candidate, just dont tell anybody that youre going to support Hillary Clinton. Crossing that line would be the danger. Wow. And so when we heard from senator kirk today, what did he do . Im not supporting donald trump, but he didnt go to the clinton thing. He went to the petraeus thing. This is what youll hear over and over again but not from Chris Christie. In fairness i think Chris Christies got a point. His experience and to the mayors point. I dont think theres evidence that donald trump is a racist. I think the statement is the problem. Right. Not his general character. And his friend has come to his defense. Good for him. I dont know donald trump well. But i must tell you ive never experienced any racism on his part. I dont think thats the issue whether hes a racest. I think the question is the statement is inflammatory, he ought to walk it back and take it back and retract it. And by speaking of what we were talking about just a minute ago, we were planning on spending a great deal of the show talking about all the turmoil in the democratic side, but donald trump issued that statement at the top of the hour. And bringing more attention and oxygen to this. And apparently hes never going to talk about it again probably until tonight when he has a press conference. Until andersons show at 8 00. Exactly. I think another problem for donald trump is how many Chris Christies will there be, right . We know Chris Christie could be on the short list for the v. P. , its probably being whittled down as we speak. Are there going to be other people who really offer a full throated defenses of donald trump, people who are in establishment, people, republicans elected officials, whos going to be on the stage in cleveland other than Chris Christie saying wonderful things.
