Is it that issue about safety and security, men going into womens bathrooms under some false pretense . Well, thats been sort of the emotional trigger as they describe the potential outcome of all of this, is that they worry there could be Something Like that. The federal government pushes back and says youre already stigmatizing a specific class of people, transgender, as being some kind of pervert in some way, which, of course, they are not. So i have to stop you there. Im sorry. Well come back to you afterwards. Heres the attorney general loretta lynch. Good afternoon, ladies and gentlemen. Thank you for being here. I am joined by the head of the Civil Rights Division here at the department of justice. We are here to announce a significant Law Enforcement action regarding North Carolinas public facilities privacy and security act, also known as house bill two. Now, the North CarolinaGeneral Assembly passed house bill two in special session on march 23rd of this year. The bill sought to strike down an antidiscrimination provision in a recently passed charlotte, North Carolina, ordinance, as well as to require transgender people in public agencies to use the bathrooms consistent with their sex as noted at birth rather than the bathrooms that fit their gender identity. The bill was signed into law that same day, and in so doing the legislature and the governor placed North Carolina in direct opposition to federal laws prohibiting discrimination on the basis of sex and gender identity. More to the point, they created statesponsored discrimination against transgender individuals who simply seek to engage in the most private of functions in a place of safety and security, a right taken for granted by most of us. Last week our Civil Rights Division notified state officials in North Carolina that house bill two violates federal civil rights laws. We asked that they certify by the end of the day today that they would not comply with or implement house bill twos restriction on restroom access. An extension was requested by North Carolina and was under active consideration. But instead of relying to our offer or providing a certification, this morning the state of North Carolina and its governor chose to respond by suing the department of justice. As a result of their decisions, we are now moving forward. Today we are filing a federal civil rights lawsuit against the state of North Carolina. Governor pat mccrory, the North Carolina department of carolina safety, and the university of North Carolina. We are seeking a court order declaring hb2s restroom restriction impermissibly discriminatory as well as a statewide bar on its enforcement. Now, while the lawsuit currently seeks declaratory relief, i want to note that we retain the option of curtailing federal funding to the North Carolina department of Public Safety and the university of North Carolina as this case proceeds. But this action is about a great deal more than bathrooms. This is about the dignity and the respect that we accord our fellow citizens and the laws that we as a people and as a country have enacted to protect them, indeed, to protect all of us. And its about the founding ideals that have led to this country haltingly but inexorably in the direction of fairness, inclusion, and equality for all americans. This is not the first time that we have seen discriminatory responses to historic moments of progress for our nation. We saw it in the jim crow laws that followed the emancipation proclamati proclamation. We saw it in the fierce and widespread resistance to brown v. Board of education. And we saw it in the proliferation of state bans on samesex unions that were intended to stifle any hope that gay and lesbian americans might one day be afforded the right to marry. And that right, of course, is now recognized as a guarantee embedded in our constitution. And in the wake of that historic triumph, we have seen bill after bill in state after state taking aim at the lgbt community. Now, some of these responses reflect a recognizably human fear of the unknown and a discomfort with the uncertainty of change. But this is not a time to act out of fear. This is a time to summon our national virtues of inclusive ti, of diversity, of compassion and open mindedness, and what we must not do, what we must never do, is turn on our neighbors, our family members, our fellow americans for something that they cannot control and deny what makes them human. And this is why none of us can stand by when a state enters the business of legislating identity and insists that a person pretend to be something or someone that they are not or invents a problem that does not exist as a pretext for discrimination and harassment. And let me speak now directly to the people of the great state, the beautiful state, my home state of North Carolina. You have been told that this law protects vulnerable populations from harm, but that is just not the case. Instead, what this law does is inflict further indig ti on a population that has already suffered far more than its fair share. This law provides no benefit to society, and all it does is harm innocent americans. And instead of turning away from our neighbors, our friends, and our colleagues, let us instead learn from our history and avoid repeating the mistakes of our past. And let us reflect on the obvious but often neglected lesson that statesanctioned discrimination Never Looks Good and never works in hindsight. It was not so very long ago that states including North Carolina had other signs above restrooms, water fountains, and on public accommodations, keeping people out based on a distinction without a difference. Weve moved beyond those dark days but not without a tremendous amount of pain and suffering and an ongoing fight to keep moving forward. Let us write a different story this time. Let us not act out of fear and misunderstanding but out of the values of inclusion and diversity and regard for all that make our country great. And let me also speak directly to the Transgender Community itself. Some of you have lived freely for decades, and others of you are still wondering how you can possibly live the lives that you were born to lead. But no matter how isolated, no matter how afraid, and no matter how alone you may feel today, know this that the department of justice and indeed the entire Obama Administration want you to know that we see you, we stand with you, and we will do everything we can to protect you going forward. And please know that history is on your side. This country was founded on the promise of equal rights for all, and we have always managed to move closer to that ideal. Little by little, day by day. And it may not be easy, but we will get there together. Let me also thank my colleagues in the Civil Rights Division who feel devoted many hours to this case so far and who will devote many more to seeing it through. Lets talk about this after weve heard from the attorney general talking about the lawsuit that the United States government, the Obama Administration, is bringing against North Carolina, the government led by the governor as well as the North Carolina department of Public Safety and the university of North Carolina about hb2, which is the law that ensures individuals can only use the bathroom designated by the gender on their birth certificate, not the gender with which they identify. Lets bring back in martin savidge. And paul butler is a law professor at Georgetown University. Professor, let me start with you. How unusual is it for the Justice Department to take a course of action against a state like this . You know, this is a very dramatic and historic confrontation. Its the federal government versus North Carolina. Its states rights versus federal rights, and in that sense its not unprecedented. The attorney general alluded to the struggle for Racial Justice back in the 1950s and 60s. Then that issue was decided in the court. Here it will also be decided in the court. But we havent seen a case like this in a long time. So, martin, as the attorney general suggested, this began when the city of charlotte, North Carolina, passed an antidiscrimination law. How did we get from there to here . Well, that quickly was pulled up by the North Carolina state legislature. They were not keen on that a city would deem some sort of action that they felt was the power of the state. So thats when this new legislation began to be drawn up and became known as the bathroom bill and it eventually said that people transgender had to go with the biological sex bathroom they identified with, not with what they identify with now. Thats where we have come to. It was an issue brought up in a city to protect rights. Now many say it is an issue thats been taken over by a state legislature to defive are rights. Thats certainly the point that the federal government is trying to make. Theyre asking in their lawsuit for a preliminary and permanent injunction against North Carolina to prevent further violations and also to grant such additional relief as the needs of justice may require in other words almost Carte Blanche to do whatever the federal government need to do to bring North Carolina into compliance. Its already been threatened with the cutoff of billions of dollars. Opponents of this law like the governor of North Carolina say it would allow grown men to into go into the ladies room where they could do who knows what to a little girl. Ive asked supporters of the law to give me an example of, that and i have not been able to hear of one. Tell me more about this charge from the governor about what this law might allow. So it really is a solution to something that was not a problem. Theyre just not documented instances of people who the governor divisively called cr s crossdressers going into bathrooms trying to harass people. So the court will look and see, well, what is the purpose behind this law, and if its just animus, if its just trying to make transgender people feeling less than other people, then guess what, thats unconstitutional. So the Civil Rights Act doesnt say anything specifically about transgendered people. But it does outlaw discrimination based on sex. So the Obama Administrations interpretation is that discrimination against transgendered folks is sex discrimination and therefore it violates the federal laws against discrimination. Professor, before you go, how likely sit that this will end up before the Supreme Court . You know, its possible, but interestingly enough, the fourth circuit, which is a very conservative federal appellate court, came down on the side of civil rights for transgendered people. So i dont know if theyre going to even get a case from a lower court that goes in favor of North Carolina against the Obama Administration. The attorney general was right, that history and the law seems to be on the side of the transgender civil rights movement. All right. One of the pushbacks is what about quantitative easing . How is well print more money different from quantitative easing . What is the difference between the two . Quantitative easing is the fed purchasing asset, dont have to be treasuries. Some are mortgagebacked securities, for purposes of pumping money into the banking system. This is buying a particular Treasury Security for the sole purpose of having the money to repay. And so it means that you have lost the ability to tax the economy, which is typically how we repay, and youve lost the ability to have the economy growing and pay it back. Youre in a very bad place when youre starting to print money for the purpose of retaining debt. Not the same thing. Not even close. Lastly in our most recent poll, donald trump beats Hillary Clinton on how he would handle the economy. 50 to 45 . So its common for families to turn to exterminators during this time of the year. But one family says the decision to hire terminex, one of the largest exterminators in the country, had devastating consequences for their family, exposing a 9yearold to pesticides leading him to suffer from severe brain damage. This is the second serious poissoning case involving terminix in just six months. Heres cnns sara ganim with the report. Reporter their Florida House had drywood termites and needed fumigation, so kyle and laurie decided the company for the job was one of the largest around, termin terminix. I think the decision was made to go with them as opposed to just a local company. Reporter so in august 2015, the house was tented and fumigated. But it was a subcontractor hired by terminix that actually did the work. They had a Sales Representative terminix that came out and sold us the job, you know, looked around the house with us, but it was actually another company that showed up to do the fumigation. Reporter that company was a Small Business called sunland pest control, which was run out of this residence. When they came back home, there was a notice on the front door saying the house was safe to enter. But almost immediately there was trouble, especially for their energetic and athletic son payton, then 9 years old. Tell me when you first realized that something was wrong. A couple hours after we got in there he said he was feeling sick. Reporter things got progressively worse. They took payton to an Urgent Care Center where a doctor had horrifying news. He immediately told us your sons been poissoned. Reporter poissoned, doctors later told them, by the pesticide used in that fumigation. Payton had severe brain damage. His arms would fly arnold. His head was going back and fort nonstop. To see your child running around on a sunday to the next night completely with all these wires and things down his tubes down his throat, it was it was horrible. It was it was like a nightmare. At times his tongue was hanging out of his mouth. When a doctor tells you, you know, thats as good as its going to get, just reporter it turns out sunland pest control owner posted the reoccupancy notice for the family to return home without properly checking to see if the air was safe. According to this investigation by the Florida Department of agriculture, williams knew his air quality devices should not be used since they did not work. Moreover, investigators said the fumigation equipment was faulty. The pump was leaking, the printed Circuit Boards were not up to correct parts. There was no airflow to the unit. Its our position that term in addition did not take the care that they should have taken in conducting a fumigation properly and overseeing the individuals that were doing that fumigation properly. Reporter after paytons poisoning, sunland pest control was shut down by the Florida Department of agriculture. Sunlands owner and his employee were charged in federal court and found guilty of improperly using a pesticide. The family blames terminix and is suing. In court papers, terminix denies any responsibility, instead putting the blame on sunland, the subcontractor. A positive, amazing little kid and tells us all the time dont worry because im going to be okay. Hes stronger than us, thats for sure. Reporter but for terminix, this is already the second serious poisoning case in less than six months. A family from delaware on vacation in the u. S. Virgin islands suffered serious neurological injuries after checking into a Vacation Home that was improperly fumigated by term in addition. Their injuries are believed to be permanent. Payton is slowly getting better. Hes able to go to school parttime but spends his days in intense therapy. The owner of sunland pest control, when i reached out to him by phone, told cnn that he apologized to paytons father and never intended to hurt anyone. He denied that he had faulty equipment or that he did anything wrong. He said he had been properly trained but when pressed about the federal charges he said, im not going to get into that. He and his employee are both set to be sentenced in federal court in florida on wednesday, jake. Heartbreaking story. Sara ganim, thank you so much. Facebooks trending section may be how you heard about that thing that everyones talking about in the office, you know that thing. But now a new report claims that according to a former facebook employee, the social media meg company sometimes ignores what is actually trending among its billion users if the story originated from a conservative news source or if its a topic causing buzz among conservatives. Now, for their part, facebook denies the allegations claiming they have procedures in place to assure neutrality in their trending section. Facebook said, these guidelines do not permit the suppression of political perspective nor do they permit the prioritization of one viewpoint over another one or one news outlet over another. For what its worth the story alleging this is currently trending on facebook. Lets talk to the nigh gai who broke the story, michael nunez, Technology Editor from gizmodo. What did former employees tell you . That there was a system in place that allowed hem to either blacklist or inject stories that werent trending into the news feed. So in a sense, there were human curators that were actually, you know, affecting what was showing up on facebooks trending news feed. You know, for the last two years facebook has maintained that its been an algorithm sorting these topics, so we obviously found these revelations to be pretty interesting to say the least. And why might facebook executives or officials want to keep stories about people such as mitt romney or ted cruz or american sniper chris kyle off the trending list and inject others into its trending list . Why do that . Because of their own personal bias . Well, you know, so its important to note that facebook isnt manding this of the news curators. They have basically tried to wash the existence of these curators from the facebook planet. For the last to years theyve been saying the algorithm doing the sorting. We have found a small group of 20 journalists graduat from east Coast Private school, often ivy leagues, are the ones activating a trend so that it can show up in your feed or blacklisting it. So, you know, its not that facebook has any bias here. I wants that these young journalists are the ones that are choosing what trends and what doesnt, and, you know, the question then becomes whether you trust recent graduates to determine what the most Important News of the day is. And quickly, if you could, michael, did you find any evidence of political bias being applied the other way on liberal sites like msnbc. Com or daily codes or think progress . No, we didnt find any evidence of that, but, you know, at least in one instance we had a source that was maintaining a list for the course of sixmonth period in which he found items like chris kyle, ted cruz, mitt romney, and a variety of other conservative news topics that were blacklisted by facebooks news curators.
