Biggest air assault on gaza in at least two years, with israeli troops lining the border, the big question is a Ground Invasion next. And the money lead, oklahoma threatening to unseat california as the earthquake capital of the u. S. And the reason according to a new study is closely linked to an industry and one that signs a whole lot of paychecks in that state. Good afternoon, everyone. Welcome to the lead. Im jake tapper. Well begin with the national lead. President obama will touchdown in the Lone Star State where he will step off air force one and immediately into the middle of what his administration has called a, quote, urgent humanitarian situation. Tens of thousands of children from Central America flooding the border. On one hand theyre just kid, 52,000 of them since october, looking for a better life, perhaps escaping who knows what, on the other hand, theyre breaking the law by coming here, overwhelming facilities and resources and setting a dangerous precedent and they just keep coming. The main reason the president is on this trip in the first place is fund raising and hell do the texas twostep on calls for him to go to the border for him to size up the urgent humanitarian crisis, however, he has requested 4 billion in emergency funding to try to deal with it. The president called out House Republicans after Speaker John Boehner said he can forget about a speedy vote on that request. Its more about continuing to deal with the problem. Weve got to do something about sealing the border and ending this problem so that we can begin to move on with the bigger question of Immigration Reform. Congress just said no to fixing our broken immigration system in a way that strengthens our borders and our businesses, despite the fact that everybody from Law Enforcement to corporations, to evangelicals. There is a coalition around Immigration Reform thats unprecedented. These guys still cant get their act together. Within minutes of arriving in dallas this evening, the president will meet with rick perry to discuss and likely argue over this crisis at the border. Perry who aimed to knock president barack obama out of the oval office in 2012 has ravaged the stance on immigration. The meeting almost didnt come together with public sparring with each side barely containing its contempt for the other. Our ed lavandera is at love field in dallas and our Alina Machado is standing by at the u. S. Mexican border. Is there any hope for the president finding any Common Ground here . Reporter jake, its not exactly clear how much oneonone time hell have with the president. President obama is meeting with local officials here and government officials and the Dallas County is considering a proposal of offering temporary shelter in a number of schools that would be able to house some of the influx of unaccompanied minors so that meeting is taking place. Weve reached out to rick perrys people throughout the day. Theyve been very tightlipped about what to expect from this meeting. So well be anxious to see just what kind of progress, if any is made and exactly what kind of oneonone communication, governor perry and president obama have while they meet here as well as other people will be a part of this process, as well. Well be monitoring that and were notor perry will be following with statements. Turning to Alina Machado at the border. What are you seeing down there . What are the conditions in which these children are detained . Reporter jake, i want to give you a sense of where we are. Ry are right on the border, right on the rio grande on one side. On the other side over there you have the mexican side. On this side where im standing you have the american side, the u. S. Border. There is a very Strong Border patrol presence in this area. I dont know if you can see over there, i want to show you, there is a Border Patrol helicopter hovering and weve been seeing helicopters and boats from the Border Patrol all over this area all day. We also wanted to venture into town and see how things are. We stopped by the bus station where many of the immigrants go before leaving town and we did see a few families from Central America including a woman and her 4yearold son who spent 15 days traveling to the u. S. From el salvador. They were getting ready to board a bus and go to houston to meet up with family. We also stopped by a Catholic Charities shelter thats been helping some of these immigrants and some of these children as theyre making their way through the process. That shelter has a mobile clinic and so far what they tell us theyve been seeing are primarily cold like symptoms and also dehydration. Take a listen to what the owner of the clinic had to say to us. We have no knowledge of where theyre coming from, what Detention Center area, but weve seen sometimes where, lets say 30 come in a bus which is a shuttle busses from the city and well see, say, 08 and then there are times when the same number come by and well see 25 . Of people who are sick . It varies a lot. Reporter now theyve been treating at that clinic children and adults, and i asked them how long are you prepared to sustain this . They said as long as needed. This person told me they are relying on volunteer doctors and nurses to help get the medical treatment these people need. Jake . Alina machado and ed lavandera in texas, thank you very much for those reports. While the president is out of town the senate held a hearing on the crisis on the border with six different agencies. They could fit on the brady bunch box, and there are a lot of agencies and im sure its very easy to understand each agencys role, right, guys . Were working with ice and health and Human Services and fema and others and the federal partner to ease these current conditions. When an unaccompanied child is in cbp custody they refer the child to us. Cbp notifies i. C. E. And the department of Human Services office of refugee resettlement, orr. Makes sense to you, right . That only emphasizes just how complicated u. S. Policy on Border Security and immigration really is and how the answers dont come easy with so many. Tom coburn of oklahoma was at that hearing and he joins me now from capitol hill. Good to see you as always. I want to play an exchange you had with Marc Greenberg for children and families. You asked greenberg if theyre checking on the legal status of the families with whom these children are being placed. Im asking you why you do not ask that question . Of the sir is it the policy of hhs not to ask the status of those people with whom you are placing the child . We do not specifically is that the policy . Ask the immigration status. Is that the policy of hhs of this country . Yes, it is that is the case. Yes. So, senator, i guess the followup is if it became the policy that you find out the legal status and if they were not legal, what do you think the children should be done with those children. Thats not where i was going, jake is theyre never going to show up for their hearing on whether or not theyre eligible to stay here and thats our problem. We have two sets of laws for the same groups of people that try to come into america. If youre mexican or canadian we have one set of laws which means you get repatriated almost immediately, whether a child or an adult. You automatically go back. If youre other than mexican, then we have a different law that was changed in 2008 with good intentions, but never recognizing that this would be the consequence of it. I take your point. Youre saying that if the kids are placed, these kids who come into the country illegally with people who are also not in this country illegally then theyre never going to show up for these hearings, but the solution, i suppose, would be to check on the legal status and what do you do then if it turns out that they would be turned over to people who were also in the country illegally . The real solution is to treat other than mexicans the same way we treat mexican citizens when they come across the border. Repatriate them immediately . Repatriate them immediately. We have a tragedy occurring because people think they can come here without any risk, this jaunt from honduras or guatemala is not without risk. Weve had tremendous amounts of tragedy, rape, death of children. Weve had a lot of mothers with children that are not unaccompanied children. You have to fix the real problem and the real problem is we have a law that says Border Patrol cant hold them more than 72 hours and they cant be repatriated automatically. We need to change that because lets talk about that. Let me make one point on it first. Sure. Were putting a lot of kids at risk. Remember, this is organized crime that is selling this and these three countries that you can get them here and theyll be here and theyre extracting large amounts of money and then abusing children as they carry them up here. Its horrific. Absolutely. Its terrible. The best way to stop that is to have airplanes landing every day bringing these children back to their country of origin. I want to ask you about that because you and senator ron johnson seem to be making that point, fly these children back to the countries they came from to send that message, but the reality is these parents are sending their children away from poverty and violence and the United Nations has named honduras, one of these country, the murder capital of the world, and el salvador, do you fear you might be sending them back to an uncertain future. No, i dont, because its not significantly changed in the last three or four years . Whats caused this change . Its the signal that says you can come here and you wont get sent back. Its created an expectation that is wrong and thats putting hundreds and thousand of children at risk. Here is the other side of it the American People ought to know. The president just asked for 3. 7 billion, for less than 20 million we can fly them all back first class. So think about how stupid our policy is. We have a law in the books which we need to change and then we need to solve the problem by repatriating within 72 hours to their country of origin. Senator, just to touch on the issue that president obama makes which is there is a larger immigration issue in this country. I recognize that an Immigration Reform bill did pass the senate. House republicans refuse to vote on anything. I realize that that does not specifically address this immediate crisis, but isnt there a larger issue here and republicans, for whatever reason especially in the house are refusing to even compromise on it . No, i dont think so. You need to look at the executive order and the regulations put out that actually said if you come in here youre not going to get sent back. So weve sent the signal through the administration. Congress didnt send that signal and this administration sent this signal and now you have the crisis on our hands because weve sent that signal. I disagree. I want to solve the immigration problem, but the way you solve the immigration problem is secure the border and youll have americans come around and say, yes, we want to solve the problem. Senator tom coburn of oklahoma. Thanks for your time. Youre welcome, jay. Coming up on the lead, why was the u. S. Government reportedly reading their emails. Well ask two targets of the covert nsa Surveillance Program next. There were two significant earthquakes in the state, where are sez are residents there suddenly buying earthquake insurance like its going out of style . Lets show em what it means to be built ford tough. Ready to save the world . Ill drive. The ford summer spectacular sales event. Now playing at ford dealers everywhere. The summer of this. Mmer. Get out there, with over 50,000 hotels at 150 dollars or less. Expedia. Find yours. Welcome back to the lead, he shook the Intelligence Community of the United States to a core with its thumb drive and another one of the highly classified documents solen by Edward Snowden is hitting thea irlines. Its a spread sheet showing 7,000, mail addresses that were the targets of government spies. On it are more than 200 american citizens including five prominent muslimamericans who say they did nothing wrong. Our pamela brown has the details. Reporter in a new report the federal government spied on muslimamericans for six years according to the latest documents leaked by former nsa contractor Edward Snowden, an attorney, two professors, the director of the Muslim Organization c. A. R. E. And a political candidate running for office, all of whom deny any ties to terrorism. Many muslimamerican advocates say the new report is alarming. All americans should be concerned because there may be one group of americans today, but tomorrow it could be another group of americans. Greenwald of the intercept identifies the five americans based off an nsa spread sheet titled fisa recap showing, mail address the government monitored. With the judges approval of the fisa court. The spread sheet designates 202 email addresses belonging to u. S. Persons and many of the email addresses on the list reportedly belonged to foreigners. The government believed were linked to hamas, hezbollah and al qaeda. Were concerned about the security and at the same time were concerned about the fundamental right weise have as americans. The government under president george w. Bush began monitoring the american muslimses soon after the 9 11 terrorist attacks. Targets included members of the president s own party. Faisal was a gop operative and served under bush. The spying allegedly continued through 2008 and in a joint statement the department of justice and the director of National Intelligence say the government values privacy just as much as National Security and that its entirely false that u. S. Intelligence agencies conduct an electronic surveillance of activist figures solely because they disagree with public approximately sees and criticize the government. Pamela brown, cnn, washington. Our thanks to pamela brown. I want to bring in Glen Greenwald for the intercept, he joins us live from rio de janeiro, along with two of the men targeted, as am gafor and faisal gill, also an attorney and former senior policy of the department of Homeland Security under george w. Bush. Thank you one and all for being here. I want to get to your story, glen, for a second, but first, glen, you suggested in wired magazine interview there might be a seconds nsa leaker in addition to snowden and im wondering has snowden confirmed that . Its confirmed. Its just that there have been stories published by other Media Outlets about america sa, using nsa documents that didnt indicate that Edward Snowden was their source for the documents leading, i think, to the reasonable suspicion that there is another source or sources providing documents to Media Outlets. All right. Back to your story. The government says that they dont spy without reason. You havent actually seen the fisa documents or other legal documents justifying the surveillance, right . So we dont know what the justification was. Right. When ive seen is all the evidence about how these american citizens have lived their lives and the fact that theyve never been shcharged wi a crime let alone convicted of a crime and theyre all public figures that have led exam lary lives and cannot remotely be said acting as an agent of a foreign power. That leads to the question why were they targeted. Lets get to you. You both have had associations in the past that were written about in glens story that people might wonder about. You have done legal representations for groups that have been charged by the u. S. Government of being associated with terrorism and you worked briefly for the American Muslim Council and the leader of the group was later sentenced to jail for the libyan plot for the crown prince of saudi arabia. Is it not possible that those were the reasons why there was surveillance . Ill start with you. Im a civil rights lawyer. I had a lot of clients, if its my clients thats calling it, thats a reason for pause to find out what benefit does the government have listening in on the lawyers communications in my case his client, what information can they use in court. In these cases i was against the government and i was winning against the government. Imagine an agent telling his or her supervisors, we had listen to his calls and maybe we can go to court to beat him and while it sounds plausible, as a lawyer, thats not the way to go about doing it. And you, its an even more interesting story for you because you worked for the Bush Administration for the department of Homeland Security at the time. Thats right. Thats why my number one reaction was of shock and surprise because theres nothing in my background that would lead any Law Enforcement agency to suspect me of any acts of terror. Now, yes, i did work for the American Muslim Council for a brief period of time, but during the time i was working with them director muller of the fbi called the American Muslim Council the most mainstream muslim group in the United States and al newedy who was th leader and who was subsequently caught in a plot, i hardly had contact with him and not know him well and he was not with amc at the time i was working with him and all of that was out in the open. I was their spokesman so i was doing it outwardly and what are other groups are there . Theres american muslim counsel and c. A. R. E. Whose director is also on this list. If youre a muslim and you want to work groups, there are only a few choices. The list has 7400 individuals, this monitoring supposedly took place between 2002 and 2008. You seem to be suggesting very strongly that these individuals were spied on because they were muslims, at least in the case of these five as opposed to i mean, i dont know the ethnicity or the religion of the 7400. I am no expert on statistic, but five out of 7400 isnt necessarily representative, right . Let me clear up a couple of things in your report and one of your questions. The list does talk about spying between 2002 and 2008, but the spying and question on these individuals who are in front of you and also the three that we named took place if 2006, 2007, and 2008. In the case of faisal, it was many years after he was at that council. It was during the time he was the republican nominee for the house of delegate seat in virginia. And so, the question that you asked him what about these clients that you represented, there are all sorts of people who represent highly questionable foreign governments and Bob Livingston represented Moammar Gadhafi and joe trippy represents the government of bahrain, lanny davis represents every tyrant on the planet and none of those people who are similarly situated and who have greater contacts and are arent muslim seem to be on this list and thats the reason why it raises the suspicion along with documents like the one we published like the fbi on the fisa form for a sample is writing things like Mohammed Raghead and usingeth lick slurs against arabs and muslims and do you means that weve seen before from the fbi and nsa raising what the motive is. Ethnic slurs are horrific part of this story, but lets get back to your case. I understand youre an attorney. Right. And theres attorneyclient privilege. Absolutely. But being a lawyer does not shield you from a fisa warrant and these cases, either a fisa court or before the the Bush Administration was called out on this, the attorney general himself, somebody thought that there was something worth looking at and they looked into it, it might have been ultimately to clear you. Well, im not saying im immune just because im a lawyer and lawyers have been prosecuted for passing on. Stewart. Yeah. Whether you agree with that level of surveillance on a jailhouse interview is one thing, but to have somebodys private email, it wasnt even my law firm, mail. It was my yahoo account to surveil that and to every 90 days or whatever they have to do to keep going before a very serious judge who may not have had the benefit of a clerk because fisa is very secret and going before the judge, saying we need another 90 days and to extend that for three and a half years and i feel sorry for the agents who had to read all of that. Theres not a whole lot you will get from my yahoo account. We are running out of time, so as briefly as you could. You work for the department of Homeland Security. You know this nation is under constant threat. You of all people must understand sometimes investigators look in places and they dont find anything, but its important for them to look. Absolutely. I have no problem with surveillance. Surveillance needs to happen, but there has to be a reason for it. There has to be something in my background that would lead someone to believe that okay, this person should be suspected of questionable cyactivities. I worked for the american muss lick council and after that i had my security clearance and it was proven it was disclosed. There was nothing there in my background and the other thing i would say lastly is the fisa court has a very high success rate, 99. 6 or something ridiculous like that. If you were to go to any county in the United States and look at the success rate for obtaining a search warrant for any crime, breaking and entering, robbery, it would not be that high. Clearly there is something wrong with the problem. You think its because youre a muslim . I cant think of any other reason. Exactly. No other reason. Thank you so much. I really appreciate you taking the time to come down here. Appreciate it. When we come back, a threat to National Security in the chamber. John kerry says his former colleagues are harming u. S. Reporter twothirs of the nominees waiting for confirmation are uncontroversial career diplomats. They charge republican payback from new senate rules that were ez intoed to have president ial nomin nominees. Nominees must be debated and confirmed one at a time instead of at groups or by unanimous consent, eating up hours of time ottesen at floor. Republican senator rob portman agreed that career diplomats should be given a quick confirmation, but he defended the delay of political and more controversial nominees to cnns jake tapper. The leadership on the democratic side of the aisle has chosen for the first time ever, at least in modern history to say republicans are not going have a voice in the nominees. The only voice the republicans have is to slow walk the process. There are those who are questionable, for knowing little about the countries they were going to serve. And jake, secretary of state kerry has proposed taking out those controversial political nominations and giving career diplomats a quick blocked senate vote just like they do for top military positions and thats a compromise even Many Senate Republicans on which they seem to agree. In other world news today 19 people are were killed today in gaza by Israeli Military air strikes and the idf claim theyve hit over 500 hamas targets, over 500, but the palestinians say it comes at a huge human cost, more than 50 killed including women and children and some believed to be the families of hamas members and the militants in Gaza Continue to fire rockets. Today at least 70 flew into israel toward major cities like tel aviv and jerusalem and basketbally beyond and so the Israeli Government is showing no signs of backing down and the cabinet has authorized the military to call up 40,000 troops and the officials have hinted at using forces on the ground perhaps as later today. Lets bring in Cnns Becky Anderson in jerusalem. Rockets being fired in jerusalem and tel aviv and one imagines it will only escalate from here. Yeah. Its about 11 40 at night and you know this city of jerusalem well, jake. It is quiet, slightly eerily quiet, i would say and behind closed doors quite sense this evening and that is because this time last night the sirens went off and thats a twominute warning for incoming rocket fire. Now the iron dome, the military, the Defense System outside of the city of jerusalem here picked up three of those rockets and they did land in open growth fund. About 20 kilometers away from this, the cnn bureau which is on the entrance to jerusalem. So understandably, people tense here tonight and they have also seen the images coming in in the past couple of hours in gaza. Deadly air strikes by israel once again this evening. So that will be disturbing people tonight as they hit their beds. They do have shelters here as you will know and oftentimes they share shelters or they will go into stair welles as they would have done last night. Hamas reiterating today that it has a fivepoint ceasefire plan, not least the release of those prisoners who were freed during the 2011 gilad shalit exchange and they also do not want it see israel trying to destroy the unity government for the palestinians. So harsh word again from the Hamas Organization today and they have also said that if the ceasefire isnt acceptable to the israelis, they will extend their art. This rocket launch will be on a longer range and that really does begin to concern the israelis inordinately. Just today the idf confirming a rocket launch about 120 kilometers out of gaza toward tel aviv and that is shocking to the israelis. Jake . Becomy anderson in jerusalem and stay safe. Ambassador to the United States, ron dermer. In an interview with president perez, he told Becky Anderson that the Ground Forces could be out soon. The operation will be expanded and will continue until the firing come the Community Stops and quiet is restored. Should we expect Israeli Ground troops in gaza and more largely, is there even a military solution to this problem . You should expect israels government to do what any government would do. We have 6 million israelis over the last two days that have had to run into bomb shelters in israel. Weve had air sirens go off in tel aviv which is our new york, in jerusalem which is our washington and you can imagine what the American People would demand their government to do if twothirs to threequarters of the population of the country had to run into bomb shelters. The Prime Minister of israel will do what he has to do to end the rocket attacks. We dont have a fivepoint ceasefire. Stop rocket attacks against israel. Its very simple. You say you and your governments say youre targeting hamas, but youve heard children have been killed. Innocent people have been killed, children by definition. Thats right. Theyre not targeted and it makes a big moral difference between hamas and israel. Hamas deliberately targets our civilians and they hope to kill as many civilians as possible and thats what they will deem a success of their operation. What are we doing, jake . They are targeting the terrorists. The problem with hamas is they use the population of human shields and they put missile batteries next to school, next to hospitals and next to mosques and israel is striking at the terrorists. The vast People Killed are not innocent, theyre terrorists. In taking action to defend ourselves there are innocents that have been killed and thats a tragedy, but were not the same as hamas, were not targeting the innocent. This is what mayim told wolf blitzer yesterday about these attacks and about what you just said. Claims by their spokesperson that they are precise and careful is meaningless because innocent people, seven children were killed today. Israel must also assess and evaluate the consequences of its continued attack because it will have some negative impact on the relationship with the palestinians as a whole including with the plo. If youre unloading 500 tons of explosives which the idf says it dropped in gaza today, in the last two days, even if youre being precise, there are going to be innocent civilians killed. I get what youre saying about who hamas targets versus who the idf targets. Point taken and if youre putting that much ordinance in gaza, youre going to kill innocent palestinians. Jake i was born and raised in this country. Let me ask you a question. What do you think americans would do if over 200 americans were in bomb schett ehelters. When you have a terror organization, you know who they are and where they are and theyre firing rockets. Do you think america would use less force than israel is using now . The hypothetical is meaningless because is america building housing in mexico at the time . Its an extrapolation. I know, its actually very meaningful because what happened in gaza. We withdrew from every square inch of gaza and we removed the settle ams. Theres not a single settlement in gaza. Israel does not control a square inch. Ry removed 10,000 people in 2005. Since then weve had 8,000 rockets land on israel. I wonder if thats hamas plan, though, if thats hamas plan to alienate the moderate palestinian leadership because israelis are. Hamas plan is to kill jews and destroy the state of israel. Thats the plan. I want to ask you about tariq kadir. When is he coming back to the United States . This is the palestinianamerican boy beaten by Israeli Police and whats the latest on that case . Have any police been arrested or detained . There say development on that case. The Justice Ministry that opened an invest galgz, they Just Announced a couple of hours ago that they suspended the Police Officer who was involved and theres also going to be im not sure if its one or two, but theyre also right now they have, theres going to be a hearing for this Police Officer and they may open up criminal proceedings against him. Were a serious country with laws and theres an investigation as i said originally. Theres no excuse for excessive use of force and well take whatever action we can take to make sure justice is done. Is tariq back . I dont know the specifics of the case and i think if he wants to go back hell be able to go back, but i also know there is an ongoing investigation. What happened before and after the arrest and subsequent to the arrest. Time to turn to the money lead. What if the big one comes in not in california, but oklahoma. Oklahoma experiencing an explosion in earthquake activity. Its had more earthquakes than california this year. Why . Well, a new stud ney Science Magazine links this update to a controversial drilling practice, an industry that forms one of the pillars of oklahomas economy, but as Martin Savidge reports, after all of the shaking someone might want to inspect that pillar for cracks. Reporter in oklahoma, earthquakes are in the news. Having an earthquake right now, our lights are shaking quite a bit here. The day we arrived there were three earthquakes magnitude 3. 0 or greater before lunch. These three were all before noon today. Thats right. . Turns out thats nothing. Weve had, um, probably a hundred quakes in total today already. Reporter most are those of hardly felt, but theyre getting strongly. Weve never seen anything like this. The the quake measured 5. 7, the largest in modern oklahoma history. Reporter marla worries the source of the soerth wake is located not that far outside of town. Right about here. An underground injection well where waste water from the states booming oil and natural Gas Production is pumped back into the the earth. Oklahoma has roughly 10,000 of them. Some scientists suggest the wells are destabilizing the states Underlying Network of fault, but any suggestion drilling and earthquakes are related makes for some difficult conversation here. Does it ever worry you at night that maybe in some way that industry is causing that kind of harm . Has it ever crossed your mind . It concerns me that its possible. Reporter one out of every six oklahomans gets a paycheck thanks to the oil and gas business. It also produces 27 of the states annual tax revenue. Were not ignoring it. Were working hard on it, and we need to understand the science better. Reporter scientists have linked the prague earthquake to nearby injection wells, they stopped short of saying that injection wells are responsible for all of the states earthquakes. The problem may be part man made and part nature. Were probably looking at a contribution of different factors working together to create what can only be described as kind of the perfect storm. So seismologists and the Energy Industry have teameded up to try to stop the solution that stops the quakes, but not the drilling. Do you worry about another one . Yes, every day. Which explains oklahomas newest business boom. Earthquake insurance. Martin savidge, cnn, prague, oklahoma.
