Tomorrow marks the end of a years long nightmare for the Five Americans and their family. 51yearold Siamek Ham Assy and 59yearold emad sharghi in 2018 and 69yearold morad tahbaz, facing charges relating to spying by the iranian government. The identity of The Other Two want to remain private and this is a deal in which the u. S. Agrees to dismiss federal charges against five iranians accused of violating u. S. Sanctions. And to unfreeze 6 billion of iranian oil revenue. Iran is only allowed to spend these unfrozen funds on humanitarian purchases. Were told that that will be monitored by the u. S. Treasury. But President Biden is facing criticism from republicans including from former Vice President mike pence who is expected in a speech this hour to say that unfreezing those iranian funds will, quote, foment terrorism across the middle east. Given that iran is a u. S. Designated tate sponsor of Terrorist Groups in gaza, syria, baja rain and throughout the middle east. But President Biden said reunited wrongly Detained Americans have a priority since day one and we will continue to impose costs on iran for their provocative actions in the region. And to unblock 6 billion in frozen iranian funds from south korea. That cash moving from seoul to switzerland before being transferred to doha, after the Biden Administration last week issued a Sanctions Waiver Clearing the way for the money to move. The role of qatar now changing from mediator to guarantor. Ensuring washingtons demands that irans billions are strictly controlled and spent only on humanitarian goods like food and medicine. What were his first words to you . He said, jared, im free. And you know, it was a Long Time Coming to say the least. It was extraordinary for me to see him. On a massive screen, im traveling abroad and in a brig screen in my hotel room and coming down off the plane on cnn and moments later for him to call me and it was incredible moving and it waeb just siamek, but his dad who kaz called back to iran who was trying to reach his son for many, many months was called back with a onetime chance to see his son and then he got taken hostage and spent three years in jail and almost died and trapped in iran for several more years and got out a year ago. So this family has been through something that i think nobody could begin to imagine. Siamek in 2015 was charged with having relations with a hostile state. The u. N. Called his detention arbitrary, the u. S. Said he was innocent. You could explain exactly how sea meck handed up in a iranian prison . He went back like many iranian americans do to visit his family. The family came to the United States after the Iran Revolution and became Naturalized Americans and after after many years in the United States, the parns decided to retire there and he went back to visit his parents and he was there and one day the Iranian Revolutionary guard take his passport and start questioning him on a daily basis with his connections with people in various places and then on october 13th of 2015, they said youre not going home and he was taken and held for many, many months until then his father was induced to come back. But, it is interesting because we talk all about this deal and the 6 billion and is It Hostage Taking and the reality is if you look at it from his perspective, there is different between the barack obama and president trump. The only american left behind in january of 2016, secretary kerry said he would be out within a few weeks and instead he becomes a hostage and barack obama and john kerry dont get them out at the end of the obama administration, they are sitting in jail. And donald trump coming into office with this maximum pressure came on iran and i had hoped maybe hell do Something Different and maybe hell bring them home. But the Trump Administration doesnt impose a single sanction on iran connected to Hostage Taking and worse than that, after promising they wouldnt do it, they brought home two other americans leaving the n the namazis two more times and at the end of the Trump Administration, so what is the difference between the trump policy an the obama policy . And the last thing i would say is if you look at the criticism of the president , it is rich of someone like Vice President pence to be going after the president about the 6 billion deal because the only reason why joe biden had to make a deal is because donald trump and Vice President pence failed to bring the namazis home and joe biden had to go ahead and do it. So siamek was hold in one of the most notorious princisons i iran. What did he experience there . We could talk about it more now. He was in a cell that was maybe five or six feet by five or six feet. Concrete floor and no bedding of any kind. Just rock hard. He had a bucket to go to the bathroom in. And really nothing else in the cell. No reading materials, no contact with the outside world. He was literally taken out every day to be interrogated over and over again. He was beaten and tased. He had electrodes connected to his genitals and after his dad was detained they showed him the video of him being detained and he knew his father was clearly in prison, not far from him as it turned out and they said your father just died and were really sorry but youre not allowed out to go to his funeral and left had imthat way in the cell for a full week until they came and told him, well, we were just joking about that. I hope the rest come home soon and i hope the Foreign Minister has said, which is we wont stop Taking Americans prisoner which essentially means hostage. It is false. But from their track record from the past 44 years, they will continue to do this and theyve been incentivized to do so. Its been one year since the death of mahsa amini. She was the 22yearold woman died in the custody of Iranian Morality Police and arrested for not wearing her hijab properly. And he closely followed her story in iran. Reporter jake, he didnt have to be in the courtroom today but he didnt take the necessary steps in advance and so there was a bit of a hitch at the beginning of this hearing where cluck clark had to sipe a form to say, i consent to not being there as a criminal defendant and from there this issue did create a bit more of a problem for Jeffrey Clark moving forward in that his lawyer had tried to submit into this case as evidence something that Jeffrey Clark had written, semly what is called a declaration, a sworn statement of what his life was like, what his role was as Justice Department official saying that he hadnt been acting on behalf of trump, but the prosecutors took issue with that and they said, wait a minute, we dont get the chance to crossexamine Jeffrey Clarks statements here so the judge didnt bring that into evidence which puts him at a disadvantage because today in court it was Jeffrey Clarks burden to try to show the judge that everything that he was doing after the election was part of his role as a federal official and they were left with very little evidence to be able to show that. And so instead, it was much more about the arguments that his lawyers was making versus the prosecutors. Well how about those arguments . How did the judge take the arguments that clarks attorney was making . Reporter you know, jake, there was some skepticism today from judge steve jones here in the Federal Court. Hes already ruled against mark meadows bid to move his case out of state court into the federal system. And Jeffrey Clark, at times was a hearing where he was questioning Jeffrey Clarks attorney Harry Mcdougal talking about this draft letter that Jeffrey Clark wanted Justice Department officials to sign and send to the state of georgia. And prosecutors say that in that letter, there were falsehoods about the election. That Jeffrey Clark wanted to have the Justice Department say false things that he was unauthorized to say. That his superiors didnt want him to say and that trump was telling him to say and had no role to tell him to say. And the judge pushed back and said isnt that opinion. And so that also didnt go particularly great for clark, trumps attorneys in the courtroom did not seem to be too pleased with those arguments and how they went for clarks attorney. What do you make of Jeffrey Clarks arguments that his case should be moved to the Federal Courts because he was acting a a at the president s question and it belongs in the federal purview. It is not surprising that he would make the argument and the truth is he worked for the Justice Department. And most people know and remember that the Justice Department is under the executive and the president is the Chief Executive at the time. So he could make the argument he was told do do by the highest supervisor he could regardless of what was told to him by his immediate supervisor above him like an assistant Attorney General or the acting Attorney General at the time. Im not surprised to hear some skepticism met by the court. It is a stretch of an argument to make and after we saw judge jones ruling that this is an issue that has to be hammered out in the Appellate Courts and whether or not this scenario, when the highest ranking federal official in the nation gives a directive, does that mean that you need to follow it and that is a reason to have your case removed to the Federal Court and the 11th circuit will look at it and it may very well the Supreme Court is the final on that question. Turning to donald trump himself. I went to get your reaction about his efforts to overturn the 2020 president ial election. Take a listen. The most senior lawyers in your own administration and on your campaign told you that after you lost, more than 60 legal challenges that it was over. Why did you ignore them and decide to listen to a new outside group . Because i didnt respect them. Were you calling shots, though, mr. President . Ultimately . As to whether or not i believed it was rigged. Sure. It was my decision. But i listened to some people. Some people said that. So he didnt respect the lawyers, the white House Counsel telling him the truth and trying to overturn the election, quote, was my decision. Does that get him into legal trouble . It could. It is always tough to have a client who disagreed with you just because you give them bad news. And clearly he had bad news and he had lost the election so he went to the next Snake Oil Salesman to tell him that he won. So it does put him in legal trouble. Remember that the cases are decided in a major part of the case is decided by the defendants intent. Did they have intent and knowledge, was this was a knowing act . So he crossed that line. And he tried to clean it up in the second part and said other people told me and i respected them so i thought their opinion might be better. That is an effort to clean it up but it is certainly not something that his lawyers want to have to deal with as they go through a criminal trial and this is what makes it difficult for him to ever take the stand. This kind of free wheeling, let me tell you this, how i feel one day and Something Else the next, and so that is making it hard for a lawyer to defend him and to be effective at it as he thinks about poving forward in the cases. Once youve been on strike recently. But were prepared. That is the thing about president faehns strategy. Every single victory local was prepared to go on strike. So were waiting to see what next phase looks like. But, you know, were showing support to our Cross Town Union family at local 12. We just have a caravan of people go over yesterday to show the support that they showed us back in 2019. How long was your facility on strike for in 2019 and how did that impact the community . It was 40 days. Ab facilities such as ours, we have a major impact on the community if were down. You look at the tax revenue and police and fire rescue, local businesses that we normally go to every single day when were going to work and leaving. They all took a hit and it is a major impact to the local economy and local 12 in the jeep workers have 6,000 members there. So it is even larger hit on the local community right now. The union wants a 40 wage increase over four years. Is that the only acceptable deal . I know that is the starting position. But you know, is the union willing to come down from that . Well, well see at the table. But it is much more than just the pay. Right. Were structurally broken from the Bankruptcy Deal that were still working under. These temporary employees that go years on end without being permanent employees, that means working in years without contributing to your 401 k , that is not getting the big Profit Sharing checks that mary barra and other employees get but we dont. There is a lot of things, when you look at our pensions, we havent had a increase in our pension in 20 years and were just falling behind while these corporations make record profits and the ceos make record compensation. You know, we got that 40 number from mary barra and the 30 million that shes received a year and they all sit on each others boards. So they all approve these increases for themselves. And they do all of this Stock Buybacks for the shareholders, but when it gets to us, they say, whoa, we cant afford that. Well, yeah, you can. Because your Profit Margins show you can. And just so folks know, those numbers are real. Mary barra, the ceo of gm makes about 29 million a year. Shes received a 34 a 34 increase in her salary over the last four years. Do you believe this secretive coordinated approach of which plants go on strike and when and is working and frustrating the Big Three Automakers so far and it is effective . I think it is. I mean, i know the Unintended Consequences of our members. This is a new strategy that weve never tried before. Were in it so well see if it works. Hopefully we could get to a settlement pretty quickly. But it is going to depend on the corporations on whether or not they want to give us this fair deal. This sounds like a lot of money that were asking for. But it really isnt. If we were being treated fairly for the last decade, this wouldnt be such a big hill to climb. But were not accepting add deals any more. It is a new day. You could see it across country. And you could see americans supporting us by 75 , the polls show.
