"starting point" begins right now. welcome barx, everybody. here inside tick talk diner in new york, lower part of midtown. the delicacy here is this dish. loet me move my coffee out of the way. this is a diner delicacy everywhere. giant waffle covered in fruit and then smothered in whipped cream, again, i have been snar offing down food from diners. we have a lot to talk about. this judge blocking the mississippi pardons. we told you yesterday about haley barbour and now there's new information that has had a judge say that he's able to block those pardons. that means that some of the people that are about to be pardoned will not be pardoned and it means the several or many that have been pardoned now will report back. the attorney general in mississippi feels like haley barbour is showing absolutely no regard for the law. lots to dig into this morning with jeff toobin who is around the table with us this morning. our senior legal analyst and our panelists join, as well. nicky ward from vanity fair contributor and simi is an attorney, as well. love to have your opinion on this and will cain is back. too far for me to reach him. let's start with what happened. the attorney general has now been able to intervene and that's because, really, of the constitution. >> you know, its arer very weird. i certainly never heard of a provision like this before. but mississippi's constitution says that the governor has the right to pardon and that's true of the president and true of all 50 governors and this weird provision. the pardon can only go into effect if the person applying for the pardon has published in a local newspaper the 30 or more days before the pardon goes into effect a notice that he's seeking a pardon. well, the attorney general went into court and said, we don't know whether this notice provision, whether these advertisements have actually been published. >> injunction. >> so, the judge said i'm going to put all these pardons on hold until january 23rd when we will find out. when we will survey and see whether these notices were published. some of them were, but some were not. >> one thing we were talking about with haley barbour. here's the statement that he released and i want to read it to you. approximately 90% of these individuals, the people released, were no longer in custody. the pardons were intended for them to find gainful employment or require licenses as well as hunt and vote. i thought, well, that's the nonanswer answer. we're only talking about the 10% that xil people. >> look at all the banks i didn't rob and, no, the key, the focus of the outreach are these convicted murderers who worked in the governor's mansion. >> four of them killed wives and girlfriends in brutal, brutal ways. >> terrible. >> this one woman was holding her baby and she was shot. >> we talked to her sister yesterday. >> those people were not recommended for pardons. they were looking for many, many more years in prison. but under this weird tradition that they have in mississippi of having convicted murderers work at the governor's mansion, barbour got to know them, trust them. >> do you know him, jeff? >> the murderer? >> no, haley barbour? >> i mean, he's certainly, you know, one of the great wheeler-dealers. >> actually, let me play a little chunk of that. this is jim hood, the attorney general was furious and i think the reference was to say, you're making us look like a back water. you're going to release these people. very few people standing up and saying, yes, this is brilliant. release murderers and make sure they can have guns later for the people who are afraid of them returning. let me play a little bit of what he said yesterday with anderson. >> former governor barbour. i mean, he didn't follow the law. this is a very simple constitutional provision and governor barbour didn't follow it. very clear he had to have this information, he didn't obtain it before he signed these pardons and that has caused public safety issue. >> so, the injunction is in place. >> does it make me a bad person that i don't know who boss hog is? >> oh, my -- >> about five blocks from here. >> boss hog was the big bad sheriff in starsky and hutch. >> dukes of hazard, thank you. >> same genre. >> okay, in any case, here's my question. you can put this injunction in. but, bottom line, those who can have been released. they have to report back -- >> every day, once a day to the authorities. >> what happens in the end. is this injunction a way of slowing down, stop it. >> they have to see -- very short story. >> if the governor wanted to pardon them, doesn't this allow them to go back to prison and then they publish it for 30 days. >> no, it's a new governor now. the new governor is not going to do this, given the reaction, the new governor is not going to reissue these pardons. i think it all comes down to where these ads ran. if they didn't run -- >> i don't think they were all in prison. >> not all. >> some of them, you have to look at this. yes, they committed brutal acts, i agree. didn't just happen yesterday. they have been out and rehabilitated and treatment, halfway houses. >> but not the murderers, they were not out. >> they were not out and, what's more, one guy had been dinged for parole. like two weeks before. the family members told us yesterday that they were notified. he will not get parole and then the next notification he got, i believe the next day, well, actually, he has been pardoned and then he was released. >> can we just come out, what is this working in the mansion thing? >> it's the ad release program. >> this is interesting. last night on "ac 360" anderson was saying when he was a kid -- >> he had been there. >> his father is from mississippi and he wrote a book and they got invited to stay at the governor's mansion. when anderson was a little kid, they were meeting and fixing and cutting the grass, they're all convicted murderers. this is how it's done. >> no matter what we read in "new york times" and what we talk here, the whole story of this is outrage. >> for the 90%, yes. that's his release said. the 90%, it's no problem. but the problem with that is that 10% are killers who now, with a full pardon, get a weapon. >> and face time with haley barbour. i'm curious, is there not a defense for haley barbour. >> the pardon issue doesn't need a defense. >> you know, a lot of people have said, particularly people on the left have said, look, governments don't use pardon power enough. that there are a lot of people in prison who should be there who are nonviolent who, nonviolent drug offenders. >> but these are not the ones. unfortunately -- >> not a case for any of these guys. >> this will probably lead governors to say, i don't want to take the heat. barack obama has pardoned practically no one and i think a lot of people are upset about that. people in federal prison, it can't be that they all should be there. but the fact that obama is simply washing his hands of it all. >> that upsets the democrats because they expected some pardons from barack obama. >> first, an update of our top stories and continue our conversation on the other side. christine romans is back at cnn center for us, she's not out at a diner, but i'll bring you food back later. >> i'm still shocked that jeff toobin didn't know who boss hog was. once i get over that news flash -- >> '8 0s trivia, please. >> dukes of hazard. >> i was like, really? [music playing] confidence. available in color. depend® for women is now peach. looks and fits like underwear. same great protection. depend®. good morning. great day. good morning. you're looking at the inside of the tick talk diner. i'm on diner duty now free food paid for by cnn, which i like. talking now about international outrage over video that seems to show marines that are urinating on the bodies of dead insurgents. the afghan government is now condemning the video and nato led isaf the international security assistance force has denounced that even the taliban's calling it barbaric. the u.s. military is confirming that ncis lead investigator on this case. we have nick paton walsh and barbara starr live at the pentagon and also joined by retired army general james spider marks. it's nice to see all of you. nick, why don't you start for us. what is the reaction there in afghanistan? >> well, point out what we see in this video, first of all. it appears to show u.s. marines, according to the posting on the internet, a company in northern heldman but the details are still being investigated by nato. lots of caveats and disclaimers although one u.s. official said it was a reasonable conclusion to suggest that it had occurred in afghanistan. har midkarzai's people putting out a statement saying that the government of afghanistan is deeply disturbed that shows american soldiers desecrating dead bodies of three afghans. this act by american soldiers is simply inhuman and condemnable by possible terms. really strong rhetoric here from an afghan government. the taliban, as you say, coming out and calling it barbaric and calling it inhuman and also saying they want to see the incident investigated and saying it apparently happened by a unit that may have already left afghanistan, but they're not sure of the details yet. soledad? >> all right, let's go to barbara now who is at the pentagon for us this morning. so, ncis, as we just mentioned, is the lead investigator on this and no indication to think that this is not genuine. this does seem to be real. what do we know about this videotape and how it came to be? >> well, that's right, soledad. we talked to a number of officials who say at this point, although they can't confirm any of it with absolute fuinality, there's every reason to believe it is legitimate and not a staged event. who was behind the camera taking these pictures? who were these marines that they appear to be marines by all accounts. the photo has some very interesting clues in it. if you keep that up for a minute, have a look. you will see that there are sniper rifles in that video that the men are carrying and that a couple of them are wearing helmets, very particular to u.s. marine corps sniper teams. the shorter front, shorter side helmets so they can hold their rifles up to their face when they're in combat. these are clues as to who these people might have been and, believe me, the marine corps knows exactly where their sniper teams were at all times and where they were serving. they will be able to pin this down very quickly. ncis will conduct a criminal investigation. it could, could lead to charges of misconduct, dereliction of duty and any number of charges could be coming pending the investigation, soledad. >> let's return to retired army general. when you saw this video, you know, i thought it was just so really incredibly disturbing. what did you think? >> absolutely, soledad. no other emotion other than this is terribly wrong. it's incredibly disturbing and, frankly, it's and as barbara has indicated, the marine corps, ncis, the joint staff, et cetera will pile on to this thing and figure out what went wrong. clearly, i'm more concerned about who is the leader of that sniper team that encouraged that behavior. i'll make an assumption that all of this occurred, that all of this is accurate. these were u.s. marines. let's get that off the table and then we need to figure out, who is the leader that pushed these young men to do that? i would suggest that you probably have an extremely bad apple that was determined by evaluation to be an elite marine. they don't take run of the mill guys to be on these teams. this was an incredibly elite, evaluated through vigorous training to achieve this great status and they get to operate on their own and work within the marine corps and these guys completely were outside of that box. folks are going to have to try to figure out what went wrong and if it is institutional. i would suggest it's not. >> before we get to open it up to our conversation this morning, general. it sounds like barbara is saying that it's going to be pretty easy to trace who these guys are and that will also determine if, in fact, this is genuine. at this point no one saying it is not. what could the punishment be. the geneva convention makes it clear you are supposed to treat the bodies and honorably entered and clearly the training says not to do this. what could happen to these men? >> this is a legal action. this is clearly within the uniform code of military justice. there will be a determination by the right folks that as we say in the army, we're the green tabs. those in leadership positions will make a determination as to what will happen. you have to determine what type of event took place, who was culpable. that will all take place. that's all legal. let's get to the root cause of how this occurred. that will happen in very short order. tt wiit will be very detail. >> i have a question for general marks on that. the taliban's take on this is completely meaningless to me. how do we deal with homosexuals do we bury them alive or throw them from the town tower? >> when the taliban calls something barbaric, you probably have crossed the line. >> seems that we have a bigger issue to deal with. that is when you train men to annihilate their enemy and kill their enemy, how do you draw a line to impose normal rules of civilization back on those men? isn't it a tough line to draw and have them continue to distinguish. >> but he just talked about, let's get the general answer -- let's get the general to answer that first because it sounds like will is saying, general, that if you're sort of pushing people to the edge all the time, how do you expect them to not sometimes or occasionally or often step over that edge? what is the answer for that? >> that's exactly the training that these marines and all folks in uniform are put through. it's a definition of discipline. it's doing the right thing when nobody is watching. there's incredibly emotion. there's incredible adrenaline. these guys were probably up until that point, let's assume, again, let's assume. i don't know that they were in an incredible dog fight right up until the moment they chose to do this. they need to compartmentalize. their job is done here. if those were the enemy, they killed the enemy and let's get them out of the way. we have another mission to get on to. we don't have to drop our travelers and that's not within the skill sets. that's absolutely not what these guys are trained to do. i apologize for my language. you can tell i get emotional about this because these guys have given our enemies an incredible propaganda flick and now we have a marine corps diverted on to the activities of about five or six bad guys that will be disciplined and their chain of command has some reckoning, as well. >> making it riskier for every other single person who is serving in the military over there. go ahead. >> general, when you say, your exact phrase, sorry, i forget right now. but you said that want to kill them and is to get rid of them. >> what do you do? what does that actually mean? do they then dig graves and bury there? what do they actually do? >> isn't it spelled out? people aren't making this along as they go out in combat. there is a code. general, let's answer that question for vicki. what is the code? what does it say to do? >> once you complete your task. clearly what we see is not within the rules. that's not one of the options. clearly after you've engaged your enemy and you move them off to the sides and you put them into quick raids and you accommodate for them. there are grave registration personnel and folks that will be assigned to make sure that is accommodated for. if you turn it back over to the local folks, that's what you do with those bodies. so, there is no gray area here. that clear, as i said, that's not one of the options. >> all right. general marks y thank you for your time this morning. barbara starr at the pentagon. nice to see you. we used to work together back in the day and now we're back together. i appreciate that. we'll take a short break. straight ahead on "starting point" talk more about mississippi governor haley barbour, explaining his reasons behind the pardon, but does it add up? >> good morning, soledad. syria's opposition rejecting the government's claims that an armed terrorist group is responsible for the death of a french journalist in a mortar attack. he's the first western journalist to die in the syria uprising. cnn has been shutout of the country for month now. nic robertson among the first western journalists allowed back in and he was talking with anti-government protesters. >> the level of anger and passion here is absolutely palpable. just a few miles from the center of damascus and the crowd here -- >> thank you. thank you. this is a crowd here of perhaps several thousand people. they're taking over this whole area and put rocks in the road to prevent police coming in here. >> look at him. 32 years only because -- >> who killed him? who is responsible? >> the government. >> i'm afraid when i'm talking to you right now because i'm going to lift this scarf and going to my home and i'm not 100% sure that i'm going to be safe because, if not today, if not tomorrow, they will arrest me. >> this opposition is not legal. >> not legal. >> how do you mean not legal or real? >> i think -- >> nic has had his equipment confiscated so he's joining us on the phone from damascus. i know it has been a frightening probably 34 or 48 hours for the international journalists there in damascus. what's the latest now? >> well, the latest is the french ambassador who went to where the french journalist was killed in that mortar attack yesterday. an investigation has begun. the arab league who have monitors here in inside syria that are going around investigating incidents just like this. according to the head office in cairo, they say they're involved in the investigation and they have a preliminary report tonight. i spoke to the head of the arab league mission here, however, just an hour ago and he denied that they were involved in the investigation. there's inconsistencies here in what the arab league is saying and doing, but perhaps more information about how this attack took place and who was responsible. but it is very unlikely anyone will provide conclusive answers. >> all right, nic robertson in damascus. please, stay safe, nic. family and friends are trying desperately to find ian burnett. he was missing for two weeks now. seen just days after arriving in new york city to celebrate new year's eve. his parents set up a facebook page looking for information. a coast guard tanker trying to reach the frozen port of nome, alaska, with fuel and gasoline. the first ever attempt of fuel delivery in winter. internet dependency affects the brain in similar ways to cocaine and marijuana addictions. as many as 10% users are addicted. most are gamers, so absorbed in the activity, they go without food or drink for long periods. and their education, work and relationships suffer. soledad? >> i am not surprised. i am not surprised. i agree with that. i think the internet is like crack and guilty as charged. christine, thank you. appreciate it. let's turn now to south carolina. the home to gorgeous beaches, great golf and republican primary is in nine days and probably going to get more ugly. campaign spending millions of dollars now on attack ads and newt gingrich has now said, prepare for armageddon. back to our panel. we begin with new york congressman steve israel who has joined us for breakfast with soledad. >> where is better than new york diner early in the morning? >> you sound like a new york elected official. you certainly do. martha monhill, as well, is with us. let's start with, yesterday i was talking to debbie wasserman schultz and she was giving, in all fairness to her, the spin of a big victory by mitt romney. and here's what she said to me. well, you know, big problems with that. that number is not so great. afterwards when we talked to governor romney, here's what he said. listen. >> i feel sorry for debbie wasserman schultz, she's got to stand up for the president's record and it's pretty bad. you have almost 2 million people that lost their jobs under this president. you have median income that has dropped by 10% over the last four years and you have 24 million people out of work or stop looking for work. >> so, he kind of said, i don't really care and then listed all the ways in which he plans to focus on trying to beat president obama. would he say he feels sorry for you, too. because you're the chair of the congressional democratic campaign committee? >> i have to say that 10, 15 years ago, mitt romney would have been endorsing debbie wasserman schultz. he would have been on every side of every single issue. the reason mitt romney can't seal the deal with voters because he hasn't been able to seal the deal with himself. quite honestly, the house is in play. 25 seats to take the house back and the more the republican presidential candidates are talking about armageddon and blowing each other up and attacking each other while we're trying to rebuild the middle class, reignite the american dream and pass a full year of tax cuts, the more that happens, the more benefits house democrats. >> am i allowed to speak? >> go ahead. >> in fairness, this does not happen when the democrats have their primaries, too. i mean, newt gingrich even said yesterday, well, so and so, mitt romney is not going to say that during the primaries. in other words, this is just pondering. they're going to south carolina and they'll say what people in south carolina want to hear. they'll say to iowa -- >> the beauty of videotape is that no matter where you are, you can run clips of anybody, anywhere saying their position on issues. >> but don't you think it's weird that you can run clips on the same guy? you can run clips from the right against mitt romney. mitt romney is running against mitt romney. >> right. typically, i think what happened is democrats have made this mistake. they have beaten up on each other in primaries and each other flip-flops we have seen all over the place. >> flip-flop is a not a new term. >> republicans have been more disciplined about this. it's kind of interesting to see the republican candidates doing the same thing now to mitt romney, who is the -- >> but there's two points on that. number one, there's a theory that says, put it out there early in primary season. by the general election everyone is like, got it. number two, is the dissatisfaction with president obama so high that ultimately if you're a republican, i'll vote for the guy who is not barack obama, period. if it's mitt romney, no matter what position he held and no matter where he has gone on social issues, if he's not barack obama, he's the guy i'm going to go for. >> every national poll over the past several months says the american people prefer a house democratic majority. notwithstanding president obama's numbers that are challenged right now. being a house republican incumbent right now is toxic. people are going to go to the polls in november and they're going to make decisions orn who i want to be president and i'm confident that president obama will win and they will make decisions. do i want to vote for the member of congress who end my medicare and took medicare for himself or herself and try to take my middle class tax cut away. >> economy, economy, economy. >> i hope so because on every level, they're making those decisions on the economy. we were for a full extension of middle class tax cut. they were against it. 350,000 millionaire husband to help pay for it. >> you can admit, this is a strong start for mitt romney. a flourished republican nominee to win iowa and new hampshire debbie wasserman schultz wants us to believe he is in a strong position. >> you said absolutely, yes. it's terrible. he is up by a lot and won by much more than he won the last time. do you think there is any chance he will not be the nominee? >> they invite me to the meetings. but, look, no question that mitt romney in the republican primary is in a very good position. we can't wait to engage this general election. and mitt romney in every house republican. >> let's play a clip of mitt romney. he was talking to matt lauer on "today" show about the economy and millionaires and billionair billionaires, i believe. take a listen. >> are there no fair questions about the distribution of wealth without it being seen as envy, though? >> i think it's fine to talk about those things in quiet rooms and discussions about tax policy and the like. but the president has made this part of his campaign rally. everywhere we go, or he goes, we hear him talking about millionaires and billionairs and executive and wall street. it's a very envy-oriented, attack oriented approach and i think it will fail. >> so, for me, there's a little challenge in that. not just the president talking about the wealth gap. not the president only who is saying there are people in this country who are very poor and you're looking at executives of big companies and they're very wealthy and a big space in between those. that's what "occupy wall street' is about. there are a lot of regular folks. i will let will cain who is our conservative at the end of the table, my friend, my conservative friend. what did you think i was going to say? isn't this strategically not so wise because no one is going to say, it's not just the president saying that. >> i think conservatives are looking forward to this election and this -- the best thing that happened to mitt romney was not the fact that he won new hampshire. they brought this argument out that mitt romney is this vulture capitalest. he's the representative of the elite. we're ready to have the fight on that level. this is a narrative that people are ready to have. >> listen to what he said. he said when people raise the question about income distribution, that that's an envy question. such a weird question. almost like you're jealous of our money. that's weird. >> it comes across as you want to take the one group and benefit another group. do we have any appropriate progressive tax rate? "starting point" begins right "starting point" begins right now. -- captions by vitac -- www.vitac.com well dock back, everybody. we start with the international outrage that appears to show marines urinating on dead fighters. there has been reaction all over. maybe more importantly there is a question about whether this could inflame anti-american feelings across the world. the naval criminal investigative service will be the lead investigator on this case. pentagon correspondent is barbara starr. we also have james spider marks, retired army general. we have the panel as well. vanity fair contributor, dicky ward. former prosecutor sema ire. blaze contributor will cain and i don't know why they put you on the end. michael is the host of our world with black enterprise. he's a professor as well. let's begin with barbara starr. ncis is involved. what does that mean, barbara? >> reporter: soledad, that means there is now a full-blown criminal investigation underway. this could not be more serious. there is likely to be violations of the uniform code of military justice here. once they verify who these are people are in the photo and the circumstances surrounding all of this. every reason to believe at this point it's legit, it's exactly what it purports to be. ncis will investigate this and determine what the next steps are. i think that you can understand one of the things the u.s. military has learned in recent years, if nothing else, when these cases of egregious misconduct surface in public, they try to move very quickly to contain them. these images fly across the internet around the globe instantly. there is often very bad, very understandably bad reaction. they want to contain it. they want to show that they're investigating it and that there will be legal ramifications of this incident. soledad? >> all right. barbara, thank you. let's get back to general marks. general, when we were talking earlier i was asking you about what the punishment potentially could be assume that go this is confirmed, assuming that they can track down the five or six men who are involved in this. clearly it's against the rules. clearly it's against the gentleman neef va convention. could they be charged with a war crime? >> they sure could. absolutely. it would be absolutely conceivable that one of the leaders or the individuals involved in this incident end up going to jail and either senior non-commissioned officers or officers in their chain of command end up getting relieved or there might even be some culpability in terms of dereliction of duty. that's premature. we have to let the investigation run its course. >> clearly, no question about that. let's talk a little bit about the jeopardy that -- i keep saying video but it sounds like it was recorded off of somebody's phone so that these images would have puts those who are serving really not only in the middle east but across the globe, what kind of position does it -- what kind of risk does it bring to our armed forces, sir? >> well, you know,th primary concern for everybody in the chain of command and every leader in the military, the primary concern is the young man or woman out there on point. the individual who's on the edge who's doing the engagements every day. you want them to be fully equipped and to better understand that environment that they're moving into. an incident like this can clearly inflame someone. somebody could wake up this morning and be completely outraged. somebody who might be a friend or might be on the tipping point of being a friend or being an enemy, we've now convinced that individual, be the enemy of the united states and then he goes and he finds some local soldier, some marine on the ground to try to attack or do something against. so that's the primary concern that we have. the larger issue obviously is this was aberrant behavior, but we need to investigate it very, very deeply to ensure it's not institutionalized. i can tell you it's not, but that needs to be drawn out of this thing. >> soledad, can i jump in for a minute on what spider is saying. >> of course. >> i think when i've talked to people over the last 24 hours or so about this video, military officials, i think one of the things that bothers them, obviously the event. what concerns them so deeply is this question of behavior, command climate. what are we really talking about? it's just like in an office. what is the climate in an office that would evolve that would let, permit, encourage someone to misbehave in such an egregious manner? somewhat the same in the military. this may be a marine corps sniper team that was out, very distant from their command structure but, still, they have a staff sergeant, they have a platoon leader. they have people in charge. where were these people? what happened here that may have just caused discipline in such a serious manner to break down? that's what you see time and time again in some of these incidents over the years. the question that keeps coming up, what is it that causes discipline to break down and causes people to behave in this manner? that's one of the things the military's really going to try to figure out here. >> well, general, to your point. if you look at the picture, that in itself seems to be asking some of those questions because, general, if i understood you correctly, you said there were six in a unit typically and in the photograph there are only three and i keep wondering who's taking the picture and why. >> and who's taking the picture and who's the one leaking the picture? >> right. what's the back story. >> this is not the first time they've done this. it's happened before. >> i think from a photo and from a little snippet of video, actually, i think probably the general is the one that should weigh in on this. i don't think we should go out on a limb and say we have any clue that this happened. >> there are questions. >> it happens all the time. >> if you get caught, that's probably one twentieth of the time you've committed the crimes. >> i don't know. >> let's get the general to weigh in on that. do you think that's a fair comment? by looking at this do you have a sense that this is not necessarily the first time that this happened? >> it may have been. again, i don't know, but the point is, is the definition of discipline is doing the right thing when nobody's looking. so i'm not concerned about who took the video shot, i'm concerned about the leader that validated, allowed that to happen, and, in fact, maybe got those guys to do that and nobody raised their hand and said, wait a minute. wait a minute, sergeant. i'm not signing up to do this. the point is, our military trains our young men and women to raise a hand, to step up and to do the right thing and to acknowledge, look, i'm not going to cross that line. this has nothing to do with whether -- this has everything to do with whether this is a legal order, but it has nothing to do with following orders. you are required to acknowledge when you are being put in a situation where you see there is an ethical or moral issue. clearly there's a legal issue in this case. so i'm concerned about the leader who allowed this to occur. if that young sergeant on the ground, i will assume it's a non-commissioned officer, allowed that to happen, we call that casual leadership. in fact, that's illegal behavior. up the chain of command there must have been some degree of causality that allowed this incident to occur. they either looked the other way or they never addressed it. they can't do that. >> this will clearly be what ncis, as barbara starr told us, will be focusing on all of that. general marks, nice to see you. barbara, of course. stick around. order some more food because we're here for the long haul. we'll go check on some of the other stories that are making news now. christine romans has the news for us. new developments this morning in mississippi. what a state attorney general says some criminals pardoned by outgoing governor haley barbour may now have to go back to prison. this after a judge issued a temporary injunction stopping their release. barbour granted 119 pards out of office. 44 were murders. bombshell revelations in the casey anthony case. in court depositions anthony tells a psychiatrist she may have become pregnant with daughter krally after being date raped. she was acquitted of murder charges in the 2008 death of kraly but she was convicted of lying to authorities. a new study saying anymore than two embryos in in vitro fertilization is not good. walls ripped off homes. piles of rubble this morning. reports of more than two dozen people hurt after a possible tornado ripped through two counties in north carolina. someone snapped this photo of a funnel cloud forming in the distance as the sky turned black. there it is. wow. we're still waiting for official word from the national weather service that a twister touched down there. it's about 11 minutes after the hour. let's get this morning's travel forecast. rob is out so let's go to jacqui jeras. good morning. >> good morning, christine. i'm here to greet everybody with winter weather. it has finally arrived after months of unseasonably high temperatures. we've got a lot of snow and arctic air building in across the midwest and into the great lakes. ahead of it still feeling mild here into the big cities, but rain and ugly in new york city as well as into boston. snowfall accumulations, just on average about two to five inches. heavier around the great lakes. that's where we have the winter weather advisories which are in effect. this will last through tomorrow before things begin to wind down a little bit. very cold behind this front as well as windy conditions all the way down to the gulf coast. temperatures right now feel like the teens below zero in the upper midwest. that cold air is going to stick around for a while as well. christine? >> thanks, jackie. minding your business this morning. u.s. stock futures looking up. futures for the dow, nasdaq, s&p pointing to a higher open right now. dow futures up. the labor department reports now how many people filed for unemployment benefits for the first time last week. an important read on the labor market. the government also reports retail sales for december. consumer spending has been generally improving signaling more confidence in the economy at the end of the year fl we'll get the true gauge in just a few minutes. soledad? >> christine, thanks. there's a new strain of swine flu to tell you about. now at least 12 people are believed to be infected across five states. the cdc is telling us that all those cases have been detected during the second half of 2011. apparently the current vaccine for flu does not work against this particular strain of swine flu. cnn's senior medical correspondent is elizabeth cohen. she has an update for us. what do we know about this strain? >> soledad, what we know is this does not spread easily person to person. you mentioned 12 cases. that's been the situation since december 23rd. so 12 cases, three of them ended up in the hospital but everyone has recovered. we ever' talking about folks in indiana, iowa, maine, pennsylvania, and west virginia. soledad? >> so is 12 cases considered a lot? is this the point where people say, wow, it's a dozen across a handful of states and we should be concerned? and we said the flu shot doesn't work so what do people do? >> right. you know what, i don't think that this is a huge big deal talking to folks at the cdc. they sound concerned but not overly concerned the the reason, again, is that it does not seem to spread easily person to person. most of these 12 people either had contact with pigs directly or had contact with people who had contact with the pigs. so it's not spreading like wildfire. now having said that, you still should go get a flu shot. it may not do much, if anything, for this flu virus, but it can still help for seasonal flu, which is still out there and is expected to get worse. if you go to cnn.com/empowered -- patient. all the facts you need about the flu virus. >> that's good advice. i get my flu shot every year. appreciate it. let's talk about tim tebow because it is now official. america loves tim tebow. me too. i love him. i'm not even a giant football fan. this is a poll. the nfl quarterback, he has topped espn's december poll for favorite pro athlete. he's only been pro for two seasons. he snatched the number one spot faster than any other person. is there anything that my secret boyfriend tim tebow cannot do? [ female announcer ] purifying facial cleanser from neutrogena naturals. president obama says he is focused on what is becoming a growing source of anger here in america, which is the outsourcing of american jobs. he gathered a number of ceos at the white house yesterday and he proposed tax incentives for companies who bring back jobs to the united states. listen. >> right now we're at a unique moment, inflection point. a period where we've got the opportunity for those jobs to come back. the business leaders in this room, they're ahead of the curve. they recognize it. >> tim brian is a ceo of galaxy solutions. he met with president obama yesterday. we're back with christine romans as well. she's at cnn headquarters. thanks for joining us, mr. brian. why don't you tell me a little bit about your company, galaxy solutions, and then what you thought about what the president said yesterday. >> good morning. our firm does software development for the health care industry for large corporations, and we are excited about the president's involvement and recognition of the fact that the trend is that jobs are going to be coming back to the u.s. in technology, in our sector for sure, as well as others. he's highlighting this. it is going to continue that momentum because we -- what we're seeing is that quality, the quality of the work being done inside the united states is superior to that being done off shore. the recognition by the president and the administration of that will only highlight it and keep that trend moving. >> quality could be one issue, but ultimately i think often as you know better than me, sir, it's often about money. when you take a look at the annual -- sorry, hourly manufacturing compensation costs, i could throw up a chafrt here, the u.s. at the bottom of that list. it costs roughly $33 an hour. that's a compensation. that includes things like benefits, insurance, etc. at the top of that chart those much, much, much, much smaller bars, that's china. that's $2 an hour. india, which is somewhere between 2 and $3 an hour. ultimately, sir, isn't it really about jobs are outsourced because there's cheap labor and unless you are going to change that cheap labor and move it here to the united states, you're really never going to bring enough jobs back? is that fair to say? >> well, it is about economics, but economics is in support of delivering something. if what you're getting is substandard, it doesn't matter that the unit rate is low. i can tell you that in technology the complexity of computer systems today requires proximity. we need people to be near the customers where the businesses are in order to build systems that are going to support those -- build the systems that are going to support those businesses. if you're paying a lower unit rate but it's half a world away, what you're going to wind up with is a system that doesn't necessarily work the way it's supposed to. so based on that, it doesn't matter that the cost is low, low, low. what matters is that the quality isn't there. so i think that applies also to other businesses. in manufacturing one of the ceos that attended the forum with the president yesterday was talking about the fact that the furniture being made in north carolina is superior in quality to that being made in china. even though from a price point there may be an advantage, from a quality standpoint it is less relevant. so, you're right. >> i've got to -- >> go ahead. >> i'm going to stop you there. we have to hit a short break. i want to continue our conversation on the other side of the break. i get what you're saying, which is money isn't everything. quality has a huge correlation. on the other side we're going to talk to christine romans. this is not the first time that a president has proposed keeping jobs here in america. we'll talk about what president bush said back in 2004 and why those jobs didn't come back back then. we're back right after this. ♪[music plays] ♪[music plays] when you're responsible for this much of the team... you need a car you can count on. ♪[music plays] c'mon, michael! get in the game! [ laughs ] hey! we're back on this side of the break. joined again by ceo time bryan. he's with galaxy solutions. christine romans is with us. christine, we had talked about a little bit of deja vu. 2004 president bush was pitching the same thing. >> he stood up and said we have to make sure companies have an incentive to keep jobs in the country or to bring those jobs back. there was a big tax break for being able to take foreign profits and bring them back to the united states in hopes that companies would hire with that money. years later, you look at the biggest companies that got the biggest tax breaks. they didn't hire in this country. in fact, they were down jobs in this country. they were investing big abroad. the reason why companies bring jobs home is not because a president asks them to. sometimes even when you try to give tax breaks to reward this behavior, sometimes it doesn't even work. history has shown that. it's because they can make money. it's how they make money. their responsibility is to their shareholders, not necessarily to the president of the united states. when you look at it, tim has some good points here. when you look at technology, there are different parts of technology. he's probably very smart to try to be bringing jobs to detroit because he can keep control of his product better there. you look at something like the ipad, iphone, the innovation comes here and the production is on a campus someplace far, far away where a middle class is being built with those jobs there. here the jobs are either inventing it, the high paid, skilled jobs in innovation, or the low paid jobs in selling it and shipping it and driving it around the country. so it's a very interesting dynamic in technology and technology jobs. >> so, mr. bryan, let me ask you a question because you talked a lot about sort of quality will be the driver. that's why the jobs will come back to the united states, because we're doing it better. maybe when it comes to technology, as christine says, that can be true. maybe with specialized north carolina furniture, that can be true. there are a lot of other things that are equally good quality that are made overseas that are outsourced. people given the opportunity, doesn't the market say people will go ahead and pick the issue that's important to them, price, quality? >> yeah. look, those are absolutely factors that are under consideration. this is a market shift, and it is based on quality. it's based on innovation. it's based on what can be delivered from the united states less expensively with a greater degree of quality. that's what it's about. in technology things are changing. our program of outsourcing to detroit is taking advantage of available midwesterners who are coming back to work in downtown detroit and we're forming an i.t. hub. that's a change in the marketplace. we're competitive with a number of the offshore destinations. this isn't going on because of tax breaks or political decisions that are being made, those are the margins. >> are you the exception? >> christine, i'm going to -- >> if you're asking if i'm an exception, i think this conference and the number of business leaders there, companies like intel, ford, rech tifs from the united steel workers, representatives from the auto workers all show that this trend is gaining momentum and we're going to see more and more jobs coming back to the u.s. based on the quality of the work that we do and the fact that it is more competitive. we can be more competitive. >> tim bryan is the ceo of galaxy solutions. nice to talk to you. christine romans at cnn center for us. ahead on "starting point" this morning, an iranian nuclear scientist has been killed. from israel, the word is we're not shedding a tear. that's a quote. also, hillary clinton weighs in on that controversy. the reveal today, mitt romney is worth roughly a quarter of a billion dollars. yet he is not the wealthiest presidential candidate over the last 20 years. we'll tell you who is. you're watching "starting point." we're back after this short break. [ male announcer ] the new citi simplicity card. no late fees. no penalty rate. no worries. good morning. welco welcomeback, everybody. you're watching "starting point" this morning. we're coming to you live from the ticktock diner in lower mid town manhattan. i've been following myself and everybody who's tweeting me this morning. couple of things, i'm sorry about the noise from the diner. i'm eating. i'll try to keep it down for you. also, yes, i do like tim tebow. i'm not a fan of the new england patriots so, there. anyway, if you want to send me a note on twitter it's@soledad underscore o'brien is how to reach me. coming up in our next half hour, we're talking about what's going on in iran. the u.s. is denying that we played a role. israel is saying they are not shedding a tear over his death. we'll talk about whether we are in some kind of cohort war. let's get ready for ar ma get din. the candidates are unleashing everything they've got to get mitt romney to end the campaign. first let's check in with christine romans. >> good morning, soledad. police in new york and virginia are searching for a 22-year-old virginia commonwealth student who has been missing for two weeks. ian burnett came to new york with friends to celebrate new year's eve in times square. he hasn't been seen since december 30th. a russian tanker and u.s. coast guard escort are struggling to reach the port of snoem, alaska. it's carrying emergency supplies of gasoline and fuel. brutal weather conditions have created a critical shortage there. the obama administration prepared to have peace talks with the taliban. talks will get underway in the next few weeks. new fundraising numbers in for president obama. his re-election campaign just announced that it raised more than $42 million over the past three months. about 1.3 million people contributed. the gop front-runner right now, mitt romney, raised 24 million in the last quarter of last year. bonuses for solyndra executives? what is? that's what the bankrupt company's attorneys are asking. they requested bonus cash from a bankruptcy court to retain the firm's remaining employees. there are only 84 employees left. soledad, take a look at the world's smallest vertebrae. it's a frog about three tenths of an inch long. little tiny frog. they discovered the new species in the southwestern pacific island. that's kind of gross. thanks. new species. good to know about. let's turn our conversation to iran this morning. iran pointing the finger at both the united states and israel after an iranian nuclear scientist had been murdered. it is the third murder over two years. this time a motorcycle rider attached a bomb to the scientist's car, blew him up. the united states is saying there is no way that this country was involved. >> i want to categorically deny any united states involvement in any kind of act of violence inside iran. >> that's secretary of state hillary clinton. let's get right this morning to our kbess. we're joined by jim walsh. he is an international security analyst. peter brooks is a secretary of defense. mr. brooks, let's start with you. hillary clinton is saying there's no way the united states was involved. involved is such a complicated word sometimes. is it possible at all that the u.s. had some influence, that there was some collusion, that there was some, how would you describe it, is that possible? >> i don't tend to think so, especially with this administration. they've really tried influence iran by not being confrontational with them. i very much doubt that. soledad, there's a lot of other players out there that probably have more likelihood of being involved especially from that region because they're extremely concerned, as we are, about iran's nuclear program. this is obviously directed at slowing or diswaiting iran from becoming a nuke leer weapon state. >> we heard from the spokesman from the israeli defense forces who posted this on his facebook page. he said this, i have no idea who targeted the iranian scientist, but i certainly don't shed a tear. my question for you would be is, in fact, mr. walsh, is that true, that he really wouldn't have an idea? i'm not surprised about the not shedding a tear part. >> i think peter is right to say that it's probably not the united states. that's certainly my sense of it in talking to administration officials regularly. i think israel is at the top of the list, and for reasons that go to history. israel had an assassination program against egyptian scientists in their missile program in the 1960s. it had an assassination program against iraqi nuclear scientists. while there are others, saudi arabia and others, who might have an incentive to do something here, israel stands at the top of the list. in the days after this killing, after this murder, they have been more talkative than they normally are about these subjects. so i think the betting person would probably bet on israel. >> jim, when we see what iran has claimed over the last week, which is that they have enriched their uranium to 20%, weapons rate is 90%, how close are they to achieving weapons grade? are they close to achieving 90% weapons grade quality? >> two issues, one is technical and political. technically in principle once you enrich uranium at all, you could if you wait long enough, enrich it to 90%. getting to 20% does move you down the road to about halfway there in doing that. but all those facilities are currently under iaea safeguards. if they were to try and go and change the rigging and try to begin to produce 90% enriched uranium then we'd know this or they'd have to pull out of their arrangements with the international atomic energy agency and we'll all know it's going on. technically and principally, yes, they are getting closer. i do not expect to wake up tomorrow, a month from now, even a year or two years from now and have iran declare that they're enriching it 90%. i don't think that's going to happen. >> peter brooks, there's a theory that goes kind of like this, that iran would know that you can't possibly disable the nuclear program by killing off scientists even one at a time over a number of years. there is a theory that what could be done is to provoke an attack maybe by israel, maybe by somebody else, by doing that. you sort of get the temperature risen so high that at some point you could start or bring in an opportunity to take out those nuclear facilities by creating this sense that the scientists are being attacked. >> yeah, it's very interesting. i hadn't really thought of that. that's a possibility where you could push somebody to the point of doing something, such as iran, then you'd have an excuse for attacking them. i don't think necessarily for israel, i can't speak for them, but i don't think that's in their calculus. if they feel an iranian nuclear program is imminent, which i think they believe is considered an existential threat to the state, they would carry out a military attack against those nuclear facilities. we've seen other things as well, soledad. we've seen the virus which has attacked the natan's uranium nuclear plant. we see economic sanctions, diplomacy. there are a lot of different tools being used by a lot of different peoples to try to get iran to change course on its nuclear program. unfortunately, as jim pointed out, we haven't seen any real change. once you get to that point of 20%, a couple more loops through of processing of that enriched uranium and you're at 90%. iran is at the capability point where they could become a nuclear weapons state. the question is as jim pointed out, it's political. the problem is we've seen no change in the direction they're heading. that's the real -- can the world live with a nuclear iran? [ male announcer ] ocuvite. help protect your eye health. look at that. that looked good. welcome back, everybody. we're coming to you live from the ticktock diner in lower mid town manhattan. that was eggs and tomatoes. much healthier than what we have. the special is this waffle with whipped cream. i've eaten all the whipped cream and the fruit too. we'll start with some economic figures to update you on. 399,000 jobless claims were filed for the first time last week, so that number is up 24,000 from the week before and maybe more importantly, it's higher than the number that was projected which was 375,000. that number is 399. talking politics now. newt gingrich says expect armageddon in south carolina. he's on the attack. back to our panelists. we have vicky ward, a vanity fair contributor. theme ma ooirs with us, will cain is with us. he's with the blaze. professor mark hill is with us as well. let me play for you what newt gingrich said about armageddon, which is such a crazy thing to say about a political race. >> this is going to be armageddon. they will come in here with everything they've got, every surrogate, every negative attack. at the same time we'll draw a sharp contrast between a georgia reagan conservative and a massachusetts moderate who's pro-gun control, pro-choice, pro-tax increase, pro-liberal judge. the voters of south carolina will have to decide. >> will cain, do you think that's true? what newt gingrich is saying it's going to be armageddon at them. when you saw the acceptance speech from mitt romney he didn't mention any of the other guys, right? he said president obama, president obama, president obama. the last several years. >> i think newt gingrich as i said earlier, along with rick perry, has given mitt romney his voice, has given him the narrative he needs. he doesn't need to point out all of newt gingrich's faults over and over. now he can say i am the symbol of free markets. i am the symbol of capitalism and they are attacking it, they are president obama. >> like a casino gambler. >> at this point romney's been attacking his whole campaign very smart by acting like he's in the general election. now it's point, pre-season is over. we're in the playoffs. >> all these sports metaphors. >> this is what he's got to do. he has to throw away the old playbook. keep this against obama. he has to come out with better stuff. even like a mission statement, he cannot keep ignoring the issues. >> let's talk about florida. we'll skip south carolina and look forward to florida. you have a population of latinos 22% roughly there. you can two candidates eventually in the general election if it is mitt romney and president obama, they both have challenges when it comes to immigration. how will that play out in florida? >> i think it plays out in president obama's favor actually. >> immigration reform has not taken off. >> it hasn't. but there's deep skepticism about any republican candidates ability to have sensible fair immigration reform. >> here is an ad, it plays craig romney. here's what the ad says, a little bit of spanish. >> craig romney. speaking foreign language. >> here. you may not speak spanish. those are key words if you're trying to reach people who are immigrants. liberty, opportunity. what's the problem? >> here's the problem. the rest of the gop pack is going to be dragging romney back to the right talking hard core immigration policy. by the time mitt romney gets to a general election, if he wins, he'll be pushed to the right in a way that will make obama more appealing. >> governor romney has said, i do not support the dream act. he said if given the position, the opportunity, i will veto the dream act. is that going to be a problem for him? >> he's a bigger problem. >> you're will? >> i did. we're a team today. >> no, i don't think it's going to be a big problem. immigration reform has been something that neither party has been willing to address in any substantive or bold level. the issue in florida won't be a huge issue. it's going to be about entitlements. mitt romney has positioned himself among all the republican candidates the best on entitlements. he did not call social security a ponzi scheme. he has not threatened to repeal it. >> it works out great. >> florida politics. >> we end as we begin. we have to go to a tease. straight ahead we'll talk about candidates and money. mitt romney is the third richest candidate to run for president over the last 20 years. we will reveal who's number one. stay with us. i wouldn't do that. get married? no, i wouldn't use that single miles credit card. nice ring. knock it off. ignore him. with the capital one venture card you earn... double miles on every purchase.
