I am told in this meeting he said to pelosi and others who were there, that this would add weight to the legal argument in court and a fight with the Trump Administration over a range of issues over a subpoena, he believes it will help his case in court and made two additional arguments, including opening up an inquiry would centralize out investigations, before his committee, the House Judiciary Committee, which has the expertise to move forward, also he referenced rules on the house floor and the House Committee that presents the disparagement of individuals and the president , if you open an impeachment probe, it is easier to make the case the president may have committed crimes and not violate house rules. We did get pushback. Nancy pelosi is resisting opening impeachment probes. She says reportedly the president should go to prison than be impeached. I am told that adam schiff also resisted that effort if they were to centralize an impeachment inquiry, perhaps that could impact his committee. He did not want to move forward on that easy well. One member of the House Judiciary Committee made the case he has been very careful, jerry nadler in how she advocating for an impeachment inquiry. He has been careful but he doesnt want to throw pelosi under the bus. Thats the view of one member of the Democratic Committee so nadler is facing these dualings tensions, even though its the personal belief they should open up an impeachment probe as the speaker resisted, washington. It would be Democratic Caucus is united about its view to investigate this president , look into all these allegations that are out there. They dont want to go out publicly and saying they are disagreeing with the speaker. They want to make the case they are investigating and will do everything they can and no option is off the table. Theyre trying to down play any divisions that are actually existing in this caucus about the strategy and whether to launch this probe. Nancy pelosi is always thinking about that next step. You open up an impeachment proceeding, you end up having a vote. It passes the house. Then you end up in the senate. If you end up in the senate with mitch mcconnell, you bet ver a mountain of evidence because this guy is not going to risk his majority. He has 22 seats up. In 2020. If he actually say removes the president , which i highly doubt thats what he would do, it would cost him the majority of his house, because you suppress his own base. I didnt have wifi so what i ended up doing is rereading the Mueller Report and i reread that sevenlths i highlighted it. Its actual that section. I highlighted that section on my iphone, it was very, very questionable what he was trying to suggest. At the same time it points out later on, on that same page, it points out trumps attorney when he was told by flynns attorney not, he couldnt give them any more information that he would tell the president , trumps attorney would tell the president that that was hostile actions towards the president. So in my eyes its what the folks associated with this administration have always done, withives to dodge, lie, to protect this president. At the same time, i want to tell people that we want to make sure that we follow all this evidence, forward all this evidence to the logical conclusion. If its obstruction, then were going to bring it out. And we want to make sure that this is read out loud in public and make sure that everybody understands whats going on. They are releasing statement, this letter, if you go ahead and issue the contempt citation, they will simply stop cooperating with you. That doesnt make a difference. They havent been cooperating with us, anyways, so we have to make sure we keep pushing our case forward and then if we have to go to court, well go to court, once again. So this is a significant development. It looks like theyre stonewalling on a whole bunch of issues. You are on the oversight committee, the ways an means committee. You want to see the president s tax returns for the past six years. You believe you have a strong case. How is that working out so far . And i said on this show, i just said it, this president as well as everybody associated, they have one strategy, its called dodge, delay and lie. And i want the American People to know it. Because theyre going to keep doing it. But were going to follow every piece of evidence, if were going to issue subpoenas, if they dont follow up on the subpoena, were going to issue contempt. If they dont have, dont follow up on the contempt, were going to go to court. Maybe this is one way for them to sort of try and push her towards the impeachment side of the fence. Jeffrey toobin, remember, these are his private positions. He is reluctant to go public. I got a question for these democrats. Why dont they talk less about investigating and do more investigate . Where are the hearings . Just dish Year Committee is going to hold a committee on monday where john dean is going to testify, who was white House Counsel 40 years ago. Why is all this discussion about strategy . Why dont they call some witnesses, produce some documents, even if its just to show that the white house isnt cooperating . I mean, i dont think all this wheel spinning is doing them any wood when theyre not producing anything. I think thats the problem. Theyre not getting the witnesses they need. If they can get don mcgahn up there. Subpoenas are fought things you decide to do or shouldnt do, its optional. Theyre subpoenaing people. They need to get people up there. Jeffrey, nadler does say within weeks, if necessary, he will issue a subpoena to Robert Mueller to appear before his committee. Well, you know, time is passing. You know, its june. The Mueller Report came out in march. You know, i guess hes like trying to be real polite with mueller, saying, asking, pretty please testify, you know, weeks are passing. Its soon. Its going july. Then august. I know all the months, actually. I can recite them. But its like you know i just dont tow what theyre waiting for to actually get some witnesses and start presenting evidence rather than talking about what theyre going to do. What do you think, david . Let me see if i can tie a couple things together . I think jeff i have right, House Democrats need to do more actual investigating. They are frustrated theyre not getting the witnesses and their suspense answered. People like nadler apparently want to move forward so they can get more access to information. On the other hand, i think the pelosi position is, i want to make it clear to the public and to the courts and to other members of congress that we cant get anything through the courts. We cant get anything any other way except to impeach. She wants this clearly to be a last resort. I think the problem is the more time that passes is actually going to undercut their argument for impeachment. Mueller put out that report i think it was april 18th he made that report public. Yes, it was reasonable for them to take some time, digest the report. Not seem like they were rushing to conclusions, impeachment. The thing is theyve had time to look at the report and look at the absolutely shocking conduct that is described about what the president and his associates new about the russian plot against america, they encourage that plot and his efforts to obstruct justice and that investigation on an ongoing basis. So at this point, for the house of representatives to not ask them, and a mayor that is their constitutional obligation, right . Robert mueller talks about, well, there is this remedy. Its not the criminal justice system. Hes not talking about oversight hearings, center, hes talking about the remedy of impeachment. If you wait and have the facts and wait too long, eventually the question comes if you think this is impeachable conduct. I do agree with susan on the point. But there is a point where there will be a tipping point. Democrats do face that exact risk. They will have waited so long, people will say, why didnt you impeach sooner . On the other hand, you can always go to impeachment. I think again the speaker wants to get to this position where she said we have no other choice and shes not, there was that poll this week where 41 think impeach. She is thinking of the 51 other american was arent there. Shes thinking of the 50 democrats in trumps district she is worried about losing. If this were a normal congress. Susan and i were talking about this, you could have an elect committee in the iran contra you can do an investigation with the public. You had an investigation in watergate. Its late for that. This isnt a normal congress. So its hard to figure out. Jeffrey, the argument that they keep making, those reluctant to go forward with formal impeachment proceedings, so the house of representatives impeachs the president of the United States. Hes not going to be convicted. In the senate you need 20 republicans. If all the democrats vote in favor of impeachment, thats clearly not going to happen. He would use that to his political advantage in his reelection effort. You know, i dont think anyone really knows the answer to what the political impact of impeachment is. You know what president s dont like . Being impeached. You know, its really not a good thing and the idea that this would be some gift to donald trump by impeaching him, making him one of three mr. Presidepre be impeached. I dont think thats a good thing for his reelection. It is true it might motivate the base. The idea that wane e any of us can predict with precision what the political impact is of an impeachment. You know, im there, you know, i agree that the senate is not going to produce 67 votes. But the idea that this would somehow help donald trump get reelected. I dont think anyone knows that for sure. Thats absolutely right. Certainly House Democrats are over learning the lesson of the clinton impeachment. At the same time nancy pelosi is being extraordinarily conservative and cautious and not moving to impeachment. She is reckless saying things like he should be if jail. Basically the democrats version of lock him up. Things we shouldnt want to hear members of Congress Talking about in that manner about pursuing those types of things. You cant have it both ways. If you think he should be in jail. Isnt that serious enough to impeach him . Im not criticizing Nancy Pelosis strategy here, but she cannot say things like, lock him up. Which she effectively said and say, but wait a minute, we shouldnt impeach. I think shes trying to have it both ways. If the concern is the election coming up, the politics of this impeachment should be her focus not whether President Trump is in jail at some later point in time. Pelosis strategy only makes sense in a world in which donald trump is not elected president. All the strategy of not wanting to pursue impeachment, beating him at the polls is fine and good if he is actually defeated. Keep in mind this was the same mistake the fbi if 2016 planned for a world in which they assumed it was impossible somebody like donald trump could be elected president. We see nancy pelosi engaging in thinking, its impossible that someone like donald trump could be reelected. Let me make the case for Nancy Pelosis point of view for one moment which is, i believe, that in order to impeach the president you have to have Public Opinion on your side, have you as to make the case. And the point, as jeffrey was saying earlier, they havent made the case, because they havent had hearings. They havent got mueller up there. They havent got mcgaughan, hope hicks, whoever they want. They need to start doing that quickly or nothing will occur. Good point.
