Already you are seeing resistance at 1. 9 billion coming weeks after Congress Passed that 900 billion relief bill in the final week of Donald Trumps presidency. Senator collins, senator romney, both of them pushing back on this. They were a part of a group of eight republicans who joined the chief economic adviser on a call yesterday. While we are told that Vaccine Distribution was, indeed, something there was broad support for in terms of additional funding, some of the specific items in here and these senators asked for more justification for this 1. 9 trillion price tag and overall some of the more specific items, including some of those stimulus checks. Now, that hourlong call will be where that ultimately goes. For now, the white house insists they want to get this done in a bipartisan fashion. Already, there is pushback from democrats who say, look, we need to do this through the budget reconciliation process, which would require the majority of democrats, a majority of the senate, 50 plus the Vice President , in order to pass this piece of legislation. Now, today, president bind is expecting to turn his attention to the military. He is expecting to reverse that ban on Transgender Service members serving in the military. That is expected to come Via Executive action today and the president is also going to be meeting with his newly installed secretary of defense lloyd austin as well as the chairmans of the joint chiefs of staff. He has been in the job a couple days now as secretary of defense. He will be ceremonially sworn in today by the Vice President and another person or individual at least with a military rank at the white house. This is a case of the type of thing that guiliani was saying. Listen. Last night, one of the experts that has examined these crooked dominion machine has absolutely, what he believes is conclusive proof that in the last 10 , 15 of the vote counted, the votes were deliberately changed. Cnn legal analyst ely honig joins us, 1. 3 billion. How strong does this case look to you . Reporter it looks pretty strong. If are you the dominion voting systems here. You have to prove two things. One the statements that the defendant here Rudy Guiliani made were false. I mean, they should have very little problem proving that. These statements Rudy Guiliani made were not just false, they were wild. The second thing you have to prove is that the defendant rudy knew they were false or reckless. Meaning he should have known, could have known, said them anyway. Those are the requirements. Given the obvious falsity i think dominion will have a real shot to prove its case here. One thing thats interesting. A dominion lawyer points this out. They say guiliani never made the dominion claims in a court of law when he would have been under oath. He only made them in public or testifying when he wasnt under oath. Why does that matter here to the point you were just making . Reporter yeah, its a good point by the dominion lawyers. It goes to rudys knowledge if these were false. If he believed them, he would have said that in law. The risk as a lawyer is you can get sanctioned by the court. Get fined, thrown out of the bar even. So i think thats a good indicator. Another interesting detail here, rudy didnt just Say Something once. Sometimes one statement that a person says you can argue well, maybe they misspoke a little bit or were misunderstood. Rudy made the statement dominion complains about here, dozens of times, 50 times. Its harder to run away from that. Dominion writes, after we asked him to stop his claims, he said he would love discovery. We are here to remind him, discovery is a twoway street. Reporter i see a bluff called there. Its costly and ricky to go to trial. Im not sure dominion will be in a settling move here. Given they have serious damage done to their reputation. Im not sure Rudy Guiliani will be able to settle for the amount of money that i think dominion will require. This one, i put this in the small category of cases i think have a real shot to end up at trial. They have every reason to push this until the very end here. There was a Conference Call yesterday with the 16 bipartisan senators who had questions for the administration about, you know, where theyre getting this number. How they came up with 1. 9 trillion. Will this be more targeted relief . I mean, they really wanted to crunch the numbers here. Do you think that it is possible that the white house will compromise now hearing some of their concerns . Do you think that they would compromise on say losing the 15 minimum wage or things like that . I mean, look, theyre certainly reaching out. They have made it clear they would like to prefer a bipartisan package. The big take away is republican resistance to this 2 trillion relief package. But we are hearing from democrats about that price tag and this incident democrats may be after the call, look, this isnt monopoly money that is targeted. If were going to spend another trillion dollars. You heard them speak up about why are people that make more than say 200,000 getting these stimulus checks . Perhaps they should be more targeted to low income earners who really need the money. So i think the interesting thing out of this is, yes, there is a willingness by a group of 16 moderate democrats and republicans to come up with a compromise. On the flipside of that, there has been this idea of trying to pass through the house into the senate on party line votes and i think what we learned is there are people that want to make changes as well and with schumers 5050 senate he will have wrangling if they go on a party line basis as well. Its not an easy win. I want to ask you from another headline over the weekend. We learned as bad as the insurrection was, seizing the capitol, it doesnt get any worse than that. But new revelations over the weekend about what else the former president was trying to do, including getting rid of the acting attorney general, replacing him with his own guy and basically trying to invalidate the entire election. Did the Supreme Court get the thing thrown out. Sort of an internal Justice Department coup. We also learned that one of the guys, according to New York Times pushing this theory, the guy down the street from you, pennsylvania congressman republican scott parry. What the u. S. This tell you that this happened that it got as close as it did and that it was driven at least, in part, from congress . Well, john, no one should be surprised that the president would go to all lengths to try to overturn the election. This isnt surprising. You mentioned parry. Hes a Freedom Caucus member tightly in line with jim jordan. Again not surprised by his intervention. I am sure he is unapologetic about what he did. So nothing her is surprising. The president has been obsessed with the election, since he lost and hes gone to Great Lengths i mean, this is just a part of the narrative. I want to ask you about the Upcoming Senate trial for donald trump. Its less than three weeks since that insurrection. Already, you are hearing from some law makers whose lives were endangered that day. I mean, lawmakers had to try to find President Trump. They were desperately trying to call him, text him. He was mia. While this was happening they were praying he could call off the mob. Calm off the insurrection. He did not do that and already you are hearing from some of these republicans saying like old news. Lets move on. Heres marco rubio why ed. I think the trial is stupid. I think its counterproductive. So hes not saying odd news there he is saying, it will increase tensions in the country. It will upset the insurrectionists, if you talk too much about the insurrection. I dont know how much worse detentions can be than what we saw on january 6th. I want to remind people what senator rubio said when there was a different maraud mob that killed four americans. This was in 2012. This was benghazi, back then, senator rubio and we have republican senators who really felt there had to be accountability and felt we had to get some answers. Here is rubio then. This is not about politics. This is about accountability. Someone needs to be held accountable for whats happened here. Its about preventing this in the future. This is not hurting anybody politically. This is about getting to the truth. So you only need accountability if americans are killed in libya. Explain the contradiction there. Well, i think senator rubio said it would be counterproductive to proceed with a trial. I think whats happening is he is thinking ability hits poteabout his potential primary with ivanka trump. I think you need to draw a complete brake from the trumps if you will be running against one. Many of these senators shouldnt be doing anything to help the president to evade accountability from his action, everybody agrees were horrific. You provoke this insurrection in many respects. So im not sure i understand the political calculation here except there will be political damage to the Republican Party no matter what happens, whether they impeach or convict him or not. I think the question for these republicans in congress is what kind of party do they want to go forward . Do they want a clean brake from the president or under the thumb of this guy, a guy whose been disgraced, twice impeached, how about Going Forward and talk about winning instead of losing . What happened between now and then, there is so much that needs to be resolved, including a powersharing agreement . How will these next few days go . Yeah, i mean, its clear, the senators are doing a lot. Chuck schumer has wanted this job for years. He is trying to do impeachment, negotiating with mcconnell. Hes being a pain in his side. its going to be a rough couple days, weeks in the senate. I think with regard to republicans, we have this pressure that is mounting. Even on republicans who are sort of feeling this pressure from constituents back home. There was a call last week where Senate Republicans were all talking about their phone lines going off the hook with constituents saying they should acquit trump and kevin camary republican from north dakota was talking about how he is getting calls from donors, including from the Senate Leadership fund and there was a lot of frankly concern about this trial. You didnt hear republicans talking about how they would justify convicting him. Rather you heard a lot of republicans trying to find a way out on this call. Could we get rid of this trial, go to the Supreme Security to say they cant impeach trump. So its clear that republicans right now even some really concerned about trump being in their party are feeling pressure. Its a question of are they going with their gut . Its a big question mark. Its just incredible that they dont feel any need to get the answers and the accountability and justice for what happened there. Its dizzying. Frankly. Is this because theyre afraid. Theyre still afraid that donald trump is what going to start a maga party or the Patriot Party or i guess theyre just afraid that his supporters will punish him in . I think many of the republicans, members of congress are in a real dilemma. They feel they cant win their primaries without trump and realize most of them will have a tough time win with a trumpstyle candidate in the fall so theyre in this no mans land. I come back with the issue, they have to make a clean break. Its that simple. It will be shortterm damage. Loyal city a oneway street with that man. Many are going the other way. Trump doesnt care about the Republican Party. He is trying to monetize his defeat. If he feels its in his interest to start a maga part. If i were republicans, id do whats right. They have to hold the president to account for what happened. He trampled on congress. He helped provoke an insurrection that it was a frontal assault on the institution, itself. I want to know how the process is going and how you intend to present your case. Well, we are the nine impeachment managers, were all lawyers and were all working very well together sort of as a legal team. We are getting ready and we felt like we were ready last week. But every day more evidence comes out like the evidence this weekend. So were just continuing to prepare our case. We are ready to go to trial next week or a week avonex sunday, the 8ing of february. So the evidence that came out this weekend, the New York Times and other places, that there was a discussion about removing the acting attorney general Jeffrey Rosen of replacing him with someone who wanted to overturn the results of the election. Why does that matter to your case . Well, there is that evidence. There is the evidence that the Trump Campaign apparently organized a rally at the white house. Numerous more statements are coming out by people who were rioting at the capitol who said that they came because trump told them to do it. So, all im saying is the case gets stronger and stronger every day and, of course, since were preparing for trial, were not going to say specifically which pieces of evidence were going to use in the trial. There is evidence that remains clear that donald trump incited the insurrection to come to washington to overturn the certification of the election results. They went over to the white house to a big rally that was organized by the Trump Campaign. The president told them to come over to the capitol and stop the counting and they did and they tried to. They came over. They broke in. They terrorized everybody in there and they tried to stop the counting. Many are saying they did it at the direction of the president. Its a pretty strong case. How all of this evidence comes in, well just have to see how it fits in as we get closer to the day. I guess im asking you, physically, we all saw it happen. We saw the insurrection play out on tv. We have heard directly with some of the people charged and we heard the president , himself, speak out loud. I guess my specific question, the specific reporting involving Jeffrey Rosen and others, what does that matter . Im not saying it doesnt. But im curious into where it sits in the case overall . Well, well, overall, donald trump for months has been obsessed with the fact that he was worried about the election. I mean, even in the last impeachment trial, of course, he was trying to persuade ukraine to bring out dirt on joe biden. Well, this has been all along his intent and then when the election happened, of course, he spent all this time trying to strongarm different spates like georgia into not counting the rules and then this revelation about the department of justice, trying to politicize them to go to the Supreme Court to stop the counting. Its just all a part of the president s mental state about how he didnt really care what the legal election was. He just wanted to stay president. Okay. So, good, getting to the mental state. Thats interesting. What decision have you made on whether there will be witnesses . I dont believe a decision has been made yet. Part of that will be up to the senate rules and we havent heard yet. What are the arguments being made against conviction . Marco rubio basically said, i dont want to play the sound byte, we heard plenty from senator rubio this morning. He said something effective to we have a flaming fire in this country. This would put gasoline on the fire. That means be careful of upsetting the insurrectionists. What about that . Dont rile up these paraowe any more, they might come back. Thats ridiculous. I think the only way we can come to closure is if we have the trial, if we find that donald j. Trump did commit a high crime or misdemeanor in inciting this insurrection and if the senate finds he cant hold federal office again. That will bring closure. That will help us come to healing. You know, i used to be a public defender and it would be like if you had a case where somebody robbed the bank, but you got the money back, you said, oh, well, we got the money back. Whats the harm . Lets let them go. It doesnt work that way. How concerned are you about your own security over the next several weeks . We have learned there will be thousands of National Guard troops that will remain in d. C. Through the impeachment trial and other events. So what concerns do you have . Well, i think that all of us will have whatever security that we need. I think a lot of the lapses that happened on the 6th of january are being investigate right now. It was a lapse in security. But i think people are now taking this seriously. Whats your message to people . And there are plenty out there. Stating it as some constitutional fact that you cant hold a trial for a former president . Well, the president says, you can try somebody who has left office. The precedent is clear that also the reason is, you cant just say, okay, if you are president , you can just do anything you want the last few weeks of your presidency with no consequence because then you couldnt be tried. Thats not a good result. And, of course, the most telling example that you could see is what just happened where you have a president who incites a crowd to go and try i to stop the certification of a legitimate election. It was my second graduation from a Mortuary School in cincinnati and it was a Surprise Birthday Party because we were stuck in the apartment and i was in school all day and we through a Surprise Party at a restaurant there and i told her parents, my parents and, of course, my grandparents on both sides and everybody made an evening of it. Not them. They drove three hours. Eat dinner. Turn around, went home that night. That was them. We got to the point where we started hiding stuff from them because i knew grandpa would stand outside and i went to the soccer game and driving sideways. We just would kind of forget to tell them. Oh my gosh. I mean, their energy is when they got sick, your grandma was 87. Your grandpa, was he 89 or 90 . Either way. When they got sick, you must have been terribly worried about them. But they were not so worried. I mean, did they think that they would survive covid . You know, grandpa was determined to make it until his 90th birthday, which would have been january 19th. When they first got sick, they said they had colds and then they tested positive. But they were so determined. We all talked to them on the phone and facetimed them before and even after they initially went into the hospital and they never once faltered. They never once sounded worried or scared. They were determined to beat it. They didnt have a doubt in their mind that they wouldnt be back home packing for their annual trip to florida. They were more annoyed their trip would be delayed. They were determined to fight and beat it. And i dont really think that they ever considered another outcome. They really have several good years left. They were able live them. So, jesse, just tell us the significance of your family the idea that they died minutes apart from each other and Holding Hands . Well, i think thats one thing that kind of gives our family a little bit of solace in a terrible situation is the fact that one of them did not have to bear the loss of the other. They were together so much, everywhere, traveling the globe and their love story which now the world is learning about, how can you write a better ending for them . It hurts for us, but we can be selfish and want to keep people with us. I think the nurse at riverside, who was so great, mariah sawers, she summed it up so well. Grandpa was the perfect gentleman. He let grandma go first and followed right behind her. How can you describe it any better than that . Just an amazing ending to an amazing life and an amazing marriage. Oh my gosh. Cassie, i know that your own daughters birthday i believe was this weekend and did she get a card from her grandma . My grandma already had cards addressed to the grandchildren and their birthdays were many january and february. When i checked the mail on her 13th birthday, saturday, there was a card handwritten from my grandma and thats how she was, she comes from correspondence and not only did we have them for such a long time as grandkids, so many of our children got to know them and that was such a gift for us our children are blessed by them as well. I, too, got a card from my grandma after she died and it was just like it was a communications from heaven. It was such a gift that i treasure now. I know that your daughter will, too. The message is still confusing. The radical left now in charge of washington is joe biden wearing that horn helmet . Its confounding. But, so too are what republicans are now saying about that mob and what happened in the insurrection at the capitol and the impeachment trial, you are hearing more people vocally. Senator marco rubio said he called it stupid that there would be a trial. Dont they still want answers . Dont they still want accountability or justice . Reporter no, they dont. What people like marco rubio wants is this to go away. So he can start screening, which he has socialists the way Sarah Sanders was in this video. Joe biden wasnt president for two days and he proposeed that covid relief bill and took some other steps open immigration before marco rubio said look at this radical socialist agenda. Theyre going to fall back on a process argue and say the trial shouldnt even take place. Theyve do not want to cast that vote over whether to convict or acquit donald trump. But it appears theyre going to have to. You used the bword there. My question is is it a fourletter word, figuratively. You are more bullish than some. At least not as bearish as some on the issue of whether or not its possible for President Biden to get any republicans to support part of his agenda, specifically, im talking about the relief plan . They have negotiations going on. Its unlikely joe biden will get a covid relief plan even if they have 60 votes in the senate. It will be paired down to some extent. The question for biden is what do i have to give up to get some republican support if i can get it . Is it worth it . Otherwise, do i fall back to an all democratic approach to this . He may end up having to do that. I dont think she prepared to make that decision yet. He will probably let it play out at least a couple more weeks. Is that with you or are you jamming out to it .
