Kicking brooks as he lay on the ground after being shot. Rolfes Attorney Says that is not true. The other officer allegedly stood on brooks shoulders while brooks was on the ground. Prosecutors said that officer would be a witness for the state, but in an unusual twist, officer officer devon brosnans Attorney Says thats not true, they didnt agree to that. Both men must turn themselves in today. Also this morning, coronavirus cases are surging now in 23 states. That is two more than yesterday. Ten states have set records for the highest sevenday average of new cases. Despite those facts, those numbers, President Trump remains in denial. He insists the virus is, quote, dying out. Thats not what the facts say. Cnns Diane Gallagher is live in atlanta with our top story. Diane, these new images are alarming here. Tell us what you know and tell us the reaction of police in atlanta now. Jim. It was the first time many of us had seen those images that youre referring to. The District Attorney announcing charges against those two officers for the killing of 27yearold Rayshard Brooks. The officer who pulled the trigger facing a potential Death Penalty sentence for felony murder, but we are getting an idea of how these officers plan to defend themselves. What they say happened that night and as well as how the prosecution plans to lay out their case. Some Atlanta Police refused to respond to calls. They say its in response to charges against the two officers involved in the Fatal Shooting of Rayshard Brooks. But the Atlanta Police department disputed there had been a widespread walkout, tweeting early suggestions were inaccurate. Across the country, moral is down with Police Departments and i think ours is down tenfold. We expect our officers will keep their commitment to our communities. Reporter just hours earlier, the Fulton CountyDistrict Attorney announced 11 charges against former officer Garrett Rolfe, who shot brooks twice in the back. Rolfes charges include five counts of aggravated assault and felony murder. The possible sentences for a felony murder conviction would be life, life without parole, or the Death Penalty. Reporter officer devon brosnan, whos now on administrative duty, is facing three charges, aggravated assault and two violations of oath of office. Officer brosnan, however, has admitted that he was, in fact, standing on mr. Brooks wobody immediately after the shooting. He has decided to testify on behalf of the state in this case. Reporter but according to his attorney theres no agreement that our client is going to testify at any hearing. In my view, he doesnt need a deal. He shouldnt have been charged with a crime in the first place. Reporter the District Attorney also providing this image, allegedly showing rolfe kicking brooks after the shooting. Thats something his Legal Team Denies and rolfs lawyers additionally claim that brooks was not running away from the former officer. Mr. Brooks turned and offered extreme violence towards a uniformed Law Enforcement officer. If he was able to deploy the taser, it would incapacitate officer rolfe through his body armor. Reporter brooks lawyer calling the charges dpeagainst two officers a good first step. But as you know, that doesnt always result in convictions. Im glad the d. A. s office has really looked into this and hopefully we can get some justice out of this one. Reporter and for brooks widow, tameka miller, wednesdays news was another painful reminder of moving forward without her husband. I dont know what i would have done if i would have seen that for myself. But i felt everything that he felt, just by hearing what he went through. And it hurt. It hurt really bad. Tameka miller actually had to walk out of the courtroom when the District Attorney was describing those officers kicking and standing on her late husband in his final moments. Now, the d. A. Showed some pictures of officers brosnan standing on brooks there while he was on the ground. But his attorneys now characterize the photo as incorrect. Brosnans attorneys say that they have evidence that the officer had suffered a con suggestion. He was confused and was not aware that brooks had even been shot when he was standing on his shoulder jim, the Fulton County district Attorney Says they have issued those criminal warrants for the officers. They have until 6 00 p. M. Today to turn themselves in. Amazing that the family was seeing those images for the first time there. Diane gallagher, thanks very much. Now to a new and revealing interview with Rayshard Brooks himself. Cnn obtained a copy of it. It was shot just a few months ago, before his death. Brooks opening up about his time behind bars and his struggles after that. Cnns randi kaye has the story. Im 27 years of age, you know, fulltime carpenter. Reporter that was Rayshard Brooks in february this year, just months before he was shot and killed by an Atlanta Police officer. I have always been the type of person to you know, if you do some things that are wrong, you pay your debts to society. Reporter broorks shared his story about navigating the criminal Justice System with a group called reconnect. I just feel like some of the system could look at us as individuals. We do have lives, you know, where its just a mistake we made, you know, and not just do us as if we are animals, you know, lock us away. When i did get arrested, you know, it was for false imprisonment and financial credit card fraud. I got sentenced to do one year in prison. Reporter when he got out, brooks had no money, no car, and a mountain of debt. From one individual trying to deal with all of these things at one point in time is just impossible. You have court costs, probation just a lot of a lot of you would have to have a lot of money. And im fresh out of jail. Reporter fresh out of jail and in need of a job. You go to filling out your application and you get to this question, have you ever been convicted of a crime or have you ever been arrested. And you know, youre sitting there, like, oh, my god, you know . It just breaks your heart. Its hurting us, but its hurting our families the most, you know . So as we go through these trials and tribulations, we make mistakes and it just causes our kids to be angry inside. And you know, thats thats a hard feeling to stomach. All of this, brooks says, impacted his mental health. It hardened me at a point, you know, to like, hey, you know, i have to have my guard up, because the world is cruel. It took me through seeing Different Things in the system, you know, it just makes you hardened to a point. Reporter what brooks said he needed most was help from the very system that locked him up. Probation is not there with you every day, like a mentor or something. Theyre not finding you out to find a job. You have to do these things on your own. And i feel like it should be a way for you to have some kind of person, like a mentor assigned to you to keep you on track and keep you in the direction you need to be going. We cant im not the kind of person to give up, you know. And im going to keep going until i make it to where i want to be. Randi kaye, cnn, west palm beach, florida. Joining us now is cnn Law Enforcement analyst, charles ramsey. Hes the former police chief in washington, d. C. And philadelphia. Chief ramsey, what do you think when you hear Rayshard Brooks there speak quite candidly about the cycle that so many people get caught in and how hard it is to build a life after a jail stent. Listen, thats a very interesting interview. And i think hes absolutely right. Van jones has a very good piece on cnn. Com today where he talks a lot about some of the issues around reentry, probation, patr parole and the like. And we need to take a look at that. But i would argue, as we talk about policing, we need to talk about the entire criminal Justice System. Whats it there for . Is it there to punish and rehabilitate . Weve got the punishment part down pat. Its the rehabilitation part that needs a lot of work to give people a succeed opportunity. Otherwise, theyre paying for the rest of their lives for something that they did. For sure. And listen, were having all of those conversations right now and everyone is calling for some sort of reform. That they see that there are things that have been done in the criminal Justice System that have been wrong and are overdue for fixing. But when you also hear that in atlanta, cnns reporting is that there are some officers who are not showing up for work, and when they are at work, theyre not responding to some emergency calls, it sounds as though theyre doing this in protest and just because they feel demoralized by everything that has happened in atlanta and beyond over the past three we s weeks. Do you worry that the pendulum is swinging back in the other direction against Police Officers making them wonder if they even want to take this job . I do. I have concerns about that. I really do think that we have to strike a balance. I mean, were talking about Police Officers that have abused their authority in some cases and certainly we need to root them out, and take whatever action is necessary, whether its administrative, criminal, what have you. But we also need to make sure bier not demonizing all of police. And my fear is this can easily spread throughout the country. We have a lot of issue that need to be addressed. But we need to strike that balance and make sure that were not giving people the impression that all police are bad, because thats simply not the case. But we do have a problem in policing and need to be able to address the problem and Police Officers know theyve got people in their ranks that have no business being cops. But chiefs have to be very aggressive in hitting these roll calls, talking to their officers and making them understand, if youre doing your job the way you should be doing it, you dont have a problem. But if you go too far, you do have a problem and you immediate to correct that behavior now or suffer the consequences. And i think theyll get that message, but it has to be a strong message and consistent. Are you surprised after you saw the videotape after what happened with Rayshard Brooks being shot, you surprised that the prosecutors went for felony murder that carries the Death Penalty . Im not an attorney, so i dont know all the nuances. He has a lot more information than i have been exposed to. I was shocked to see the whole snapshot of the kick, which looks like it was taken from a video. So obviously that video would be there and would be part of the evidence but again, i never felt the shooting was justified from an administer point of view. And when i say administrative, i mean in the policies of the Police Department. Whether it rose to a criminal level or not, certainly thats something that attorneys would have to look at. Obviously, in the mind of the District Attorney, it did. But getting a conviction is a whole different ball game and trying to get a jury that has not been prejudiced by all the attention that h case has been given is not going to be easy. We should also say that officer rolfes Attorney Says that that snapshot is not fair. That that snapshot does not capture what the actual video says and that his client wasnt actually kicking Rayshard Brooks, but well see. We just dont know. Yeah, well see. We cannot know at this point. But beyond the bad actors that youve addressed and the bad actors that ruin it for everybody in the police force, do you have any concern that with all of this reform, with all of the talk of defunding or at least even redistributing money, that with all of these stories, that the job is that Police Officers will somehow feel as if their hands are tied, too tied, and it may not be an appealing job joyce for even the good ones . Well, yeah. Listen, if you have opportunities and choices, as a young person coming up, and you see everything thats going on now, you may very well say, you know, i kind of like policing, but maybe ill do something other than that. It kind of reminded me of the 1960s, not a popular time to become a police officer. I had people that i considered friends that were no longer friends when they saw i was going into policing. Its a tough time. Its a very tough time. But again, reform is needed. They could be a part of that reform. But part of the discussion that hasnt taken place, weeve got o deal with the crime and violence thats taking place in the neighborhoods every single day. Thats why police are there to begin with. Wheres the balance . Weve got to be able to deal with all the issues that were confronted with and we have an opportunity to do that now. But if you just narrowly focus on just what police are doing and ignoring a lot of the other problems that exist, were going to miss the mark on this. President trump, hes downplaying the coronavirus, insisting, as you saw there, it is dying out. The facts dont show that. The numbers dont show that. This morning, in fact, 23 states are seeing an increase in cases. A key model now warns that florida has all the markings to be the next epicenter of the transmission crisis. Joining me now is dr. Jean mirazzo with the university of alabama at birmingham. Good to have you on. Just, youre a doctor, youre an expert in Infectious Diseases. The president says its dying out. Is that true . Good morning, jim, thanks for having me. Its not true. Its hard to see how one could arrive at that conclusion when you look at the data that we have been talking about. Yesterday, in the United States, there were over 25,000 new infections reported and equally alarmingly, to counter the assertion that we sometimes hear, that this is just a consequence of increased testing, its really important to note that hospitalizations are also up in some areas. And that is very concerning, because we do not want to face the situation that we faced, for example, in new york city a couple of months ago. So the president is lying when he says its dying out. Thats the the facts show that. A second argument would hear from some of the president s defenders, but also people who argue for opening up is, okay, but we still got to open up. Economic consequences, et cetera. But well open up and do contact testing and tracing, so when people are infected, we can find those people. Which is what the recommendations are. But in states such as texas, arizona, alabama, where you are, where youre seeing a big jump in cases, thats just not happening. Why isnt that happening . Contact tracing is a very important tool. Another example is tuberculosis. The challenge with Contact Tracing in terms of whats happening now is that we have so much infection that is now really endemic in the community and creating a sustained opportunity for people to get infected, its almost impossible to go in and isolate a single case or a single cluster to really try to keep it contained. Contact tracing would have worked and is working in places where things are bubbling up. You have these cluster of cases. You can swoop in there with your contact tracers. When the design gets this common and you have this many infections, it becomes really important and impractical to think about doing Contact Tracing the way you describe it, and that would be great. Florida now has the hallmarks, according to some experts, of a new especially of this crisis. And to be clear, florida is not new york, new york city with a dense, urban area has particular characteristics that help the spread. That said, you look at that graph there, its a sharp jump in cases. When you look at florida, are you concerned about a new epicenter . Florida has already made the stuff of nightmares for me and many Infectious Disease people when it comes to covid19. In fact, we were surprised when other states were experiencing the kinds of increases that they saw that florida didnt see. And part of the reason im really concerned is that florida has a lot of older people, right . And we know very, very well that age and coexisting conditions, like classic disease, like lung disease, like diabetes are the prime predictors for hospitalization and for mortality with this virus. So florida also has a lot of nursing homes, a lot of geriatric care centers, a lot of retirement communities. So the potential for the virus to take off there is very, very nerveracking and could have catastrophic consequences. Yeah. And of course, the question is, will state officials there respond . I dont think hes fit for office. I dont think he has the competence to carry out the job. There really isnt any guiding principle that i was able to discern, other than whats good for Donald Trumps reelection. You say that you were astonished by what you saw. A president for whom getting reelected was the only thing that mattered, even if it meant endangering or weakening the nation . Well, i think he was so focused on the reelection that longer term considerations fell by the wayside. So if he thought he could get a photo opportunity with kim jongun at the Demilitarized Zone in korea, there was criminal emphasis on the photo opportunity and the press reaction to it. And little or no focus on what such meetings did for the bargaining position of the United States. John boltons book makes many more damning allegations against President Trump and well get into all of those. Joining us now, maggie haberman. Shes a White House Correspondent for the New York Times. Good morning, maggie. So john boltons really letting it rip here in this book and it is significant, because though weve heard other critical kind of tellall books, this was his National Security adviser. This was the president s National Security adviser, and he, i think, is being the most explicit and critical, because he says that he was right there for these moments. He was listening. He was taking notes as President Trump was doing things like asking president xi of china for election help with his reelection coming up in 2020 by if president xi would just buy some more Agricultural Products from the u. S. And so whats the reaction this morning in the white house . Well, its not happy, alisyn. As you say, this is an unusual book, because there is a name to it of an adviser. This is not anonymous people talking to various authors or anonymous people talking to those who write these stories for cnn and for the New York Times. This is something whos basically confirming everything we have all written and then supplying Additional Details from what he was present for. So the white house is very unhappy. They have had a sort of belated reaction to this book, for lack of a better way of putting it. When mike schmidt and i first reported on some of the relations in this book that related to the president s call with the president of ukraine, that was at the heart of the impeachment inquiry, when we reported on that last january, the white house was, you know, reactive, but then they believed they had gotten past it. Bolton made clear in media accounts two weeks ago that he was going to go ahead with this, but the white house only this week started moving to make a legal effort to stop it from going forward. And from the folks i talked to, they feel like a lot of that is only aimed at making it feel like the white house is trying to do something. So alisyn referenced the president requesting help from authoritarian china in President Trumps reelection, begging for help, as bolton describes it. He also, and ill read another excerpt here, about giving china an okay to build concentration camps for a million muslims. Let me read it. At the opening dinner of the osaka g20 meeting, with only interpreters present, president xi had explained to trump while he was basically building concentration champs in northwest china. According to the interpreter, trump said he should go ahead with building concentration camps. Concentration camps, world war ii style in the 20th century. Beyond its anger, et cetera, does the white house have an answer to the National Security adviser giving a firsthand account of this . Do they have a factual answer to that allegation . No, look, as you have seen, jim, so far, what they have said is two things that are very hard to square as potato true. One is that the book is highly classified, as the president said, and the other is that its false. The president called john bolton a liar last night. A white house official i spoke to last night said, look, there are some things in there that are true, but classified. There are other things they are arguing that are not true, but theyre not specifying which, which is a timeworn tradition, as you know, of administrations saying, you know, were not going to get into the specifics. But that said, this isnt going away. Amazingly, there are people around the president who think that this bolton fight is a better fight for them than the pressure the president has been under amid a massive shift in public sentiment about police and Race Relations in this country. But as you just noted, when the two choice eiths are either tal about concentration camps for uighurs or Race Relations, these are not great options when youre running for reelection. When you poll those issues, those are not at the top of the lust what voters want the president to be dealing with or talking about or favoring. Heres hoot one. One of the things that john bolton says is that President Trump is easily duped by foreign leaders, leaders like putin that basically he false for. The things their story lines. The things that they say to him. Here is another excerpt that the New York Times got from this book about how he favors dictators. Bolton describes several episodes where the president expressed a willingness to halt criminal investigations to in effect give personal favors to dictators he liked, citing cases involving major firms in china and turkey, bolton said the pattern looked like obstruction of justice as a way of life. Maggie, your thoughts on that . Whats interesting about that, alisyn, is that is also a conversation that john bolton had, he writes, with bill barr, the attorney general. He writes that he had this conversation with barr and that barr shared some of his concerns about the president s conversations with president xi about the president s conversations with erdogan of turkey, about zte, this chinese tech firm. About a sanctioned bank company in turkey and that basically the president was willing to waive concerns by the american judicial system about these companies that had state connections and that barr himself was concerned about it. When mike schmidt and i wrote about this in january, we got a massive denial from bill barr. We have not heard that in the last few days. What we have heard from bill barr is his anger that bolton wrote a book and his suggestion that its unprecedented while someone is still in off. Thats also not true. Maggie, theres another story in here about secretary of state mike pompeo, because he has been one of the president s most public and ardent defenders. Passing a note to bolton, saying, he is full of shit. Talking about the president. Didnt know we were allowed to say that on air. Well, you know what, its the way they talk, so weve got to quote it. Pompeos strategy, as you know from the past, is to attack reporters. This is the National Security adviser giving this account. He also says that pompeo, as well as bolton, considered resigning at points. As you know, the president does not suffer critics. This is these are this is someone still working for him, right . What is the president s response going to be to this . Well, the president did talk about this last night in, i think it was in an interview with the wall street journal, saying, show me the note, show me where this happened, which is a version of what mike pompeo said. However, who was talking wasnt on the record, chi thought was interesting, in a comment to jake sherman from politico saying, you know, this isnt true. You know, this is all madeup bolton has not just one example of mike pompeo being unhappy with the president , he has several examples of mike pompeo threatening to resign, which is of note to your point, because he has been such a vocal, public defender of the president , i think it is going to be incumbent upon mike pompeo to say in his own words that this is not true and people can then weigh the two statements together. Yeah. We should note that pompeo is currently in hawaii meeting with the Chinese Foreign minister. Hep did not bring any reporters with him, which is extremely unusual, so therefore cannot be challenged immediately by reporters by these revelations. Thanks, guys. As you know, President Trump plans to hold a big rally on saturday in tulsa, oklahoma, and some supporters are already lining up there. And while the focus will be on the president s reelection, it is impossible to ignore the citys painful industry of racial violence. Cnns abby phillip is live in tulsa for us with a closer look. I am standing here, not too far from where President Trump will have his rally, but in a neighborhood called greenwood, and this mural behind me that says black wall street marks where 99 years ago, this was a bustling prosperous city within a city in the city of tulsa and it was destroyed in a night of violence, after a white mob completely burned it to the ground. I spoke to some of the descendants of the survivors of that massacre and say this National Conversation on systemic racism has special resonance here. Reporter amid the coronavirus pandemic, the beating heart of tulsas Greenwood District is still here at the historic vernon ame church. The sanctuary sits atop a basement that is the last remaining structure in the once prosperous black community that was destroyed by a white mob by the bloody massacre in 1921. Were the on thing on the original Greenwood Avenue thats still black owned. And the only thing thats still black owned in the Greenwood District. Reporter nearly one hundred years ago, the area made tulsa a mecca for the black businessman, doctors, and lawyers. You have folks that are en envious of what they call little africa. Reporter and then hundreds of white tulsa residents went on a murderous rampage after a white woman accused a black man of sexual assault. You would either stay in your house and burn to death or run out in the street and hope not to be felled by a bullet. Reporter homes were looted and then burned to the ground and hundreds were killed. Not one person was ever charged with a crime from the worst race massacre in american history. Reporter a history shrouded in secrecy. Reporte for so long, there was this intimidation of silence that the White Community put upon greenwood, that if anybody talked about it, they became missing, they were killed, they were lynched. Reporter now in the midst of a National Reckoning on systemic racism, President Trump has offered this solution. What you now see, has been happening, is the greatest thing that can happen for Race Relations, for the africanamerican community. Thats what my plan is. Were going fof tto have the strongest economy in the world. Reporter for descendants of the massacre, that message falls flat. You had wealthy people at the time and their wealth did not protect them from racism. Reporter as tulsa looks to move pardoforward, it must firsk back. Black folks have the story, we want white folks to have the story, but the accurate story. Reporter here in the city cemetery, only two graves mark the dead from that massacre. Theyve created a 6 million fund to honor the victims of that massacre. And a quick update on the excavation plans they had planned this summer to continue the excavation, to find whatever remains of the victims of the massacre, but they had to put that on hold due to the coronavirus concerns. As you know, the president s rally there in tulsa, its going ahead. It was going to be on juneteenth, tomorrow, marking the emancipation of slaves, moved one day. Is moving it one day in light of not just juneteenth, but also the anniversary of the massacre there, does that make a difference . No. No, it makes no difference at all. Juneteenth is a weekend celebration, so him moving it one day has no effect whatsoever on what i fear could be a very tense situation that could turn very bad, very quickly. Tell me the reaction to you on the Health Concerns here. Of course, insisting on having this rally indoors, exactly the kind of venue that Health Experts say is the Perfect Place for the virus to be transmitted. Indoors, crowded, lots of people talking, shouting, expelling droplets, et cetera. You have noted the mayor has the authority to prevent this from happening. The mayor has expressed anxiety about this event. By letting it go forward, is the mayor, is the governor endangering the people of tulsa . The people of oklahoma . I believe so. Absolutely, i believe so, because they have the authority to stop it. The arena was closed to the end of july because of the covid crisis. And this was allowed to happen, i believe, because the president is who he is. And certainly, it doesnt and surely because this is a red state, those exceptions were made. I would venture to say if president ial candidate biden had asked that the answer would probably have been no. But, you know, who knows . But it is a very grave concern, certainly on the Public Health level here in tulsa. We have yesterday reported 96 additional cases, which is the largest spike of positive cases that we have experienced since the crisis began. And it is of concern. Trump himself sees wearing a mask as weak and will berate anyone who wants to wear a mask, sees it as a sign of weakness. So i am very concerned about the potential aftermath of whats going to happen here, not only as it relates to our Public Health, but also potentially what could happen in our community, because there could very well be some negative confrontations that take place. How concerned are you about confrontations like that . Very concerned. The atmosphere here is tense and its growing more and more tense. Rumors are spreading about situations that have possibly taken place. Im looking to try to confirm or deny just as people are coming into town in preparation and visiting our city, that there has been some negative, you know, confrontations. Nothing that have blown out of proportion yet, but i think as we get closer again, the atmosphere is growing more and there has been concern that demonstrations in the wake of george floyd have attracted extremist groups including white supremacist groups that have deliberately sparked violence. Are you concerned about that in tulsa this weekend . Absolutely. Absolutely. We know that trump has a pretty large following of extremists. People that want to carry around automatic weapons. Oklahoma is a constitutional carry state and thats certainly of concern. Thats of concern. And i mean, i dont think it will take much. Now, i know that the Police Department and others in Law Enforcement are trying to make sure that doesnt happen, but all one must do is look around this country to see that things can go that things can turn very bad, very quickly and im concerned about this for my community. Fired officer Garrett Rolfe facing 11 charges including felony murder, that carries the possibility of the Death Penalty. The second officer, Devin Brosnan charged with aggravated assault for allegedly standing on brooks shoulders as he was fighting for his life. We are hearing from Rayshard Brooks, just four months before he was killed. He talk about trying to turn his life around after incarceration.
