The ground by a Police Officer. Now to the developments in the investigation into George Floyds death. Minneapolis news station kmsp is reporting that Derek Chauvin the officer who wined george floyd to the pavement with a knee to his neck for nearly nine minutes was in talks to plead guilty before he was arrested and charged with murder. Those negotiations reportedly fell apart. Meanwhile, what went wrong in georgia after scenes like this, voters waiting hours in the hot sun yesterday and reports that machines didnt work. Why did they have so many problems and can they fix them before november . Lets begin with Cnbcs John Harwood live at the white house. Hi, john. Good morning, alisyn. You know, weve got the wheels turning fairly quickly on capitol hill just 24 hours after George Floyds funeral. Today, philonise floyd, his brother, is going to testify before the House Judiciary Committee as legislative action begins on Police Reform. The house of course laid out their bill monday. It was a as you would expect a more proscriptive bill banning chokeholds, banning no knock warrants in certain cases. But the Republican Party interestingly is now stepping up and saying in the senate that they want to have some action as well. Tim scott, the senator from south carolina, the only africanamerican republican in the senate offered a bill yesterday evening. It is less proscriptive, its more in the manner of collecting data from states and providing grants that are conditioned on certain actions but it indicates that theres a common space for discussion between the democrats and republicans. Its going to be Senate Republicans who drive the gop position on this rather than the white house. We know that the president and his aides have indicated that theyre open to some of those reforms, but as we have seen in past episodes like this on gun control after Mass Shootings it is really the Senate Republicans who are ultimately going to drive the train here. Important to note though that many local jurisdictions, a dozen of them so far, have acted on their own to ban chokeholds. Of course, minneapolis, washington, d. C. , and a number of others have. So reform is happening at the local level and there are signs that we may get some at the National Level too, guys. John, has the president indicated at all, out loud, which measures he would ultimately support . No. His aides are going to present options to him. We saw mark meadows and Jared Kushner on the hill yesterday consulting with republicans. John harwood, thank you very much. Lets bring in cnbc political analyst maggie haberman. Also with us, abby phillip. Great to see you both of you. So maggie, as the president has watched this what feels like a sea change over the past two weeks, people demanding progress, congress attempting to take some steps towards that what is his thinking and mindset inside the white house . Well, the president recognizes the speed at which Public Opinion is changing on race, alisyn, and remains to be seen. As john said, mark meadows the chief of staff is bringing the president a menu of options that are plucked from what folks on capitol hill are talking about and senators and Republican Congress members dont have the same plan in mind. Theres a bunch the president has heard from a number of advisers he has to do something. He has avoided it thus far. The options have been to give a speech or do a listening session. Lots of aides dont want him doing a speech and he doesnt like the idea of a listening session but i think there are enough people recognizing there has to be something to be done and they have to get him there if hes ready or not. His instincts though from, you know, when we go back nine days now to when he cleared out the street in front of the white house and walked across the street for a photoop have been in a different place. His instincts have been to lean into the different place. To what extent has that affected the discussions over a public speech or affected the discussions about whether to come out publicly in favor of something . A great deal. His impulse is to lean into law and order as his default setting and he says he believes he thinks this is what his base wants to hear. He thinks this is what is going to help hip win again, talking this way. It is true that historically republicans have done well with a law and order message. Its a little different when youre the incumbent and you have inserted yourself into the conversation without actually talking to the various voices around the issue of race and police. Instead, he just says 99. 9 of police are good and he thinks that that is the message that folks will want to hear. It will be a struggle to get him a little further. I think when he recognizes his back is against the wall, he tends to try to get up and fight and fight for a reelection win. But look, his advisers know hes in a lot of trouble right through. Im not sure that just saying that hes looking at reform bills is going to be enough, but well see. Maggie, if you have to wrestle with whether or not you have to give a speech on racism you shouldnt give a reach speech on racism. It seemed curious that he was considering giving a speech when his twitter handle speaks for him. So we know how he has felt about the protesters, et cetera. So thats not going to happen, right . Yeah, i tend to agree with you, alisyn. I mean, i have a lot of flash backs in this moment of the days after charlottesville when the white house decided to put the president out to give a speech that was, you know, from a teleprompter that he read. You know, sufficiently convincingly and then proceeded to completely undo what was written in that speech just you know, a day or two later. So there are risks here that the president is perceived as not not genuine in his oefrts to speak to this moment. And i think that theres no indication that what the president actually wants to do is unify the country. Lead this effort to to start grappling with racial reconciliation. Theres absolutely nothing in what the president has said on twitter, with his own words or done over the last two weeks that indicates that that is where his head is at. Its a huge risk to force him to read something from a teleprompter that he does not mean, because i think well find out very quickly soon after how he really feels about these situations and that will backfire. I think the American Public right now, they already feel like he has handled this poorly. More missteps will only make that problem worse. In terms of where his head is, maggie, we saw the statement that the president made on twitter yesterday about martin gugino, hes the 75yearold peace activist in buffalo who was pushed to the ground. I dont want to restate what the president said there, but my understanding while no one is surprised when the president says something outrageous on twitter now, my understanding was there was an unusual level of alarm from within about how damaging that statement at this time actually was. The tweets have been an issue. Look, the tweets are always an issue and by the way, just to be clear i completely agree with abby, i dont think hell give a speech for the reasons she said. In terms of what the president tweeted yesterday, the white house is used to him tweeting things. A bunch of people have told they have taken twitter notifications off the phone because they dont want to chirp of what he says. This one is different in the sense that hes theres a guy who is 75 years old, who was hospitalized. Still hospitalized as of the note that the president tweeted this and the president is saying based on nothing that he offered up that the guy basically that the guy had it coming. Essentially, well, the guy was trying to harm the cops is what he was saying. People saw the video and the problem the president is having over the last week and a half of problem that hes having theres a lot of video. There was video of george floyd. There was video of this man in buffalo being pushed. And essentially, the president and some of his defenders are resorting to saying that people didnt really see what they saw and thats very dangerous. Abby, in terms of moving forward, a lot is resting it seems on senator tim scotts shoulders. He has been tasked with trying to figure out the republican plan for Police Reform and he said something yesterday that i thought needed clarification. He said something to the effect im working on a different track than the white house. What does that mean as Jared Kushner and mark meadows head over there . Yeah, i think it actually means exactly that. That Senate Republicans have in a lot of ways, not just on this issue, but on a lot of other issues, they are forced to kind of take the lead and bring the white house along with them. The white house does not have a kind of moral authority on this issue. They cannot lead on this. You know, in jeron smith, a senior black Administration Official who has been spear heading some of this, but theres not many voices speaking loudly and with moral clarity on this issue. So tim scott has had to do that. And scott i should note has been one of the republicans willing to say, yes, Racial Discrimination does exist, he himself said hes experienced it as a black man and so i think thats why youre seeing that that divide here. At the same time, if you look at the details of the republican proposal so far, its very bare bones. I mean, some of these things are kind of basic. They dont even include, for example, this data base that would allow people to track when a bad cop go from one city to another. Thats actually something that House Republicans have expressed openness to public. I think theres a large gap between the democrats and the republicans, but the white house understands that they need to rely on the only black republican senator in the senate to take the lead on this because theres not a whole lot of room for error here. It is interesting, while republicans on capitol hill seem to know that there needs to be Movement Towards some kind of concrete reform, there is one place that it doesnt seem the president is willing to go which is to acknowledge the existence of systemic racism. It was interesting to see joe biden, the former Vice President , stepping into that yesterday. Do you believe there is systemic racism in Law Enforcement . Absolutely. But its not just in Law Enforcement, its across the board. Its in housing, its in education, its in everything we do. Its real. Its genuine. Its serious. Look, not all Law Enforcement officers are racist. There are some good, good cops out there, but the way in which it works now, we have seen too many examples of it. Its up interesting to watch, some were saying that joe biden was in a bind with the calls to dismantle the police force in minneapolis. It was easy for joe biden to determine where his issue is. No, hes not in favor of defunding the police, but hes against systemic racism. I dont think the president is willing to go anywhere near saying theres systemic racism in policing. No, he already hasnt. I mean, look, he did a roundtable this week as i mentioned before and he talked about how 99. 9 of officers are good. Biden made clear there are officers who do good work and whose intentions are good, but acknowledging the prevalence of racism in the criminal Justice System and acknowledging the black men and women are impacted differently than people who are white are is going to be a big difference. I dont think youre going to hear much of that from the president. But i do think there are some republicans in the senate and in Congress Sort of more willing to say that than the president. Whether he recognizes that that is something that he should do both as a leader and in terms of his own political future remains to be seen. But hes resisted it at almost every turn. Maggie haberman, abby phillip, thank you for your reporting and perspective. So some Police Departments are already making changes like banning chokeholds. Denvers police chief joins us next. One of them is denver, colorado. Chief paul pazen, thank you for being with us this morning. I want to show people the changes that your department has just made. Its going to ban using chokeholds. S. W. A. T. Officers are required to wear body cameras. And restrictions on when police can use chemical weapons and projectiles. So why . Why have these changes been made . Well, first of all, this is a lot of work with our use of force committee made up of Community Members as well as some ongoing work with the center for policing and equity. We really looked at these types of policies. We had a pretty strong and progressive use of force policy already. However, strengthening the language can really help us around culture, making sure that every member of our department knows and understands that chokeholds are strictly prohibited. How will the changes affect your ability to enforce the law . We believe that working with our community is how were most effective in addressing crime issues and Public Safety issues in our community, and continuing to have dialogue with our community. Continuing to work with partners is how we will effectively address the Public Safety issues in our city. So what is it about this moment that these changes happened now . Really, we have to be cognizant of this movement. We have to recognize that this truly is a Tipping Point that this is bigger than just our city, our state and our country. We need to truly reexamine. We have to reevaluate and really reimagine what Public Safety looks like now and what its going to look like in the future. You said we have to recognize this is a Tipping Point. Im just wondering what it feels like to be sitting in that chair or sitting in that position as the chief of police right now in a major American City . Just how much things have changed over the last three weeks. Well, really, the Police Department has to be reflective. It has to understand the community needs. It really needs to listen and thats what we are doing right now. We are listening to our community, where significant policy changes make sense, like these ongoing conversations that we have had with our use of force committee as well as the center for policing equity. This gives us an opportunity to reevaluate and make positive changes, substantive changes that can help us keep our community safe. And when you hear around the country, im sure its happening in denver also, people calling for defunding of police or in some cases dismantling Police Forces thats in minneapolis, whats your reaction to that . Well, you know, again, this has different forms across the entire country and we need to listen to our community here. We need to be open minded and we need to be ready for change. When were talking about reevaluating, reexamining and reimagining we have to listen and maybe there are Better Outcomes on alternative response to certain of types of calls. The Substance Abuse types of calls for service as well as calls for service involving people experiencing homelessness. If theres alternative ways to address these types of challenges, then we need to really take a hard look at these. If theres Better Outcomes, then certainly we want to partner with community and create space so that way we have a safer city. You know, thats a really interesting part of the discussion that in some ways i dont think is getting enough focus right now. The discussion of whether or not there are things that police are doing. Sometimes being forced to do by necessity over the last several decades that maybe others could do differently or do better. Maybe that police would rather not be doing. And that has to do with Fund Allocation as well. Talk to me about that discussion. Again, you know, we want to further explore these types of opportunities, alternative response Getting Mental Health clinicians, medical professionals potentially peer navigators to help us with these types of underlying issues and if they have Better Outcomes, then that can be better for our communities. So we believe that there are opportunities. We want to build on some of the small steps that we have taken as a city to try to step into the to have others step into these spaces. Just very quickly, one quick question. I know you have banned chokeholds unilaterally in the city of denver. How much would it make if it was part of federal legislation to ban chokeholds, do you think that would have a positive impact around the country . So we made that change, again, based on ongoing dialogue and communication with our use of force committee. It made sense for us to do this. Its the right thing to do. While we think that others are doing the same, and if it can help us help keep communities safe, then we certainly support it. Texas authorities are investigating the death of Javier Ambler who is heard telling Police Officers during his arrest i cant breathe. Ambler died more than a year ago, but body camera video of the deadly encounter emerged just this week. Javiers parents spoke with cnbcs ed lavandera and he joins us live from austin with that emotional interview. What did they tell you, ed . Good morning, alisyn. Well, it has been about 15 months since ambler died and whats shocking in all of this is that his parents tell us that they are just now finding out the most basic details of how he died in police custody. Body camera of a Police Officer captured the final moments of Javier Amblers life and his parents cant bring themselves to watch. Its too similar to the way that george floyd died. So when you saw the george floyd video i saw my son. I saw it. I just said thats exactly oh, you know, most likely what my son went through. Reporter the parents sat down for the interview. Theyre angered that its taken more than 15 months to learn the most basic details. They were stunned because Javier Ambler failed to dim the head lights of his car. It could have been avoided if the officers were to just use common judgment. And dont dont look at my son as just a big black guy that is that his life doesnt matter. Reporter it was just after 1 00 a. M. On march 28th of last year when according to the williamsonville county Police Officer began to follow ambler and that triggered a 22 minute pursuit that ended when ambler crashed his car. Ambler stepped out of the car with his hands up and was unarmed. The report says that ambler failed to follow verbal commands of laying down on the ground. Within moments, several deputies were on top of ambler who suffered from cardiovascular disease and congestive heart failure. Officers tased him. Roll over i want some justice. I want them to suffer exactly you know, go to jail, be responsible for your actions. They used their badge, they used their position and its not right. Reporter his death was ruled a justifiable homicide. The office of professional standards determined that the deputies used reasonable force and theyre still patrolling the streets. Riding alongside the lead sheriffs deputy was a film crew with the a e network for live pd. Prosecutors havent been able to get their hands on it. The mother hasnt seen the video but she has strong opinions about it. That was what it was, putting on the show to show he has the power. And he didnt care who got hurt. Reporter the Sheriffs Office is refusing to comment on the case, but in a statement a e said investigators never asked for the video captured by the shows producers and they no longer have it available. The footage was deleted as part of the shows policy to avoid having the footage used by police against private citizens. After Javier Ambler lost consciousness, cpr was administered until medics arrived on the scene but it was too late. Javier ambler has two children. His mother carries her sons ashes in a locket around her neck. His father called him a gentle giant. Im sorry, im not as tough as his mom. Everything has changed since since he was taken from us. The revelation of this video, alisyn has sparked a great deal of controversy. Several commissioners have called for the sheriff to resign. The sher i haiff says he wont down. These are partisan and cynical attacks on him and there are also allegations that the Police Department as this stonewalled this investigation for more than a year by not providing evidence to local prosecutors here in austin that they say is crucial to the case. The sheriff insists thats false and theyre willing and able to participate in the investigation. But as all of the sides bicker about what is going on, the ambler family continues to wait more than a year for the answers. My heart breaks for them. You know, his handling of the economy has been something that when we poll people, they have given him high and consistent marks but thats starting to stumble a little bit. The june number is now 48 . I think it kind of goes hand in hand with his overall handling of the pandemic. Theres disappointment in the handling of the pandemic and that of course relates to the economy. So his handling of the economy number has slipped a little bit here. This had been you know the central argument for his reelection so thats one to really watch. Is also in the polling i think its so interesting when you look at how people feel, how comfortable they feel. A lot of people like half of the people who say theyre not comfortable returning to normal behavior this year, i think thats really interesting. 32 say it will be next year before they get back to normal. That feeling, that confidence among workers and consumers in the public will be critical for what this country feels like. Its ticking up, but slowly. Where are we this morning with what asymptomatic peoples effects on others is . I think what should people understand is that somebody could not have any symptoms at all, no symptoms whatsoever, still be carrying the virus in their body and still spread the virus. Thats the important part. Thats why we still wear masks when we go out in public thats why we keep distance. If you have symptoms, you should obviously be staying home. But if you were going out in public you have to assume that you could have the virus. Even if you have no symptoms. Lets put up the definitions of asymptomatic spread for a second here. Just so you understand, a lot of times people may have no symptoms whatsoever, but theyre about to develop symptoms. So if you have no symptoms and you never get any symptoms, thats asymptomatic. If youre about to develop symptoms but dont know it yet, thats presymptomatic. But i think, you know, the issue is people could still be out there without having any symptoms and spreading the virus. That is why we all have to behave like we have it. I mean, it would be a shame as i said yesterday, sanjay, if this came to the debate about vocabulary, whether its presymptomatic or asymptomatic. The bottom line here is people need to be careful. I think not quibble over words there. You have some inside information from dr. Anthony fauci on the status of the Vaccine Research and maybe the government backing behind some of it. Yeah. I mean, this is you know, just keep the context here in mind. In january, when you hardly heard anything at all about the virus, in the first month of july, one of the vaccine candidates is going to go into phase iii Clinical Trials. It doesnt know it will work, that we know this is a safe and effective vaccine, but within months to go into phase iii Clinical Trials is very, very fast. Typically that takes years if not decades, so moderna is the First Company supposed to go into phase iii Clinical Trials and then a couple of weeks after that astrazenica oxford, and then by the end of the summer johnson johnson. You know, there are several vaccine candidates out there. These are the three sort of moving along at the fastest pace. Now, one thing to in phase iii Clinical Trials you are giving the vaccine to tens of thousands of people. And youre comparing that to tens of thousands of people in similar areas that didnt get the vaccine and basically getting an idea, is it working, is it preventing the infection in people . It can take a while to get results like that back and you have to have populations around the world where the where the virus is circulating pretty robustly. So it may not be just the united states. There are vaccine Trial Centers in brazil, in south africa. We may start to hear about the trial starting to expand to see if they can get some idea is the vaccine actually starting to work . Sanjay, you know, some people are so grateful that scientists are fast tracking this vaccine and some people are nervous that scientists are fast tracking the vaccine. This will be the fastest that we have ever had a vaccine and will people be able to feel safe and confident getting that vaccine by then . You know, i think its a very legitimate concern. I think, you know, you look at the polling, they say a third of people may not may choose not to get the vaccine even if it becomes available. I mean, i think that the you know, with all of the news that we talk about, the speed of this, we you know, we are looking obviously for conclusive evidence that it is both safe and effective. Can you do that in a compressed time line . Perhaps. You know, theres been a lot of work that was already done on the vaccines even before they started because of work that was on previous coronaviruses. So they werent sort of starting from scratch here and thats part of the reason they have been able to go more quickly. But its a legitimate concern. I think its one that well probably be reporting on, you know, for the rest of the year and the next year is what is the evidence that not only is it safe and effective but its safe and effective in all populations of people. What about the elderly, what about people with preexisting conditions, what about children . Right now, its primarily given to young, healthy volunteers. So those are Big Questions and theyll have been to be answered. Im terrified by the notion that people arent going to take the vaccine if its proven safe. The bar to prove it safe will be much higher than the bar to prove whether or not its extremely effective, right . I cant imagine theyre going to compromise on safety. Right. Thats right, john. I think one right to think about it though, look at the phase i trial it is typically in young, healthy volunteers. One of the things you do get as you start to expand this into tens of thousands of people is a more diverse population of participants. So what you know, again, what about the elderly, what about people with preexisting conditions, children .
