Lets start with impeachment and then move to rudy. Im going to have a lozenge while we talk. If you had lozenge on your bingo card. Have another cup of coffee. Joe, who would have thought that wed be looking back on the clinton impeachment as a Gold Standard of civility and bipartisanship. But that is where we are. Mitch mcconnell saying that he will follow the rules as they were done then. Lets take a listen to what he is saying and then have you tra translate it for us into truth. We havent ruled out witnesses. Weve said lets handle this case just like we did with president clinton. Fair is fair. Every other impeachment has had witnesses. Its not unusual to have witnesses in a trial. Okay, joe. Whats he talking about. Whats that clintonera standard that we need to return to . We should remember that trent lott and tom daschle did get together and got rules and got a 1000 vote. Imagine today getting a 1000 vote. Thats a possibility . It doesnt happen. On lunch. You couldnt get that vote on christmas or santa claus or any of those things. But mcconnell is not being straight with you here. The 1000 vote was a twophased system where theyd start, let the lawyers argue for a couple of days and then take a vote on not if they would win, which witnesses. So they approved three. Their house managers wanted 20. The Clinton White house wanted zero. But they you it wasnt up to us. It was up to the senate. We told senator daschle that we wanted this thing done as quickly as possible. It was a logical place and the senate did what they wanted to. The senate was not controlled by the threat of a mean tweet which is it appears to be what the senate is now. And Mitch Mcconnell talking about fairness and norms and institutions is about the most ridiculous thing you can do on Christmas Eve. This is a guy who took 200 years history and denied Merrick Garland a senate vote. I dont think democrats are going to take too kindly to lectures from Mitch Mcconnell on the couch at fox friends talking about fairness. Its much easier to talk about process than defending the president s actions. Theres one reason who really wants a trial and that seems to be the president. So Mitch Mcconnell could well do without one and he wants to make one short, sweet. The president will be acquitted and move on. The question is will the president be okay with that. He wants something theatrical. He wants witnesses. Mitch mcconnell is doing everything he can to say no. We will have no witnesses. Going back to 99. The irony of the great debate about witnesses was when they put Monica Lewinsky on camera, she destroyed the house managers case. It was a netplus for the democrats because she told a story in a way ken starr hadnt told the story. She filled in some blanks, some exculpatory evidence and republicans were like, we want theres no way we want her on the house floor. We dont even want people to see the video. Whats weird, dana, is new evidence keeps coming out every week. In some ways, that makes the republicans case that democrats were rushing this and it makes the democrats case the republicans are wearing ear muffs and dont want to hear new evidence. Including the emails this week because of the foia request. What i heard in the comments from Chuck Schumer and Mitch Mcconnell were baby steps towards each other. Not giant leaps. Not compromise tomorrow but baby steps. In that Mitch Mcconnell said as he said but maybe in a less emphatic way last week, were not ruling out witnesses and whereas before the reporting was that he didnt want witnesses, period because he had said internally that it was mutually assured destruction which we can get to in a second. Hes moving a little bit. Chuck schumer is not saying we have to agree on witnesses before we start a trial. Hes saying at a minimum, we want to have votes on witnesses. So you see where this is heading when it comes to a potential compromise. Whether theyre going to agree on the number of votes theyll have, who theyre going to vote on, thats where the rubber meets the road and what theyll have to deal with, the really hard stuff theyll have to deal with before this break before they start in skrn. In terms of public opinion, theres a reason the white house released these emails through the foia request on a friday news dump thinking nobody would talk about it and it would be buried. The least the democrat s could o is bring this to light as members of congress go home and maybe people move on and Start Talking less about impeachment, republicans and democrats are putting this front and center saying, look, there could still be a lot of information that we dont know thats not out there right now. And the white house is covering it up. And thats such an important point. Two things here. One, foia requests are why this is coming out. Your government is not responding. Its responding to lawsuits by journalistic and Good Government organizations. Dana bash giving us hope on Christmas Eve that maybe theres something im a giver, john avlon. I wouldnt go too far down that road, but i i was careful. I do think the hope is, its directly related to what bianna and you just said. Its because the more we learn about, i mean, Chuck Schumer, its not his first rodeo. Coming out and jumping on this email that said 91 minutes after the president hung up with the ukrainian president , the aid was held up. That makes it harder for Mitch Mcconnell, because it makes it harder for his senators who are going up before the voters in november in purple and sometimes blue states to say, no, im not going to try to get these people to come forward so we do learn. Mutual destruction works both ways. You have nancy pelosi with vulnerable democrats from moderate districts who dont want to have the impeachment cloud hanging over them for months to come. They had a vote and thought it passed. We shouldnt focus on schumer, mcconnell, pelosi mcconnell. The key may be schumer and pelosi talking to trump because peoples equities are not aligned here. And trump can deliver as many votes as he needs in the senate. If pelosi and schumer can find a way to get the president involved, their leverage goes way up. Hes given this eyebrow raising, interesting interview to new york magazine. The reporter olivia newtsy. They went and drank bloody marys. This was december 8th, the day he returned from ukraine. Everybody wanted to know what was he doing there this time around. She also asked him about his relationship with lev parnas and igor fruman. They look like miami people. I know a lot of miami people that look like that and are perfectly legitimate and act like them. Neither one of them has ever been convicted of a crime. Neither one. And generally thats my cutoff point. If you do it based on allegations and claims, well, youre not going to work with anybody he said laughing, particularly in business. Well, dana, no, theyve actually been charged with crimes. Theyve been charged with trying to with successfully illegally funneling money to u. S. Elections. Of course. Hes trying to explain why he got involved with them in the first place and just used the Giuliani Google translate which john avlon can as well. I know a lot of guys like that who are players who you can see on the scene wanting to get into the mix. But it doesnt make them criminals. But youre, obviously, right. Its completely different when they have been indicted for crimes. And reminder of where the name fraud garuaranty came from. Its because parnas was indicted and didnt want that to be the first thing that came up in a google search. He decides to name his Company Fraud guaranties but thats associated with a company and not necessarily his checkered past. Brilliant. I wouldnt go that far. I think the core thing to remember is the company was called fraud guaranty. You didnt mishear that at home. You have known Rudy Giuliani for many years, as have i. Theres a dark poetic irony about the fact that this article and interview came out almost 18 years to the day after he was named time magazines man of the year after leading the city of new york through 9 11. And theres a conversation in this interview about his legacy. And i want to read it to you. In it he says, he reads his own press and sees that his friends, these sources close to him are being weaponized by the conspirators, helping to paint a public portrait of a man unglued. These are concerned people who have told him to be careful with his legacy. And my attitude about legacy, rudy says is f it. Someone who spent a lot of time with politicians, usually theyre covetous of Something Like legacy. Whats going on in your eyes . Well, what we see here is him trying to reclaim his legacy as much as he says hes not. His trips to trip to ukraine, his insistence that everything that he is talking about, the conspiracy theories about joe and hunter biden are true is his attempt at vindication for his legacy. He says its for his client. You have to take him at his word that its about the president , but its also about Rudy Giuliani being remembered for getting it right. Whether hell get there, that is a very uncertain, i think, thats well, its unclear. I dont think hes going to get there with going down this road. Ill just say it. But the notion that hes not concerned with his legacy, you know, he did change when he got on the trump bandwagon. He went out there defending the president , defending the thencandidate in a way nobody else was, going further than anybody else was and it was a part of his personality that, john, youve probably known for years that he didnt put forward when he was americas mayor. Look. Id say that trump has an ability to bring people into his gravitational field. He certainly does think hes going to be vindicated but it reminds me of one of Ronald Reagans jokes about a boy who comes across a pile of manure and digs into it, there must be a pony in here. What they care about most when they are out of office is their relevance, and thats the key to whats going on with rudy. He cant stand not being in the middle of everything. Even at the risk of making a fool of himself, which hes doing. He is relevant again. On that note, you cant help but think about the article that came out that was written by Maggie Haberman just the day before and talked about the pivot pivotal, crucial role he played in the endorsement of bloomberg following Rudy Giuliani and now compare that to this train wreck of an interview. If you pause for one moment and read this ig report by horowitz, heres the fbi. They broke into President Trump at the time candidate Trumps Campaign spied on him and then covered it up. It is a modern day watergate. They broke into his campaign by bringing people into it. They have been trying to cover it up for the whole time. All right. Not so fast. Facts first. The justice departments own Inspector General report that mccarthy is referring to specifically debunks that Conspiracy Theory finding no evidence whatsoever of spying. But what does this tell us about the Republican Partys efforts to defend donald trump . Joining me now, cnn political commentators, former republican senator Rick Santorum and former republican congressman charlie dent. Two kings of the keystone state. Glad to have you both with us. Rick, i want to really reinforce this to folks. What the ig report specifically said about these allegations that mccarthy repeated that the fbi did not try to recruit members of the Trump Campaign as confidential human sources, did not send sources to collect information in Trump Campaign headquarters or Trump Campaign spaces. And did not ask them to join the Trump Campaign or otherwise attend campaignrelated events as part of the investigation. Nonetheless, in addition to the video you just saw of Kevin Mccarthy, he doubled down and tweeted the same thing. He tweeted this. The fbi broke into President Trumps campaign, spied on him and then tried to cover it up. This is a modern day watergate. Senator santorum, why is Kevin Mccarthy lying. I dont think he is. Yes he is, sir. Explain why he is. John, let me explain. What kevin is referring to is the fact that they were using they used fisa to get into carter pages and wiretap and get information and, of course, he was talking to people at the Trump Campaign on occasion. And thats, quote, breaking in, using a false i mean, if the ig report is clear about anything, its the abuse of the fisa system to get that wire on carter page which was then used to listen to people in the Trump Campaign. So its not direct, i agree with you. They did not directly go in and recruit people and they did not directly take wire people in the Trump Campaign, but they did use that wire from carter page to spy on the Trump Campaign. And thats what kevin is referring to. Thats what kevin is referring to. Okay. Lets put it in additional context for folks. Kevin mccarthy is directly repeating President Trumps talking points about the ig report before it was released. Right down to the worse than watergate line. Hes repeating what the president said before and after the report. When the report specifically says there was no spying. I take your point about fisa. There are reforms that need to be made but thats a thin read for see, i disagree with that. I dont think its a thin read at all. Look. I think in the end, this fisa issue and the issue of the fbi and the processes that were abused, and i think clearly for partisan purposes is going to be the bigger story come november than really . Worse than watergate . Worse than watergate, senator . I think youre going to see lots of indictments of fbi individuals for the role that they played in this. And i think that will be a huge story come november. Charlie dent, what say you . The ig look. The ig was pretty clear. He felt the russia investigation was justified and properly predicated. Theyre very clear about that. Theyre also clear there were problems with the fisa applications and surveillance warrants. No question about that. But look, as republicans, weve always been the party of law enforcement. We are the paefrty that defende the fisa process. Heaven forbid theres another terror attack and it will take forever to get a fisa attack. We better be very careful about how we go about attacking the fbi. Clearly they were justified in initiating that russia investigation. According to the ig, problems with the fisa. We ought to be clear about that. Theres a lot of spin going on here that really is unnecessary at a time like this. Charlie, i couldnt disagree more. I think this is a hugely serious issue thats being glossed over. I think youre going to see the durhams report and indictments are going to be shattering to a lot of people. And to get to the bottom line that you cant just wipe this off. Oh, they just made mistakes. No, these are seasoned professionals who lied to the fisa court in order to continue to investigate a campaign. Charlie, if someone who v volunteered for your campaign was suspected as being involved with russia and the fbi didnt come to you and tell you that someone potentially close in your orbit is involved and we need to look into them and they didnt tell you, youd be ticked off. Id be ticked off. This is just rogue in my opinion. Look, let me get in here because senator santorum, i want to remind folks the fbi director chris wray said this was specifically not spying. There are issues with the fisa process. Wed all agree. Theres a degree of moving the goal post to the Durham Report because some folks were invested in the mass indictments they nled would come out of the ag report that did not materialize. Theres christmas Silver Lining here because back in the day, there were a lot of folks on the left very upset about fisa and the process. A lot of republicans who supported the patriot act said they were just crying chicken little. Now maybe theres a Little Common ground between you and folks concerned about the fisa process . We assume the fbi is going to do what they should do which is theres no counterparty in a fisa application. Nobody there to argue on the other side so the court expects the fbi to present all the evidence thats exculpatory as well as those that support the warrant. And they didnt do that. And the question is, how often they dont do it. So, look, if you have people with bad motives at the fbi, they can abuse the fisa process. And thats why the fisa court took a remarkable step of condemning the fbi and saying you have to clean up your act. There was a point to the critics of the fisa process back in the day . No question about it. One thing i love having you on new day, its an example of the robust civil disagreements you can have from fellow republicans but from the same state. Thats the kind of civil disagreement were not seeing enough of in washington among the Republican Party, particularly around impeachment. But i want to read you a quote that one of your former colleagues dave trot gave to the New York Times to j. Martin and Maggie Haberman. Trump is emotionally, intellectually and psychologically unfit for office, and im sure a lot of republicans feel the same way. But if they say that, the social media barrage will be overwhelming. Do you think thats an accurate assessment of the way people talk behind closed doors . Yes, i do. I know dave trott well. I was in the meeting with dave trott when he made comments about the president s failed leadership on health care. I was there. Yes, members do say things like that about the president s unfitness intellectually and emotionally at times. Its very clear they say these things. So this is hardly shocking news to anyone. Many members are simply worried about their primary situation, and thats why they are stomaching what they are. And thats why they try to defend the indefensible or explaininexplicable. Senator santorum, do you think the role that social media is playing, the trolls and botts are intimidating folks into silence . I think thats happening. I think its happening within american politics generally. You just look at whats going on in the democratic primary and how many people just went way, way left because of the of what was happening on social media. Anybody that would stand up and say capitalism is good, youre a betrayer. So its happening on both sides, and, look, i would agree that there are members on the Republican Party who dont believe President Trump is competent to do this. But i dont think theres anywhere near the majority, and i think most people like the president because hes a fighter and theyre willing to put up with a lot of the crap to get someone who is willing to fight back. That includes john bolton. According to our next guest, bolton is dodging having to tell the truth about ukraine. Why . Joining us now is mark broombridge, a former Senior Policy Adviser to john bolton. Thank you very much for being here. We really appreciate getting your perspective as someone who has worked with ambassador bolton who had worked with him for so long and knows his thinking. Heres what you tweeted out about this. You said ambassador bolton, i was your handpicked Senior Adviser at state and the u. S. Mission to the u. N. You are dodging. The constant is what you know about ukraine. The variable is how you present that information. The only logical conclusion is that you are placing profits over patriotism to sell books. So is that what you think this is about . Do you think hes about thats what this cat and mouse game is about . It is. And that view was reinforced last friday which was a gamechanger. Keep in mind after ambassador bolton left the white house, hes been tightlipped, particularly about impeachment. Hes been speaking through his lawyer on and off. But on friday, he gave a remarkable interview with National Public radio. And he revealed two points that i think sort of tip the scale. First, he flat out and bluntly said, quote, i have a lot to say on the subject. That, by definition, implies he has information privy to the ukraine investigation and the impeachment process more broadly. But it was the second part of what he said during that interview which, to me, was most troubling which is that he said, well, he basically implied, i want to discuss what i have to say, but i cant do it at this point. That, obviously, begs the question of, if not now, then when . We are at a Crucial Point in american history. You could think that ambassador bolton would want the senate to have all of the information so that they can make a fully informed and productive decision. Keep in mind that 71 of americans and 64 of republicans support the notion that the senate should be allowed to call witnesses. Needless to say, ambassador bolton and chief of staff mulvaney would top that list. Ambassador boltons lawyers have said as much. Just to your point, they have said he knows a lot. Heres the statement. They said he was personally involved in many of the events, meetings and conversations about which you have already received testimony. As well as many relevant meetings and conversations that have not yet been discussed in the testimonies thus far. So that was his lawyer to house investigators. And, yet, he didnt show up for a deposition. So what about his argument, i think, his lawyers argument that he wants the court to compel him. Is that legitimate . Its smoke and mirrors. Dr. Fiona hill courageously testified, and i didnt see any erosion of separation of powers or executive privilege issues. In fact, one could make a strong counterargument that she helped reinforce or bolster the operation of powers by affording congress the opportunity to exercise its legitimate oversight responsibility. You have to go through a process of elimination here. Bolton knows the courts arent going to decide this one way or another prior to a senate trial. You can knock that off the list. Then you can also consider the fact that nothing is stopping him from writing an oped, giving a speech or appearing on a program like this to explain his views. That can essentially mean theres only one logical conclusion and forgive me for being snarky and blunt but hes stealing a page from omarosas playbook by arguing ive got something really important to say but youll have to wait and hear it. He could speak publicly right now. Hes choosing not do so. The only logical reason is hes teasing his book. There has been some speculation hes also the author of anonymous. Do you think thats him . I dont think theres any possibility that thats the case, no. Its not his style. Its not the way he would approach his criticism. For example, hes been sharply critical of the president on north korea, but has tried to separate that from his criticism of the president which is precisely what he did at the end of the Bush Administration. The last two years of the Bush Administration, he was in the private sector. He had no problems criticizing the Bush Administration on iran and north korea, just as hes doing with President Trump right now. But he still wants to be a player in gop politics. And he knows full well that if he goes after President Trump too personally, that would essentially ruin his opportunity or burn bridges with potential donors for his pac and superpac. Ambassador boilton wants to be player. If it later comes out he is anonymous, that would ruin his legacy forever. Of course, theres a strong argument hes on the wrong side of history right now and legacywise, by refusing to reveal what he knows. There you have it. Thats the rub. If you are saying he doesnt want to alienate republicans and republican donors, maybe thats why hes not speaking out. You are basically saying that he is choosing profits over patriotism. And that is correct. A harsh assessment of it. But what i hear you also saying is that hes trying to preserve his future in the Republican Party. Hes walking a tight rope. Its a delicate balancing act. He has no problems criticizing the president on north korea, justifiably because the bromance summit diplomacy we have with President Trump is clearly not working. But more broadly, ambassador bolton views himself as a champion, if you will, of a certain hawkish view of National Security. Hes worries that senator rand paul and his isolationist views are gaining traction with the president. Bolton feels its his ethical and moral responsibility to champion his views on foreign policy. And i certainly respect him for doing that, particularly when you see such abject failures in this administration such as on north korea. However, he is still going to be careful. He understands that he also has, at some point, an obligation to say what he wants to say. But theres still no logical explanation for why he would not want the senate to have as fully informed picture as they possibly could as they move into one of the most divisive and controversial issues in our nations history. But one democrat polling best in headtohead matchups against him. Here to break down the numbers, cnn politics Senior Writer and analyst ho, ho, ho, merry christmas. How are you, my friend . What you got for us . Lets see what i have in my gift basket. Okeydokie. This is the 2020 general election. Harrys average of the 2020 december live interview polls. All the democrats are leading trump but biden clearly has the largest lead at seven points. Thats running ahead of sanders only four points ahead of the president nationally speaking. And the favorability rating. Right. So this is lets get an idea of why biden is running the strongest. Like last time, in our cnn poll taken this month, all of the leading candidates, including the president have net negative favorability ratings. They have a higher unkafrable than favorable rating. What does that mean . What does that mean . Last time you recall clinton and trump had negative net favorability. The voters had an unfavorable view of both candidates. The president won that group by 17 points. Whats going on in this group . Biden, among those who have an unfavorable view, biden and trump is leading 729. Thats a 63point edge. Thats significantly larger than the lead that sanders has over trump among those who have an unfavorable view of sanders and trump. His lead only 41 Percentage Points. Warrens lead only 40 Percentage Points so biden, that 63point lead under those who have an unfavorable view of both is a big, big deal. The margin trump won by actually seems to have come or can be attributed to folks who walked into the ballot booth saying i dont like Hillary Clinton or donald trump. Donald trump won them handily. It seems the Trump Campaign strategy is to drive down everyones negatives, especially joe biden. That might account for their ukraine strategy. That is why this group is so important and bidens overwhelming edge with them is the reason he has a general election edge over the other democrats. They only hate biden a little bit. Okay. That should be his new motto. Youre saying theres a chance. Another key reason biden is up versus the other democrats doing better. This is among dem and democratic leaning voters. Liberals arent liking biden too much in the primary but hes winning by 88 points in the general election over trump. Thats close to sanders 91 percentage point lead. Moderates to conservatives who love biden in the primary. Hes doing significantly better in the general election than sanders, warren or buttigieg. Hes winning them by 83 points. Sanders only beating trump by 72 points. So he is holding on to that base and those liberals in the primary who dont like him are coming home in the general election. Sanders warren could scare off moderate voters and cause them to vote for trump . Thats exactly what this is saying. Tell us about women. So this im not sure harry is i go to harry for all my advice im not touching that one. But general election. White women without a college degree. This is such a key group. Trump won those over clinton by 23 Percentage Points. Look at these margins in our last cnn poll. Biden is losing them but only by 9 Percentage Points. He cuts that deficit by more than half. The other democrats dont cut those deficits by nearly as much 17 to 18 points. Keep on trucking. Why is that group so important .
