The next steps in their investigations. That comes as theres a lot of heat on nancy pelosi to begin the impeachment proceedings. The impeachment process is going to be inevitable. Its just a question of when, not if. Reporter more than two dozen House Democrats are now calling for the House Speaker to begin impeachment proceedings. You know, i think the case gets stronger the more they stonewall the congress. Reporter but nancy pelosi is still not convinced, standing by her cautious approach, even after a heated meeting with democratic leadership behind closed doors on monday. Are you under pressure to impeach the president . No. From your caucus . No. Reporter pelosi believes impeaching the president should be an evidencebased bipartisan decision. A growing number of democratic lawmakers disagree, saying the stonewalling from the white house leaves them no choice. It would be terrible if the fact of protecting the constitution by starting an impeachment inquiry somehow led to, you know, him being able to defy the law even more. And of course thats a real fear. But you cant let Political Considerations get in the way of your duty and the truth. Reporter meantime, the House Judiciary Committee issuing two new subpoenas to former White House Communications director hope hicks and the former white house counsels chief of staff annie donaldson. Hicks speaking to special Counsel Robert Mueller about key conversations with President Trump, including emails donald trump jr. Sent to set up the june 16th meeting at trump tower. And donaldson, whose detailed notes are cited throughout the mueller report. Yet, theres growing uncertainty if mueller will testify in public. A source telling cnn mueller does not want to appear political after staying silent about his twoyearlong investigation. All of this comes as the Washington Post obtains an irs confidential draft memo that directly contradicts the trump administrations refusal to hand over President Trumps tax returns to lawmakers. The tenpage document says the agency must provide congress with trumps tax returns unless he opts to assert executive privilege. Mr. Trump has not done so. Treasury secretary Steve Mnuchin instead blocking the request, arguing it, quote, lacks a legitimate legislative purpose. So lauren, at this point what is the next step in the fight over the president s tax returns . Reporter when ive spoke within the chairman of the house ways and Means Committee, he says theres just one way forward and that is going to court. But there are some members on the house ways and Means Committee who believe they should exhaust more of their congressional power, and that includes holding the treasury secretary and the irs commissioner in contempt of congress. Thats something that richard neil has said is not necessary. His plan to move this fight to the courts, he wants to move on. He has a lot of other priorities he wants to get through, including infrastructure, something hes been talking about for several months now. He wants to get this fight, this partisan fight off of his plate so he can move on to some of the priorities of the ways and Means Committee. Lauren fox with the latest this morning. Thank you. All right. This morning were learning of an intriguing meeting behind closed doors that took place in relative secret. Former secretary of state Rex Tillerson, who had more than his share of issues with the president , sat down with the top democrat and republican in the House Foreign Affairs committee for several hours. Cnns joe johns live at the white house for us on what this meeting was all about. Reporter well, john, whats striking about this meeting is while the president and the legal apparatus here at the white house is spending so much time trying to stonewall the democratically controlled house of representatives on the information theyre seeking, the president s former secretary of state literally slips in the back door and spends hours on end having a conversation with Elliott Engle and michael mccaul, the chairman and Ranking Member of the committee. What they talked about, among other things, russia and the relationship between the president s soninlaw Jared Kushner to United States foreign policy. Apparently they did have quite a lot to talk about. It went on, were told, for about seven hours. Were also told members of the committee were somewhat surprised to hear about this actually happening. Now the question will be what all did Rex Tillerson talk to these people about, simply because he had, at times, a stormy relationship with the president while he was serving as secretary of state. Yeah, im interested to find out what were the topics of discussion. Another interesting moment on capitol hill yesterday, joe, ben carson, whos the secretary of housing and urban development, was asked questions about housing. It had some real problems. What went on here . Reporter yeah, well, this was a question that was raised by congresswoman katy porter. Shes a former law professor. She asked carson, whos the secretary of housing and urban development, about things that are referred to as reos. These are acronyms for real estate owned, which is how you describe a property thats gone into foreclosure and reverted back to the lender. The secretary of housing apparently misunderstood the question. Listen. Id also like you to get back to me, if you dont mind, to explain the disparity in reo rates. Do you know what reaso is . Flash floods continue to grip the midwest. Folks in the region also reeling from at least 30 reported tornadoes on tuesday. Its been a rough couple of days here in the central part of the country, and even though the rain has stopped for a good 24 hours, the threat of the flooding is still a concern. One person died last night in oklahoma after driving around a road barricade, getting stuck in flood waters, and drowned. I spent 36 years here. Its probably as bad a flood as ive ever seen. Reporter historic flooding sweeps through the central United States, prompting dozens of water rescues over the past two days. Its scary. Scary, especially when you got grand babies. When are they going to get here . You hear the choppers and youre like, come on. But i just want to go. Reporter vicious weather has dumped heavy rain on to the area along with 30 preliminary reports of tornadoes on tuesday. Oh, my gosh. Theres a storm chaser. Reporter some in texas were caught in the middle of a hailstorm, pelted with chunks of ice, some the size of baseballs. Others grateful they were able to survive the twisters and floods that followed. I was freaking out. I am still freaking out. It was a nightmare. I was worried about my daughter and my best friend and her kids. Reporter rescuers in oklahoma worked around the clock to save stranded locals from the raging waters, like this woman who grabbed a branch, hoping desperately not to be swept away. After some time, rescuers were finally able to pull her to safety. Or this man, who had been clinging to a fence post for more than five hours before a passerby was able to call emergency crews to save him. At least 200 people in hominy, oklahoma, had to be evacuated because of rising flood waters. As long as its raining, as long as we see flooding on this end of town like weve never seen before, well be out here all night getting people out of these houses. Reporter roads turned into rivers, people stranded on top of cars. This home in edmond, oklahoma, now an island. The first floor was almost completely under water. Others found themselves without homes anymore. I texted brandon like, im going to have to swim in the house. Hes like, what do you mean . I was like, open the front door. Reporter most of the flood waters here in the central oklahoma area that weve seen really started to recede, but many First Responders will tell you that you still need to be very cautious. They say that as flood waters recede from most areas, it does tend to rise in other areas as the water makes its way back into the creeks where it belongs. And that can cause problems in certain lowlying areas. So they still caution people to be extremely careful. Dont drive through standing water, as you well know. He also had another big moment when it came to abortion, laying out his policy for that, saying he wants women to have access legal and safe abortions, wants to get rid of the hyde amendment. Not only did the question in the audience get a lot of applause, but so did his answer. Of course, hes from el paso, texas. So you should also expect him to talk immigration. Thats something he really, really is passionate about. You can really tell that that means a lot to him when hes talking to people in the crowd, be it in texas or here in iowa. Lawmakers in congress divided after a briefing on the threat iran poses. Irans foreign minister tells cnn he has no interest in speaking with President Trump unless President Trump shows respect. Cnns Nic Robertson joins us from abu dhabi with more. Reporter yeah, what we heard from the secretary of state before he went into those briefings, he said it was too soon to say what definitive role iran had played in the latest rise in tensions here, but he did say those attacks on shipping just off the coast of the emirates here was quite likely iranian involved somehow. We heard from the acting secretary of defense also say that right now iran is the threat. That threat is being managed. Republicans, when they came out of that briefing, mostly the takeaway seemed to be that iran, they understood that iran had been responsible not for the attack on those vessels but for an attack on an old pipeline in saudi arabia and for an attack in the green zone in baghdad. Democrats critical of what they heard, saying they believe there wasnt sort of interdepartmental thinking and strategy about how to get iran to the place the United States wants to get them to in terms of talks. Two u. S. Officials giving us insight into how this current rise in tensions with iran began. The u. S. Base just a few miles north of baghdad in april came under a rocket attack, but the concern was this was from an iranianbacked group, and this group was using a drone to overfly the base at the same time. That drone would give more precise details, a more aggressive attack, if you will, because they were using complex technologies to more precisely attack the u. S. Base. Joining us now, congressional reporter for the Washington Post. And joe laockhart, former clintn White House Press secretary. Rachel, i promised our viewers you would have breaking news. Youve been at the leading edge of the reporting on this ground swell inside the Democratic Party for impeachment. Where is it this morning as they head into this 9 00 meeting . You know, i got a bunch of texts from lawmakers last night who are greatly anticipating this meeting and think its going to be rather ugly. This is going to be pelosi trying to tamp down these members who are increasingly calling for impeachment. The reality is, you know, you have two does whon hazen who hat in the past 48 hours who say its time to begin an impeachment inquiry on the president , but there are a lot of people who privately support this as well and havent come out publicly. I think were going to see these impeachment cheerleaders press pelosi. Shes going to do you are utmost to argue back at them that, look, the courts are coming to our rescue. We got a good court ruling earlier this week that bodes well for our additional subpoenas. But its going to be potentially ugly. She potentially will have to give some ground to some of these people. I dont expect anything on impeachment. I dont expect her to embrace it coming out of this. I think maybe well see her green light some of these other hard line tactics these folks have been pushing for, say finding Trump Officials who are ignoring these subpoenas. And that list is growing longer and longer every day. It is th. It is this delicate dance. Its a balance being taken into account. Yeah, i think a lot of the members who have called for impeachment, and i dont mean it pejoratively, but theyre in the debate every day. Nancy pelosi is interested in two groups. One is the rest of the democrats out there, the democratic voters who remember in 2018 didnt bring her back to the speakership because of mueller. They brought her back because of issues like health care. It was a very focused, disciplined campaign. Shes got that in her head. The other thing is if you look at the list of the 24, the most vocal people are people in safe seats, people who are going to win no matter what. 85 , you know, theyre going to get. What pelosi as the speaker is most concerned about is those vulnerable democrats. The democrats who came in and won on saying, im not going to were not going to do the washington, you know, political game. Were going to do Kitchen Table issues. So i think she is. It is a very delicate balance. I think she is overall, her strategy is she doesnt think impeachment right now is a winner, but shes going to allow this to move to a place where if they do need to impeach, the country will see much more information before they make that decision and see that the president gave them no choice. This is going to be a victim contest of whos going to get cast in the role of the victim. The president wants to be the victim, but i think what Speaker Pelosi wants to do is say, i didnt want to do this, but mr. President , you gave us no choice. Were going to have the number three house democrat, the House Majority whip. Its his job to count votes. Hes on at 8 00 here. The very first question ill ask him, if hes watching, is whats your vote count right now on impeachment . Its his job to know. Im fascinated if he thinks the number is higher than 24. Margaret, i want to shift gears. Robert mueller, the special counsel, is apparently reticent to testify in public before the house because hes concerned about it seeming too political. Is this something you think he can avoid, or where do you think this debate is going . I have to say, that plays into what will happen on capitol hill today, this discussion inside the democratic caucus. I mean, john, i think his considerations are a little bit different than President Trump and his advisory teams considerations are, but you can understand why mueller feels that way certainly. If you look at polling, and im not saying hes poll driven, but if you look at polling, its really striking to see the broad swath of americans who believe he has credibility, who believe that mueller handled this well. Somewhere between twothirds and threequarters. Thats a number that grew over time. So the longer that he worked the way he did behind the scenes and without leaking information, the longer he proceeded with his probe, the more his credibility grew. And he wants to be able to maintain that sense of integrity, but i dont think hes in the business of defying congress in the same way that the president s current political playbook is proceeding. My sense is this is much more a negotiation about how he would provide a response to congress or how he would work with lawmakers than about if. I think theres a separate question, which is how would the white house and Justice Department handle those inquiries . So far weve seen the attorney general say that it would be up to mueller, but when it gets down to brass tacks, i think well see. This kind of meshes with the way Nancy Pelosis considerations with impeachment on the president s side are going because to a large extent, she is urging her members to rely on the courts to take action. From the president s perspective, hes put all his eggs in this basket in the idea that either the courts are going to side with him or at least its going to take the courts a long time to decide. Again, for mueller, hes not interested in Court Challenges and turning this into a drama. In fact, i think his inclination is just to try to avoid the drama as much as possible. But when the courts start kicking back responses, thats also going to help channel how all of this works and peoples obligations to show up, whether its in a public setting or behind closed doors to answer congress questions. I have two quick thoughts on mueller, if i can jump in real quickly. The first one is jo, you know, has made it clear to house judiciary staff is he doesnt want to be seen as a political football. But you have to ask yourself, at what point does he have an obligation . He has done this nearly twoyearlong investigation. Its not just democrats who want to hear from him. Republicans on the hill have also called for him to come in. A lot of people, because of his credibility, want to hear from him around the country. The other thing i would say is watch the hill for another subpoena. A big question i have right now is are hill democrats willing to subpoena him to appear in public . They have sort of treated him with kid gloves for the past few weeks, hoping to work with him to get him in to have him appear publicly, but if hes not willing to do that, do they take a harder line against him . Again, hes somebody they want to be a star witness for their party, and its just going to be interesting to see if the talks break down and things get contentious. We also want to get your take on this from the Washington Post. This memo, this confidential memo that was written specifically in the fall about how to deal with requests, right, for tax returns, which found that, in fact, there wasnt much that should stand in the way, that they need to be turned over, except in the case of executive privilege. Whats fascinating to me is this memo goes on to say that even when it comes to executive privilege, the law might be read to procollude a claim of executive privilege, meaning it could be interpreted as saying this cannot be invoked to deny a subpoena. This is quite the little bit of information were getting, especially based on the reaction we saw, of course, from Steve Mnuchin. This is a little bit of a gift for nancy pelosi this morning to bring all of this together. The courts are saying now twice this week well, one court is saying on his personal finances, and this memo is saying that the argument the administration is making is nonsense. Its not legally weak. Its not debatable. Its nonsense. Its not based in the law. So i think shell be able to go in and say, look at these two things. You know, have some patience. Were going to win this. If i can just say one quick thing on mueller, mueller will testify. You know, i hate to be cliche, but hes a marine. He takes his obligations seriously. I remember he did some work for the nfl. I remember we went to him and said, we want you to talk about it. He said, ill get on the phone once. Ill give you 30 minutes, and i never want to talk about this again. But i did this report. I need to defend it. Well see him up there. Thats important history to keep in mind. Margaret, on the tax story, the Washington Post, which broke it, they quoted from this memo, and it was coming from inside the building. This is the irs counsel or a lawyer within who wrote this. The disclosure of tax returns to the committee is mandatory, requiring the secretary to disclose returns and return information requested by the tax writing chairs. So its not just that it was from inside the building. This was buried for months and months. Somehow the Justice Department under william barr and the current irs leaders chose not to look at it when they were stiff arming congress on this request. Right, draft memo being the keyword, asterisk. Look, there are always, to some extent, internal divisions. But i think its instructive this memo is being leaked or getting out there at this time. It again shows the importance ultimately of the courts in deciding these issues when the internal decision inside the administration was to set this recommendation or this analysis aside and move forward. Again, all of these decisions now the pressure is going to be on the courts to resolve them. Well see whether the trump administration, you know, immediately follows Court Instruction or whether they press for appeals up the chain. Margaret, rachel, joe, thank you very much. Thanks. And theres something obvious here. If youre losing more than half the vote before it even starts, youre in trouble. Thats exactly right. Look at these. There are a number of candidates who might be up on this list to win reelection, but they were all below 40 in terms of people who said theyd vote against him. Hes already so far high up. And this, i think, is also kind of key. This is another key facet. Remember weve spoken about this. In 2016, the reason donald trump won was because of this group of voters, those who had a favorable view of both Hillary Clinton and donald trump. He won that group by 17. If trump is going to win, hes going to have to make this a choice between him and the democratic nominee.
