Pressure growing for special Counsel Robert Mueller to break his silence. Democratic lawmakers ramping up their demands to have him testify. Were going to move on as well to make sure we secure the testimony of Robert Mueller. While they wait, the white house filling the void. Lashing out at mueller and his team. In a letter to attorney general william barr, Top White House lawyer emmet flood slamming mueller for not making a determination on whether President Trump obstructed justice saying, quote, the one thing the special counsels office was obligated to do was the very thing the special counsels office intentionally and unapologetically refused to do. Mueller citing Justice Department guidelines that a sitting president cant be charged. Instead, laying out ten episodes of possible obstruction by the president leaving it to congress to decide what happens next. The letter also accusing the special counsels team of bias, writing the team, quote, failed in their duty to act as prosecutors and only as prosecutors. This is very, very serious. Reporter meanwhile House Speaker nancy pelosi taking aim at the attorney general. He lied to congress. He lied to congress. If anybody else did that, it would be considered a crime. The New York Times reports pelosi called barr a lapdog for trump and enabler of obstruction. On capitol hill, house judiciary chairman jerry nadler threatening to hold the a. G. In contempt of congress for not releasing the unredacted Mueller Report. Mr. Barrs moment of accountability will come soon enough. I have had him testifying already for 30 hours. Is the answer no . I dont think i can let him and tell everybody else they cant. Especially him because he was a counsel. I understand they have lots of questions because they saw ample evidence of obstruction in the Mueller Report. Obviously democrats feel they need answers but it is all in the Mueller Report. They know he threatened to quit because he thought he was being asked to commit crimes. How does him going before Congress Change anything . There are two points. What we know from the Mueller Report, we know a lot about don mcgahn. There could be other conversations and pieces, things that congress would be interested in. We have only seen the summary report. The second thing is there is no question the mcgahn obstruction piece is one of the strongest parts of the Mueller Report. What congress has done is focused in on one of the place where is it appears the president took action to obstruct justice to what end . Right. So the interesting question is this is an impeachment. Thats the question i think is the fair question of should they be doing this through another form to litigate the obstruction question if you look at the Mueller Report, what Robert Mueller says don mcgahn says is the president told him to fire Robert Mueller and create a fake paper trail. That sounds like obstruction of justice. William barr says it didnt happen that way. The only jury that matters in this is the u. S. Congress. So the u. S. Congress wants to get don mcgahns version to crossexamine mcgahn on whats in the Mueller Report after bill barr now. Thats why it could change. My question is once they say no and you heard the president. The most significant thing is the president told us hes not going to let don mcgahn testify and emmet flood wrote a fivepage letter to say we are not going to let don mcgahn testify. Joe, once that happens, once they stiffarm congress, whats Congress Going to do about it . Let me answer both questions. Fantastic. Thank you. I think it was a political question. They want to animate the Mueller Report. People havent read it. Lets not pretend everyone has gone through it in america, potential voters will be deciding on whether he should be reelected or not. This is to animate it. On the letter they have expre expressed their view that don mcgahn should not testify. Theyll take the steps they believe they have. Don mcgahn doesnt work at the white house anymore. Don mcgahn is subject to contempt. He is a lawyer in Good Standing who might put that Good Standing at risk if he doesnt. Don mcgahn has been called a liar by the president. He may have reason. I wouldnt expect him to go willingly, but my prediction is that hell say if you subpoena me, i will show up. Yes. My point, john, and im sorry if i sound like they have broken my spirit. Thats what it sounds like. Thats the goal. Its worked. I think i am channelling many members of the American Public who feel the past two years have been disheartening for people who believe in justice. The reason i say that is because you see in the Mueller Report ample evidence laid out of obstruction of what Robert Mueller considered obstruction, but nothing happens. You see violations of the emoluments clause and nothing happens. Nepotism emoluments is Going Forward in the courts. There is a feeling of exhaustion. We know it from polls, from voters turning away after the Mueller Report that they think congress will continue and there will be more legalese and nuance. Im not sure to what end. To the end of checks and balances and a functioning democratic republic. You and your details. You cant just say this movie is exhausting and boring. Im going to turn the channel. Its not a reality show. This is real life. Never boring. There are questioning about congressional theory. What hill to fight and die on. Was nadler focused on the outside counsel or inside counsel asking barr questions that created a standoff yesterday. Mcgahn is obviously a key witness in getting more information. Obviously joe is right about the optics and well. Bob mueller is really the testimony everyone will be watching to get clarity on the report. Barr, we know, is an unreliable narrator, to put it mildly. The focus should be on the ongoing house investigations into, for example, trump finances and potential connections with russians and allegations of Money Laundering which they have said theyll pursue which the Mueller Report apparently did not. Open questions about which florida county was hacked by the russians. Cambridge analytica. If Robert Mueller laid out ten cases where he thinks there is evidence of obstruction of justice why shouldnt congress, the only body and everyone seems to agree now, the only body that can do anything or has oversight over it. Why shouldnt they get involved . People generally like an outcome. Who . All americans. The constitution says congress is the one that gets to decide. Why shouldnt they hear from someone who was in they should. Of course. John, you were saying they should focus on finances and other things. If there is evidence of obstruction if the Mueller Report lays out the road map thats loaded here but lays out the evidence of obstruction, shouldnt they ask questions . They should. But the other investigations are a better use of time. There are significant Unanswered Questions that need to be answered it appears the mueller team didnt look at that go to the heart of why, for example, outside of questions of collusion, President Trump has an odd obsession with vladimir putin. They are getting in the way of financial records being released. They are panicked. This isnt principle this is a false choice. Impeachment is the last step. We are in the first couple of steps. The only way democrats should bring impeachment is if they have some reason to believe there is a bipartisan support for it. The way to get bipartisan support for it, just go back to 1974. Republicans were supporting nixon. They were all behind him. Then the tapes came out and they were not behind him anymore. Thats why he resigned. This is a process. It is probably boring to a lot of americans, but it is an important part of the process. At the end of the day if they dont, through the series of hearings, build bipartisan support, i suspect theyll wait for the ballot box. Also relevant to the next year. I want to take issue never boring. Well, i want to take issue with something joe has said. Joe said don mcgahn might be forced to testify. It would look bad if hes held in contempt. I see no evidence that anyone cares about being held in contempt of congress now. It has no teeth this is a huge problem. What they could do, there is not going to be a prosecution if someone is held in contempt. If don mcgahn said im not showing up, they bring it to the house. They hold him in criminal contempt. He wont be held in contempt. The civil route can take three years. In some ways they are running down the clock. One thing about mcgahn thats different is the white house and the administration controls people in the executive branch. Don mcgahn is out. Hell want to come in. Congress is saying to him, we want you to come in. If he fegets a subpoena, mcgahn will honor it his reputation is on the line as a straight shooter. Thats incentive to go one step forward and i agree, he wont be the person to resist. If he says im willing to go with a subpoena, the white house has to come and try to block him. They have to start the Court Process thats what they are telling us they are going to do. All that back and forth. We have many more questions for you all right. You good . Yeah. I mean, sort of. I think we have to find a way to explain what you did of why they want to go back through this. First you say is there anything here, whats happening, we got this information. Lets see if we can make the first cut of corroborating it its called investigating. Thats the word. What does bill barr think the fbi does when they find out that somebody might have been turned into a russian stooge. What does he want the fbi to do with that information . If anything, this is a minimal first step to send somebody out and say, hey, whats going on, and ask the question. Look, this fits the definition of spying to most humans at home. Somebody went out and spoke to this person under false pretenses for information and they were in a trench coat. Basically. Im not getting beyond the trench coat. Lets pull back for a second. This was an inquiry kept under wraps at a time when everybody knew about the investigations into hillary clinton. There was an effort to really hide the fact that the fbi was looking into allegations of russian influence in the election because it could have hurt Donald Trumps prospects in the election. Thats the first thing. Second thing, the thing they were looking into saying the russians had dirt on hillary clinton, emails they were going to release happened. That happened. Lets not forget those things in light of this is new information, significant, sheds light on bill barrs testimony but dont ignore the Bigger Picture why does the fbi having to defend themselves for doing their job . Bill barr is part of a political operation. Hes the president s personal defense attorney here. Hes trying to muddy the waters. Hes trying to do what rudy giuliani, sean hannity and other crazies have been doing which is to say its not about the crimes committed. Its about how the people found the crimes. Its not new. The other thing on being involved in a campaign, there are a lot of public corruption and ann thankfully i hope she wouldnt contradict me. In public corruption they dont say, hi, im with the government, are you doing anything wrong . They send somebody in. Is that spying . Of course not. You asked the question before, what were you supposed to do . What does bill barr think is supposed to happen when someone says he was asked this in the hearing and there was a pregnant pause. He didnt come forward and say you go tell the fbi when a foreign country is going to explae investigate a campaign on hacked emails important for the 2020 election. This moment is real especially because the door is now open to additional influence operations and questions of whether it is legit. Joe worked on a lot of campaigns. 18 individuals, over 120 contacts with the russians isnt typical best practice for a president ial campaign. More people than they met from entire states. Thats a lot of smoke worthy of investigation if youre the fbi. The email dump did occur you did say most americans would consider this spying. Barr knows it and is craftily choosing the words and timing. It is a good word. A catchall word that gets your attention its part of the effort to misrepresent the entire thing his own department embarked on it and spent the last three years looking into various elements of a counterintelligence obstruction of justice. Lets bring in former White House Press secretary under president clinton, joe lockhart. Listen, joe. In this day and age in the Trump White House with Sarah Sanders, these were often combative, fact challenged affairs right. What good are they . Well, i think the purpose of the briefing is for the president to get his agenda out. Whatever he believes. But for the public to see that the president is accountable on a daily basis. Even if the answers are fact challenged, the public has the ability to say, oh, boy, they are relying on that. There must be more there. Oh, boy, she seemed aggressive on that. Maybe they have a good point. Its not in the constitution. There is a norm that says the president should be held accountable and the way we do it in this country is through a briefing i have to tell you. You used what i think is the most important word of the month which is norm yeah. The one thing the Trump Administration has done is bust norms. You realize how much of our country is based on actual law and rules and how much is based on norms. A lot of it is norms. Theyre saying, you know, we dont want to play by the rules, but there is no consequence well, right now there is no consequence. Hes still president. Hes told 10,000 lies and hes still president. He is a president who has an economy thats doing well and he cant break 40 of job approval. It defends on how you define consequences. Hes an unpopular president who cant get much through congress. Even if he had an idea it would be a problem to get it through. He doesnt have any leverage with democrats in congress. Youre right about the norms. There used to be a high price to pay for lying from the white house. It would be a story for weeks from president bush, president clinton or president obama said something that was a whopper. President obama was the most scandalfree white house ever. His thing about keeping your plan, we heard about it for years it was Cottage Industry on fox. Now we blow by it. Trump has accused democrats, doctors, mothers, of swaddling babies and having a discussion on whether to kill them or not. Its unheard of that the norm would allow that look, you are voting for transparency which everybody wants transparency. The Trump Administration says they want it. But the feeling of people watching the press briefings was that Sarah Sanders or whoever in the role was there to protect the president , there to parrot what the president said whether or not it was factual. I think there was a feeling of frustration that maybe they werent getting to the bottom of real information there is always a feeling of frustration on all sides in the Briefing Room. It is a battle. You are trying to a good press secretary promotes the agenda of the president , tries to put things in the best light and sticks to the truth. There are days when you have to say, you know, you got us on this one. Lets take our medicine, move on tomorrow or the next day. They have not done it you did press briefings during impeachment . Every day during impeachment. One of the reasons why i think the white house is missing something here is we did press briefings during impeachment. The strategy was we are not focused on impeachment. We are focused on the peoples business. I talked about the peoples business and every day people reported on it. They saw it. They saw a president who was not selfpitying. They saw a president who was not rage tweeting. Thank god we didnt have twitter. It was very useful for us. Thats a good point. The economy is doing well. It would behoove them if they wanted the message out for Sarah Sanders to come out every day and trumpet that. She should.
