And finally the Washington Post reporting this morning the president s phone calls with foreign leaders, quote, an anxietyridden event for his staff. So far the Seasons Change nothing and they blame democrats saying theyre not doing anything, but this really shows this investigation is ramping up on capitol hill. These subpoenas come after a letter came from three committees conducting the investigation sent to Vice President pence, requesting more documents from him, saying they have interest in any role he might have had in any communications or messages to ukraine. I do want to know one thing here. Before they even issued the subpoena, the white house was considering sending out a note sending a note to Speaker Pelosi that said that they didnt have to comply with this investigation because it wasnt a real impeachment investigation, citing the fact there hadnt been a house vote yet. Theyll keep their eyes out for that. They say it could come as early as monday. As you said, President Trump is doubling down. Hes calling the investigation a witch hunt and hes blaming democrats. You know better than anybody. For the last three years, democrats, lawmakers, theyre deep state cronies. Secretary of state mike pompeo missed the deadline for a House Democrat subpoena for the phone calls between President Trump and zelensky. This is the third time hes blown through. They started seeking these documents september 9th. Democrats wanted conversations related to the phone call between trump and zelensky but also related to the president s decision to suspend military aid to ukraine around the time that phone call took place. House democrats said they would consider it obstruction under their impeachment inquiry if they did not comply with the subpoena, but pompeo issued a defiant response earlier this week saying he did not agree with the conditions they laid out under the subpoena including the fact they didnt want state house lawyers accompanying them to the committee because they wanted to get the most candid testimony possible. Pompeo argued the state departments interest might not be protected if that were the case. But they call it a stonewalling over requests ten months into the investigation. But again democrats said they will consider any stone walling obstruction under their inquiry, and that could be included if any articles of impeachment were to be filed in the future. What can they do if the white house delay this and it winds up in court . Ultimately, boris, i think the court is going to have to determine whether the white house or secretary of state have to comply with these subpoenas. This issue normally does not go before a court this early in the subpoena process before the house has oh fijally voted to have an impeachment inquiry. I understand their positions. Look, were not going to file until you officially declare an impeachment process. I could see a judge requiring something formal before he forces those subpoenas that have been served on the white house and the secretary of state. Page, to be clear and to followup on that, theres no legal requirement necessarily for democrats, House Speaker nancy pelosi to hold this vote on the floor of the house, but you think a judge might necessarily make that the case, might require that. Right. I do, boris. Theres nothing in the constitution. Theres nothing in federal law that says you have to hold an impeachment inquiry before you issue subpoenas. Congress does that all the time without having an official vote. But if you have to go to court to enforce these subpoenas, thats not an unusual thing. Judges in the past have said, look, im going to allow congress a lot more latitude if theyre in the middle of an impeachment inquiry, and it would be so much easier if congress were to step forward and say thats what were doing here, thats why these subpoenas are especially important, thats why we need them enforced. Errol, to you, from the white house perspective, were hearing the impeachment inquiry is being led by two people Jared Kushner and he acting chief of staff, mick mulvaney. Do you think thats a sign they dont take it as sear yuzly as they did the Mueller Probe or they brought in a slew of attorneys . I think it is a sign. Seriously in a political sense, not necessarily a legal sense. The Mueller Probe was all about trying to withhold documents and slow the process down and so forth. Were in an odd position because normally youll get whistleblower documents and subpoenas and its supposed to lead up to a smoking gun. In this case the president himself is not only describing the conversations, but hes defending them and making them more public. To a certain extent congress is filling in the blanks and trying to figure out to what extent others were involved. What was the role of the secretary of state and Vice President and all of that. The underlying, the most explosive or impeachable facts are not in dispute here, which is a little unusual. Errol, i want to stay with you with regard to this second whistleblower. A second official with more information about trumps attempts to sway the ukrainian leadership, what do you make of that . Here again, were kind of filling in the outlines of a picture that the president has already drawn. It sounds as though the second possible whistleblower would be more credible, would have more information, might name more names and more fully complete the picture of how all of this went about. Whats interesting, boris, its the reaction in some ways thats almost the most important part of this, the fact that career officials were alarmed, startled, were led to try to memorialize and inform others about what they consider to be improper and possibly criminal conduct. Over and over were seeing it. Were seeing referrals to the justice department, whistleblower complaints, apparently furtive actions by the white house to try to cover up some of this stuff. Clearly something is wrong and the second whistleblower might further explain that to us. Page, the white house, the administration can try to stonewall when it comes to providing documents to congress, but having a second whistleblower having a whistleblower in general, its tougher for the president to try to stop them from providing nvgs right . Thats true. And i understand the attorney generals rationale, the first was corroborated. They confirm he had two stents placed in an artery to combat a blockage but also said he was diagnosed with a mild cardial infargs, which is the clinical term for a heart attack. Now, inside the campaign i was told there was no real deliberation as to whether or not he would continue his run for president. Some testiof the heart tissue actually dies and then they call it a heart attack as opposed to anything else. The campaign was doing what its supposed to do, put the best face on it. On the other hand theres some news theyre not going to be able to cover up or spin. You know, according to the american heart association, theres a 20 after youve had a heart attack of having a second one over a fiveyear period. These are questions theyre going to have to ask. I think it makes it less likely that they can avoid questions like, you know, what kind of prescription medicine has your doctor recommended . Is it statins . Is it beta blockers . Whats your exercise regimen going to be . All of those are going to be relevant questions. Possibly relevant to fell low candidates. We know the primary debate is coming up october 15th. Sanders promises hes going to be there. How likely is it some of the younger candidates are going to pick this up . I think theyre going to tread very carefully around this question because this is a country where many, many people revere our elders, right, and his experience and his time on the campaign trail has really drawn a lot of people to him and Bernie Sanders cannot and should not be dismissed out of hand simply because he had a medical issue. If he had fallen down skiing or Something Like that, i dont think anybody would say, well, you cant be president. I think people are going to be very careful about that. On the other hand, hes going to have to be careful and not dismiss it as something thats completely irrelevant. Again, you look out over the horizon. If he does manage to win the election next year, there will be four years after that, and he would by far be the oldest president weve ever elected. He might spin this. Shortly after he was released from the hospital he was fortunate to have good health care. Look at the tweet he sent out. He rides no one should fear going bankrupt when a medical emergency oh curse.
