It is not that the federal judge said the federal government can never take back this money. What the judge said if they want to take back the money, congress has to authorize it. It cannot be the executive branch saying we will take this money for not complaining. Congress funds things . Correct. Congress makes the law when you can withdraw that money. According to judge orrick, he said that doing this without congressional authorization is unlawful. Two ironies we saw. We will get into how trump is treating the judiciary and if that is right or wrong. The legal basis you cannot mess with the money comes from the case against sebelius on obamacare. That president obama was messing what which states to get which money. That goes back to that. It was republican states that were saying, you attach too many strings to federal funding. That is coming back. Separate issue. The second thing is the judge seems to say or the president s lawyers seem to say in this case that this was a bluff. They are not really messing with the money. They are not really changing anything. Did you read that in the decision and was that interesting to snu. It is interesting. The white house is trying to have it two ways. On the one hand, they are saying we are impossibing out wilr wil cities. But this is encouragement. Strongly imposing our will. David gregory . Look, the reality is there a are ideological issues that play out on the Supreme Court. As chris mentioned in the case with sebelius, you see this as well. What is the proper role of the executive versus the Congressional Branch of government. Legislative branch of government. The immediate political fallout is the president is at odds with the judiciary and there are questions about him overstepping his authority in the realm of immigration policies. As much as he will argue about it and go after the judiciary, there is a check and balance on powers that are asserted by this president. That has repercussions. It has the white house reeling. When it came to the travel ban as much discussion of them vindicated on the law, which there may be, there is political fallout from all of this for this president , who at the very least this drives him nuts and have him going in so many directions. I want to give them the money they want to operate as a city or state. If they have sanctuary cities, we may have to do that. It was that last word that wound up sticking in the judges head this was punitive and connected. Ultimately how does this fight play out on trump for the issue of sanctuary cities. People have strong feelings against sanctuary cities. Especially among his base. The white house has vowed to continue to fight this. They said they will go all the way to the Supreme Court. This is something that President Trumps base really fires them up. We heard him talk about it on the campaign trail. It is interesting the legal argument you were talking about earlier. The administration is making contrast with how they presented this to us in various briefings from the podium and the press secretary talk about this in a different way and strong way that the attorney general did. And yet, you know, this is all happening as the president moves towards his 100day mark. He has been talkidogged by the fights based on the executive orders. He has hemmed on his executive power. This timing is something that is frustrating for the white house. Can i say one thing in defense of the president here . I would think this idea you cannot criticize federal judges is absurd. They wield enormous power and unau unaccounted and unelected. He is not the first to criticize. Lets look at some of the things he said. This is since the travel ban and now the sanctuary cities. You remember he attacked judge c curiel for being mexican. Thought it would make him bias. If there were a tariff tax, the judge would be to blame. The travel ban judges act like bad high school students. He said the hawaiian judge was just that was sessions . This was sessions. Who is sitting on some island in the south pacific. Now the overreach in sanctuary cities. There is freedom of speech. Do you think somehow denigrates that branch we rely on . I would like to put judge curiel statement aside. It does to how i does it. Can you criticize . I think the curiel was off limits. The others were critical. Judges are not like shrinking violets. They are in the middle of the mix here. Criticism is appropriate. Doesnt it have a bigger effect on the judicial branch. The public understands these are very controversial issues. Some disagree. Just because one federal judge says something one thing trump has not done is we will defy the order. Like president Andrew Jackson did. That would be beyond the pale. To criticize the orders. Also, David Gregory, as the judge of the ongoing argument here right now, sure. He can go after the judiciary. The question is if you consistently attack the checks and balances provided in the constitution, is there something of concern about that or is this just trump being trump and people dont take him seriously anyway . No. These are all human beings. If you keep picking on the checks and balances, they will keep checking and balancing you. Thats reality. I think it is right. A lot of examples. David gregory. Beyond the procedure that phil is talking about. Remember Michael Flynn was the first named adviser to then candidate trump. He was with him all the time. Shoulder to shoulder. We interviewed him several times because he was the spokesperson many times on many subjects for the campaign. Why didnt they vet him more closely . I think this is the real issue. You have somebody who is extremely close to the candidates and the president elect. Then the president who has ties to a foreign power. That foreign power is judged by all of our intelligence agencies in the country to attempted to manipulate our election. And he turns out to have lied to the Vice President in terms of contact was the russians. This is a huge problem. I dont know what the legal exposure is for general flynn. That is a process that the investigation is going through right now. Both congressional, fbi and we will see how that plays out. The judgment, the lack of vetting, the inability to apprehend by the president or anyone else that may be russia is trying to manipulate us. Maybe we have a really bad relationship with a big power in the world. That level of naivete should be deeply troubling to people. That is something we should get to the bottom of. Which covers not only whatever contacts, but vetting and why didnt they know or push harder or did they just excuse all of this . Carol, we are doing regressive analysis. Phil is saying is this Something Congress should look at in the first place. They dont have the mandate. The doj does. Then you have the accountability at the white house. If you look at what Michael Flynn has done since he left the white house, we learned a number of things about his time while he was with the campaign and shortly before he joined the campaign. We know he then had to register as a foreign agent. He worked for the government of turkey. He obviously took money from rt. The russian state run media organization. We also know now he was looking for immunity from investigators into the russia issue. This is potentially one of the reasons why. What we have seen from the white house is they have tried to distance themselves from a number of people. We have seen the same thing with paul manafort. They tried to distance themselves from him. Now they are trying to distance themselves from Michael Flynn. This is frustrating for them because i do think from their point of view, they didnt really realize or know all that went into bringing Michael Flynn in the white house. This continues to evolve and we learn new things weekly. That is frustrating for the president and for his advisers. This is going to continue to play out. I dont think we have seen everything that we are going to see in terms of michael fliynn. One question is what did he do in the white house . That has not been exploplorexpl. Phil, Michael Flynn is looking for immunity. Now he has a story to tell. Now senator burke is saying no immunity. It tells me senator did the right thing. Why give the core of the investigation immunity . The fbi will decide if he committed a crime or not. Second, there is a perfectly legitimate investigation. The Big Supreme Court decision on this is actually about when the federal government said you cant get federal highway money unless you raise the drinking age to 21. Strings attached to federal money. That was okay. It was related. The rule is if you attach strings, it has to be on a related subject. Those were sometimes harder to find. Also, there is a little bit of relevance to being in the ninth sith circuit. You have the sanctuary cities. Politically, trump could be on strong ground here. Sanctuary cities, one, there is a great deal of misinformation and misperception. That name alone. Sanctuary cities plays to political hot talk on it. People dont like sanctuary cities within trumps base. Does that give him leverage . I dont think it is just within the base. I think the idea that a city can defy the federal government is troubling to a lot of people. If you look at what the cities actually do, it is not they give Carte Blanche to violate the law. It is about if they will report criminal violations to the immigration authorities. It is not a sanctuary in the sense you can violate the law. In what other situation do you have this . Rarely. Almost never. Doesnt get said that often. There is often coordination with local. The argument of the chiefs is a practical oneonone level. Ill give you whoever you want. You take too long. It is costing me a lot of money. And it hurts us as community policing. The police rely on some of the folks. We dont want to make them enemies. Exactly. All of those are plausible arguments. The difference between Ruth Bader Ginsburg and clarence thomas, it is a different way of going about being a judge. These differences are real. It matters who is on the federal bench. Now President Trump finished the tweet. Brought in the ninth circuit. He was talking about shortstopping. He says has a terrible record. They used to call this judge shopping. This is another piece of misinformation. What is the reality of the circuit overturned as a function of the number of cases it has . You know, i dont know where the 80 number comes from. It is true the ninth circuit has been reveersed by the Supreme Court of the United States. There are some in particular. There is a caveat on that percentage of why it gets overturned. There is a volume issue on cases that go up there and what they get overturned on. It is not as simple. One thing most people dont realize is most times, not always, most times when the Supreme Court takes a case, they reverse it. If they agree, they would not because it is a big certisu. There are also not liberal judges. This is a big circuit. The president is not the first president to go after a judge for disagreeing with him. He has every right to do so.
