Help us understand what you see on this. Heres what is very key to this whole piece that we have here. It is certainly a pretty graphic video. But in all fairness to the community and the officers, this is still very early in the investigation and i think whats going to be critically important is not just the video but forensic evidence that is going to suggest how and why the shooting took place the way it did. But to the average viewer thats out there and environment were in today between police and community, it certainly does raise a lot of questions. Is one thing thats going to be very important and you heard that from batten rouge Police Department is that theyre going to have to be very transparent in keeping that community in contact with them and sharing information as it becomes relevant to this investigation. Thats going to be critically important based on the video we just saw. Obviously the protests and the out rage are for good reason. A guy on the ground shot in the back. We need to look at forensics and talk to witnesses. Sometimes we can look at so many things that we forget what happened in our own eyes. A man clearly subdued not accessing his weapon. We should find out more information. Lets not confuse this. We begin to dig into the persons background. What did they do when they were 18 or 12. Then we raise all these other questions that have nothing to do with what happened in that incident. Its a long pattern of black men in particular and black women and in batten rouge were seeing evidence this is a pattern. We need investigate but not deny whats in front of our own eyes. We dont know what the other side of that car, which we cannot clearly see and what was taking place, what was in officers mind when he yelled gun, gun, gun. Its our understanding from the initial reports that he did have a gun in his position and heres where i have to be very careful and i think its important that the community and the country at large will be careful is that we will know more as more is revealed but we have a few seconds of a video thats very graphic and i will reemphasize it again, the fact that in this particular shooting, it appears that he was down. We dont know where his hands were. We dont know why that officer shot but hes going to have to articulate and clearly articulate. Its going to have to come down to where his hands were. Because the eye witness testimony is that they saw the officers taking the weapon out of his pockets. And his hands were never at his pocket. But you have eye witness testimony. You have two things that are going to be impressive to people on both sides of the equation. This is my guess. One is good thing you got videotape. We dont know if the body cams were working properly. Without it, its an entirely different analysis, certainly for the public and on the other side its going to be why did he resist . Why did he create a situation . You know everything goes against you once that happens . Hold on, cedric. Of course, yes, videotape is always great. If theres no videotape, theres not a chance we have this conversation with this. Because the assumption is police do nothing wrong unless we have video. It also helps the cops. This was shot by somebody that was in the parking lot at the time of that recally morning shootingtop it is short but it is prompting serious questions and a call for transparency. Hundreds of protesters taking to the streets in batten rouge after this graphic video circulated on social media of a deadly encounter between police and a man at a Convenience Store. Two officers are esponded just after midnight on tuesday. The caller said a man selling cds outside of the store threatened him with a gun. The officers attempted to subdue sterling. The store owner says one officer used a taser but sterling remained on his feet and sterling is tackled by an officer over the hood of the car. And someone yells. Hes got a gun. Reporter he was then shot several times at point blank range. He says while sterling lay in the parking lot, he saw officers pull a gun from his pocket. Sterlings family now demanding answers. I really want to know more about what happened, about the whole situation because my brother didnt deserve it. Reporter cnn affiliate wafb reports that the officers in question were wearing body cameras but they fell off in the alteration. Batten rouge police have placed the officers on administrative leave. This is an ongoing investigation. Were going to review the video, the audio. We have nonbiassed witnesses here. Were going to bring them down to our station. Theres no reason to shoot him at this point and if they thought he had a gun, which witnesses say he did have a gun on him, to me that shouldnt have been the way they approach him. There are other ways you can disarm an individual, simply by asking if they have a weapon and even if he doesnt tell the truth in that situation, there are other ways you can go about still disarming him. What can you tell us about whether or not the family can substanshiate that he owned a gun. We know theres open carry law alouns in that part of louisiana. But what can you confirm . I cant confirm anything on that right now. Ive spoken to several relatives and they werent aware that he had a gun. So, that differs from the witness accounts. So, we still are investigating that. Thats an intent to transfer classified information that is grossly negligence. I say you can make this case out as a prosecutor. But theres a curve ball that gross negligence is the standard and the statute but thats not the standard employed when they prosecute under this . As fares as i understand and comey implied is that every time there has been a prosecution for improper disclosure, it has been against a defend where the government could show knew it was classified and intentionally disclosed it anyway. Hundreds of protesters taking to the street after this deadly encounter between the police and a man at a convenience star. Two officers were spotted just after midnight on tuesday. The caller said a man selling cds outside of the store threatened him with a gun. The officer attempted to subdue 37yearold alton sterling. The store owner says one officer used a taser but sterling remained on his feet. He is then tackled by an officer over the hood of the car as officers wrestled to restrain sterling, someone yells. Sterling was shot several times at point blank range. I was actually there when it happened. He said he saw officers pull a gun from his pocket. Sterlings family now demanding answers. I really want to know more about what happened about the whole situation. My brother didnt deserve it. He didnt deserve it at all. Cnn affiliate, wafb reports that the officers in question were wearing body cameras but they apparently fell off in the altercation. Baton rouge police have placed the officers on administrative leave. We are going to review the video, the audio. We have witnesses, nonbiased witnesses. Sterling died of multiple gunshot wounds to the chest and back. God bless his soul. It could have been handled differently, much differently on both sides itkov been handled differently. Cnn has had an opportunity to speak to the owner of that Convenience Store where this all played out. He said he had known him for several years and given information to sell cds there outside of that business and ultimately, that interview, one of several that will be part of this crucial mountain of evidence that well have to process. There is a local congressman now calling for the Justice Department to join in or at least start an investigation of their own. This is just a start. Thank you for all of that reporting. I want to play for people who have missed it and who may just be waking up this video of what la happened to your nephew. It is very disturbing and very graphic. Have you seen this video . Yes, i saw it. Sandra, what have you learned about what happened to your nephew . Caller the only thing i learned so far which i just recently learned when the new video came to surface of how this was. When i first got to the scene, they didnt tell me anything about how he was killed. What did you then think when you saw this video for the first time . When i saw this video, i was so disturbed. I was hurt. I just couldnt believe what i was seeing and hearing. It was horrible. He was outside this store selling cds as he had for years. What do you think went wrong . I was told they had been arresting him all day. That night, the store owner told him that he was out there harassing him. Alton came in the store and got ready to leave. Once he got ready to leave, those two officers came back after they got this alleged call, which we havent heard about who called or what the call was about. That confrontation happened then. It happened so fast. Its horrible. We understand or at least the police have said there was an anonymous person that called 911 and said there was a guy selling cds, who we believe to be your nephew, who had threatened him with a gun. Did your nephew have a gun . My nephew would never have a gun because of his situation. Meaning what . What does that mean . Meaning he was kind of in a little trouble with the law. He would never have a gun. He was on probation. He was taken off. In the state of louisiana, he cannot carry a weapon, because of his previous incident. He cannot carry a weapon. His previous incident, does he have a history of violence . No, he dont have a history of violence, no, no. He was like a gentle giant. He dont have a history of violence. Can you tell us what his previous incident with the law was . I can tell you this about that. It is Public Record in louisiana but it was something so minor. Its not worth even saying over the phone. So when you see the video, what does it say to you about what happened . To me, there is no justice. He didnt even have a chance. No justice there. Had that person not came out and bought that cell phone video, we would still be in the blind today. The officers said that during the struggle, which i didnt see a struggle, their body cams fell off of them, both of them. Mr. Mcclanahan, i want to ask you about that. These officers did have body cams on them. The police say they fell off during the struggle so they didnt provide any video. What do you think of that . Well, you know, p we have body cameras that were designed to be placed on officers in their line of duty. They are to be worn and they are to be stationed no matter what goes on during the officers line of duty, during his shift. How ironic that not only one but both of them came off. It doesnt look like there was too much of a struggle to me during the encounter. It speaks of the lawlessness and what i would like to think the ignorance of the Police Officers to think people will fall for that. That video everybody is seeing now is a cell phone video of a witness. The audio is particularly disturbing on the video, as if the video and pictures arent bad enough. The audio, you can hear the witness just screaming. Ill play a short version of it for you so that everybody can hear what the witness impressions were. After that, the witnesses screamed because they realized what they just heard. You heard the officer saying, gun, gun. They felt, it sounds like, that all ton sterli alton sterling had a gun on him. The officer are trained. They are properly trained. They know how to get a persons gun without killing him. They are trained to do this. With the proper training, officers know how to get a gun, a weapon off of a person. What the video shows, two things, that camera videos from common, ordinary citizens are crucial in todays time. Number two, that the Police Officers live and operate in an environment of lawlessness. I would say 1 of officers operate in an environment of lawlessness. Nothing they did. Absolutely nothing they did was lawless. Nothing. Sandra, we can imagine how devastated you and all of your family is and we know that you are going to be speaking out publicly this morning in the next hour. What do you want to see to the community . First, i want to tell the community, lets do this peacefully. I want to say do it peacefully, because back then, my nephew was gone. He will never come back. We want to fight that this will never happen again, not in batten rouge, nowhere. It should never happen again. Stupidity is not a reason you are going to be innocent. It is not a reason. Today is the best evidence ever that we have seen that our system is absolutely, totally rigged. Reporter trump attempting to cast clinton as a corrupt politician, all after fbi director, james comey, says he wont recommend charges against clinton for using private email servers while offering pointed criticism. There is evidence they were extremely careless. Trump leapt at the chance to pile on. She said vast amounts of classified information, including information classified as top secret. She was extremely careless and frankly i say grossly incompetent. She will be such a lousy president , folks. Trump even suggesting clinton may have bribed her way to this outcome. She said we may consider the attorney general to go forward. Thats like a prbribe . Thats after a New York Times story, clip ton, herself, cited unnamed democrats. Clinton said she may decide to keep Loretta Lynch as attorney general. As clinton was alongside president barack obama, he took a aim at his penchant for golf. He says isil. Almost to make people upset. And his demeanor in the white house. We have a person in the white house thats having a lot of fun, a lot of fun. I watched him today. It is like a carnival act. As trump tried to stay on the offensive, he set off con o t controversy by offering his accolades to Saddam Hussein p. We shouldnt are destabilized. Saddam hussein was a bad guy. He was a bad guy, really bad guy but, you know what he did well, he killed terrorists. He did that so good. Now, trumps comments about Saddam Hussein were made even more awkward by the fact that he was campaigning alongside bob corker, the chairman of the Senate Foreign relations committee. Donald trump tried to turn the attention back on Hillary Clinton and took to twitter to do that. Tweeting out a number of things, including, i dont think the voters will forget the rigged system that allowed crooked hillary to get away with, murderer. Come november 8th, she is out. Donald trump on the attack days before the Republican National convention. What can we expect in cleveland . Well talk to the Republican National committee coming up. The attorney general is sitting there saying, if i get hillary off the hook, i am going to have four more years or eight more years. If she loses, im out of a job. Its a bribe. Its a disgrace. Its a disgrace. Thats right, donald trump said Hillary Clinton bribed the attorney general to get out of the email scandal. This comes after james comey revealed the results of the investigation into the private email saying there is not a lemg it matt basis to prosser cuse. Sean, do you want to own the allegation from your presumptive nominee that Hillary Clinton got off from the email situation because she bribed the attorney general . Here is what i do know. The evidence that director come yechcomey was gross negligence. It was an indictment on her judgment and her fitness to be president. To put it in terms that everyone would understand, imagine getting an a in every class and have someone say, you are not going to graduate. It doesnt add up. I dont know how you can explain a situation where the attorney general has a private meeting with the former president , her husband, and gets special treatment to go into the fbi on a saturday morning of a threeday Holiday Weekend and tuesday morning, they announce despite all of this overwhelming evidence, despite the fact that we admit she lied, there was classified information on her server, despite the fact that she set that server up for the intent of evading detection, that we are not going to come to the conclusion of this. Despite the fact that there are hundreds, if not dozens, if not hundreds of people that have worked for the government that have been prosecuted for lessor crimes. I dont understand how he came to that conclusion. I do think for the average american looking at this system they have to think something is weird about it. Two points. One, as he laid out and as i think you will hear more from him whether he gets dragged on to capitol hill to discuss it. Very rarely, almost never has this statute been prosecuted on the basis of gross negligence. It is almost always done on the basis of intent and almost always prosecuted when someone then lies to the fbi. Those are important distinguishing characteristics. The other point is, i dont hear you saying the word bribe. You dont like certain things about this but you are not calling it a bribe. Your presumptive nominee did, should he have . Thats up to him to decide. Im only going to go with what i know and the facts laid out. Shouldnt he be going with that . Do you want him going beyond the facts and coming up with something that is a very charged statement . Right. I think he has every right to decide how he wants to present the contrast with Hillary Clinton and make the case he wants to make. Ill stick with the case that im comfortable making and the way i want to present it. When Hillary Clinton didnt just have a g mail account or a yahoo account, she set up an entire email system, put in multiple servers to evade detection, to make sure she could communicate privately outside the rules and regulations she signed a form to abide by. I believe that intent was very clear from the beginning. Anybody can see it. The reason she set this up was actually with the explicit intent to avoid detection. Thats why it was set up. It wasnt like somebody sat around and said, hey, i have a g mail account. Can you send this to me once in a while or im going to blind copy the state department . They literally set up this private server. She was warned multiple times about not abiding by the rules and the concerns people had on security measures. She disavowed each time. Hillary clinton has a set of rules for her and a set of rules for every other american. What the fbi director laid out was clear. She knew what she was doing was wrong. She was reckless and there was a culture at the state department of an unrecognizable importance of National Security. This is a person who wants to be president of the United States, commander in chief, overseer of the National Security, who will be getting daily briefings and see the most sensitive intelligence and has now been told by the director of the fbi, na she had blatant disregard for maintaining that security. It certainly can be seen as a political crime and will play out in the election. On the other side of the lecture, where is the partys stand on the email over the weekend by donald trump with the star of david in the referenced image on what he said about Saddam Hussein, which kind of seemed like a compliment for him being good at killing people, specifically terrorists . With respect to the email that you were references, i think the social media director of the campaign has answered that. It was done rather slopilily in terms of the intent was not to be disparaging or anything. They chose an image that wasnt proper. They took it down and corrected it. It was a mistake and it wont happen again. Never apologized. I think he basically said it was a mistake. Whether you get into exact wording, it is not for me to decide. The bigger point that i look at when you look at a guy like donald trump, in 1985, 30 years ago when he wasnt running for anything and when the liberals that controlled Palm Beach County said that blacks and jews werent allowed in any elite club, donald trump went down and bought a club, mara lago and said, i dont care about your renl or what color of your skin, i want to open a club for everybody. Well before he was running for the United States president before he was in the public spotlight. That speaks volume for who the man is and the kind of person he is and the kind of actions he would take as president and the way he would lead. Thats whats important, not whether someone made a misstep on twitter. The actions and the kind of perp he is. This goes back 30 years. When it comes to the character of who he is and the type of person he is, he is someone who has shown over the course of three decades that he looks at people not because of the color of their skin or religion, as equals, all, as people, not as part of a group. When you have a group of liberal elites down in palm beach that were deciding to be racist and antisemitic, it was donald trump that came to the rescue and says, i will fight tooth and nail for everybody to be a part of the club i want to be down here. How damaging do you think the fbi findings about her recklessness or carelessness will be to the Clinton Campaign . The honest answer is, i dont know. One thing we all should have learned from this process to date or relearned is that a little humility is in order in judging events and their impact. There is no doubt that comeys lang winl w language was very, very tough. He provided a lot of fodder for negative ads and opponents of Hillary Clinton. How much of it is baked in the cake already . How much of the hit has she take foreign the emails . Will it further affect peoples attitudes towards her. We dont know the answer sitting here in july, it is hard to know what impact this might have in november. One factor will be how donald trump handles it. This is one where you want to let the facts speak for themselves. Donald trump never lets anything speak for itself. He always embellishes. He has a tendency to overdo and add elements that arent necessarily warranted by the facts. House speaker, paul ryan, is calling for director, james comey, to be interviewed by the oversight committee. Do you think this email controversy continues on . This is politics. This will go on. I dont think the republicans will let it die. They have an issue and they are going to beat it very hard from now until november. The question isnt wlo it will die but whether it will be impactful. Her numbers have already taken a big hit as a result of this story going back to when it first emerged. You think her numbers are, when you say a big hit, we have heard some of her supporters say, voters do not care about the email controversy. You think it has made a dent in her numbers . If you look at her favorable ratings and ratings on trust from before this story emerged and after, that is a line of demarcation. She has paid a big price for it. That said, even with those numbers, she continues to lead trump in polling. There is another one out today that i think is way out of whack but has her up by 13 . She is averaging about a five or sixpoint lead even with those numbers and trumps numbers are trustworthyness are nearly as bad as hers. As i said, i go back to axlerods rule. Humidity humidity is the order of the day here. One shortterm hit she got was she got this wonderful endorsement from president obama yesterday who was clearly pent up and ready to go and been waiting for a long time to deliver it. He was sort of at ultimate enthusiasm yesterday. That story was completely shoved to the side by what director comey did. If anybody thinks he was in collusion with the Clinton Campaign, the white house or anyone else, he obviously didnt get the memo. He stepped on what was going to be a very good story for her. He ended up taking some of the glow off of the first joint appearance between president barack obama and Hillary Clinton. David, do you think there are still people in the Obama Administration who are using private email . I really dont know. It was made xleclear to us frome very beginning that official business was to be done on official email but there was a recognition that people did have private email. We were asked to transfer those emails to our public account when it had something to do with official business. So i assume thats still the case. I imagine that there are people who have private email accounts but are doing what they were required to too, to transfer them over to their public accounts. There is certainly a lot of evidence surrounding that. She did in a very public setting absolutely say that she is considering keeping the attorney general on. I think thats very hard to argue that she didnt do that when she did it in a public way. You have her husband meeting randomly on the tarmac. They just coincidentally run into each other. Where there is smoke, there is fire. There is a whole lot of smoke around this situation. It certainly is coincidental that all of the cards are falling into place for Hillary Clinton and on a Holiday Weekend none theless. You had the fbi director come out. The point is words matter. We like to say that specially about others when we have our own miscues, we dont like to hear it. Bribe is a very strong word. Clearly, he cant prove it. Is that something he should not say . Words absolutely matter. In this case, Hillary Clintons words are the ones that matter most. She deliberately and clearly has lied to the American People as we know now based on the fbis report and their press conference alone proves that Hillary Clinton lied. At this point, it is not just about the trcrime but the coverup. Thats whats become most disturbing and frankly disqualifying for Hillary Clinton to be president when you have the clintons, you have scandals. You have lies. They dont trust her. The American People dont trust her. Thats one of the many reasons i think donald trump is going to be president and beat her in november. All of those are good bases for criticisms and points of comparison for trump to make. He is throwing his body blows. That is all fair play. Then, he makes this turn to Saddam Hussein. Except, he was good in this respect, talking about him killing terrorists. Why did he make that turn . Why would he ever say anything positive about a man who killed women, children, his own, the innocent . Why . Why do that . He certainly i dont think was trying to praise Saddam Hussein. That wasnt his point. The point he was making and he has many times that he has for years that he believes the iraq war was a mistake and we have to start putting american interests first. We left a major void there in the Obama Administration. Hillary clinton and her role as secretary of state was failure after failure. The void left there has allowed isis to come in, take hold and continue daley threatening American People and american lives and there has to be a stop and a leader that stands up and says, we will put american interests first. That is going to be his first priority. That was the point he was trying to make. It clearly hasnt been done under this administration and certainly will continue under a clinton administration. The Trump Campaign is no stranger to calling out the media for being unfair to trump, that he gets unfair scrutiny. Do you believe it is somehow a gift from the media that trump gets a pass on i was against the iraq war . There is not a single bit of proof that he ever said, a man who is quoted all the time in the new york papers, that he was against the war whether it first started . Afterwards when it turned south and everybody realized there were no weapons of mass destruction and yellow cake was something you served at picnics and didnt have any role in what was going on in iraq, everybody was against it. There is no proof he was ever against it before. Yet this has become a pillar of his campaign. Isnt that a gift to you guys . I would hardly say the media has given any gift to donald trump during this campaign. I think that the big issue here is, you said, everybody was against it. Thats frankly not true. There were a lot of people at that point were saying it was a good thing, still trying to spin that. Donald trump came out when a lot of republicans were still trying to argue this was the right thing and said that it wasnt. Again, i think the bigger issue here is the contrast between the type of president that donald trump would be and the type of president that Hillary Clinton would be. Which one will keep us safe . I think the message that jason sends people is that anybody can do anything. I dont think he views himself as an inspiration but he truly is. We have been through this before in american history. We have had waves of antiimmigrant feeling in this country that generally follows periods of immigration. After letting in lots of newcomers, there is a moment where existing people get a little bit anxious. I think thats what we are seeing. It is a period of anxiety. I dont think it represents some kind of permanent shift in the nature of this country. This is a country based on accepting people from other parts of the world. I am one of those people. Im from canada. This country opened its arms for me. You dont seem scary. No. I tried to be as innocuous as possible. The pendulum swings back and forth. Thats some of what i think you are going to be doing in your podcast of revisionist history. Lets look at something that does seem very gripping and very anxiety provoking and thats these Mass Shootings. Scores of them just this year, gone to paris, brussels, orlando. How can history ever look at these in a different way . The odd thing about Mass Shootings in this country is that the average american citizen is substantially safer today than they have been in generations. If you think just 25 years ago, the crime rates nationally were almost double what they are now. We have a case where in general the countrys crime is at one of its lowest rates since probably the 60s. We have these episodes of these terrifying episodes of Mass Shootings that pop up seems like every couple of weeks. There is some shift in the kind of crime that we see. But the basic fact remains that we are safer than we have ever been. Necessary such a good reminder. They are so anxiety producing that it does seem to be a speight of them that it feels like we are in danger. It explains why we never do anything about Mass Shootings. The fundamental psychological reality of American Life is that we are crime hasnt been this low since probably the mid 60s. Its hard on a policy level to figure out what to do with these things like orlando or sandy hook, these terrifying acts that pop up every couple of weeks. So tell us about your new podcast.
