There is a spectrum. You can have someone with minor depression getting treatment being careful about it. Thats just as good as any other pipe or you could have a system where pilot versus the hide their problems theyre not gotting the treatment that they need. Those pilots are probably way more soft than a pilot who fesss up the flight examiner is watching the pilot. In the United States is there any incentive to make sure this Self Reporting is done . So if a pilot, in this case this guy is hiding his condition. If a pilot goes to a doctor doesnt tell the pilot, gets treatment for depression the doctor isnt going to know. Every doctors appointment i have been to they ask me. Exactly. If you are going to lie to your employer and you are going to lie to your fellow pilots you are going to lie to a doctor. Which is in itself a problem. Because if someone is you know deeply into the spectrum of some sort of Mental Health issues the Self Reporting to me is a challenge. I think the main thing here is this was a bill it was a passed that was designed to allow people who believe that the government was infringing on tear religious right to have a restoration of those rights. And i think the main thing that the governor was trying to do out there was apply this compelling intrastandard for judges that were then reviewing those cases. One of the real big problems that mike men e pence has now and the moxy folks out in indiana have is this has sort of gotten out of. Theyve lost a narrative to allow the opposition groups. The opposition groups have more narrowly defined this around discrimination when i think the original intent here was to protect those that felt that their government their religious rights were being infringed upon by Government Action. Well the law was originally intended the original federal, two decades ago, the freedom restoration act to protect individuals in a private religious view. It was created, for example to allow native americans to worship in a way they want to. To allow a faithful muslim be a prison guard even if he has a beard, which was against federal regulation. Now what governor pence is moving it into the commercial realm. Indiana law covers not just people but every kind of corporation you can imagine and it will allow those corporations to assert a defense. It doesnt say you are free to discriminate. But it would allow them to assert a defense. Thats where i think it was wrong. Indiana could fix this easily bypassing a nondiscrimination law for lbgt saying we make it clear, you dont have to go in too deep. He says he will not. Right, because he wants to discriminate. Its the only straight answer he gave yesterday is no he would not allow equal Protection Laws in antitrip nation laws for transexual genders. Thats the problem. A person who passed this law back 20 years ago and you say that it was supposed to be protecting native american but president clintons words are sort of ambiguous. Let me read them to you. When he passed it there is great debate now to the question which people of faith can seek to do gods will as political actors. I think the compelling interest part of it and equal protection application of the law is where most people would say that would have a, an overarching effect on how people will interpret, whether or not they will discriminate t. State has an interest a compelling interest in protecting against discrimination and, therefore, it could protect against any of that discrim napgs. One of the interesting things is while we are having the debate about its narrow application, there hasnt been any judicial decisions in any of the other 19 states or 35 states that have similar versions of the law, where there has been a discrim nation applied. Right. So i think thats, again, this is one of the real big challenges that the folks have out in indiana is trying to explain. That i think there are many legal scholars who said one of the things you need to do when you pass a law like this beyond the 1990 act passed on the federal level and beyond for example, president barak obama, he voted for a very similar bill like this. He did. Because nobody backed and anticipated, but businesses would claim that they have religious rights. Thats where hobby lobby came from. The Supreme Court decided that corporations can have a religion. They are not endowd by their creator. Back to roman times, corporations businesses have been considered persons under the law. How did he go down this path . What was the illness . Was it Mental Illness . Because we all know the result. 149 lives taken because of what was going on with him. Reporter yeah chris, of course everybody is talking about the transcript from the cockpit voice recorder that was released by a german newspaper called the build newspaper. We have no way of verifying whether or not it is authentic. But it does give a chilling picture for the moment leading up to that awful crash. Lets have a look. Over the weekend, disturbing few details from flight 9525s mangled cockpit voice order published by german newspaper build. The cvr transcript is leaked way too early in the investigation. Then a loud bang on the door the captain screaming, for gods sake open the door passengers are also heard screaming. Five minutes before impact more bangs can be heard. Metallic noises as if someone was trying to knock the door down. 90 seconds later, another alarm goes off, warning, terrain, pull umm. The captain again screams, open the damn door. Two minutes before impact the paper reports lubitz can be heard breathing. The plane now only 13,000 feet from the ground. 10 40 a. M. Investigators hear the right wing scrape a mountaintop and screams from the 149 on board. A couple years later, citing source close to the investigation, he developed severe depressive symptoms generalized anxiety disorders. In 2010 he had antipsychotic medical injections. There were aint depressants found inside his apartment. Cn has not been able to verify but beyond the reported psychological treatments according to New York Times he also had vision problems. There were doctors notes in dusseldorf excuseing him from work on the day he crashed the plane. I did speak to the airline. They say they find it hard to believe he had vision problems. According to reports, investigators when they went into his apartment found antidepressant medication. Sim li larry, according to other reports, he was on some psychotic drugs he had generalized anxiety disorder. In 2009 he had severe depressive symptoms. And 2010 he received Antipsychotic Medication injections. Sanjay, when you see this what does that tell you about what symptoms he miefbl experiencing . Well when you look at these medications, a lot are medications used for various illnesses. They can be used for very severitys. There is one particular medication injection that you mentioned given five years ago and he was then 22 or 23 at that time. That is a very powerful antipsychotic. It can be used for people who develop a depression that develops into a psychotic depression. Its not just depression that people start to have psychosis, which means delusions, hallucination, things like. That oftentimes if they develop extreme agitation associated with that thats when this medication is injected and again, we just know the one time it was injected back five years ago. If it was for a psychosis that was ongoing, the question is that will he continue to get treated in some way for the psychosis . It is different than the depression. Depression can be more easily treated. Its not necessarily a life long illness. Skitsz friendia or some other psychosis, those are typically life long illnesses that require ongoing treatment. I think it speaks to the severity and a little more detail on what his Mental Illness may have been. Miles, when you hear the symptoms of delusion hallucination, are pilots allowed to be on antidepressants and indiana psychotic drug . Antidepressants yes, thats relatively new,al sen. Its just been within the past couple of years the faa has come around on this that was disqualifying up until recently and as it stands right now, a pilot has to be on the anyt depressants for some period of time and evaluated before they can return to the cockpit. Now, what we are talking about here with sanjay just a moment ago, extends way beyond what it would be qualifications for flying as far as the faa is concerned. So i think, you know its just like any disease now. Theyre trying to embrace it like any other disease, you have hypertension you take a pim. You can still fly. Have you depression can you take that. As far as taking injections for antipsychotic that it would probably be disqualifying. Although i dont know the exact drug is there clearly the picture of what we were talking earlier is of a man who should not have been in the cockpit. The investigation and the inquiry and the error of the investigation must focus on how he ever got in the cockpit in the first place. Miles, help us understand is there a Self Reporting regulation whereby he should have alerted somebody and is there only Self Reporting . Because, obviously, that is not fool proof . Thats the system as it stands. You get a psychological exam when you sign up as a pilot. But as you go through your routine medical exams every six months for a first class medical with a qualified medical examiner theyll ask you, how are you feeling . Thats it. Thats the extent of the psychological evaluation. The rft is left up to pilottopilot interaction. They spends a lots of time together in a small room. Over the years, thats a check and balance. You have a low cost carrier that put a very inexperienced pilot in that seat and there was much less vetting time to get him there. He wouldnt have been flying in that seat in the United States. He would have needed twice as much time in his logbook and different certifications sort of a ph. D. Of flying. Apparently one of the possible side effects of the medication he is taking is blurred vision. Now, if he was experienced blurred vision that puts him into this untenable bind. Does he deal with blurred 56 as a pilot or stop taking the meds to get rid of the blurred vision . That is exactly right. There are side effects of these medications, some can be pretty unpleasant side effects. Its a balanced side effects with the medication. But you are right, some of these medications we are talking about are not the more routine sort of medication the he was on that its a more powerful antipsychotic. It is associated with various unpleasant side effects, one of which is blurriness of vision. By the way, when you stop taking the medication the vision does improve. To your point, alisyn that might make someone obviously in a profession like this not want to continue taking that medication. Here we have a pilot who is determined to avoid, who is determined to lie. You cannot build a system. You can do the best you can on it but you cannot build a system thats going to always cap cure this sort of pilot. Somebody who is in any profession whether it be journalism whatever it is who is determined to railroad himself through. There is no way to make a system completely immune from risks. The side that doesnt want a deal cut with iran they say the voice of speaker john boehner, i will squeeze them with sanctions right away. What do you think would happen if there were harsher sanctions put on iran . I think that would be a investigation of the p5 plus 1 eastern ray groemt on the joint plan of action. So if i were iran, indeed the other members of the permanent 5 plus germany, i would point a finger at the United States and say you just screwed the pooch. The person has to demonstrate their religion is burdened and substantially burdened if only they are able to do that then the government has to demonstrate that their action is serving a compelling government purpose and uses the least restrictive means. Let me ask you, why do so many so many christians these days believe that the exercise of their faith requires exclusion and judgment of others . Why so much time spent on this . What is your compelling interests of your faith that says you cant serve gays as a business . Where is that . Some people have a sincere cons conscientious believe that marriage is between a man and a woman. 53 of americans in any root poll said i believe marriage should be defined as the yven of one man and one woman. I have a poll that says the majority of the marines say it should be legal. Here it is. When asked if they agree or disagree that government should leave all the beliefs about marriage as they live their daily lives at work and in the way they run their businesses 81 of americans believe agree with. That and so even in the context of this agreement. As we both know popularity is not the ultimate arbiter of what is right and wrong if protecting rights under the constitution. The question then goes to a why do you need this . What is it about someone being gay or someone wanting to marry someone of the same sex what is there in that that is keeping you from being the christian that you want to be . Well this is not about that broad issue. Even in the of course it is. Even in the examples you give these individuals in the wedding industry who have had these cases arise are people who are happy to serve gay customers. They have a longstanding record of serving gay customers. The only thing they object to is using their expressive abilities to communicate a message they disagree with by saying that marriage can be the union of two men or two women. But that isnt stopping them from excerciseing their faith. Theyre still able to go to chufr, theyre still able to be christians. It doesnt violate their faith . Im a christian. How does it violate my faith . It forces them to say that two men or two women can be married when they believe in their deep sincere belief its not the case. Thats a personal belief. If i said mr. Sprigs you have to go marry a man right now. Can you say no, no no thats a violation of my faith. Babe that you would be able clear this hurdle of burden. But how is wanting to judge others somehow stopping you from practicing your faith . I dont get it. Americans believe that you should have freedom to believe what you believe and to act on those beliefs and they believe that in the context of these Small Businesses in the wedding industry too. The burden placed upon these same sex couples is they go to another vendor and they get the service they is ask for. The photographers you dont want to treat everybody the same way. Reporter over the weekend disturbing new details from flight 9525s mangled cockpit voice recorder published by german newspaper bild. It was leaked way too early in the investigation. Reporter it was criticized by mere voyeurism by french investigators captures the steps 27yearold Andreas Lubitz took to kill all 150 on board. Around 10 00 a. M. The plane takes off from barcelona and the captain tells lubitz he didnt go to the bathroom in barcelona and lubitz tells the pain go any time. And it reaches cruiseing altitude and the captain asks lubitz to check for landing and he answered you can go now and then you can take over. Lubitz now alone with the door locked reprograms the autopilot from 38,000 feet to 100 feet sending the jetliner straight toward the alps dropping around 3,000 feet a minute. Air Traffic Control tries to contact the plane but reinforce no answerreinforce receives no answer. And alarm goes off, sink rate. The captain banging on the door screaming for gods sake open the door. Passengers are also heard screaming. Five minutes before impact more bangs can be heard, metallic noises as if someone was trying to knock the door down. 90 seconds later another alarm goes off warning terrain, pull up. The captain again screams, open the damn door. Two minutes before impact the paper reports lubitz can be heard breatheing, the plane now only 13,000 feet from the ground. 10 40 a. M. Investigators believe they hear the planes right wing scrape a mountaintop then screams once more from the 149 on board and lubitz apparently stays silent. So again, it seems lubitz might have been setting the stage for his captain to leave the cockpit very very early on as we saw there from e sperpts s excerpts from that transcript. We cant guarantee its ah then tis. I the french Investigative Unit have come forward and criticized the leaking of this document and dismayed any details came to light this early in the investigation. Thanks. We are learning more about Andreas Lubitz history of Mental Illness. This as the german prosecutor releases new information about the investigation. We turn to pamela brown in dusseldorf germany. So many questions about him and what could have led him to crash that plane. We heard from investigators last friday he had torn up doctors notes in his trash bin even on the day he crashed that plane. Authorities say he was trying to hide his illness from his employer. We still dont know exactly what that illness is. Publicly officials wont say. Accordingly, he had a history of Mental Health issues. In 2009 severe depression symptoms and in 2010 he apparently took antipsychotic medical injections according to sources close to the investigation telling this to the newspaper. Cnn has not been able to independently confirm this. We have this new video cnn obtain obtained. From 2007 a couple years before he apparently developed the depression symptoms. It shows him, as we see rights here flying his plane, laugh laughing smileing. He was a teenager in this video. Apparently at one point he said dont stress me out. Of course a very different picture there from what were learning about him, that he was seeking treatment, psychological treatment and we happy to learn more any minute from the prosecutor. I had an opportunity to speak to one person whose brother died on that site and heres what she had to tell of her big brother. He said if someone killed in the flight crash would be okay because its gone and youre in this sky and your soul would go. He had spent eight minutes reporter she, like many of the other relatives are desperate to get as close as possible to the crash site. They want to find out what its like there. I hiked up there a couple days ago and able to tell her, look right now, spring flowers are going and the melted snow is filling crystal streams. At that point, she looked up to those snowcapped peaks behind me and said at least i can find some comfort. Now, i believe my brother is king of the alps. Back to you krrks chris. They happen in every investigation. Id like to say it was rare but was not. I thought the investigation chief when he gave his press Conference Last Week was quite forthcoming. The investigator told us this but abstractly and the investigation tape leaked out at some point. It can be used in court although theres lots of precautions you have to take but theyre secured. Ive seen this a lot. Its not unusual. It happens in the u. S. Too. We often depend on them. I ask this as a loaded question because it was, im not worried about this leak. We need to know more. Sanjay i come to you on this level. People are treating Mental Illness and any type of depression this man may have had as if it were in a fever, comes in a flash and goes away. Can you help us understand better how depression works and different factors in your life can combine to bring you to descending into this type of mad madness. What were talking about here is not simple depression to a point. We dont know looking at the medication some pretty powerful medications, if it is true he took these as long as five years ago, he was taking a medication as an injection that is typically used for agitation associated with psychosis. Mental illness can be confuseing in terms of diagnosis and criteria can overlap one over the other and start with depression if not adequately treated, you can develop a psychotic depression which means in addition to depression you might start to have symptoms of psychosis, delusion things like that. It sounds like one of medication if he received this medication around age 22 or 23 he may have been having some of those symptoms at that time. Depression can be treated, sometimes you have an episode and gets treated and you dont really deal with it much after that. With schizophrenia or psychosis after that it was more of a lifelong thing. Was he continuing to get treated over the last five years would be a very important question chris. Also proof, sanjay something you understand very well and the rest of us are learning more and more in our culture, even if you have psychosis level depression not like youre walking with welts on your face. Miles, that takes us to the point of is it time to change at least for the u. S. How we address the Mental Illness and monitoring and need for information for people who have such sensitive position where others lives are in their hands like pilots is it time for a change . Absolutely chris. No question about it. The system was built on the honor system on trust between the pilots in management between pilots to report each other when theyre in difficulty. The system is frayed at the edge edges because of cost cutting, because of management forceing pilots to give back wages, because of a general atmosphere of acrimony between both party parties. It inhibits that layer of trust. What you have to do in those case is either come together somehow i dont think is likely given the environment in the Airline World as it is and difficulties there are, or you have to clamp down. You have to start reviewing psychology call wellical wellbeing and physical call health every pilot goes to. Mary what has the pushback youre a laur and understand the investigative and legal side. The pushback is the medical language anybody with a pilots license has seen it and you have to go in and check off various boxes and there is an infamous item 47 and they say we dont want to collect a lot of psychological or psychiatric information and ask them if they check the box and look at them and see if they can remember those events. Nowhere is there a blood test if youre taking psychiatric drugs and that would be an onus on the airlines saying youre responsible for the health and wellbeing of not only your pilots but passengers your duty to find out and check. Sanjay were making this about pilots because of this specific instance. We know it goes way beyond it in our culture. We know and republican tim murphy in pennsylvania trying to get this vote on it on the floor to allow family os have more leeway to get information about their loved ones who seem to be suffering but not taking it seriously enough. Do you think it will happen . The problem is more stigma i think than policy chris. The idea that even if you try and legislate some things the stigma still exists. That stigma lead though possibility people wont seek treatment is a real concern. It is important not to clump all Mental Illness together. Depression can be treated. The likelihood of someone who is depressed carrying out an act like this is very remote ive never heard of such a thing. With psychosis or skits nennia oftentimes can become really noticeable when its noticed. He may have been 22 or 23 when he received this injection. They want to reduce centrifuges to enrich uranium, the fewer you have the longer it would take you and what do you do with this existing stockpile. The old plan was ship to it russia. The new plan because iranians are baching at this is dilute this so you essentially cant go from low enriched to high enrich enriched. Technically both are fine. The problem with the seconds one, you have to really get it right and seal it and do it in a way where even if one day the iranians throw the inspectors out, they cant go back in and turn that low enriched to high enrich enriched. Youre trying to make sure whatever you do you cant get from a civilian program to a Weapons Program fast. The naysayers will say see, you cant trust these guys. Dont do this deal. Force them into sanctions and force them into a position they do what they need to do give this up and let the inspections do. Whats the risk on doing that . We have history. Between 2003 and 2005 the europeans almost did a deal with the iranians. They were to cap the centrifuges at 164. The french and the Bush Administration played ded hard line. No more pressure well get a better deal. The iranians walked away. From 164 centrifuges they went to 20,000. Under sanction iran is an oilrich country. They make something in this range of 50 50 billion a year. A Nuclear Program isnt that expensive. While we have you here we were talking about yemen a minute ago. This is an important question and we have to focus on persons and machines in this system. Mitigateing your risk of your pilot developing a psychiatric condition would involve two ways of doing this. The right way and wrong way. Whats the right way . The right way is a program we have developed here in the United States whereby a pilot tells the airline i need help. The airline say, great, ill hold your job, go get help. The faa says fantastic, these are the disasters that will do this protocol for treatment. People like myself that verify it works and theyre stable once we do that the person goes back to work. What we have done here is preventing a pilot from going underground and either becomeing increasingly des respondent and depressed or getting unapproved treatments we dont know the efficacy. Everybody wins and this is a team effort. Let me stop you there. My first issue with that is youre assumeing that a person that has a problem is going to admit they have a problem. We know how we humans are. It often is the person who has the problem is the last person willing to admit it. I would agree with you completely. That is one of the risks we have to mitigate. I would put it to you there is les of a if we offer the person a way to deal with the problem without going underground. This program is replicated on top of a couple other previous programs i had fantastic success, pilots by and large very professional very ethical safety oriented professional group, will do the right thing and come out and get the help they need. You have to offer a way to care for them and support for them. My next question is for you then maybe its because i fly and we need some comfort, was this an outlier . Was this a rare circumstance how rampant are these issues of Mental Health illnesses or disorders within the Airline Pilot community . This is an out liar no doubt. One of them is too many. Since 1997 we had five pilot suicide by aircraft accident events. The most recent one, the most concerning one was in mozambique and it was almost exactly the same as this one. Right now, there are thousands of airliners flying in the world piloted by professional crews doing an outstanding job and making this the safest estst transportation method there is. This is an outlying event and we have to do something and the way to address it is provide a way out for people who feel distress distressed. Final question for you. Heres another challenge, we may be talking about a system here in the United States. We very well know american flyer flyers will go overseas were talking about a Global Airline industry. How do we make changes globally if there isnt the same kind of recognition in other countries of Mental Health challenges . That is a very good question and one that is a concern to me because we have to have a Culture Shift in the industry and many agents of global ministry. Around the globe we have to try to pry away the stigma associated with mental disease and people get sick. Pilots are people. Pilots will get sick. That this is reality and we have to deal with it in an up front proactive manner. Youre right. It is a concern and has to be addressed at a proactive manner.
