Maliki who is in charge of the Iraqi Military increased the numbers of iraqi troops, Security Force ts and tan nx bagdad on sunday including in bagdads green zone, the location of the Iraqi Parliament and the largest u. S. Embassy in the world, a troubling sign after iraqs new president allowed more time for the National Coalition to find a replacement for the Prime Minister. Maliki said the extension is a violation of the constitution that would lead the political process into a dark tunnel. The u. S. Says they back the new iraqi president. Only 220 miles north in erbil, one apparent consequence of a government divided. I. S. I. S. s murder rouse rampage hampered by u. S. Air strikes over the weekend. The u. S. Protecting u. S. Personnel and four strikes defending yazidi civilians. Kurdish forces were able to capture two towns south of erbil pushing back i. S. I. S. Militants. The u. S. Response hoping to break the siege by i. S. I. S. And allow thousands of the religious minority trapped on sinjar to be rescued. The u. S. Also conducting its fourth air drop of food and water as the humanitarian crisis worsens, totaling over 70,000 meals and 15,000 gallons of water now delivered. Our military obviously can play an extraordinarily Important Role in bolstering efforts of an Iraqi Partner as they make the right steps to keep their country together, but we cant do it for them. Having been in country as you have and understanding it politically as you do, peter, it always has felt like a country very much desiring to break apart. You had the kurds who had been asking for their territory. They havent gotten it. You now have this majorityminority pull with the government. Lets start with that. With whats going on there, maliki has the power. No question about it. Does he have the ability, rick, to fight off change . Well, thats a good question. Hes trying to do that. But time is not on his side and hes lost all hes losing his support. We saw him flexing his muscle. This is not how you have a transition of power. Hes taking on the trappings of a dictator. He says im not leaving. The only thing that matter, he says is the military. He sets up, fires on opposition. Distracts from anything theyre able to do in the north, thats almost nothing anyway. Thats all the kurds. Then what happens. I think the Obama Administration has made it clear. Theyre willing to take military action to prevent erbil with a lot of oil from i. S. I. S. And protect yad difficults. Theyre not going to go further unless they feel they have an Iraqi Government that has support among the sunnis. Unless there can be a new Prime Minister beyond maliki who actually is able to rally the country together, i think you see the Obama Administration will be unwilling to pursue military action. Thats exactly right. The problem swe ear trying to buy time for the Iraqi Government and army to stand up and do something and demand they have an inclusive government. One doesnt follow the other. Someone has to take on i. S. I. S. Right now. If we stand back and wait while i. S. I. S. Continues to roll down the river valleys, it may be too late. Theres criticism these air strikes are all show no go. Pretty much. I dont want to say its all show. We or not hitting who we need to hit. Were defending erbil and protecting the yazidis. We need to be taking out i. S. I. S. Can you do that through air . You can, if youre willing to commit the resources and have people on the ground. Theres a ready made army right there, the peshmerga. You believe in the peshmerga which should be better equipped. Are we giving them anything . It seems like through some reports we are giving them better weapons. Why do we care if its a shia country whether theres sunni representation in the government . Thats what helps keep the country together. A lot of those i. S. I. S. Fighters are believed to be former sunni, Iraqi Military guys who got kicked out when saddam left. Isnt that part of the speculation . Thats whats happening, as they roll further south, they gain strength as the former Iraqi Military join with them. Thats not a longterm solution for i. S. I. S. Thats a temporary fix. Many of these people are more secular than they are radical islamists. This is a temporary marriage for them. Theyre joining not because they agree with i. S. I. S. , but because they dislike or hate the government in bagdad. The quicker you change the government, you may haurt isis through the collateral impact of changing and having a more stable government where people can get something from their iraq. Fair point . Right. This is the fact that the situation weve seen in both iraq and afghanistan. In afghanistan, also, you have the u. S. Waging this military campaign on behalf of a leader, hamid karzai, who is not able to unify the country politically. It turns out its actually easier to deploy American Military assets than it is to create a government that can get the fullbacking of its people. We keep picking our own bad guys in these places. Maliki now is being revealed as a different flavor of bad guy, not Saddam Hussein, but not that different. In afghanistan, same thing. You picked somebody now written off more as a chiefton and local fair. Ive talked to kurdish friends in erbil this morning. Theyre very concerned that, yes, theyll get u. S. Aid, but that u. S. Aid comes with the proviso that they dont form an independent kin tri. I thought the kurds getting their own land was a forgone conclusion. They have their own ought tan mouse region. Why would the u. S. Stand in the way . If kurdistan becomes its own country its harder to see what keeps the rest of iraq together. You have this scenario where you have a shia country in the south close to iran, a kurdish country in the north. But most frightening of all this central city area under control of i. S. I. S. , a very large state which can be a launching pad for jihadist around the world. And has very few natural resources. So they have nothing else to do. The curds will be okay, the shia will be okay. The sunnis will have nothing more to dothan to create this terrorist city. Why isnt the likely scenario that you divide that area, so the curds get some of it, the rest of the shia minority get it and you defend which is yours and do your part to battle the insurgent element. That leaves a radical islamist country in between. This is Mission Creep, all over it, the u. S. Has to get more involved, going to have to be aggressive getting rid of isis or its going to spread. I think the Obama Administration will resist that unless they have a partner in bagdad. Right now they dont. Who is a possible partner. Theres been talk about joffery. Its clear mole ki will never gain the support from his country. Im taking that as a long yes. Kate . Lets turn our attention to israel where theres a fresh and fragile 72hour ceasefire between israel and hamas. Its golding right now in gaza. In the hours leading up to the truce both sides fired on each other. If a longterm end to the fighting is possile, today could be absolutely key. Both israeli and palestinian delegations are back in cairo to kick start talks again. Thats where our reza sayah is this morning. Reporter another round of indirect negotiations between the israelis and palestinians has yet to get under way in cairo. Both sides have agreed to give this another shot and much of the world anxious to see if this time anything is going to be different because, of course, last time these two sides failed to get anywhere, the palestinian delegation is here in cairo. Theyve been here for a week, they never left even after the initial ceasefire last week fell apart. There are media reports that the israeli delegation is here in cairo as well. We have yet to confirm that with the egyptian government. All of this happening, of course, when yet another ceasefire agreement went into effect sunday midnight local time. The palestinians agreed to it first. Soon after the israelis sat there on board, obviously its good news if the ceasefire seems to be holding and the fighting has stopped. Here is the glaring problem. Even with these two sides negotiating again, the glaring problem remains and thats the core demands that have yet to be met from either side. On one side, hamas is demanding for a lifting of the economic blockade, the opening of the border crossings. On the other side israel saying were not going to agree to anything until hamas has been disarmed. Thats where the impasse is. All eyes on cairo to see if theyre going to resolve this impasse in the coming hours and the coming days. Kate . Of course, the question is will the ceasefire hold for the 72 hours. Well see. Witnesses say the teen had his hands in the air at the time he was shot and killed. But police tell a different story, that brown instigated the altercation, physically assaulting the officer while in his car and struggling to take his gun. Police in upstate new york insist it is not a criminal investigation right now, but authorities are questioning nascar driver tony stewart for a second time about a fatal crash that happened during a dirt race track this weekend. Along with that they say they want to see more videos that may have been recorded by members of the audience that could show the moment of impact and what led up to it. At the same time tony stewart is speaking out, telling fans why he felt he couldnt race here, also sending his thoughts and condolences to the ward family. Tragedy on the race track. 20yearold race car driver kevin ward, junior, killed after he steps out of his car and onto the track, hit by one of the sports greatest drivers, tony stewart, a threetime nascar champion. Its just an unbelievable tragedy. Our hearts go out to obviously kevin and his family. Reporter the deadly hit coming after the 14th lap of the 25lap race on this dirt track in upstate new York Saturday night. Watch what happens as stewarts car closes in onwards cutting him off. Wards car is forced up against the wall where he spins out. As the race continues amateur video shows ward out of his car pointing his finger, seemingly in the direction of stewarts car. One car swerves around ward. Stewarts car hits him. Wards death now under investigation. The investigation, when its completed, we will sit down with the District Attorney and review it. I want to make it very clear there are no criminal charges pending at this time. Reporter stewart is cooperating with investigators. On sunday the nascar great decided to pull out of another race just hours before it started saying in part, its a very emotional time for all involved and its the reason ive decided not to participate in todays race. Stewart is known to show passion for racing. At times hes been called hotheaded. It just looked like to me someone who got wrecked by tony stewart was very upset, wanted to show his displeasure and in the process of doing that, got caught up in a terrible accident. We know people in the Race Community are talking about this, two very definite schools of thought about what happened and why. Take us through it. Well, basically the video that we see right now ultimately shows the wreck and it shows Tony Stewarts car hitting kevin ward. Such an unfortunate accident and thoughts go out to he and his family and tone many stewart and his family. I think right now it is a process of gathering information just like the sheriff said in ontario county. What the video shows to me right now is inconclusive as to what happened leading up to that accident. Really when you see tonys car, it was right before the point of impact. We dont see his car before that, was he sliding around . In the absence of more video and more information its hard to say what happened. Here is what we know. Sheriffs dont ordinarily investigate crashes on race tracks. Even if somebody dies, you dont usually have an investigation. This is unusual. Its unusual in part because the driver was outside the car, but mainly, lets be honest, because of how he died. Tony stewart didnt race. Was that scene as being a smart move because people are against him right now or do you think its about how he feels . Chris, originally when sunday morning rolled around, the news was tony stewart was going to compete at watkins glen which is surprising to everyone. Someone on his race team said they were operating as business as usual which was outrageous considering what just happened the night before. When clearer heads prevailed, they said were not going to race, we need to take some time to think about what happened saturday night. Its going to be interesting to see what happens next week. We dont know yet if tony stewart is going the race in michigan. We havent heard whether he is or not. If we take anything from what happened yesterday where he almost raced, we would likely see him in a car next weekend. How many people are giving him the benefit of the doubt, the other racer was very angry, moving toward his car, making it more difficult on a dirt track to maneuver . We know thats part of the racing is the slip of the car. And then you had the other side which is people saying, at least one driver saying you know what happens when you hit the accelerator around the curve, you know the car is going to flatten out, you knew it would flatten out towards him. What do you think . Whats the main take right now . As far as race fans go, people calling in sirius xm nascar radio, some people saying it was tonys fault, some people in support saying kevin ward shouldnt have been walking down the race track. As far as another racer in the grandstands, he wasnt holding a steering wheel, he doesnt know what tony stewart saw, what his field of vision was based on a car in front of him and the conditions and everything else. Really i think the hard core fans just wants to know more, wants to know the facts in this whole situation. We dont have all the facts in the absence of more video. The statements coming out from the Race Community are pretty tepid when they come to tony stewart, people are definitely keeping their distance. Andy, whats the speculation, if it is concluded, they have a local sheriff doing this right now . We dont even know if the Race Organization itself is looking at it. If it is concluded that tony stewart did something that was wrong here, whats going to happen . That would be so tough to prove as we talked about. The video is inconclusive. Its going to be hard to prove there was any intent or wrongdoing. We know tony stewart has a history of being a little bit of a hot head. Weve seen him throw his helmet at matt kenseth on a race track before. I know a couple of photographers in dallas, texas, where tony stewart said some very unkind things to them when they got close with their cameras. Still theres no reason to believe he did this on purpose. I talked to someone who works in dirt track racing. A lot of things at play. A dark track, kevin ward wearing an all black suit. Tony stewart came around that corner, maybe he meant to scare him, maybe he didnt. Maybe he didnt see how close he was to kevin ward who was way out there on the track. So theres really no way to tell, chris, just how what was going through Tony Stewarts mind and if there was any intent at all many this case. Obviously, brad, the best thing he may have going for him right now is that it is a legal investigation. If they cant find the proof to make a case, it starts to relieve some of the pressure surrounding the situation. Racing more than any other sport really is a family. This morning iraqs government in crisis, Prime Minister maliki accusing the new president of violating the constitution. Hours ago secretary of state john kerry issued a warning to maliki to not interfere with the process of picking a new Prime Minister. Now there are fears he will abuse his power, try to abuse his authority to try to hold on to power. What can the United States do at this point in this political crisis. Lets bring in margaret cooper, cnn commentator and republican consultant and john avlon, editor in chief of the daily beast. Good morning, guys. Happy monday. Not so happy unfortunately with all the news were looking at. Everyones attention has been in the north in the military operation. From the United States standpoint, theyve been very careful to not call on Nuri Al Maliki to step down publicly. The president said that to me, he wouldnt go there, wouldnt say malikis got to go. Does the United States need to go further and be more forceful in trying to say that . State Department Officials have been indicating via tweets and statements in the last several hours that the United States policies are for anybody but maliki, the president needs to be the guarantor of the constitution and that maliki has to go. Youve got a constitutional crisis going on in iraq at the same time United States is ramping up operations in the north of the country against i. S. I. S. This is an enormously delicate time, has to be managed appropriately. Ultimately the u. S. Shouldnt be in the business of determining iraqs leaders. The one guarantor needs to be somebody who can unify the country. His sectarian approach is what created this crisis. Hes moving tanks to protect himself, looking more like a henchman dictator, more the style of his predecessor. The problem is the United States has precious little political influence in bagdad because when we vacated iraq, we vacated our ability to have any influence over the political process. Do you think they would have had more if the United States had been able to get the status of forces agreement together and been able to stay there . Thats the whole point. Sure. The point of being able to be there was to help secure the peace while the political process took hold. We frankly left too early and abdicated their ability to influence the political outcome. In fairness, of course, the United States wasnt going to singlehandedly create a pluralistic democracy. If we kept troops in, it could have been at one time. One of the reasons we left was maliki and the Iraqi Government wasnt going to guarantee our success. You can argue we should have pushed harder and the absence of troops created this crisis. But we are where we are. Now were getting back involved in the country. We have Mission Creep going on right now. Thats exactly what i wanted to ask you about. You have a president that we all need to remember and everyone is kind of remembering this at this point, he ran and won at least in part on saying he was going to get out of iraq. Lawmakers, you heard him on the sunday shows split along ideological lines about are we not doing enough, is the president not doing enough in iraq or is there already Mission Creep and theres a lot of concern that the president is going to go too far, even with these targeted strikes. What do you do . One thing is pretty clear, i would be shocked if the president puts boots on the ground. What i think you will see is an escalation of air strikes. The question is how much do you do to try to dismantle i. S. I. S. To what extent does the administration see this as a National Security threat to the United States . I think you are seeing them, the president saying the other day this is not a question of days anymore, this is weeks, possibly months. Lets just be very clear. I. S. I. S. Now is larger, has more territory than al qaeda did at its height. The reason were going in for i. S. I. S. , while the humanitarian mission is incredibly important, this is a threat against United Statess National Security. Its in the United States interest to make sure iraq is stabilized, simply for our own National Security interest. Go ahead. Which is exactly why we need to be there. This is not i also want to get your take, because this leads right into this. Hillary clinton in this interview with the atlantic, stepping further away from the president on Foreign Policy than she has in the past. Shes being careful. It is nuanced. She does call that the president did not do more to arm rebels in syria a failure. Let me read you part of the kentucky quote. The failure to build up a credible fighting force for the people who were the originators again assad, islamist, separatists, failure to do that left a big vacuum with the jihadists which the jihadists have now filled. Why is she doing this . Is this purely a political strategy or is Hillary Clinton more hawkish . I think its both. It appears from all accounts she is not just being a political tunists, thats how she felt and what she argued within the administration at the time. It appears she was probably right. The president didnt have a strategy for his Foreign Policy, visavis syria or the middle east at that time. I think its a very fair point that she says, look, not doing stupid stuff is an organizing principal. You need an overlay that you can use so your allies know what youre going to do. You talked about the fact that its not organizing principle. This interview is significant because it is the most direct steps Hillary Clinton has taken to differentiate herself. As margaret said, its a credible differentiation because its rooted in her history. Remember, she was the senator from new york during 9 11. In many cases she was sort of the neocons favorite democrat. She has a record, as weve learned for reporting, in those internal administration debates of being more hawkish. I think youre seeing its who she is and part of a world view differentiation thats going to drive her campaign. She cant really run as simply as a successor. Its a try ang lated approach between bush and obama, consistent with her husband. What we see now is there doesnt seem to be a Clear Strategy. President obama doesnt have a Clear Strategy now, bombing parts of i. S. I. S. , but theres no name even for the military operation. What would she do now . What should be our goal . What should be our end point now . Thats what americans will be asking our government. Politicians focusing on that rather than the endless fingerpointing. What happened in iraq. Thanks, guys. We got a chance to sit down with the commissioner for a rare interview to take a look at whats going on in the world around us. Is it good to be back . Great to be back. No place id rather be. The job change since the last time you had it . 94 was traditional crime. This time terrorism is front and center and will always remain friend and center because we are the number one terrorist target in the world and will remain so. Are you concerned with isis, ever see a group like this before, running around and trying to chase christians down, telling them to convert or die. Are they a new breed . They are a new breed in the sense of their ability to inspire, but to recruit and train americans. They have the potential to come back to this country. Can the police handle that kind of threat . We have a better capacity and capability than any other city in america. When you see whats going on over there, you still feel confident saying even a group like that, dont bring it here . Thats correct. You dont leave it to the feds. You cant leave it to the feds. As well intended, as skilled as they are, they just dont have the resources. Theres 12,000 of them trying to protect the whole country, 35,000 trying to protect the 300 square miles of new york. When you were in l. A. , a lot of tension between the populous and the police force there. Are you surprised that youre encountering some of that again back here . No. The unfortunate reality of America Today in the 21st century is the issues that come bubbling to the surface very quickly any time you have a Police Incident involving a minority and particularly an africanamerican minority. The eric garner case, what you refer to as the incident in staten island, it looks bad on i its face because the choke hold that seems to be being used is not allowed to be used. Its frustrating to hear for your critics that theres an vapgs when the situation seems obvious. Seems to speak for itself. We have the expression, it looks awful, but its awful. The role of the District Attorney is to determine were any of the actions of the officers involved illegal. My role and responsibility is were any of the actions of the officers involved inappropriate could they be illegal but appropriate . Theres a potential possibility interestingly enough. It could be illegal and appropriate . For example, many in the media have referred to the choke hold as illegal. Yes. You cant find anywhere in the statutes of new york choke hold. Where does that come from . Its a police term of art, a policy term. We have a prohibition against choke holds. It appears to be a choke hold, as we understand it. It wasnt. How could it not be based on what youve seen and ive seen . Ive been in this business a long time. What appears to be sometimes may not be what it is. You know what the concern is i know what the concern is. The concern is if theres no action taken and something that seems very obvious, it looks like theyre getting attacked because they attacked a black guy. Were too far down the path. Im a lawyer, im all about the process. Were only beginning the journey. Theres a lot of miles to cover before we get to the destination. The guy who takes the video of this many people feel without the video you never hear about this he winds up getting arrested. He says he was being followed. He says that the officers said to him karma is a blank to him, about why he was being arrested. That in some ways look just as bad. He was not being targeted by the new York City Police department. He was a career criminal. He was engaged in a continuation of his criminal activity. How did the police wind up being in the right place at the right time if they werent following him . How the police came to be there at that particular time was in the course of an investigation not involving the subject. In any event, it will all be resolved in a court of law where its appropriate it will be resolved. You think the head of the union for the police is helping or hurting the situation when he says we have to use tactics like this because people resist arrest now, putting the problem of Excessive Force on the populous as opposed to the police. You think that helps . Pat lynch, he has an obligation to speak on behalf of his members. Doesnt help your cause. It does in one instance, but not in another. Not in this one certainly everyone is entitled to speak their opinion, the same as mr. Sharpton has been able to nuns eight his concerns. You think mr. Sharpton makes the situation better or worse . It depends on the prism youre looking through. If youre africanamerican, if youre black, what he attempts to do is to give ak sive voice to the concerns of africanamericans. Myself as a Police Commissioner, i have to deal with everyone. The garner incident grew out of a stop for selling illegal cigarettes. The criticism is you go after these petty things and wind up targeting poor people, minority people all the time. Youve got a guy who is now dead and all he was doing is selling illegal cigarettes. Is that a fair criticism . I think its an unfair criticism. Were focusing on behavior. If that behavior happens to be occurring in an africanamerican neighborhood, latino neighborhood or white neighborhood, we are going to take action. If we were ignoring it, theyd be taking our heads off. The front page of the New York Post jumping up and down because they found two squeegee pests. You think Niagara Falls was drowning manhattan. Get over it. Does anybody think the New York Post or anybody else that i as Police Commissioner would allow this city to go back to what it was . Its not going to happen. If you want it to happen, fine, get yourself another Police Commissioner. Unusually assertive for commissioner bratton. Hes a very hes quiet when it comes to these kinds of things. He knows hes got to get the process going again. There are crimes on the increase in new york city. Thats pressure for him. He has to do it. Stop and frisk was interesting. There was a big todo about stop and frisk. He says were doing it less, being used in unnecessary circumstances. Broken windows is better because it targets behavior, not just how they feel about the suspicion of who theyre looking at at the time. He believes its a better method. Hes got big challenges. He has a huge job. I watched him in l. A. He was my police chief while i was in los angeles for the bulk of the time. He spoke pointedly, spoke assertively. He brought numbers up. Thats the hope. He did it here once before, a changing time. A lot of political pressure around him thats different. If anybody can handle it, he certainly k. Good to get a look into his mind. They told me how many times my son was shot. Eight. We want this investigated fully. We begin with the prospect for some measure of piece. The current ceasefire allowing for yet another round of piece talks to begin . Egyptian and for humanitarian help to get into gaza. Is either side closer to a longterm deal . Is it Holding Strong . Thats correct. It started last night midnight local time. 14 hours. We accepted nine ceasefires. We accepted them. Hamas had those ceasefires including the last one. We hope this one sticks. I think everyone does who is watching this process play out. The israeli delegation is back in cairo today to begin those talks anew. What from your view is different this time around . This 72 hours as the talks commence. The truth is for us its the same. We were ready for a ceasefire on july 15th. Thats 30 days ago. We were ready for a ceasefire then. Unfortunately hamas said no. Were ready for a ceasefire now. The egyptian process says ceasefire and talk about the problems in gaza. We were ready for that then and ready for it now. We hope its possible to keep the ceasefire on going. Not to rourn to violence and to solve the issues in cairo through these indirect talks. For us the most important issue is to prevent hamas from rearming. If hamas can rearm, get more rockets and terror tunnels and so forth, well be back to square one and have to very visit this in six months or a year. The other issue in longer term which secretary kerry spoke about, can we demilitarize the strip . That would be amazing benefit to the people of gaz ska and isr l israel. The leader of the palestinian delegation say the same as well. They say going into this round, its the same for them as well. Im trying to figure out what you think is going to break the logjam because they say they need the economic blockade in gaza lifted. We are willing to ease the restrictions on gaza because the restrictions were only put there in the first place because of the Security Threat because they were firing rockets at our people. If that stops, if you have a cessation of old rocket fire from gaza into israel, if you have a cessation of the terror tunnels with the death squads coming out, if all aggression from gaza. Theyre only there as a response to violence in the first place. What is going to break the logjam. Be candid with it. Youre saying israel is in the same position. Were hearing from palestinian delegation theyre in the same position. What is going to break this logjam . Im concerned whats going to happen when this 72hour ceasefire expires. Also were concerned what happens at the end of this 72 hours. Were also concerned of what happened just a few days ago where they violated a ceasefire that they accepted. I think the key to understanding progress is the issue of nonviolence. I believe that the palestinians, if hamas ceases violence, ceases to target israeli civilians, then everything is possible. On the other hand, they cant shoot rockets as israel trying to kill our people and at the same time demand we have a normal relationship. Sorry, that doesnt work. If they want to move forward to a normal relationship, and were ready to have a much more normal relationship, it has to be built on nonviolence. Thats a commitment that hamas has yet been ready to do. I hope they will accept it. Do you think a deal on some of these key issues, the blockade, the con security concerns on the part of stlael, can this be figured out and agreed to within the 72hour ceasefire. Is your immediate goal to try to figure out how to get to a longer term ceasefire and then work out these details. We think obviously the issues on the table are complex. Youre not going to solve them in one day or two. If we get a commitment of on going nonviolence, that gives you a sustained period to deal with these issues. I want to stress, the people of gaza are not our enemies. If its possible on the basis of nonviolence to build a better relationship, a more cooperative relationship, israel will be a partner in that effort. We dont want to see a situation where violence is rewarded. We dont want to see a situation where fans now are going to help the people of gaza, helping hamas rebuild its military machine. We see nonviolence and demilitarization as the keys as we move forward now. Is this the new normal, 72hour ceasefires, trying to have talks. They break down, the rockets start firing again . People are starting to see a pattern here. Its a very troubling pattern. I agree with you 100 . I hope its not the new normal. Every time you have a problem in talks, you cant have hamas start firing rockets. With israels delegation leaving the talks, hamas and the palestinian delegation, is israel backing out . No. Lets be nair. The talks in egypt are based on the premise of nonviolence. Thats what the Egyptian Initiative said. It said unconditional cessation of fire. The minute they broke the foundation which was they started shooting so there was no basis for talks. If nonviolence is maintained. If they dont shoot at our people, then these talks can be on going and were ready to deal with these issues seriously. Once again, the basis is nonviolence. The special forces loyal to him strategically occupy key neighborhoods and secure areas in the green zone where many government buildings are located including the largest u. S. Embassy. The Prime Minister also delivering a fiery message to the iraqi people making clear his intentions to forge ahead for a third term bid despite plans to replace him. Malikis resistance comes as the country is in turmoil, battling the presence of i. S. I. S. Militants. The u. S. Executing five rounds of air strikes on i. S. I. S. On sunday hitting all targets within the space of a few hours. South of erbil, Kurdish Forces claim victory taking back two towns overrun by i. S. I. S. American aircraft are positioned to strike terrorists around the mountain to help forces break the siege and rescue those trapped there. Reporter nearly 20,000 stranded yazidi iraqis were rescued from mount sinjar and taken to safety over the syrianiraqi border. Thousands got on trucks with the help of Kurdish Forces. The Minority Group targeted by i. S. I. S. Went to this mountain to seek refuge but instead are suffering. According to an iraqi official hundreds are dieing on the hillside from starvation and dehydration. U. S. Officials confirm four Successful Air drops bringing more than 74,000 meals and 15,000 gallons of water to those in desperate need. Iraqis christian population also facing grave danger as i. S. I. S. Issues the terrifying ultimatum, convert or die. Chris, its important to remember that these isis militants now control onethird of iraqi territory. It really is quite frightening. Theyre certainly instill fear amongst the population here because of their brutal tactics, the slaughter of innocent civilians, the executions we have been seeing of people who do not adhere to their extreme form of islam, chris. Perversely, their viciousness is a good recruiting tool which is just as sad as anything else. The speed at which they are taking ground is what makes the idea of air strikes not enough. Obviously u. S. Has to ramp them up. On the ground, what are you seeing with the kurdish fighters who are the main resistance and are they keeping the people safe on that mountaintop . Look, i think its really important to know that those u. S. Air strikes are extremely effective because they are allowing the Kurdish Forces, the peshmerga to get in and reclaim some of those towns lost to i. S. I. S. Militants last week. But as for mount sinjar where that humanitarian crisis is unfolding, the Kurdish Forces have managed to create a safe passage for some 20,000 of the yazidis, the religious and ethnic minority who are going to be slaughtered by i. S. I. S. Militants if they didnt flee their town. So 20,000 have managed to get off the mountain, but up to 30, 40,000 still trapped. That is what we are hearing from aid groups. The humanitarian aid drops that the United States and britain are conducting are essential. Theyre providing food, water, providing medicine. But we are hearing from u. S. Officials, chris, that it could be days, if not weeks, before they can set up a corridor through the Kurdish Forces with the cover from the u. S. Air strikes to get the rest of those refugees off that mountaintop to safety. I know a big concern youre hearing on the ground, although put crudely, youre giving them food, but are you just fattening up these people for slaughter. President obama once again dismisses the idea that arming the Syrian Rebels would have been a wise thing to do. The next day this hillary interview comes out where she once again goes out and says thats what we should have done. You backtoback we should point out she did the interview prior to the president announcing the air strikes. Still really interesting. She does say the president is thoughtful, she thinks hes a brilliant guy, too hesitant, too cautious in many ways. In the current environment, you make important timing, the interview is done and released in all of this where Hillary Clinton sounds a lot more like the republicans. Here is rick perry in iowa looking at the president s Foreign Policy and saying hes unimpressed. When i think about whats going on in israel, when i see libya and i see egypt and i see whats going on in israel and i think about ukraine and then back in iraq, a Foreign Policy that is absolutely its not distinguishable from anything. The republican criticism, the question is what would they do differently, that begs the question now, especially if republicans say he should hit some targets inside syria, be more aggressive in going after i. S. I. S. I havent heard a republican say put boots on the ground. No, not yet. I dont think well necessarily hear that. They know that the American People dont want that. But it is interesting because Hillary Clinton has given an opening, also, for all these republican candidates to go after obama. And shes shown how shes a little closer to them on some points. I think that debate about whether obama went in early enough is just going to rage throughout this fall. Republicans are so hinged on their Foreign Policy critique of obama. They cant help but make it obviously lots of things happening in the world right now that arent good. It comes back to the fact of what perry said, theres no real strategy, hes not being assertive enough or bold enough and america has to play a strong role in the world. What they dont say is anything substantive in terms of theyre always going back in time rather than forward in time. After what happened in iraq, they know that pushing to commit u. S. Troops into a theater somewhere else in the world politically is very dicy. Thats an interesting point for the midterms, too. We didnt see a lot of Democratic Senate candidates coming out talking about the air strikes. Thats going to be a tricky issue for them. They might have an opening to argue that republicans are being too hawkish and will get us too involved in iraq. Interesting if youre watching at home. It seems like were beating up on the president. His former secretary of state, one of the problems for the white house, you dont have democrats rushing out to defend them. The democrats were saying make sure this is limited, no boots on the ground, mr. President. Not a course of praise. Also among those out, 2008 opponent john mccain on state of the union with candy crowley. She asked the senator as part of this interview, she said sometimes viewers say why do you have john mccain on that often because it doesnt matter. The president would say its a beautiful day, john mccain would disagree. Listen to the senators response. My reply is that there are a number of things that the president has done Foreign Policywise that i have not only approved of but supported. If i look at the world in january of 2009 and i look at the world today, i can tell you this, candy, its very, very different. And i believe its because when the United States of America Withdraws from leadership from the world, it creates a vacuum and bad things happen. Its been a while since he supported the president. Thats true. But you have to remember, covering the 2008 campaign, there is bad blood that goes back a long time between those two. He had a lot of time to criticize the president on the campaign trail and has not really shown much interest in trying to work with him on these issues. This is always a challenge of a democratic president who commits to some kind of intervention abroad. His own party by its very nature is more dog gish, so he gets support from his own party, the opposition has never supported him on anything except for some kind of brief total support for the strikes before going on to a broader critique of his Foreign Policy. John, to your point, where are the voices of support. What we have not seen is 2016 mccain Bumper Stickers. This was spotted out in california. Look at that, romney 2016. He says hes not running. Good for the Bumper Sticker business. How much longer are we going to do this . How many times can a man say no . He says hes not running. Up until the republicans have a nominee. What do you make of this and what do you think needs to be done . Im not sure how many options we have. Look at how much has happened in the past few years, we had authoritarian regimes in libya, in egypt, had one with Saddam Hussein in iraq. This quick transition from an authoritarian regime where security is provided by a strongarm take stater to democracy isnt working that well. When you have leaders win as weve had maliki win in iraq, the president says when you win power, you dont have to live by the rules, you get to set the rules. I think what maliki is saying, i represent the majority community, the shia, were 60plus percent of the population, i get to set the rules. I won. Add to that, the u. S. Sitting here on the sideline watching whats going on, were trying to draw down our troops, our presence here, we look at this situation, an unstable iraq is very, very concerning. Yet its a sovereign nation. Whats the u. S. Legally able to do and what can they reasonably do . I think weve got a lot of questions in the coming days. Right now weve taken a stopgap measure with the military operations in the north. The peshmerga are very powerful. Theyre very committed to fighting the i. S. I. S. Troops. What weve done is limit our operations to try to keep the i. S. I. S. Troops at bay, that is, going against front line troops. The questions will be if we look at command and control at places elsewhere in iraq and syria, tick the fight to i. S. I. S. And eliminate some of their leadership. Weve had limited strikes. The question is do we expand them. Thats the question. We talk about the Iraqi Government, without a stable Iraqi Government what hope is there for combating and taking on and stamping out i. S. I. S. . I think in the shortterm theres very little hope. We can hold them at bay. U. S. Air power can assist the curds. I think the kurds my guess will be very effective at taking out of Northern Iraq. I think over the long term the question on the ground is going to be do the sunni tribes work with the shia government, Nuri Al Maliki to fight i. S. I. S. I think as long as maliki is as isolated as he is, that will be an im prosable task. Americans are somewhat war weary, do you think well see pressure mounting domestically and partners in the u. S. Doing more than just beyond the air strikes . I think the question is going to be do we expand the number of air strikes into things like leadership strikes. There will be a parallel question. Weve seen some of that answered already about whether nato plays a bigger role. There are tens of thousands of kurds in germany. Where are the germans . I know the president has talked to president cameron in the u. S. Nobody is going to say put boots ton ground. They are going to say do we expand the air strikes and become more aggressive. The u. S. Has the air pour to complete some of this operation by itself. But the question isnt military force alone. In the wake of withdraw from afghanistan and the wake of withdraw from iraq, the question is going to be do we operate with an International Consensus that commits us to air power over a long period of time in the face of an adversary that wants to put somebodys head on a stake. I think given the potential duration of this campaign that is months, maybe even years, the question is going to be where is the u. K. , the germans and the others . Following a crash three time nascar champion tony stewart struck and killed a fellow driver on the track and apparently angry at stewart during a sprint car race in upstate new york this weekend. Now, during the actual race, 20yearold driver kevin ward jr. Got out of his car as you saw there to confront stewart after their cars had made contact and going to put into the wall. Moments later, stewart struck him, killing ward. Now, were not showing you that part of the video. Who needs to see the video is philip pavro. His county is investigating the crash. What we know at this point you have detailed quite efficiently that the fatal crash did occur, and we are taking as much time as we can to gather every piece of factual information that may exist that will help us clearly identify the cause of this tragedy. We have had tremendous amount of support and cooperation from all the racetrack officials, the racetrack management, other race car drivers, staff and mr. Stewart and his staff. Mr. Wards family has been cooperative with us. And we are basically trying to see if there are any other video recordings that may have been made on saturday night that could help us in the analysis of this crash. The information at this point is coming in from our investigators, our forensic investigators and deputies. Were waiting on other information that is relative and still to had happen, such as an autopsy and subsequent results from that. Were finalizing our Crash Analysis at this time. There are a lot of crashes, drivers sometimes die. It is rarely a matter for the police. Youve gone out of your way to say there are no pending charges at this point. But youre investigating for a reason, yes . Yes, were investigating because we have a young man who has died and as a result of this crash. We are going to investigate death cases. We have consulted with the District Attorney. And although as you do point out there are no criminal charges pending at this time, this is an Ongoing Investigation and all options remain available open at this time. Were continuing to gather and analyze every piece of evidence we can. And hope to come to a conclusion when all that data is collected. Are there two operative theories now that this was either, a, an accident, because the driver was out on the track and maybe it was dark and maybe it was slick, or that the driver was out on the track, trying to confront tony stewart who was also angry and there was a tactic involved that wound up going wrong and leading to the death of this driver . We have obviously heard these theories presented. And have talked to people that, you know, want to discuss and have opinions on that. Right now the key is obtaining facts, and of great assistance will be accurate data from video which will help us to clearly isolate what happened at the time. Interviews of people who were present and are eyewitnesses has become very informative information. And all this is being compiled into one investigation which when completed will definitely answer the questions or settle the rumors or theories that arent relevant regarding this investigation. Did the Race Organization ask you to investigate this . How did you come upon to take it . This investigation began when our 911 center received a call regarding this crash on 10 30 saturday night. It is our obligation in new york state to investigate incidents like this where a death of this nature occurs. Apparently as a power play by the embattled Prime Minister Nuri Al Maliki. Hes under pressure from the United States to step down. It comes as the United States carries out a new round of air strikes against isis targets in Northern Iraq. Cnns Barbara Starr has more from the pentagon this morning. What are you looking at now, barbara . Iraq now clearly a full blown military and political crisis for the Obama Administration. This morning, political chaos in iraq. The Prime Minister of the country in crisis, nouri al maliki, flexing military muscle amid fears of being ousted. Maliki, in charge of the Iraqi Military, increased the numbers of iraqi troops, Security Forces and tanks in baghdad on sunday, including in baghdads green zone. The location of the Iraqi Parliament and the largest u. S. Embassy in the world. A troubling sign after iraqs new president allowed more time for the National Coalition to find a replacement for the Prime Minister. Maliki said the extension is a violation of the constitution that would lead the political process into a dark tunnel. The u. S. Says they back the new iraqi president. Only 220 miles to the north in erbil, one apparent consequence of a government divided. Isis murderous rampage hampered by u. S. Air strikes over the weekend. The u. S. Conducting five strikes near erbil to defend Kurdish Forces protecting u. S. Personnel. The u. S. Response helping to partially break the siege by isis and allow thousands of the religious minority iraqis trapped on mount sinjar to be rescued. Over the weekend, Kurdish Forces were able to capture two towns south of erbil pushing back isis militants. The u. S. Also conducting its fourth air drop of food and water, as the humanitarian crisis worsens, totaling over 70,000 meals and 15,000 gallons of water now delivered. Our military obviously can play an extraordinarily Important Role in bolstering efforts of a Iraqi Partner as they make the right steps to keep their country together. But we cant do it for them. And family members are outraged, sparking renewed debate about Police Brutality and in minority neighborhoods. Well talk to the mayor from there in a moment. First, George Howell is live in ferguson, missouri, with more. I no know it is quiet there now george. You were in the thick of it last night. What is driving it. Reporter you put it there quite precisely. Two different versions of the story that sparked outrage that have sparked Unanswered Questions that inspired thousands of people to come out to this street and initially for a peaceful rally, but, again, we were here to watch it all happen as things degenerated into anger, into violence, and some people who came to just take advantage of the moment. Across the city, a night of pure chaos. This is your warning, leave the area. Disperse. Reporter people pushing the limit with police. Racial tensions, nerves on edge, even an officer we caught on camera gave into his rage calling protesters animals. Listen. [ bleep ]. Reporter many here are angry about what witnesses say was an unprovoked attack on an unarmed teenager. Michael brown, shot and killed saturday, by a Ferguson Police officer. We watched as a struggle played out sunday night. Some protesters who took to the streets trying to keep the peace while taking a stand against police. This is a peace march. It is nothing to start this is all about peace. Reporter it is not a peace march anymore. You hear whats happening. You see them, the confrontations between people and Police Officers. Yes. And it got outrageous. Reporter others who simply came to cause trouble. Police are still stationary right now. But i want to show you what is happening over at the jc wireless. People broke through the glass and right now you can see people running in and out, apparently looting that store. Cell phone video captures the frenzy of stores being looted. Some people threw rocks and bottles. The sound of gunshots rang out several times sunday night. We had to take cover. All of this started as a peaceful march sunday for Michael Browns family. You took my son away from me. You know how hard it was for me to get him to stay in school and graduate . You know how many black men graduate . Not many because you bring them down to this type of level where i feel like they dont feel like they got nothing to live for anyway. Theyre going to try to take me anyway. Reporter the victims friend said they were walking together when brown was stopped by a Police Officer. Witnesses say the teen had his hands in the air at the time he was shot and killed. But police tell a different story. That brown instigated the altercation, physically assaulting the officer, while in his car and struggling to take his gun. The Unanswered Questions sparked people to take action. Caucasian, africanamerican, asian, everyone, doesnt matter what color you are, get out here and support your people. Reporter police made several arrests. Several hours of insanity for the moment distracting from the greater call for justice. With the light of day now, the looting has certainly stopped. The main street here through ferguson is much quieter than what we saw several hours ago. But fair to say the frustration, the anger and outrage remains for many in this community who want answers to those Unanswered Questions. And, again what were expecting today, another peaceful, were told, rally that will happen at 10 00 a. M. Local time in front of the Police Department, the hope for many organizers is that today we dont see a repeat of what we saw overnight. All right, george. As youre saying, the mood of that community only as good as their confidence in the process of finding answers and ultimately justice. Today, browns family will hold a News Conference with their new attorney benjamin crump. Youll remember that name, crump represented the family of trayvon martin. How will the town handle this situation . Is there going to be another chaotic scene, is there going to be calm . Lets bring in the mayor of ferguson, james knolls. You were largely in control of this situation. It is your community. Youre a young man yourself. Youre in your second term, 30 years old when you were elected, 34 now. That will give you an opportunity to appeal to a wide cut of your community. Being young yourself, and being a leader. Leadership is needed right now. What is the message to your community. The only thing i can tell my community now is to remain calm and obviously the events of last night are not indicative of what we are in ferguson what we have done to bring our Community Around the past ten years. I can tell you that what is going on last night i understand the rage and anger of people, but this is not constructive. This is not doing any good for our community. It is only bringing the community down. And unfortunately it is not going to do anything for the process involved right now and investigating the untimely death of this young man. But it is helpful for you to be out there about what that process is, and showing ownership. I know it is the cops. I know theyre investigating it. It is your city. What can you do to give this Community Confidence that this is not going to be forgotten, that youre going to know whats happening, that youre going to keep them updated so they dont need to use flashpoints like last night to get attention . I think the biggest concern from protesters speaking to people involved in some of these events is that this, you know, this investigation will be whitewashed or wont be impartiality. We turned this over to the next highest authority, which will be st. Louis county police and government. We have taken a hands off approach now to this investigation because we want people to have faith in the process, we want them to know that is going to be looked in, it will be impartial, that justice will be served and that, you know, we as a community are trying to move forward and calm people. As a government, were not going to be involved in this investigation because we want people to be confident in the process. But you do have to be there coaxing it forward, making sure there is an urgency to it, otherwise the longer it goes, the more are trouble there are there is, especially when you have these types of flashpoints and im calling that to use a more gentle word. People want to call it something ugly, but the motivation counts as well. You had your cops caught on tape screaming at the not screaming at the crowd but talking back to the crowd saying bring it, bring it, you want to come over here, ill show you what happens. The cops have to be better than the people around them. What is your message to those cops . Well, there is 15 Different Police agencies that were here last evening. I believe many more actually came throughout the night. So not all of them are Ferguson Police officers. But i can tell you this, we have been lauded by local media and others that our officers and officers around this area have shown a great deal of restraint. Were trying to not allow this to escalate. Were trying to give people an opportunity to speak their mind and protest, to let out some of that anger in a constructive manner. But last night obviously everything lost control. The officers did their best. They are only human. They are here to serve the community and that is what theyre doing. But you do know that you need to get the message out there mr. Mayor that the cops cant be yelling back at the crowd like that. It is not going to make anything better. Absolutely. No, absolutely not. But thats something well deal with internally. Until the flashpoint last evening, our officers and other officers acted with a great deal of restraint. Now, but of course now that takes us back to the original question here. What kind of restraint was used by the officer involved in this altercation. Obviously the young man dead. The question is why. Have you met with the family . Have not been able to meet with the family yet unfortunately. As you can see, tensions are a little high. We did have on the day of the incident our police chief was able to make contact with the mother and the father. I do hope to be able to meet with the mother and father in the next day or so. I know they are calling for an end to protests. Theyre not happy with what is going on now obviously in this community. Were all in this together as far as that is concerned. As far as what happened with the officer, there is an investigation taking place and we have to allow that to play out. We cannot get involved in that. That will home tank the process. Understand you want to keep a step away from it so people dont think there is any corruption involved, it is done by an objective body. I get that. As a lifer from ferguson yourself, and you know how much leadership means to that community, is this something youre going to try to own not from a culpability standpoint or responsibility standpoint but leadership, of meeting the family, bringing them in, let people know theyre being shown respect . Absolutely. We met with people last night. We met with clergy. Ive been meeting with some of the area clergy and some africanamerican elected officials and leaders in the area tomorrow evening. Well hopefully move that up, considering last evenings events. But, you know, what we will own in this process is when the investigation is complete, and whatever is the outcome of that investigation, at that point it is our Police Officer and we will own that situation, we will take the outcome of that investigation and deal with it. We will own that. But the investigation itself, like i said, the people here are wanting an impartial investigation. To have me or anyone else politically get involved in that, i dont think it does anybody any justice and a disservice to both the young man and the officer himself. And the pace matters. He said our hope is that mr. Maliki will not stir those waters. But to be clear, is it the secretarys view that Nuri Al Maliki must go . Well, it is not up to us to decide who the next Prime Minister of iraq should be. And i think an important point that has happened since the secretary made those comments is the shiite block in iraq has nominated someone else to be the next Prime Minister of iraq, so we want this process to continue. I know there is a lot of tension on the ground, certainly very tense situation. But there is a path forward here to form a fully inclusive new government, and we stand ready to work with that new government as soon as it is in place. Well, youre looking on the ground as you look at tanks in the streets, looking at Iraqi Special forces even in the green zone. What will the u. S. Do if al maliki wont budge . Well, what we want to see here, kate, as i said, is the iraqis move forward themselves with an inclusive process to form a new government. We have seen some progress on that front just today. We have had a number of conversations with Prime Minister maliki, with the new president of iraq, with all of the leaders in iraq about how they can move forward here. And to be clear, as we said yesterday, we would not support any attempts to use coercion, to use the constitutional or judicial process to coerce a different outcome than the iraqi people themselves and the constitutional process warrants at this point. You the administration has wanted to see that though for months. When i sat down with president obama, he said very much this very same thing, he wanted to see the process move forward. What were looking at now is a different situation on the ground. Youre not only looking at violence in the north, but youre also looking at what could be the makings of a political coup in baghdad. What will the United States do if Nuri Al Maliki will not leave . Well, lets not get ahead of what we see here. I understand that Prime Minister maliki made strong comments last night. We knew this would be a difficult process. We always said that. We never thought it would be easy. But what we have seen today is the shiite block nominate a new candidate for Prime Minister. There is a process in place here where they can get a new government, formed very quickly. So youre right. While we have seen a very tense situation over the last 24 hours, i really think we need to take a step back and see if the iraqis themselves can make progress politically over the next 24. What is the conversation with Nuri Al Maliki. I know the state department has communications with him. What are you are you talk about making a deal with him, are you talking about helping to keep him safe if he does leave . I know that is a bit of a question there on the ground. Some concerns about that. What is the conversation with Nuri Al Maliki today . The conversations with Prime Minister maliki, but also with other iraqi leaders. Because to be clear, this isnt just about Prime Minister maliki. This is about all of iraqs leaders, putting aside their first, it is very clear and the secretary made very clear today that this first step does include not having maliki there. It includes having a new government in place. We see a path forward for that now. The conversation is about putting aside personal ambitions. We know this is very difficult. We know there is a lot of tension and a lot of personal things that play on the ground here, but what the iraqi people need in order to fight isil in the best way possible is a new government as soon as possible so thats the conversation were having, not just with Prime Minister maliki, but with all of iraqs leaders. If you look at what is happening in the north particularly, this is the time to put aside politics and put the people of iraq first. Is the secretary, is the state department concerned when they see tanks moving through the green zone . Iraqi special forces moving through the green zone, or do they or is the view that this is more of a political muscle flex coming from Nuri Al Maliki. Well, look, were always concerned about reports coming from the ground like this and obviously concerned about our people in baghdad and in erbil. Some of this is actually quite frankly not new. We have some of this military presence in the green zone already. So i would caution people from assuming some of this is new. But what the president has said is we have a couple of objectives now with our action. One of which is protecting our people in baghdad and erbil. Were very focused on that. It is something we watch all the time. And well take additional steps as we did over the weekend to readjust our staffing, move people in, move people out, to help us with our goals here. And important part of that the very same time, it comes it is interesting, the president of the kurdish region in iraq, he wrote a piece for the Washington Post and said they need more help, they want specifically weapons to come from the United States, to help better arm them so they can fight off isis. Is the United States directly sending weapons to the Kurdish Forces . Well, kate, as we said last week, were working with the government of iraq to increasingly and very quickly get urgently needed arms to the kurds. This includes the iraqis providing their own weapons from their own stocks, and were working to do the same thing from our stocks of weapons that we have. So it is really a team effort here. We have seen an unprecedented level of cooperation between the iraqi forces and the Kurdish Forces. We hadnt seen that in the past. Theyre helping each other out. So any way we can get the very urgently needed arms to the kurds we are actively working on, well work with the government of iraq to do that, but we believe again there is such an urgent situation that we need to do this. You call it an urgent situation, of course, we can see it on the ground. We know also one of the objectives of u. S. Involvement there is to protect u. S. Personnel. If there is such a concern for u. S. Personnel, in erbil, why not move them all out . Well, because we believe it is important to have a presence there. We have a joint Operation Center in erbil that is currently sharing very critical intelligence with the iraqis, to help them fight isil. Thats a key National Security priority. So we want to have people on the ground there who can carry on this mission. Over the weekend we removed some people from erbil, but we sent an Additional Team to erbil that could work on some of the challenges fighting isil right now. Look, we constantly reevaluate. Thats why we have taken steps as isil moved on erbil. But we believe it is important to have people on the ground helping the iraqis, helping the kurds fight this very serious threat. This weekend, just 20 years old. He was hit by nascar star tony stewart after he got out of his car following a spinout with stewarts car. Now an investigation is under way. Discussing it with Rachel Nichols and sunny hostin, our cnn legal analyst. A mans life is cut short, but the grieving continues but the investigation has to begin. I want to start with you, rachel. Are you surprised that it escalated like this, the spinout, gets out of his car, walks on to the track, which never seems advisable. Not a good idea, your mother told you to look both i was before croways before crossing the street. This happens in racing. Hot tempers flare. Guys feel like they have to defend their turf a little bit. I want you to look at this. This is from two years ago. This is tony stewart of all people. He gets out of his car, and goes into matt kenneth while hes driving toward him. This is obviously dangerous. And yet at the time, this is really almost celebrated. Good old hot head tony stewart standing up for himself, Like Fighting in hockey, everybody says it is not a good idea but there is a blind eye that has been turned to it because it is entertaining for a segment of the fan base. You got to think after this, this weekend, thats going to stop. Drivers will think twice. A blind eye but maybe until now, sunny. Will that incident be brought into consideration during this latest one, especially when a young man is dead . I think there is no question this is a really young investigation, but they are looking at it very, very closely. The question is will there be criminal charges for this type of behavior. Anytime you have a death in any sport, in any in any space, really, it is something that prosecutors and investigators certainly look at. I will say that i think what is difficult about a case like this is you got to prove criminal intent. S what what was going on in Tony Stewarts mind . You have this video of his hot temper before and you have, you know, this young kid, 20 years old, coming out, kind of aggressively, pointing at the car. And so i think people are going to be looking at investigators at least was there between the two, what was the history between the two, were there any words said whebefore this accid. It is young in the investigation but it has to be looked at. It has to be. I want to look at the investigation aspect of it in a second. I want to read something another sprint car driver, tyler graves said, this is really interesting to me. I know tony could see him. I know how you can see out of these cars. When tony got close to him, he hit the throttle. This is quite an accusation. When you hit a throttle on a sprint car, the car gets sideways, it set sideways the right tire, hit kevin, kevin was sucked underneath and was stuck under it for a second or two and then threw about 50 yards. Horrible. Were not going to show you the extent of the video. It is too much for viewers to watch at home. But he would know how the car is going to react. Benz dri hes been driving for a long time. We all have to offer our deepest condolences, this has to be just the worst time and to hear everybody dissect it the way we are is analytical. Absolutely terrible. You have to wonder how much someone sitting in the stands can have a definitive unassailable view of what happened on the track. I think theyll take into account what this other driver said. I think theyll take into account what other drivers on the track at the time said, the interviews with stewart and possible we might never know. Maybe he opened up the throttle because he was trying to gun the engine to southwestewerve aroun maybe he didnt see him. It was dark on that part of the track. Those are all the questions that the investigators will have. How do you prove what was really going on in his mind . The other thing that will be interesting is youve got to reconstruct this kind of accident, right . So that will be i think a significant, significant part of the investigation, not only just speaking to the fans, looking at video, looking at photos, interviewing tony stewart, but, again, i think you really need to sort of accident reconstruction in a case like this. One thing to remember, nascar is sort of like a soap opera. Everyone has predefined characters that come at you, the clean cut guys from california, like jimmy johnson, the good old boy like Dale Earnhardt jr. , and youve got the guy cast as the hot head rebel in tony stewart. It is an image he cultivated and frankly made a lot of money off of over the past years. Were going to have to see if that comes back to haunt him. Investigators have to put that away and look at the facts in the case. I want to speak to the fact that chris spoke to the sheriff involving this case now. And the fact that a sheriff is investigating yet says there are no criminal charges filed at this point, if thats the case not a criminal investigation, why not just let the racing commission handle it. I think youre always going to investigate it criminally. You do use that line because thats accurate. There are no criminal charges pending, but the investigation is ongoing. I think in a case like this, i prosecuted so many cases, it is really difficult to prove what is going on in someones head. Thats the worst part. And to go back to it, a 20yearold is dead at the end of the day. A family is grieving. It is tragic. It is tragic, the racing community is shaken. Well have to wait and see if calm minds can prevail. It crashed in a wheat field in Eastern Ukraine in the middle of a battle zone and there it remains. The dignity of the dead and their loved ones ignored by militants and Ukraine Forces fighting for control of the region. Now International Investigators have been forced to suspend their mission until the fighting stops. Joining us now is a man who knows this all too well, michael butraku, spokesman for the organization and security and cooperation in europe. The osce. Thats what we kept referring to, the observers, the best eyes on the ground, trying to keep the integrity of the scene in place, but harder and harder to balance. Good to see you safe here. Just the overlay for people, okay . It is getting worse and worse in the area surrounding the crash site what is it like to even try it approach it . Thats why we had to suspend. It is getting worse because the front line has come right through that crash site. And we had to suspend our visits there a few days ago because there was shelling going on. We had more than 100 experts from two or three Different Countries there. And they were shooting the other day. So everyone, you know, realized that it is not worth it, proceeding with the humanitarian effort of looking for those human remains, looking for personal belongings of the passengers. So dont want to create more death in a situation where were trying to go and deal with a death that occurred already. How frustrating is it for the investigators if they finally get there, the country freed up the assets, got promises they would be able to get there from the militants in ukraine. Very frustrating too. Dont forget they waited a long time to get in there. And now they cant do their work. And we have always said, chris, the worst thing that could happen, if that front line comes through that crash site is going to be exposed more to human and natural factors that no one can really control. It has been weeks now. Were showing you this, just to give you an idea how big the area is, this plane fell from five miles up in the sky, some of it landed in a direct line, much of it did not. These are the areas, the yellow is where the investigators have been able to get. Largely the open areas. Okay. The concern is that in these orange blocked areas you have density of people, but a lot of debris there as well. And our best, michael, if im right, as i remember correctly, mostly from what youve told me, that most of what we know about these areas in orange is what villagers have brought forward and said, look what i found, look what i found, not forensically done. Correct. And because we cant bring experts in there right now what were going to be doing the next few days is passing out leaflets and encouraging villagers to come forward if they found any belongings. Big agricultural area as you know. So farmers are going to be asked to maybe hold back on cultivating their feels until an investigation can be completed. We feel so much for these people. Not only did they live through this airplane literally raining down on them, but also now a conflict that has come right to their doorstep. No electricity, water, food is difficult to come by. It is the worst of all scenarios. People are dying. People are dying. So now we get to youve had a really unusual experience. This is not what youre supposed to do. Youre not a crash scene investigator. Not an aviation expert. But youve been the best set of eyes on the ground because nobody else can or wants to get in there. So youve been taking tons of photos. And youre getting these impressions as you go along the way. As we look at these different sections of the aircraft, each one means something significant to you from what youve seen on the ground, the cockpit, why . Well, the cockpit is one of the first things we found, and it you can see it pancaked, slammed in the earth. What happened almost immediately is you had First Responders coming and what they hacked into it with a power saw, possibly looking for human remains, but thats one part that got really disturbed. They may have been having a negative curiosity of trying to find the black boxes that became such a source of intrigue. Why would they want those and why . That takes us to this picture. You havent had expert eyes on a lot of this, but youre feeling and looking at it and talking to the people with you and the monitors believe there is unusual markings on this. Yeah. I mean, we have four different groups of experts to the site and they stop and go, wow, a big wow factor when they look at this fuselage. You can see here these pockmarks. And this is unique to the entire airplane this is part of the fuselage, chris that comes from near the cockpit area. So we cant draw any conclusions as you know, but these were really, really unique marks on that piece. The speculation is that it is shrapnel that would come from a missile, which the militants say they dont have, but now all of a sudden they got one because they just shot down a plane with the exact same kind of thing. Where is the next area we look. I just had a birthday, i cant see anything. This is the largest single piece of the fuselage in one piece, in tact, meaningful because well, it fell straight down. So it is hitting kind of in the woods. We stumbled upon it. You can see there are 17 windows here and it is the only part of the aircraft that kind of remained in tact where you can walk in and, you know, have cover. But, you know, this was the Economy Class section and huge piece hidden in the woods. We found it and the investigators looked at it very carefully. Thats the last reminder you want to make for people. Your organization is committed. Youve been there a few months before, monitoring the violence. But we havent had the Forensic Experts to tell us what happened here, so we can get the answers and look for accountability and there are still dead there. There are human remains there, we know that. And, you know, it is such a sad thing. We really feel for the families. Our hearts and prayers go out to them because there is a discrepancy of 70 or 80 bodies according to the dutch. You can imagine how the families feel. As a monitoring mission, we have 270 folks in ukraine now. We stand ready. When conditions improve to continue that work with the experts. And yet at this point you stand in the middle of two groups of people who are more folk o focused on more violence. We facility dialogue, thats part of our mandate to bring the two sides together to bring about deescalation. It is a dangerous job. Hider al abawdy is the Deputy Speaker of the parliament now and former aid to the current Prime Minister Nuri Al Maliki. Maliki resisted calls to step down and intends to stay in office for a third term. Iraq has been entrenched in political turmoil as isis militants seize territory and slaughter thousands of people. What remains to be seen what this announcement will do to the political turmoil happening in baghdad. Well have much more on that coming up.
