After turning up empty scouring twothirds of the intended seabed so far. The search in the air drastically scaled back due to rain, poor visibility, and she i have seas from Tropical Cyclone jack. It represents the best guess as to where the plane may be. If nothing is found, the search area may widen dramatically with more equipment. Investigators say theyre in the early stages of talks on longterm search plans, as far out as july. On monday chinese families ofs those on board flight 370 arrived at a Beijing Hotel expecting a briefing with technical experts from malaysia. But that meeting was canceled. The families turned away. Even a small pieces, they havent found it. So we really doubt the whether its in the right place or not. We just want to help them check it. Reporter some of the families saying theyre not convinced the bluefin21 is looking in the right place. They say they have too many lingering questions. Kate . Erin mclaughlin with the latest from perth. Thank you so much, erin. The death toll rising again overnight in the ferry disaster off the coast of south korea. At least 108 bodies have now been covered from the sunken fer prip as dive teams search the vessel trying to find the nearly 200 that are still unaccounted for. Lets get to Nic Robertson who has the latest live in jindo, south korea. Nick, have they acknowledged at this point they are moving into just a Recovery Mission or do they believe that theres still a chance they could rescue some survivors . Kate, officials here are still calling it a rescue mission. They stand by that. There is a hope that people may be trapped in octobers on air aboard that ship. Today another very tough day for the families, a tough day for the divers down below the waters as well. Reporter the arrival of each police boat brings some closure to a few families of the missing. For so many more, the uncertainty continues. The scope of this tragedy becoming more evident with each body brought ashore as authorities hearsay most of the people they find are still wearing life vests. The company which operated the ferry posted a public apology on their website saying, in part, we apologize to all the people who are grieving for the loss of their loved ones. We beg for forgiveness from the victims families and we pray for the dead. The search for survivors in these waters are dangerous. Low visibility and debris aboard the ship make it nearly impossible to navigate. Divers must first swim down over 100 feet to reach the ship. Then the difficult task of breaching the wall of the vessel. Rescuers focus their search on the third and fourth levels inside a lounge and cabin area where they believe most of the students are located. So far, seven crew members in all have been detained, including captain lee jiang sock featured here in this 2010 safety video. Once touted as face of safety, he is now charged with five counts of criminal activity including abandoning ship which carries a hefty sentence of life in prison. Weve been learning more details from some of those arrested crew members outside a courtroom today saying that they were struggling to right the vessel that was listing, that the cap pan was was in the bridge there with them and a that they couldnt get to the life boats to release the life boats. Chris . All right, nic, thank you. Theres also some news other newsbreaking in the region. Overnight, concern north korea is beefing up its nuclear program. South korea is detecting fresh activity at the norths main Nuclear Test Site so the south is in turn stepping up its military readiness. All of this is happening ahead of president obamas trip to asia. Paula hancocks is in seoul with the latest. What do we know, paula . Well, chris, the ministry of defense here in south korea say they have detected increased activity at the sites. This is where the last three Nuclear Tests have been carried out by north korea. Theyre not seeing exactly what they know or how they know it. You would assume they know it from increased satellite activity that they have surveillance in the sky. What they are telling cnn is at this point all thats left is the political decision. It looks as though north korea is physically ready for a possible Fourth Nuclear test saying they need to dig the underground tunnel, the entrance of the tunnel, and seal it up. They have done this we three times before. They have done it within a month of warning about a nuclear test in the past. Remember, last month, just 19 days ago, they did warn they may crry out a new kind of nuclear test. So this would be in keeping with previous practice from north korea. The experts are assuming this new kind of nuclear test may be uranium rather than plutonium. It comes a few days before obama reaches here and the timing has to be looked at quite closely. The Foreign Ministry say they believe obamas trip is a reacti reactionary and dangerous one. Lets look at more of your headlines at this hour. S hard to believe the more you learn about it. Hard to believe, kate. The Surveillance Video reportedly shows this teenager hopping the fence at san jose airport the day he boarded the flight. The fbi says theres also video of him walking across the tarmac to that plane. This morning that teenager remains in the custody of Child Protective Services with one incredible story to tell. Airport crews in maui were the first to spot the 16yearold. His arrival here, tend of a nearly fivehour, 2300 mile journey across the pacific in the wheel well of a boeing 767. He was weak. He hung from the rear well and fell to the ground and remained some strength and stood up and started walking to the front of the aircraft. Reporter this morning there are new questions ability how the teenager managed to go undetected. Airport officials in san jose say they arent filing any criminal charges at this time, even though Surveillance Video reportedly shows him hopping the fence on to the tarmac and walking to the plane. It is possible to scale an airport perimeter fence line, especially under cover of darkness. Reporter that was just the beginning. That teen reportedly hid himself in the landing gear compartment after he ran away from home on sunday with little oxygen and subzero temperatures, he flew to an altitude of 38,000 feet. But the only way i can see he got up is climb up here. Reporter aviation inspector robert elder showed us just how difficult this feat is. Climbing into a wheel well less than ten feet across, just inches wide. Once the gear is up, hes got a little bit of a corner where the tires make the circle. He could actually stand on this door and probably maybe stretch a little bit. Remember, above about 14,000 hes going to pass out because he has no oxygen. Reporter which is exactly what the teen reportedly says happened. Telling airport officials he blacked out after takeoff and didnt regain consciousness until he landed in hawaii. Airport officials in maui say that teenager only had a comb on him. Crews say they bought him some lunch and a bag of cookies because he was so weak. He was treated at the hospital and released to Child Protective Services who have notified his family that hes safe. Kate and chris . Amazing tale. They issued a list of 26 questions for malaysian authorities. Despite multiple meetings the questions have not been answered. They really havent even been addressed. Instead the families were pressured on a timeline for, quote, moving forward including the issuing of death certificates for their loved ones. Meanwhile, the search continues to come up empty only making matters worse. We have with us mary schiavo and represents victims and families after airplane disasters. And an airline accident investigator, airline expert. Mary, i start with you. Counsel, i give you 26 questions. Many of them we have them here are simple. Whats is serial number on the black box, can we have the manife manifest . I am starved for information and you dont even address the questions . How can the investigator justifies this callousness . Well, they really cant. Particularly if theyre following the International Civil Aviation Organization standards. And already they were supposed to have had an initial report issued and then brief the families and provide to the families information as it goes along. As you can see from the list of the families questions they really arent questions that in any way, shape, or form would parallel the criminal investigation the malaysian Authorities Say is going on. Theres no reason to have failed to keep the family advised and try to answer the questions. Some of them they may not know the answers. But, for example, why the emergency locators didnt go off but they could provide them many of these many of these answers. And yet they didnt. Right . And thats going to be one of the continuing problems here. And they did not. Many of the families, they dont believe that this plane is gone. They dont believe that all is lost and yet theyre just losing more and more confidence in the investigation. That cant be good. All right. So, shawn, the bluefin, tenth session. Okay . Now, i have a source on the military intelligence side. He says that he believes that they are being pushed to search too much beyond the capabilities of the area as they understand it. Do you believe that that may be whats going on here is that theyre being forced to show progress instead taking the time to think about what to do . Well, you know, im not really sure we have any evidence of that. I think what we have to be very mindful of is that very larch area were searching, right . And still some area that sun searched. Two thirds of the way through this primary area. So, you know, until we get every square kilometer of that initial search area examined, you know, im not really convinced that all hope is lost. You know, i still, lets finish the search effort that is under way now and then we can talk about plan b. You can look at it two ways. On one side, past twothirds, that supposedly yesterday. And look at air france 447, mary, and that was two years, om ten weeks of searching. David gallo says thats because we took a lot of time in between searches the do the best recognizance we could do before we moved forward. Right. And they had the coordinates where they believe the airplane did enter the water. They had debris and three underwater search vehicles. Even with all the additional assets and information, it took a long time. So, yeah, im with shawn. They have barry began the search if you compare it to some of the searches in the past. This is still in a preliminary stage. So its certainly not hopeless at this point. Its very expensive. At one point or at what point does the cost start to impact your decision on continuing the search . Shawn . Well, you know, i im sorry. Was that for me . Yes. Okay. So i think the question is really, you know, what are the what are the resources that theyre really willing to commit to this. At this point in time i dont see any indication those discussions have taken place. Of course, we have no idea whats being discussed behind closed doors. With all the military assets being used im not sure theyre at that point yet of saying that, okay, weve reached a predetermined limit. Lets go ahead and scale back. I think theres still a lot more that can be done. I think that really is going to be guiding factor instead of necessarily a numerical value on when we should slowdown or stop. Mary, one final point. You know, just as informational point. We know the cyclone is going on there. We know why it disrupted the search. Obviously anything thats on the surface still and thats very unlikely, theres less chance now because the cyclone will blow it around. I mean, thats just a point of information. So that cyclone is going on. Theyre going to continue searching. And that really leaves us with this issue that we started with. They didnt answer the questions of the families but they do put out this useless information about the altitude of the plane. We think it is now 39. They dont know its at 39 any better than they knew it was at 43, any better than at 4,000. So why throw that out there yet not address what the families are asking you . Exactly. That is a complete mystery because we have now had at least the third set of altitude data. Remember, at one point they were saying it went to 45,000 and then dipped low and there were theories about why they did that. Then they said it went down to 5,000 and flew across the malaysian peninsula. And that turned out not to be accurate. Now weve got this third set of data. I think really whats behind it is they dont have good altitude data and i think we will find as the investigation goes on that some of the persons who were supposed to be monitoring the radar were asleep at the switch. I think they simply dont have it and are trying to reconstruct it. Shawn, quick last word. Yeah. I agree with mary 100 . Heres the deal. We talked about this three weeks ago. These data points are very, very suspect, right . So placing all of our hopes an all of our goals predicated on those data points, as we said weeks ago, is extremely challen challenging. And really we have to, you know, eye that data very, very carefully and realize the limitations that it really posse possesses. The question for investigators, if youre going to stick your neck out and speculate why speculate things that dont help the search when you could at least extend that curiosity to the families questions and give them comfort. The search continues this morning for missing malaysian flight 370 as the blue february droen mak drone makes its tenth mission. They will suspend air traffic activities because of weather. Aircraft captains will assess weather conditions onsite and decide whether to continue on or return to base. The bodies 108 have been brought to the surface. 194 people are still missing. The Company Operating the sunken ferry issued a formal apology begging for forgiveness from the families of the victims. Meanwhile, south korea says its detected increased activity at north koreas main nuclear test side. Seoul stepped up military preparedness in response. The north has already said it wouldnt rule out another nuclear test. The last one was over a year ago. These nuclear concerns happening as president obama prepares for a trip to asia. He has stops planned in japan, south korea, malaysia, and the mi philippines. The trip was planned for last october but pushed because of the government shutdown. The president will be stopping in Washington State on his way to meet with victims families of last months deadly mudslide. That area still recovering from that devastation. Its going to be a long time. Certainly will. All right. Altitudes well above that of mt. Everest. Temperatures lingering in the negative 70s, possibly the negative 80s. So how could a teenager survive a flight from california to hawaii traveling within the landing gear wheel well of a boeing 767 under those conditions . Joining us to discuss dr. John brookbar, professor of nur report neuroscience at cornell. Im sure you would say its hard to believe and this is one lucky boy. I agree with that. Most of the medical community would agree with that also. This is quite a miraculous recovery. The brain can adapt to these high altitudes and low oxygen situations but surely this is not something that we see frequently. I feel like every doctor i know has a story of a medical miracle they come across that beat all the odds. Have you ever heard of anything like this . Well, i treated that window washer that fell 47 stories and survived. So these story s do happen, like you said. This is one of those stories that is somewhat hard to believe. The duration and the altitude are the two factors that are truly difficult to understand. I want to ask you kind of the affect of both of thosefactors. The altitude, meaning the lack of oxygen on the body. What does that do . We all have mechanisms to deal with those situations. Should they kis. For example, if a child falls into a pond thats frozen, their bodys heart can stop beating, brain can stop functioning. Yet, when that child thaws, they can be revive and live a near normal life. We do have mechanisms to allow us to survive these extreme situations. So the combination of the affect of the lack of oxygen and the affect of the subzero temperature, do you believe that somehow worked in this boys favor . Well, yes, and i think that his youth is his biggest asset here. How so . Well, much like our brake pads are better three days after we buy a car than three years after we buy that car. Our bodys ability to repair itself and survive these extreme situations are better with youth than with age. And then when you take all of that into consideration, i wonder, they say that when they found the boy he was kind of Walking Around the plane kind of dumbfounded and dazed. Do you believe could you see there being lingering or any longterm effects or problems because of what this boy experiences . Well, thats actually the most remarkable part. I would we would have expected that he had a slower return to normalcy than walking out of the plane an hour later. So its hard to evaluate exactly what the longterm effects would be, whether theres been tissue damage, whether theres been frostbite, whether theres been kidney, injury, or any muscle related injury. Because he walked an hour later, thats awfully surprising. And he doesnt remember any of this flight. He told investigators that right after liftoff he went unconscio unconscious. At what point of lack of oxygen or the temperature drop do would you suspect he went unconscious . There may have been some gradual affect where there was an abrupt termination of his consciousness and that may have helped him. Somewhere above 25,000 feet we expect him to have lost consciousness. A couple of minutes into the flight. If this is true, but authorities are taking this very seriously. Right. And all of the evidence that they have so far, video in san jose and video in hawaii, is that this actually happened. What do you think is i think you pointed to it, but what do you think is the hardest thing as a doctor to believe and how this played out . Duration, altitude, and the low oxygen and temperatures are really very difficult to believe. Should he have frostbite . He should have frostbite. He should not have walked an hour after this event. Thats whats most reremarkable do you think its his youth or am i searching for the answer where this answer should have been this shouldnt have been able to happen. Unless hes a super hero, this is not something that we would have expect to have happened. He is one lucky boy. We can all agree on that. Doctor, its great to see you. Mo nearly 200 are likely somewhere in that sunken ship. The accident is sharking questions about safety and training on passenger ferries worldwide including here in the United States where millions ride them each year. Captain james staples is with ocean river maritime consultants, cargo ship captain. Two quick questions as we try to figure out what happened here. On the captains side you say take a look at the narrow sage way here and his knowledge of the cargo displacement and organization on board. Because . Thats his job. Its his responsibility to know what the stability is, whats been loaded on his ship. Hes the overall supervisor of whats happening and all the operations of the ship. And most likely to you in this scenario is that something onboard shifted and caused this problem and in that narrow passageway it may have been exacerbated by the route he took through it. Thats correct. Thats the most obvious conclusion im coming to, he had a shift in cargo on board the ship. Third mate, young at the helm when the captain was not, says she didnt make a sharp turn but the ship did turn much more than usual. What does that mean to you . We need to look to see if it was a mechanical fail were the steeri steering gear, maybe on if they had it on board this ship, if they were using that. We need to look at that type of stuff, if it was a mechanical or some type of navigational error with the equipment. All by itself, young third mate at the helm, captain not there. Not entirely unusual . Not unusual for the third mate toby themselves but usually not in a situation where its a critical area. Where theres a lot of traffic, a lot of current. Thats where you would want to be as captain, up there just to make sure in case anything did go wrong you were there to supervise it and to oversee any problems you had. Thats a point of concern. Thats a real issue. Yes. So now, lets look at the divers. Were hearing that they are under tremendous strain and now were going to run a little video simulation of what theyre up against. On top of having to deal with all of these dead kids theyre finding and adults, what are the conditions like under watter . Bad visibility and a lot of current. Theyre getting blown around, a lot of strength it takes to maintain youre own physical integrity. Absolutely, yes. And theyre going through the corridors. Having to cut. Were making it visible to make it helpful to people at home. They probably cant see their hand in front of their face. Its probably that bad. Its a very hazardous, dangerous situation these guys are working on. My hats off to them. These guys are doing a great job. The lines theyre using are in lieu of tanks or are they security things, are they fuel ways . Im not a diving expert. Im not sure what those are but i believe its something they use to connect to the shore side, up top to the boats. Keep their oxygen going. That makes them careful because if youre tethered youre not as mobile. I would assume. Over time, the emotional strain to deal with death in this way, how much of a toll . I think thats going to take a great toll on them. I can imagine what theyre going through coming upon Young Children in this t state after being under water for a week. That takes us to the people who are really most in agony, those left on board. When you look at the levels. We broke it down this way. This is what we believe the capacity was. In a situation like this in the what to do if you are, god forb forbid, ever in a situation like this where is the best place to stay . I would not stay in the lower part of the vessel. Common sense . Common sense. Get to an open space. Get somewhere where you can get off the ship in a up kofl seconds. Once you start getting down below the deep of the vessel its almost impossible when youre inverted 180 degrees. The problem is most capacity is in the place you least want to be which is the deepest down in the vessel. Correct. When a ship is in a critical condition. And that then gets you to the timing of when youre told to evacuate which is another point of scrutiny. A timely decision was not made. The concern that people have in the u. S. Is a lot of people take ferries. Not on 13hour trips like this one. This was really like a cruise ship. The level of certification of the sacaptains, training and simulations for what to do in an evacuation, do we do that right here . In most cases we do. If we lock at the Washington State ferry system, they operate 22 ferries. Some are as large as this one here. Up to 400, almost 500 feet with capacity of 2500 people, 200 vehicles. These guys have deep Sea International licenses. Very well trained. They have a great accident rate. Yet, we can still look back to 2003 with the Staten Island incident that we had when 11 people were killed and 165 people injured. We found there that there were two things we needed to look at. One was the training and the other one was the medical condition that the operator was in. We found that he was using prescription drugs in combination, caused him to be drowsy. And then we also went back and looked at the Safety Management system of the operator. Saw that they werent following the policies and procedures that at the time of birthing when the ferries come alongside the dock there should be two operator tons bridge just in case that happens. We saw that wasnt being done. Something were going to have to look at with the ferry incident, too. So its not about whether theyre properly trained, its whether their training is being put into practice. Just as big an issue as anything. Thats correct. And the company has to believe in a safety environment, safety culture. Thats where it starts. With the company to impress upon the captains that theyre going to be in a safety culture. They need to do the proper training and they need to follow the Safety Management system which is in placen of every vessel. Still trying find out what the training level was and feed it into the calculation whether or not they made the right calls at the right time. So the big question is obviously now, when were hearing about the captain he did make it off. Crew members did make it off obviously so many passengers did not. One of the important questions still being asked by Family Members of flight 370 is, why the four emergency locator transmitters loan as the lts, did not send any distress signals. These lt rz designed to transmit a signal when triggered by a cra crash. Mr. Joeff wise is here to do a show and tell. We have an elt right here. This is different than the one on the 777s, correct . We dont know actually whats on the 777. This is one of the strangest things that Malaysia Airlines has not told the public whats on the plane in is quite common in 2002 when the plane was built. This is an old version. This would send satellite signal up to satellites to other aircraft in the area. And they would be able to triangulate in and find it. The Newer Versions transmit information including the location, gps, identity, a phone number that you can call. Really . Its much, much easier. Much more tech logically advanced. And highlight the difference between flight data recorder or the black box that weve been looking at. Okay. So this transmits a radio beacon. This is an merge distress locator. Yeah. This is the recorder. So this is recording flight data. Its recording voice, cockpit voice information. And inside it we have this acoustic. This is sending out this is the thing of the hour that were trying to sense. This is what the whole world is hoping to find. This is inside this box. Its sending out an acoustic signal, not radio but noise essentially. This is inwater to be detected. Whats most fiing to everybody is that neither of these were picked up, detected, et cetera. I want to show you something here that actually caused me a little bit of a concern. Okay. Thats an on off switch right there. Right. Thats an on off switch. I could easily flick it off. We know there are four of these elts on board the plane. Would it be easily accessible and could you switch them off . One is in the cockpit. Listen, so its off. Or its on sort of stand by mode where its if it gets a certain gload, meaning if the plane hits or stops abruptive, then that will activate it. Thats a crash, essentially. Or you can just turn it on. There might be a situation where a pilot has to land somewhere far away and he hasnt crashed but hes also off the grid and maybe wants people to know where he is. Then you can manually turn it on. Two of them are located indoors, in the life rafts. Specifically. The door opens, the life raft comes out. The elt is in there. And then so youre floating around in the ocean and youre sending out the signal so rescuers can come find you. Again, thats not easily accessible. The idea that someone would have manually turned them off is unlikely. Its likely they were submerged before located. And because they do not work in water, the elts. Thats right. If theyre under water theyre not going to work or if it might have landed so gently the gforce was not sufficient to set it off. The older models are not completely reliable, only working 80 of the time . Exactly. No, sometimes as low as 25 . The new ones only work about 80 of the time. So theres a lot of reasons why we might not hear the signal. The pinger only you have to be within a mile undert water. Thats why theyve had such a hard time finding it. This, instantaneously, the new ones, anywhere in the world can be detected by the satellite. The older ones you have you to triangulate in. It takes longer. It would be nice to know from the airline if they were carrying the older one or the n newer, more sophisticated ones. Weve heard about ebbs tending the battery life on the pinger locators. Do you think were going the see a movement to increase the accuracy of the elts because of the mystery of flight 370 . Were sort of in the middle of a transition to a newer better technology. And thats still under way. So thats definitely something that i think the authorities would like to see. Because we havent had a signal sent from here, admitted from the elt, does that tell us anything, does it speak to the investigation . Does it change the investigation . Well, theoretically it would shift the probability but cant determine anything for sure because of the problems of reliable, because theres Different Reasons why you might not hear it. We cant say, well, it deaf t it inially didnt. For instance, when captain s sullenberger land it in the hudson it didnt set off because it was a fairly gradual, gentle miracle on the hudson. Right. Inside this. This is operated by a lithium battery, correct . Okay. And these have been known to lithium batteries have been a fire hazard. Right. You might have heard about the 787 dreamliner that there was some smoke and fire in a plane and that caused some hull damage actually to a plane that was on the ground in england. And that was a different configuration from the 777. These are all things that investigators and searchers are looking into. Yeah. Every possibility. No stone is being left unturned. At this point weve got so little to go on that every contingency has to be examined. We wanted to look at these with jeff because this is one of questions that the community of families put together a list of 26 questions and one of the questions they had was about these elts, emergency locator transmitters. The search for survivors in these waters is dangerous. The divers are experiencing just darkness in the sedimentse no end in sight, no sign of flight 370. Officials say crews organized russian activity. I have no doubt at all that putin and the russians are behind this. They are not pressing charges against the teenage boy who climbed into the landing gear compartment. He had to be in the right spot otherwise he would have been crushed like a bug. Good morning. Welcome to new day. It is tuesday, april 22nd. 7 00 in the east. Breaking over night, new fears north korea is stepping up its nuclear program. South korea says it picked up new movement at the north main test site. The timing is coming into question with the south dealing with that ferry tragedy. Reporter chris, the ministry of defense telling cnn they are stepping up their activity in this area in the northeast of the country, the exact area where they have already carried out three underground Nuclear Tests over the years. Now we do understand from the spokesman that all that is left is the political decision, suggesting that they are all but practically ready to carry out this nuclear test. Now, we do understand that they do have to dig the entrance to the underground tunnel and then seal it up. But at this point theyre not telling us exactly what the intelligence is that they have, that they do say they have stepped up this activity. So, the South Koreans are on 24hour watch to see what is going to happen. They have increased their military readiness. And it does come at a time when president obama is heading to asia and hes going to be here on friday in seoul. Now, the north Korean Foreign minister has talked about obamas trip calling it reaction their and dangerous trip. Just to put the preparations into context for you. In the past, the underground Nuclear Tests they have carried them out after warn that they would within a month of this warning. Now, this time, just last month, 19 days ago, that they said they may carry out a new tripe of nuclear test. Experts are assume that means it will be a uranium test rather than a plutonium test. At least 108 people are now confirmed dead. Divers are searching under water and very tough conditions around the clock for the nearly 200 who are still unaccounted for. Its still considered a rescue mission, hope that pockets of air exists. The divers working today on the third and fourth levels of the ship in an area they described as a lounge area. They want to punch through the wall of that and get into the cafeteria area where they believe there may be more missing people. Theyre also searching the cabins. The rear of the ship on the fourth floor. But very emotional scenes today as the bodies brought ashore. Each body given its own ambulance to be driven off in, very sullen, dignified processions of stretch bringing those bodies to be driven away. For the families, some families from today will have the information that theyve been dreading but it will help give them closure. Many more families, of course, waiting uncertain about what subpoena a i happening. We have heard of the crew member, four of them in court, arrested, saying the ship had been listing, it had a problem with trying to right it, that it was a historic problem with this ship. Also saying when they went to try to get to the went to try to get to the life rafts, they werent able to reach them to deploy them. These details fresh today. Back to you, chris. Meanwhile, Tropical Cyclone jack is forcing authorities to call off the air search for 370 overnight. But the underwater search is still on going and the bluefin21 is on its tenth mission. Chris, that Aerial Search may have been suspended today but by the time they made that decision, four military planes were already in the airs facing difficult, possibly hazardous conditions. Conditions that didnt seem to have affect on the bluefin21. Now as far as we know, still under the water on that tenth mission. As of yesterday, it had searched about twothirds of this very critical area, the areas designated as the most likely place that they will find the black box based on a limited set of information that they have. But with most of that area now ruled out, officials beginning to ask, what next . Theres been talk of a broadening of a search area introducing perhaps more underwater submersibles. Spokesperson for the u. S. Navy telling cnn that the Key Stakeholders are at the early stages of these discussions and theyre planning for as far out as july. Kate . All right. And miles obrien, cnn aviation analyst and a science correspondent for pbs. Good morning to both of you. Lets start might where Erin Mclaughlin left off in perth, australia, miles. The u. S. Navy telling cnn that they are now in the early stages of talking about now how to proceed with the search on a longterm basis. Planning as far out as july. What could those plans include, do you believe . Well, more undert water searching. The problem is that its a big ocean. Its deep ocean. And the bluefin is right at the edge of its capability. Its done a fair amount of searching. Theres still more to do. And its not exactly specifically clear where those pingers might be. Theyve heard them. They think here in the right area. Theres still a lot more to go. I think the level of patience that we all need and the families especially is its a big challenge at this point. Put it that way. Absolutely. And patience is an important thing to note, miles. They said, miles, that there are two thirds of the specific search area has now been covered. Do you think that confidence is we waping on parts of the investigators and search crews or more pressure from the outside to look for whats next if this isnt it . Oh, i think the people on the water as it were have a different kind of time frame than we all do. I think the amount of pressure that is here and understandably given what has happened doesnt jive well with the reality. When you think about what happened with air france and a twoyear search, which actually only amounted to about ten weeks of actual searching, i think that people have to readjust their expectations here. And thats a terribly difficult thing to say to families who have so many unanswered questions. A whole list of them, as a matter of fact. I want to ask you about kind of about the families, mary, but to button up the point miles is thinking, what should the expectations be at this point . Lets see if this search area doesnt pan out, they cover it all, this is the area theyve put so much confidence in. They put everything they had in it. They dont find it. Whats the impact of that . What should the expectation be . Well, the expectation, and this is based on other accidents and other sea searches for other wreckage, is that its months. Its a months long process. Probably a similar situation with the crash of adam air in the java sea. It crashed in january and it was august before they were able to get the black boxes. They couldnt find any wreckage at first. They had to give rewards for people to turn in wreckage. And this it was a much smaller search area. So i think that the authorities, you know, a lot of times they make statements just trying to get through the moment. I think they realize that theyre in for a very long haul and the families are being more than patient but a little question answering would help. If the malaysians would tell them the answers to the simple questions theyve asked it would go a long way in helping them deal with this. On a topic, one thing has come up in a recent press briefing that i have to ask you about. There is now a discussion on some level of the and when they should issue and on what timeline death certificates. Kind of approach that topic with the families of the passengers. Clearly, a complex issue and that saying nothing about the emotional toll that will have on the families. What are the considerations, what should be the considerations of that . Well, we face this also in the post 9 11 attacks in the United States because there were many families and i know some who did not get any remains for years and some never did. It was a very decision to decide when to issue the death certificates. But the death certificates are very key to a lot of the next steps. You have to have them for various insurance policies. By the way, the airline is insured not only for its liability, for things it did wrong to take care of the passengers, but it has its own policy to cover it for terrorism, san tabotage. Some is often triggered by the death certificate. People should look at it as a formality they have to have to get the benefits but the search wont stop because they issue those. In fact, it will go on just as rigorously as before. But thats something that has to be done to trigger some benefits for the families. Thats an interesting clarification, mary, i didnt know before. Miles, your final take. You said that asking for patience from the families is about the hardest thing to do. I think we can all agree on that. The families have put out this list of questions that have ranged from the very simple to the very technical. What do you what kind of information do you think families are entitled to . Well, its interesting the list almost matches what im interested in finding out. You know, there are two things to think about here. You have a criminal investigation. I think we can all agree sensitive material that relates to any sort of criminal activity that might be involved in this flight probably needs to be kept secret. But theres a whole body of information which can be released which is not going to change or affect a criminal investigation. Air Traffic Control tapes, transcripts, what was said between city center and the crew and the aircraft. This is not going to effect the criminal investigation one way or the other. And it really would go a long way for the families specifically giving them answers but also as a show of good faith from the malaysian officials that they care about their needs at this point. Because theres still a huge emotional issues here. It seems that relationship seems to be getting worse and worse as every day passes. Thank you very much. Chris . Whats the answer . The answer is we know exactly how he did it after the fact. Thats the problem youre talking about, right . So every airport has an out of perimeter and outer perimeter security. But the question is, in this particular airport, can you watch the full perimeter 24 by 7, usually the answer to that is no which is why airports like newark, remember, we had that case where a guy jumps over a fence. Theres a camera and electronic system. It feels the sensation on the sense, directs the camera to look at it and directs security people to look. We dont really understand what happened here. We now know that this young man jumped the fence in the darkness. They have now video of him on the tarmac a etch pring this plane where they got in the wheel well thaw goring e ing go go back and understand what is the outer party in this airport and why didnt they pick it up at the time it happened to prevent this young man from getting inside the plane. Im still not getting it. People secure perimeters all the time. Right. Prisons, businesses. You put cameras up there. You pay someone to watch. When someone jumps over, you notice. Right. This is not a sophisticated situation. Its not. Its not the first time it happened. Not just people randoming jumping over the fence but st stowing away. Statistically, according to the faa, since 1986, 105 stowaways and 94 flights worldwide. Thats pretty small. You know what though, its a lot more than youve had of 60yearold ladies that youre making take off their shoes and all their clothes as they go through your scanning devices. Why arent they paying more attention to this and checking the wheel wells . Chris, its the right question. I think i going to get more attention. Though you do have to say, for one, its a very dangerous thing. Less than 25 of those who climbed in the wheel wells have survived to tell the story. We know, one, this kid is very, very lucky to be alive. And may have longterm permanent damage as a result of it. This is a solvable problem. Thats your point. And why havent, for the billions of dollars that weve spent on Airport Security, why havent we solved it . Its the right question. You know, i think people would say to you there are easier way it is youre a real bad guy of actually getting into an airport, getting on a plane and actually wreaking havoc and this is not a method that theyve identified as one used by terrorists. And so i think its gotten less attention. Thats the frightening part, is that you only recognize things after you get burned by them. Thats right. Its a silly thing to do. When youve got my 11yearold padded down on an airport. The perimeter security, too hard to keep them from jumping the fence. What . You cant stop someone from jumping a fence . Jumping the fence, the stowaway in the wheel well is kind of not the real issue, right . I mean, what we ought to be asking the Security Officials is, well, if a terrorist jumped a fence and planted a bomb in the wheel well and didnt get on it, thats the problem. Look, theyre going to have to go back and do a Lessons Learned and understand at various airports, tier one airport like jfk and newark, they do security runway. But they have to understand what they need to do to prevent this problem. Right. I do hope one of the things they usually do is punish the person who did it. I hope that does not happen this time. This troubled kid. He did something wrong no, question about it. But his intent was clearly just to escape as opposed to do anything wh anything. Seven crew members are in custody including the captain facing a series of criminal charges for his role in it. South korea says its detected increased activity at north koreas main Nuclear Test Site. Seoul stepped up military preparedness in response. The north said it wouldnt rule out another nuclear test. The last one was over a year o ago. Its been 46 days and no sign of flight 370. This morning the air search for the missing Malaysian Airlines jet is suspended because of bad weather related to a cyclone in the area. The bluefin21, the unmanned sub, is scouring the ocean floor for the tenth time. So far it has covered nearly two h twothirds of the area where the pinger locators picked up sound. Okay. Lets start, ladies and gentlemen, with the one number that matters most this year and thats the president s approval rating. Gallup put up the quarterly review. Look at the chart. Thats from day one of the Obama Administration. He started at 63. He is at the end of quarter 21. The president has been in office now for 21 quarters. At 42. 4 . One of the questions is if youre a democrat you want them closer to 50 . In a Midterm Election history tells us a president in the low 40s means his party is going to take a beating some november. Whats the biggest concern at the white house about nudging that up . The white house obviously is seeing these numbers are dragged down from the rout of the Health Care Law of 8 million enrollees. Optimistic these numbers will go up and president will not be a drag on his party. The question is how much better do things get, what happens perhaps and this tour to asia hes about to embark on. Help out those democrats in vulnerable states who are trying to weigh the decision on whether or not its smarter to cling closer to this president or distance themselves. And the last time we went through this, robert, in the sixyear context. Secondyear president , george w. Bush, at 38 . He could not move the numbers. The iraq war, unpopularity was going up. Bush could not move the number. This president has Foreign Policy trips theyre hoping the Unemployment Rate sinks in with voters in the country. They hope by septemberoctober health care is more pol latable. Maybe not perfect. When you look at the map, one of the president s problems is we look at a national number, 42. 4 . The big senate races are in places where hes already at a disadvantage, right . Arkansas, louisiana, places he lost twice. Thats right. I think the president has had some positive news with the obamacare and new enrollment numbers. The question is, that may be helping his numbers inch up a bit here nationally. But in those red states how is that helping democrats . Especially those vulnerable democrats . Im not see that really a major boost even if the president goes up three points, five points. Is that going to really help mark or Mary Landrieu, im not sure. It is i remembering up a little bit. If it inches up a bit more he may start getting a few more invitations in states marginal. Not the deep red states but the more marginal states. We talked about this a bit into last weekend and throughout the weekend. The Keystone Pipeline. The president has decided the administration has decided to delay a final ruling on whether to approve the rest of the Keystone Pipeline project. Karl rove was george w. Bushs architect, now a contriburib contributor at fox news. He says pandering to the base and pandering to big environmentalists donating millions of dollars to the Democratic Party says the president s decision was stupid. Of course it was about politics. Its all about politics. The president is concerned about the enthusiasm of democratic voters going into the 2014 Midterm Elections. He doesnt want to do anything thats going to depress that turnout. Is that what this is all about, thats all it is, not about policy, not about weighing your choices, its about keeping the Democratic Base happy so they vote in november . I dont think its fair to say us all about politics. If youre a Vulnerable Oil state democrat, the best news you could get is delay the decision, kick the can down the road past november to create that window. If youre a Mary Landrieu in new orleans, or if youre a senator not making a decision on the Keystone Pipeline. Its a doubleedged sword here. Help me though on the inside politics part of that, robert. If youre mark or mary from Energy States you want the Keystone Pipeline approved. So is it bad for you politically that the president said wait, hit the pause button until after the election, most likely, or does it maybe in a contrarian way help you because now you get to kick the president . Im leaning in that direction. Case study in democratic constituencies, labor unions want the pipeline. The environmentalists dont. And i think the president recognizes he needs the base to come out, nose environmentalists come out. If you are a Mary Landrieu in louisiana, she slams the white house. Creates distance between her and the president. We have drones now a factor in the Midterm Elections. Drones are a big issue in national security, a lot of court cases pushing the administration to release more information about them. This one has been kicking around the conservative blogosphere for a week. We have a Montana House candidate, matt rosendale, he doesnt think the government should be using drones or, in his words, spying on its citizens. This is pretty provocative. This is how i look from a government drone. And this is what i think about it. Some of the most provocative ads involve guns it seems in our politics lately. What does it say, robert, that you weve had rand paul on the early president ial primary making a name by going after surveil llance and drones. Saying this is your government. Your government is doing this and firing a weapon. Its amazing. When im out on the campaign trail, theyring looking more at rand pauls decisions and policies rather than the Republican National committee. Rand paul, position on nsa and drones, hes setting a new paradigm for the gop candidates. You get attention. I often go back to Susanna Martinez when run for governor of new mexico, he was out shooting guns, a candidate shooting obamacare, putting the Health Care Law out there in front of him and shooting that. Does it get your votes . In some small pockets. The issue of drones have been big on the news. Faa announced the first drone test this week as well. Its galvanized a lot of people who are concerned not only about privacy and these civilian drones, Unmanned Aerial Vehicles that are not armed but those on the other side concerned the government is over reaching the use of the armed drones that are used at the pentagon. Hes about to have his big annual retreat. Coming to that retreat, chris christie, mike huckabee, rand paul jumps out at me. Heres the guy of who came to power as tea party guy. More and more he is trying to hug the establishment. And going really inside politi politics. I spoke with rand pauls people. Hes meeting with romneys finance chairman this friday in boston and mapping out all the relationships at romneys retreat. He mows more than christie and ryan and others going, he needs to build these donor relationships now so when he runs in 2016, should he get close to the nomination theyre behind him. He lost the last election. A lot of republicans were mad the day after. Now he seems to be a big brand. He is. He is a big brand. I think mitt romney youre seeing him step into that role of elder party states man defining who he wants to be for years to come. He doesnt want to be a candidate that fades away into irrelevancy. More disappointment for families of the missing passengers of flight 370 or malaysian officials postponed a long awaited meeting. Relatives are desperately looking for answers to a list of questions. Some technical, some pretty simple, srurrounding the investigation. Sarah bajc is one of those press for an answer. She is partner of philip who was on board 370. Sarah, thank you very much once again for coming in to speak with us. As the days pass, it seems these briefings for Family Members have become more and more frustrating. In your writings i sense that must trace as well. What is your biggest frustration . The briefings have become more like a standup comedy routi routine, you know, black comedy or maybe gallows comedy. Our frustration is that there is no information given. The only thing that the malaysian government has released so far has been opinions basically. So theyve not released a single piece of data. And the families have basically lost their patience with it. So weve been businessly organizing ourselves. Weve been up to almost 200 total Family Members combined together between the chinese families, malaysian families, and families from other countries such as australia and india and, of course, the United States. And were going to start to put a lot more political and perhaps even legal pressure on the government to release data for thirdparty assessment. At this point do you think you want to or need to pursue legal action to get answers . We dont feel we have a whole lot of other choices because were certainly not getting any answers without it. Now, the jennifer exception within the family group, nobody is interested in compensation lawsuits, and were really quite sick of being hassled by attorneys trying to get us to sign on to earn millions of dollars. Thats got to stop. We really do need advice in how to pressure Malaysian Airlines to open up what should be exposed information in a criminal investigation. In a way that i dont think ive ever seen before or anyone has seen before, the sense of despair and disappointment is so obvious and palpable, can you describe the roller coaster of what it is like for families to go into these briefings . Youre a very reasonable person asking questions and getting nothing in return. Not only do we not get any information but we actually get distraction and lack of respect. I mean, the way that the families have been treated, especially these last couple of weeks, is completely disrespectful. And it just aggravates an already very painful situation, effort chinese families that are here that have such limited access to information. You know, the Chinese Government blocks a lot of access to International News and other types of communication. So even amongst our families group, were all pretty sophisticated people, we have to use like four or five different means of communication to bypass the chinese blocking and then the language barriers and everything else. Its actually complicated organization. In a situation that shouldnt be complicated to get simple answers. Exactly. One thing that has been brought up maybe in the past day or so is the issue of issuing death certificates. Have you been contacted, have you been asked about such a timeline, when you would think it would be appropriate to do so . No. Actually the nonmalaysian, nonchinese Family Members have not been contacted at all as far as im aware. So in talking with the australian families and the indian families and, of course, philips family, none of us has been contacted. At the malaysian briefing they did say that they wanted to get things in order so that paperwork could be processed including perhaps death certificates. They didnt say they were going to be issuing them. What do you make of that . Because i know that you and many other Family Members of those that are missing want to see evidence one way or the other before you are comfortable saying what happened to your loved one. What do you think of this approach that theyre making . Well, this is the second time theyre doing it. I mean, the first time they did it was on march 24th when they basically said, okay, its conclusive, were sure the plane is in the ocean here. And of course within days that was proven to be wrong or at least not proven but they restated their position and starteding looking someplace else. Now theyre trying to put our Family Members in coffins again. I mean, theres not the slightest bit of evidence that this flight has even crashed. Theres no wreckage. Theres no sightings. Theres nothing at all that could be deemed to be actual fact. Its only conjecture at this point. And so thats why the Family Members are trying to go back to square one to, to day one, and we want the malaysian government to open up the data that should have been opened up within days of the investigation starting to a thirdparty, in fact, yet still Confidential Group qualified to assess the data. The air Traffic Control audio, that should be public record. The radar for both civilian and military, the engine pings, not the analysis of the engine pings but the actual raw data including from as much as ten days before the flight so it can be looked at for anomalies. As far as the search that is under way right now on its tenth mission. Theyve come up with nothing in this search area. Theyre now talking about longterm plans, what the process would be if the search continued as far out as july. If this search does not pan out, if its for some reason called off, what then for the families . What then for you . Well, well keep going back to wanting to start over with the investigation. You know, what theyre doing now, searching in the ocean, is like continuing to try to bail out a boat when the hole in the boat hasnt even been found yet. Theyre just treating a symptom. Theyre not going back to the cause. And its absolutely astounding to me that they havent been willing to release that data. What is so confidential about the data sets that a thirdparty set of people couldnt come in and make new calculations on them because, clearly, the calculations theyve been making so far are wrong. Theyre obviously wrong because the plane has not been found there. So, you know, once bitten, twice shy. We want to go back and have a little more control put into the situation. You are going to keep the pressure on and hopefully continue to come on and talk with us about the process and the answers you guys are seeking. Sarah, thank you very much as always for your time. Two more crew members of that south korean ferry have now been arrested bringing the total to nine and more than 100 people have now been confirmed to have lost their lives in the disaster. Nearly 200 more people are still feared to be in that ships hull. Leading to questions about safety and training on passenger ferrys worldwide including here in the United States where millions ride here each. We brought in captain patrick little, a retired captain with the u. S. Coast guard and a former Commanding Officer with the u. S. Coast guard marines safety center. Captain, im not putting you on the spot about prognosticating what happened here, but you know the rules and regulations, whats supposed to be done, thats what we want to get out this morning. Beginning with abandoning the ship as a captain and crew, one of the big criticism. The captain made it off while people were still onboard. What are the rules and then what are the ethics involved . In general from a ship design and operation point of view, its long been a principle that the ship is its own best lifeboat. So in general, you want to stay with the ship, and theres a great deal of effort put into designing and building ships so that theyre redundant. So that if something happens, if theres some flooding, if theres a fire or other sort of emergency, the ship can stay afloat and people can stay on it. So thats generally rule number one. You know, obviously obviously, if it were me in charge, and i dont want to speak for the person, the people involved, but generally, the rule is that the captain is the last person to go down. So that would be the ethical consideration in that regard. Well, and is it just an ethical consideration . Because hes being charged with it in korea, and weve seen it before. Is there a law that the captain must stay onboard until everybody else is off . Im not familiar with what the local laws would be in korea. So youd have to get into that, and i dont think that im not aware that that is normally regulated. Thats a code of ethics. Thats a code of professionalism. It goes back to being a leader, a person being in charge or a person being responsible. Youve got people under your care, and you generally want to make sure that everybodys taken care of in an emergency situation. Another piece of new information that came out this morning is that theres a claim from the crew that this ship has had problems with listing in the past. Have you ever heard of anything like that . A vessel this size that has trouble with listing . Specifically, no. You know, ships are very large and complex entities. This is several hundred feet long. During the course of a ships life, you know, people bring on material, they bring off material. You might have design and construction changes, and if e the, the weights that are added and taken off arent done in a very even way, you could end up with a residual list, but that would be something you would notice at the pier. Its not typically common for a ship to be listing to some degree during operation, but it could happen. I mean, thats something that the crew will manage. You try to manage, you know, the list which is the side to side attitude of the ship, and the trim which is the fore and aft attitude of the ship during formation. The main concern here in the u. S. , we dont have a lot of voyage ferries in the United States, a lot of people take ferries. Do you feel the captains and crews are adequately trained, they do evacuation simulations, we make sure ours have lifesaving equipment so Something Like this will be managed as well as possible . I had the fortune over my time in the coast guard to work with the ferry industry as a member of the coast guard through all aspects of design, construction and operation, and i also had the opportunity to work with many of the professionals that run the ferries all the way from the cruise to the owners to the industry association, the passenger vessel association, and im very confident that everybody thats involved in operating, running ferries, you know, the entire system, theres a lot theres a high degree of care and attention to detail, and effort put in to doing it right, doing things the right way, and ensuring that, you know, passenger safety is paramount, and i think if you look at the record of the United States ferry industry, youd see that its its outstanding. I mean, theyve done a really, really good job. The coast guard industry, and the mariners. It really takes all parts of that group to keep things running smoothly, and the record is excellent. All right. Captain, we appreciate that, because obviously people are going to look at this and think about what happens the next time they get on a ferry, and so Many Americans do. Anger and frustration 46 days after flight 370 disappeared. Overnight a Tropical Cyclone forces authorities to call off the air search for the missing plane, but the underwater search continues today as the bluefin 21 drone makes its tenth mission down to the ocean floor. And with still no sign of the plane, the next step in the search is uncertain. Cnns Erin Mclaughlin is live in perth, australia with the very latest. Erin . Reporter good morning, kate. Well, for military planes, four military planes were in the air today despite difficult and possibly hazardous conditions, and while hope may be fading for this part of the search, theyre still certainly giving it everything theyve got and theyre already planning phase two. No end in sight as investigators are now only days away from completing the search in the targeted area, and still no sign of flight 370. Back in the water this morning, bluefin 21, after turning up empty scouring twothirds of the intended seabed so far. The search in the air, drastically scaped ba scaled ba rain, poor visibility, the targeted area, six miles in radius represents the best guess as to where the plane may be. If nothing is found the search area may widen dramatically with more equipment. Investigators say theyre in the early stages of talks on longterm search plans as far out as july. On monday, chinese families of those onboard flight 370 arrived at a Beijing Hotel expecting a briefing with technical experts from malaysia. But that meeting was cancelled. The families turned away. Even small pieces, they havent found it. So we really doubt whether they are in the right place or not. We just want to help them check it. Reporter some of the families are saying theyre not convinced the bluefin 21 is looking in the right area. Theyre saying they have too many lingering questions. Chris . Not helped by the fact theyre not gotti igetting any. Two more members of the south korean ferry arrested bringing the total to nine including the captain. Meanwhile, at least 108 bodies have been pulled from the sunken ship. Nearly 200 are still unaccounted for. Rescuers are not giving up hope some may be found alive. Cnns Nic Robertson is live in jindo, south korea. Nic, whats the latest . Reporter chris, this is still being called a rescue mission, the divers battling tough conditions inside the ship. The pace of recovery, the success, if you will, is picking up. Anxiety among families waiting for news, also high. The arrival of each police boat brings some closure to a few families of the missing. For so many more, the uncertainty continues. The scope of this tragedy becomes more evident with each body brought ashore. As authorities here say most of the people they find are still wearing life vests. The company which operated the ferry posted a public apology on their website saying in part, we apologize to all the people who are grieving for the loss of their loved ones. We beg for forgiveness from the victims families, and we pray for the dead. The search for survivors in this waters is dangerous. Low visibility and debris aboard the ship make it nearly impossible to navigate. Divers must first swim down over 100 feet to reach the ship. Then the difficult task of breaching the wall of the vessel. Rescuers focus their search on the third and fouth levrth leve inside a lounge and cabin area where they believe most of the students are located. So far nine crew members in all have been detained, including captain lee joon featured here in this 2010 safety video, once touted as the face of safety, he is now charged with five counts of criminal activity, including abandoning ship, which carries a hefty sentence of life in prison. An outsider courtroom today, four crew members giving their version of some of the events that took place onboard the ship, discussing how the ship began listing, that they were having a problem trying to stop it listing, stop it capsizing. They say that the vessel had a history of this type of problem, and also hearing that when they tried to launch the lifeboats, they wouldnt go. That they couldnt get to them, couldnt operate them. Kate . Still hard to believe how all of that happened in such a short period of time. Nic robertson in south korea, thank you very much, with an update. Also breaking in the region, north korea stepping up activity at its main Nuclear Test Site and now south korea is increasing military preparations in response even as they, of course, continue to cope with that ferry tragedy. Cnns Paula Hancocks is in south korea with the very latest on this angle of the story. Paula . Reporter kate, the south Korean Defense Ministry Tells cnn basically all north korea has left to do, to make the political decision. So in practical terms, they are almost ready with a potential Fourth Nuclear test saying theyve seen stepped up activities in the same area they carried out the nuclear test back in february 2013. Theyre not specifically saying what theyre seeing, although local media is reporting its increased personnel, increased vehicles. What we do know is they still have to dig out the entrance to the tunnel of this underground test and then seal it up. Now, of course, north korea is very interesting in its timing. We know that the u. S. President , barack obama, is heading to asia. Hell be here in seoul on friday, and already the north korean Foreign Ministry mentioned his trip saying it is a reactionary and dangerous trip. What we are looking at at this point, the south korea military is stepping up preparedness watching around the clock to see if this will happen. Last month north korea did say if the u. S. Pushed it to, it would carry out a new kind of nuclear test. Assuming it would be our uranium rather than plutonium. Thanks, Paula Hancocks. Theres going to be additional economic aid that america will give to the government here in kiev, but also there is going to be Technical Assistance in Energy Security, because, of course, ukraine is highly dependent on gas from russia, and russia is using that card as a bargaining chip in the standoff it has with ukraine. The u. S. Wants to help ukraine be less dependent on russian gas. At the same time, the Vice President also saying that the ukrainians themselves have to get the rampant corruption in the political system here under control, and he says that especially important is an election thats going to happen on may 25th, michaela. So much at stake. Thank you so much. Cnn just obtained new video of that deadly avalanche on Mount Everest that killed 13 people. Look at this. Large clouds of snow tumbling down the mountainside. Climbers and guides setting up ropes for the route when suddenly a big piece of ice came off the mountain. This was the single deadliest accident on Mount Everest. Meantime, a French News Agency is saying theyre cancelling the rest of the climbing season in the aftermath of that avalanche. The Obama Administration must release top secret memos. A federal Appeals Panel issued the ruling monday in connection with the freedom of information request about the death of anwar al awlaki, an american citizen and suspected al qaeda terrorist killed in yemen in 2011. Its not clear when that memo could be made public. Speaking of memos, memos from National Intelligence director james clapper, the government spy agencies pulled media leaks. This morning his amazing tale, surviving at 38,000 feet, with little oxygen and horribly frigid temperatures is raising all kinds of questions about his health and the health of Airport Security. Cnn is in los angeles with more. Akiko . Reporter well, chris, Surveillance Video reportedly shows that teenager hopping the fence at san jose airport the day he boarded the flight. The fbi also says theres video of him walking across the tarmac towards that Hawaiian Airlines plane. This morning, that teenager remains in the custody of Child Protective Services in hawaii with one incredible story to tell. Airport crews in maui were the first to spot the 16yearold. His arrival here, the end of a nearly fivehour, 2,300 mile journey ay cross the pacific in the wheelwell of a boeing 767. He was weak. He hung from the whaeelwell, fel to the ground and stood up and started walking to the front of the aircraft. Reporter this morning, new questions how the teenager managed to go undetected. Airport officials in san jose say they arent filing any criminal charges at this time, even though Surveillance Video reportedly shows him hopping the fence on to the tarmac and walking to the plane. It is possible to scale an airport perimeter fenceline, especially under cover of darkness. Reporter that was just the beginning. That teen reportedly hid himself in the landing gear compartment after he ran away from home on sunday, with little oxygen and subzero temperatures, he flew to an altitude of 38,000 feet. The only way i can see he got up, climb up up here. Reporter this aviation inspector showed how difficult this feat is climbing into a wheelwell less than 10 feet across, just inchings wide. Well, once the gear sup, hes got a Little Corner here where the tires make the circle. He could actually stand on this door and probably, maybe, stretch a little bit, but, remember, above about 14,000, hes going to pass out. Because he has no oxygen. Reporter when is exactly what the teen reportedly says happened. Telling airport officials he blacked out after takeoff and didnt regain consciousness until he landed in hawaii. Airport Officials Say the teen just had a comb on him when they saw him. We do know that the crews bought him some lunch, a bag of cookie, because he was so weak. He was sent to the hospital and treated and released to Child Protective Services who contacted his family to let them know hes safe. Chris and kate . So the families have a list of 26 questions. They gave them to authorities and so far the authorities refused to answer them. Lets discuss this. Ma mary schiavo, and represents victims and families after airplane disasters. Miles obrien, science correspondent for pbs and a cnn aviation analyst. You know how i always say that, lets not judge anything here. I dont want to speculate. Lets test the information that um cans out . Well, that rules off today, mary, because i do want to criticize and speculate about whats going on with these malaysian investigators, because these questions are not complicated. I do not see, as an attorney myself, any infringement of the criminal investigation. So when you have these people desperate for answers and are happy enough to put out ifaltite numbers that never seem to match up to data, why are they restricting answers from these families . Mary, you first. I think impartially they dont know some of the answers and arent willing to say with the investigation ongoing, heres what he know, heres the information and would have to hold other agencys feet to the fire. A couple could come from boeing, but these are very i wont say simple, but very straightforward questions and exactly the kinds of questions that are answered within the first days of an investigation, and made public by american authorities, british authorities, french authorities, as they follow the investigation guidelines. Theyre very straightforward. What do you make of it, miles . Like, whats the serial number on the black box . Can we look at the cargo and passenger manifests . Thats not complex. I think its a volatile mix of a lack of candor, some arrogance and a culture of secrecy. Put it all in one pot and you have families left out in the cold asking really basic questions, which there is no reason to keep from them at this point. If nothing else, show them enough respect and give them a a little bit of good faith to give out information which is so basic and i will defer to you, counselor, has nothing to do with the criminal investigation. I dont even know what the criminal investigation is at this point, to be honest. One of the things ive leaned on mary so heavily for, for all of the ideas, coming out of investigation, we dont create theories, never have, on this show, but from the beginning mary was saying, theres a good chance it was memechanical. Im still there. I dont know if any basis remains here. Mary . Exactly. And in yes. In any criminal investigation whats really amazing now were seven weeks in, and, for example, comparing it to 9 11, by seven weeks in, we had just an avalanche of leads, tips, witnesses, people coming forward. You know, i used to be a mob prosecutor. Even people would come forward against the mafia. Here there is nothing. And so i think they really dont have anything, but in any criminal investigation, by the time the investigators know it, theres really not a way that telling the families of victims could compromise the investigation, because the criminals already know what they did, if there are any criminals here. And the sensitivity obviously, miles, is not only am i not going to answer your question, you really need to figure out what you want paid here in your death arrangements and getting your death arrangements necessary. The families arent ready for that. No reason to push that part of the process. Is there . Theres two ways to look at this. First of all, the emotional component of all of this, of course. You know . If nothing else, a body provides some degree of closure in all this, but the flip side of this is that as this rocks on, and it looks like it could go on for quite some time, who knows. They might find somebody today. Having said that, there are, you know, just basic financial considerations, which the families need to factor in, and im sure thats very difficult for them to reconcile those two aspects of this. You know, miles, thats a fair point. However, mary, unless im mistaken, i dont know that the malaysian authorities or the Malaysian Airlines has coughed up any cash to help them sustain themselves during this period, which is often done. Right . Right. Exactly. And this is the dance that the lawyers for the Insurance Company for the airlines do in every crash. We have seen this so many times. First of all, if they wanted to, and theyd save themselves money in the long run. What they should do pay immediately to the family the special drawing rights. Its about 175,000, comparable, and if they would theyre going to be liable for at least that, but the Insurance Companies lawyers always do this dance and hold it back and say, oh, we want evidence. We dont really know anything yet if they would do that they would have such a different outcome to just step up to the plate. Theyre going to do it in the end, but theyre going to drag it out for years in the interim and it happens this way every time. Mary, miles, i appreciate the perspective. I focused on only this, because to be honest, whether the search will continue, at this point we believe it will. Theyre in the tenth point of the bluefin looking around. We dont know if theyre going to find anything yet, and theres a cyclone going on. So the air search isnt going on. Stagnation on those levels of the investigation, but whats happening with the families is very much influx and thats why we focused on it today. He endured altitudes of above Mount Everest, temperatures lingering in the negative 70, even negative 80s they say is possible. Joining us to help us understand this better a professor at metropolitan State University of denver. Jeff, thanks so much for coming in. There is a healthy amount of skepticism, when you hear this, a story like this. We talked to a doctor who said this really put it under the category of, its a medical miracle. But every agency involved is taking this very seriously. Kind of from the technical and security side, how is it possible for a teenager to climb into the wheelwell of a 767 and survive a trip like this . Well, youve got two issues. The first issue, how did he get over the fence and into the aircraft . Thats the secret security issue, but the real extraordinary story here is that if he really was in the wheelwell, which seems to be the case, is, how did he live . And by all indications, it seems it was a right combination of a slow climb to altitude, which means it wasnt a rapid loss of oxygen. It was a possible warming inside that wheelwell from the tires themselves and from the brake system, and also the freezing temperatures, once the aircraft was at altitude, seemed to have put his body into a state of hibernation. So kind of like when somebody falls into that freezing lake in the middle of wintertime, how they can still be resuscitated long after the fact. Its an extraordinary story and if its true, that he did survive in the wheelwell, then hes one very lucky individual, but hes also not one of the first. This has happened a couple other times. A very good point. From everything we know so far, obviously, a lot of questions still. This teenage boy did not have any special training or knowledge of a boeing 767 in the wheelwell. How can you describe how tight it is in that wheelwell . As its been described to me he it to be in the right place to protect from being crushed or dropped out of the plane . Which adds to his luck factor in this case. There is not a lot of extra space in an airplane, really, for anything, and particularly in the wheelwell. Theres just not a lot of extra space, when the gear tucks into the aircraft, theres just not a lot of extra space. And he had to be in the right place to be able to pull this off. Additionally, a lot of these stowaways, if they do successfully make it into the wheelwell and successfully make the trip they fall out when the gear deploys when the aircraft is preparing to land. Another right combination of luck factors at play. Do you believe should a member of the ground crew discovered him . Is that an area that they check before takeoff . Or he just was hiding in the right place and got in there without someone detecting him . The pilot will always do a walkaround of the aircraft prior to flight. So it depends on when the pilot did that walkaround, and whether the pilot looked up into that wheelwell area in order to try and spot somebody, and this happens so infrequently, it wouldnt be something a pilot would normally check. They would check to see if there was debris or other sort of objects that had been placed in there by a ground crew member or someone like that. Depends on when walkaround occurred and when the person went into the wheelwell. Talk more about the security aspect of this and really what it says about Airport Security. Some of this teenagers journey was caught on security camera, but obviously, no one caught him before takeoff, and knew about it until he got out of the plane in hawaii. What does this tell us . Tell you . About Airport Security . Well, it tells me theres a layer of systems in place that are designed to prevent this type of intrusion, and in this case, they slipped slew the lth layers. A quarterback burned by a wide receiver, i look at it. Theres layerss protection in place but sometimes the wide receiver will get free and get open. Theres fencing in place. There were cctv camera in place, even though its not always monitored 24 7, its not always possible for that to be the case, you have Law Enforcement patrols on the airfield, security on the airfield and every employee that wears an i. D. Badge is required to challenge anybody they see without a badge. There are multiple layers in place. In this case, the wide receiver just burned the quarterback. Jeff, Airport Security differs from airport to airport, kind of on the need of that area. Is there some standard, though, that needs to be improved . Is there something that you believe from your perspective can and should be changed to protect from this happening again . I think the system right now works for the level of threat that were at. We talk about perimeter detection systems and those are in place at some airports. Some airports elected to go with that technology to detect an intruder, but its not required, and its not required at all airports. And i think were okay with the level of threat were at now. I think what this tells us is its time to practice more. Its time to tighten up the layers of security that are already there. So i dont see any regulatory changes coming out of this. I dont see sweeping changes throughout our industry. What i see is Airport Security personnel taking more attention, paying more attention to whats going on on the airfield. Interestingly enough, everyone involved, all the agencies, all say at this point they wont be pursuing any charges against this teenage boy. Say nothing happens with the bluefin by the end of the week, what do you think the game plan will be . Well, at this point i think theyll expand down to the other pings they had before. One thing we dont have, michaela, at this point, the information about how, what the intensity or the level of the pings were. When they received them. So what theyre probably doing right now, im guessing, is focusing on those pings that were the loudest or most significant, and that doesnt necessarily mean that its the twohour or the 13minute, or the 7minute. Just a matter of the fact, how strong are the pings coming in . Its interesting, because the bluefin underwater search area focused around the second towed ping locator detection, the 13minute one, not the first, which seemed it was more sustained. Like over two hours . Right. And that was confusing to me, but going back to the amp pllit how strong the pings are. You have reefs not reefs but rocks, valleys, silt and everything thats playing with those sounds. Sure. You also have the thermal layer on top that can play with it, too. Its a matter of deciding when amplitude is the best. Because of concerns about cyclone jack in the area causing high winds and waves in the area, theyve called off the air search. We know the underwater search continues. How long do you think feasibly to keep searching the surface . Because we know those assets are going to be required elsewhere . You know, frankly, im concerned or confused a little bit about how long that air search has gone on already. From an investigative point of view, the clues that we would find on the surface are pale in comparison to what youd find on the ocean floor, as far as finding out why this happened, what actually happened and the events that occurred. So, you know, i think the biggest value of finding something on the top of the the surface of the ocean is to find something for the families so that they can really, truly say, yes, this is a piece of the aircraft. It really did go down here. I think thats why that search continues. Yes, always that goal of trying to find some souls for the families. Right . So a u. S. Navy spokesman told cnn that right now there is a current discussion among all the stakeholders about a longterm plan for this search. Talking about planning out as far as july. What does that tell you as an investigator . Well, you know, i think everyone was hopeful that the pings would lead us directly to the aircraft, and its just simply its just not that simple, to be honest with you. Its going to take a while. So Resource Planning have very important. Even, no matter how much everybody wants to get this done and devote all resources, it has to about slow methodical process, as painful as it is for the families, its the way to conduct the investigation, especially for the crews out there well over a month. Its time to rotate and get some fresh eyes in there so they can start seeing things from maybe a new perspective that would add some help to the investigation. Fresh eyes, new perspective. Maybe some new tools, david . Maybe relooking at the data they had from before . What else do you think they can do to sort of reinvigorate this search effort . Well, there are some tools that are better suited possibly for a massive search in case they have to expand to a larger area, but im still not giving up on these pings. Okay. I still believe that those pings were from the aircraft. So i think they still have to continue to look. The interpretation of the data ive looked at some of the data coming back from the bluefin. Its difficult to understand. Its very small specks and pieces, but were going to i would expect to see something larger, particularly because we dont have any surface debris. Id expect to see something larger and we might come across that. Makes you wonder what that could to do debris left on the surface.
