Trial is fair. Well look at chief Justice John Roberts role in impeachment. Judges and justices are servants of the law, not the other way around. Judges are like umpires. Umpires dont make the rules, they apply them. The role of an umpire and a judge is critical. They make sure everybody plays by the rules, but it is a limited role. Nobody ever went to a ball game to see the umpire. And the 2020 campaign trail is back in Business Today across four states, and one of those candidates, senator Bernie Sanders, is getting a warm welcome back. Take a look at these headlines just from the last 24 hours or so. The New York Times, why Bernie Sanders is tough to beat. Politico, democratic insiders say bernie could win the nomination. Wall street journal, dont count bernie out, and thats just a few of the headlines weve seen. They all tout his resiliency and impressive rebound from a heart attack two months ago, and also his consistent slow climb in the polls. But they also emphasize a concern that his quiet rise is being overlooked. A democratic chairman in iowa tells the New York Times the following. Sanders is definitely being underestimated in iowa. Part of his durability is he has 15 to 20 of the caucus who are absolutely committed to voting for him no matter what. That counts for a whole heck of a lot. Cnns ryan nobles has been covering the Sanders Campaign. Ryan, what are you hearing from inside about how they feel and people around the campaign who feel this is maybe the right time to be on the rise . I have a text stream with annie creag who are helping me cover the campaign, and we were texting each other saying, this is what weve been saying for weeks, that the Sanders Campaign is a lot stronger than many people are giving them credit for. And whats interesting when you talk to those aides and associates that are close to senator sanders, and even senator sanders himself, their confidence is a quiet confidence. Usually campaigns sometimes have to overstate exactly where they stand in the polls and where they stand in relation to other candidates. The sanders came says they dont overplay it. They say what they said in the beginning, that they believe he has a strong shot in winning the democratic nomination and theyll continue to stay this their lane. The Campaign Manager says he operates between 1 to 10 between a 4 and 6. They never overestimate or get too down their standing in the polls, but there is no question there is a shift since he had that heart attack. Sanders is a different person on the campaign trail. He seems to have more energy and its a bit looser. They believe they can win, and when you look at where theyre standing in these polls, theyre starting to rise slowly. Theyre not rocketing to the top of the polls as some of these other candidates have done. And the big thing you cant ignore, dana, is the resources Bernie Sanders has. Hes raised more money from a wide range of donors. They believe that means they have more support than the polls are showing. There is more support for bernie this time around. I think there is a realistic shot that he could win the democratic nomination. There is a long way to go, but do not underestimate Bernie Sanders. Ryan nobles, thank you so much for that reporting. Except the big difference is he was the only guy in his lane four years ago. Now there are a lot of people who have taken up the Bernie Sanders mantel for fighting progressive ideals, one who is very popular and has a lot of support also, Elizabeth Warren. What do you all hear from your sources about what is happening on the ground, why Bernie Sanders is having a quiet resurgence . I think there is two things. Look, admittedly ive been stuck in the Capitol Building with impeachment, but reading the headlines this morning, what changed . I feel like hes been in this place and for some reason people havent been paying attention to it because another candidate was hotter and other people were getting more attention on the floor. The reason he is where he is right now is because of what that Iowa Democratic chairman said, and that is he has a floor thats not moving. He has 26 locked in. Even when you have someone to share the same ideals and policy procedures that Bernie Sanders has been talking about for decades now, youre in a very good place. I think ryan hit it on the head on this point. He has money, lots of money. He has an operation, a large operation, not just in iowa and new hampshire, but in nevada as well. The fact is those donations are not max out donations. Theyre grassroots and theyll keep coming almost monthly no matter what. When you have the resources, when you have an organization and realize this is someone who did it before four years ago and is able to improve and correct what he did, that makes it real, no matter who youre looking at or who the shiny object is at the moment. And when this race started and there were several people running in the Bernie Sanders lane, he was the coclassic. He is the original. You guys are too young to know that. Maybe theyre just returning to the brand. When i say they, im talking about hardcore progressives who like the idea that hes talking about. I think the point that phil made, in order to catch lightning in a bottle, you have to have a bottle is really, really important. This is probably the most organized politician ive ever covered. Hes extremely organized. They use social media extremely well. Hes hard to quantify as a poll thats 15 of caucus voters. Hes not going to make the same mistake and not game out on how iowa caucuses. This is to your point about liz warren. Hes married that to a message that says, come build a movement with me. Across other democratic politics, you see other politicians who are mimicking them. Beto was all, come watch a movement. Elizabeth warren was doing that as well. As more people try to match his message and try to match his organization, who is going to prevail . Lets dig a layer or two deeper on what youre talking about and the substance. You talked about the two of them, Elizabeth Warren and Bernie Sanders. She got a little bit tripped up on her road to being Bernie Sanders on health care. Im with bernie on medicare for all. It took her a while to adjust. Not Bernie Sanders. He is unpositivea positiveunapor medicare for all. Despite the fact you love your insurance company, youll have to find someone else to argue with. Youd get all the coverage you need. But point that it may all go away. But nobody loves the doctors. Medicare for all, you can go to any doctor you want. I think that idealogical consistency, particularly on health care, is why Bernie Sanders had that resilience, had that durability, because weve seen how health care, particularly medicare for all, has tripped up lots of people. You talk to Elizabeth Warren, and i think her decrease in the polling and her stature coincided with how much she struggled to explain, for example, how she would pay for a medicare for all campaign. Bernie sanders was very honest. He said, while costs may go down for American Families by the day, cost for health care would go up. Hes been very candid about that. Also democrats are treating him like a frontrunner. Weve seen a lot of other candidates taking a turn at having the arrows pointed at them. We saw it with biden at the beginning of the campaign, Elizabeth Warren a few months later and now Bernie Sanders. Lets look at some of the numbers. This is the latest National Poll from reuters. If you look at Bernie Sanders here, he should be treated as a frontrunner given the numbers. He is within the margin of error of joe biden, for example, on health care and on immigration. On immigration and the economy, accident could you see me. On health care and the environment hes well ahead of joe biden and the other candidates. But hes been consistently polling in second place, and when i say second place, i mean a close second place depending on where hes been in first place. You mentioned how hes been treated. In some ways being underestimated has benefited Bernie Sanders because Elizabeth Warren was getting attacked on those issues and Kamala Harris before her because they were seen as the frontrunner at that time. Many times on the debate stage, Bernie Sanders has fought back, and while they were all fighting he didnt get caught up in the pete buttigiegElizabeth Warren wine cave thing, even though it was his staff that were wearing wine shirts to the debate. They have sat back and let others attack each other while hes stayed with his specific issues being invoked. You were talking about his organization. Everybody has to remember the last time he ran against Hillary Clinton in iowa, he came very, very close to winning iowa, and that organization and much of that support, while some of it has gone to Elizabeth Warren, has not gone away. Theres Something Else i want to get to before we move on to a different topic, and that is the outrage the Sanders Campaign is doing to the latino community. This is a quote from the Washington Post on thursday. As complaints have mounted for other candidates in the democratic nomination, sanders has been, without fanfare, building a base of support in latino communities. Sanders continues to probably have the best latino outreach so far. He also has the aoc who is helping him in the latino community. We have to remember its not a monolith. Cuban americans vote differently than mexican americans. I would like to see what the breakdown is. Its interesting in general because of the progressive stuff, he does attract a lot of young people. Democrats have had trouble with some latino populations either because theyre very catholic or Small Business owners. I have not seen what aoc is telling voters on behalf of bernie. One thing on aoc which tracks with what she was saying earlier. When you track her on the trail, all she fwatalks about is the movement. It really tracks in her stump speech and it tracks in, i think, with the broader effort of the campaign. When you have the highest level surrogate based on bernies track inside the party who dovetails so well with the message youre trying to get out, that can be remarkably effective. President trump is spending yet another day lodging public complaints against the impeachment process, tweeting this morning and quoting, what else, fox news, complaining about impeachment, Speaker Nancy Pelosi and minority leader Chuck Schumer. Meanwhile, House Democrats are lining up to defend the speakers decision to hold onto the articles until she gets confirmation over the trial. I suspect she probably will send them in the coming weeks. I dont begin to secondguess her. Though i suspect it wont be that long. Well, i think shes being smart. Its not a political play. What people are calling politics and partisan, et cetera, sometimes the question of what is facts and what are not. Were back with our reporters. Phil mattingly, translate that into nondemocratic caucus speak. We have absolutely no idea whatsoever because the speaker hasnt told us what shes going to do. I think thats the funny part. When you watch democratic members come on, they dont know. Thats not a shot at them. I think the speaker is just keeping this very closely held at this point in time. I think the expectation is the first week lawmakers are back for a full week, the articles will be sent over and things will begin to kick out. The speaker saying shell hold out until she has a better idea what the trial will look like and the majority leader in the Senate Making clear what democrats in the senate want in terms of locking up witnesses and documents for the trial isnt going to happen. How does this work . Do you just give up and say, fine, were going to fight for this lady when we have votes for witnesses later on in the trial, or are we just going to kind of let things go . I think we do have a pretty firm understanding. This will start to move pretty quick. It will be an unsustainable position for democrats to hold out sending over the articles of impeachment for a long time, because weve heard over and over again from House Democrats how quickly they had to move in the process. They actually set that christmas deadline for the impeachment vote. They stressed the primary reason theyre not going to courts to fight for witnesses and documents is the timetable. They say theyre doing it during an active Campaign Season so we must act right away. When youre holding back the process longer and youre holding a critical piece of the process, thats been a difficult position for the democrats to explain, so thats why i think you have this parade of democrats saying, well, we expect her to send them. Its not just democrats in this speakers caucus, its democrats in the speakers family, namely one that she gave birth to, christine pelosi, who is her daughter, who also appears to be a Democratic Party official in california. Listen to what she said this morning on new day. Nancy pelosi does everything with the long game in mind. I think that shell move when the time is right. I think that justice will prevail. She will do what is necessary to make sure that shes done all she can, exhausting all of her constitutional remedies. Any efforts to try to take her off her game by insulting her only fuel her fire to be stronger than ever. Like that means anything, right . Thats almost textbook. Theres no message there. But the reason why we wanted to show it is because it sounds a lot like what nancy pelosi says about herself when shes up against a wall. This is a fight over whether and how to call witnesses in this trial. Democrats look at the polls that show that calling witnesses is more popular than actually proceeding with impeachment, and they think theyve got leverage here. Whether they do or not, i dont know. When Mitch Mcconnell talks about following the clinton model, im not sure what he means. The senate voted in secret on some rules of the road. They didnt have live witnesses, they had some videotape witnesses. They have a lot of options here, but look, the polls are showing Something Like 60 of americans support calling witnesses, but the number for actual removal is much, much larger. No question, and my impression of what he means by follow the clinton rules is lets not deal with witnesses or documents until we start the trial, and then well do it the good oldfashioned way, well vote. Or ill find a way to block the votes, is probably what hes really thirnking. And thats not what democrats want. They want live witnesses, including mick mulvaney, who thad li they would like to hear from. The republicans have made clear thats not likely to happen, and the president has said he wants witnesses, but thats unlikely to happen. I hate to make this about the 2020 president ial race, but in many ways, it is. Because you start running against the iowa voting, new hampshire, and you do factually have senators who need to be campaigning that need to be there on the day of the caucus, and how long impeachment will continue becomes an issue for them. You mentioned 2020 which is all about politics and base politics and finding their nominee, but its also, when you look at the politics of this, there is also a lot riding on how Chuck Schumer handles this. Which is why youre seeing him continue to try to not just get under the president s skin but send up flares to democratic donors and to the base like, im fighting, im doing what i can. Heres what he did in a tweet just this week. President trump, if you are so confident that you did nothing wrong, then why wont you release the emails and let the witnesses testify under oath . Hes not doing that because he thinks thats really going to happen, right . I think the big concern you heard from democrats outside is the senate will just kind of let this happen and let Mitch Mcconnell do what he always does, which is run the show and see what happens. The majority leader doesnt necessarily have the kind of rock solid power if he doesnt have 50 votes to back him up here. That said, dont ignore the reality here that democrats are also use thanksgiviing this for. They know how this is going to end. They know they dont have 60 votes to remove the president and nothing in the next month or two is likely to change that. So framing this that the president and Mitch Mcconnell are running the trial and turning it into a sham, and whatever happens here theyre not allowing a full trial to occur. If you know how this is going to end and its not going to end the way you think it should, frame it in a different manner. Thats probably the best way to look at the last two and a half weeks and how this will probably end with the stalemate coming in january. And he has told his caucus members treat this seriously, treat this soberly because they want the point that Lindsey Graham are out there saying this is not what were doing. So there is a lot of questionable statements all around. We have to take a quick break, but i will say dick durbin told me last sunday or the sunday before, im losing track of time, that he admonished senators in both parties, including in his own caucus. Team trump sounding confident the economy will propel him to victory in 2020. James carville said it best in the 1990s, its the economy, stupid. The president s reelect numbers are very strong and they see the economic gain. Its so much easier when you have people who are paid to message, to go out and say these things which are cogent and clear. The problem that the Trump Campaign and the trump team has had since day one is that the president then, you know, tweets up a storm or something Something Else in battle creek, michigan about john and debbie dingell, for example, and the focus changes. Is the question whether or not the economy is going to propel him, whether he stays focused on it or not, or does he really need to stay singularly focused on it . What ive heard from people around the president is that they wish he would stay focused on the economy. Its the biggest thing he can be running on, but he has been on twitter tweeting about impeachment. He talked about the dingells, he talked about windmills and a whole other host of topics on twitter, and thats what they end upp talking about. With some of the democratic candidates, thats what theyre staying on message on. They are innarrowly driving a single issue and those donald trump rallies are going for an hour. He is who he is. Hes no different than we started covering him back in 2014 and probably longer than that when you read what hes written and said. His campaign is probably more agile than some and were like, lets take advantage of it. Mark louder is talking about the economy, his inseizuurgents are talking about the economy. The base cares about that message as well, and we can do multiple things at once. The question becomes, do you stretch yourself too thin or do you lose focus on the thing that perhaps suburban voters want to care about more or people who are trump skeptics but arent sold on where the democrats will because they see impeachment and everything else. But there will be multiple tracks because thats where hell be. You mentioned suburban voters, and i think thats an important thing to look at, because if you look back at the midterm elections, a lot of voters who said bye bye to the Democratic Party and voted were suburban voters that are disgusted with this president. Now were in an Election Year where some of these people are disgusted with him but theyre also really excited about their 401 k . That becomes the choice that conservative democrats and republicans will be making in these swing states that could determine michigan, could determine wisconsin and in the southwest. We have to acknowledge either a very dark rhetoric that the president offered up in the waning weeks before the election did not help republicans. I think phils point is very well taken that there is a range of trump comments and people react very differently. At bottom, republicans want him to pound the message that change is scary. Whether its the economy he does a lot of lifestyle changes, scary messaging. Oh, my god, these light bulbs make me look orange, that kind of stuff. Dont forget the toilet bowl. Right, the toilet overflowing at the white house. I think they look at these categories of trump content and as long as hes hammering away that change is scary, meaning pounding away at the democrats, theyre content. Theyre not as content when he goes after debbie dingell. And we cant talk about the Republican NationalCommittee Without mentioning they are swimming in cash. They could spend all day just counting their money and not raise any more, and they would be in great shape. Once there is an agreement on the impeachment process and the trial begins in the senate, much of the responsibility for keeping the historic proceedings dignified and fair falls squarely on the shoulders of the chief justice of the united states, john roberts. Here to offer her insight on this immense burden and how hell handle it is Cnn Supreme Court analyst Joan Biscupic who has a book out on this very topic, the life and Turbulent Times of chief Justice John Roberts. Thank you for coming in. I feel lucky that youre here on a holiday week. First, what is the chief justices role as described by the constitution . Sure. The only time the chief is mentioned in the constitution is in terms of him presiding over an impeachment trial when the president is impeached. So it says that and only that. Then there are senate rules that dictate he should be the presiding officer. He is not a judge or a juror. That falls to the senators. But hes there to make sure everything runs on schedule. The senate rules do allow him to decide matters of evidence, but the senators, with a majority vote, can overrule him. Lets listen to his famous line when he was testifying at his confirmation hearings before the senate about how he will approach the bench. No, in fact, what he is hoping is that no one comes to this Senate Impeachment trial to see the presiding officer. You know that when hes across the street deciding cases, theyre essentially behind cameras. Theyre not filmed, no cameras are allowed in there, they navigate their cases behind closed doors, so this will be the american publics first chance to really see john roberts since that 2005 clip. So what he will do is take his lead from Senate Majority leader Mitch Mcconnell and perhaps also from minority leader Chuck Schumer, which is what happened back in 1999 when chief Justice William rehnquist presided over the bill clinton trial. Thats what i was going to ask you, whether you think, since theres only been three trials in history, two in modern history since Television Cameras existed, do you think hell take his cues from how the late chief Justice Rehnquist operated and saw his role in 99 . I do. First of all, john roberts is even more reserved than the late chief. He will probably want to have a lowkey role. Chief Justice Rehnquist saw his role as much more material than substantive. In fact, he would joke, using a line from gilbert and sullivans olanthy, i did nothing in particular and did it well. I think chief Justice Roberts will want to recede into the background, but he might be under a lot more pressure to rule on documents and witnesses given the division were seeing, but however he rules, again, dana, this is a senate show and a Senate Majority could overrule what he does. Thats really the key, and its not like things were hunky dory in 99 but there was a bipartisan agreement, at least, going into the trial on how to deal with it. And democrats, their whole m. O. Is hoping to pick off some republicans on votes on whether or not witnesses are allowed, and there could be times where they all look at the chief justice and say, you decide. Yes, and i think what the chief would do is try to take his lead from where the Senate Majority is, because he knows even in the constitution, no matter where he pre sidsides, t constitution says it is the sole job of senators to decide whether a president is convicted. It takes 70 of votes, twothirds majority. In some ways we know the outcome already. Thank you for breaking that down.
