Shot candidates in round 2 tonight you might have to fight for time. Congressman delaney i introduced the only bipartisan carbon tax bill all right. 30 seconds. Come back to the big debate takeaways in just a moment but we begin the hour with two big rulings on political questions from the Supreme Court. One is a big win for republicans. The other is a loss for the trump white house, though that loss could be just temporary. The justices ruling today that the administration cannot add a question about citizenship to the 2020 census. But the court did not say the question was out of bounds. It just sent the case back to a lower court for additional arguments. And it says the Commerce Department needs a better explanation. The other big ruling came on the question of partisan gerrymandering. The court was asked to determine how far the party in power can go in maximizing its clout when it draws legislative and political lines. The courts conservative majority, though, led by the chief justice john roberts, said no, that it would not set a standard because it believes those decisions are best left to the politicians, not to judges. Thats a boon to the republicans at the moment because they control more governorships and state legislatures. Cnns Ariane Devogue is outside the Supreme Court on this big day. What are the big major takeaways as we wrap up this session . Right. This is the last day of the term. Two big politically charged cases. And chief justice john roberts, he was at the center of both of them. The first one, that census case that you mentioned, in the vote that mattered chief justice john roberts, 54 with the liberals, sending the case back down to the lower court. That blocks the question for now and it raises the question of whether or not the Trump Administration is going to have enough time to add it in time for the next census. Chief justice john roberts, he really focused on the reasons put forward for agd the question. And this is what he said. We cannot ignore the disconnect between the decision made and the explanation given. Keep in mind the government said all along that the question was necessary to comply with the Voting Rights act. Challengers said that it was a veiled attempt to intimidate minority voters. But in the second case, john, that was a totally different circumstance. This case had to do with the census question. And here the chief was partisan gerrymandering and here chief justice john roberts, he sided with the conservatives here and he slammed the courthouse doors shut on these kind of challenges that go to when politicians go too far in drawing district lines for partisan gains. Critics said that the court needed to step in here because the system had run amok. But chief justice john roberts, again, with the conservatives, he said that such claims are beyond the reach of federal courts. That drew a biting dissent from Justice Elena kagan. She said of all the time to abandon the courts duty, to declare the law, this was not the time. She said she read the dissent from the bench and she said she was deeply saddened about this. Ariane de vogue outside the court. Appreciate the insights. Pretty remarkable. 54 decisions, both by the chief justice siding with different blocs on the courts. Big day. With me in studio to share their reporting and insights, cnns Vivian Salama with the wall street journal. And rachel bay with the washington post. This is the roberts coast. The final day cements that if you had any doubt about it. Lets start with the gerrymandering caig case. The census vote has been more the debate in washington the sxheer now immediacy. The gerrymandering case has the impact to have much more meaning as this goes forward. And at the moment it benefits republicans because they have more governors. They have more legislatures. To the victor go the spoils. The Supreme Court essentially saying go the spoils on steroids if you so choose, we wont get involved. On steroids is right. When you consider whats happening with extreme partisan gerrymandering across the country. Two things to note here. This has been a project of chief justice john roberts. He has wanted to remove federal judges across the country from assessing these partisan gerrymanders. And he was able to do it this term with the vote of brett kavanaugh, who succeeded anthony kennedy, who was the fifth vote leaving the door slightly open to allowing these kinds of challenges. And interestingly, the chief said we dont want judges involved in politics. But the dissent said youre playing right into politics. Look what is happening to democracy. These voting maps are getting rigged based on sophisticated data, polling analysis, computer maps. So he got what he really wanted in this one. Yeah. Its interesting. Well have to see how it affects washington here because weve been hearing, you know, on capitol hill that gerrymandering is one of the major reasons why were seeing partisan tensions increase, you know, over the past few decades. Cook political report has said that only 20 of congressional districts are actually swing districts held by sort of moderate voices. And thats a decrease by more than 50 overt past two decades. So with these gerrymandering districts you have more increasingly partisan politicians. They dont have to work across the aisle. And that could affect politics. It will be really interesting to see how this emboldens a lot of politicians around the country. Todays ruling obviously focused on maryland and south carolina. But you have issues like this in georgia and elsewhere in the country. And its going to come up over and over again and a lot of politicians are going to feel emboldened because their opportunity because you can use a data base now. You know where the voters live and you know if you have to deal with Voting Rights issues you know some of those issues. You can still come back if its a racebased, some other standards you can come back but the Court Essentially saying now if youre the republican governor of state x and you have a Republican Legislature even if your states divided 5050, you can draw the congressional districts in a way or the state legislative districts in a way that benefit you overwhelmingly. Thats right. There is a counterpoint thats sort of a less popular one thats a defense of the maryland map in particular, and its the map that the defense that was used when this map was challenged in the state courts, which is this, that when you gerrymander and for maryland it went from a 44 state, four democrats, four republicans, to having seven to one, seven democrats, one republican, what that meant is those democratic districts are a little bit tougher for democrats to hold on to. The voting performance is not as high. And the argument an argument out there says look, these are more moderate members because they actually do have more republicans in their district. It was an argument that won in the maryland courts. The chief said, john, that federal judges shouldnt be have no standard to assess this. But the truth is that Lower Court Judges have been figuring out ways to assess this, not just in maryland but North Carolina and ohio and michigan. So all over the country as the dissenting justices pointed out in a very passionate dissent by elena kagan from the bench, judges are working with this, dont you chief Justice Roberts throw up your hands and say its impossible. To that point you see some of the 2020 weighing in. Kamala harris saying politicians shouldnt be able to pick their voters. Cory booker saying essentially the same thing in a tweet, voters should be able to choose their politicians, not the other way around. Because they do use these Computer Data bases now to do this. It will be interesting to again, benefits republicans today because they have more governors and more legislatures. Two years from now, four years from now, six years from now could flip that one over you get a little back and forth. Lets come back to the census case. The court did not say, did not say the constitution prohibits you from asking this question. It said just the opposite. You can do that. You can do that. What it said, though, is there was new evidence introduced as the case was in the pipeline, therefore back to court for you. But in that, in that the chief justice also took a shot at the commerce secretary and the Trump Administration. They have said essentially some guy at an agency proposed we do this. And we said yeah, sure. The evidence in the case says hogwash, this has been discussed at the white house, this has been discussed at the secretary level. He essentially said altogether the evidence tells a story that does not match the explanation the secretary gave for this decision. We are presented, in other words, with an explanation for Agency Action that is incongruent with what the record reveals about the agencys priorities and decisionmaking. The Court Essentially saying the Trump Administration lied about how this happened. To the courts. But it sends it back not saying because you lied doesnt mean you cant ask the question. The question is can the lower courts resolve this in time to possibly have that question be on the census . Youve made exactly the right point. Because in many ways this is a ruling that could help the administration down the road. But on this particular point of the commerce secretary saying the sole reason we did this was to enforce the Voting Rights act, the chief said were going to defer to you but were not going to be duped. That wasnt the sole reason. So if hearings are able to go on, i expect the administration might be able to say contrary to what has been said to this point that were running out of time, maybe there is more time. The Trump Administration seems like again and again gets caught up in their process being so out of whack. And i just think having the Supreme Court call them out on that youd hope maybe other agencies will look to that, like look, we need to do this the right way and not just, you know, slap some question on to those who dont like the question, think that it will lead to a massive undercount because of mistrust, distrust in the latino community, that is still unresolved. This case goes back to the lower court and it is possible, it is possible the administration could the clocks ticking. Youve got to get the forms ready, the procedures ready. But its possible were not done with this. This is also a perfect opportunity for us to look at the consequences of an election and now were going to go into a democratic debate tonight where elections matter and now we have a court which is skewed to the right and these decisions are going to come one after the other where the right is going to dominate. So while the Trump Administration may not have gotten a clear victory on the census issue, on gerrymandering, this is one case where they can point and say there we go. Like we were successful in packing the courts and its going to work in our favor in the future and something for people to think about. Thats a reason to tune in to that to see more debates, get more wrinkles. Well continue that. And what happened last night tells us a lot about the next eight months. A big audience for ten democrats last night. For many of the candidates wednesday their first real chance to talk to american voters. Julian castro making a big impression. Watching that image of oscar and his daughter valeria is heartbreaking. It should also piss us all off. No joe biden on the stage, so Elizabeth Warren essentially last night playing the de facto frontrunner. She helped set the tone on policy. We can make our government. We can make our economy. We can make our country work not just for those at the top. We can make it work for everyone. And i promise you this. I will fight for you as hard as i fight for my own family. Weve had an industrial policy in the United States for decades now, and its basically been let giant corporations do whatever they want to do. Giant corporations have exactly one loyalty, and that is to profits. Warren there reflecting the biggest dynamic across the stage last night. The candidates are pulling the Democratic Party to the left on health care, immigration, taxes, climate, corporations. The candidates, most of them anyway, want more government sayso, expansive and expensive policies like medicare for all, carbon taxes, busting up corporate titans. The marquee takeaway many of the candidates in 2020 believe in solution thats veer left of where the country was in 2018, 2016, 2012, 2008, or in any modern president ial election. The big question we cant answer until the voting starts next february, are those candidates in sync with their own party or too far to the left . Are they in sync with the country or too far to the left . Aliahna johnson from politico joins the conversation. It is an unproven question. Most of these democrats think the country is ready to go farther left, to change the paradigm that has governed president ial politics, at least in the 30plus years ive been doing this. We dont know if theyre right, but they think they are. Thats right. One of the biggest moments last night i think was Elizabeth Warren saying she supports doing away with private Health Insurance, which we saw Kamala Harris stumble over a couple of months ago. That does not poll as a popular position with the general public. So i think it will be interesting to see whether that is a popular and successful policy position for the Democratic Party as warren moves forward. Lets just listen to that as you bring it up because it is striking. Again, well see the official ratings later in the day but the early reviews were a lot of people watched. Thats a good thing, whether youre democrat or republican, whether you like these candidates or not you should watch, listen to these candidates have the debate. On this question what does medicare for all mean some democrats say well, you keep private insurance if you want it. You just have a public option. If you have medicare you can switch your plans. Elizabeth warren says no, lets go all the way. Yes. Im with bernie on medicare for all. There are a lot of politicians who say oh, its just not possible, we just cant do it, have a lot of political reasons for this. What theyre really telling su they just wont fight for it. Health care is a basic human right. And i will fight for basic human rights. Its an interesting position. On the debate stage, on the far end of the stage, former congressman from maryland john delaney, he was among the democrats to stand up and say no, no, no, no, thats too far. People like their private Health Insurance, by the way. It should be noted that 100 million americans i mean, i think we should be the party that keeps whats working and fixes whats broken. [ applause ] i mean, doesnt that make sense . Why do we have to stand for taking away something from people . But all the big transformative things weve ever done in this countrys history have happened when huge majorities of the American People get behind them. Which is why we need real solutions, not impossible promises. Nobody votes until february. Bt at the moment if you just study the polling, if you add up Elizabeth Warren and Bernie Sanders youre in the 30s or higher in these polls. And if John Delaneys at zero, one, or two, or three. At the moment that position is carrying the day within the Democratic Party. The question is does it carry the day in the end of the Democratic Party and if it does can you sell it to the country . You dont get a chance to sell it to the country if youre not the nominee. And you heard what Elizabeth Warren said. Im with bernie. And that was the only time Bernie Sanders name was mentioned on the debate stage. And there is a reason for that. I mean, she needs his voters at some point to come to her. So shes saying, you know what, this is an evolution for her. She has on the campaign trail been wishywashy. Shes been listening to that polling you mentioned and the polling you mentioned. But at the end of the day she doesnt get to make that case if shes not that nominee. And thats the bet shes making. She sees the opportunity. Thats politics. Thats what we saw. That was politics. I thought it was really telling that delaney was the one that had to jump in there to say this is not what i think we should be doing, medicare for all. His argument was something along the lines of hospitals are going to go bankrupt if we do Something Like this. You didnt see a lot of the candidates who do not support medicare for all on that stage push back at all. And it was one of those moments for beto orourke where you thought he would really stand up for his own Health Care Plan and potentially keeping private insurance. He had to be saved by john delaney which was not a good look. Well watch tonight. Well get to tonight later. We have ten more candidates tonight. Well watch tonight. I think this debate is going to be even sharper because they saw it last night. The questions are coming back, the candidates are come bag. You look for a breakout moment. 23, 24 dmgz remocrats running f president. 20 on the debate stage. At the moment Pete Buttigieg on the debate stage tonight if youre looking for Something Different. Last night jewel can castro, he made his case, if youre looking for Something Different give me a try. Reason theyre separating these little children from their families is that theyre using section 1325 of that act which criminalizes coming across the border to incarcerate the parents and then separate them. Some of us on this stage have called to end that section, to terminate it. Some like congressman orourke have not. And i want to challenge all of the candidates to do that. I just think its a mistake, beto. I think its a mistak. And i think that if you truly want to chait system youve got to repeal that section. A little texas battle there, internal texas battle there for starters. Julian castro, who hasnt gotten a lot of attention, having a moment there. But b, again, pulling the party left, saying if you cross the border illegally its a traffic ticket, its not a felony. So the interesting thing about Julian Castros performance yesterday is he really had an opportunity obviously, its a very timely subject, so he was able to take this emotional flashpoint and use it. But he also has a very comprehensive immigration plan which hes rolled out already. Hes a little bit ahead of a lot of the other candidates in this area. And thats what we saw play out in his exchange with beto orourke, who just really could not kind of come back and bottle him because Julian Castro was very prepared on this particular issue. And then you also had Elizabeth Warren texting castro today to say hey, look, you did a really good job last night. Shes come out and endorsed his plans. So i think youre absolutely right that he has really seized this issue. And i think for beto orourke he cant punch back against castro, how are you going to look against trump, whos the chief puncher . Its round one. Its an interesting point. The question is if you go back think about the crowded republican field not last time but back to 2012, Michele Bachmann and herman cain. People had boomlets. The question is can you sustain . Castros going to have a boomlet after this debate. Can he sustain it . Senator Bernie Sanders takes the debate stage tonight, says he has a strategy for the fight. Like muhammad ali. He noticed the weakness in his opponent. What weaknesses did you see last night . Dropped their left hand. Biopharmaceutical researchers. They along with senator Elizabeth Warren who was on tv last night have top standing with the democratic voters right now. Biden will be literally center stage tonight thanks to his early lead. Does he feel like he will have a target on his back tonight . Well, i think theres no question that a number of folks will be looking for a breakout moment tonight, alisyn. And Vice President biden doesnt necessarily need a breakout moment. He doesnt need a viral moment. He doesnt need to take shots and frankly thats not the kind of campaign were running. So a lot of people might take shots at him tonight. Senator sanders might be one of them. But what he will be focused on is being laser focused on speaking directly to the American People, looking into the camera and letting folks know where he stands. Cnns jeff zeleny is at the debate site in miami right now. Jeff, Vice President biden, senator sanders, the two leaders if you will of the pack. Center stage tonight. John, theres no question. Also center stage is the generational and ideological divide that were witnessing in real time inside this Democratic Party. The last time joe biden was on a debate stage of course he was the running mate, he was the Vice President in the 2012 campaign. And boy, what a difference in this Democratic Party. We can hear just in terms of policy. And one of the biggest reasons for that is senator sanders himself. So of course he is going to keep trying to draw that difference with the former Vice President. But john, i just talked to an adviser to a joe biden who sums up the strategy like this. Says this. Theres no need to try and draw contrasts with senator sanders. The contrast couldnt be more obvious or stark. So theres no question that joe biden is going to try and present himself as the most electable candidate. Thats what he has been trying to do. Theyre actually more concerned, or slightly worried about some of the other people on the stage who are firing, you know, grenades potentially or looking for attention. Perhaps senator Kristen Gillibrand who is certainly looking for a breakout moment. But the Biden Campaign is looking at this as an opportunity for him to directly say why he is the most electable. But Bernie Sanders also has a moment here and he is trying to draw a contrast. But john, just looking at the differences on stage will be the biggest contrast of all. John . Jeff zeleny live from miami, appreciate the reporting from the scene. We bring it back into the room. Youre the frontrunner, which makes you the focus. Is he a target . Well see how aggressive it gets. My question is more if you think about last night, is joe biden going to say Elizabeth Warren was wrong, senator sanders youre wrong, we cannot abolish private Health Insurance . Is he going to draw that line and have that fight now . The moderators will try lead him into it. The question is what does he do when given the opportunity . He has not engaged with anybody. His entire strategy so far since he got into this race has been to avoid any candidate forums where hes on stage with anybody else. So that makes me that phase is over. That phase is over. But wonder to symone sanders, his spokeswomans point sex, going to try to pretend that phase can continue and last . Thats wheeze been doing and theres been this idea hes floating above. That is not a sustainable strategy for him. And i think if he tries to do that tonight then that becomes a line of attack for the other candidates on the stage. I think bidens goal tonight has to be to do Something LikeElizabeth Warren did last night where although she was the frontrunner on the stage it wasnt Elizabeth Warren who really took the fall. His goal has to be to do no harm because he has a lot to lose and very little to gain. If youre a democrat inclined to support biden right now, a lot of that is because you like him, his history and all, that but you think he can beat trump. Hes on a debate stage tonight. If he doesnt look stroj on a debate stage tonight youre immediately going to big test for senator sanders. He watched senator warren last night say i want to take that line, i believe im a better candidate in that lane. Senator sanders tweeting today candidates are talking about raising taxes on the 1 of corporations raising the minimum wage, tuitionfree college, making health care right. Our movement led the way we cant stop now. Tried to raise money off nap but hes also essentially trying to make the point tonight look, glad you have to in the parade but im the leader. Right . Bernie sanders the other issue with him is in 2016 he really was able to put himself out there as the antiestablishment candidate and this kind of newcomer to president ial politics, national politics. And differentiate himself from hillary clinton, for example. But now hes become a bit more establishment and hes been absorbed by the democratic establishment as a whole. The way he will still try to distinguish himself from the establishment while also being more in line with what voters are looking for sort of in the middle is going to be the interesting with sanders tonight whereas warren didnt see a ton of pushback on her own proposals in terms of talking about medicare for all, hes on stage with not only biden hes got hickenlooper up there, michael bennet. Both these democrats have said medicare for all is not the answer. Hickenlooper was even booed for saying socialism is wrong. Its not going to be him versus biden. Hes going to potentially have to fight back its a great point. We show you the lineup here, if you put it we know he wants to protect his frontrunner status. He thinks Bernie Sanders and the partys going too liberal. The question is does the Vice President let them carry hope they carry that attack and he can stay back and just nod a couple of times or does he have to i assume the moderators know what theyre doing, theyre going to try to get him involved in it. Mayor pete butdgig was the early surprise of the democratic race. He got in a new and different lane before beto orourke even got in the race. Hes had some issues back home. Hes the south bend mayor theyve had a Police Involved shooting with an africanamerican that got him off the trail. Can he tonight get back to this . Going to work. Whats not going to play where i come from in the industrial midwest is having our own version of turn back the clock. The republicans want to turn back the clock to the 50s. Sometimes im afraid democrats sound like theyre offering a return to the 1990s or the 2000s. Youre talking joe biden. Im talking broadly because theres that temptation. Hes going to be next to joe biden tonight. He was asked in that interview are you talking joe biden he says im talking broadly. Again, if you want to convince voters, youre new, youre different, youre next generation, and youre tough enough to beat trump, frontrunners right there next to you. Thats right. He is right there next to him. But he is hes so weak at this point. He was attacked, even though he wasnt on stage, last night with some references to his troubles back home. He is running on this idea that he has done a good job in south bend and thats the kind of job hes going to do as president. And i think that case does get legitimately harder when you are facing a lawsuit from the family of the victim when a Police Officer shot and killed a black man. I just want to show one quick graphic before we go to break in the sense its a democratic contest right now, its a fascinating contest. Ideological tug of war in the party, generational tug of war in the party. It matters who you nominate in president politics. This is from nbc wall street journal polling. Look at the top four lines and look to the left there. 96 of americans think they can rate joe biden. 96 83 Elizabeth Warren 95 Bernie Sanders. You see them there. Are they comfortable with these people . But look at the reservations. 56 of voters have reservations or concerns about joe biden. 62 about the incumbent donald trump. Half the voters already reservations about els becht warren. 63 Bernie Sanders. This is it matters who you monument. For biden thats going to be one of his demons tonight too. If any of his competitors decide to seize on the fact theres been some wavering and flipflopping on certain positions in recent weeks that could really hurt him especially when theyre all laying out their positions for the voters in front of them. Im glad the speaker and the administration are discussing some of these outstanding issues. Theres also something happening right now in the house and that is a bunch of moderate democrats and front line democrats in trump districts are pressing her privately is thaenting to take down a rule and repass this bill. She is dealing with her tone internal mutiny. Shes trying to demand that the white house and republicans continue negotiating. Its a tough position for her. And this is exactly what happened to john boehner when democrats controlled the senate years ago and obama was in the white house. She says she wants to talk to the Vice President. She did talk to the president. She thought after that shed done an endaround on mcconnell. She had the president willing to discuss changes. But then he tweeted after that Republican Senate just passed bipartisan humanitarian assistance for our southern border 848. The president goes on to ask for other things he wants. That would be separate legislation. So that seems to be the president saying never mind, pass the senate bill. Yeah. But to rachels point, this is something nancy pelosi has been very good at doing in the pacht shes managed to claw a victory out of the jaws of defeat in the past. I dont know if weve seen her against a wall like this before, though. We definitely havent. Shes getting pressure from progressives who want her to make a stand here. But the reality is theres already a bipartisan agreement in the senate and that really hurts her. This is also a really emotional issue. The president as one that will not back down when things get like this, you have an image of a dead father and child in the water and he tends to react very strongly to things like that. But i cant help but feel theres a little bit of a lord of the flies situation going on. President trump is now in japan and he cant be here physically to put pressure on congress and so you have them sort of sorting it out amongst themselves and its starting to drag and thats why you have nancy pelosi now trying to find alternate avenues going to the Vice President and others trying to find a solution. Antiwar sentiment, though, we have learned does run deep especially in some of these early democratic states. It really struck me that tim ryan was to the right of donald trump in his arguments. So it made me wonder, you know, does his sentiment really have a place in the major parties today . Unless i think theres another terrorist attack in which case i think that sentiment tends to come roaring back. Congressman ryan trying mostly to stake out im from a bluecollar town where people work with their hands and the Democratic Party has lost touch with the works class but he did respond to congresswoman gabbard today. She was trying to score points. I think whoever got that question on afghanistan she was going to try to go after and quite frankly she doesnt have very good judgment on a lot of these issues. She was actually meeting with assad not long after he was gassing children in syria. So i dont think her judgment is up to speed on some of these issues. So its interesting that he didnt actually bring up the assad issue on the stage during the debate. And that was probably one of his shortfalls. But also the problem with these debates is often youre trying its a performance and youre trying to be the more forceful and seem like the more knowledgeable. The actual debate of being in afghanistan kind of fell through the cracks of why we think we should be in afghanistan, does the taliban represent a more global threat to our National Security and not just whodunit on 9 11. And so that was the problem. And he mentioned the google searches. Tulsi gabbard had a lot of searches west of the mississippi. Its interesting. Well see what it means. Jonathan martin of the New York Times smartly points out there were a lot of cory booker searches in the south and in michigan making the case that maybe some africanamerican voters were seeing him for the first time.
