The senate is headed to a reasonable approach in that it seems to me and speaking to a few senators including Lindsey Graham that allowing this woman to be heard in sworn testimony and allowing judge kavanaugh to be heard in testimony. Speaking with senator graham and others, this woman will be heard. We begin there. With a me too moment in the year of the women threatening judge kavanaughs nomination to the nations highest court. A professor at Palo Alto University told tthe washingto pos post, the would be Supreme Court justice of the United States physically and sexually assaulted her in high school. Y details are grim. She said kavanaugh and a friend, both stumbling drunk at the time, pushed her into a room where kavanaugh pinned her down. This is fords lawyer on cnn this morning. The reason she felt he might inadvertently kill her is he had his hand over her mouth and she was having a difficult time breathing. He was larger and pressing his weight against her and ignoring the fact that she was attempting to scream and having a difficult time breathing. She believes that but for his enebriation and inability to take her clothes off, he would have raped her. She said her client is willing to tell her story in an open Committee Hearing on capitol hill. Judge kavanaugh issue add i statement denying the account andy said he too is willing to answer questions. What happens next is officially up to Senate Republican leaders. They were caught off guard by Kellyanne Conways statement that said ms. Ford should be heard. At this hour, it is still the official position of Senate Republican that is the exxon firmation hearing will go on as scheduled thursday. Expect that to change soon though. Democrats called for a delay and at least one republican member said the vote must not be rushed. Jeff, a big statement from Kellyanne Conway, silencing the president. How is the white house going to play this . The white house and the president standing by judge kavanaugh and support his nomination and are pushing for his confirmation, but it is uncertain at this hour, no question. He is still here at the white house, we believe. He is not scheduled to meet with the president himself. He is meeting with others who are playing a role in his confirmation process here. The comments from Kellyanne Conway are certainly interesting. She intentionally is sending a message to everyone in the president s orbit and supporters to not play hardball, if you will and say she should be heard. Republicans think the best opportunity to have all of this be heard and go away is to in fact volunteer to have a hearing. The stakes of this moment are far too high for the midterms as well to denigrate this womans story here. One thing we have not heard it from the president himself. He has been unusually silent. He is upset by all of this and thinks someone is trying to smear him and his nominee. He has been silent. The only word is from Kellyanne Conway. We will see how it plays out. Private conversations going on between the white house and Senate Republicans. Now it is in their hands to reschedule the vote or have a hearing. High stakes decision. This hearing could be extremely significant and completely up end the nomination process. Depending how it goes. It would be catastrophic for the nomination. Its a huge risk at this late hour. If they had a thursday hearing, they would have to happen tomorrow. Having it here in one day is very difficult. They could delay the proceedings further. Ultimately, can they get the republicans in line and the democrats almost certainly are all going to vote against her. Even the red state democrats. A key tweet, Susan Collins said professor ford and judge kavanaugh should both testify under oath before the Judiciary Committee. Some key republicans want it to happen. That are math makes it over. She would be a key vote if it came to the floor. There would be an option and 50 days before an election and you will have a 70 Something White man deny her the chance. Thats not going to happen. Susan collins said they should be heard. Jeff flake is on the committee. One republican goes away and they cant move ahead. Jeff flake said i made it clear, im not comfortable if we have not heard her side or explored this further. Senator mcconnell and chairman grassley trying to get their ducks in order. I suspect by the end of the day, we are going to have a delay and maybe for the fbi to investigate. And perhaps plans to move forward with a hearing. If you have flake and collins saying that, it seems like the only way there is two things that can happen. Kavanaugh withdraws or is pulled or move forward with a hearing and hear from kavanaugh and hear from this woman. I think that that is the only way they want to push forward with this nomination. I will say this. Covering the midterms for a living, thats my day job, the specter of a woman up there talking about a painful experience with all the cameras on and a collection of all men interrogating her, that is not what the gop wants going into the midterm elections. You have already got women in this country, many of them are fired up and enthusiastic to a vote against President Trump. The possibility of that hearing in late september, early october, i can tell you from talking to folks, that is not something the gop wants to see going into it. Early voting now starts before election day, too. I agree with the optics and your point about the committee and one of the reasons we have a delay is you have 70 somethingyearold white men who dont like the process being disrupted. Its not about process. This woman wants to come forward and tell a story and she deserves to be heard. Kellyanne conway, the most senior woman around the president of the United States who has controversy with issues like this and one of the most reasonable things in washington. Everybody take a pause. Let everybody tell their story and we regroup. This is the catch 22. The prospect that a hearing itself could be really bad optics for them. The prospect of not hearing for this woman and being seen as wanting to silence her can be very damaging to them. Even before kellyanne went on television this morning. We were hearing for source that is the idea that they want to go head to head with this woman is completely untrue. There is very little desire to have that fight play out at this moment. They dont view it as being helpful to kavanaugh. If you look at collins and murkowski, these are woman that you dont want to antagonize before you get to a floor vote. People around the president are aware of that. The president is doing his part by staying silent, but hes never been a me too kind of guy. He never liked this torpedoing his people. He doesnt like it now. I think he knows he wants kavanaugh confirmed and this might be the only way. He might want to pick up the phones at the judicial crisis network, a conservative group to find judges and sell nominees. They are planning for the 1. 5 Million Campaign defending kavanaugh saying they are not going to allow a last minute Smear Campaign on a did good and decent man. If she wants to come forward, she should be heard in some way. The reason to question the timing is because it was dictated by senator Dianne Feinstein who had this information and used it cynically by busting it out at this point. As Susan Collins notes, casts a cloud over both the accuser and the accused. He was under oath and she was there and could have asked questions. When we are called publicly to adjudicate these things 35 years after the fact, which was very tough. I look to a couple of criteria on this stuff. The named accuser on the record and two contemporaneous reports and helpful as in the roy moore case when they are verifiable. And four, not are necessary, bu they were in the roy moore case. In this case we have a named accuser at this point. The next step would be to hear more from her. If you get more of those things, fine. This is a tough situation for the gop and designed to be one partly by the timing. There is no question the timing is unfortunate and complicates everything. The attorney is an esteemed attorney for the woman who is defending feinstein. Even her democratic colleagues were not happy about it. She is defending her saying ms. Ford was having a hard time about whether to public publbec or not. A reason to have a hearing. Everyone can ask every question. The attorney for the accuser describing in more detail the party where ms. Ford alleges Brett Kavanaugh assaulted her. Was your client also drinking . My client had a beer. She was not stumbling drunk. The men were stumbling drunk. One only needs to look at the writings of mark judge who was the only person present. He and other members were repeatedly, routinely, this was part of their culture. Mark judge is a former classmate of kavanaugh and cold the Weekly Standard he has no recollection of this and doesnt believe it happened. He said it would be out of character for them. You have by ms. Fords account, Brett Kavanaugh and mark judge were in the room and a couple other people in the house. You could put a team of fbi agents on this and collect what is left with the direct interrogation in a matter of days. Its longer than a matter of days. Some time to turn something around which is one reason why there is a concern of going down the routes the democrats are pushing for a fullblown probe, but they could call the people forgive me for interrupting, but Mitch Mcconnell who said he has his reasons who would not let Merrick Garland have a vote for a year. We have to put Brett Kavanaugh on the court in october. Thats a hard argument to make when you have a legitimate issue in fairness to everybody. Judge kavanaugh who said it never happened and ms. Ford who said it did. No question, thats a hard argument to make. If you let this hang out, an investigation that can take more than a couple of days and a hearing that happened much later, how much does that hurt the nomination by being out there . The members are going to get more and more pressure back home. Collins and murkowski where they need support ultimately. This is why the allegation is so significant. It could derail this nomination and its so unpredictable. President trump is not going to stay quiet. If there is any press depth we can rely on, he may be restrained in the first few hours, but hes not going to stay quiet. Speaking of precedent, with this president , every time of these stories we have seen, he sides with the accused. With the man who is whether its roy moore or rob porter and even mike tyson, the long time boxer. He sides with the man. Those are not votes who are directly connected to him. Like kavanaugh is in this fashion. Someone whose legacy is tied to his. Thats a challenge for the republicans. Its not just what they do on the hill, but what this president says in the hours and days ahead. We will come back to this, but the math of the moment gets the no choice. 5149. The math is done. They will have to do something to investigate this in days which they cannot or delay the vote on thursday which appears inevitable. They have to decide how to fight this. Do they want to fight on the ground that is it happened so long ago and he was a kid and doesnt have any bearing on him right now or that it didnt happen at all . The latter. Hes on the record twice saying it didnt happen. What you are hearing from a lot of republicans is some people wanting to have the other argument which is to say he was 17 years old. Thats what you have to keep in mind any time a trump official or anyone in politics goes on tv. They are speaking not just to the general audience as we are now, but often about the president. The first statement from the chairman of the Senate Judiciary committee. Senator grassley moments ago issuing a statement saying anyone who comes forward as dr. Ford has deserves to be heard. I will continue working on a way to hear her out in an appropriate, precedented and respectful manner. He goes on to say the standard procedure is to have a Background Investigation to conduct followup calls with the relevant parties. In this case he said that would include a call to ms. Ford who said Brett Kavanaugh sexually assaulted her in high school and grassleys statement said a conversation with judge kavanaugh calls. Dianne feinstein refused to go along with that. The Significant Development is ms. Ford is willing to testify publicly. Here chairman grassley said they prefer to have a call. We are talking about the politics of that and the danger of the kavanaugh nomination. This is a box for everybody. A situation that is complicated for everybody. Let me start with the republican at the table. Chairman grassley is trying to say we will listen to ms. Ford, but this indicates he does not want to do it in a public setting which is a huge risk for republicans and judge kavanaugh. Since she is willing to testify publicly, can they do that . As your previous guest mentioned, on the one hand its extremely important to make sure that republicans are doing all they can to say we want to hear from this person. In fact, its a shame that democrats for weeks and weeks and weeks knew of this womans testimony and knew of her story and kept it silent until the moment it would be the most politically advantageous to bring it to light. However, i do think that even if Senate Republicans dont go along with an open hearing, they will have the argument available to them. He was already under oath. We had the hearing. Why did they not bring it up before the hearing happened . Its the fine line of making sure you want to make sure this womans voice it heard because her story deserves to be heard. People deserve to know what she has to say. Holding firm that this was not done in the right way and the democrats should have brought it up when you had people under oath. Its really about far more than what we do next. What is the story here. What is the broader picture of what this means for the American People and women voters who were watching. You have had a gender gap and Party Identification since 1980. In 1992, the year of the woman in response to how anita hills testimony was handled. And then you have a president now who has been accused himself of Sexual Assault. On top of that you have a Supreme Court nominee who will throw the people before we had an actual nominee and worried about the court becoming too conservative and a nominee with this story that news to be investigated and discussed. Potentially protecting a president from who has his own challenges. You add that in addition putting womens rights. You have all that together and its important that we have a conversation that seems inclusive and open minded. You touch on why this is so complicated. There is judge kavanaughs nomination. He deserves to be treated fairly. Ms. Ford said this happened to me and i had a hard time wrestling with whether to go public, but now i do. There is the issues of the balance of court being at stake. There is an election 50 days from now where the women view as the key constituency. How is this in a way that is respectful to everybody . Do you believe if she is going to testify publicly, Senate Republicans can say we will go ahead with the confirmation vote without her testifying publicly . I suspect my bet since we are in the polling business and our job is to forecast whats to come, what i forecast is going to be a lot of ugliness. I dont forecast this will be done in a way where everybody is satisfied that both sides are heard and the vote proceeds and we move on. From a political perspective, the kavanaugh nomination in the data i was seeing is not something that was a big driver or factor in something thinking about the midterms. In red states you had some folks who voted for President Trump and wanted to see his nominations get through. Yet had a democratic senator up for reelection and how that factors in. This moment has really elevated the story to a much higher level of importance and a piece of the conversation, which i think makes it more challenging for republicans in concert with all of the other polling news that came out in the last week or two is not good news. Stay with me because i want to go up to capitol hill. Phil, come into the conversation in the sense that all morning long the question is what will the Republican Leadership do . Chuck grassley is striking what he calls a reasonable compromise. Can he sell it . Thats right. The chairman of the Judiciary Committee putting out a lengthy statement. Anyone who comes forward as dr. Ford has deserves to be heard. I will hear her out in an appropriate, precedented and respectful manner. One of the key take aways is what i have been told. Republican staff behind the scenes over the course of the weekend was trying to work with minority staff to set up a phone call with the accuser and touch base with judge kavanaugh. Democrats rejected that and believe there should be public testimony and the confirmation vote on the Committee Level needs to be postponed. When you read through the statement that grassley put out and talking to republican staffers and aides throughout the morning, you see the frustration here that this came upon them just last week and they didnt know about this and filed with the team before last week. There is a lot of frustration and questions about motives. One thing there is agreement on is that the accuser needs to be heard and judge kavanaugh probably needs to be heard again. Trying to thread a needle here and the question remained and this is what i heard from aides throughout the day. Whatever republican senator, Susan Collins and Lisa Murkowski and jeff flake said they need to have concerns addressed. Thats likely whats going to have to happen. You saw senator collins making clear there needs to be testimony under oath. She did not say whether that needs to be public, but thats the push from democrats. If republicans start heading in that direction, too, the honest answer is Republican Leaders dont have much of a choice. Right now the chairman of the committee clearly trying to make the point, we are going through a process and the committee has a process. Democrats at this point are not willing to accept that process. How this ends up is an open question. The Committee Vote on thursday so long as other republicans are skeptical or want more answers are at best at this point. Let me end this way. We are discussing polling andida andidaand data. Help the guys here. I mean this with full sincerity. We are in the middle of this. White men who run the senate. Who cares if they are democrats or republicans. They are trying to face the movement of the specifics of this case and a movement and election 50 days away. I thought Kellyanne Conway was the highest ranking woman in the white house. Struck a reasonable position. Dont insult her or smear her. Let everybody be heart. Is that a reasonable position . Shouldnt the men take the queue here . The other thing is not dismiss the seriousness of what is being alleged. Thats not something Brett Kavanaugh is doing. He said it never happened. I heard rumblings behind the scenes of folks saying well, is it such a big deal . If we dont want 17yearold boys thinking this is an okay way to treat women. My advice to republicans is do not for one moment dismiss the seriousness of what is being alleged here. Thats good advice and important to not just be respectful and think about these actions and how serious they are and how they match your policies and politics, too. Lets start in arizona. This is the seat at 50 . This is jeff flakes seat. Martha mcsally at 43 in the cnn poll. This is likely voters in the state of arizona. A likely poll had sinema ahead. Dont invest in any one poll, but in the state of arizona carried by President Trump, republicanheld right now, the democrats are in play and with a slight lead heading into the final days. Thats arizona. A republicanheld seat. Tennessee, the retiring bob corkers seat. The democratic governor in our poll with a fivepoint lead over the republican congresswoman. 50 to 45 . The fox news poll had that closer, but average them together. A very close race with the democrats in play or slightly ahead in the state of tennessee. If you look at the map and take the solids, the likelies and the leans, what would happen . Lets go out to the state of arizona and if the democrats are in play there. Just by taking the two republicancelled seats, the democrats are in play and maybe florida will break their way. Maybe they hold indiana or missouri, but the senate is very much in play. These new polls reinforce that. Building a wall. Here supports obamacare. He supported tax cuts. Thats a nonstarter for me. He gave crooked hillary tons of money. And now washington democrats are behind. One of my favorite things i did as governor is brown bag lunches and just talking about things. Its concerning to me the debt we will leave to our children. Its taken both sides to get us in this debt. Its a moral issue. Tells you a lot. Dont go to vegas in any one poll, but the democrats are ahead or at least in dead heats tells you about where we are. The irony is in this year of the antitrump anger on the left where everything is about trump, the candidates who could be the majority makers, Kirstin Sinema is running a super cautious campaign where they avoid criticizing President Trump and more often take aim at their own party. Its striking to watch them in that ad. He is talking about how this is out of control. This is so old school and pretrump era, but thats the reality of democrats running in red states. They will get huge antitrump energy in the liberal pockets in the states and raise a ton of out of state progressive money, but the message to actual voters on tv and in person is going to be like circa 1987. Its fascinating. No question that the antitrump sentiment is helping them despite their own messages that are not so much antitrump. The same poll that came out said trump was at 35 in arizona. Tied with tennessee. Just 4948. A state that he won overwhelmingly in 2016. No question this energy on the democratic side. The map in the senate has changed so dramatically. It favors republicans when you look at the state and now we are talking about the prospects of maybe the democrats could win the senate. Its difficult, but possible. The statewide races and in both of the polls, you saw both female candidates trailing with women independents. This is a persistent problem. I think they are running smartly because you have to run more towards the center despite the talk of the democratic socialism or far liberalism. Thats the no the case in these states. Hes a known quantity. Sinema is attempting to pull it off. It cant be shown how favorable this is. They are totally blowing the opportunity. They may end where they were. Surprisingly at the end of the day, things were set up this year to favor them. Math was so tilted in their favor.
