We begin here. The president s longtime lawyer and fixer, Michael Cohen, back in federal court in new york this hour. President trump getting a realtime lesson in just why his lawyers keep begging him to stop talking about pending cases. The Court Hearing is for an update on how to handle the records and materials the fbi seized from cohens offices and his home. Because those materials relate to cohens work for the president , there is, of course, extra sensitivity about how to handle them and about how to protect things covered client p. But prosecutors are saying it perhaps isnt as big a deal as cohen and his lawyers are insisting. Heres new evidence fresh in today. How much of your legal work was handled by Michael Cohen . As a percentage of my overall legal work, a tiny, tiny little fraction. But michael would represent me and represent me on some things. He represents me, like, with this crazy Stormy Daniels deal. He represented me, and, you know, from what i see, he did absolutely nothing wrong. There were no Campaign Funds going into this. Now, that tiny, tiny little fraction comment . Thats what prosecutors are focusing on in the federal Court Hearing in new york today. The rest of the president s answer there is also a new exhibit in a big civil case, the one filed by adult film actress Stormy Daniels. You just heard the president saying this morning no Campaign Funds were used to buy daniels silence. Three weeks ago, though, the president said he didnt know anything about the payment. Do you know about Michael Cohen paying 130,000 to Stormy Daniels . No. No. What else . Then why did Michael Cohen make tohose comments . You would have to ask him. Michael sheriff of the new york times. It is stunning to Michael Cohen who walked into court a few minutes ago and the judge on how to handle these documents are quoting to fox s friends thi morning. There are things the president said used in court. The president says it one hour and the next hour its in court. I think what he said, its unclear what the legal significance of it is going to be eventually, but this idea of this changing story, i knew nothing about what Michael Cohen was doing, Michael Cohen said trump knew nothing, now trump said cohen was representing him in this matter. The fact the story keeps changing for mike avenatti, for Stormy Daniels lawyer, and for anyone who wants to try to question trump in related matters, i think it only enhances their case to say, we have to interview the president directly because the Public Comments he makes keep changing. And it underscores the danger for the president if he ever does sit down to answer questions in any of these cases, whether it be the Stormy Daniels case or the mueller case. The president is not disciplined in either deciding not to Say Something or when he does Say Something in saying it exactly the same way each time. And that is what, you know, brings people into jeopardy in these kinds of situations. This is on two tracks. The hearing under way right this hour is Michael Cohen in new york. They seized all his materials, they took his phone, his laptop, his bank records. The president saying he has nothing to worry about. He has lawyers in this hearing to make sure nothing that effects Michael Cohens legal advice to the president gets thrown in here. But if you listen to the president this morning, weve heard this about Paul Manafort in the past, and Michael Cohen. Because hes got other things, hes got businesses, and from what i understand theyre looking at his businesses, and i hope hes in great shape. But hes got businesses skmiz lawyers probably told him to do that. But im not involved and ive been told im not involved. Key from the president at the end, ive been told im not involved. We know from reporting that hes been told by the Deputy Attorney general that at least at this moment the president is not a target. This is about cohens business dealings, bank records, trying to track some money. Not at the moment. But thats the president , thats mi michaels thing, its got nothing to do with me. Thats a classic trump move, right . Hes close to people for years and he can manage to distance himself in a second if he feels its advantageous. Like Paul Manafort when he got roped in to the investigation. We know people that have been around him for years and years. He has no problem saying, im not involved. Hes been a business intermediary in the past. I think all these questions are going to come up. The president said in that interview that cohen has only represented him in a tiny, tiny portion of legal cases. For President Trump thats still a lot of legal cases. Michael cohen is a big deal. He calls himself a pitbull. Hes lawyer of the president and other people in trump tower. He traveled to moscow, in fact, to explore the possibility of a trump tower there. That fell through. His involvement with Stormy Daniels has been shown politically. He raised money for the campaign. Michael cohen is as close to donald trump as you can get. I understand the president saying the business investigation has nothing to do with me. There is a reason the president has attorneys in that hearing. He understands this stinks for him. Ive said it before, im happy for the government to have to jump through hoops and prove why its necessary to have to raid an attorneys office. I think thats good for all of us. But im not sure in the Stormy Daniels story, what the implications are yet. It doesnt point to good for the president , and whats been a problem for this administration throughout, even if theres not much there at the end of the investigati investigation, they do not care, they are not disciplined, and they dont care about him making false statements. If youre in that room, you walk down a dangerous path. This is an unknown crime we do not know yet, and now it looks like a scummy 130,000 sec violation. Thats not the biggest trouble in the world. Were bouncing around and its hard to keep the distinctions. Theres the federal case of Michael Cohen. Theres also the Stormy Daniels case. Shes trying to be relieved from an agreement. They want to depose the president of the United States. Heres Stormy Daniels lawyer this morning saying, remember, on air force one the president said, i dont know about it, call Michael Cohen. Today the president said, call Michael Cohen but it doesnt involve Campaign Funds. He seems to express more details, not the timing of it. This is why they want the federal judge to say President Trump has to be deposed under oath. This case gets better every hour, and the reason it gets better is they step into every trap we lay. Its going to help our efforts in deposing the president and place him under oath. Now we have two contradictory statements made in the same oath outlying what he knew about the agreement, what he didnt know, what his relationship is with Michael Cohen, and were going to utilize that Statement Today to argue for his deposition. Now, to be fair to the president , theyre not contrary statements, theyre not directly contradictory statements, but theyre different statements. One shows no knowledge, the other shows some knowledge. He may have known if he knew nothing about this in october 2016, he sure as youknowwhat knows a lot about it now. If he claimed to know something before and now claimed that he didnt, in theory, you could argue both statements are praif operative because he since learned more about because theyre not consistent statements, it does help mike avenattis case to go to the judge and say, look, lets have a hearing set to go through it. The only way to have it fixed is through a deposition. This reminds me of james comey drawing upon a reservoir of trust and the general credibility of a witness or target or whatever it may be influences how prosecutors bring their case in court. So i think these statements the president says do really matter even if he doesnt realize the implications in the moment. The one consistent thing has been, mr. President , stop. Dont talk about pending cases because everything you say can and will be used against you in a court of law. Compared to trump, avenatti is a mildmannered lawyer. He has been laying these traps for the president , and because the president cannot stop talking, cannot stop tweeting about all manner of issues, he does tend to fall into some of these exact traps. Again, lets be clear. Its not clear what this add up to legally for the president right now, but just in terms of the optics of it, the idea that the president does seem to fall into Stormy Daniels traps. Another inconsistency, the president this morning saying this is michaels business, michael is pleading the fifth, thats up to michael, let michael handle his case. The president is on the record in other matters not involving anyone close to him saying, anyone who pleads the fifth must be lying. Did you see her i. T. Specialist . Hes taken the fifth. The word is hes ratting her out like you wouldnt believe. When you have your staff taking the fifth amendment, taking the fifth so theyre not prosecuted, i think its disgraceful. If youre innocent, why are you taking the fifth amendment . The fifth amendment happens to be one of our most cherished legal tradition to see an american citizen can protect him or herself in a legal proceeding, especially if there are two or three Legal Proceedings going on at the same time. Michael cohen is deciding the federal case is a big deal. The civil case . Im not saying a thing until im done with this one. Makes perfect sense for Michael Cohen, but the contradiction comes when the president , everything hes said in the past, comes back to kick him. We dont believe what the president said on the campaign trail then, we dont believe him now. It does not amount to an admission of guilt. It could simply mean you dont want to give the prosecutors or people coming after you information that could be used unfairly against you. His allegations range to drinking while on duty, banging on the hotel room of a female subordinate and improperly dispensing prescription medications. After that interview a tweet from ivanka trump praised Ronny Jackson and said she looked forward to working with him at the white house every day. There is also a question whether the pentagon will be compelled to look into these allegations. Number one, anyone have a sense . Anyone know who the president is going to replace him with . He had a list before he made this surprise decision to put Ronny Jackson out there, and it was made up of some fairly traditional candidates and some nontraditional candidates. So there is a pool of people he can go back to. I think the real question is what hes going to be hearing from republican senators about the next name that he puts forward. A lot of these republican senators are just going to want him to put forward a pretty conventional pick, someone who can get through a confirmation hearing in an Election Year pretty easily on an issue like veterans that should be pretty safe ground for the white house. Lets roll you back on that point because its a critical point. Before you can get to that po t point, the president has to look himself in the mirror. If these allegations are false, have that evidence, have that material when he meets with senators. If one or two of them are correct, were all human. Make your case to senators as you go through some of this stuff. Instead the president nominated him on a whim, sent him there without a thorough vetting and now his reputation has been tarnished. Senators on capitol hill say they want to keep going. Forget donald trump, forget republicans. There is a doctor who sided with the president of the United States on these key foreign trips and there is question about his conduct. Not only has the president not learned the lesson about the vetting question, but because dr. Jackson a nomination was sort of went awry because of these character issues, the president also has not confronted what were deemed questions even before the character questions about whether he had the experience and qualifications to lead this kind of agency. So i think whoever he picks, there is no indication that those lessons have been learned, either the vetting or the qualification. Sarah sanders just saying at the white house, the president has a great deal of respect for Ronny Jackson, really likes him a lot, hates whats happened over the last several days but likes him a lot. Everyone hates what happened over the last several days. A process done backwards has put maybe legitimate, maybe unfounded allegations about the personal and professional conduct of someone who has served in the United States military on the hot seat. It also has caused democrats and republicans to clean up a mess the president made by not doing his homework beforehand. Republicans are expressing just as deep concerns about dr. Jackson. The ranking democratic member of the committee who happens to be up for reelection this year in montana, and if you look at television, Johnny Isaacs and the chairman said, pull your application, youre in trouble. He did say some more provocative, and i would say let the man have a hearing, let the man have a chance to answer these allegations first. The president this morning focusing on the senator from montana. I watched what john tester of alabama, a state i wonly like over 20 points, you know really they love me and i love them. And i want to tell you that jon tester, i think this is going to cause him a lot of problems in his state. But for jon tester to start bringing up stuff like candy man and the kind of things he was saying. And well you know these just statements are being made, theres no proof of this. I think jon tester has a big price to pay in montana. Senator tester says, hey, wait a minute. Ive been bipartisan on these issues. Ive worked with the president at the white house on veteran issues that we have whistle blowers come forward and it was my job to investigate. Senator tester says its Congress Responsibility to keep this investigation going. The president knows a good political target so, republicans aside, lets go after a guy who really might pay a price, right . I do think some of his language is irresponsible given there hasnt been the full investigation. Speaking for admiral jackson, you dont get to be an admiral be being a screwup. There are issues from the past three administrations, but do i think the lesson was learned about vetting . Probably not. Im not afraid to admit theres been a learning process, and when congress or independent bodies of oversight find fault in our decision making, i want to correct that ask nd ensure t it does not happen again. The republicans have been polite to pruitt, the democrats anything but, calling him an embarrassment to the president. You said that youre staying because only you can carry out the president s mission. And i strongly disagree with that. I think your actions are an embarrassment to President Trump and distract from the epas ability to effectively carry out the president s mission. And if i were the president , i wouldnt want your help. I would just get rid of you. Now, if you havent been paying attention, those troubling media reports pruitt acknowledged, well, take a peek. Jackson, and they did recognize that in his management alert you did recognize him, then, to sign them . That decision was made by yes or no . Did you authorize him . There were delegations given on that authority. I was not aware of the amount, nor was i aware that of the bypassing or the ppo process not being respected. Well, then, im concerned that you have no idea what is going on in your name at your agency, especially on an issue already under ig investigation. Im the administrator, my chief of staff signed off on them, but im accountable. The buck stops with me. Wont happen again. Whats wrong with that . Nothing is wrong with that, but hes taking his cues, and i think a lot of people in this administration take their cues from the president. He has a propensity to feel unfairly treated himself. Thats what you see with Ronny Jackson, you see it with scott pruitt. He feels theyre being treated unfairly and it makes it hard for him to distinguish whether these allegations are very serious and they report directly on him. We have seen in recent weeks more republicans saying its time to do more oversight. Its an interesting dynamic in the Election Year. In this committee hearing, for the most part, there were questions about did scott pruitt overdo things on the republican side. We got this. Im hoping we would be able to stay on policy today as much as we could, but im seeing some just cant resist the lifeline, the opportunity to grandstand. Many. If you cant beat policies in washington, you attack the personality. Thats whats happened to you. Shameful today that this hearing has turned into a personal attack hearing. Its very nice to say that everybody should just talk about policy and not talk about politics. Sarah sanders herself yesterday said scott pruitt is going to have to answer these questions. You know, part of what we will see in the next 24 hours or what have you is, did his answers today, to the members of congress, satisfy with the white house definition of answering these questions fully enough or not . For republicans to deflect and say, well, we wish we were talking about policy, that was never going to happen because this is washington, but in addition the white house said he should answer. The problem with the Trump Administration is there is not a topdown message of keep your nose clean and do your best job as possible. You get into these problems, i think he still has the support of President Trump which matters, and contrary to what you think, i think he still has the support of trump voters. Reporter a big decision on how the documents will be handled now in this case. They have decided to appoint a former judge, barbara king, as a special master to oversee these documents. To the degree of that, were not quite sure. Thats still coming out in court. But certainly this is a Big Development in this case because it allows the criminal investigation into Michael Cohen to proceed forward. A little bit about the former judge barbara king. She was a u. S. District attorney for 16 years appointed to that positio position with president bill clinton in 2005. Before that she served in the Southern District of new york. She certainly has a familiarity with this court here in new york. A big thing, just some background for your viewers about this special master. This is a neutral person from the investigation, from the government, from cohens attorneys to oversee i said the wrong name, im just getting corrected in my ear, i apologize. Barbara jones is the name of this judge. A special master is a new position in this case, separate from the government, separate also from cohen and his attorneys. Again, she will oversee how these documents move forward. Cohens attorneys actually wanted a special master in this case for these proceedings. The government first said they didnt and then earlier today before court actually took place today, they said they didnt mind. They took that back in a filing mainlily becauy because of that interview that President Trump went on fox news claiming that cohen really didnt have many legal matters for him. So that basically bolstered their case and thats why they argued they were okay with the special master. Barbara jones the name of the special master appointed in this case here for Michael Cohen. Now we get to move forward. Bryn, outside the courthouse, thank you so much for that update. Lets get quickly to our reporter shimon prokupecz. What about the speed and process Going Forward . Thats exactly right, this has to do with the speed and process moving forward. They feel like what the defense team mwanted, what Michael Cohens team wanted was to move things forward. This morning they agreed sort of taking control of this investigation, these documents, deciding that a special master probably would be best. They told the judge that this morning. The judge clearly now agreeing. Perhaps maybe some of what the president said this morning may have played a role in this. We dont know yet. But we know they did use his comments in their filing this morning with the judge, those comments on fox newsme. They also said it appeared that while Michael Cohen was claiming sean hannity was a client, sean hannity has said hes not a client, so there are a lot of things that probably factor into the prosecutors decision. Prosecutors have said, and Michael Cohens legal work was minimal, if any at all, in that his only client really was the president. So their feeling has been all along that there wont be a lot of privileged information in this, and theyre hoping by having a special counsel, a special master appointed to go over these documents, it will move this case much faster, and this way they can proceed with any potential charges that they may bring. Let me say with all the strength i can muster that no nation has a finer group of law officers than those who comprise the fbi, the dea, the atf and the United States martial service. We face criticism, and its a free country. We will not be defensive when questions arise, even if misplaced. We will take necessary action to establish that the concerns are either not true or take strong action against any wrongdoing. Now, take those words from the chief Law Enforcement officer of the United States, the attorney general, the integrity of the agencies. Heres the president saying no. They have this witch hunt going on with people in the Justice Department that shouldnt be there. They have a witch hunt against the president of the United States going on. Im very disappointed in my Justice Department. But because of the fact that its going on, and i think youll understand this, i have decided that i wont be involved. I may change my mind at some point, because whats going on is a disgrace. Its an absolute disgrace. An absolute disgrace, the president of the United States. No nation has a finer group of Law Enforcement than the fbi. It went on to say even if the questions are misplaced. Its a pretty remarkable statement from the president , number one. Then from the attorney general calmly but right back at the president saying, no, sir, youre wrong. Thats why Jeff Sessions has come under fire from donald trump personally because he is defending the agency that he oversees. You find yourself kind of getting a little immune to what the president says about the Justice Department because he does say it so frequently, but it is extraordinary to have a president who is consistently undermining the work that is being done there. Yes, he is personally involved in one investigation that is underway, but it is a dangerous precedent for the president to be so forceful in criticizing the Justice Department. Its almost unprecedented. He thinks theyre supposed to drop any cases against him, lock up hillary clinton, lock up Andrew Mccabe and jim comey and move on. Thats what the president thinks.
