Burnett and we begin with the breaking news. Tom brady is firing back. The new England Patriots superstar quarterback will speak live moments from now. This is where hes going to be speaking a live picture of Salem State University in massachusetts. Its his first public appearance since an nfl reported that brady like i knew that the game balls were deflated to his knowledge. As we await bradys live remarks, here he is moments ago. He arrived at the university via helicopter. Bray day is speaking to night at this massachusetts college. It is just 15 miles knotnorth of boston. This gives brady the Home Field Advantage to answer the charges that he was quote generally aware that the footballs were deflated. His agent today released a statement slamming the nfl report the charges first surfaced in january. This was right after bradys new England Patriots won the game that got them into the super bowl and ever since bray da had repeated that hes innocent. I mean i feel like ive always played within the rules. I would never do anything to break the rules. Brady scheduled to speak in a few moments. Were standing by to bring you that live as it happens. Debra feric is outfront tonight. Shes there in salem, massachusetts. What can we expect . Reporter well heres what we expect. We expect a lot of happy fans who are eager to see tom brady. Theyre wearing brady tshirts. One of them said the report was waikted towards the nfl but they still have a lot of faith in tom brady. This event was sold out the day the tickets went on sale. These people all expected to be here. Tom brady is going to get several questions. Some of them may relate to deflate gate but the majority may not. Were going to hear what he has to say and whether he decides to take the bull by the horns and address the questions that so many have about this report. New England Patriots tom brady firing a bullet back at allegations. His agent charges that the deflate gate report has tragic flaws that suggests investigators reached a conclusion first and then determined socalled facts later. Brady first responded to charges that footballs were deflated to his benefit a few days after winning the afc championship game back in january. Is tom brady is cheater . I dont believe so. I didnt alter the ball in any way. But the report lays out a string of circumstantial evidence against brady concluding that he was at least generally aware that the game balls were deliberately deflated. Much of the evidence centereds on two patriots employees, john gentleman strem ski and locker Room Attendant jim mcnally who referred to himself as the deflart. Damning Text Messages between the two started months earlier, including the jokes about the expected pay back. Quote, i have a big needing l for you this week he wrote before one 2014 game. Mcnally responded better be surrounded by cash and new kicks or its a rug by sunday. F, tom. The two texted about needles and toms preference for a soft fastball. Then theres this text. Brady, you good johnny boy . The equipment man answering still nervous, so far so good. Ill be all right. Brady, you didnt do anything wrong, bud. Surveillance video showed mcnally just before the game going to a rest room near the entrance with game balls within gone for one money 40 seconds, enough time to let the air out, investigators say. While brady denied knowing mcnallys names or duties the report states that mcnally told nfl security he had been personally told by brady of bradys inflation level preference. Then theres this despite not having spoken by phone in sixth months investigators found in the three days after the game the star quarterback and the teams assistant equipment manager suddenly exchanged six phone calls, speaking to each other for a total of almost an hour. And tom brady never handed over any of his texts, any of his electronic communications. So people are wondering why. But keep in mind all these people here theyre showing up to celebrate tom brady. They were intended oncoming. The deflate report total coincidence that it happens to be now, the day hes scheduled to speak. Whether he answers any questions about that one man said wheres your spirit brady, brady, brady. The fans here love him. Thank you very much. Something very important. Youre talking about the most wellknown player in the sport, a super bowl something watched around the world. Out front now, coy wire and u. S. Today nfl columnist gerald bell and mark daniels, he covers the patriots. Hes on the phone because hes actually inside the event tonight, sitting there listening as tom brady goes up to that podium and we all hope and expect will address this issue. Its a soldout crowd. Its 15 miles from boston. Whats the mood there where you are . I would say right now weve got about 4,000 anxious fans. People would be excited either way to sea tom brady. But with the recent allegations and everything thats been going on people are a little nervous right now. It will certainly be interesting to see what tom brady has to say. I think it helps that hell be talking with jim gray someone who hes very familiar with. And how do you expect this will gone down mark . Obvious lis these questions hes getting are vetted, but they may choose to address this right off the top, right . This is his first opportunity to weigh in on an issue that everybody is watching. Exactly. I mean i think it makes sense to get out in front of this now. This is kind of the perfect opportunity. The media here we wont be allowed to ask tom brady any questions. Chafr comment he wants to say, no one will have anything to ask him back. Its a relaxing atmosphere. However he wants do this he can do it. Its a perfect situation for him. Certainly hell be lulled into a sense of security. Those pictures of his arrival, you can see the officials there from the university looking up at him with south of a sense of aj las vegas. Coy, you played for the nfl for nine years. What do you expect tom brady will say . Well we only get ten minutes, as we know and then theyre going to cut off the live stream. Will he Say Something within those ten minutes . Is he going to reguj tate the statement from his agent, which doesnt say all that different from what the owner said earlier or is he going to Say Something commanding and offer an intriguing interpretation of what happened so he can tell us what he saw and we he saw it. The thing that stood out the most from the statement from his agent is he said he was physically present for tom bradys interview and verbatim he says for reasonens unknown the report omitted most of toms testimony, most of which are drit critical. If you have the notes why havent we seen them . There was a reason they were omitted, erin. This is the live picture of the room. As you see the crowds lining up to get inside. You just heard deb fearic say he hasnt talked to his equipment manager in a long time and all of the sudden six phone calls days after the game with an hour of talk time. Some people said because it was got cold and it was raining with that would explain the issue with the balls. They had 68 pages in which they in the report say that is almost certainly not the case. That doesnt explain this. What can tom brady say that will make people believe his side of the story . Obviously the fans in the room believe him. But the nfl, the rest of the country. No question. I think coy hit on a point. If there are gaps in what came out in the wells report versus what tom bray ki wanted to be out there in terms of representing what he thought and what he felt the situation was that needed to be clier fied. But you think back to the press conference that tom brady had as this issue surfaced right after the championship game. He had the press koorchs where he pretty much said he knew nothing about it. This is the real interesting thing that needs to be squared away now. If you knew nothing about it and declared that at the press conference what did you talk to these guys about, what did you talk to the equipment manager about for an hour. And you had all of these text message exchanges and these phone calls. What was that all about . You know it could have been a case where tom brady was trying to get to the bottom of it. If you remember bill belichicks conference that same day where he said he learned more than the ever knew in 40something years about the deflation and inflation of footballs. Well we didnt get that from tom brady. So at that point he basically said that all hands for off, he knew nothing about it. Well we know that he definitely knew more about it than he let on. There has to be some kind of clarification of that situation. Of course. The reality that we talk about him as a surgeon of footballs. He would have felt something was wrong. Even if he didnt direct someone to create the outcome, he knew about the problem. Suspending the general manager of the Cleveland Browns without pay. He texted his Coaching Staff during the games. The nfl suspended the president of the Atlanta Falcons, they pumped in loud noise during home games, 350,000 fine, they lost a draft pick np this the context what would be a fair punishment for the super mvp in the game that followed the game that all of this happened. The most wellknown Football Player in america with the evidence that they have which they say generally proves that he knew but not specifically. Well its definitely a challenge for the nfl to back up the rhetoric that weve heard from the league about the importance of competitive balance. And so if youre going to talk about having a level Playing Field and you have a situation where there was an unlevel Playing Field, then you have to address that. I think the recent penalties for ray farmer the browns general manager and rich mckay the Atlanta Falcons president set a template for what the nfl must do now. It must punish tom brady and the patriots either from the draft picks or fine or suspension. Its not out of the question that tom brady will be sat down for a game or two for this type of violation. Obviously right now were talking about now having that hard core evidence. But, you know brady could contend that basically the equipment manager deflated the balls below the level that he basically wanted to communicate to them how the falls felt without knowing the specifics. We dont know that. We need to hear that from tom brady. I appreciate both of you taking the time. Of course were taking this live. We also will talk about some of the other punishments, losing the mvp title, the patriots losing the super bowl title all together. Next were also learning new details into the investigation of freddie grays death. Was he murdered or not. And the fbi sent out a warning that gunmen were targeting the Prophet Muhammad cartoonist. Commissioner Anthony Batts is not afraid of a department of justice investigation into the brutally. The mayor is demanding the investigation. Batts says so what do it. Now questions of whether the driver of the van should ever have been charged with murdering freddie gray. The charges came fast and furious, six plafrs charged, one with Second Degree murder the death of freddie gray. The chief prosecutors decision surprised some, praised by others and now being scrutinized. Sources say the police case does not support several of the charges fooild against the officers including murder. According to officials, the police contemplated a manslaughter charge at after being briefed by the medical examiners office. The same investigators thought the autopsy would fall short of calling the death a homicide. But it turned out the medical examiner had determined differently. Mr. Grays death was a homicide. Another discrepancy, whether the knife found on gray was legal or not. The knife was not a switchblade and is lawful under maryland law zblu the Police Investigation found it was illegal under Baltimore City code. Theyve put out a statement saying while the evidence weve sustained stash yates the elements of the charges filed, i prefuse to litigate this through the media. Proving how he died amounts to murder is the hard part. Is this case going to be difficult for the prosecution . These charges . I think it will be difficult, specifically the Second Degree murder and the voluntary minneapolis. And the reason being is well the depraved heart requires willful disregard and that conduct caused in the death of the other. Doesnt required the intention of the person harmed or killed. The discrepancies have raised a red flag for u. S. Congressman elijah cummings. I think it should concern all of us. I cant judge that. But one thing i do know is that when i hear about things like that it reminds me that it is a good idea to do a pattern and practice type investigation. So you want oh yeah yeah. The doj in here . I asked the attorney general last week. Reporter and we know that the mayor said shed be happy to have the doj come in and investigate and that the city has been working with the department of justice long before the case came to the floor. We should mention that we did sit down this week with the mosbys and we spoke to the states attorney and tried to ask her some questions but she is adamant that she will not discuss a single bit of evidence from this case until the case is tried and the public ask see it in front of them. Thank you very much. Outfront now, defense attorney former baltimore criminal prosecutor ae along with van jones. Andrew let me start with you. This comes down to the charges, right . And you have the Police Investigation saying they were not going to end up where the prosecutor ended up. They say the Second Degree murder charge doesnt make sense. Thats what the prosecutor charged officer goodson with. So murder is a different charge than homicide which is a different charge than manslaughter and theyre all getting thrown around in the public in different ways. Weve got to be careful with this. The Second Degree murder is a reckless disregard for human life. The prosecutor is alleging it was so reckless and depraved of any heart for another person that the officererss did that and they should have known. This is goodson theyre talking about. Its fascinateing to me that that charge is in the case. The stutes in maryland which are the laws are interpreted by the cases. And theres a case in maryland interrupting Second Degree depraved heart murder that stands for the principle that when you have an manslaughter situation, that doesnt apply. So i dont know if they dont know that. Its shocking to me that this depraved heart murder charge is in play. So you wouldnt have gone tore vekd degree murder, bottom line . Absolutely not. Absolutely not. Absolutely not. Van, whats your view of this. To prove Second Degree murder you know you have to this reckless and depraved you have to prove that. Is this a guy who had been driving a police van for years. No one else had ever died in the back of the van. It would seem that if he had this reckless depraidveddepraved not caring about human life his record wouldnt be that. Every situation has to be taken on its own merits. Just because somebody did a good job yesterday doesnt mean theyll do a good job today or tomorrow. Heres the situation. When you have somebody who is taken into Police Custody and they wind upped dead we should be glad that the prosecutor is taking this seriously. Whats new is that you have a prosecutor willing to bring charges at all in in ferguson we had a da refusing to give charges. And gave an inflammatory speech the night he refused to give charges and you saw ferguson catch on fire within hours. Now youve got a prosecutor willing to do what prosecutors are supposed to do. Prosecutors often go very hard early on sometimes they back up. Shes being put on trial in the media because shes acting like most prosecutors do if they see a bad guy, they throw the back at them and try to get them. Its very important here the charges. This isnt just a matter of semantics or legal distinction. I mean as andrew points out, those are important things. But Second Degree murder is a 30year sentence. Involuntary manslaughter is a tenyear sentence. These are dramatically different situations van. They are different. But what im saying is simply this. Ill let my colleague get in here but i want to say usually when you see a prosecutor who says i see wrongdoing i see a bad guy, im going to go get them. People stand up and cheer. In this situation you have a prosecutor saying i see a bad guy, im going to get him. Now people are secondguessing. Whats different is you have a prosecutor who is willing to do her job when it comes to the police. Andrew when you look at the video and youre looking at officer goodson, the only one charged with murder the driver of the van, you actually see hes not the arresting officer, hes not the one who put gray into the van, hes not the one who made sure he was properly buckled. Fine wu you dont think he should have been charged with Second Degree murder. But if youre going to charge him with Second Degree murder wouldnt you have to charge the guys who were responsible for putting him in in a prone position . Well, so i think the first point in response to that the community kind of went the thing that got us going was we saw the arrest video where his legs were drags. Those officers are not the ones charged with murder which we can reasonably infer from the charges what theyre saying is whatever happened to him didnt happen before he got in the van. That shouldnt be lost on us. What happened and what Marilyn Mosby outlined is it was the failure to seat belt him. What are we going to do every time theres an accident and somebody is not seat belted, were going to charge them with murder . That would put people in a ridiculous situation. Number two, the other part of what we saw here is that theyre talking about the lack of medical care. And were going to steed need to see the autopsy and medical records to know what thats about. Its got to be foreseeable the to these officers. Theyve got to appreciate the harm for it to be at the level of Second Degree murder. What were reacting to is the ore person in the van said he was banging around asking for help, there were multiple stops. You have a lot more going on other than there was an oops and the guy wound up dead. There was a guy asking for help begging for help not getting help multiple stops. Lets not pretend this is an ordinary situation. Shes right to go after these guys hard and figure out whats going on here. Thanks very much. Braking news tom brady to speak out moments from now. Were standing by for his first pub luck appearance since damning nfl report charged that brady likely knew the game balls were dlab rately deflated to his advantage during the afc championship game. These are life pictures right now of salem university. Bay dri is going to be speaking there momentarily 0 in the room you see on your right. Were going to bring that to you live the minute he begins speaking. We anticipate that hes going to directly address this. He obviously has denied the charges again and again. But that report incredibly damning. Weve got our panelists standing by. In the meantime i want to squeeds in one more breaking story story. Were learning that the lowell authorities were warned by the fbi three hours before two gunmen attacked an event near dallas texas. That is the event where there were cartoons of the Prophet Muhammad. There are many others in the United States just like those two gunmen, just like those two men who tried to murder people in texas. Those people are waiting to carry out attacking. Pamela brown is out front in phoenix. Reporter the fbi was so concerned about Elton Simpson seen here in a new video obtained by cnn, that in the hours before he launched husband attack in texas, sunday the Bureau Shared his photo and license plate information with local police. Today the fbi director told report ers about that warning but said he did not know that simpson and his accomplice had already traveled to texas in a car full of body armor and guns. In this video he talked about his faith in terms of weapons. When you come together and pray five times a day, it provides you a form of weaponry to go out into the real world. Simpsons Online Presence showed a more extremist view. Weve learned that he communicated on twitter with known terrorists but also messaged privately with an american born member of al shabaab. U. S. Investigators believe hussein and hugh san each helped radicalize simpson, encouraging him to carry out an attack. But its believed that simpson chose the target. An evangelical pastor close to simpson said he was not surprised to hear simpsons name connected to the attack. He expressed to me admiration for osama bin laden. He used the word hero. We are also learned more about simpsons accomplice. He bought an ak47 on craigs list. His mother said her son a had dvds of the former leader of al qaeda and yemen. Reporter and we learned today from fbi director james comey that the fbi alerted local authorities in texas with a bulletin a few hours before the event about simpson, based on his treats twb his social media activity about the event. But were told that the fbi had no idea that simpson left his home here in phoenix, arizona and drove to texas to launch that attack. Erin . Thank you very much. Live in phoenix. And outfront now, military analyst and retired Lieutenant General mark hertling. The fbi director saying there are hundreds of possible u. S. Extreme mists right now that are linked to isis influenced by isis. This is the fist time theyve come out with specific numbers like that. How concerning is this to you . Its very concerning. But heres the thing. Im not an Intelligence Analyst or official but i use them a lot as an operator and as a commander. And when you have massive amounts of intelligence i used to tell me team heres what im looking for. Its got to be valid, timely relevant and precise. Once you give me those four things, im going to take action against it. What they have is elements of those things and in talking to hundreds of jihadists or people who are interested in jihad across the United States. But all of those things have to come together in order to take action. Thats where they faltered a little bit. The passing of information is a whole other story. The fbi is scanning the entire country with other intelligence agencies. When they get information and pass it to a local source like it was in this case you want to get that on the line real quick. But then is it precise enough to take action and it wasnt in this case. But my question is should it have been . This could have been something where a lot of people were killed. It could have been. Its incredible the traffic cop stepped up and stopped some kind of carnage from happening. One of the guys has been known to the fbi since 2006. Three hours before the attack the fbi warned local police they gave them a photo possible license plate number all of that information they knew and gave local authorities. But yet they didnt say that he had actually left arizona to go to texas. There is a perception if something awful happened here we would be looking a these things saying where did the ball get dropped. True. And looking back on Something Like that is a whole lot easier than looking forward. This guys name and picture was on a list of dozen os others with this kind of internet contact. Which one do you choose . Any one of those could have caused those actions but they didnt. Unfortunately theres a luck involvement in this as well. General, i appreciate your time tonight. Thank you. On that breaking news. Next the breaking news as we stand by for tom bradys first appearance since the nfl report threw him for, well calling him essentially could be a major cheater. How will brady answer those charges of cheating as everyone gets seated in that room were going to bring tight you live as soon as he begins speaking. And the most unpredictable lx in decades. Philips sonicare. Breaking news. Were just getting the first results from what is called now the most unpredictable election in dekads with millions and millions across britain voting. Exit polls suggesting there could be a massive upset. Thats pretty incredible. Prime minister David Cameron has been fighting for his political career. Richard quest is live in longdon. Its not only unpredictable but its possible theres an upset . Whats happening . Reporter bigredbus. The exit poll suggests that David Cameron will be reelected as the prime minister. Here you have mr. Cameron, the current, on the other side looks like he has not managed to do it. And nick clegg, the Coalition Partner for the democrats, his support has just about evaporate evaporated evaporated. If the exit poll is right, were starting to hear the first gurgling and rumblings that maybe the exit poll is not as accurate as people had first thought. So we really dont know. Its incredible to not know. Youre talking about britain, this is the United States closest ally. This is the country that has gone to war with the United States in afghanistan and iraq. The closest ally no matter who is in the white house. What does this mean for the United States . Reporter it certainly creates an element of uncertainty, whichever way it goes. If miliband looks like hes going to be able to do it its the question of the special relationship the transatlantic relationship. If David Cameron gets back in, then the real issue is camerons referendum on europe. Hes promised a ref run dumb on europe. Will britain vote to leave the european union. Whichever way you look at it, tonight im guess in washington they may be more relaxed about a cameron victory but certainly they will not be totally happy. We just dont know. Bigredbus were now headed toward the pick ka dilly circus the bright lights of london. Its 12 43 a. M. In london. It is stunning to not know the answer. Just imagine that happening here in the United States. All right outfront next, moments away from tom bradys live comments his first since the nfls scathing report on his role on deflate gate. Ask your doctor about xarelto®. You may be able to get up to 12 months at no cost. And the breaking news tom brady will be speaking any moment now. The patriots star quarterback going to make his first appearance since the blistering nfl report charged he knew game balls were deliberately deflated. Thats how he likes the balls. That this happened at multiple games but specifically of course at the game the patriots won that brought them into the super bowl. This is laif picture right now of Salem State University. Its just knot of boston. Brady arrived there by helicopter about an hour ago and now hes going to be come in the room. Someone in the room a reporter there telling us about 4,000 people now are seated ready to hear him. Most of them of course he is preaching to the choir here. These are his fans. Were monitoring the event. The minute he begins speaking were going there live. Now i want to bring in re chill nichols along with Rick Gosselin who has been writing about the allegations against brady. Bradys agent came out swinging today. There was a statement basically, they interviewed him, i have all of the notes with they didnt put anytime the report. The context is missing. This is his argument. They said the nfl is trying to make brady the fall guy for this. Do you buy the argument . I certainly dont think the nfl is out to get tom brady or if they have been out to get tom brady for the last 1w5 years, they have been doing a miserable job. Were they in this investigation as his agent claims, did they start with the conclusion and work their way backward to prove the conclusion . We dont know. Were not going to be able to dive into that methodology right now. One thing that was curious about the statement though is it didnt lead with tom brady the innocent. It led with here are the problems with the investigation. And i think there are a lot of people out there in the greater nationality who want to hear him get up there and say wait im innocent not the investigation was flawed. Those are two different things. In that room tonight i have to say, you said there are 4,000 people there. I think 3,999 are flag waving tom brady fans. They dont care what he says. Hes going to be met with thunderous applause. But there are people around the country tonight looking closely to see if he says anything what he decides to say. When you hear tom brady, he said again, again and again, that hes innocent. Let me play a quick montage of a few of the times and ways in which he has denied any involvement with this scandal. I didnt alter the ball in any way. When i picked those balls out, at that point to me they are perfect. I dont want anyone touching the balls after that, i dont want anyone touching them taking any air out. I wouldnt do anything outside of the rules of the play. Im not a conspiracy theorist. I dont i dont know what happened. I mean i i have no explanation for it. And some people when they hear that they think of Lance Armstrong that for years denied any kind of involvement and it turned out it was a complete and utter lie. People do complete and people do completely and utterly lie. Rick can you hear me . He didnt put the needle in the ball. Mcnally and jastremski did. And wells investigated this for four months. But he said connect the dots people. If you look at the Text Messages it is pretty damning for brady. And if he brings up anything today, show up on the stage with your Text Messages and say these are my Text Messages. Im kpleen that is the only way he clears his name. And lets look at the Text Messages between the equipment managers. Are you good day johnny boy. And he responds still nervous. Brady, you didnt do anything wrong, bud. And he had an hour total talktime with six calls with one of the equipment managers when he didnt talk to him for nearly a year or longer. And it is pretty damning. And tom brady is the surgeon of footballs and he takes great prides and he said when he spikes it i can feel the ball is deflated. Maybe he didnt put the needle in or out but you knee something was wrong. Before this report came out people sat there and said it is hard to believe if footballs were altered tom brady didnt know about it. Because no equipment guy who wanted to keep his job, the theory goes without the quarterbacks consent. And tom brady is one of the quarterbacks along with Peyton Manning went to the lobby to have special footballs used on away games because quarterbacks are so sensitive so he is he has demonstrated they are so careful.
