And we see that as an attack on our country, when one of our own is killed like that. We made clear if you come after americans were going to come after you, wherever you. Are and thats going to guide our planning in the days to come. Is the white house making a case for war . Barbara starr is at the pentagon tonight. This is beyond iraq. Jim foley was beheaded in syria, a place the United States has so far steadfastly avoided. Will the president strike syria . It appears to be headed in that direction. The words were hearing from the administration are both sides of the border. Theyre not restricting it or just continuing in iraq. They are making the point going after isis potentially on both sides of the border. The u. S. Is going to need better intelligence the military about where isis targets are located. In order to get that intelligence you are not putting u. S. Troops on the ground. You are talking about aircraft or dproens flying over syria on Surveillance Missions to collect that realtime intelligence the instant information about where isis fighters are located and where command and control centers are, where their leadership may be and make the decision to proceed with air strikes bombing isis targets inside syria. That is a decision for the president of course. That would do something that helps one person very particularly, Bashar Alassad who has been fighting isis in his country, not a man the United States supports. What will the u. S. Do . We have heard it is impossible to send the military into syria because we would be helping a person we say should not be ruling syria . Its a fascinating military dmem ma. The u. S. Military has made the case it would be difficult to send manned aircraft to bomb inside syria and the regime target because syria has radar, antiaircraft missiles. You cant take that risk with american pilots. What officials are now saying is they have looked at where they believe isis is. Its a less populated area. If youre going doubt damascus, the capital of syria and get to the alassad regime, very tough military business. The chances of getting shot down a little too risky for the u. S. To take. But isis in less Populated Areas with less air defense. Maybe they can work around it and do it. And we have now seen the First Military mission inside syria with that attempted rescue of the hostages. Of course they said went off flawlessly but failed but the hostages werent there. Its not simply the threat they pose to the United States. Its the threat they pose to the entire world. I think what the president is going to say is he is a president of the United States who is working to keep america safe from terrorists. Thats why he took out Osama Bin Laden and going after isis. The Obama Administration today under questioning for how it handled hostage negotiations reiterated it will not pay ransoms to terrorist groups. We feel strongly it is not the right policy for governments to support the payment of ransom to terrorist organizations. In the long run it provides additional funding to these terrorist organizations which allows them to expand their operations. We also know that isis was demanding more than just money in ransom. First we have to point out that says that swap of the five taliban members for Bowe Bergdahl was not legal. The second thing this is not the first time that a terrorist organization has suggested such a swap. Al qaeda repeatedly said they wanted the blind shaykh released. He, too was the iconic figure to al qaeda. I think she is this is sort of the same thing. Al qaeda has tried to distance itself from isis and what this tells you is these are one and the same. They share the same tactics and ideals. The administration is absolutely right to say we dont do these swaps. We dont pay ransoms and we dont negotiate with terrorist groups. Tim, this Bowe Bergdahl issue is fair to bring up. The prisoner swap for bergdahl didnt create an incentive to kidnap americans. But has bergdahls release changed the game . I think it was a mistake. I dont think we should be negotiating with terrorists. And any time you reward an activity you promote that activity. Kidnapping is a way of life in third world countries. It happens in south and Central America regularly. The cartels make a lot of money. Supporting people like isis that rape, torture and kill, thats their ideology is a different thing. Its a big mistake to negotiate with people like that. The taliban and haqqani are not far from their ideology in how they kill. The United States government says that Bowe Bergdahl was in the u. S. Military so thats different. Thats not something that be embolden anyone to kidnap or demand prisoner swaps because its a u. S. Serviceman. Do you buy that . I dont buy. That you have to have a clear statement of policy and be true to. That you negotiate with these people or you dont. You have to pay the ransoms or you dont. And you cant you sort of cant pick and choose depending on the quality or cast of the victim. We have to be clear that we dont do that. Tim, i was talking to jim foleys boss yesterday and he was saying he changed his mind on this. He would have wanted the ransom paid. And the family thought it would be 5 million to get their son free. But what im curious about is this issue of ransom. The United States, again, if theyre going to negotiate with the taliban for the release of Bowe Bergdahl would it be consistent to pay ransoms. Are those two things consistent . I dont think they are inconsistent. Obviously as fran said the law was violated in that trade and that is something for congress to work out with the executive branch. But i think when youre going to sit down and negotiate face to face with a terrorist group thats a precedent that should never, ever, ever be established and i think its going to come back to haunt us in the went. This is a group that kills and maims and tortures. How can there be honor in a deal . The only way i could have done a trade is to put a tracker on the person so we could hit them with a drone strike five minutes later. They are making these controversial and inflammatory statements talking about women and killing people and saying people involved in Domestic Violence should shoot themselves. They released a statement and it says that the chief would again like to apologize to anyone this video has offend and ask any videos of this nature be reported so we can take proper action against any officer not meeting our standards. They are asking people in the community or out there if they know about officers who may have views like this to send them the video because they want to deal with them. But certainly its a very Disturbing Development here the officer relieved of duty, having to undergo a psychiatric examination and also, the chief would not go as far as saying this, but when pressed, he didnt deny it, this officer will probably be fired or forced to be forced to retire. It says his record as far as a Police Officer is unremarkable. Not involved in police shootings. So he has a solid record as a Police Officer but these comments are disturbing. This Development Comes as we have new details into the investigation of the shooting of Michael Brown. Fbi agents have knocked on 400 doors and interviewed 200 individuals to get more information on what happened the day that brown was shot and killed by officer wilson. We are learning crucial information tonight, this, the makeup of the people who will determine if he is charged. The grand jury hearing the chth case. What can you tell us about the grand jury . The grand jury is comprised of three blacks and nine whites. Most of the members are men. The group was selected from a random pool here in st. Louis. And in st. Louis county. And they were seated back in may. They were not just chose on the listen to this particular case. Not so much the jury versus the prosecutor. Because he has the power to present whatever it is he wants to present at this point. And from what i understand theres not much in the incident report itself. That makes me question what information are you going to be delivering to the grand jury . Do you think race will play a role as they are sitting in there considering what happened and whether to charge officer wilson . It depends on what the evidence shows, you know, thats how i feel about it. Do you have faith they will reach the right decision . Yes, i do. What would you tell them . Just go by the facts in the evidence. Now that you just heard a taste of what we heard when we went out into the community to get a sense of what people were thinking when they heard the composition of the jury. And more were concerned by the process itself than they were by the composition of the jury. Thank you very much. And outfront tonight, the new president of the naacp, Cornell Williams brooks. Let me ask you about this. There are three black people on the jury and nine white people on the jury. That roughly reflect the racial breakdown of st. Louis county but not in ferguson. Exactly the opposite do. You think this group can give a fair inindictment . I believe this group can. Im more concerned about the county prosecutor. Frankly, there have been widespread calls for the governor to appoint a special prosecutor. There are no less than five Outstanding Civil rights complaints against the county police force and its municipalities. The county prosecutor has not responded to those. He has not demonstrated a sensitivity toward the community. So as a consequence he does not enjoy the trust or credibility of the community. We are talk about Robert Mcculloch here. Yes. Some would say this guy has been reelected in st. Louis county since 1991. He has been voted back in by an overwhelming majority in st. Louis county. Doesnt that show that the majority of people think hes fair and if people dont turn out to vote that is their problem . It demonstrates he is effective as an elected official. It does not show he can be effective handling a high profile case where the attention of the world is focused on ferguson, missouri. And here we have no less than five Outstanding Civil rights complaints with the Justice Department file by the naacp concerning police harassment, intimidation and racial profiling. Hes not responding to the complaints or demonstrating an interest or commitment to resolving the complaints. Why would the people of ferguson, missouri or the county or the country believe he can deliver the kind of commitment and community sensitivity needed here . And im curious what you think of this as a racial issue. We hear the attorneys say he was shot execution style. We have not yet seen all of the evidence about what really happened. But what do you think . Do you think a guilty verdict for Darren Wilson is the only verdict that can move Race Relations forward or are you open to the fact that maybe the facts wouldnt leave you in that direction . Im open and the naacp is open to a verdict that matches the facts. We have an armed adult with a gun, a badge, and strange. He meets a teenager, unarmed. The teenager is jaywalking and the teenager ends up dead. There will be other facts that emerge. But the community has every right to call for a full, robust, transparent investigation into and need a prosecutor who can do that. And so you think that must be a special prosecutor . We believe so. Officials say brown was found dead 35 feet away from officer wilsons car. But how does that distance factor into a Police Officers decision to shoot . Some people say its so far away and others say thats so close. Reporter when to shoot . For Law Enforcement like ferguson Police Officer Darren Wilson who shot Michael Brown he got his gun out reporter and then ten days later, the st. Louis Police Officers who confronted a knifewielding mentally ill man. Reporter that decision begins with training at the police academy. This is standard training . Reporter are on martinelli says he has been an expert in more than 100 shooting cases, most of them officerinvolved wearing a standard issued officer duty belt. This guy is just big and intimidating. Reporter its unclear what distance Michael Brown was shot from. But these types of shootings typically happen in close proximity. At a san diego area shooting range, using training weapons, martinelli shows us what is called the 21foot rule. The assailant rushes. Do you have time to aim . There is no aiming. Reporter everything takes time. Two seconds to unholster and lift the gun. You have to push the button, rock it back and pull it out. Reporter even at this distance where you see the knife and gun is out he still has got you . Absolutely. We can really see that knife right there and we can get ive got a lot of time and on my front side and i can take shots, that distance would be okay. Right . But in a street situation thats not probably farther back. Change the scenario to a smaller female assailant and you gain a little time but not much. This does not factor in an adrenaline level, if there is cover or if people are in the line of fire, add to the duty belt. More things you add to the holster or to the duty belt, that delays the officers response by 50 of reaction time. Its easy, says martinelli to say officers have other options but that doesnt mean every officerinvolved shooting is justified. That assailant poses an imminent, not potential, but an imminent threat of serious Bodily Injury or death. You start to think, two seconds to get the gun out of the holster and someone can run 21 feet in that time. We see there is no time but its what about other tools that officer wilson may have had . The taser . The pepper spray . Why not in this case . In lethal force, pepper spray is not effective. Martinelli says you have to be about 20 feet away from the assailant and because of operator error it has 60 effectiveness rate. In the situation where you are faced with potential deadly use of a weapon, attacking an officer he says that Police Officer training is to go for the gun. Thank you very much. You think if mike brown was 35 feet away, three seconds until he was on you. Does this in any way will this enable Darren Wilson to claim selfdefense . I have been astonished in these studies. Obviously i dont know what the facts are with respect to what wilsons going to say. But putting the case together, first of all, an officer has to perceive and respond to a threat. When he gets out of the car, he has that thought process, am i in a threatening situation . Thats going to knock off a half second. Were having a whole contin constellation of three seconds. He is seeing mr. Brown who is bigger than the average National Football league lineman. Hes huge and this officer is a small officer. He perceives a threat if brown is approaching him. If he is. Which of course the officer says he is. Well have to see. And the arms of course were the arms like this or over the head . The witnesses differ on. At one point, the planes wing tips were within 20 feet of each other. Tom foreman has the story.
