How many will vote early out of fear . 68 million have already way ahead of the pace four years ago. But cases are exploding as well. Were getting close to double the case number where we were this summer as a rate. Were around 40. Now were at 70 plus. How many will stay home . How many will vote to punish trump for his inaction . How many believe biden will make good on his promises of better . One thing for sure, we are exactly where we didnt want to be. For months, trump has been begged by many of us in the media, by insiders and experts, first responders, health workers, let the government get together a real plan to fight covid and get it uncontrolled. All hands on deck. Think that b the last time a major effort in america didnt even have a name. The vaccine effort does, right . Operation warp speed. But trumps effort to fight covid doesnt even exist. He cant even name you something. There is no plan, no operation. There is no anything. Remember, though he kept saying covid was a hoax, when he wassed what was happening in november if Nothing Happened to abate the pandemic. Remember ted wild notion not to do something radical to fight the virus but to move the election so that americans could properly and securely and safely vote. He wanted to buy time. Not buy you safety. Remember, he said, i can do it myself, you know. Of course, he was wrong. He was bronco that as he was wrong about not going all in to stop the virus. Now we can add another victim to the pandemic toll. The election. And it is in this precarious moment that were realizing skoefd worse than ever. Were faced with two candidates making their closing arguments for your vote, one week away. If you havent voted already or you dont vote tonight. Biden sees the pandemic as front and center. He sees the country in need of healing and on multiple levels. His cure is the same. Come together. Come directly at what is making us sick. Culturally, physically, politically, and come to a better place. Clear the decks for action. We will act on the first day of my presidency to get covid under control. We can and we will control this virus. As president , i will never wave the white flag of surrender. They are completely going in opposite directions. Trump argues just as vigorously as the opposite. Were testing everybody. In many ways i hate it. In many ways i hate it. We test everybody. They use it to make us look bad. No. You make you look bad. Thats all it takes. If were testing too much, why does the positive rate keep increasing . If you were testing too much, the rate of positivity would stay the same. Then you have more of the same data appointment. If youre testing too much, why are the hospitals filling up . The better question is, mr. President , why lie . Why deny what everyone knows this country is living . She was chasing after him, begging cops not to shoot a man clearly in mental distress. You dont have to believe me. There is tape. And it is so sad. You will feel yourself watching it. You can see that the police dont know gha to do. They dont know how to make the situation any different than it is unfolding. You see the mothers desperation and you feel yourself saying, dont, dont, dont, just like his mother was. The biden team put out a statement on the shooting today. On addressing systemic flaracis had in this country. For biden, the battle of dealing with racism or the coronavirus, is to get a president who cares about fighting these problems. A president who is not in it for himself. A president who doesnt divide us but unites us. A president who appeals not to the worst us but the best. I will govern as an american president. In any president ial election, you really want it to be a choice. Not purely of referendum. And i think it is so much a referendum on the president s leadership on a crisis that is not abating. We are not vanquishing. And i think thats very bad for the president. Is biden making the right move . He is. And i think hes getting stronger as the Campaign Goes on. I agree with david that these elections, these second term elections are almost always a referendum on the president. But biden is proposing a different way of doing this. A more traditional way for president s to lead and trump is not leading. Trumps problem is not that hes conservative. His problem is that hes crazy. Hes incapable of thinking about anybody but himself. Joe biden has learned through bitter experience through his whole life, thats the wrong way to approach very difficult things. What do you think the biggest challenge is pulling this off, depending on a couple of case turnouts, a few days after november 3 . With, two things. Is there an aspect of 2016 which is people go in to vote or they vote early, and despite what were seeing in the polls, theyre making a different decision, more of a gut decision to stick by trump. The other thing is the fear factor. I think this is all about fear on both sides. The fear of biden that trump is trying to expose is, hey, voters say, maybe im done with trump but im afraid of the left. And im afraid, biden seems like a nice guy but the left will be in control and theyre going to push hard on stuff that i dont like. Even on the virus. Maybe theyll start shutting down is that i dont have a job. Maybe they wont open my kids school because it is a shutdown mentality. I think those fears are real and i dont know how big that group is. Howard, speak to the role of fear and who you think it helps more in this race, and as a big organizer at the party level, which party do you think positioned itself better to deal with the discount effect of the pandemic on election day . Well, trump is the republican party. So they obviously did not position themselves terribly well. I think the democrats have done a pretty good job positioning themselves. I would give the credit to joe biden. Many people wanted somebody younger and more dynamic and somebody further left. He is the right candidate. His experience means a lot to people. Especially when you compare with trump who had none and still needs to have none. I think were running both a positive campaign and a reassuring campaign. And i dont say that because im a biden guy. I stay neutral because of it. The nuts and bolts, looking at the numbers, early voting has surpassed 58. 3 million pre election votes cast in 2016. Election day is a huge push we expect republicans to come out strong. That means you had to prepare. A lot of key states, wisconsin, michigan, pennsylvania, florida, theyre going to have scary situations. I think theres no question about that. And the president has tried to pump up his ranks to win on that last day of voting. To try to make a stand in some of these battleground states. I think it is important. I think the specter of long lines and crowds and even the fear of some kind of suppression or intimidation is a factor in some of these states. I think the governor speaks to it. Theres so much motivation. A lot of fear. Theres so much anger. I think there is a sense that big things are on the ballot. It is who we are. Who we want to be as a country. I thought biden was smart to talk with the bible and a time for healing and ecclesiastes. He is saying, its time to calm down, we have to get out of the ditch here and get back on an even keel in this country. Whether youre for me or taxes or whatever. Can we just stop the madness a little bit . And i think that resonates. I think thats a bigger motivators. I think just as the end of the bush years, there was a desire for the United States to reorient itself in the world. To stop a posture of war. To stop some of the response to the war on terror. People wanted that reset. The social fabric has been torn even worse than it was in those years. I think the closest analog, and people will be bored by the history of it. If you look at hoover over fdr. Hoover made the mistake of denying the depth of the depression. That it was a short term bounce. It would come back. He didnt do anything big. He believed he should play it down. Fdr went 180 degrees the other way. And i think the more of biden doing, that im going to go big. Ill going to help the businesses, throw everything at it. Lets take a look at who is turning out early to vote this year and compare it to where we were four years ago at this point. I think this gives you an idea of what is cooking. Look at the share of voters turning out early under the age of 40 this year. Right now, its 22 . Compare that to where we were on election day in 2016. It was 14 . We have a little time to go and well see what actually occurs on election day but this does seem to line up with what we saw in 2018 where Younger Voters made up a bigger piece of the pie in that midterm. Who do they like . They like joe biden. He is leading by about 20 points. Up 56 to three . And that is what weve seen consistently over the last few years as the millennials have come up. They make up the vast share of those under the age of 40. Generation z makes up some of that share. No doubt the more Younger Voters turn out, the better it is for the vice president. In one of the very funny conversations we have, more and more, i believe the best part of this show happens before it happens. I said to you, boy, im surprised they would like biden issue for issue with all due respect to the former vp. And you said, well, its not about liking him. It is not about liking trump. How much so and how do you know . So look at this. Take a look at the favorable and unfavorable of biden and trump among registered voters. You see the favorable is slightly down. Thats not what we saw in the numbers. Whats driving it . 61 of registered voters under the age of 40 have an unfavorable view of donald trump. Thats really what is driving my opinion. This youth enthusiasm. Not so much a love for biden. It is for a lot of young voters the truly deep dislike of the president of the United States. How are they dispersed in terms of states that matter in. If you want to look at young voters, i would specifically look at arizona would be a good example of a place where there are a lot of up and coming, especially among hispanics and especially in a state like texas. If biden is going to flip that state. Young voters are very important. If joe biden can get young voters to turn out in texas, he has a real shot furnishing state blue. You keep talking about arizona. Why . Look at these states right here. If youre looking at the road to 270, the easiest pathway is through the upper midwest. It gets to you 279. Say biden was to fall in one of those states. Lets say he doesnt win in pennsylvania. If you add in arizona with its 11 electoral votes, and you take away the 20 from pennsylvania, you still get joe biden to 270 electoral votes exactly. Right now biden is ahead in the arizona average by 4 points. So hes leading there and it is a very important state. If one of the states in the upper midwest falls through. If were counting the second congressional district, then nebraska with its one electoral vote, this will be a very close count on tuesday if it even ends on tuesday. So when you get your taxes mailed off, when do you need them post marked by . April 15th. Then youre set with the man. No matter when they get it, youre covered. Thats not the standard for our votes. Even this year. So we have two attorneys general who are in the middle of a fight to count every vote in their battleground states. Think about it. You have the president telling you, weve got to have a legitimate election. Isnt that what makes legitimate . Counting all the votes . Now, throw into the mix under certainty about one of the ways people can vote safely. According to state law, in both places, if youre in line to vote on Election Night when the polls close, you still get to vote. That same rule may not be true if your ballot is in line with the post office. We have the latest on a pair of Pivotal Supreme Court cases which now may have a different disposition. Lets begin in, that a. Republicans want the high court to hear a case they just ruled on last week. The gop wants to make sure absentee votes only count if they arrive by election day, no matter when they are post marked. Lets start with the Pennsylvania Attorney general josh shap eshapiro. How are they able to go down after they accept the state courts ruling . Well, technically speaking, last week the court dead locked 44 on the request for a stay. Basically, staying or stopping state law that says, you can get three days to receive the ballots, assuming they were post marked. What now theyre asking the Supreme Court to do is to hear this case on the merits. Theyve asked for the attention of the court to consider this. It is important to note the United States Supreme Court has not granted it. They have not yet determined whether or not they would even hear this case, chris. So whats your fear . I dont know that i have a fear. I recognize that Justice Barrett being on the court now creates a nineperson court. She will have a pivotal vote should this case come back up. But everybody talks a lot about how this is a 63 conservative court. A court that strictly reads the statutes, strictly reads the constitution. A carroll reading of the statute, and specifically of a legal principal known as the purcell principale, they would let the state law stand. The principle says it should give great deference to matters of state election law. And that deference is even more heightened the closer you get to an election. Well, chris, were in the midst of an election. 2 million pennsylvaniians have already voted. 3 million have requested their ballots early. We expect record turnout by election day. An election is going on. The principle makes it clear at this point in time the federal courts should not interfere with Pennsylvania State election law. What do you read into the chief Justice Roberts flipping on the wisconsin decision which will well get into more. But there the court said no, wisconsin, you cant have the extended time. The rationale was because a federal court started. This it is not coming from a state court determination. But robert flipped on that and he was in favor of the other conservative judges decision of Holding Wisconsin to no extra days. Yeah. And you just hit the nail on the head. I want to pull out what you said and really focus on that. The United States Supreme Court was reacting to a decision made that i a federal Court Dealing with the issue in wisconsin. Thats a very different procedural setup than what were dealing with in pennsylvania where the highest court in our state, our state Supreme Court, interpreted a matter of state law. It should not meddle in this issue that has been heard by the highest court. Thats a very different procedural issue than what came in wisconsin. One of the operative principles under the law will be equity of forfeiture. When people are relying on something to be a certain way and youre going to change it, you will create a forfeiture of rights, of confusion. What is your concern given the outbreak of cases and what people think they know about how to vote to avoid covid, what happens if this goes south on you . Look, an election is already underway. We keep telling people, make your plan to vote. Whether youre voting early or on election day. Make your plan to vote whoever your preferred candidate is. I hate to nerd out on you and keep coming back to the purcell principle, but one of the very reasons why the federal courts are not supposed to meddle in state election laws, it could confuse the voters, and number two, it makes it harder on the Election Officials who are really just counting employees and volunteers in the counties to run the election. So you speak to the very reason why the federal courts at this late stage shouldnt step in and meddle with our state election laws. Let us have an election. The reason were in these situations is because the president has been unbelievably litigious. Hes tried to undermine our voting process in pennsylvania. Hes sued us. There have been five cases. He went 05. Were 50 to frequent rights of all voters in pennsylvania. To secure their right to make sure their vote is counted. Unfortunately, were having to beat back attempts to undermine the vote. Supreme court just denied an attempt by democrats to extend their deadline for counting mailin ballots. We have josh, the Wisconsin Attorney general. And rick, a law professor here in new york at nyu who found his own words being used as part of a dissenting opinion by justice kavanaugh. He said they were taken out of context. Whether to both of you. Let me start with you. They said this is about the Supreme Court and our reckoning of our constitution. Were good. If you want wisconsin to be about federal law, the judge can come to a different decision so the Supreme Court did what it did. Do you believe wisconsin was treated fairly by the Supreme Court . The rule is clear now that voters in wisconsin need to get their absentee ballots in by election day. A lot have gone by mail. For those who plan to vote, what i want to encourage people to do is to either return to it a drop box now or take to it a clerks office. Put it in the mail one week before election day is too risky. Why is a week not long enough . Well, unfortunately, the Postal Service is not working as quickly as it used to. And my colleague a. G. Shapiro in pennsylvania and i and others have challenged the rollbacks to the post office. The post office hasnt gotten to the efficiency it used to be at. So i encourage people to get their ballots in. And given the case explosion in your state. Good news is that were in a really different position than we were in april. We had a high profile election a few weeks after covid really hit the u. S. Thats an packs never should have taken place in my view on that date. Now people are following safety protocols, they have hand sanitizer. I believe people voting in person are going to be safe. From the pandemic and any other concerns. So why is the handsome professor with us . Ill tell you why. In Justice Kavanaughs opinion in this case, he quoted a law review article. It said the following. It opens up one of the greatest risks of what might in our era of hyper polarized Political Parties and existential politics destabilize the election results. You say, professor, happen to be quoted but get it right. You were taken out of context. How so . I was certainly quoted accurately. It has been my view since march that we do want to encourage as many ballots to be cast and received by election day as possible. I was writing to policy makers. I didnt say anything about courts, what they should or shouldnt do. I urged policy makers to consider extending the absentee receipt deadline given the huge number of ballots we would see and the post office. I still say if people can vote in person, they ought to do it. Early or election day. As long as theyre not in certain categories. Or return it to the Election Office in person. If you mail it, mail it very early. This is very late already now. So what troubled you about what you read in the judges decision . My concern was that i was not speaking to the courts about what they should or shouldnt do. Whats the difference between speaking to policy matters and to the court. There is a fundamental difference between making policy and what constitutional doctrine could not strains. They have lots of discretion about how to regulate the process. Courts have a much more minimal role. And what do you think this will mean limiting, especially pennsylvania comes up before the court. What could the impact be . With people being so worried about going to the polls . I would be stunned if they reversed course and said these ballots three days after the election are not valid courts. I doubt the court would do that. The court has refused to intervene there. It is very likely down the road, they would hear the pennsylvania case and conclude Going Forward for future elections that courts cannot do what the Pennsylvania Court did. I dont think the court is going to pull the rug out from voters in pennsylvania who have relied now on the Supreme Court saying were not going to stop the threeday extension. We will see. And she was pleading with him to calm down. Try to control himself. Why . Because walter wall streace jr. In distress. The family said it alerted police that he had Mental Health issues. That Police Needed to use deescalation tactics. They didnt have enough tasers. Walter wallace sr. Joins us now alo alongside the family attorney. Im very sorry to meet you under these circumstances. I want to make sure that the Company Knows this happened. Understands your pain and understands what you want them to know. Lets begin with not letting your son be defined by what took him out of this world. What do you want people to know about your son . Well, i want people to know, all this violence and looting. Counselor, did i have it right that people told the police from the family or on behalf of the family that walter was dealing with Mental Health issues and that he was in distress and that he was on medication and they should deal with him that way . Good evening, chris. Yes. You got it exactly right. The officers that responded at the fatal time in question were apprised mr. Wallace was in fact in crisis. They were told that by his wife before the video began to be recorded. His wife told them he is manic, bipolar and in crisis. Unfortunately the officers were not equipped with the training or the proper equipment to deal with a person who was experiencing crisis in that moment. You dont deal with crisis with a firearm. You dont deal with a person experiencing a Mental Health crisis or a breakdown, you dont meet them with a firearm. Unfortunately the officers who did not have less than lethal options on their gunbelt obviously had only one option to turn to. That was to execute a death sentence on mr. Wallace. Mr. Wallace, do you believe this was about color or condition, his Mental Health and the police ability or inability to deal with it. I believe it is both. They overlook things. This is what we call common sense. You got to look at things. If somebody tell you something, you know, you are supposed to take that and respect it. If you tell me something and i overlook it and dont pay you no mind, that means i should be paying it because of taking somebodies life. It could have been dealt with in a different way. He could have called a superior to handle the situation. You think your son would have hurt the officers . No. He cant hurt a fly. He had mental issues. I wouldnt be talking to you now. I believe in the justice system. We got good cops. We all sure got bad cops. We have to be held accountable for what we do in life, all of us. Can i add something to that please. Go ahead. I think that one of the things we have spoken about since the onset of this particular issue, one of the things we talked about immediately was the fact that the officers did not have what they needed. There wasnt a less than lethal option available. They didnt have tasers. They didnt have tasers. That is important. I cant think of a scenario better designed for the deployment of an electronic control device than this particular scenario here. You respond to an incident. You are given preliminary information, which officers sometimes dont have. A person is in mental decline and in crisis. The person displays a weapon. Not the weapon that hurts you from a distance, but one that requires close quarters combat. You dont have the element of being indoors and contained. The best situation would be with what the Philadelphia Police department hasnt outfitted their Police Officers with. When you say with respect is, is this race or color. I have to wonder.
