New evidence is likely to come out over the next few weeks and months, evidence that he claims will help prove trump knew about the 130,000 hush money payment to daniels just before the election, that and his silence so far is very deliberate. President trump ordering 60 Russian Diplomats expelled sending them back to moscow in response to a brazen poison attack. Strong action against russia from this administration, but the white house refuses to say why the president refused to mention the poisoning in his call to Vladimir Putin last week. Well have more on that in just a minute. First i want to bring in cnn White House CorrespondentCaitlyn Collins and matt lewis. Okay. We have a lot to talk about. A lot of people, a lot of allegations. A lot of sex, tawdry stuff. We have yet to hear from the president about Stormy Daniels. He did however tweet an attack on the media saying so much fake news. Never been more voluminous. Or more inaccurate. But through it all our country is doing great. Why hasnt the president spoken out . It is uncharacteristic for him to remain something about silent. Usual le he responds to the even smallest slight made against him. He hasnt said anything about her at all and has remained totally silent. He hasnt said anything about her at all. He remains totally silent. We know that the president has been polling his aides whether he should respond publicly to these allegations. So far he has been advised against doing so. They think it will further bring the story into the headlines. We have seen the president be eager to defend himself here. He has not done that himself yet which is surprising in this front. There is a chance that the president could decide a tweet about this. He was advised not to tweet about the special counsels investigation and it is specifically something we saw him do. I do think that interview with Anderson Cooper on television would cause the president to tweet further. Thats something he pays a lot of attention to obviously is something on television. The white house wouldnt say he watched the interview but later said he believes the claims she made were inaccurate which does lead one to believe he watched at least part of the broadcast sunday night. Speaking of that, here araj shah at the white house today. Was the president aware of a physical threat made against daniels and her daughter in 2007 . The president doesnt believe any of the claims that ms. Daniels made last night were ago r he doesnt believe she was threatened . No, he does not. Whats his basis for that. He doesnt believe there is nothing to corroborate her claim. He doesnt believe any of the claims are accurate. This is the one way the president has been most consistent when it comes to any accusers, deny all allegations, right . Interestingly as you were discussing with kaitlan, he hasnt spoken publicly about this. The only person i can think he has not responded to when attacked like this is Vladimir Putin. Hes been completely silent on this issue. Look, i think that, you know, she was very clear that they had a consensual relationship. I dont think the fact of the affair will shock anyone knowing what we know about Donald Trumps history. I think there are three sort of areas of danger for him. One is the Campaign Finance violation. We saw in the case of john edwards, democratic president ial candidate, and a former girlfriend led to some serious Campaign Finance trouble for him. Thats one area of trouble. Two, is if this in any way intersects with the Mueller Investigation, remember, our friend sam nunberg who did his interviews which seems like a few years ago, one of the things he said is he was asked about the Stormy Daniels, Michael Cohen investigation. We dont know exactly what was asked or what mueller was getting at but it was intriguing mueller asked about that. Finally if this civil case you know, i think most the legal experts believe its avenatti and stormys weak evidence hand here. They are a much stronger hand with this sort of Public Campaign against trump calling him a liar. The civil case seems a little bit weaker, but we know from the clinton era if a civil case starts getting traction and the president gets deposed and has to say something, that can cause trouble if he is not truthful. So they have opened up a lot of political peril for him on a number of fronts. And you the other case Going Forward with the other accuser here. Listen, i want to read from the Washington Post it says, but privately the president has lobbed sharp attacks at daniels and her immediate tour calling her allegations a hoax and asking confidants if it was hurting his poll numbersment the president even has griped to several people daniels is not the type of woman he find as track tiff. Sorry. Sometimes i have to chuckle. Believe me, i can do better. The president made similar comments when he was defending himself from a claim from a People Magazine reporter, he forced himself on her. Look at her, he said, i dont think so. Whats your reaction there . There are some consistencies here. Thats one of his line of defense. There are other consistencies. He tends to tell these women they remind him of his daughter. He has this weird m. O. I think ryan is exactly right, though. I dont think this hurts him politically. I think its baked in the cake politically, right . So even, you know, a lot of people voted for donald trump after seeing the access hollywood video. They knew what they were getting. They knew who he was. He never pretended to be anything else. Donald trump was pretty up front about him. Nobody is surprised or shocked that he had sex allegedly with a porn star or a playmate. Where he could get in trouble is with the Campaign Finance violation potential of this. With the cover yip and the legal matters. Hes wise to not talk more thats the thing, math. I think most people say if its an affair, its between him and his wife. It is salacious. Especially when you think it is unprotected sex and all of that. I think that maybe now it may be baked into the cake. Dont you think there will be a cumulative effect especially by the 2018 election and 2020, if these women, if there continues to be this drip, drip, drip . I actually dont, to be honest with you. Look, donald trump was a known commodity when people voted for him. We saw that access hollywood tape, the horrible things he said that you can do to women if youre a celebrity. This is the guy who is on his third marriage and has cheated on the past all three wives. He said things about his daughter that wont repeat here on tv being his daughter being attractive. He went on howard stern. Nobody is surprised by this. And so i think if you care deeply about the me too moment you already hate donald trump and if you like donald trump, you already know that this is the guy youre getting. I think he will stay between 32 or 42 and 35 and no matter what. If another woman comes out tomorrow making a similar accusation, i dont think it matters politically. I matters morally and ethically and it may matter legally but this i had a question for kaitlan but it looks like you want to get on this, ryan. Its not about the sex. Its about whether he bullied her or in any way forced her into this agreement against her will. The new accusation, the new information that came out last night is this threat. So to me it changed my mind a lot about this case. If he actually threatened her through Michael Cohen or anyone else in any way forced her against her will into signing this agreement, that changes the nature of this. This is what gets me is when people say this is about an affair that happened ten years ago. The actual act may have happened not long ago. The only reason it came out is because of cohens actions that happened a couple of days before the election and then the wall street journal report coming out and him responding to it. Thats why it is in the news now. I think most dont know about the affair. You said he is concerned about this being in the headlines. Andersons interview on 60 minutes attracted 22 million viewers. The elements of defamation, you have a published statement, in this case an oral one that its false, that its injurious and no privilege attached to it. She has to establish whats with said was injurious. Its not clear that it rises to that level. She can file the lawsuit but not clear she reached the threshold but others can disagree for sure. Thats a subjective determination for what is injury. I want to move onto russia and other things. What do you think . Does she have a case . Yeah. What i would say is she could certainly file a case and then it would give her some leverage. I dont know how strong Stormy Daniels case is. But the fact is shes filed the case and that will give her leverage against the president. It will give her leverage against the president. It will create problems. The daily beast reporting that two more attorneys for turning down to turn down his legal team. They say that they cant do they cant do it. Its due to business conflicts. What do you make of all of this . I think its an interesting statement because when you say the term business conflicts, thats not a legal or actual conflict of interest. What that means is that either some of their existing clients dont want them to represent President Trump or that the firm doesnt want to take on that kind of risk. I will tell you, lawyers generally like to represent rich and powerful people. So here what i think what were see something with all these top lawyers turning down President Trump, what it suggests is that either theyre concerned about potential ethical binds that that will put them in if they represent him or could potentially believe their bills arent going to get paid or they have a lot of clients that would not like help representing President Trump. It is an unusual situation for somebody who is rich or ostensibly rich and powerful to be in. Business conflict soubds like oh, i have a previous engagements which kind of covers everything. Ted olson is another one who rebuffed the trump here. This is what he had to say today. I think everybody would agree this is turmoil, chaos, and its confusion. Its not good for anything. We always believe that there should be an orderly process and of course government is not clean or orderly ever, but this seems to be beyond normal bounds. So, michael, do you think that the chaos olson described is why hes having a hard time finding qualified lawyers . First, in respect to ted olson, as i understand it, the law firm has said it has a legal conflict, not a business conflict but a legal conflict on the type that joe digenova had which precludes them from representing donald trump. However what i think we can read into what ted olson said there was this is a tough client in a tough situation. If you have a client in a very difficult situation who you cant be certain will listen to you and take your advice, for a lawyer its sort of a no win situation and you stand down to it. Could it be because the reputation has been reported that he doesnt pay for attorneys or for his legal renato, youre nodding your red. Thats always a concern. Ill tell you as a lawyer who takes in clients and represents them now, thats always a concern. Every law firm evaluates when a you know, what is their ability to pay if a client is coming in. I will tell you, if a client doesnt pay, youre essentially, when youre performing services for a client that isnt paying in advance for them, youre essentially making a loan to them. Youre forwarding them money. If you cant be sure you will be paid, it can be a huge problem for firms. How does one get away for allegedly not paying for it . It has been said reportedly he doesnt pay for his legal counsel. He sues people is what he does. Im sorry, renato. I didnt mean to interrupt. Go ahead, michael. So the published reports of donald trump and his bill paying pattern is people give bills and he sues them saying that you didnt perform under the contract. And he pays or doesnt pay or he pays something less. As renato said, as a lawyer, you just cant do that. You cant put yourself in that position. Unless he was going to put up a 1 million or 2 million retainer, god, i said that like a new yorker, retainer, that you can draw down against people arent going to take the risk. Got it. So, michael, when you look at the lawsuits that President Trump and his personal attorney Michael Cohen are dealing with now, they raise a lot of questions about Campaign Finance violations, about threats of intimidation and whether daniels has been defamed. Are any of these issues likely to overlap with the Mueller Investigation . So, two things. First is i think that which is viable is the Campaign Finance violations, the notion of paying 130,000 two weeks before the election for a matter that has been sort of already multiple years old to me smacks of an inkind donation and i think the federal Election Commission and perhaps the Justice Department has to look into that. How it will be resolved. John edwards was a year before. It was only 11 days before. Go on. Exactly, which makes it a more problematic case. Then, of course, we know that we have mueller looking at cohen with respect to the building of the trump tower. Moscow. He has mentioned in the steel dossier, that which gave rise to this investigation in certain measure, small measure but not to be discounted entirely. He is mentioned in that. And so mueller, i think when he sees this would likely want to go to rosenstein and say to rosenstein, hey, look, there may be viable Campaign Finance violations here. Id like to look at that. Potential if for nothing else leverage a witness who has valuable information on the core matter im investigating. What do you want me to do . Then he and rosenstein have to make a decision. Rosenstein ultimately being the deciding authority whether he wants to give it to mueller to use it and leveraging cohen or him saying it is too disconnected to what youre investigating. If there is a Campaign Finance violation, well give it to the Justice Departments Public Integrity section which typically looks at these things and they will make their call independent of what youre doing, bob. Renato, ill give you the last word. No problem. I would say that above and beyapdz that terms of the leverage he has over cohen, its improper for an attorney to be forwarding and paying that on behalf of the client. I dont think anyone really believes that payment was made by cohen in his personal capacity and i think, you know, he may potentially lie to mueller. Regardless of the reasons behind it, maybe it was altruist altruistic, it certainly does raise suspicion. Thank you. Well, number one, it does have the feel, the cold war competition. This is not a cold war. It takes two superpowers to do that. And the russians dont fit that category. But it felt like old times in another sense, don. American leadership, this was done combined with our allies within nato, the european union, elsewhere around the world, the australians. It looks like we took the lead because we did the heaviest lift. I think about 120 russians were pngd from around the world declared persona non grata. So to reiterate what you did, in coordination with the european union, do you think it was was this our own doing or was it something that i think it came from within the american government, the permanent institutions of government, the career professionals guided by the rule of law. And history. I think this is what they wanted to do. I think they were reinforced because theres an awful lot of energy coming from within our allies. I dont have facts. I dont have a window into this, but my suspicion is this is something that the president didnt demand but which he decided not to oppose. Okay. Since the uk pointed the finger for this nerve agent attack, even with this conversation, he did not bring it up. Why now . Again, it wasnt the personality of the president , wasnt the preference of the president. Wasnt the president driving this. In my judgment, again, without having a window into the deliberations, but it was the government itself internally working through its processes and now was when the decision was right. I know ive done this before. There are some things that happen in their own time. And i think this was it. Okay. The Russian Ambassador to the u. S. Responded saying that the u. S. And this is a quote, will understand what kind of grave mistake they did. What do you think he is saying, that they will retaliate . Yeah, oh, they will. Theres no question. We have a bunch of american dims right now in russia making personal plans. By the way, this is a horrible personal burden on both the russians who are being expelled and on any american or other diplomats who will be expelled. That also suggests, don, maybe a bit of weakness about choosing this course of action. You can probably tell im already a fan. I like this. We are operating in a lane which the russians have the complete ability to reciprocate in exactly the same measure that weve used these powers to push out their diplomats. I really think if we want to get their attention, we need to do something, one that, has a greater effect thats more immediate and, two, which it was very difficult would be very difficult for them to respond. And here im talking about russian money in the west. I had a great case officer who told me once that russias a colonized country. I go, what do you mean . Yeah, its a colonized country. It is colonized by russians who exploit it and prefer to live abroad, park their money abroad and educate their kid as broad. Thats the vulnerability that we could exploit. So are you saying go after bigger and more important things that will touch them more, that will affect them more it will affect yes. The oligarchs. They can push back on it and putin will get by with fewer diplomats in new york and washington. But if the oligarchs around him are made to feel pain, that is something that i think that could actually affect russian behavior. I have been thinking this through since the attack in great britain. I have come across a new term that others may have known but i didnt. The consent of unexplained wealth, thats something we could russians showing up in london or new york, financial market, properly market, stock markets and so on. Thats something we have a right to look into. We could do that to i think great leverage. With unexplained wealth. When they show up there, they should have to explain i think there are good reasons why our government could be selective with regard to whom we might put that criteria against. Raj shah did not rule out more sanctions on oligarchs and on putin himself. Yeah. No, i would not rule it out either. But the president hasnt shown real stomach for that. Do you give them any credit for these moves . I do, don. Good evening. He deserves credit for what he did today, and its what any american president who wanted to protect our ballot box and our democracy would do. But, don, what the president should do is to declare to the country what our strategy with russia is and what we will do to achieve that strategy. I would suggest that the strategy should be to counter russian aggression here and abroad, and to carry it out he should direct he should directly confront Vladimir Putin. He should ratchet up the sanctions. He should use the resources we have in the United States to give the ballot boxes in our counties all the protection they need to stop further russian aggression, and he should support an independent commission to tell the country what happened in the last election and what were going to do to make sure it never happens again. So, representative, the Russian Ambassador responded to the expulsion saying the United States did very bad step. Undercutting a little what we still have in russian american relations. These decisions are going against to the telephone conversation between our two president s. The question is, is the ambassador making a distinction between the words of this president and the policies of the administration . Well, certainly, don, whats been frustrating is that you see on one hand the policies either from nikki haley or former secretary of state Rex Tillerson who had been rather harsh on russia, and then you see the president. So, if the president is not willing to directly confront them, its confusing to the russians and our allies as to what exactly were going to do. Now, the president says over and over and over, wouldnt it be great if we could just get along with russia. Well, sure. But only if getting along with russia accomplishes something that helps our security and the security of our allies. And the president has yet to declare that and i think now is an opportunity to tell people what the strategy is and what were going to do to achieve it.
