Pentagon officials telling cnn, they didnt know the announcement was coming. This was a president seizing the momenting and goi and going rog. We saw the same dynamic a few hours earlier, when he signed a measure putting a 25 tariff on imported steel and a 10 tariff on imported aluminum. Even though his top economic adviser quit over the tariffs. And then, theres the lawsuit anxiety by Stormy Daniels. President trump said to be furious as Sarah Sanders acknowledged he was a party to the lawsuit. She claimed the arbitration was won in the president s favor. That was before we learned that a woman who previously accused trump of inappropriate sexual contact, was named in the nondisclosure agreement by Stormy Daniels of having information about the alleged affair with donald trump. Paul manafort entered a plea of not guilty to bank fraud and tax crimes. On capitol hill, former campaign manager, cory ley lewandowski refused to answer questions about the trump tower meeting with russians. Theres a lot to discuss. We want to begin with the breaking news on north korea. And i want to bring in michelle kaczynski, caitlin kallca collin kirby and matt lewis. We have a lot of ground to cover. Admiral kirby, i want to start with you. Cnn was told that President Trump was being told not to go along but yet, here he is. Hes going to meet with north koreas dictator by may. The president is doing what he wants. I think it depends. I was flab ghasted that the invite was accepted. And the timeline is only eight weeks away. Thats incredible to me, the amount of work that has to be done between now and then, to i have any effective summit with kim jongun, a man who is a brutal dictator and wanted the status that comes with a president ial dialogue like this. Im a little concerned. Very concerned about the timeline and about the chances for success. But im always a fan of diplomacy. In general, we have to look at this as a positive development. We have to hope that the administration will work diligently to make this a success. Not only will the timeline be hard for them, but it will be harder because they dont have expertise. We dont have an ambassador in seoul, the special envoy to north korea has decided to resign. They have a long road to go and a short while to get it done. I cant let that concern slip. Why are you very concerned about this . Were dealing with a regime that has been developing Nuclear Missile program for a very long time. And theyve axccelerated that development. They know what theyre doing. It is their insurance policy. What they want more than anything else is regime survival. I see very little incentive for them to give that up, unless were willing to offer them something that really insures that survival in a tangible way. And legitimacy. They want legitimacy, and standing on the world stage gives them legitimacy. They want to be the soviet union of today. Thats what they want. They want that recognition. What are we doing to give up for that . What are they going to get from us to get us to get them to denuke. Im concerned about what this administration will be willing to barter away. Were at this point. Lets hope it works out. Where is secretary tillerson in all this . The president said, the secretary of state was wasting his time on north korea. Yeah, wasting his time ptryig to negotiate with north korea. That would hardly be the first time that the president has undercut what the secretary of state has done or said, in the work hes trying to do. In the few hours before this stunning announcement, secretary state tillerson was asked about the situation. He talked about skepticism. He thinks were a long way off from negotiations. We have to have talks about talks before we know if north korea ready for negotiations. Weve seen a difference in the language the administration is using between talks and negotiations. It used to be, were a far distance away from talks. But now, its more along the lines of, we can talk, we can talk about what were going to do before we start to negotiate. It was a much different tone from the secretary of state. You can see why this announcement, then, from the white house, might have come as a surprise to tillerson. Theres a time difference. He was in africa. He was up and talking to the president before the announcement. We know he talked to the japanese prime minister. But tillerson was still characteristically silent during this. He didnt make a statement an hour after the announcement, the state department did put out a paper statement. At the end, again, referring to the white house for more details. Thats pretty consistent with what weve seen. Just days ago, as this was brewing, as we knew the south korean delegation was about to come to the United States, the president was talking about north korea having called up and said they wanted to talk. Everybody wanted to know what that was all about. We asked tillerson directly what he thought about the situation or could he lend some clarity . And as he stood there as the secretary of state, he had absolutely nothing that he wanted to say. Its interesting because i was reading about Nicholas Kristof who they dont think tillerson is even a player in washington, the North Koreans, at least. Here it is. Secretary of state Rex Tillerson would be a possibility but the North Koreans have scoffed at me that he isnt a player in washington. Im going to talk to nick about this. Its interesting in the conversation that were having. Michelle, where might this proposed meeting happen . Thats one of those question marks surrounding all of this. You cannot, in a million years, imagine kim jongun coming here to the United States. And what that looks like. Were not sure if were ready for negotiations. Not sure if were ready for a visit like that. People like to speculate about the spectacle and the strangeness. Thats not going to happen. It would be something, too, if President Trump traveled there, maybe to the demilitarized zone. I think south korea is a likely place. It would be seen as the president going to kim jongun. Exactly. Either some neutral zone that could show goodwill on both sides. South korea has been motivating this. It seems like that could be a likely spot. Somewhere, you would think would be neutral. You dont like to predict whats going to happen with this administration. And remember, were dealing with President Trump and kim jongun. You know, we dont know what ideas they have. Two unpredictable characters or personalities to say the least. Together. Im going to bring caitlin in on this. The president came into the briefing room, notified reporters. Our reporting was an inrun around everyone. They were caught offguard. The chaos emanating from this white house has been constant. It seems like the president is taking charge, creating more confusion in the process. But hes doing what he wants. He certainly is, don. But the chaos is on full display when Something Big like this happens. As small as the president not letting his other officials know that hes going to pop into the briefing room, something hes never done before. A big announcement about north korea. To think hes not on the same page as the secretary of state. Rex tillersons comments that michelle was referencing that he was making earlier today. Mike pence made it seem like any negotiations with korea were a ways off. When the National Security adviser was making the announcement, he referred to the National Security as visor of the United States, h. R. Mcmaster, as aextensively, the president and the National Security adviser do not have a good relationship. The president has been searching for a replacement for him. It seems that his departure could come as early as by the end of this month. We have all of that going on, while such a monumental decision, as this could be made with the president. Really goes to show the stories, sometimes it seems humorous that the white house can be so chaotic and complicated. But on a day like today, when Big Decisions are being made, its stunning that the president so quickly accepted north koreas offer to meet, it makes you question how things are going down in this white house. Kaitlan, let me ask you, why would a third party, another leader outside of the white house not even inside of the white house make this announcement and read a letter . It was just odd. Seems like it was something that the president wanted to do. Or maybe some joint news conference. At least it would be done inside the white house. The announcement seemed very odd. What happened . It certainly is odd. Why would the president , not himself, make this decision that he had accepted north koreas offer to meet with kim jongun. He didnt. It was an oral letter. A message, basically given to him. That raises the question, after he was briefed at the white house today, as well as h. R. Mcmaster, thats when this response was made. It raises those questions. This is a president who likes to outdo other president s. Thats something we have to keep in mind. His decisionmaking here. He likes to do things differently. If you advise him, past administrations have done x, y and z, the president likes to do k k. You can see that playing in his decision here to accept a meeting like this. We still have many questions surrounding this. Its important to keep that in mind, that the white house has not given any indication of when this meeting will happen. We do not know this meeting would happen. Just a few days ago, the president was expressing skepticism about Something Like this happening at all. Theres a lot of ground to cover between now and then, even when this meeti ining happens. Matt, you have been sitting there patiently. I want to talk about the president going his own way on a different issue. Thats the issue of tariffs. Every republican didnt want the president to do this. They warned of a trade war. But the nondisclosure agreement is a solid agreement because she took the money. And in agreement, even though it has a provision for a signature, that can be waived by the conduct of the other party. And these agreements are upheld all the time. Earlier, you were on another network and you said, in agreement, you need the signature of both parties. If theres no signature by him, its not valid. I have to acknowledge that i was incorrect. A study of the jury instructions says even though the signature was not there, if she took the money and acted in a way to waive his signature because she took the money, she cant have it both ways. She cant take the money and claim the agreement was invalid. As i told you, i have a leading case on the subject. Im going to go on. She what if she forfeits the money . Still, it is legal and binding . The agreement, the conduct spells out a waiver of the need for him to sign the agreement. It spells out how condoning the fact that he didnt need to sign the agreement. Unless the agreement says it doesnt become binding until its signed by the party, he can waiver, estople. It means what it sounds like. You cant assort a right. You think she will lose this case. She will lose the case, without question. Why so . Because these agreements are upheld. A party can waive the First Amendment rights. The fourth amendment, fifth amendment. Constitutional rights can be waived. And she chose to sign the document, take the money and run. Right. To use woody allens expressi expression. If she had waited his signature, maybe she might have a case. But she didnt. She wouldnt have. She acted as if the agreement was valid. Valid. If he allegedly signed it, then she would be clearly out of court. Right. Thats what the Appellate Division held. You said you had the leading case in new york. In regards to the enforceability of a nondisclosure agreement. It went to the Appellate Division and the court of appeals refused to review the decision of the Appellate Division. Its a reported case. And it stands for the proposition these agreements are enforceable. Now, conduct is also of great moment. She took the benefits of the agreement. And now claims that there was no agreement because he didnt sign it. Assuming her story is correct. He was involved with her. You said you were wrong after your initial appearance this morning. Did you speak with anyone . No. I consulted and i still have it here for you, the jury instructions. I have the pages for you. This lays out what the law is. And all judges in the state have to comply with the patent jury instructions. And theres no question, its 1000, that she would lose. If you were advising Stormy Daniels, now, what would you adviser, mr. Goldberg . What would you say to her . She cant give the money back because she wouldnt give the money back. The agreement doesnt say, it doesnt become valid until he signs it. Doesnt say that. And these agreements, like they are written in cement. They are upheld all the time in new york. Its believed that it takes away the womens right to free speech. What do you say to that . The lower court in the case that i was involved in, held that very same thing. That it impacted negatively on the right of free speech. But the Appellate Division held that a person can waive the right to free speech, can waive constitutional rights. The fourth amendment, the fifth amendment and the like. And the court upheld it in the Appellate Division. And even if court of appeals, which is the highest court, refused to review it. It would disturb the holding below. This is a situation where theyre taking the money, the benefits of the agreement. And claiming the agreement is invalid. No judge would go for that. Republicans control it. They will not exercise any kind of contempt on anybody they find is connected with the Trump Administration or the trump campaign. You said hes going to get away with it, john. Then what is the purpose of this Committ Committee . Well, it is an intelligence committee. It used to be nonpartisan. It doesnt look like it has teeth. They have no teeth. And the reason it has no teeth is, it takes the majority of the committee to put them in contempt. The full house is controlled by republicans. Theyre not going to do it. Even if they did do it, it goes to the u. S. Attorney, who is a republican appointee and hes not going to enforce it. Theyre going to get away with it. And good night, folks. Seriously. Jack . Yeah. If speaker ryan wanted this committee to act like a Congressional Committee and get to the bottle at bottom of thes and not have their way with the committee, things would be different. And then, things will be different. And then, with rmt to any witnesses in this committee, and before the special counsel, theyre not going to have their way with mr. Mueller, the way theyre having their way with these house and senate committees. Didnt they subpoena bannon and he refused . He did. You mean mueller . No. Hes cooperating with mueller. Im talking about the House Intel Committee. Right. And in the political investigative bodies, they have no desire to see this, apparently, move forward and be conducted as a true investigation would be. So, as long as their party is in control, you cant expect to see anybody held in contempt. Well, isnt that something . That were the case in real life, the employees would take over the company. I mean, think about that. Let me ask you this, john. Paul manafort was in court today. He pled not guilty to bank fraud and tax trcrimes. His trial starts july 10th. Did you see he would make a deal before then, july 10th . I would say, the judge put pressure on him because he has a september date in the district of columbia. And now, to get a july date, earlier date, in the eastern district, is going to put a lot of pressure on him. So, this actually helps the prosecutor if theyre trying to flip him, to get to that goal. After he spoke to his former chief of staff about the interactions with the special counsel, a white house official told cnn that the chief of staff, john kelly, has warned President Trump about speaking to witnesses, from a legal perfective. How much trouble could the president be in talking to the witnesses after the fact . Its not illegal. Its just unprecedented and not a good look, right, jack . First of all, hes clearly ignoring the advice, not only of general kelly but certainly of his lawyers, who must be telling him not to do this. But youre right. On both counts. Number one, in and of itself, these probing of various employees is not does not amount to obstruction of justice or witness tampering. Having said that, its incredibly unwise on his part. Its unwise because it creates a terrible appearance. You know, innocent people may get nervous and want to find out what other witnesses are saying. Guilty people do this all the time. And somebody who is doing this, looks to be guilty. Wouldnt you be curious if you had all of these people testifying about something that could lead to your impeachment or put you in jail . I would be curious about it. I would follow the advice of my attorneys and say, did you ask them . What did they say . The way to do this is for his lawyers to be talking to the lawyers of the people who are testifying. Yeah. This should be a lawyertolawyer conversation. The lawyers should have said to him, do not speak to any witnesses. Do not speak to my lawyers other than us. And preferably, dont talk to anybody. Yeah. I want to give you the quick last word here, john. Were hearing that its clear, kelly, this is what an official told jim acosta. Kelly admonishes him constantly. Hes not the only one. Do you get a sense that those closest to the president are starting to get nervous about this investigation . If they havent, they should be. I think the drive is going to continue.
