A midnight curfew fast approaching in charlotte. Police said they would not enforce this curfew as long as the protests were peaceful. Were watching to see if that remai remains, if that holds up tonight, as well. The mayor is asking the candidates to stay away for now, both have agreed to the mayors request. Well talk about that but lets get straight to the streets of North Carolina and also atlanta. Well get there soonish, as soon as we can. First i want to get to Boris Sanchez and bryan todd. Bryan what are you hearing where you are . Reporter don, the protestors have been here in front of the Police Station in charlotte, trying to figure out their next move. They may be on the move soon. They have been moving all night long and i talked to a protest organizer not too long ago and he said they want to move because they dont trust the police even though the police have said they will not breakup the protests as long as theyre peaceful even after the curfew, this protest leader said we just dont trust it, we want to keep moving. Now, the requesty iquestion is keep moving beyond the Police Station. Theyve been chanting why wait, release the tapes, theyre doing another chachbt ovnt over. We can listen in for a couple seconds. [ chanting ] okay. So don, by stopping here ask staying here and yelling at the Police Officers over here, is they are just not accepting the argument by the police chief, putney, by the mayor and others they cant release the dashcamera and body cam shootings. The mayor said we want to release them as soon as possible, but its the state bureau of investigation who handles it. That bureau has said those tapes are in the custody of the Police Department and eacheptintit eac throwing it to one another. Their point is, release the tapes and we can get transparently here. Theyve been arguing all night as theyve been moving through the city, don. All right. I want you to stand by for me now. I want to get to Boris Sanchez. Boris, we are just about an hour a little bit under an hour now from the curfew. Tell us whats going on. Reporter hey, don. So were on the other side of bryan and as you can see behind me, theyre in front of the Police Station. I hear they starting to peal e f well, that wpeeling that way. Im joined by the captain of the Charlotte America len berg Police Department and theres bit of coordinate between you guys and the protests. You can tell us about that . We try to present were here for the safety, make sure traffic, and cars dont get inside where the protests are and sometimes the communication goes well and sometimes it doesnt. We just respond either way. Reporter yesterday there was this curfew we said at midnight, the sail thing tonight it. Wasnt enforced as you said the proef protestors remain peaceful. Are you dog the same thing tonigh tonight . I hope so and everything remains peaceful and everything will be good. Reporter theres certain mistrust from the police and the community. One of the points i overheard was the shooting of mr. Carr, the 26yearold outside the omni hotel. People here dont seem to believe he was shot by a civilian. They believe he was shot by a Police Officers even though there was an arrest in that case. How difficult is it as a Police Officer to try to communicate what you see is facts to the community when theres so much distrust . The first thing we need to do is work on the mistrust and if we work on the mistrust all the other stuff may fall into place and we may not be able to convince people about this particular case but maybe we can do better with trust and work on the next one. Reporter i also noticed every time the protestors stop at a location, you mobilize the troops. Are you expecting to do that to get them away from here . Theyve anyone here for a while at this location. If something goes sideways, we can deal with it. Captain, thank you. Reporter don, were going to keep watching the situation. There are crews of Police Officers roving around these protests. Ive seen some of them start to peel off, and the crowd has down sized considerably when we last talked to you in the past hour. I want to get to Martin Savage where theres large group of protests, as well. Martin, it seems theyve cull min eight minm minatd in one particular spot. Take us there. Reporter yeah, theyve gathered here at the atlanta city detention center, city jail, and theres several hundred people now that are sort of focused on the steps here as you can see. The crowd is just beyond us here, and essentially, theyve occupied this space. It is somewhat of a showdown. There are authorities that are of course blocking the main entrance to the building and theres no way theyre going to allow the protestors to get inside so the steps have become a focal point for the speakers speaking about this crowd talking about injustice in the system, and talking about how the Police Shootings of the last week cannot be tolerated and in many ways there are lots of different groups represented in this crowd all the way from black lives matter, to various church organizations, and they intend to occupy this space at least until midnight. There was only one scuffle match that began when the crowd walked up a man sort of rushed at the police as they stood at the entranceway. That was quickly quelled by the demonstrators themselves. Otherwise this has been kw extremely disciplined, well organized, vocal, but peaceful. There have been no real altercations and the police have stayed away. Theyre obviously guarding the front france to tentrance to th you havent seen much of a presence. It is the parade organizers that have stopped traffic and allowed the precession to move through. Theres been no real showdowns or major struggles with Law Enforcement although they are monitoring it very, very closely and they say the protestors will be here another hour, don. And we have a former member of the house of representatives who sporupports Hillary Clinton and good to have all of you here this evening, and bakari, i want to get to you first because youre in charlotte tonight. What are you hearing from people in the community about this new cell phone video released by the family today . Well, i can tell you it didnt do much but hiden teight distrust between the community and Law Enforcement. I mean i think thats what this whole thing has been about. Its been about justice and its been about a trust thats been broken. One of the things that i looked at when i saw the video is that ms. Scott, she had the wherewithal and the courage to film that video knowing that that incident with her husband surrounded by those Law Enforcement officers could have led to something bad happening and it led to his death, and so i think thats something that most africanamericans feel like they may be incumbent to do now, so everybodys chanting release the tapes, no justice no peace and everybodys getting into a good trouble so far which im very happy for and proud of, don. I want to get to van jones of the lets talk about a little politics here. New polls in North Carolina say trump and clinton are neckandneck. Clinton tweeted earlier saying charlotte should release police video of mr. Scotts shooting without delay she said. We must ensure justice and bridge divide. Is she taking the right approach . I tell you, i think that she is speaking for a lot of people. Obviously there are good reasons to keep a tape back if theyre in the middle of an ongoing investigation, but i think more importantly, North Carolina has really been a hotbed of challenges the governor has been very tough on Voting Rights against Voting Rights essentially for africanamericans of the its a real hotbed and its going to be an important Battle Ground state and this i think heightens all the tensions and one of the most important things that i can say is that im very, very proud of those young people tonight who are out there constructively engaging, exercising their Constitutional Rights and speaking up for the redress of their grievances. Its in the constitution. Nobody likes it when you see the destructive active, but just as much as people want to condemn some of the stuff you dont like you have to stand up and cheer that these young people are taking to the streets, demanding redress of their grievances and doing so in such a powerful way. Hey, stacey, i have a question for you now. Donald trump says Hillary Clinton shares responsibility for the protests because she supports the narrative that Police Officers are racist. What do you think of that . Well, i wouldnt say that she shares responsibility for any violence or anything of that nature, but of course we have to be careful what we say and i dont agree that Police Officers are inherently guilty or theyre hunting down blacks or any of those things. What i think is happening here is we have a couple officerinvolved shootings. We dont know whats happened. The investigations are ongoing and id like to see us maintain this level of order are, if youre going to protest, make sure its orderly, make sure its lawful and lets see what the investigations show. My hope is that black folks watching those same images on television, and then seeing the history represented this museum, can say to themselves the struggles were going through today to connected to the past and yet all that progress weve made tells me that i cannot and because if we join hands, and if we do things right, if we maintain our dignity. Were a wounded country, dochb, and weve gdon and weve got to have some Difficult Conversations where people that are going to be openminded to things that might hurt their feelings a little bit, and engage in a discussion that for too long its been brushed under the rug and people that want to inflame groups, theres some difficult things here and there have been officers that have made bad judgment, done things in correctly, as a whole, as a 16year member as a reserve officer i realize how much training they go through and i appreciate what they do and how they have to put themselves in some very dangerous situations that call for splitsecond Decision Making on life or death. You know, i think that the law needs to take its course on this case and let the facts come out as they will if Law Enforcement is saying in the judicial department, they are saying they need to take these steps to go to before they release the tapes, want to stain a jury or put an impression on people before they have the chance to do what they do but were going to have to have some difficult discussions that we quite frankly as a country havent had. Weve brushed them under the rug and politicians have said things to get their supporters behind them, or to alienate or to bring folks in but we really havent had you need people like van jones that are fair and reasonable and can articulate a great message and thats where youll have a Progressive Movement to solve some of these problems. Our africanamerican communities are absolutely in the worst shape theyve ever been in before ever, ever, ever. It just seems theres lack of spirit between the white and the black. Its a terrible thing that were witnessing. I will stop the drugs from flowing into our country and poisoning our youth and many other people. And if youre not aware, drugs are a very, very big factor in what youre watching on television at night. Bakari, whats your response . I mean i my response is and first i just want to say that i agree with andre somewhat, but the conversations that are going to have to be had, with all due respect to van jones and even myself, theyre not necessarily conversations that just need to be had with us. In fact theyre going to have to be had with our cousins, theyre going to have to be had with the people who go to work every day, who are out here protesting and screaming. We cant pick and choose who we have these conversations with and to staceys point talking about the rioting and protesting, if you can condemn the rioting and protesting you also have to condemn the conditions that led to it and my last point is were not talking about charlotte. I want the tapes released tonight in charlotte. I hope they come out tonight, but even more than that, i think my heart aches because its not just charlotte, its terranence crutch crutcher, its tamir rice, its walter scott, and for many us of this isnt an isolated incident in charlotte. Were tired of seeing black bodies this the street. Stacey, respond to that. As an africanamerican who is conservative, how do any of the remarks that you hear from donald trump and more, how does that help reaching out to the black community, disdooes it . I dont think anything he said was false. Im not sure about the drug involvement in the protest. I dont think the protestors are on drugs. What were talking about say conversation that he started when he went to that black church in detroit. Hes been opening up the dialogue with himself, his campaign and the black community which has traditionally supported democrats more than republicans for decades now. Hes saying give Something Else a chance. The democrats have controlled america for 50, 60 years, and hes asking for an opportunity for republican policies in the Republican Party platform to apply to the black community which some is heavily concentrated in inner cities. Okay. And thats an opportunity, thats what hes offering. Van jones . Well, look i am somebody who said at the very beginning of this campaign back in the primary season, that republicans did have a shot at the black communitys vote because frankly its unnatural to have one group with 90, 92, 94, 95 of any one thing. But i think that donald trump has made a mockery of those efforts first of all when you assume that all africanamericans are poor, youre automatically making a stereotypical statement and you dont talk to poor people the way hes been talking to poor black people. I could just easily say youve got a bunch of poor white folks that have been voting for republicans for generations. And they have not made very much progress and i could talk about their Living Conditions and talk about them living in trailers and talk about all kinds of stereotypes and i could say vote for me, i think those people would be highly ovendffended th was the way i was coming at them and i think people are highly offended at the way trump is coming at us. And i do think this is a very important moment. Listen, the Africanamerican Community is tired of funerals. Were crushed now in some of our communities between street violence and Unlawful Police violence. And unfortunately, too many politicians just want to score points on you know this funeral or that funeral and were not working together to get the overall number of funerals down so to me and i dont feel donald trump has been very helpful in getting us to that place. Former Police Officer david klinger, author of into the kill zone, welcome back into the panel. How do you think the mayor of charlotte has been handling this case, mark omar a . I think shes trying to be transparent, sensitive to the enormity of the social issues being addressed unfortunately now in her city like many, many others. I must say i dont like there was a bit of a split between her and the police chief, because i think if nothing else, there needs to be a concerted front in the fact this investigation needs to be continued in a way that maintains the integrity of it. Overall, very difficult situation. This, like many other cities is now the focus point, not only of the nation, but the world as to how were going to react to the undeniable racist biases and issues to our criminal justice system. This is about police and also about the leadership of the city and somewhat of the state. Is there anything that you see could have been being done differently . One thing would have been to have a tighter messaging and i know thats a political term but what i mean by that is not put out little bits of information. It doesnt make sense to me certain information has been leaked from the investigation about the handgun that was found. Doesnt make sense to me that the mayor would make some comment about what she saw on the video. The chief makes a comment so on and so forth. I think everything should have been kept in the house until a decision was made to go ahead and release the videos after all those investigative issues weve been talking about this evening and prior, have been taken care of. I would have liked to have seen that. So lets talk about mark, you know as we talk about these issues, race always plays a big role as you know, from the George Zimmerman trial and from other things weve covered on cnn. There have been so many of these things, ed, weve covered sadly and were right in the middle of the president ial season. This president ial debate between Hillary Clinton and donald trump coming up, do you expect this shooting, as well as others like this one, maybe tulsa, to be the topic of discussion there and should be it . Well, unfortunately, its going to be, because candidates love playing with political footballs, they like trying to make headway on their own campaigns by threading some needle as to how to do it and thats great but enough politics. We have a crisis in america. Its very simple. We no longer need to deny it because. Past four years watching it on video almost once a week and this is where it is. We have a crisis in trust and respect between the Africanamerican Community and the police. And in that equation the police are the professionals and theyre going to have to be the ones who take the first step, take the second step, if necessary, and the third, we need to train our officers better, we need to pay them better, we need to get rid of cowboy cops so that people that they serve dont forget cops only exist because we break the law. Cops are there to protect United States from each other and that that roll a very delicate and necessary role we have to train and pay them better and they then need to earn our respect because this is going a bad way when we have less and less trust for officers and officers have less trust and weapon for the black community. Is it has to stop. David t has been said, on this broadcast, at least, you know, the political candidates may be using it to sort of make headway with their base. But this these issues are usually handled on the local level. But it has also been said there needs to be some uniform standard for all Police Departments that need to meet one single standard. What do you make of that . And can that happen from a president ial candidate . Yes and no, and what i mean by that is this, there are already National Standards about a lot of things and so i think that people think the cops can run willynilly in one jurisdiction and another however they want. The constitution sets baselines in terms of search and seizure and the police have to work with in that. I do not love the notion of having some overarching police power. One of the reasons our country has succeeded so long for twoplus centuries is because we do not have a federal police or the heavy hand of washington and im seeing more and more encroachment from washington on police and one of the problems with that is it takes away the flexibility. One of the things we know that has worked in Law Enforcement, is movements towards letting the citizenry closely with the police on the local level, which is what Community Policing has been all about for the last 20, 30 years depending on who you talk to and when the federal government gets involved, what happened is they just know how to handle it from washington, d. C. You talk to the folks in the fbi, you look at their history of officerinvolved shootings, theyve never had a bad shooting. What kind of sense does that make, so the federal government wants to hold local police more accountable, but they dont hold themselves more accountable. Bryan todd is live on the site of the protests. Whats going on bryan . Reporter groups of activists have been holding a de facto debate here in front of the station. They were doing it on the street there, now theres some people speaking from the elevated position here debating about the best way to bring about change in the city and express their views about whats happened here, some of them believe through continued protest and marching on the streets . Some believe you have to do it through economic boycotts. Weve heard a lot about that and one of the activists leaders said the central theme, theyre trying to release their out range, the state bureau of police have not released those body cam videos, and they believe a lot of this controversy would dissipate. Theyre holding sort of a debate here on the streets over the best way to kind of effect that message and theyve been here now for several minutes, probably at least close to an hour. Whether theyre going to keep on the move, were going to see about that. I think a street debate is still ongoing down there. You can kind of see it over my left shoulder. Again people try to get in the middle there and debate about the best way to do it don. Bryan todd well keep a close eye and ear. Bry and civil rights activists, there you saw our demmoocracy a work there. What do you think of the protests tonight sort of doing a mock debate . I love the productive discussions that people are having, thats part of what this is about, in terms of reconciling to build the trust, but really from a legal standpoint, the role has to be on the prosecution and legislators to say, listen, how can we effectively enable prosecutors to be able to be independent, to be objective and prosecute appropriate crimes and a stepbystep has to take place in each case. This video from keith scotts wife, you hear and you see the lead up to the shooting and you hear the shots fired. What stuck out to you . First thing that really, really concerned me, don, was the introduction of this information about a traumatic brain injury. Weve not heard any knone talki about the mental capacity or the met Mental Health or neurological issues, and you can clearly hear his wife saying that he had a traumatic brain injury and he just took medicine, so it raises the question if he even understood what was happening and the police chief himself said when he watched the video, mr. Scott seemed dazed or confused. Weve seen a lot of these case where is police are dealing with someone that just different understand their commands but yet theres this expectation that they respond so quickly before and if they dont respond almost immediately, it escalates into the type of shooting we saw in that new case. You can hear officers repeatedly asking for scott to drop the gun, listen. Dont shoot him. Dont shoot him. Drop the gun. He do not do anything. Drop the gun. Drop the gun. He doesnt have a gun. He has a tbi, heat ns not goin do anything to you guys. He just took his medicine. Drop the gun. So officers ask him to drop the gun at least ten times. Even if his family is right and he doesnt have a gun, doesnt it seem the police were convinced he had something . It does support that and the chiefs statement they did. Everyone keeps talking about traumatic brain injury. What she said was tbi, and its unclear what the officers knew that was standing for or the object he was holding. Her statement is he doesnt have a gun, he has a tbi, hes not going to hurt you. He just took his medicine. In that short span of time, officers are supposed to be able to listen and reconcile that. We have heard the inconclusive video that has a lot of gaps to be filled and as a prosecutor, you have to hear from the eyewitnesss and the officers about what they interpreted. And he apparently got that traumatic brain injury in 2015 in a motorcycle accident october, november, im told. Go ahead, ariva. You know, im a lawyer, like you are, and i understand why shes coming from as a former prosecutor, but i think from a public perspective and layperson looking at this video and so many of these videotapes, we cant help but ask the question, how come these situations arent handled differently, how come theres not more efforts to deif escalate these situations . You have a man who isnt committing a crime, and has interaction, according to the videotape, lasts less than a minute or two, and he ends up dead. That keeps playing out over and over again and we can go fact, by fact, case by case, and it is going to be a ultimately a justified shooting but if we dont change the way policing occurs with respect to after p africanamerican men, when youre not committing a crime and you end up dead were never going to resolve these deeply, deeply engrained racial issues tearing apart this country ask causing africanamericans to feel as if they are haunted on a daily basis. I hear you and i agree, but as you well know, one of the reasons that officers are believed to be emboldened and empowered by their actions and being reckless or disregarding human life is because youve got a Supreme Court standard that says were going to only judge officers by what other reasonable officers believe is the appropriate force. So what has to be the inquiry for a prosecutor looking at these separate cases is, number one, what was the level of force that should have been used in this case 14 w . Was there provocation . The only way to affect the standard, or aleve what youre talking about, if we have cases where the prosecutors can appropriately and effectively prosecute ask they can discover was there provocations a, was te use of force, and whether they acted appropriately. Im glad you bring that up. Can i just say one thing, don . Yes. Im glad you bring that gardner v. Tennessee case, because there was a recent Massachusetts Court case that said maybe its time to look at the actions of the police through the lenses of the civilian and not solely through the lenses of the Police Officers. I completely agree that has to change you know and i think were saying the same thing, ariva, its just a matter how the approach is being taken and what role the prosecutor in this case has taken. You know the prosecutor represents the jurisdiction and they have to make changes for that but they have to begin with the facts of the case and the socio aspect of it is very important for the opinion, but a prosecutor has to win in the court of law.
