This is a president who the house impeached a week or so ago because he abused his power, he broke federal appropriations law by withholding hundreds of millions of dollars in vital foreign aid that was needed by ukraine in order try to pressure the ukranian president into investigating his political rival and interfere in the 2020 president ial election. And now he is essentially coordinating with the majority leader, Mitch Mcconnell in the senate, to try to rig the outcome of a trial in which every single United States senator will raise their hand, swear an oath of impartiality and Mitch Mcconnell has already admitted hes going to violate that oath. So no question Speaker Pelosi is correct in the way shes handling this. I want to ask you about that, because Mitch Mcconnell has taken a lot of heat for those comments that highlight what youre talking about, the fact and this is something Chuck Schumer has jumped on, democrats have, even republican senator Lisa Murkowski has said hes not an impartial juror. But during the clinton impeachment, schumer actually said something very similar to larry king on cnn before the senate vote. Lets listen to that. Actually, let me tell you what he said. How are voters supposed to take this seriously when Chuck Schumer is taking a serious one that i guess you say the basic tenets of the trial like the trial that will take place in the senate. They include the calling of witnesses. It would be unprecedented for the United States senate in an impeachment trial that will decide on whether the president is. Andrew johnsons impeachment, 41 witnesses. President clintons impeachmen. , witnesses who have never been spoken to. Leading up to the clinton impeachment, they made sure that senators could get access to documents they needed to review, listening to witnesses testimony. Thats a bake component of a trial under the constitution, and when you swear an oath to be impartial, youre supposed to mean it. Everybody brings their own opinions to the table, but then the reason that you have a trial and you hear testimony from witnesses and review documents is so that your initial opinion can be shaped by that evidence. And that is the very minimum that Mitch Mcconnell should be putting into the components of this trial. So far hes not, and thats the Constitutional Authority that we have inside the constitution. What would this departure mean, first up, for his prominent role in the Trump Administration and more broadly for National Security . Having been inside the administration, these personal rumors happen all the time, unfounded rumors, often, and a lot of times people who are ang li ling for these positions see it in the media, so we have to take it with a grain of salt. But secretary pompeos departure could be a good thing for the house. Morale is low, so if he departed and President Trump named somebody who had diplomatic standing in the diplomatic community, that would be okay. He said, quote, my first evacuees of seeing the videos was surprise and disgust that they would make up blatant lies of me, but i quickly realized they were scared of how the truth would come out how cowardly they acted on deployment. I felt sorry for them that they thought it necessary to smear my name, but they never realized what the consequences of their lies would be. As upset as i was, the videos also give me a confidence because i knew that their lies would never hold up under real questioning and the jury would see through it and nciss refusal to ask hard questions or corroborate their stories strengthened my resolve to go to trial and clear my name. We knew that members of his platoon turned him in, and we also know he was acquitted after another s. E. A. L. Said, and really changing his story at trial, actually he, not gallagher, killed the isis militant he took this photo with. I wonder, general, whats your reaction to these leaked videos . I had a negative reaction to it, brianna, truthfully. This was, i believe, part of the pretrial inquiry. This is raw data coming from the questioning of those members who had suggested what Eddie Gallagher had done to their commanders. This is what drives the referral to court martial. So this is really raw, pretrial information that is important for a commanding general like myself, or in the case of the navy and admiral, to say yes, there is enough evidence here to refer this trial to court martial. But then when you get into the court martial, though, you have rules of evidence procedures that are important, the ability to crossexamine witnesses. We dont know what happened in that trial. The jurors do. And we do know that a lot of this damning evidence, and it took a lot of courage for these s. E. A. L. S to come forward and turn their brother in for some of the what they perceive to be crimes in combat, but when it gets to trial, then it goes through an entirely different process and we have to depend on the outcome and have trust in the system and the processes to determine guilt or innocence, and thats what happened. It was a controversial outcome, important to point out, and poorly handled by the prosecution team. I think a lot of people can agree on that. What did you think when you saw thoo the that these videos were out there . Certainly a lot of refuted details out there and gallagher has argued about those interviews. There is a code in these b interviews. Yes, there is a code of silence but there is a code of honor they believe in to talk about what they saw. They were the same stories and werent corroborated prior. Number two was just the issue of the leak itself. Very troubling and interesting timing here. Gallagher goes down to mt. Maralago and now these videos come out, and i think thats unfortunate. The third reaction i had was this isnt going to make admiral collin greens job any easier. Hes out in san diego. Hes trying to get a grip on some conduct issues theyve had in the past. This isnt going to make his job easier. Its almost as though the general saw gallagher on kind of what has looked like a media blitz victory lap. But i also wonder even though you talk about having faith in the system and the outcome, in the end this has split a community. And this has flipped a lot of people on how they view the military. How does an elite military organization recover from this . I tell you, brianna, you introduced me a while ago as a former commander. As a commander and flag officer, you have many occasions. I have introduced many caourt martials. Many turned out to be viable and the right action was taken. There were many, frankly, that turned out not the way i wanted them to turn out. The important part, and i think admiral kirby backed me up on this, once you turn them over to the military justice system, you stay out as a commander. Its something called command influence and that didnt happen in this case. There were commanders, in fact, the commander in chief, who kind of put himself in the middle of this case not only during the trial, but posttrial during the administration discussion. And thats unfortunate. You have to trust in the system to make things occur the right way, and any time you have command influence or interference in a trial, it makes things bad, and thats like the comment you just made, this is going to make it very tough for the s. E. A. L. Community to get their discipline back, and its going to cause questions among the ranks in terms of whats right and whats wrong. You brought this up a little bit. Theyve already been struggling with their issues. You had the question of a death of a green beret in bali, you had a commander pull out from drinking on the job, which theyre not supposed to do, and a rape allegation. They have a lot to fix. And we need to remember that the vast majority of navy s. E. A. L. S are like a vast majority of any of our military members and act with conduct, but there have been prominent issues about conduct in the military community, which is why admiral green said when he first came in, were going to fix this, and hes still trying to do that. The gallagher case, i think, has made it more difficult for him to be able to do that, because now there is a message being sent by the commander in chief. Not just to the navy s. E. A. L. S but to anybody who may be in legal trouble. All i have to do is get on fox news, get somebody to see my case, get the president s attention and ill get clemency and get exonerated. Thats not good order for the force. They have issues theyre trying to deal with, and i think its important that we as a country give admiral green the chance to deal with those issues fairly and equitably without outside interference. At the start of the year, President Donald Trump called the crisis at the border a national emergency, and in effect, the administration carried out sweeping and often controversial universal policies. Many judges put in place to enforce those policies have called it quits, and one of them is judge lisa darnell. Shes joined us now. Thank you for coming in to talk about this. Thank you for having me. When we look at the numbers over the last year, its been 45 judges that have left for various reasons, but in the prior year it was about half that. Clearly something is going on. You were part of that. You decided, after making judgments under the policies of three previous president s, obama, bush and clinton, that in part you couldnt do it under President Trumps policies. Explain that to us. I wouldnt do it under President Trumps policies, and ive worked under a variety of administrations, and each administration has, as their prerogative, to implement certain policies. However, interference with Judicial Independence is not acceptable under any circumstances. There was a pattern of increased interference with the ability of Immigration Judges to make independent decisions and that was just unacceptable. What did that look like . What did that interference manifest itself as . There was the removal of an immigration judge from a decision. As Immigration Judges, as jurists, we try to get it right. Sometimes we dont get it right. But there are specific provisions in place to address that. Removing an immigration judge from a case is not the answer. What does that signal to other judges when that happens . Its an incredible lack when it happens . It yunner mi undermines morat were charged with doing. Provide due process of law to every person who appears before our courts. Reality is that not everyone who comes before the courts can be given permission to stay, but the law requires that everybody be given a fair opportunity and due process of law. Jeff sessions was really the early implementer as the first attorney general, and really kind of put exerting pressure on judges about how they should be deciding cases. He actually said the system encourages weve heard this from a lot of people who defend trump policies that the system encourages migrants to make baseless asylum claims. Weve seen asylum claims jumps as it was families not generally single men come across or through the border, and when he made that claim that this was encouraging baseless asylum claims what did you think of that . Thats based on a misunderstanding of what our asylum laws are developed to address. There is a clear distinction that is to be made between immigration claims of claims that are lacking in legal merit and those that are fraudulent. The misperception on the part of this administration, just because people, desperate people seeking asylum of performing fraud. Thats just not true. Released i sigh luasylum for of Domestic Violence and how did you react to that personally . With horror. Because asylum cases under the law are to be decided on a casebycase basis, and any efforts to interfere with that ability on the part of Immigration Judges is unprecedented and unjust interference in Judicial Independence. Thats why for years Immigration Judges have been pushing for an independent Immigration Court. An article one court, removing us from, and protect us from, the political whims that blow as administrations come and glow. Hearing you today say this was an unprecedented interference in the courts that you had the likes of which hadnt seen before. Other judges have said this destroys the Immigration Court system, that thats really the effect of what the Trump Administration is doing, and then were also seeing with the crisis of so many people wanting to come into the u. S. , that courts are just backlogged. What is the status right now of the courts, and i mean, can they be effective . I can speak to the situation when i left. Yes. In april, right . Under funded, under staffed and what we need is an administration and a congress to Work Together to solve this immigration problem. It is a solvable problem, and you dont solve the problem by separating children from their parents. You dont solve the problem by keeping people at an unsafe situation on the other side of the border. Congress needs to step up. The Administration Needs to step up and get serious about doing our duty to protect people who come to our nation and who deserve the protection and the rule of law.
