The White House Press secretary Sarah Sanders was on a couple of the morning talk shows, as you saw earlier this morning, trying to explain her own admission in the Mueller Report that she was passing a on false information to reporters over here at the white house when it came to the president s firing of the fbi director james comey, but i want to take you back, brianna, to something ive just learned in the last hour from a former Senior Administration official who was familiar with the Mueller Report and some of the events that are described in the Mueller Report. This official confirmed to me that the president did say when mueller was appointed, quote, this is the end of my presidency. Im fd. According to this former Senior Administration official this person said the pant was not trying to whine about his Current Situation at that point. He was trying to convey to the former attorney general Jeff Sessions and don mcgahn, the white House Counsel, how much they had let him down, according to this former official, and it came across as tactical bullying in the words of this former official, and so while the president is on twit they are morning saying, you know, some of the events that are talked about in the Mueller Report are total bs, i talked to one former Senior Administration official who is very deeply wired into the situation over here when all of these events were unfolding who confirmed thats what the president said. Now, in terms of the White House Press secretary, she is certainly under fire right now. Shes been under fire for the last 24 hours. We have not seen her over here at the white house today. We did see a Deputy Press Secretary hogan gidley and this goes without saying, you covered the white house, its not every day when federal prosecutors put out a report that states that the White House Press secretary had been lying to the public, had been giving false information to the public, but thats indeed what has happened. Sarah sanders was on those morning news shows earlier today defending herself and insisting that she wasnt lying to the public, but, according to that Mueller Report, what she said was not was not founded in any kind of facts. It sounded as though she was just making things up at the time when she said it, and it certainly seems like thats the case now, brianna . Things she repeated over and over. Thats right. Jim acosta at the white house. Thanks so much. Despite the spin from the white house, the Mueller Report does expose the president s key emissions and outright lies on several topics. For instance, the fundamental claim by trump that the whole Mueller Investigation was witch hunt, from lying to voters about his business interests in russia and knowing his misleading explanation of the trump tower meeting there were plenty of reasons to investigate the president and his associates entanglements in russia. Evan, there is a long list of lies exposed by this report. Can you walk us through a few of them starting with the fact that it appears there was plenty of attempted collusion. Absolutely, brianna. You can understand now why the president s lawyers tried to protect him and stopped him from testifying or giving testimony to the special counsel because of all of these lies. Lets start with his business deals in russia. He repeatedly told us that he had no interest in russia. It turns out there was a letter of intent signed in 2015 for a trump tower moscow. Thats something that goes right through the report. You see repeatedly efforts by People Associated with the president to try to pursue that business deal. We know he sought the clintons emails, obsessed with trying to find the 30,000 deleted Hillary Clinton emails from her from her privateer is verbs and we know that people that inside the campaign went looking for it. Tried to Contact People who thought would be able to help them get them. The purpose of the trump tower meeting is one of the things that we know the president has lied repeatedly about. Obviously they talked about that it was about adoptions. It turns out they were told it was about getting dirt on Hillary Clinton, and, of course, the response, once that became public the president essentially dictated what were false accounts of what exactly was behind that. He ordered don mcgahn to try to fire special counsel Robert Mueller, and then once that story came out he tried to get don mcgahn to go out and pubically say that it did not half. Again, thats something that we learned in the report that had been report previously and that the president lied about. Lots of contact with russians, obviously, as you mentioned. There was a lot of collusion. It may not be criminal violation. It may not have the been enough for them to bring charges against anyone, but you can see there were multiple people from his family members to People Associated with the campaign who were in content contact with russians and thats what the special counsel was focusing on in volume one of his report. Of course, the reason for firing comey, we know that he was that hes told nbc news that it was in part because of the russia thing, and the special counsel report details exactly how much he in mind about the about the russia investigation and how much that was occupying him when he fired james comey. And, of course, interference with the special counsel investigation. We know that repeatedly he was trying to undermine it. A lot of it we saw in public as the special counsel reports that theres a lot of these things, including people who are associated with with the white house, trying to get to them to try to get the scope of the investigation to be narrowed repeatedly. Brianna. You can see a president and a white house thats replete with dishonesty, and its what comes across in that report. Evan perez, thank you so much. In the Mueller Report, it wasnt just what the president did do that piqued the special counsels interest. Its what he tried to do but then was unable to accomplish because his closest advisers ignored his orders. We have cnn White House Correspondent Kaitlan Collins here with us. Tell us about these aides that saved the president by refusing to execute the president s demands. Some people were more willing than others to go along with what the president directed them to do, but there were some orders from the president that seemed to border on brink of breaking the law and they were not willing to go along with it. What their motives were, whether personal or for the president s sake, is still unclear and not determined in the report, but the eye of the storm was really don mcgahn, the former white House Counsel who had a lot to do with so many things involving the Mueller Report, but one of the key ones was, of course, when the president wanted him to call rod rosenstein, the Deputy Attorney general, and essentially instigate the firing of the special counsel. Now, don mcgahn didnt want to do that and it almost led to him resigning at the time, but its just one instance that don mcgahn was involved n. Also, mcgahn did not go along with that and months after that when it was reported later that the president tried to fire the special counsel he wanted don mcgan to come out and say that just wasnt true. Don mcgahn wouldnt do it because he told people that was true so he wasnt going to go out there and put his name on the line by denying something that had actually happened. Thats another instance of the president pressuring people to go along with what hes demanded. One interesting one that people did not see coming is cory loon dousk i who worked on the president s campaign, does not work in the white house and never has, but the president tried to get him to send a message to the attorney general Jeff Sessions basically telling him that he wanted him to curtail the russia investigation. Lewandowski realized that was a problem and did not go along with it and tried to pass it is along to someone else in the white house who did not follow through on it. What they all portray is a president being managed by his staff. Thats not a depiction that the president links. The thing is just because the Mueller Investigation is over, we are still told by sources that this is something that happens. People either slow walk the president s demands or simply refuse to carry them out and hope that he forgets he gave them. Managed by his staff and maybe saved by his staff. Kaitlan collins, thing you so much. Former white House Counsel don mcgahn may be in the end be responsible for saving the Trump Presidency. When you see some of these details in this report, carrie, about don mcgahn, do you think that he will be credited with saving the presidency . Well, maybe first of all, his incident was one of many that the special counsels laid out, so they laid out over ten different categories and instances that they said created a pattern of what potentially could be obstruction and obstructive behavior on the part of the president , so i dont know that we can point to mcgahn as maybe preventing one specific thing from happening, but there were a whole host of other things, and, remember, mcgahn, like some of the others who may have not taken an actual act on behalf of the president , its not that they were just saving the president , they were saving themselves. Thats right. From their own legal jeopardy, so had he, and hes a sophisticated enough person and a lawyer and a good lawyer, to know this, had he actually engaged in the activity the president was directing him to do, he would have himself been potentially part of an obstruction or a conspiracy investigation. What do you think about this though because i know a lot of lay people who have been watching will say but he tried in the president tried over and over and it was people protecting him and themselves from being attached to certainly his terrible instincts when it came to what was legal or appropriate . Right. Who may have saved the day multiple day multiple times. Well, under the law, you can attempt badly and not succeed, but its still a criminal act because the predicate criminal act exists with regard to intent and the obstruction is still there as far as the allegations are set forth in detail in the Mueller Report. I think when you really step back and look at this the in the broader perspective, were really living in a constitutionally defining moment because right now as we sit here today bob mueller has taken the obstruction ball and really passion it had over to the congress, and now congress has to decide whether its going to act as a constitutional barrier to protect the country, and really what its going to do is really the key question as we sit here today. They have a lot of granular information with respect to obstruction. As youre pointing out maybe it was more akin to an attempt at a felony, but this is a lot of information that was passed over to congress. We know what the Justice Department is going to do with this, and we saw that at the 9 30 presser. That speaks for itself so thats real the cloud hovering over the congress right now i want to listen to something that Lindsey Graham sawed, not recently. This was back in the day, right, 1999 when hes talking about bill clinton and his transgregsz. Hes, of course, now the chairman of the senate Judiciary Committee. Lindsey graham in 1999. He doesnt have to say go lie for me for it to be a crime. You dont have to say lets obstruct justice for it to be a crime. You judge people on their conduct. Not magic phrases. Clearly, pamela, when you look at this, President Trump doesnt measure up to the Lindsey Graham standard that he had for bill clinton, but the question will be what does a Republican Congress do when it comes to President Trump, and he seems pretty confident that they are going to be on his side. Yeah. He seems confident that they are going to be on his side and for good reason in some respect. I mean, there are some republicans on capitol hill who seem to be in the same category as bill barr, the attorney general, and saying is, look, this is an obstruction. This is a president who was fighting back, who is a sympathetic figure, who was a victim here who really thought that his presidency was being clouded by what he viewed as an illegitimate investigation, and, yes, it is true that the that mueller did not find a criminal conspiracy between the Trump Campaign and russia, but then you look through the Mueller Report and in terms of understanding the why. Why is he acting like this and was there corrupt intent, and muellers team had a different view. It wasnt just that the president is a victim and that he felt like this investigation was undermining his presidency, but they lay out, i believe its on page 76 of volume two. That is memorized. That the fbi could uncover information that the president could perceive as a crime or they could uncover information that could be personally or politically concerning and that was the motive. You know, we know they didnt get the interview with President Trump, but now in reading this report, it does raise even more questions about why they didnt push harder to interview don jr. Because it appears they they looked at bringing a case against him, and they weighed the pros and cons and determined that it would be too difficult to determine the thing of value, this information on Hillary Clinton and his state of mind, whether it was willful and so forth. We do know that there were efforts made by Robert Muellers team to interview him and that don jr. Through his attorneys resisted those efforts, and it appears there wasnt a subpoena. There could be various reasons. Robert mueller laid out the reasons for the president , that it could prolong the investigation if there was subpoena and they felt that they had all they need. Could be the case in don jr. s situation because he did testify under oath in congress to various committees and could have looked at the testimony and thought they had enough but its certainly an open question. I want to quote the report which says in part a prosecution would encounter difficulties proving that Campaign Officials or officials connected to the campaign willfully violated the law. Thats what pamela is speaking to there. Why is it so important whether they willfully vie late the law or not . I think thats something specific to the Campaign Finance laws. Theres specific aspects as far as the Campaign Finance laws whether or not they actually would have known what they were doing. I think part of the problem that the special counsels office might have encountered is that the Campaign Finance laws werent necessarily a good fit for trying to get at what happened at that trump tower meeting, so one of the questions would be was there a thing of value that they were obtaining on behalf of the campaign, whether that thing was actually transferred and what would it have been, and i think this is one of the broader challenges Going Forward when were dealing with information that is coming from in this case a hostile foreign power. How are laws going to deal with that situation and future campaign . So at least in terms of the Campaign Finance violations is it legally they are not in trouble because they were playing tictactoe instead of chess . You know, in other words, if you really werent that sharp understanding and appreciating the legal consequences of your conduct, is that real kind of, you know, your ticket out of jail. This aspect of the charges really need to be looked through the lens of new york and in d. C. In new york the Campaign Finance violations are still alive and well in the southern district, so that story is still yet to be told, but youre right. In the Mueller Report as far as the situation here is concerned, there was literally a finding that he really could not have appreciated the legal consequences of his conduct which is one of the stunning results of this, because one. Reporter well, of course, brianna, we got from the attorney general really four pages in that letter to congress, plus that 17minute or so press conference yesterday, whereas, you know, the special counsel, this was a nearly 450page report, and it turns out it was a lot more detailed and nuanced, of course, than what the attorney general has put forward. Lets just start with that overarching issue of obstruction of justice, so heres how the attorney general put it. He said the special counsel states that while this report does not conclude that the president committed a crime, it also does not exonerate him. Now, grant that had was the bottom line from the special counsel, that the president was not exonerated by this report. However, muellers Team Expanded even further, putting it this way saying if we had confidence after a thorough investigation of the facts that the president clearly did not commit obstruction of justice, we would so state, and then right after that line the special counsel really goes on to say that their hands were tied here because, of course, the the opinion, the olc opinion here at the Justice Department clearly states that a sitting president cannot be indicted. So the special counsel not stating conclusively that there was no obstruction of justice coming to no conclusion on that and then also saying they cant do anything because of that olc opinion here at the doj. Brianna . What about the question of whether the Trump Campaign conspired with russia to sway the election . There was the whole volume one on collusion, and this is whats directly from Robert Muellers report that was released yesterday saying although the investigation established that the russian government perceived it would benefit from a Trump Presidency and worked to secure that outcome and that the campaign expected it would benefit electorally from information stolen and released through russian efforts, the investigation did not establish that the members of the Trump Campaign conspired or coordinated with the russian government in its election interference efforts, so that was the entire conclusion from Robert Mueller. Robert mueller saying that the Trump Campaign team, they real were willing to take this information that was put out there from the russians. Attorney general bill barr didnt go that far. Really he narrowed is down from no collusion, putting it this way. Saying the investigation did not establish that members of the Trump Campaign conspired or coordinated with the russian government in its election interference efforts, and then as to the collusion question in a broad sense, both mueller and barr did effectively say it somewhat similarly, so this is what the report said saying we understand coordination to require an agreement, tacit or express between the Trump Campaign and the russian government on election interference, the report here adding another line saying that requires more than two parties taking actions that were informed by or responsive to the others actions or interests. Barr, on the other hand, put it quite similarly omitting the second line saying in assessing potential conspiracy charges, the special counsel also considered whether members of the Trump Campaign coordinated with Russian Election interference activities. The special counsel, as was said above, defined coordination as an agreement tacit or expression between the Trump Campaign and the russian government on election interference. Brianna, as a whole, this was a large voluminous report from the special counsel and really the attorney general had to summarize this in a sense with that fourpage letter to congress and then that fairly short press conference yesterday. Muellers report, a lot more nuanced, detailed and perhaps even damaging. Brianna . Jessica schneider at the Justice Department. Your colleague Eric Swalwell has called for bill barr to resign as attorney general because of his mischaracterizations of the Mueller Report. Do you think that barr should resign . Well, im a member of the Judiciary Committee along with Eric Swalwell, so i im a big fan, and hes smart guy. What i believe is i dont know whether its worth talking about resignation. What i believe is true is that attorney general barr has displayed an unbelievable lack of professionalism, an unbelievable cover for this president. Its stunning when you saw that press conference yesterday, the press conference frankly about nothing but cover, press conference prior to release the report, where he characterized the president as upset and emotional and angry instead of standing there and being our attorney general, and standing up for the rule of law, hes giving the president cover and claiming full exoneration and going on you talked in your reporting about no collusion. Notice how often the president and the attorney general have said no collusion, and what did Robert Mueller say . Were not investigating collusion. The American People are not that foolish, but i think attorney general barr gave away his credibility in buckets with that shameful press conence. What do you mean by Robert Mueller said he wasnt investigating collusion . Because its not a legal indictable thing. The report actually says that. So this has been a bit of a charade and a masquerade. No collusion, no collusion. Thats not the criminally chargeable thing. Were talking about obstruction of justice or conspiracy. Those are the chargeable things. But the highest the coordination i understand what youre saying, but the coordination between the campaign what was alleged coordination between the campaign and the russians, that was not founded in this report, and youre saying its a semantic difference and yet there you its an important semantic difference. Thats not what is being investigated. They were looking for coordination that would possibly rise to the level of conspiracy. The more important part of this report as we are digging in is the obstruction of justice, and what i think what mueller has done in this is laid out that there are multiple times where it appears that this president or members of his administration attempted to obstruction justice, most importantly the president , with trying to get don mcgahn, for example, to fire special counsel mueller and when mcgahn would not do that and it made the media, the president then layered on a request of mcgahn that he actually correct the record, falsely correct the record and say, no, he was never asked by the president. Imagine that kind of interference with this investigation asking for his underling, a subordinate, to fire the special counsel. Well, so to that point, Robert Mueller basically said that the only reason obstruction charges werent brought was because or or what really what we saw was obstruction wasnt brought because people like don mcgahn got in the way multiple times, not just once, but many, many times. In the end though i dont believe thats real the takeaway. Not because somebody got in the way. That isnt what is required for obstruction of justice. You dont havetohave succeeded at it. Real mueller very thoughtfully lays how the in the beginning of volume two that he had some legal barriers in his way. The Justice Departments rule, right . Absolutely. That you cant indict a signature president. The yeah. He lays that out. You know what else he said . He laid out the road map for congress. The conclusion that congress may apply obstruction laws to the president s corrupt exercise of the powers of office accords with our constitutional system of checks and balance, and the principle that no person is above the law. What is your takeaway from that and what is Congress Going to do with that . I think absolutely congress has the obligation, the diet, and i know our committee, the Judiciary Committee as well as other oversight committees believe it is a our duty to take exactly a look at what the behaviors of the president were. What mueller said hes talking about preserving the integrity of our criminal Justice System and preserving the evidence, notice that he says that. Under the department of justice takeaway that you cant indict a sitting president , Robert Mueller want to very specifically preserve the evidence and the corresponding documentation. Notice that the president did not fully cooperate as attorney general barr tried to say by because he actually did not come in and testify, gave limited responses, including he didnt recall about 36 times in written responses, and then some of his associates destroyed documentation. Mueller very carefully said im trying to preserve the record here in terms of our criminal Justice System. So much is at stake. And now its theres a ball in the court congress. Is impeachment on the table, congresswoman . I think its not off the table. I think we are going down the process that we have laid out very, very carefully. Youve heard from chairman nadler that we will have barr buffs on may the 2nd. We have a left out to special counsel mueller that he come before us before may 23rd, so we are doing everything in our power to complete the oversight to get at a central thing, and thats the truth. Notice how disspectful this administration has been of offering the truth to the American People, whether its interfering with this investigation or coming before the press and spewing things that simply are not true. We need to get at the true. We will fulfill our obligation. We will not be dissuade by the redactions of this report. We have a subpoena out, as you know, that we get the entire report and all of its underlying documents by may the 1st. Theres so much at stake and the American People i was just at my local barbership in glenside and person after person came up to me and said, please, get at the truth. Our democracy is at stake. That the Mueller Investigation was a witch hunt and his claims that the press is out to get him could have been taken from the recordings of Richard Nixon more than 40 years ago, right down to the rough language that im blanked when he learned of the Mueller Report. And he revealed that the desire to fire special counsel an echo of the saturday night massacre and for both an investigation led to a raft of criminal charges and each president went after opponents. Since trump is still in office, do these comparisons end there. We have Nicole Hemmer with us, a president ial historian who specializes in the Nixon Administration. You say that the congress isnt abandoning trump like it did nixon, that is the beginning of the end for him, a clear end for him was republicans abandon him. You say that is the big reason why trump wont meet the same fate as nixon. Right. The parallels between trump and nixon are surprising and a little on the nose. But the difference here, having a congress that, especially republicans in congress, that just dont show any signs of wiggling when it comes to President Trump. It seems pretty likely that theyre going to stand behind him and that President Trump has a conservative Media Organization working for him. Those are things nixon would have loved to have had. Well, and exactly, because there was no fox news, there was no similar conservative media during nixons term. How big of a role is that sympathetic media playing in the trumps ability to avoid what happened to nixon. It is important because when nixon was calling watergate a witch hunt, that was reported but it wasnt repeated credulously about the media or a defense built by a conservative media, at least not one of any note. So trump has that and we could look at the polling and see that fox news viewers were about 10 points more likely to dismiss Mueller Investigation than other runofthemill republicans. And so that is a pretty significant benefit for a president to have. A big part of nixons downfall was the discovery that he been taping himself and so his decision to tape himself and verifiable proof of his voice, that was really an issue for him. Right. And we know that President Trump does not like there to be any notetaking happening anywhere around him so even just written notes are unlikely. But it was interesting reading the Mueller Report, there was kind of that same sense that you get when listening to the nixon tapes of having a fly on the wall perspective and hearing the president s reactions to things. Hearing him trying to obstruct justice by removing various players. And even though it is not the tapes, and i think that does matter, it is not his voice, it is not his words, there is something very compelling and persuasive and insightery about the report that gives it an extra oomph. And we think of don mcgahn resisting the order to make a firing. His aides seem to have gotten in the way of there being a saturday night massacre like there was for nixon. If they have not resisted and the president had been effective, what do you think would have happened . So i think that youre right, that is an important difference. And i think that people like don mcgahn learned from the Nixon Administration there is ome so far you can go in helping the president out on issues like this. I still am not sure that republicans would have broken from donald trump if he had done those kind of firings. There is just no sign that they would have abandoned him at that point and as long as the special counsels office believes that it cant do any sort of indicting, that that has to be left to congress, i think we probably would still be in the exact same place that we are now.
