Expect that tomorrows senators will be sworn in as jurors as a part of the Senate Impeachment trial. But then we expect a twoweek break. As you noted, this is really a critical period of time for both the former president Donald Trumps defense team as well as bidens legislative agenda up here on xichlt expect the democrats will continue that push to get more and more of his nominees through. Meanwhile, there is a debate within the Republican Party about whether or not it is even constitutional to be holding an impeachment trial of what is now a former president. Heres what mitt romney, a republican from you that you said this weekend. If i believe that what is being alleged and what we saw, which is incitement to insurrection is an impeachable offense. If not, what is . That the preponderance of the legal opinion is that an impeachment trial after someone left Office Constitutional . I believe thats case. I will, of course, hear what the lawyers have to say for each side. But i think its pretty clear that the effort is constitutional. Reporter and this has really been a debate between the republican for the last few weeks. Tom cotton, republican from arkansas, come out early saying he couldnt convict President Trump in part because he didnt believe it was constitutional. Expect that to continue to play out over the upcoming days and weeks. Thanks very much. Joining me now to discuss is democratic congresswoman from the virgin islands, one of the house impeachment managers who argued the case before the senate for former President Trump. Thank you for taking the time this morning. Thanks for having me. First the big question here, the talk, the hope among democrats have been for a twotrack for this trial. In other words, a trial in the afternoon, consider legislative business in the morning. Given Republican Opposition even lack of agreement on rules going forward, is the twotrack plan effective live dead . You know, i am going through the processes to the leadership, the speaker as well as leader schumer and Mitch Mcconnell and others in the senate. My focus is on preparing a case against donald trump for inciting insurrection and arguing that article of impeachment. Okay. New information has come to light since the capitol riot about the president s repeated attempts to overturn the election. The latest being the reporting of the times and wall street journal, that they fire to get a low acting lawyer of the claims of widespread Election Fraud. Do you plan to use this new information, explore this new information as a part of your case against the president . Well, im not going to give strategy or what our case is going to be. Suffice it to say that we know that the president has engaged in a prolonged effort to overturn the results of the 2020 president ial election using all means available to him. Whether its frivolous lawsuits, disinformation. Lies, false claims that he won by a landslide. Reported that the results were somehow fraudulent. All of these things go to what he did on january 6th, leading up to january 6th. And that is to drum up individuals to come to washington under false pretence, under these lies to ignite them and to set that flame in the capitol. This is all about him trying to sustain power for himself, holding on to his grip. Its exactly what the framers of our constitution anticipated when they have put in impeachment of a despot hungry for power. The last trial when the senate was under republican control, witnesses were blocked. Will you call witnesses to make your case . Well, we have a strategy and again, jim, im not going to explain exactly what we will do at this time. We are prepared for trial. We have a dynamic team of not just impeachment managers, but incredible staff, attorneys who have been working around the clock who have a case ready and i think the American People are going to be compelled by what they hear. Listen, this is the only impeachment we will have, where not only where americans, all witness to the crime. The jurors were witnesses to the crime. But the jurors, those 100 senators were also victims. There were atempted kidnapping, mayhem, assault against them as well. Im not asking you to reveal secrets from your prosecution, but this is the outlines of this trial are already being debated in public. So im curious about the time frame here. There have been discussion of a trial as short as three days. I know many of those things have to be decided by leadership. You are in effect a prosecutor here. Would three days be enough for to you make the case . Well have to see. I know its frustrating for you not to hear what our strategy s. I dont think it would be appropriate at this time to reveal that. I think the time will tell. Suffice it to say that were prepared. Were ready. I think the evidence is there. And you know what the president did is exactly what to theiment people. Stood for, for inciting an insurrection, for an individual trying to overthrow our democracy on january 6th, of all days, when members were attempting to carry out their most solemn constitutional duty. Weve all seen where both witnesses to this crime. A number of lawmakers senators, such as marco rubio who criticized the president s exhortations to the mob have been backtracking, the house leaders of the president bore responsibility now, so saying everybody does, i wonder, are you concerned this is heading towards a Party Line Vote like the first impeachment, in other words, you will not be able to convince republican senators to convict . No, i am hopeful that members will be open minded that they are going to when they raise their hand and take that oath that theyre going to view the evidence that is presented today and that theyre going to do the right thing. I cannot be moved by the machinations of politics that are going on in the interim while we are trying to put this together. I think that we will be speaking to all 100 senators. We will not be speaking to one group or the other. I am hopeful they will do whats necessary to truly unify this country. Yeah, no doubt, it has, the Biden Administration has faced criticism from some republicans for taking that unilateral action. But at the same time this is a Biden Administration showing they are going to work and focusing on some of the priorities that got President Biden elected into office. So you see the themed day every single day of the biden presidency, weekdays have had a theme. First we saw coronavirus. Then we saw the economy. Today we will see a focus on this buy American Initiative from President Biden. He will be signing an executive order for the federal government to purchase more americanmade goods. Yesterday the top economic adviser huddled with 16 senators, eight democrats, eight republicans, to try and gin up some bipartisan support for this legislation. But we are already seeing what a steep path this legislation faces at least on a bipartisan basis, several were on the call, both of them expressing concern about the high price tag that we are seeing, especially seeing Congress Passed a 900 billion piece of legislation a few weeks ago. We are seeing today President Biden taking action to replace the white house position. That was dr. Sean conley, who was in that position, he, of course, offered misleading information to reporters about President Trumps condition when he was at walter read hospital with the coronavirus. Conley essentially lied about the fact that President Trump was receiving supplemental oxygen initially. Dr. Kevin oconnor will be taking conleys place. He has been a longtime physician. Modernas data found a sixfold. The way they put it, a sixfold reduction in neutralization. And that might be okay. The vaccine might still be quite effective. It might be 70, 80, 90 effective. It might not be the full 95 we heard so much about. We need to keep that in mind. It might pose a bit of a challenge it might work well against it. Up to 78. Its not bad for a vaccine from what you told us in the past. What do we know about the severity of these new strains . When you look at scenes in the uk. British hospitals overwhelmed. Doctors describe it as a war zone. Some describe it as more deadly. How much more deadly . Is it here in the u. S. . Are we seeing results of that here in the u. S. . Thanks, jim. So if you are seeing more people getting infected, which is certainly what this variant is known for so increased transmissibility. Will you have more people that will end up sick and in the hospital. So if greater numbers statistically more people get infected, you will have more people getting at that sicker end. Listen to this, ladies, i was stunned to hear this from the cdc director Rochelle Wolinski who just came in and inherited all this heres what she said yesterday. I would say one of the biggest problems right now is i cant tell you how much vaccine we have. If i cant tell it to you, then i cant tett tell it to the governors and state health officials. If they dont know how much they can getting, this week and the week after, they cant plan. Let me just note how important that honesty and transparency is, to hear what they dont know rather than it is what it is. How refreshing. Its refreshing. Timing is so important, but refreshing. Its terrifying. I mean is the reality. Right. I think it is terrifying in some ways to hear from someone as high up as dr. Wolinski that we dont know how much we have. They have a lot to dig through. Scientists have been privy and they are feeling it is likely the uk variants in and of itself is more deadly, not because it spreads faster, there is something giving it a higher death rate. It speaks to the importance of a reasonable transition. Right . Because they wouldnt be sharing from scratch if they were going back to november 4th. There is some good news and forgive me for trying to focus on that where we can. But when you look at the number of infection, there are science. And dr. Fauci had talked about it, that it is peaking and we doesnt p didnt see the big jump, i wonder how significant you see that to be and why you think thats happening now . Yeah. Im very willing to be helpful on this monday morning, jim. I think that, you know, people are seeing the results of some of this transmission in their communities, so i think that, hopefully, it would be really nice from a hospital standpoint and infrastructure standpoint for this to start kind of going back down. This has been the largest surgery path with the most cases. Its accelerating with our numbers and death rates because its been widely acting the nation. So it would be, we looked for it in our healthcare system. Some of our hospitals are seeing a little bit of a decline at our institution, were about the same. Understood. He drafted a letter to georgia electtors that said doj were investigations voter fraud in the state and georgia officials should invalidate bidens win. Top doj officials told trump he was wrong and requested that he hold a press Conference Announcing an investigation into voter fraud, according to times. Clark then met with trump the week of january 2nd and after the meeting, he informed him trump was going to fire the acting attorney general and clark would take over. Clark denounced a plan to add rosen to the times and says the conversations with the president were above board. All my official communications were consistent with law. There was a candid discussion of options and pros and cons for the president. It is unfortunate that those who were a part of a privileged legal conversation would comment in public while also distorting any discussions. But before rosen could even react to what was unraveling, clarks demand and claims that he would soon fire rosen, tape of trumps Pressure Company on georgias secretary of state got out. So, look, all i want to do in t this, i just want to find 11,780 votes which is one more than we have. Because we won the state. Reporter trump tore into secretary of state brad raffraf raffensberger insisted georgias numbers were accurate after three recounts. You should want to have an accurate election and you are a republican. We believe we do have an accurate election. No, you dont, no, you dont, you dont have it. Not even close. You got, you are off by hundreds of thousands of votes. Reporter after the call came out, rosens deputy, Richard Donahue let several Senior Justice Department officials in on what was happening. Sources tell cnn they all agreed, including trumps own senateconfirmed appointees that if trump fired rosen they would all resign in protest. On sunday night, january 3rd at 6 00 p. M. , Jeffrey Rosen, ditched donahue and a doj official doing the president s bidding met at the white house with trump, white House CounselPat Cipollone and other lawyers. The times reports rosen and clark laid out their arguments as if they were contestants on trumps longrunning reality show the apprentice. Rosen arguing there was no fraud to investigate. Clark urging the president to move forward with his plans to fight the results and fire rosen. Pat cipollone advised the president not to fire rosen, according to times and trump was warned that several top doj officials will resign if he fired the acting ag. It took several hours, sources tell cnn, but eventually trump was swayed the resulting chaos doj wasnt worth eliminating rosen. But the damming details now emerging of a constitutional crisis averted are adding to the president s calls that the president needs to be convicted in the senate. The president was actively trying to take out his own attorney general and put an unknown bureaucrat, conspireing with him, i think were going to get more and more evidence over the next few weeks as if its not enough that he sent an angry mob down the mall to invade the capitol. Reporter Incoming Senate judiciary dick durbin says his committee is investigating trumps reported plans to fire rosen and rely on clark to further his claims of fraud. And Chuck Schumer is calling on the Inspector General to investigate more intentioned sedition. To get him to lie about the results of the election and cause chaos in america. You know, i think in a few months, we will know. Its kind of hard to see it in the fog of where we are now. We are coming out of the selection, everything thats going on, that went on, i think in a few months, we will see where this goes. Every die that goes by there are less and less people that would consider themselves republicans. In six months, i think it will not necessarily be the party of donald trump. This whole point is i do think we are in a battle, it may be a battle that needs to happen for our party to say, where does it stand now . As much as anything, are reaspirational or party that feeds on fear and division . A big test of that will come on a vote on liz cheneys position in the republican leadership. You got into a republican spat with ohio congressman Warren Davidson lauren davidson. You sea happy to discuss and vote on everyones role in this and from the top down. Liz didnt attack the capitol and need not defend herself. Those like you who sold a lie do. On that point just to be clear, are you accusing davidson and others that bought into that big lie the election was stolen. Did they bear direct responsible for helping to incite that insurrection . Well, look the only ones that bear did it. They bear responsibility for the narrative. Thats the key. We have to as a party come to real terms with what was our role . So for four years and especially in the last year, we heard qanontype conspiracy theories. I did a video of qanon to expose it. I got to stay away from that. But we play a role in that. When you sit around and accept the idea that the election was stolen because, a, its going to bees year to tell people that thats the case, so i dont have to have that uncomfortable conversation. B, maybe it will try to keep some out of that energy we need to get 51 . You bear responsibility especially if you spread that. We will learning just now matt gaetz, he will go to wyoming and campaign against her. You and he, were getting into it on twitter as well. I wonder, does liz cheney have the ropes to remain in leadership . Or is her leadership in danger, in your view . Well, i think she does. I think shell survive. Maybe ten of us voted to impeach. I think there were well over a majority of republicans that in a secret ballot would have voted for it. Heres the bottom line question. Liz cheney showed a vote of conscience. Right. There is nobody that took the vote to impeach that was easy for. Around are we really going to punish somebody for getting somewhat out of whatever you think the Donald Trump Party is today . Yeah. Listen. Ive talked to fellow republicans who told me directly they voted because they voted against impeachment because they would lose their primaries. Ill say it right out. Ill sx mccarthy, he says the president took grief for it and is responsible. Now he says everybody is responsible and is changing his tune. Does mccarthy belong in gop leadership . I think if were going to open up this can of who belongs in leadership and have the debate that some in the freedom club want to have. I think its only fair to have the conversation from the top down, to have a discussion of what is the leadership of this party and if you are a leader of the Republican Party right now, you need to be focused on one thing. Not winning another election. Thats not what we should be focused on right now. We should be focused on restoring the integrity of this party. I get it. Democrats dont have integrity. Our job is to take care of ourselves to lead the people the best we can. We have sat here pointing side at each other saying were not as bad as them and nuggets done. We need cool, calm, steady leadership to get through this crisis. If the Party Remains trumps party, in effect, throws its lot in with him again, make that calculation, they cant win these house districts beyond with donald trump, do you say in the party or do you say enough, im out . I dont know. And i think thats why the party fell, sounds corner, but when i was a kid, i loved the ideas of the Republican Party, i feel like weve lost a lot of that now. Thats why im going to fight like hell to bring it back to the party that i believe in. And, you know that a kid born in the inner city should have the same opportunity as a kid born in highland park. Thats what conservatism is. Not all this other anger and division. We stay an angry, divisive party, the party is one of change more than the partys values. Adam kinzinger. We do have breaking news, the Supreme Court will not hear a case concerning whether former President Trump violated provisions of the constitution that bar a president from receiving a benefit or an em emollument. It appears they are doing this because hes no longer in office. Thats exactly right. They consider this indicate moot. Really, poppy, this is yet another example of the Supreme Court transmitting this desire to stay out of these political disputes. They did not act on this case when trump was still president. Now a few days after the president , former President Trump has vacated his office, the Supreme Court saying we do not want to weigh into this. Remember this was a big issue, particularly at the beginning of President Trumps presidency. Because he had the Trump International hotel and other businesses throughout the country and eastern the world, the question was, did President Trump violate the emolluments clause by money coming into these businesses that he had and the hotel that he owned . Because a lot of the money coming in, was coming from former governments. The clause says, you cannot accept this money from foreign governments as a head of the united states, as president of the united states. Whats interesting here is that lower courts let these cases forward. They allowed 78 subpoenas for the money coming into the Trump International hotel, for example. Poppy, what this decision does from the Supreme Court, it not only says we are not going to hear this case because it no longer matters, because trump is no longer president. But it also wipes away those 38 subpoenas that the lower court had approved so this information that was potentially going to come out about how much money these trump businesses were taking in from foreign governments. But how do you catch people in the military if they harbor these views just to themselves and engage in activity at last minute. So there is a real effort to see what the screening procedures are when they come into the military, find a way to catch if there are illegal behaviors and try and tighten up on the screening. Do they have a problem . A lot of people will tell you that absolutely, yes, they do, and they do have people in the military that get booted out as soon as these behaviors are found and verified. Is there a vast network . No indication of that at this point. But after what happened on capitol hill, this is a situation where congress and the pentagon are in agreement, they have to do more, what that is we dont yet know.
