Best efforts to downplay it. We cannot, as a country, escape the simple math here. The facts are nearly 500,000 new cases were reported the past week. The nation is now averaging more than 70,000 new cases per day, 37 states look at that nap how many are red and orange seeing a surge. In the month of october, more than half of all states have reported their highest, that is record single day new infections so far in this pandemic. Lets begin with news, however, from Supreme Court because there is big news. The high court has decided a major decision with significant ramifications for this election, seven days away. Tell us what it is and what it means. Reporter right. Just before Amy Coney Barrett was sworn in last night, the Supreme Court issued an order and it rejected the democrats request to extend ballot deadlines in wisconsin. Wisconsin is that battleground state. The court divided 53. The conservatives basically say the federal court here was wrong to step in and change the state rules. They said that they shouldnt have done so and that the state rule that had the deadline on election day should stand. But Justice Elena kagan wrote a biting dissent saying the reason the federal court stepped in is because of covid and she worried voters do be disenfranchised. A similar case in pennsylvania, the ballot extension was allowed. He explained the difference sayings the wisconsin had to do with a federal Court Stepping in and thought that was improper for the federal court to strike down the state rules. But the pennsylvania case had to do with the pennsylvania Supreme Court decision. He said there that was okay because it was the states highest court in the land that was interpreting its own law. He made that distinction last night, poppy. I think that the words from justice cav a gnaw are really telling and i wonder if you can explain the significance of them particularly this line, quote, and those states also want to be able to definitively announce the results of the election on Election Night or as soon as possible thereafter. Reporter right. A lot of justices wrote separately last night in this order and cavkavanaugh did so. He seems to buy into the argument if there are late ballots it could cause chaos. He said some of the states like to count on Election Night but we know not all of the states do all of the counting on Election Night. What is interesting about what he said, he said particularly those states want to avoid the chaos and suspicions of impropriety that with ensue thousands of absentee ballots flow in after the election day and potentially flip the results of the election. That sounds similar to arguments that trump and the republicans have been making going into this election. So that is interesting. Illegally, if they are cast validly, they are not flipping the results of the election because the Election Results arent known yet. What is the legal explanation for that . Reporter youre echoing what a lot of progressives are saying this morning waking up and reading kavanaughs opinion. Keep that in mind lots of states do things different ways. Election has election day deadline but other states have allowed an extension. So what he was saying there really bothered and concerned progressives for the fact that he was suggesting anything that was sent in or counted after election day would be somehow would cause chaos. That is what is causing controversy this morning. Thank you, ariane. Lets turn back to the campaign trail and begin with our White House Correspondent john harwood. Good morning, john. The family of the president is out on the trial and the first lady out campaigning, i think for the first time by herself today. Reporter thats right. The Trump Campaign, including the first lady, as well as Vice President pence and the president are playing scramble defense today. Yesterday, the president was in pennsylvania, must withwin sta. Melania trump is there today. Her husband goes to the other states in the midwest. President needs one of these. Hes in Michigan First and then wisconsin and then to nebraska to omaha where there ais a Congressional District awarded separately from the statewide vote. The president won it four years ago and he is behind there. If all of the places he is traveling he is behind. Vice president pence is going to carolinas. North carolina is another place they are playing defense and trying to hold on to it. Bidin has a very narrow lead. South carolina is probably more about the senate race where Lindsey Graham is facing a tough time. If you look at the averages, president has to find a place to take back electoral votes he won in 2016 from joe biden. John harwood, thanks. Lets go to mj lee with more on bidens strategy this week. Georgia on the list . Reporter thats right. It tells you so much that joe biden is kicking off the final full week of campaigning in the state of georgia. This is a state that a democratic president ial candidate has not won since the 1990s. This was bill clinton in 1992. Recent polls have showed a competitive race in that state and widen has a shot of winning that state and you look at the map and you see how fanned out the Biden Campaign is today. You mentioned Kamala Harris is campaigning in nevada. Former president barack obama, who is one of joe bidens highest profile surrogates is campaigning in florida. You look at the rest of the week in store for biden you get a good sense of the frame of mind for the Biden Campaign right now. Biden, himself, is returning to florida on thursday and then on friday, this is very interesting. He is going to iowa and wisconsin in what he told reporters yesterday is that he feels good about winning the states of pennsylvania, michigan, and wisconsin. These are three states, remember, guys, that made all of the difference in the midwest for President Trump, so biden is saying he feels good about those states and that as far as states like iowa and georgia are concerned he feels like he has a fighting chance. Its so interesting and we are glad youre on the trail. The georgia move fascinates me so lets talk more about this. Our White House Correspondent is here a here. Margaret, good morning. Biden is in georgia making a closing case in a state that has not gone blue since 92. The Washington Post calls it gamble. Is it . There is not very much downside for biden in doing this. The payoff could be really big. Look at what has been happening in georgia. You know, President Trump won georgia in 2016, but by a considerably smaller margin than george h. W. Bush. The state is just changing the demographics are absolutely changing and we are having really big early turnout turns. Two senate races, two because of the special election on the ballot. So from bidens perspective, it matters not just for the electoral map, 16 electoral votes is really important, obviously. But to try to get the numbers up in the senate, if democrats are able to take control of the senate and he were to win the presidency, it gives him a lot more Maneuvering Room and if they were to add one or potentially even two more it would make a really big difference. Its also meant to send a national signal about turnout to voters of color in several other key states. Anita, forgive me for many skeptical but i remember in 2016 the final couple of weeks of the race we saw the Clinton Campaign talking about texas. They felt really strong and, therefore, did not focus on what ended up being the key swing states which they lost in the rust belt. I wonder if you see any cautionary tale there from recently political history . Democrats will tell thaw 2yo 2020 is different this 2016. Democrats are worried that biden and harris are not spending enough time in those states. They say you got to be in these states. Exactly what Hillary Clinton didnt do. Look back in the last few months. Joe biden has not been campaigning in person nearly as much as Hillary Clinton did because of coronavirus. Everywhere he goes every single place that kamala place goes tells a story because they are going to so few places so there is a cautionary tale and concerns about that. If you look where President Trump is going he is really focused hard on the states that he has won. He is focusing on those three states we just mentioned. And not very many other places. He is looking at New Hampshire he just went to and minnesota and nevada three states he thinks he can flip but mostly focused on the map he had in 2016. A family friend said to me last night, wow, the Amy Coney Barrett nomination sailed through. I dont feel like there was a whole lot of hub bub around that. A huge deal it happened in eight days before the election. I wonder what you think that does in terms of motivating one side or the other more in this final push . Its been one of the big questions. President trump was hoping that it would put coronavirus off to the side a little bit but that does not seem to have happened. We know coronavirus is still overwhelming the main issue driving voting. But, look. A couple of things to watch for and one is lastminute emergency election petitions. The court spared her having to go on the board last night with that one. They had the mantle withojority her but other petitions, we imagine. Number two is the Affordable Care act. Within a mapts tter of days shel be involved in what is probably a crucial decision for the Affordable Care act. It may be that Health Care Issue that is driving many on the democratic side or at least many voters who are motivated by health care. I think its also certainly in terms of the way any election cases are dealt with by the Supreme Court very well impact the debate ahead with the next senate is if democrats take control about whether to try to change the makeup of the court. Anita, i find it somewhat incredible that this needs to be asked, but Amy Coney Barrett, will she recuse herself from electionrelated decisions in this court, given she was confirmed a week to the election by a president who might sit to benefit from those decisions . Or is that just the reality we will deal with next week . I think its probably the reality. People have been asking that same question and all indications are that she would go ahead and, you know, could be involved in some of those cases. Now, you know, anything she didnt hear the oral arguments on she wouldnt be involved in but some of these cases you mentioned are the lastminute issues have been coming up so we do seem to think that she is going to be involved in any of those cases that are coming up right now. Twelve states are steady, the numbers are not going anywhere. Only one state going in the right direction and that is washington. Not great to go into the winter with these numbers. Take a look at another chart. Look to the far right of this chart, youll see the case numbers are going up and have hit an alltime high, highest numbers, daily numbers since the pandemic began. Credit to you for sending mixed messages when reality is some of them are flatout false, right . You have the president questioning the other day on fake science that masks make a difference. I just wonder, given you have seen people suffer and die from this, what do you say to people, including the president , and members of this administration who still say to this day the virus isnt so bad and there is nothing we can do about it . I know that sometimes the truth is painful, but i think the data, the facts, the science bear out the truth and i think all Public Health officials have been echoing the same chorus and we all need to be on that same page that the masks work, that this virus, we know little about it, and so as we learn more, you know, we can say more, but for now, it is something that we have to Pay Attention to, that we need to protect ourselves from. The goal is not to get infected. We dont even know what the longterm effects are. So here you are yesterday at the podium. Youre doing what we see Health Officials have to do every day and announce the toll of this and maybe we could show that on the screen again. Moved to tears, as i imagine. My sister is a doctor and she has been moved to tears when she is told some of these stories. Tell us what was going through your mind at this moment. Yeah. I felt like i didnt know that was coming. In retrospect, you know, trying to put it together because i havent had that kind of a public display and ive been doing this now since the beginning in january for illinois. But im surmising that it was a culmination of the pain and the fatigue, as well as the frustration, and the anxiety that, you know, history was repeating ourselves in this state and what we went through the first time was so traumatic to the entire state and just thinking about repeating that and the frustration of people not quite getting it because the fact there are things we could do that could make history not repeat ourselves. There are. You know, you have the experts talking now, dr. Fauci among them, about a long dark winter here. Figuratively but also literally in a place like chicago where it gets cold in the winter, people are going to be inside and indoors more. What is the way out . How can people watching now make a difference and maybe find some hope as we face these coming weeks and months . E. What ive been trying to share you know when we have record numbers cases. We announced 6,000 cases in a single day. We know those people that are affected, some of them will go to be hospitalized and some, unfortunately, to succumb to this disease despite the valiant effort of health care workers. Tomorrow, the infections have not been determined, so we have a role today to take precautions so much fewer number of people get infected tomorrow. So the day after, there are fewer hospitalizations and fewer deaths. Yeah. The future is not mixed. In a weeks time, we are going to have either a reelected President Donald Trump or a new president , president elect in the former Vice President joe biden. If you had ten minutes with one or the other after election day, what advice would you give them to help steer the country forward through this . I think it would start with the clear message from the top down to explain what we know about this virus, what mitigation strategies we know work. I think just level setting there is an important first step and then building out a National Testing strategy, a National Mitigation strabltegy so we are all on the same page instead of going through different waves at different periods. Reporter there are a lot of Unanswered Questions and police and the mayor say there will be an investigation. The Police Commissioner says that i heard and felt the anger of the community and that was clearly on display last night when we saw these protests erupt overnight. About 30 officers were injured including one who was struck by a truck and who broke her leg and about ten were arrested as these protests broke out. We saw some businesses that were looted across the city. This investigation will still continue. The mayor called this a tragic incidents and says he has been in touch with the Wallace Family. The Police Commissioner says she would like to be in touch with Community Members and the Wallace Family when there is time but, obviously, tensions are running high here in philadelphia. We have breaking news. A federal judge just denied the justice departments effort to intervene in that defamation lawsuit brought against a magazine columnist. It paves the way for this case to go forward. We are joined now from our correspondent in new york. This is unusual asking the department of judge to intervene in this case. What happens next . The judge decided that the department of justice here, which was in essence trying to come in and step in for the president , and take responsibility for this lawsuit because they were arguing that when the president made comments denying that he sexually assaulted jean carroll, he sued. He came in and basically claimed the president at the time these were false allegations he never sexually assaulted her. She in turn sued him in new york for defamation. When the state court decided that the president could be sued because he argued he cant be sued because he is the sitting procedure, the court said no, that is not right and we will proceed with this case. They filed to take charge of this case and now this federal judge in manhattan denying that, saying the department of judge cannot intervene in this lawsuit. The next step, obviously, is that this is going to have to wind its way throuits way throu courts so here a loss for the president and the department of justice. Thank you for that. What did you go through . Well, at the beginning of the quarantine, i was sick for a little while. And then i got better for about five days and then i went down again and it was a lot worse the second time. The second time i had a lot of chest pain, it felt like it was hard to breathe and a lot of back pain and i was extremely tired all the time and i was very light headed. I was nauseous and didnt want to eat. This was going on for weeks. She was bed ridden for a couple of months after her initial infection. When we thought she got better, all of a sudden she started to get worse again. Goodness, that is difficult, no fun for mother or daughter as you go through that. You went through Great Lengths to find out what was happening here, amy, and there was a lot of resistance from doctors. Some were saying it was psychological. I wonder how frustrating that must have been for you, but how did you get to the point where you said this is what it is . I had to be okay with the fact that this was a novel coronavirus, maggies pediatrician from the beginning with on her team, never doubted what she was reporting, but telling us give it another week, two weeks. And after a couple months, they were like okay time to see specialists. The specialists were saying we dont see anything on her ekg, so shes fine. Shes healthy. And i knew she wasnt. So it was frustrating but at the same time i knew there was no way for these specialists to understand what long covid was when we were all figuring it out at the same time. Amy, our viewers are looking at these pictures of you and forgive my surprise. I hadnt seen them before. Theres some of you hear recovering, doing your school work but also with ivs in, at the hospital. What do you want to say to anyone who says, look, children dont get covid, even the president said children are almost immune, you prove otherwise. A lot of kids arent going to be very sick. But it could be very bad. So you need to think about it that you are going to be very bad so youre careful enough that you dont get it and risk being sick for this long. I think thats the point, you dont want your kids to get covid because you dont want them to get covid. Its not just asymptomatic spreaders, its bad in itself. Both poppy and i have kids as well. You can get lulled into a false sense of security almost naturally. Im curious what doctors are saying now to you, maggie . How long do they expect you have to go through this . A lot of them are saying that they think im going to be Getting Better soon but they arent sure either, just because this is a new thing. So theyre kind of learning about it with us. And theyre asking us and stuff, too. Theyre looking at people who had sars and things like that. People who had sars had Chronic Fatigue syndrome afterwards and are still not better. Theres a possibility this is going to take years and a possibility that the improvement that weve seen in recent weeks is going to continue to happen and shell continue to get better. Maggie, any final thoughts you want to share with people around your age who might be watching, might be going through covid, might have family members who have gone through it . If you are going through it, at a certain point it feels like you arent going to get better and kind of lost hope that i was going to get better. But ive gotten better and im almost completely done with it. So just keep pushing through it and its going to be okay. Well, guys, we wish you the best. I know youre going to get through.
