Lets begin though with covid19 and my colleague rosa flores who joins us in florida. There is a new key model out that is projecting that its florida that could be the next coronavirus epicenter. Reporter you know, poppy. Its very alarming. This new model is from the university of pennsylvania and in essence it says that florida has all the ingredients for a covid19 disaster, and all you really have to do is look at the numbers. You now talked about this last week. We were talking about 1,000 cases a day. Now its more than 2,000 cases a day, and the latest daily count was 2,600 in one day alone with a doubledigit positive percentage. Thats very alarming. Now, we went to Governor Ron Desantis to ask about this, and his office says this is all due to aggressive testing because they are testing more in communities where there are outbreaks, like prisons, longterm care facilities and also agricultural facilities, but we went to the experts, an expert at fiu telling us that that is not the case, that there is an actual rise in cases in the state of florida. Now im in the epicenter of the covid19 crisis in the state of florida, and thats in miamidade county. The mayor here acknowledging yesterday that there is an uptick in cases and an uptick in hospitalizations as well. Rosa flores, thank you. We have significant breaking news out of the Supreme Court. A decision has been handed down on dreamers, on daca. Lets go to the Supreme Court. Reporter the socalled dreamers anxiously waiting for this decision since november. When the opinion came down we heard a cheer from some of the dreamers who have gathered here outside the Supreme Court steps. Because of the coronavirus the Supreme Court has actually set down so everything were getting is via computer. Ive had a little trouble loading this opinion. Were going through the opinion right now to determine exactly what this opinion says, but, again, more than 700,000 Daca Recipients, they are just waiting in limbo right now to find out if the daca program will remain in place. A little bit of background for you. This was a program that was set into effect by president obama back in 2012. It protected those children who were brought here as children to the United States by their parents. It allowed them to get work permits. They were renewable every two years, and it really granted some temporary status to those people here who told me when i interviewed them back in november when they were listening to these arguments at the Supreme Court, they say that the United States is really the only home that they have ever known. They cant even imagine going back to their home country, so they are waiting anxiously to find out if this program will be rolled back as the Trump Administration tried to do in 2017 or if in fact the program will remain in place. It was when President Trump took office in 2017 that he wanted to roll back this program, and there were issues with the way the administration did it. There were numerous memos, numerous policy decisions that came out specifying how they would roll backnd the question was did the Trump Administration actually roll this program back protecting the socalled dreamers in the right way . That was the question before the court, saw know were waiting to read through this opinion to decide what exactly this opinion says. Well get back with you in just a moment as we wait to see. Jessica, we really appreciate that. This is huge. Its huge, and we will bring the decision to everyone as soon as jess has it. Jeffrey toobin to you. Lets talk about here the plaintiffs in this case said, look, the way that the administration rescinded this, rescinded what the Obama Administration had done was capricious and arbitrary, and it violated the equal protection clause because it was motivated by discriminatory animus, and that is the decision on the process of how this was done that the court has to or has decided on. Well almost, poppy. What happened was the Supreme Court said that the administration, the Trump Administration, not that they violated the constitution, but they violated something called the administrative procedures act, in other words, they did not follow the appropriate procedure for undoing daca. Now, what this does essentially is kick the can down the road. I mean, i should say actually much more importantly for the time being it leaves the 700,000 dreamers safe in the United States. Thats the most important aspect of this ruling for the time being. However, what it does is it gives the Trump Administration a road map for how to do this properly if they want to pursue it, and if, of course, the president is reelected because these sorts of things take time, but for the moment the dreamers are safe. They are not going to be exposed to deportation as a result of todays decision. However, this is not a resolution of the matter once and for all. This base cically says to the tp administration, if you want to end daca, if you want to put these 700,000 people out of the country, you have to follow the procedures appropriately which you did not do when you did this in the first place. Jeffrey toobin, as this case was being brought and being heard, you had the government. You had the Trump Administration being joined with the support of nine states who essentially said, you know, were continuing to incur financial harm by having to pay for health services, et cetera. You had an amicus brief written by 143 different major u. S. Kworpratio kwo corporations, including apple, jeffrey, that said in the court that said here is why we believe dreamers should be protected. Well, you know, its important to remember who the dreamers are. Yes. Theres been so much news that its hard to keep track, but what it means what daca is all about is about children who were brought to this country illegally at some point in their childhood, you know, many of them as babies. Jeffrey, sorry to tint rupt. Well go right back to the high court. Jessica schneider has read there you this and has the decision. Jess . Reporter poppy, the Supreme Court has blocked the Trump Administrations efforts and their plan to roll back daca. That means that daca will remain in place for now. The Supreme Court, im going over this opinion now, it decided that the recision of daca must be erased. That the was something that the the Trump Administration tried to do, resend daca, the Supreme Court saying the Trump Administration cannot do that saying that the department of Homeland Security was arbitrary and capricious in its decision to roll back this program. Now, this was argued over because the department of Homeland Security initially issued a memo grounding this recision on legal grounds rather than policy grounds. It was a later memo where then secretary Kirstjen Nielsen said it was based on policy, but the Supreme Court saying here that the department of Homeland Security did not roll this back in the right way, and, therefore, daca must stand. This is no doubt a huge relief for those 700,000plus Daca Recipients. We have some of them outside the Supreme Court now, a very small number as opposed to how many were here back in november when this was argued. I spoke with some of the Daca Recipients back in november, and they told me that this was crucial, keeping daca in place was crucial because she was fendant on it. One woman had two young chirp here in the United States, was brought here when she was 14 years old. Lives and works on long island, has renewed her daca status every two years and feels like shes an american. This was a program put in place by president obama in 2012. So were looking at eight years of Daca Recipients relying on this program. Were still looking into the exact vote count here. I still have to go through that, but we do know that at oral argument chief justice john roberts, he said that while the Trump Administration may have been able to do this, perhaps it if it was done in the right way there, also needed to be some humanitarian concerns here because these people, these Daca Recipients have relied on this program for the past eight years. They have set up their life here. They work here. They pay taxes. They have had children here, so to all of a sudden roll this back really seems like an inhumane injustice and that was something that it seemed at the time of oral arguments in november that chief Justice Roberts was trying to balance to really look to that humanitarian response that we got, you know. I spoke with some of those dreamers. They marched here to the steps of the Supreme Court from new york city. They marched for days in oftentimes bad weather. It was raining actually the morning of oral arguments here. They were committed to this. They were passionate about this, and today the Supreme Court handing them a win saying that the Trump Administration, as it was done, cannot in fact roll back the daca program established by president obama. Poppy. Jessica, thank you. Jeffrey toobin, back to you for reaction. Well, you know, this is another example im just looking at the vote split, and it is complicated, but in the core of this decision chief Justice Roberts is joined by the four democratic appointees, ginsberg, briere, sotomayor and kagan. Just like last week about firing people because they were gay or trbz gender, thats where the chief justice joined the liberals. The other four more conservative justices joined part of this opinion but not all of it. I think, again, to sort of focus on the big picture here, this is a tremendous relief to the 700,000 people, most of home never knew any country except the United States. I mean, if you are brought to this country when youre a baby from mexico or honduras or some country, you know, some country where there are a lot of immigrants from and youve lived here every since, the idea of being deported is a particular nightmare since youve never lived and dont know that country, so thats who the dreamers are. As far as the substance of the decision, you know, this is, and i dont want to speak i mean, this is a delay. It is not a deliverance. Yes. This is yet another example of the stakes of the election in november because if with this road map and if the president is reelected, he now can do daca. He now can overturn daca if he wants to. Yeah. If he gets reelected. Its a very good point, jeffrey, and as you point to the last part of the opinion here by the chief justice, quote, we dont decide whether daca are sound policies. The wisdom of those decisions is not our concern. We have David Leopold, lauren bear ron lopez and dana bash on the politics of all of it. If i could get to you, david, on jeffreys point that this is not full protection of dreamers indefinitely. This is right. What we need is a legislative decision. That is what is going to protect the dreamers, and whats interesting here when we talk about legislative solutions, overwhelmingly americans, even trump voters, by the way, support dreamers and support a legislative solution, so its time for congress to get to it, and hopefully in the next administration, hopefully well have a situation where new legislation can be enacted and signed by a president , but i will say, you know, what you need to know, taking back and stepping back from this case this was always, this decision was always simple on the law. It was about choice. It was about what we call discretion. What was complicated here and what was nefarious was the ugly politics that surrounded it, and ive got to tell you, i think Justice Roberts leading this opinion reminds me of what Justice Robert jackson said years ago in 1947 about applying practical wisdom to the context of a decision. Clearly here the administration as its done in so many other cases and as we know, as we see from john boltons book yesterday in some policy decisions, has failed to follow the law, and thats what the Supreme Court said today. You know what, Trump Administration. You didnt follow the law when you tried to pull daca exposing nearly a million dreamers to deportation, and the Supreme Court stopped it, and thats what this country is about. Thats what the rule of law is about, and, unfortunately, we dont have a president or an administration that tends to respect the rule of law. Luckily this court did the right thing today and protected dreamers and protected some amazing, amazing aspiring americans. To that point, david, lauren, let me bring you in on this. I would like to remind people who dreamers are because the president , you know, youll remember before these arguments began in this case talked about dreamers and said that many are, quote, far from angels. Some are very tough hardened criminals. In fact the rules prohibit that to even be the case. It prohibits anyone who has a felony or misdemeanor offense to even enter into the daca program. Thats right, poppy. So many dreamers are as mentioned earlier are people whole were brought here as children. They live in the vast majority of their lives and they know no other home essentially. They are very much and feel american, as though they are americans without the legal status, and also to remind our viewers is that, yes, there are 700,000 dreamers, and a lot of them are in the u. S. Workforce. They pay taxes. And these dreamers are now on the front lines battling the coronavirus. They are health care workers. So i think its also important to remember that electorally they have a majority support amongst American Voters, and thats not just democrats or independents but a recent poll found that some 68 of republicans think that dreamers should have protections, so moving forward if donald trump if President Trump repeats the promise he made in 2016 which was to pull back daca, if he does that again heading towards november. It could potentially hurt him with republicans as well. I saw that poll this morning and found it fascinating the support amongst republicans right now, and when you talk about the economic impact, the kato institute, said if you deport all these dreamers the Economic Cost to america would be in excess of 6. 3 billion to replace them in the workforce. Dana bash, lets step back and take a look at this moment. This is a big loss for the Trump Administration, losing so hard on that they pushed for and comes on the same day that we get the exclusive bombshells from his book, the National Security adviser saying hes nod fit to lead the country. Theres so much here at this point that the administration is fighting back against, not to mention the pandemic, the covid pandemic getting worse. Absolutely. This is just one other very, very important data point in everything that you just said. Its also interesting that this is coming almost five years to the day that the president then private citizen donald trump rode down that escalator and put himself on the map by talking about immigration in a very vitrioloic way, and it made his fellow republicans cringe, and not only did he become the republican nominee but he became president of the United States. That was a big one. He was tapping into something that is unfortunate in that country, but it is very real, fear of the other. Daca is at least has been in recent history set apart from the really intense debate about illegal immigration because you are talking about children who came here through no fault of their own, but it has been wrapped up in that, and it has been used as a bargaining chip because there is broad support for fixing this legislatively, used as a bargaining chip for the broader immigration reforms that both sides want to do, and thats why we are where we are, so just going back to what David Leopold said, that is really an important thing to think about right now. Were only where we are, for the administration in the obama years did this by executive order. The Trump Administration rolled it back the same way. Were only there because congress hasnt been able to get its act together because it has been so divisive on this issue. Thats going to be front and center again in the president ial election, never mind the elections for the United States senate and house. Yeah. Joan is with us. Just to remind how this was brought about, brought about by the head of the university of california, janet napolitano, backs when daca was initiated pack in 2012. You wrote a whole book on chief justice, so i just want your your download on reading this opinion from him and the significance of it coming from him and his state of mind. Its so beneficiaries and for the Supreme Court. Once again john roberts, generally a conservative chief justice, has swung over to the side of the four liberals on a very important case testing essentially, you know, the court versus a presidency here. It was an Obama Era Program that donald trump had tried to roll back, a very politically charged case, and john roberts decided that the administration did not do it the right way, and poppy, it certainly recalls his vote in 2012 in obamacare and his vote last year when he blocked the Trump Administration from putting the census the Citizenship Question on the 2020 census. At that time he said that the reasons the administration gave were flawed and thats exactly what he said here for a very important ruling. Joan, big picture. I just want to stick on the chief justice at the moment. Sure. Theres this and then obviously the key role in his decision on obamacare, and then we have a major Abortion Case that is still to be decided that he will also play a very key role in given his history of votes on abortion issues. How significant . What i think is you can pair this one with the obamacare one and the census one. I do not think that this decision gives us any hint or guidance Going Forward on more social policy sort of decisions. Okay. When he flips over, it tends to be in these big politically charged separation of powers, who is in charge here kind of questions, and thats where the pattern is. They tend to be more political and more having to do with the office of the presidency. Thats a very, very good point. Dont read any more into this. Yeah. If i could go back to you, Jeffrey Toobin, for your thoughts. You know, its worth what struck me is not just the Obamacare Decision but, remember, john roberts voted with neil gorsuch and the liberals on the discrimination against gay people case last week. Yeah. You know, i think john roberts, who is definitely a conservative, is also a very good politician, and i mean that in a respectful sense because i think all great Supreme Court justices are good politicians. I think at some level john roberts recognized that in the United States in 2020 you simply did not fire people because they are gay. Thats just something intolerable to the vast majority of americans. In the same sense, he recognized that deporting 700,000 young people who did nothing wrong, who had no by no definition are not criminals because you cant be in the daca program if youve been convicted of a crime, to deport these people who have lived their entire lives with small exceptions as americans is simply intolerable, and i think, you know, Sandra Day Oconnor was another justice who had her finger on the pulse of what americans will tolerate and john roberts as he mature, its now opinion is a years as chief justice of the United States, is recognizing that the Supreme Court cant be too far out of step with the vast majority of the american people. Thats an interesting point, jeffrey, you know, if you compare it, for example, Justice Kennedy when it came to gay marriage, right . Thats right, and, you know, the Supreme Court was somewhat ahead of Public Opinion on marriage, but Public Opinion has come around on that issue. You know, the discrimination issue is in many respects an easier issue for the Supreme Court than marriage was because marriage is all tied up with religion and peoples personal lives. You know, employment is about, you know, how people make a living, and the idea that you could fire someone, and this was true in more than half of the states until last week. You could fire people simply because they were gay or transgender. That was intolerable. It is intolerble, and now its no longer true, and i think chief Justice Roberts recognized that thats where the United States is today, and i think todays decision, though its phrased in the details of the administration, the administrative procedures act, also reflects where the United States is today. Were going to go to the white house in a moment for john harwood to get reaction there, but, john, hold that thought for just one second before we do. Joan, i just had a followup on what jeffrey just said because so much has been made to the president and his two justices that hes gotten on the court, but two huge rules this week that jeffrey went through. Of course, last week the ruling on gender rights and now daca. Yeah. I think you have to look at them individually. Weve made distinction between the gay marriage ruling that john roberts dissented from very vigorously, but on monday he signed on to what neil gorsuch had written. Neil gorsuch didnt sign this opinion today in terms of the broader ruling benefiting Daca Recipients and neither did brett kavanaugh. What well see is case by case is trump appointees at times will swing over to the left as neil gorsuch did on monday for the gay and transgender case but overall they will be firmly on the right wing and ditto with john roberts, although john roberts in the conservative majority is more likely to inch over to the left, because of ice ideology and because of his role as chief justice trying to steady the court in a very polarized time in america. As you wrote so well in the book on him, this is someone who has been focused in recent years on making sure that this court does not appear political. That keeps him up at night. Thats right, and hes so aware of the fact that hes now dealing with these two trump appointees. Hes dealing with an administration that has pushed some very, very hard line positions. This is a loss for the administration today. The monday case was also a loss for the Trump Administration, and just think of what we have coming down over the next three weeks. Yeah. The subpoena cases with donald trump, abortion as you had mentioned earlier, poppy. We have several rulings that john roberts will be walking a fine line, and i expect that this term overall will have a lot of surprises, but they are not going to be predictable because well see a lot of Movement Among key conservatives, john roberts included. Youre right. We still have many key decisions, the louisiana Abortion Cases, two cases having to do with the president s finances and tax returns and can the american public, the house and new york prosecutors see them. That is still waiting to become public. Let me let me get to David Leopold for a point that you have on what has been decided here because the key line here is they write the dispute before the court is not whether the dhs may rescind daca. All parties agree that it may. The dispute is primarily about the procedure that they followed in doing so. Right. David . Right, and, poppy, theres another quote for the reasons that follow we conclude that the acting secretary did violate the apa and the recision must be vacated. Remember, what happened here is when it was vacated, when this pulling of daca went in a effect of september of 2017 when then attorney general jeff session announced it, that stopped applications. The court stopped daca applications and what they did is put an injunction on most of that. While the courts did rule one court did at least rule that new applicants for daca could apply. That was stayed. That was stopped, and its been stopped pending the Supreme Court, so, again, im going to say this with the caveat of i would like to be able to read this opinion thoroughly and carefully, but it seems to me at first blush in this opinion that new applicants for daca they may be able to apply. Just to be clear. Do we know or they may or they can . I think looking at this opinion they can. Okay. Because what they did is they vacated the decision. They vacated the decision by the administration or the procedure that the administration used. They said that was unlawful. They have then they take the situation back to the day that daca was rescinded which tells me that new applicants should be able to apply for daca now. Okay. Jeffrey toobin, i want your take in that. I do want to get to john harwood at the white house. We know what the president has said about Daca Recipients in the past. Has he said anything about this decision by the high court . Reporter ive not seen it before stepping in front of the camera. He had not tweeted on this subject up to a couple of minutes ago, but i do want to build on a point, poppy, that Jeffrey Toobin made a moment ago, which is that ultimately the Supreme Court cannot completely ignore political reality in the country and preserve its legitimacy, so the court is going to accommodate itself to overwhelming political reality of the country. What weve seen in the last few weeks is the court is not the only institution that has done that. We saw the u. S. Military separate itself from the president of the United States on the response to the floyd protest to presever its legitimacy, its proper role in civilian military relations. To a lesser extent we have seen elements of the Public Health Community Stand up to the president on his response to coronavirus. Anthony fauci has been obscured because the Coronavirus Task force has been shunted aside, but he has stood up and said im concerned about these things. You even had had the Surgeon General the other day encouraging people to wear masks which is something the president and the Vice President havent done. These institutions all have their own equities and interests in upholding the values of their institutions, and i think the the court is one of those, but its not the only one. Jeffrey toobin, how do you read this . The point David Leopold made, he thinks that this now opens the door for new applicants to the daca program. Is that how you read it . Poppy, ive got to say i cant express that opinion at this point. Okay. That is a very important question. It is a technical question relating to existing law and this opinion. I havent read the opinion carefully enough to to express a view on that. If i can just add on something that john just mentioned though. Both the decision on whether you can fire people simply because they are gay and whether you can deport 700,000 lawabiding people in the United States were total rebukes of the position taken by the the trump Justice Department. You know, these are two extraordinary direct refutations of the positions taken by this white house and this Justice Department on major major cases. Yeah. Its not unprecedented. The Supreme Court ruled against the Obama Administrations sometimes, too, but on two major cases like this, a still conservativedominated Supreme Court, you know, john roberts is no liberal. Its not you know, lets not get carried away. Neil gorsuch wrote that opinion. He didnt become a liberal overnight. There are five conservatives on the Supreme Court yet in two major cases within a week they rejected the position of the Trump Administration which is a pretty extraordinary thing, and it will be interesting to see how the president reacts to this one. It certainly will be. Given the way that hes tweeted about and spoken about Daca Recipients and the way that president obama initiated the daca program in the past. Thats right. The president has continuously put himself opposite of the daca program, whether it was in 2016 or also 2018. Immigration was a huge political issue for the president. He really hammered it, the vilification of immigrants around 2016 and also was the separation of the children at the border and when i was in states like texas talking to voters ahead of those mid terms, they were former republicans who were very upset about the Inhumane Treatment of immigrants at the border so this is an issue, and then we saw a number of those those districts flip from red to blue, so this is a political issue that could be very problematic for trump heading into 2020 if he continues to make this argument against daca. Dana, im just looking back at something that the president tweeted back in october of 2019. He wrote if the Supreme Court upholds daca it gives the president extraordinary powers, far greater than ever thought. Extraordinary powers that this president has asked for himself to hold time and time again. Yes, and, you know, the irony, never is it lost on me or so many people who covered the Obama Administration for this very move he made on daca was called an imperial president for using his executive power because the legislative process was broken, and yet you have a current president who is very, very eager to use that same power given to him by the constitution, so, you know, that should just be kind of hanging out there in the air. Regardless what this is kind of going back to what i mentioned earlier, this is the Supreme Court not just upholding one president s order over another. Its also a reminder that the court can go only so far, that some of these big social and legal issues must be dealt with legislatively, and this is i mean, i was up on capitol hill covering the ins and the outs of this these attempts over and over again to get bipartisan immigration legislation done for a decade, and it always collapsed, for lots of reasons, but perhaps, perhaps, maybe im being a pollyanna here. Perhaps this will throw the issue once more back into Congress Hands and after the election when a new Congress Comes back, when, you know, after inauguration day, perhaps this can be revisited. Thats a very good point, and maybe this time it will be different that a decision will be made and it will be settled. Joan, let me just go to you on your overall view of where the court has gone and where it has perhaps pushed the chief justice. Well, its the Trump Administration that keeps pushing the chief justice. Weve all been making the point that the administration actually has the power to enact any kind of policy having to do with Daca Recipients, and it has to do it the right way, and in this chase the Trump Administration did not justify sufficiently what it wanted to do, and what the chief is saying dont push us, dont go too far. Dont overstep and take sort of these extreme stands that even push conservative members of this bench over to the left because now, you know, the good thing is for all these daca beneficiaries it buys them a great sigh of relief but for the administration its sort of back where it started it, and i think thats the overall point here is that were still dealing with a conservative court. The most conservative court that many of us have seen in generations are, but the Trump Administrations pressure is having almost a reaction formation effect, at least on the chief justice of the United States. So i mentioned, as the decision came down, that there was this big, big friend of the court, you know, memo drafted or amicus brief written, Jeffrey Toobin. 143 different businesses here when this was being argued said do not deport dreamers. Big, big corporations, including apple, they talked about the economic benefit of dreamers to the to america and the companies. Team cook obviously who leads apple, you know, who knows the president well, talks to the president fairly often, i want to read his response that just came down. He writes, quote, 478 dreamers at apple are members of our collective family with creativity and passion. They have made us strongly, more innovative, be a innovative company. Were glad for todays decision and well keep fighting until dacas protections are permanent. As you know, they are not permanent yet, jeffrey. They are not. It is, as you point out, and this has been true throughout the impeachment debate going back to the 1980s when Ronald Reagan passed what he called an amnesty bill, you know, a bill that allowed people who were some people who were in the country illegally to remain. Its always been business that wants a more open immigration policy. You know, they recognize that immigrants are an indispensable part of the american economy. Both as employees and as consumers, and and, you know, this is not the Traditional Democratic republican split. You know, big business is often on republican side when it comes to lessening regulation las, when is it comes to cutting taxes, but when it comes to immigration, business has been much more on the proimmigration side which has been more associated with the democratic party, at least today, and well see howe that plays out in senate and the president ial race this year. Yeah. Thats a good point. I would like to read for people one key part of the roberts decision here, the chief justice writing this majority opinion. Quote, we do not decide whether daca or its recisions are sound policies. The wisdom of those decisions is none of our concern. We address only whether the agency complied with the procedural requirement that it provide a reasoned explanation for its action. Here the agency nailed to consider the conspicuous issues of whether to retain forbearance and what, if anything, to do about the hardship to Daca Recipients. That dual failure raises are doubts about whether the agency appreciated the scope of its discretion or exercised that discretion in a responsible manner. The appropriate recourse is, therefore, to remand to dhs so that it may consider the problem anew. Jeffrey, they are saying do it again, and it also sounds like the chief justice is writing you rushed this. This was not done in a proper manner, and, therefore, you lose. Thats right, poppy, but what hes also doing is giving the Trump Administration a road map for how to do it correctly, and thats why this decision is so important for the election because what the chief justice is clearly saying is you can do this. The two Police Officers charged in the shooting death of Rayshard Brooks have just a few more hours to turn themselves into police. They are now facing 11 charges, one facing a felony murder charge. Lets get to our Diane Gallagher in atlanta with the latest. Good morning, diane. Reporter good morning, pop be, and those officers have until 6 00 p. M. Tonight to turn themselves in. The list of charges, you mentioned that felony murder charge against former overs Garrett Rolfe would was fired after the shooting of Rayshard Brooks, that is a charge that carries up to life in prison or the Death Penalty if convicted. He also faces five different aggravated assault charges, two against mr. Brooks, one for shooting him and the other forric canning him and the three others are for individuals who are in a car that also was hit by a bullet. Thats where that Property Damage charge comes in. The others are a violation of his oath. Now officer Devon Brosnan is facing three charges, the first being aggravated assault for standing on mr. Brooks shoulders when he was still on the ground there fighting for his life. The other are oath violations as well. The attorney for officer brosnan, poppy, tells me that he was disoriented because he sustained a concussion during that struggle there and did not know that mr. Brooks had been shot at that point in time. Attorneys for former officer rolfe say that the shooting was justified based on the circumstances of that night. They also deny that rolfe kicked him and say that they would like to see video and not just a still frame of that, poppy. The update is we actually have some good news out of beijing on thursday where the governments chief epidemiologist saying the outbreak here has been brought under control thanks to the Early Detection of cases and the Quick Response by the local authorities.
