Obstruction, lying to congress, witness tampering. Found guilty on all seven charges. Stone just arrived at court here today. The sentencing is going to get under way around 10 00 a. M. Stone and his attorneys have said he does not deserve any jailtime for this. Prosecutors originally asked for 7 to 9 years before this extraordinary set of circumstances that happened where barr intervened in the case. Called that sentencing excessive and they asked for a shorter duration of time. Obviously, weve also seen President Trump repeatedly intervene in this case. We saw him do it again overnight. He posted this tweet from a fox news host saying, Something Like this should never happen again to anyone in our country about roger stone. Presumably meaning, i guess that you should never be sentenced for the crimes youre convicted of by a jury . Weve seen the president say over and over again that roger stone has been treated unfairly, that this judge is biased. That stone deserved a new trial. So, of course, the other thing were all on high alert for today and the coming days is the possibility of a pardon from the president. The other thing that we should remember is that no matter what the judge decides today, amy berman jackson, even if she decides that roger stone deserves jailtime, he is not going to be detained today. Stone has asked for a new trial and the judge said shell consider that request before he begins serving out any sentence. Remarkable events to follow, sara murray at the courthouse. Michael bloomberg got hit hard and often in his first democratic debate last night. Arlette saenz joins us from las vegas. We knew he was going to face incoming. The question was how was he going to deal with that . Bloomberg got the frontrunner treatment last night. It was a Michael Bloomberg pileon last night. And one candidate who appears to have benefited a bit from last nights performance is Elizabeth Warren. Her campaign saying they raised more than 2 million on debate day. All of the democratic contenders came ready to fight last night in what was the most fiery and contentious debate yet. The democrats were ready to rumble in their first chance to debate against Michael Bloomberg. The mayor says that he has a great record, that hes done these wonderful things. Well, the fact of the matter is, he has not managed his city very, very well when he was there. I dont think you look at donald trump and say, we need someone richer in the white house. Reporter frontrunner Bernie Sanders delivering the first blow. In order to beat donald trump, were going to need the largest voter turnout in the history of the United States. Mr. Bloomberg had policies in new york city of stop and frisk. That is not a way youll grow voter turnout. Reporter bloomberg firing back at sanders throughout the night. I dont think theres any chance of the senator beating President Trump. What a wonderful country we have. The best known socialist in the country happens to be a millionaire with three houses. What did i miss here . Reporter Elizabeth Warren was ready to strike, zeroing in on his alleged treatment of women. Id like to talk about who were running against. A billionaire who calls women fat broads and horsefaced lesbians and, no, im not talking about donald trump. Im talking about mayor bloomberg. But understand this. He has gotten some number of women, dozens, who knows, to sign nondisclosure agreements both for Sexual Harassment and for gender discrimination in the workplace. So, mr. Mayor, are you willing to release all of those women from those nondisclosure agreements so we can hear their side of the story . We have a very few nondisclosure agreements. How many is that . Let me finish. How many is that . None of them accuse me of doing anything other than maybe they didnt like the joke i told. They decided they wanted to keep it quiet. For everybodys interest. They signed the agreements, and thats what were going to live with. Im sorry. This is also a question about electability. We are not going to beat donald trump with a man who has who knows how many nondisclosure agreements and the drip, drip, drip of stories of women saying they have been harassed and discriminated against. Your trying to say that im dumb . Are you mocking me here, pete . Im saying you shouldnt trivialize that knowledge. Klobuchar trying to shift the focus back on the candidates real opponents. We have not been talking enough about donald trump and whats lets just talk about donald trump. Now we are just two days out from the nevada caucuses, and all of the candidates, except for Michael Bloomberg remain in the state today trying to make their final pitch to voters. Is it enough to put her back at or near frontrunner status . I think its too soon to be making any conclusions after one debate performance. I think she did have her Amy Klobuchar moment, the moment we saw amy have in New Hampshire that put her over the edge and threw her into the top tier. Thats what warren was gunning for, and what she realized she needed to do to revive a fledgling campaign thats been overshadowed by bloomberg and the vast money hes spent. And Bernie Sanders pulling away in the polls. That being said, what warren didnt do, which is the ultimate hurdle to her securing the nomination is attack Bernie Sanders. The one person who she is really splitting voters with and, again, who is becoming a potentially formidable frontrunner. But this debate performance as arlette pointed out, Elizabeth Warren raised a record amount of money in that first hour. Its clear that shes picked up some energy. She may have that going into the caucuses on saturday. And thats what shes looking for to translate into South Carolina for the primary the following saturday. Maria, looking at Mike Bloombergs performance, he knew going in he would have an issue with stop and frisk. He got ahead of it. Went out and apologized, met with a congregation. Owned it in effect. On the issues, for instance, the ndas from women during his time leading bloomberg, didnt seem to have a great answer on that. Are you surprised he didnt have a stronger pushback on something, when he was preparing for these debates, had to know he was going to get pushed on that issue. I was really surprised. And i think that a lot of people were surprised as well because it was clear that he was going to have the target on his back. You would think that he would have overly prepared for Something Like this. He has good people around him who should have told him that this issue is undoubtedly going to come up. And that his rivals on that stage were going to be putting that in front of him. And he looked like a deer in the headlights. Not just giving really bad answers to those obvious questions, but also not being able to pivot, which, when you are in a position of not having a great answer to something tha that is the tactic that you use to pivot. And in that debate, and not just him, but all of the candidates really missed the mark on trying to go after donald trump on one key issue, jim, here in nevada with a population that is so critical. And that is latino voters. I think they really miss the opportunity to push back on trumps one main talking point about the economy and having record unemployment numbers in the latino community. And no one really did that. And i think it was a big miss. When you know that voters consistently put beating donald trump, democratic voters at the top of the list for the qualities theyre looking for in the democratic candidate. What about this moment . Let me replay it because it certainly struck me watching last night. Here was Pete Buttigieg going after Bernie Sanders and Michael Bloomberg. Most americans dont see where they fit if they have got to choose between a socialist who thinks that capitalism is the root of all evil and a billionaire who thinks that money ought to be the root of all power. Lets put forward somebody who is actually a democrat. He did not fare well in the latest National Polling as well as hes been doing. Is this what mayor buttigieg needed to do last night, jackie . Well, look, we do know that the mayor has a problem with voters of color, africanamerican voters hes barely registering in the polls. Despite his wins and his success in iowa and New Hampshire, that might not be enough to potentially put someone who was at zero to a top tier in these more diverse contests. He does speak to, you know, a real craving and need amongst voters were seeing. Bernie sanders may have enough plurality but not enough have coalesced around him. People are still really searching for that alternative. Thats why Mike Bloomberg was such a topic of, you know, ire amongst voters as well last night because people eyed him as that alternative to biden. Hes been able to really shoot that gap. And what you saw pete trying to do there was, obviously, exploit that in a pretty smart way and, you know, and try to stake his claim in the race. This is in the middle of the president s repeated complaints against prosecutors and the judge and jurors in this case. Were joined by White House Correspondent john harwood. Reuters White House Correspondent jeff mason, and former federal prosecutor laura coats. The president saying that stone has been treated unfairly. Given his seeming unleashedness since his senate acquittal, is a president ial pardon here almost a foregone conclusion . I think so. I dont think anyone doubts the president intends to pardon roger stone and you can throw in mike flynn and Paul Manafort as strong likelihoods of pardons in those cases as well. The president wants to protect his friends and malign his enemies in the judicial system. Hes made that clear with his comments. So this sentencing and the controversy here is really about the president. Its not about judge jackson, and we will see. Shes an obama appointee. Well see whether she assigns a sentence in the original recommended range, which was pretty long, up to nine years, or eases off. But i dont think anyone has questioned her integrity or conduct. This is about the president inserting himself into the process. If it doesnt go his way, we expect him to insert himself again. Laura coats, what are you expecting, not only in terms of a sentence here, given that initial recommendation and then the lower request from justice, but also in terms of whatever comments judge jackson chooses to make or not make, not addressing all of the periphery here . Well, the first is to have a question about why there was a difference in the sentence recommendations here. Its important to know the judge takes seriously the prosecutors recommendations. They want to know its not just based, of course, on throwing spaghetti against a wall. Its based on an actual sentencing guideline chart thats given to the courts, given to Pretrial Services where they calculate what somebody, based on their criminal record and the current crime and any enhancements would actually receive. So shes going to be wondering why there is a departure from that recommendation in general. But also i expect her to assert independence and autonomy. The word recommendation should keep circling around everyones mind. Its only a recommendation. It is the judges decision on how to rule. And they should be politically insulated. Now the president has attacked her, talked about the Paul Manafort case. If theres a pardon, if there is any sentence, remember that it is a jury who found this man guilty of seven counts. It did not rest with judge amy berman jackson. Jurors found that this person lied to congress, tampered with witnesses and obstructed. So you have all of these issues at play. If theres any decision being made, its based on the facts and the jury as they saw it. Jeff mason, laura coates described how the system is designed to work. Should work. The rule of law should work. But the fact is, its not the president s approach to this. Is it . Hes already signaling in public in ways that president s should not do, right, and have not done, interference in cases. But may very well use the pardon powers weve seen him do already to help out friends. He might. We dont know that yet. Its important to note that this is still speculation. He hasnt pardoned anyone. He hasnt pardoned anyone related to the Mueller Probe but he did in recent days pardon and commute the sentences of several other white collar criminals. And he has clearly shown a willingness and he has said he has the right to weigh in on these cases. Theres reason for that speculati speculation. Its driven by the president himself. He also said just in recent days in front of a few of us at the tarmac of joint base andrews that hes the chief Law Enforcement officer of the country. So that is the context with which he is looking at these cases. But we dont know what hell do. He may weigh some political considerations. He is obviously running for reelection. Yes, hes emboldened from the outcome of the impeachment trial but he does have to try to win again in november. Certainly if he does decide to pardon roger stone, thats something his opponents will use against him. He might decide to wait until after that election whether or not he wins again. I just want to add one thing quickly. Sure. Jeff makes a very important point which is that, yes, roger stone is the president s longtime adviser and friend. And he wants to take care of his friends. But Donald Trumps number one friend is donald trump. And so hes going to make a decision based on the combination of, yes, whether it helps his friend, but does it hurt me . Does it have an adverse consequence for me . I think that is likely to govern his conduct. Thats a very good point. When it comes to the criticism thats been leveled against the jurors forewoman, its important to note this comment that chris cuomo had a different juror on his program who addressed the question about any potential bias in the forewoman. Heres what that juror said. Tamika hart whom we elected as our foreperson. Tamika was perhaps the strongest advocate in the room for a rigorous process, for the rights of the defendant and for making sure that we took it seriously and looked at each charge. Without her in the room, we would have returned the same verdict and we would have returned it more quickly and without looking as deeply into the evidence. I am firmly convinced of that. How significant to hear that given even the president s attacks on her . Well, very given that roger stone has moved for a new trial based on what he perceived to be her bias. Of course, whatever sentence is handed down will be suspended in light of that motion. But the information about this potential juror, about her background, about her viewpoints, that was all available to both the defense and prosecution at the voir dire according to reporting. Meaning they could have asked her about these issues. They could have asked about potential biases and inquired whether it would have an impact on her ability to receive the information objectively and to decide according to the law. They had the opportunity. Apparently at the time it did not impact their decision and now they are asking for almost a second or third bite of the apple because the president is now weighing in via twitter. So it really undermines the idea of the voir dire process and the idea that the jurors had every opportunity as did the defense to display and talk about whatever misgivings they may have had. They were not called on it. It wasnt addressed. Now after a conviction its suddenly a problem and after the president weighs in, its disingenuous at best. Its a created problem, right . Trump has created this sense that whether juries are jurors are democrats or republicans or members of the Justice Department have spouses who work for one party or another that that creates bias in this system that justifies, right, this view as the outcomes of these processes as being inherently wrong. This is the thing. John, jeff, youve covered this for some time. We cant treat that as a normal process here. That has not been a litmus test for years prior to judge whether a case is fair or not. I think its also go ahead. No, you go ahead. All right. I think its worth noting that despite the fact they white house will say that the president has a right as a private citizen to weigh in on things like this. He is the president of the United States. Hes the leader of this government. Hes the leader of the country and the leader of the free world. So when he issues comments that are critical of a judge, when he issues comments critical of a jury, its beyond just being a private citizen weighing in on a case that he is that he has taken into in. It has significant weight. And the point is, if he does not show particular concern for the country in doing so. Remember, what were seeing is a judicial process which has moved to hold the president accountable in various ways or the president s allies accountable. He doesnt like that. He tries to delegitimize the process. If the rule of law in the United States is holding him accountable, he is discrediting the rule of law. And that has consequences for the country. I wrote a story about this today. The ability of the United States to attract allies, to persuade others, to lead in the world, militarily, diplomatically, economically, depends on the rule of law. And so does the vibrancy of the u. S. Economy. If people dont have confidence we have honest governance in the United States, we are not going to have the economic advantages we have enjoyed for the last 100 years. And the functioning of the system and the attacks work because we see it in the polling. Peoples distrust in a whole host of institutions the president has attacked, whether Justice Department, courts, the intelligence agencies. These things matter and they have effects over time. Harvey weinstein arrived at court just moments ago as the third day of deliberations in his sex crimes trial begins. Jurors getting back to work after peppering the court with a series of questions about the charges against the disgraced hollywood movie producer. They had questions. Lets go to our jean casarez. Jennifer rogers our legal analyst is also here with us. Jean, let me begin with you. Is there any sign that they could be close to a decision . And talk about what these questions that they have handed in actually mean . Poppy, you never know about a jury, right . This is the third day of deliberations. We can tell from the notes and the questions they seem to be methodically going through the counts. They sent out five notes so far. Theyve deliberated for 12 hours. And yesterday the notes were very interesting because there was one on mimi haley. Shes one of the main accusers in this case because two of the charges, predatory sexual assault, criminal sexual act in the first degree, they are from the facts she has alleged that she was raped, sexually assaulted by Harvey Weinstein in 2006. Now the dates they were really interested in on hearing the direct examination and crossexamination were dates of july 10th and july 26th. The 10th is when she alleges that very violent assault in Harvey Weinsteins apartment in soho. On the 26th is when she admitted on crossexamination she had sex with Harvey Weinstein and it was not forced. She had to admit that on crossexamination. The other thing they wanted are all the email exchanges between the two and that lasted for years afterwards. They also wanted any email exchanges from the Weinstein Company that mentioned mim mimi haley. He would have his assistants to get those things in order for her. The flights he paid for her. Also the jury heard readback from rosie perez, actress rosie perez. Rosie was very good friends with ann dlat bella sciorra, one of the six accusers. She testified not long after it happened that annabella told rosie, i think i was just raped. She didnt give a name but thats an outcry witness. Someone you tell immediately that something happened to you. So there were five counts here, but he can only be convicted of it, at most, two charges. Some complicated law in there. I am just curious, based on the questions youre seeing coming from the jurors and that structure, does that make a not guilty verdict or a hung jury more possible here . More likely . The more time that goes on, right, during deliberations, th or not be able to reach a verdict. But juries are often compromising. They are looking at two different charges in this case, a more serious charge of forceable rape versus a less serious charge of assault. Which way are they going to go . What does the evidence show . Thats why you see them asking for testimony trying to figure out which way it should go or neither of the above. To jennifers point about how likely a hung jury or mistrial could be, theres a question about juror 11 who is writing a book about predatory older men and younger women. Not about weinstein but about this issue. And three attempts that the judge has denied by weinsteins lawyers to have that juror dismissed . What is that this is very interesting, poppy, because on jury selection, the defense asked her about this. She admitted she was writing that book to be published in july. But she said she had not done any research for the book on predatory older men and younger women and she was not following the weinstein case. So she got on the jury. Now the defense has launched an argument that they have realized that during the course of this trial, she was reading a book on predatory older men and consent and actually wrote a review of it online. Prosecutors said, your honor, shes not forbidden from reading books and writing reviews during this trial but the defense countered that by saying its the exact subject matter of this case and now it appears there are two books, one that she did write a review on, both about predatory older men and consent, younger women. One she has yet to write a review on, but she was questioned before the judge and she said that she was just reading the books, hadnt written the review yet. The judge said its fine. She stays on the jury. Okay. Another question, jean casarez, jennifer rodgers. The president s new acting director of intelligence has no intelligence experience. But he say longtime trump loyalist. So the president has a pick, a new pick to lead all 17 different arms of the intelligence community. And yet has no intelligence experience. But richard grenell, the current u. S. Ambassador to germany, is a staunch supporter of the president. Grenell will take over for joseph mcgwire who has to leave the position next month. Lets discuss with samantha vinegrad, a former advicer to the National Security adviser under obama. Good to have you on. As you know well, this position was created after 9 11 to prevent another 9 11. We look out our window here and see the site of the former world trade center. Im going to read from the act of 2004 that created this position. Any individual nominated for appointment as the director of National Intelligence shall have extensive National Security experience. Richard grenell does not. Does that make the country less safe . It certainly does, jim. When you think about the role of the dni, or the director of National Intelligence, you want someone experienced because theres so many Component Parts. Talking about 17 different organizations and departments. The dni is responsible for integrating. The integration of intelligence with something sorely lacking ahead of 9 11, and that was one of the key reasons this position was created. But it is not just a management function that relies on a dnis experience. Its also his or her ability to prioritize intelligence and what he or she brings to the president. A dni should not just tell the president what he wants to hear. A dni should tell the what president he needs to hear and that takes a level of experience. Finally, jim, we also need to remember the dni is responsible for protecting whistleblowers within the intelligence community. Sure that comes with experience, but thats a major responsibility that grenell will be faced with that, unfortunately, i think we have reason to believe he may not be comfortable pursuing in light of what were likely the qualification that President Trump was looking for in the dni. So mark warner, of course, the ranking democrat on the Senate Intelligence committee, you know, up in arms about this appointment. I wond ir if its telling that the republican chairman of the committee, richard burr, Spokes Person for him, had no comment on this, sam. Its quite telling but i think its something we likely should have assumed. Republican members of congress have stayed silent whenever the president has made a poor personnel pick. Part of the reason that grenell will be an acting dni and not a nominated dni is because our reporting shows that Many Republican members of congress likely would not have agreed with his nomination if he had to go forward with a confirmation. But the truth is that, at this point, we have to consider that from trumps perspective, inexperience is a virtue when it comes with his cabinet picks. As a dni, you are responsible for upholding the ethics of the intelligence community, including speaking truth to power. And we know that something that President Trump does not like from his cabinet officials or from members of congress or anyone else. So lets look at the experience of the previous holders of this position. You get a sense of the contrast here. Joseph mcgwire was a retired u. S. Navy vice admiral. He led the Principal Agency for countering terrorism. Dan coats. Mike dempsey, 30 years in the cia. Dennis blair, commanded u. S. Forces in the pacific. James clapper led two of the 17 agencies before becoming the dni. Mcconnell, navy vice admiral. Led the nsa and john negroponte. Why does that matter . Why does that experience matter . A position created to coordinate all the intelligence agencies so they are sharing information intelligence honestly among each other and with the president to prevent other attacks. Well, to say that the learning curve for grenell is going to be steep is a massive understatement. Coming into this position with no relevant intelligence experience means hes going to have to spend time understanding how these different 17 Component Parts work together. Who they are. What functions they perform. Hes going to have to understand how to take all of the information that they collect from various sources, signals intelligences, human intelligence and otherwise and then decide how to appropriately present that to the president. He has no experience doing that. And so that learning curve is going to be quite significant.
