Reporter what its illustrating is the division that exists in hong kong between the people who are celebrating this bill and the government which is condemning it because obviously it authorizes sanctions on chinese and hong kong officials involved in human rights abuses. The very abuses that protesters have been at times violently fighting against for the last six months plunging this city into a recession and adding to the uncertainty is another part of this bill that requires the state department to review hong kongs highly covetted special trade status. The mainland doesnt have it. Hong kong does. Its a big reason why this country has been so prosperous for so long. If that were to go away because of perceived human rights abuses by the United States that could further deepen the economic crisis that has resulted from the social unrest here. And so you have people waiving american flags, thanking President Trump and then you have the government pointing to the videos from poly u the scene of intense clashes almost two weeks ago and they say they found 600 petrol bombs and other weapons and asking why the United States would support a violent government the government considers rioters but the city overwhelming sports and the election proved that. Well monitor that situation. Will, what can you tell us about the projectiles reportedly fires from north korea over night . Reporter yeah. This was the 13th launch this year. Its been dizzying but the difference between the launches that we saw in 2017, for example, when there were Intercontinental Ballistic Missiles and nuclear tests, these were short range launches that President Trump said it doesnt bother him has all but given his stamp of approval for. Meaning kim jongun can launch as much as he wants without any fear of penalty and frairpgly at the moment theres no disploemsy to speak of happening between the United States and north korea. Everything is ground to a halt. North korea is not getting along with south korea right now, so i suspect these launches are less about sending a message to the outside world. Obviously they want to remind south korea theyre developing their short range capabilities, but i think the bigger challenge facing kim jongun is how to project strength internally. These launches hes not getting penalized for internationally still allow him to appear strong on state media, despite the fact that north koreas economy is in shambles and they continue to struggle and havent made any diplomatic progress with south korea or the United States to speak of. How important is it for these antigovernment protesters in hong kong to get this message from the president of the u. S. , that he signed this human rights act . Its significant for them because just think of the alternative if donald trump had failed to sign it and had gone against the wishes of congress what that would have essentially said to china was you sort of have a free hand in tempering down or at least stopping these protests. And so it is a huge sort of surge of relief on the ground and gives the protesters as were seeing today as they sort of honor the United States today at least sort of shot in the arm right now. I dont think it will have a longterm impact in how china decides this. The second thing of course is china is not happy. They have called our ambassador in. It is already sort of threatened a response to the legislation being signed. And we have a lot to deal with with china. So their unhappiness, at least with the u. S. Government, although they dont attack trump specifically, which i think the interesting, is going to play out in a lot of the negotiations going on with the trade deals. Julet some argue this doesnt go after china but punishes the people of hong kong . No. I think thats a way to sort of get out at least the United States having a strong statement to support the protesters. Look, its complicated a Statement Like the legislation is not going to do grave harm to china. It is names and shames. It requires the United States to say that hong kong is an autonomous city, something that we recognized in the past. Its a statement. We have done statements like this before to show where our moral clarity is in the protests between hong kong and china. Timing is interesting because of the trade war with china. Yes. What do you think this does to trade talks . I think to a certain extent china will view the trade talks as probably untouched by this. This is what i find interesting and what will was reporting on earlier this morning that the chinese have not attacked donald trump specifically. Theyre condemning us. Theyre being critical towards the ambassador. The chinese have said in recent statements that they like dealing with donald trump because money speaks with donald trump. Theres no principles to speak of. Theres no guiding sort of u. S. Interests that they need to worry about. If you can get donald trump on your side, the chinese believe then you can get a deal. So, they will the criticisms of the United States will in some ways i think sort of isolate the president of the United States so that they can continue with the trade talks which they want as well. And your take on north korea firing off another projectile overnight. Should we be worried about escalation there or are they just trying to get attention. Picking up on wills great reporting over the last 24 hours, this is something that the leadership of north korea will continue to do because they are short range missiles, sort of no threat to us, of course. And they will not get donald trump to respond i think in kind forgetting, of course, that we have interest in south korea and japan in the area. This is a way for the leadership of north korea to remind the United States that they want a deal by the end of the year. Donald trump once again just like with china has made the relationship with north korea personal with the letters and the he really likes north korea. And so, i think like with china the north korean leadership will continue to try to court the president of the United States outside sort of the traditional United States interest and National Security apparatus that have been dealing with a rogue and terrorist state for a long time. The New York Times reports while Rudy Giuliani was pushing for an investigation into the bidens, the president s personal lawyer was also trying to sign business deals in ukraine for hundreds of thousands of dollars. And there are also new questions this morning about that phone call Ambassador Gordon Sondland reported he had with President Trump. Its the call republicans and the president have used as a defense to push back on ukraine reporting. Joining us to discus this is cnn National Security and legal analyst susan hennessy, former National Security agency attorney. Good to have you with us. Thanks again for being here on thanksgiving. Lets start with Rudy Giuliani. If giuliani was trying to make these business deals, hundreds of thousands of dollars with the very same ukrainian officials he was talking to in his effort to dig up dirt on the bidens, what kind of legal trouble could this pose, even if they didnt follow through . Potentially there is some potentially legal exposure here. Keep in mind, this is exactly why we saw so many career officials talking about the concerns regarding this irregular channel. If Rudy Giuliani was a Government Employee or even had been sort of designated as a special envoy, somebody who worked in a private capacity but on behalf of the government, he would be required to make disclosures to adhere to a series of ethics and compliance rules when he was representing the interests of the United States he was really doing that and not his own financial interests. So what were seeing here this comingling of pursuing political favors for the president of the United States reportedly and also reportedly trying to essentially make a buck off of it, thats exactly why people are so concerned when ever they see Foreign Policy being conducted in this way. So, we dont have any sort of concrete information right now about what exactly the Southern District is looking of new york is looking into, but it does appear that this is at least one element of that inquiry. This feels a little like deja vu, we dont know how this is going to end. You have a personal lawyer working for donald trump who also profits off of his using his association with him, sounds a bit like michael cohen. And the president is now starting to sound like he did when he was talking about cohen before he flipped, slowly distancing himself from him. Susan giuliani talked about having insurance against the president. Could any case against him go down differently than cohens . Yeah. So this is interesting to see sort of the parallels play out. Now giuliani has said that this sort of crack hes now made multiple times about having insurance in the event that the president of the United States throws him under the bus. It doesnt look that much like a joke. It looks a little more like a veiled threat hes saying if the president of the United States doesnt protect him, he might reveal some sort of damaging information. Now, its significant to see donald trump sort of trying to distance himself from giuliani a little bit, saying that he didnt know anything about what giuliani was doing in ukraine. Right. Giuliani had lots and lots of clients. Thats significant because giulianis defense, his representations in the media are accurate. He was doing what he was doing on behalf of the president. So to the extent that he needs to prove his defense by either sharing communications, you know, with prosecutors or with congress in order to prove that the president did, in fact, tell him to do this, or if it becomes an incentive to share those communications because he finds himself in a lot of legal jeopardy and wants to do things like cooperate in order to face reduced charges. Those could both potentially be very significant. Republicans and the president have been seizing on that one interaction between Gordon Sondland and President Trump in that phone call where President Trump supposedly said no quid pro quo. Now theres new reporting from the Washington Post that no other witnesses or documents have been able to corroborate that call. Its just sondland himself. And according to the post, quote, there is evidence of another call between trump and sondland that occurred a few days earlier, one with a very different thrust in which the president made clear that he wanted his ukrainian counterpart to personally announce investigations into trumps political opponents. Sondland is obviously a key figure in this impeachment inquiry. He is one of the people who talked to the president who did testify publicly but is he a reliable source . Sondland has had to change his story multiple times. There does appear to be a lot of confusion about whether or not there is evidence of this no quid pro quo call, having occurred. Looks like there might be a little confusion over the exact time that it occurred. You have multiple people traveling through multiple different time zones. So i think theres a lot to sort of disentangle about what the evidence says. Ultimately even if this phone call did occur just the way Gordon Sondland is saying, it is not any way exonerating of the president. The fact that the president of the United States felt compelled to say no quid pro quo immediately after essentially being caught learning of this whistleblower complaint is itself essentially evidence of awareness of guilt. You called this testimony at least so far against President Trump devastating and compelling. If you were still in the house of representatives, as a republican, would you vote to impeach the president . Well, anna, first i certainly would have voted for the impeachment inquiry based on the facts as i understand them now i do think this rises to the level of impeachment, i would probably support it. That said, i dont think the democrats should move forward on impeachment until they hear from some of these primary witnesses, like john bolton and Mick Mulvaney and the secretary of state himself. I think they need to close that loop. I dont think they should force this or rush this. By the same token, neither should the Senate Republicans force or rush a trial. We havent even heard republicans expressing really concern over what came out of the past couple of weeks hearings. Did you recognize your former republican colleagues this past couple of weeks . Well, i think my former colleagues are in a situation where they understand their base pressure, the base has not yet has not yet bolted from the president. And i think thats why theyre standing with the president for the moment. But theres no question having spoken to many of them privately theyre absolutely disgusted and exhausted by the president s behavior. They resent being put in this position all the time. Just take, for example, ana, they tried remember how they tried to pivot from the ukraine scandal a few weeks ago by pivoting to doral, bringing the g7 there, one corrupt act to another, those types of headexploding moments are just infuriating these members. And i think they like to step out but they just cant because of their base at the moment. But where is the courage . Well, look, i think a lot of members have to take a hard look at this. They can be more concerned about their election or their legacies. And i would argue to many of them your legacy is more important than the next election. Thats hard for a politician. Youre a politician, you want to win. Youre competitive and you do what you must to win. Its sometimes hard to try to look at this in a Historical Context and thinking about how youre going to be perceived for years to come. So i think many of them are wrestling with this fact right now, this real challenge. And so, theres still time. Give them a little time. You have said the facts get worse for podus daily. The president putting distance between himself and Rudy Giuliani. Whats your read there . Well, clearly you know the president wants to throw Rudy Giuliani under the bus. Thats what im seeing here. The fact that he said that he didnt know what rudy was doing over there in ukraine. Well, of course he did. So, its clear that the president , you know, hes loyalty is a oneway street with him it seems. He expects everyone to be loyal to him and while hes not loyal to others. I mean, i think this president takes the loyalty of so many people for granted and their support. In fact, at times he mocks their loyalty. I think thats whats happened here with Rudy Giuliani. Cnn has learned that Senior Pentagon officials are privately saying how disturbed they are by President Trumps behavior on a wide range of issues, including his impulsive Decision Making and the recent intervention in war crimes cases. The starting point is on this thanksgiving day, tens of thousands of troops obviously serving around the world, eating their thanksgiving meals so far away from home. And some of that is the exact reason commanders are worried. They want the troops to feel very confident that there is clear, precise Decision Making, that there is not political influence on their mission and what they are being asked to do. Troops reflect american society. Broad range of political opinions, many, of course, do support the president and think hes looking after them. But here there at the pentagon especially, there are senior commanders who are very privately growing increasingly worried about the president s interference about his Decision Making, about him exerting political influence on what the military is doing. And its really all come to a head in recent days over his stepping into those courtmartial cases involving alleged war crimes by a number of military members. It cost the Navy SecretaryRichard Spencer his job when he objected to the president s interference. And he wrote in the Washington Post, i want to read it to everyone because it crystallizes what some of the concerns are. Spencer writing that the president s intervention in the military Justice System was shocking and unprecedented. It was also a reminder that the president has very little understanding of what it means to be in the military, to fight ethically or to be governed by a uniformed set of rules and practices. Thats really the point here. The military does not operate in this country on anything but uniform rules and practices. Remember, President Trump has called these now pardoned Service Members essentially war heroes. He said he was defending them against the deep state, implying that that was the pentagon. And in the past, recent past, hes tweeted the troops, u. S. Troops are trained to be killing machines. That is absolutely in the view of senior commanders not what they want to hear. Ana . Let me ask you about a related development, barbara. The three navy s. E. A. L. S. Pictured with officer Eddy Gallagher will not face the review board. Tell us more about that. Yeah, thats right. Of course gallagher this is what really led to spencer being fired. Very complicated. There was going to be a review board, an impartial military review board of all of those navy s. E. A. L. S. Being able to keep their s. E. A. L. Status upon retirement. The president intervened in the gallagher case over the objections of the Navy Secretary and said he would keep his try dent, his s. Echt a. L. Status no matter what. Now because of all this controversy, the other s. E. A. L. S. Are also not going to face a review board. The feeling inside the navy is this has become so controversial, be very tough for them to get an impartial review and the bottom line is the navy very much right now wants to move on. Ana . However, for me, i believe i watched the Vice President also being dispatched by the president to certainly work with international leaders. And thats going to be important in the for the next president because obviously we dont have that. And also, if president obama trusted know joe biden, it trust him too. It sounds like you see bidens past service as his strength, but he has faced criticism for his past over his past stance on criminal justice issues, his past relationship with segregationist senators and more recently cory booker keeping marijuana illegal it affects minorities in a disproportionate way. Does any of that give you pause . I had a conversation recently with a constituent actually on the criminal justice part of it. And i explained to him that when communities, particularly africanamerican communities were being ravaged with drug lords, infiltrating our communities, that many thought that the right thing to do was the war on crime and the war on drugs and minimum mandatory sentences to clean the streets. Today, many of those same individuals, including republicans and high ranking elected officials in that party, believe in reform. And because we understand now the damage that that type of attitude reeked in particularly africanamerican communities. And so, there are probably some historical issues, as you mentioned, but the good part about it is the realization of what should be in todays world. Okay. And so if you dont continue to make the same mistakes and you realize that we should handle things a little bit differently, and i think Vice President biden did realize that, then we can move forward. Everywhere. Welcome back. Lawmakers are on thanksgiving break right now, and theyre taking time to meet with their constituents ahead of next weeks new slate of impeachment hearings. But a recent cnn poll shows impeachment is not a top issue for voters. Joining us now to discuss is New York Times politics editor and cnn police kal analyst Patrick Healey and National Correspondent for time and cnn political analyst molly ball. Great to have you with us. Patrick, our new cnn poll finds that basically support for impeachment has not really moved. It was between 47 and 50 since late september. How might that impact democrats messaging as they move forward into this next phase . Democrats are going to be coming into next week having a big decision to make, basically, how broadly to go with articles of impeachment. Whether to bring in the mueller report, for instance, or whether to focus on ukraine. The real issue for democrats here is that they spent several weeks now building a case specifically on ukraine, trying to shape public opinion, get voters to understand issues like abuse of power and bribery. And they really havent moved the needle in an extraordinary way. The trump white house, the trump campaign, the republican establishment has been very effective in basically saying this is a partisan sham. So, if democrats decide to go broad and bring in the mueller report, it really it could risk kind of confusing the issue and saying, boy, were now throwing a lot of things at the wall to see if they stick. And voters may sort of see that and start seeing this as more of sort of big and slightly messy democratic cover. It could muddy the waters. But even if they stick with ukraine, molly, democrats are on track to hold this full house vote by the end of the year, they say. Theyre moving quickly. And yet were learning more and more information all the time on this specific case. Are they risking missing some Key Information and witnesses . Yeah. Theres actually a pretty active debate among Democratic House members in particular about this issue. Its very similar to, you know, when a prosecutor builds a case at some point they have to decide this is enough to convince the jury youre never going to track down every stray piece of information, youre never going to get every single witness that you think might be relevant, they have to decide at what point is it better not to bore people or make them tired of the case or make it seem like yesterdays news or something thats just going on and on and on. At the same time, there are a lot of other democrats who feel that given all of what they consider wrong doing by the president and his administration it would send the wrong message to only impeach over this one issue and not broaden it out to present to voters the full case of things that they believe the president has done to violate his oath of office and abuse his power. So theres a debate going on behind this. And the official line is that they actually havent made the decision. The official line is this is in the hands of the judiciary committee. The other committees, similar to what the Intelligence Committee is doing now, are also going to report out what they think based on their own investigations because remember there have been six committees all simultaneously doing these investigations of the president on various issues. And then its going to be up to the judiciary, and they maintain that that decision has not been made what to put in those articles and how to move forward. And even who else they may interview. Patrick, john bolton, Mick Mulvaney, they could offer something to the democrats case, right . But would whatever they have to say be something that could potentially change republican minds . I think its on two tracks. One is bolton and mulvaney, if they were somehow to come before the committee, before the committees, could change both some republican minds in congress possibly but more so voters. A lot of fox news watchers know john bolton from his years of appearances. And right now john bolton, for instance, would be pretty highlevel witness who if he said damning things about the trump white house, at least some of those republicans who followed bolton for years would have to reckon with that, similarly with mulvanemulvaney. Thats kind of public opinion. In the house, senate, ana, it may change some minds. But really right now what were seeing is so many republicans are kind of dug in to defend the president. That unless you had a truly dramatic flip by a john bolton or certainly a Mick Mulvaney, its hard to see right now, at least, at least right now, a lot of changing minds. The Trump Administration doesnt know how many families were separated at the border when it implemented its zero tolerance policy. And they still dont know just how many families have been reunited. A new Homeland SecurityInspector General shows widespread errors prevented officials from being able to properly collect and track the data. Cnns natasha chen is following this story for us. Natasha, what were these errors, and will the government be able to find and reunite these families . Well, ana, a lot of these errors point to Software Problems and the systems from different agencies not talking to each other. The report says this caused a lot of extra work and overall this policy ended up costing more than a Million Dollars in overtime. Were talking about five different i. T. Systems across three different agencies mentioned in this report. For example the Border Patrol system did not even have features in its software to mark that a child was separated from its from his or her family until nearly two months after the zero tolerance policy ended. And as of february of this year, that system still couldnt automatically tell health and Human Services about a separated child. Hss had to manually check a box that a child was separated from a family based on emails from Border Patrol. Here are some quotes from the report to give you an example. Cpb adopted various ad hoc methods to record family spragss. Without a reliable account of all family relationships, we could not validate the total number of separations or reunification and they continue then to say that they then cannot tell how many separated families were actually reunified. Here is what they do know. Cbp estimates during that six and a half week window of the policy there were about 3,000 children separated from their families, an estimated 2,100 reunified, but they found 136 children with potential family who were not accurately recorded. And when they extend those dates wider to october 2017 through february of this year, they found an additional 1,200 kids not accurately recorded. They say the agencies were aware of these problems since november of 2017 but did not address them before the zero tolerance policy took effect the following year. And they say, like we mentioned, this cost more than a Million Dollars in overtime and did not achieve the original goal of deterring catch and release. And ended up resulting in these kids being held for longer than the 72hour legal limit. The Inspector General did make about five recommendations for fixes, updating systems, automatically sharing data between agencies, and they did acknowledge that most of those recommendations, ana addressed right now.
