Congress gets ready to open the closed doors and start the public stage of this impeachment inquiry. Lets begin with todays testimony. Were expected to hear the lawmakers will hear today is more concerns being raised about the role that rudy giuliai played which has been a consistent theme that the personal attorney worked outside legal channels. Even at a key time these officials were trying to strength relations with a key u. S. Ally. Catherine croft testifies about efforts what she was told about this aid being put on hold for ukraine. She said on july 18th, i participated in a subpolicy Coordination Committee Video Conference where an omb representative reported the white house chief of staff Mick Mulvaney placed an informal hold on Security Assistance to ukraine. The only reason given was that the order came at the direction of the president. Now we also are expecting to hear from anderson testifying later this afternoon. Christopher anderson is a Career Foreign Service officer, and he is expected to say, according to this Opening Statement that john bolt bolton, then National Security adviser cautioned that giuliani was a key voice with the president on ukraine and could be an obstacle to increased white house engagement. Were expected to learn more about the efforts to try to get rid of that Ukrainian Ambassador to the ukraine, marie yovanovitch, someone who had been ousted, targeted by Rudy Giuliani and others, recalled from that post after pressure from the president. Someone with a lot of career officials had concern had been removed from the post. We expect croft to say there was a push by lobbyists livington to get rid of yovanovitch, and weve reached out to livingston, cnn did last night. Livingston declined to comment on his efforts to oust the Ukrainian Ambassador. People outside the normal policy process with political roles and motivations interfering in ukraine policy here. I want to ask you because folks at home may have trouble keeping track of the testimony every day. But one key takeaway from vindmans testimony yesterday was that this effort was not just about the july 25th phone call between trump and zelensky. A meeting on july 10th when Gordon Sondland, the eu ambassador, again brought up, made this tie between the president ial visit meeting and an investigation of the bidens here. I mean, it seems what were seeing from this testimony is this was a continuing effort over time. It was not just about one phone call. Yeah, no question about it. And whats significant about that testimony, about that july 10th meeting is that it flatly contradicts what Gordon Sondland said in his own sworn testimony in which he said no concerns raised from the specter of investigating, raising those investigations into the president s political rivals in exchange for a meeting between the Ukrainian Administration and the president. He said that never came up. No concerns were raised. That is flatly contradicted by vindmans testimony and also fiona hill. Separate witness testified about concerns they raised. John bolton. Were hearing from multiple witnesses had concern as well. Thats absolutely a consistent theme that these the idea of anything prior to bolster relations with ukraine tied to that push to investigate the president s rivals and thats what democrats, of course, are zeroing in on. Manu, thank you, on both fronts. Well see what today brings. Lets talk about all we know so far. Retired Major General spider marks is with us and molly ball and cnn legal analyst ross who knows a lot about impeachment law. Molly, let me begin with you on what a crucial part of vindmans testimony yesterday, which is that he had a different understanding about some parts of that july 25th call than the white house transcript release shows. And he was on the call so that matters. And he was under oath when he said these things. Namely those ellipses and that he believes there was a mention of the biden tapes, about comments made last year. During watergate, the nixon administration, of course, gave house investigators edited tr s transcripts of those white house tapes. It did not match the full versions of the recordings. Is that similar to this or is this minor because many argue what the white house did release was damning enough. I think we dont know quite yet how major this is because while we are hearing, you know, snippets, bits and pieces of what was said, we dont have the call in its entirety. Its unclear whether well get that. Its significant in part because it does puncture that talking point from the administration that the transcript proved that there was no coverup. Theyve been saying if we were trying to cover this up, would we have released the transcript and the president trying to say, i told you this was a perfect phone call. You can see that in the transcript. Plenty to disagree with, but if, in fact, that transcript was not complete, was edited, important things, material things were left out of it, that calls that whole talking point into question as well because it would indicate that, in fact, the transcript was cleaned up. General spider marks, always great to have you on. I like to bring the conversation back to why this aid matters. And its not just a political question heres ukraine. Its at word with russia. 13,000 ukrainians have been killed. Tell us in the simplest terms, why does it matter in this ongoing conflict that that aid was delayed for political reasons. How would that undermine the ukrainians . Im just curious, would russia seek to take advantage of such a delay . Oh, i would think they would take advantage. The larger picture here is russian i would say constant pressure where the United States has either vacated by influence or is trying to establish what its role, the United States role might be in some region. What we see is really kind of a containment in reverse from what our policy used to be over the course of 60 years. What we see the russians doing which is pushing back in terms of where the United States seems to be engaging. So you look at ukraine. The activities that occurred in 2014 with the annexation of crimea. Now an ongoing civil war with participation from russia in the donbas, and it would go the way of crimea. Its a big deal that the United States to state emphatically its role visavis whats happening in that part of the world and then get all the economics and the oil and gas and all of that. But it is critical of the United States to establish its influence. Military aid is one of those elements of power by which we do that routinely. Of course. Rorks to you. How what does it mean for charles cupperman. He shares a lawyer with john bolton. What does it mean for him and bolton that all of these witnesses including Catherine Croft today and Christopher Anderson are complying with the subpoenas and coming to testify. Will the courts consider that in their consideration of kuppermileanhour . Instead of coming like many witnesses have, or having his lawyer write a letter as some witnesses have, saying im not going to come, he took an unusual step. He actually went to court and said on the one hand i have the house telling me to show up and the white house tellinging me not to. I dont know what to do. I want to do whats right. Court, you decide. Its unclear right now whether a court actually will get in the middle of it or just say its not its sort of not for courts at this point at least to decide what to do. Let the executive branch and the house sort of work it out themselves. You know, i think its sort of a move of somebody who cares, i think, about how they appear in public and who wants to sort of telegraph that theyre trying to do the right thing. Lets wait for the white house and the house to clear tup themselves. Put some money on that. Molly ball, lets ask about the politics here of democrats having this vote tomorrow. Seemingly in an attempt to take away some of the fire from republican criticism here about a closed process, et cetera. Does this do the trick . Well, yes and no. I think for one thing, i think the reason that democrats didnt do this before and hold the vote before is because they always viewed the republican criticisms, this particular republican argument as disingenuous, and they always assumed if they did hold a vote, republicans would find something to object to and thats exactly what we see happening, moving the goal post rather than saying all we wanted is the vote. We view the process as legitimate. Theyve just order other arguments to continue to argue its illegitimate. I dont view this as a Public Relations move by the house democrats. I think its an opportunity to take control of the process. This is our house. We make the rules and were going to decide how this process unfolds. You dont get to dictate it or tell us thou how to do our busi. Weve seen not very much respect for that from the white house but its the houses jurisdiction and this is the message theyre sending. Its so clearly laid out in article 1, section 2. Its right there. But, you know, the white house, of course, is still going to weigh in on it. You can see the document, yeah. Although we have seen the constitution being pressed by the white house and the president questioning the what did he call it . The phony emoluments clause. Help us understand how vindman being the position he is, an army ltc in the room on the call with President Trump and the ukrainian president. The role of that. Because the white house knew he was on the call. Sure. Lieutenant colonel vindman is what we call a foreign area officer. Personally identified early on in his career with a number of skill sets. Hes probably a native russian speaker, was born in the former soviet union. Grew up here in the United States, gets a commission. But he has these skill sets and the army requires everybody who is in that role to prove yourself as an army officer. So he has the credibility of being in combat. He wears the combat infantrymans badge having earned that in combat. Awarded the purple heart. Hes an unimpeachable representative of an incredibly unique capability. Its not unusual that hed be in the room. Hes got a very narrow, limited view. Hes a ukrainian specialist. But hes working in the National Security council which means hes risen through the ranks and identified by a number bofsof bosses. He was in the room by invitation. He could understand the conversation on the other end. Didnt have to go through a translator. So he has a perspective that many in the room did not have. So his voice is very, very credible. Plus, based on the education that Army Officers get, if i can give this a couple of seconds. Were trained to not only develop ourselves as individual leaders but Leaders Within organizations. So he has a very clear picture of what right looks like and when he heard the conversation, he raised his hand and said something seems amiss here. Folks, dont buy the character assassination. Hes a soldier. Hes an american. Hes proved his loyalty. Its lunacy to go down that path. But has shown you that, listen, there are no rules in the current conversation. Theyll mark up a resolution that will lay out the rules for public hearings as well as the direction of the inquiry. Lawmakers will then take it to a floor vote tomorrow. Thats key. Theyll have to be on the record now. Congressional reporter lauren fox is on capitol hill. I mean, its pretty obvious nancy pelosi doesnt go to a vote without knowing the numbers here, but you do have at least one holdout democrat from the state of new jersey. Any objections or changes expected at the markup today . We dont expect any changes at this current moment. Of course, its several hours to the markup and a lot of things can always change on capitol hill when were talking about this impeachment inquiry. But many lawmakers are saying this is a welcome announcement. The fact that this is going to expand the rights of the republicans on the committee. At least give them the opportunity to request documents as well as witnesses with consultation from the chairman or a vote of the full committee. That, of course, gives democrats the advantage there given the fact that they do control the house of representatives. But it also expands the rights of the president of the United States to defend himself in these proceedings. It gives his counsel an opportunity to crossexamine witnesses to have objections to what is going on during these public testimonies. And i think thats going to be a key change in what weve seen in these closed door depositions. Democrats are saying this is not a reverse in our position. We had to do these closed door depositions because we are undertaking an investigation. But, obviously, this is a welcomed development for Many Democrats who were arguing they wanted to take that public vote on the floor. Stay there, lauren. Well bring back ross garber. Before we go to ross, very quickly, i imagine youve been canvassing republican members of the house. Lauren, do you believe do we think well, well get back to lauren in a moment. I know what youre going to ask. Its a good one. Lauren, any republicans likely or possibly going to vote for this resolution . Vote in favor . Well, i think a lot of republicans are arguing this is just a little too much, too late. And thats basically the argument weve heard from many of them is that, look, this doesnt really give republicans the opportunity to issue subpoenas or request witnesses if you have to do this with consultation from a democratic chairman. You have to have a vote of the full committee where democrats already control that committee. So theyre arguing that just a democratic talking point. This really does nothing to establish the rights of republicans. And i think that leadership is basically were united behind this. You saw that was something that republican lawmakers were tweeting over the last several hours saying that after meet with the president last night during that fundraiser, they are walking away feeling very united as a party. That theyre going to stick together on this vote. Of course, well be watching if there are any republicans who cross the aisle. A little rich of a point if youre asking for the right to crossexamine witnesses, call your own witnesses. You get those rights and say its too little, too late. Its somewhat predictable. Okay. Thanks, lauren. Ross, give us the intel. Compare this to the clinton impeachment for us, if you could, in terms of the rights of the Minority Party here. Yeah, so the comparisons arent direct because, remember, in clinton, the starr investigation happened the starr report was done and submitted to congress. But notably in clinton and nixon, the rules allowed a role for the president s lawyers. Specifically to crossexamine witnesses. And here, i think what the republicans are saying is, what they were demanding are a vote. They were demanding things happen in public. And they were demanding that the republicans and the president s lawyers get some rights. I think what theyre going to argue here is that the rights for the president s lawyers and for the republicans actually dont happen until they are too late because they are only applicable to the Judiciary Committee. And the public hearings that are coming up are going to be with the three committees that are already doing the investigation. And by the time things goat the Judiciary Committee, everything is already going to be done. Theres going to be a report. The rules provide these committees are going to produce a report to the Judiciary Committee. And so the way that rules look, it doesnt look like there are going to be witnesses that actually testify before the Judiciary Committee. So its probably going to be too late for the president s lawyers to actually do anything even if they could. I think thats what were going to hear from the republicans. And its a fair point, i think, that the clinton rules and the nixon rules actually are different. Meteorologists just want people to understand the threat, the level of threat were seeing and the fact this has not been reached in at least recent history. Now part of what they fear in this, lets start with winds. When you talk about the getty fire thats still burning, winds have the potential to take these embers far outside Containment Zones and start to make fires in places there werent to begin with. It goes back to how this getty fire started in the first place. We learned it was high winds that ripped off a tree branch and sent it flying into a power line and that sparked the blaze thats burned more than 650 acres and burned more than 12 homes. Forced thousands from their home as a precaution. So when you look at the week ahead, we have already seen this morning wind gusts topping 65 Miles Per Hour in some parts of Southern California here. And were getting initial reports there may be another fire that just sparked in the last five or six minutes or so. So were going to try to keep an eye on that. So right now another state Department Official is testifying behind closed doors sharing what she knows about the trump administrations decision to withhold that aid from ukraine. According to the Opening Statement that has been obtained by cnn, Catherine Croft will testify that she learned that acting chief of staff Mick Mulvaney put a hold on that Security Assistance and said the only reason given was that the order came at the direction of the president. With me now is Vermont Democratic congressman peter welsh. He serves on both the house intel and oversight committees. I know youre going into that testimony right after we wrap up here. So lets get right to it. What questions do you have for ms. Croft . Well, its what you said in your opening. What were trying to do is a thorough investigation, who knew what, when. This all starts with the president s own language. His phone call and the read out of that call where he asked for a favor. And basically used his office to try to get a foreign power to assist him in the 2020 campaign. And what were doing with these witnesses is finding out what, if any information they have to corroborate what was obviously the intention of the president according to his own words. These two this witness is a career state Department Official. You mentioned she has in her Opening Statement, but our questions both republicans and democrats will be do you know anything more and well try to get corroboration. Okay. Lets talk about whats happening tomorrow. That is a full house vote on this impeachment resolution and the rules for it. You have obviously got a lot of democratic support for this. Nancy pelosi wouldnt take it to the floor, i think, without knowing the votes but you do have, for example, new jersey democratic congressman jeff andrue who is a no and he said recently, i think the right side of history is not to impeach. Do you expect others to join that camp . I dont think too many. And keep in mind theres a couple of things. One, there was a lot of reservation about proceeding on impeachment led by nancy pelosi and that really did change after the ukraine call and it became a question as to whether there was a constitutional obligation to proceed. Mr. Andrue is in that camp and well see. Tomorrow is about the process. Its really not validating the inquiry. Thats been ongoing. And this process is going to be very open allowing the president and his attorneys to be present during the testimony. And hell be able to ask questions and see things. Let me ask you a little bit more about that because what weve learned from reading this and, you know, and from impeachment experts like ross garber who was just on the program a few minutes ago, yes, it lays out that the president s attorney would be able to be in the room, would be able to crossexamine witnesses but not until it reached the Judiciary Committee stage, right . Which is and its different than the clinton impeachment. You already had the ken starr report, the road map. The republican argument, as i understand it is, this isnt really fair because the president s attorney cant be in there crossexamining during this stage of it, right . With your committees and the questions youre asking. Should they be afforded that opportunity so you can really argue, you know, full transparency, full equal rights . No, you are partly right but heres where its different. In the clinton impeachment you had a special prosecutor. In this case, the special prosecutor in effect is the Intelligence Committee and the hearings were conducting with the two other committees. So that stage, which would be comparable to the mueller investigation, the obstruction of justice issues, is the part that is done in private for investigation reasons. So thats whats really different. The special prosecutor in effect is the intel committee. You make an important point. I understand the difference but im glad you laid it out for people. I wonder if you see any merit to republicans argument here because they are different scenarios than back in the late 90s. I dont. And heres why. When you do an investigation, youve got to get the witnesses in private so theyre not doctoring the testimony and, really, preparing it in advance on the basis of whats been reported publicly. Thats the normal approach. When we get to the open hearing stage, everyone is going to hear from many of the witnesses who weve heard from in private in realtime. And there will be an opportunity for the republicans then just as there is now in these closed hearings for them to ask questions. So my view, this is a fair process and very consistent with prior history. Right. There are 48 republicans between those three committees that can be in there for all the hours of testimony asking whatever questions they want. Mark meadows has said no limit on questioning. Do you think its important to hear from the whistleblower . I dont really. Maybe added color but what youve seen with the whistleblower report, the incredible details that was in that report is confirmation from everyone from the president s phone call that came out after the whistleblower report to Mick Mulvaneys statement in public to the other witnesses. So the whistleblower, i dont think at this point the whistleblower got this started but the whistleblower didnt have firsthand information. It turned out that the firsthand information he lacked has been provided by many others, including Lieutenant Colonel vindman yesterday. Okay. Finally, when it comes to what other members of congress can do right now, for example, members of the committees who are not going into the room, like the congressman who until yesterday had not attended any of these depositions, the Ranking Member on the Foreign Affairs committee, mike mccall wrote a letter complaining about the process and your staff claims the only way to have access to the transcripts is in your offices during designated hours under the personal supervision and monitoring of a majority staffer. Is that fair, do you think, congressman . Well, theres two issues. One is, do we want to make the transcripts available to all members of congress . Yes. Do we want to keep the transcripts private until theyre disclosed publicly . And that requires some process where theres some limiting of when and how you can see it. We just dont have the staff. I think we can be flex oibl tib that to accommodate the desired members. So were open on that. Maybe there should be some give there. I appreciate your time.
