The phone call was in the context, i guess i have been secretary of state coming on a yearandahalf, i know precisely what the american policy is with respect to ukraine. Its been remarkably consistent and we will continue to try to drive those set of outcomes. Its actually not remarkably consistent when you withhold aid, but that aside, all of this would seem to make pompeo a fact witness in this probe. Now democrats are, in part, up in arms about. We are covering this from all angles this morning. Lets start with our correspondent manu raj just. Where does this thing go from here . Reporter well, today there is a high interest in what happens with this Inspector General from the state department who sent this email to capitol hill about an hour i am told after mike pompeo sent a letter saying he would essentially fought comply with the democrats request. Its essentially a subpoena that ask for documents related to the ukraine matter and scheduling five depositions. Afterward, he said it was urgent he had to have this briefing with key congressional staffers with several committees in the house and the senate. L lennoc has been with the innextor general since 2013, he was confirmed by the senate by a voice vote. He has bipartisan support. Republicans and democrats are not sure what this is about, the email sent to capitol hill, simply said this is related to the ukraine matter. There were documents he obtained from the Legal Adviser of the state department. So what that exactly means is uncertain. How much fuel that adds to the impeachment fire is uncertain or does that do anything to dissuade democrats in anyway, that is a major question. Inspector generals operate independently of these agencies. With the Inspector General, the Intelligence Committee deemed it credible and urgent which fuels this investigation right now. So well see if this other Inspector General gives any more fuel to this fire. Thats why you have inspectors general so they can provide a nonpartisan view and oversight of government. Thats right. Well see if it works. Thanks very much. A lot to discuss. We are joined by a congressional reporter for the Washington Post, a White House Correspondent and associate editor for politico. Rachel, it strikes me, you look, for instance, Rudy Guiliani last night seeming to point the finger at some degree at the state department saying, hey, they told know do this. Now josh rogan is saying voelker, until recently special envoy for ukraine, hes going to testify he was trying to contain the damage of this president. It strikes me you are starting to see Division Within the ranks in the Trump Administration here on actually what happened over this ukraine call. Yeah. Certainly some finger pointing here. Clearly guiliani wants to say hes not the only one involved here and everything was kosher when folks at the state department reported this was a shadowy trump operation within the state department, that they were sort of operating on their own and not exactly following orders. So what is interesting here, i think, if you look at capitol hill right now is we have seen for the past couple of weeks cuping months, really the white house stonewall ever effort democrats have had to try to investigate the president. And this is the first time were really seeing folks from the administration current or former go around those orders and come to congress both to the state ig who will be coming to the hill today, sort of defying pompeo and other state employees who were involved in the ukrainian matters who are going to be coming to talk to congress. I think thats really a game changer for democrats right now. They have people willing to cooperate to sort of get down in the weeds and find out exactly what happened here. Rachel, let me ask you about something that struck me, anita, sorry about that. Chuck grassley yesterday coming out with a statement yesterday defending the whistleblower essentially taking a swipe at his republican colleagues who have tried to undercut the process for filing these whistleblower claims and spreading disinformation. How significant is that from grassley knowing that, yes, she a huge advocate of whistleblower protection. For him to feel the need to put out a Statement Like this at a moment when pompeo is blocking congress from getting the depositions they need and the documents they need on this front. I doily the its very significant. I dont think you can underestimate that. Now, Chuck Grassley is the kind of guy that has gone out there before and broken with his party on a couple things. I think its significant because of what the president is saying. The president is out there. His rhetoric is getting stronger every day saying the whistleblower should be outed. He wants to talk to the whistleblower. So i think that he was sending a message both to his colleagues on capitol hill but also to the president that we need to let this take its course. We need to protect the whistleblower. And so i think it is very significant. Now, whether other republicans will follow right away is unclear. We need to see you know what more is going to come out of this. I think this is extremely fast moving, though. We havent seen Something Like this in all these months we have investigations. These its just the last couple weeks that weve seen movement. I figure its wednesday this week. Where were we last monday . Not here. Its developed a little over a week. The pace is remarkable. I want to ask you, rachel, about the secretary of state here, where his credibility is on this . One, he was on the call, a lot of interviews where where he was claiming complete ignorance about this call prior. But he also has the president s personal lawyer taking shots is the right word but pointing some fingers as you said. At the state. Hes with the state. Hes worried about his longterm political aspiration, mike pompeo. How does he view this . Does he stay in lockstep with the president here . In there especially if he wants to run for senate at some point. Absolutely, he has to worry about that clearly, hes done a two step, sort of brushing off and acting like he didnt know anything, admitting this morning he was on that call. I think from somebody who covered him when he was in the house. I covered when he was on the sweat committee on benghazi, when the republicans were investigating Hillary Clinton and pompeo over and over again would demand documents, demand witnesses over countless times. So its sort of interesting to see him on the other side just blocking this, sort of going along with the white house strategy of complete stonewalling when he was making the total opposite argument a couple years ago when he was in congress. And the other thing that, of course, we will hear again from democrats and i assume, i would expect pelosi to bring this up in her News Conference in a few minutes is admitting he was on the call as you guys mentioned, thats in their view a conflict of interest and he needs to recuse himself, theyre going to argue when it comes to all these documents and witnesses. He should not be the one to green light or red light whats happening. An interlocutor. You are right to bring up barr, anita to both those points, rachels and jims, you can holler all you want if you are a democrat in congress about that and there is a conflict of interest. You are a fact witness, you need to recuse yourself. That doesnt mean he does. Right . Right, absolutely not. I mean weve seen as rachel mention e mentioned for the last nine months, congress saying all sort of things to the administration. You need to do this its the law. You need to give us these documents. You need to testify in certain ways. Theyve ignored them. Thats why republicans and democrats are in court right now so mike pompeo, you know, is going to do what mike pompeo wants to do, what the white house wants him to do. Talking to people in the white house and outside the white house that are close to the president , what he did yesterday was not surprising at all. Yeah. There are a lot yeah. Can iiaed to that point, though . There is a piece in the Washington Post about inherent contempt. Its a phrase that was brought up in that Washington Post opted by those seven vulnerable House Democrats. Remember last monday that sparked all this it is a move that congress has, ahni that, inherent contempt. They havent done it in 100 years. You are right. I was actually talking to someone on the House Oversight committee Gerry Connolly of virginia the other day, a democrat, who was saying he is actually pushing. He would like them to use it. But there are other people in congress, obviously, leadership that are not willing to take that step yet. It could come to that point. So far, theyre allowing everything to move to the court and letting judges decide. The problem with that is that it takes a long time. Yeah. So we got some news in. S. On deliberately falsified charges. There is a lot in there. That would seem to indicate, does it not, rachel, that this administration is not going to cooperate with the impeachment . Wasnt that a threat to sue congress . Yeah, definitely, for sure. The interesting thing about that tweet is that hes saying congress is exceeding its authority. Everybody who has been watching this and who has watched congressional oversight for the past few years, decades, knows that we have seen Congress Oversight authority totally trampled by this president. Such that a lot of legal experts say where is the separation of powers . Congress used to be able to ask for documents to hear from witnesses, bring them up to the hill even when republicans have the majority just a few years ago, the Obama Administration reluctantly did that with a lot of their administrations. That has totally been thrown out the wazoo. Everyone everybody, democrats, say she trampling their authority and they feel powerless. I understand something about new subpoenas in this to the white house . Reporter thats right, Elijah Cummings the oversight chairman is warning theyre issue a subpoena as soon as friday to the white house to get documents related to the ukraine probe. He is doing this in conjunction with the two other committees now involved with this investigation. Its the house Intelligence Committee and House Foreign Affairs committee. He actually sent a memo we obtained saying by friday if these documents are not turned over, then they will issue a subpoena. In this letter that is about to go out to the white house counsels office, they warn that there is they say there is concern about Rudy Guilianis efforts in ukraine and they say that there are questions about exactly what occurred and theyre saying that they are asking for a range of communications and documents. Theyre saying the white house needs to preserve documentation about what they may have had in terms of urging ukrainian officials to move forward with an investigation to the president s political rival joe biden. And they say that they want all these documents by, immediately. They said if they dont get these documents, then this will happen, the subpoena will come out by friday. But this is an escalation after we saw last week, the House Foreign Affairs committee issuing the subpoena to the state department saying that they should turn over documents because of part of this investigation into ukraine and part of the efforts by Rudy Guiliani to go over to ukraine. Those subpoenas that subpoena has not yet been complied with. There has been a subpoena by the house Intelligence Committee for Rudy Guiliani to turn over documents related to his communications and everything he has done from the beginning of the Trump Administration as the president s personal attorney. Now we are seeing this, the subpoena that could be issued in a matter of days to the white house asking for more documents. So what were seeing, putting all these pieces together, poppy, a rapidly escalating impeachment investigation. Well see if the white house complies. So far what we have seen from the Trump Administration is resistance on all fronts to turning over these records, which presumably could be what democrats are warning is articles of impeachment, obstruction of congress at this point. They have special powers over the impeachment inquiry more expansive than other subpoenas. But with know ethis white house, they have resisted subpoenas before. What do you do if the white house says we aint going to answer you . Well, we will proceed with this. We will fight back any attempt to obstruct this impeachment investigation. We know that we want to find out what was Rudy Guilianis role. Once pompeo admitted to being a part of the conversation, hes now a witness to this impeachment investigation. And we want to get to the bottom of this. We submitted these subpoenas. And we are expecting them to be there. And we reject any and all attempts by the Trump Administration to stonewall or intimidate witnesses from coming forward. If they do not comply, if the white house does not comply with these, does that become another article of impeachment . That may become another article of impeachment. We will look at any and all legal possibilities to move forward and gotothe next level. As we should and as its entrusted to us by the u. S. Constitution. But when you read that, in effect, it seems that he is saying we are carefully considering our Legal Options to seek redress against congress and individual members. Is it Rudy Guiliani, the president s lawyer . Is it Rudy Guiliani the quasistate Department Officer . What was he doing in madrid . What was he doing attempting to meet with you kra Indian Officials . Thats the real question. The real question is, what was his role and what authority he had . Right. What role did he play visavis the state department . What guiliani seems to be playing thoet tweets is congress those tweets is congress is going beyond its role, this impeachment inquiry ineffect invalid. If they sue, what happens . Especially suspect we will hear a lot from Rudy Guiliani as the weeks and months come forward. Nothing surprises me from him. But the real question is, what was his role in all of this . Does this threaten . Because nancy pelosi has proposed a very ambitiously fast time line for this impeachment inquiry. She wants it to be done in effect by thanksgiving. Thats less than two months away, and have a vote by then, as you see the white house and others throw up road blocks here, is that time line still realistic . I think most of the American People want to get access to this information as quickly as possible. The white house doesnt want you to. We will fight back in any and all attempts to obstruct this impeachment investigation. I want to talk about another issue. This relates to the 2020 election and interference. The president of russia who interfered in the 2016 election made it like a joke today, talking. He was asked about interfering in the 2020 election. He jokingly said ill tell you a secret, yes, well definitely do it. In reference to interfering in the election again. He added an aside, a stage whisper, just dont tell anyone. The fact is u. S. Intelligence does believe that russia will attempt to interfere again. Is the president in your view taking that threat seriously . I dont think so. Because lets take a look at this whole matter. The russian involvement in the past election was in the past and the president was not in office. He was not able to use government to assist the russians, putins involvement in the election. He uses campaign apparatus. But now this is prospectively. Now the president is a part of government. Hes going around asking foreign powers to investigate one of his opponents. I think that gives the green light to people like putin that come in and do whatever you need to do to get me reelected. This is far far too aggressive for any citizen, for any american. And i think thats why the American People want this impeachment investigation to move forward. What does that say, though . You are saying the president not only is not only defending against russian interference, but hes participating in interference, asking a foreign power, in this case, ukraine, to investigate a political opponent for folks at home who are watching this election closely and want to use their cherished right to vote do they have confidence in this. Thats an assault against a fundamental right of democracy, which is your vote and my vote. The validity, which is a great equalizer. Your vote and by vote i propose weighs the same. So any attempt to erode that is an assault against democracy. Its an assault against the United States of many earthquake. I want to talk to you about the immigration issue. Im sure are you aware of a New York Times report. The president has talked seriously, it seems, about ideas, including shooting migrants in the legs, so that they cant cross the border and fortifying the board twer a border wall and a trench filled with snakes and alligators . This is vigilanteism coming from the white house. This kind of attitude this kind of mind frame promotes vigilanteism. It promotes theory that you as a private citizen could take a gun, maybe even an assault weapon and shoot randomly people who may or may not be immigrants. This is horrendous. This is government at its very worst. Vigilanteism comes into play when government erodes, when government collapses. Thankfully, his staff quoted in the New York Times did tell him not surprisingly it would illegal to shoot people in the legs as they come towards the border. But on other issues like a moat with snakes and alligators, folks im not making this up, you can read it in the New York Times, they took steps to do a cost estimate. We are learning about a vintage world war ii plane that crashed in connecticut. Its a b17, typically a crew of at least two. Do we have any sense now of casualties . That this was going to possibly be coming last night on fox news. Listen to guiliani there. We should bring a lawsuit on behalf of the president and several of the people in the administration, maybe even myself as a lawyer against the members of congress individually for violating Constitutional Rights, violating civil rights. So that, is that the white house strategy now, sue congress . Apparently. Every time you hear something from rudy and you think it cant get any goofier than this he thinks up another crazy idea. I mean, he has it backwards in terms of who has the protection of the constitution in a proceeding like impeachment. Its actually the congress that has both the power to execute on that, that process, the impeachment process. And, you know, the congress right in the constitution has immunity from lawsuits and something called the speech and debate clause. I dont want to get down into the weeds with you. But there is simply no basis whatsoever for a lawsuit against congress. It is crazy and he is trying to run out the clock. Its interesting. Im glad you laid that auto for us. As soon as i read that from guiliani a few minutes ago, i was wondering, can they even do that . You are saying, no, it is prohibited. He cannot sue congress . Yeah. And their a fundamental i think there is something very fundamental going on with the trump people. Theyre making an assumption that with all the judges theyve appointed and so on and the Supreme Court that might befriendlyier than it used to be, that, you know eventually the courts might bail them out. I think that is a terrific miscalculation. Because i think that judges in this country, the federal judges in this country understand well the system of checks and balances. It is the most important you know sort of foundational point about our democracy. That we have three coequal branches of government. They hold each other in check. They hold each other in balance and what trump is trying to do here is totally rearrange the power structure of the federal government. I dont think that the federal courts will going to go along with that and allow him to diminish congress, to his own benefit, particularly his other than personal benefit, his own political benefit. I did a piece, by the way, in the Washington Post a week ago today essentially saying if congress doesnt utilize its power to hold people in contempt through a process called inherent contempt, that it will become, in fact, something other than a coequal branch of government. So i think what you are seeing now is congress saying, were not going to put up with that we are a coequal branch of government and you know rudys threats are meaningless and i again, i think theyre trying to stretch out the time here and allow trump, they think they can run out the clock. But they cant. Because they dont have a strategy. The democrats have a strategy and part of the democratic strategy is to just let them behave foolishly and outrageously and begin to lose the war on public opinion, which is the critical part of it going on here. He apparently had chest discomfort during an event yesterday and they smartly immediately took him to the hospital to have it addressed and thats where the blockage was discovered. You know, i can take you back, jim, to an event that Bernie Sanders was a part of back in the spring in South Carolina where he woke up and actually hit his head on a glass door in the shower and had a huge gash over the top of his head. He had, was stitched up and came to the event later that day, did not miss a beat and then ended up doing a number of elents e ven event right after that. His health a point of pride for him. His pace of campaigning has been so intense i think of the Democratic Candidates who are running for president right now. He is known for really being fawn stop in sort of the pace of his events, how much he travels and how frequent those travels and those Campaign Events have been and, obviously, we are awaiting more information from his campaign on exactly how he is doing. We know that hes in recovery. The statement said that he has been conversing. So that seems to be a good sign. Yep. But i think also just in the big picture, keep in mind that we currently have the three top Democratic Candidates who are running for president. They are in their 70s. In a lot of way, that is really unusual, right . Especially the incumbent president. We have Bernie Sanders who is 78yearsold. We have Elizabeth Warren who is 70 this year. We have joe biden who is 76. And i think you know politically this gets talked about sometimes, right . There is a little bit of rooting the candidates and rooting your opponents, raising questions about their age, but i think on a more, much more serious up level, this does bring into question i think questions that some voters have raised about health and age. Listen. We should be clear. Because others have had and live with stints for many years. Bill clint has had stint surgery, Vice President cheney, we dont want to under or overestimate the facts from a political standpoint, beyond the age issue. This comes at a crucial time in this democratic campaign. Right. I think ryan nobles, our sappnds reporters were saying on your show, this is a critical time for all the opponents, we are four months out from the iowa caucuses. The Bernie Sanders campaign has good reason to feel good right now. Their fundraising numbers released yesterday were incredibly strong. They feel good about through their organization, the Campaign Building that they have been doing on the ground. Yes, his number versus slipped a little bit in the polls compared to Elizabeth Warren, compared to joe biden, but they were going you know full speed ahead.
