The biggest winner in last nights democratic president ial debate may very well have been president barack obama. Moderates no longer running from obamacare, actually embracing it, pushing back at progressives big plans for medicare for all. I know the center said shes for bernie, im for barak. I think obamacare worked. Add to it, replace everything cut, add a public option, guarantee everyone will be able to have affordable insurance. On medicare for all, costs will go up for wealthier individuals and costs are going to go up for giant corporations. But for hardworking families across this country, costs are going to go down and thats how it should work. Every study done shows that medicare for all is the most Cost Effective approach for providing medical care for every man, woman and child in this country. I, who wrote the damn bill, if i may say so while bernie wrote the bill, i read the bill. On page 8 of the bill it says we will no longer have private insurance as we know it. The problem, senator sanders, with that damn bill that you wrote and that senator warren backs is that it doesnt trust the american people. All right. Athena jones is with us now from houston. Its good to see so much focus on the issue that voters say is the most important one to them in the election. What it shows us is how divided the party is on the answer. Hi, poppy. Thats exactly right. Health care has dominated the conversation for all three debates because its the main issue that you see these democrats disagreeing on. You laid it out right there in that mash up of the candidates, fight for progressives who want medicare for all but would eliminate private insurance and those who say it goes tore far. It will be easier and faster adding a public option to obamacare. Vice President Biden kicked it off when asked by the moderators are Elizabeth Warren and Bernie Sanders trying to go too far with their plans. He said its for voters to decide but highlighted cost. He said neither of those two candidates has been very clear about how much this massive overhaul of the Health Care System will cost. Biden arguing his own plan, adding a public option, is already costly. Elizabeth warrens plan, Bernie Sanderss plan would cost much, much more. You heard from Amy Klobuchar saying they dont want to lose their private health insurance. Polls show across the board thats not a popular idea. Shes saying its not a bold idea, its a bad idea. Its not surprising to have seen that debate continuing. Poppy. So Julian Castro was the latest far trailing distant trailing candidate to take a shot at joe biden in a debate, a personal one, and it didnt go over well, did it . It didnt. You could hear the reaction in the crowd. Listen to what Julian Castro said. This was about the debate during their health care plans. Take a listen. The difference between what i support and what you support, vice President Biden, is that you require them to opt in, and i would not require them to opt in. They do not have to buy in. They do not have to buy in. You just said that two minutes ago. You just said two minutes ago they would have to buy in. Are you forgetting what you said two minutes ago . Are you forgetting already what you said just two minutes ago . I mean, i cant believe that you said two minutes ago they had to buy in and now youre saying they dont have to buy in. Youre forgetting that. So you can hear the reaction from the crowd when Julian Castro, seemed to plan to be pretty aggressive all night last night. When he made that comment, you could hear the crowd kind of sighing, booing, not a positive reaction. Biden did have a somewhat muddled explanation of his health care plan, so he did come back and say, look, if you already qualify for medicaid, low income, you dont have to buy in. Youre automatically enrolled. Still, it seems like castro wanted to have an opportunity to have a standout moment. He may have had a standout moment in the wrong way because of the reaction of the crowd and the reaction afterwards in social media and elsewhere. Jim, poppy. Kmum nist for new york times, good morning to you both. Delighted to have you. Where do we start. Lets get to guns in a moment. Lets begin with even cory bookers ability to carry it to the end zone but he waited until after the debate stage and did it on cnn. Here was that moment. I think we are at a tough point right now because theres a lot of people concerned about joe bidens ability to carry the ball across the end line without fumbling. I think castro had some really legitimate concerns about can he be one in a long, Grueling Campaign to get the ball over the line and he has every right to call that out. Jim did a good job pointing out to one of his advisers in the last hour, he sort of said two Different Things last night on that front. Whats your read, kirsten. I saw it a little differently than other people last night on the panel a lot of people felt this was kind of, you know, cory going too far, discordant with his message of uniting. I dont agree with that. Look, he was asked a direct question and thats very different than just bringing something up, you know, making an attack against somebody. He was asked a direct question and he answered it honestly. He was saying he said later in the interview that, you know, it wasnt about age. This was something hes observed in joe biden for a long time. So i think there is a concern in the Democratic Party exactly what he said. Can he carry the ball over the line without fumbling it. I think thats a sincere question. It has nothing to do with age, because there are people in the race who are older and obviously are having no problems and there are people on the Supreme Court nobody thinks Ruth Bader Ginsburg is too old. Its not about age, its about joe biden and whether or not he can carry this to the end. David gergen, the voting public doesnt seem to share that concern, does it . Biden maintaining a lead for months now and particularly on electability. Even as his lead has thinned a bit in relation to particularly Elizabeth Warren on first choice in terms of who has the best chance of beating donald trump, the clear choice is joe biden. Thats exactly right. If you watched the debate last night and you were in the biden camp, you werent in the biden camp last night. I do think castros chance of being on the ticket as Vice President went down some last night. But overall i thought the debate, you know, was one of those kind of things that everyone has a different interpretation. There was no dominant theme that emerged. From my point of view, if you never heard anything about democratic politics, walked in for the first time and watched that last night, you would say, you know, second tier candidates doing pretty well. Looked better, more relaxed, more pointed. First tier candidates tend to be more defensive. They try to rush things too much. If they could just slow down and be more conversational, you would be more welcome in living rooms across the country. Beto orourke may have saved his campaign for a little while here at least. Lets listen to this moment that stood out to everyone on guns. Hell, yes were going to take ar15, ak47, were not going to allow it to be used against fellow americans anymore. All right. So democratic senator chris coons just told me last hour that is a clip that will be played for years at Second Amendment rallies to scare people and say democrats will take your guns away. It got broad applause but did it really help him in the long run . Is it going to hurt the democrats on the gun efforts now . Whats your read . I just want to quickly address the biden thing. Jim, you were saying hes the frontrunner. I think an important thing with him, though, hes on a downward trajectory. Hes not he has been losing. Hes been going down as Elizabeth Warren has been going up. Im not sure hes necessarily somebody who people are overly enthusiastic about. A lot of people are parked with him but i dont know if they will stay with him. Beto, i think he had a great night last night. I appreciate his moral clarity. I happen to agree with him. I do think, poppy, you hit on something. As much as he was saying it, as much as he is substantively correct this is what the country needs, i think it could be a very difficult message for a general election. I think its true. This is something this is what people are always saying democrats want to take your guns and thats essentially when hes saying. Its that message that i think democrats have pushed back against. So its risky. Thats all i would say. David, can that fear be overestimated, though . Lets look at some of the recent polling, monmouth poll from august just last month, 56 of the public supports banning future sale of assault weapons. Of course thats different from taking away existing ones. Npr pbs poll, should congress create mandatory Buyback Program of assault weapons, there its split down the middle. There is a difference. On the Bigger Picture here, do democrats overestimate the fear but not leaning more into gun control measures . Its an interesting question, jim. My own feeling is that in general the general direction of what the democrats are proposing this election are very mainstream and i think will be bought into by a lot of people. The danger is when they go a bridge too far or two bridges too far, theres a big difference in peoples minds whether, in fact, they are going to you create an option for them in medicare and decide for themselves whether had a really wonderful argument on it, trust the people to make up their minds and play with an option for three or four or five years and then decide to go on. If you insist no, no, no youve got to get rid of the insurance companies, no, no, no you cant keep your ak47, no, no, no youre not going to be able were not going to make any pledges on this or that, i think it puts them in an uncomfortable position. I do believe over time the old adage that applies in politics is still going to be true and that is can a democratic primary go to the left when the nominee gets the post. You come back more toward the center and vice versa for republicans. Although that didnt hold for donald trump in 2016. Point of order. Chairman jerry nadler vowing to, quote, hold aggressive hearings as they investigate the president. Took steps yesterday to outline exactly how that process would work moving forward. As soon as this coming tuesday we could see testimony from former trump staffers if the white house allows it, of course. The process is a far cry from actually voting to convict the president. Notably a word in the debate last night that didnt come up, if at all, impeachment, on the very same day the house judiciary votes to begin these formal proceedings. The candidates who want to grab as much public support as possible arent sensing public support for impeachment. Of course, you support it. Well, jim, they have a different job. They need to inspire the country and convince them on a positive vision. We in the house have to hold this president accountable unseparation of powers. So jerry nadler has begun an impeachment investigation and thats how constitutional duty. I fully expect hes going to be aggressive and make sure this president is held accountable. For that to be a rolistic impeachment effort, you also need public support and commitment and the polls just dont seem to show youve got that. So what is the end result of all this. Hes going to build a case. I mean, the polls, as you know, can change. What hes going to do highlight sale of office, emoluments clause where the president may have profited or his family may have profited with u. S. Tax dollars, highlight serious issues of obstruction of justice. We will build a case and see where the facts take us and look where Public Opinion is. Topic that came up, real focus last night, of course, guns. We just spoke about it prior to you in the panel, beto orourke saying he supports not just ban for future purchases but buying back requiring buyback of folks who already own these kinds of weapons. Do you think thats a bridge too far. I agree with senator warren and senator sanders, we need to have an assault weapons ban and voluntary buyback. Lets first do an assault weapons ban. When the president did that, led to 138 decline in Mass Shootings. You can have aggressive voluntary Buyback Programs. I think where the democratic should be. I see. Dont force the hand, in effect, the way beto orourke seemed to be stating last night. I would be more where warren and sanders and biden are, which is a voluntary program. I think you can do that effectively. Theres a voluntary buyback bill in the house. We ought to get a vote on that and the assault weapons ban. Those are two things that would go a long way. We havent been able to pass that out of the house. You, of course, support Bernie Sanders as cochair of his 2020 president ial campaign. The polls show some worrisome signs for him. Elizabeth warren seeming to eclipse him. His support flat or declining. Do you feel that his voice is fading a bit in this campaign . Jim, i really dont think so. There was a recent poll that had him first in new hampshire. I do agree with you this race is going to come down to senator sanders, senator warren and vice President Biden. They would acknowledge polls are all over the place and any of those three could emerge. I feel good about senator sanders standing in the early states, particularly iowa and new hampshire. Youre right. National polls show one thing and this is all about states, early voting states and they can upend things. The current frontrunner, former Vice President joe biden you saw Julian Castro take a personal shot at him. Afterwards you saw senator cory booker question whether hes the guy to carry the guy across the end zone, into the end zone as he said. Do you think joe biden is a weak frontrunner for the democratic nomination . I dont think he has the vision to take us to the future but i think as a person hes had such an admirable story. When he spoke about losing bo biden and almost choked up, i think we have to respect his service so i didnt appreciate the way castro attacked him but i think the argument needs to be about the future and he is not the change agent for the future leading the party. You can say that still respecting his lifetime of service. Thank you for going high on that. A shortage of that in washington today. Final question, with the departure of john bolton, president S National Security adviser you wrote an oped, americans can breathe a sigh of relief with bolton gone. Are you concerned about what may be the end result of this, which may be the president may be his own National Security adviser, someone more pliant than he had in that role so far. I dont see who could be worse than john bolton, a cheerleader for the war in iran, cheerleader for war in iraq, ripped up the agreement bill clinton struck with north korea to help end their Nuclear Program in the 1990s. I hope the president will pick someone with greater military restraint in the role. I am concerned there have been so many changes in National Security advisers but i really dont think you can pick anyone who would be worse than bolton. Prosecutors want the actress to spend a month in prison and pay a 20,000 fine. Her lawyers are pushing for probation and Community Service only. Of course she pleaded guilty earlier this year to paying 15,000 to boost her daughters s. A. T. Scores. Shes the first of 34 parents facing prosecution in this case. Paul cowen our analyst and former new york city prosecutor is with us. We find this whole thing astonishing and riveting at the same time. Okay. So prosecutors suggest one month prison time and a fine . Her lawyers say just probation. She wrote this letter to the judge imploring the judge to give her a break here with a lot of contrition. Whats going to happen . I have to think theres a good possibility shell get no jail time at all. The reason i say that, the judge shes in front of sees a docket all day long of terrorist, drug dealers, people who have committed murders, then in comes Felicity Huffman who used 15,000 to bribe her way into college or her daughters way into college. Thats a relatively minor crime on the list of federal crimes. In addition, the prosecutor only has recommended 30 days in jail. And judges a lot of time compromise between what the prosecutor is asking for, usually the toughest sentence, and what Defense Attorneys are saying. Defense attorneys are saying Community Service and a 20,000 fine would be appropriate. So my bet is that if she gets any jail time its going to be a tiny amount and she will get the fine, the 20,000 fine. So paul, of course, as you know theres other defendants in the broader scandal here who committed worse crimes. This was paying money to fake s. A. T. S. You have the others who paid hundreds of thousands to outright fake athletic achievements in high school and reserve them positions on College Sports teams and therefore positions in the college. If she is not sentenced or sentenced what does that mean for other defendants like Lori Loughlin who are fighting, who have not pled guilty, about what they are likely to face. A lot of lawyers looking at this say this may set the standard for how the parents are going to be treated in the case. When you look at her conduct compared to some of the other parents, under the federal sentencing guidelines, one of the things they look at, for instance, is how much money was used to do the act, to bribe the way into college. In her case it was 15,000. There are other parents who spent as much as 6 million to get this kids into college. So shes at the lower end of the spectrum. I think the judge is going to be conscious of that. I think we should expect she also pleaded guilty early and accepted responsibility. That means an enormous amount under the federal system. Sheets credit for that. That will set an example, by the way, for others maybe that it would be in their interest to plead guilty and not put the system through a trial. They defrauded the schools, they defrauded their kids, right, thats another headline from this, just incredible. For sure. For sure. Paul, thank you. Clearly, during the debate last night cory booker went on attack as well after the debate ended when he joined us on cnn. This morning top officials in the biden camp warning castro has not learned the lesson about attacking the Vice President in personal terms. Communications director for biden 2020 is with me. Good morning. Lets start there and get to some of the key issues last night. This is what you said, quote, secretary castro likes to tubing about who has learned the lessons of the past. I think its very clear he hasnt learned the lesson attacking joe biden in incredible personal terms is no way to advance yourself in the polls. What is the lesson and from whom . I think a number of candidates have tried so far to distinguish themselves or make a name for them sells or boost themselves in the polls trying to attack joe biden particularly in the debates. So far that hasnt hurt. Senator gillibrand is no longer in the race. Theres a very clear lesson here that people know joe biden, they know who he is. They know his character. They know his empathy. So trying it attack him in personal terms the way secretary castro did last night, which, by the way, was an attack factually wrong, he was wrong on his fax as he was coming at the Vice President in this personal way did more damage to secretary castro than it did to joe biden. Lets talk about the key issue here. Id like to get your read on guns and what we heard from beto orourke saying, hell, yes were going to take your assault weapons. I had chris coons on the program last hour who, of course, is a good friend of senator biden. He said to me that clip will be played for years at Second Amendment rallies saying that is just going to further the narrative that democrats want to take your guns away. What is the biden camps read on that this morning . Today is actually the 25th anniversary of the signing po law of the assault weapons ban, which is the only time in recent history in this country when assault weapons were illegal and not allowed to be on the streets. The person who got that done was joe biden. That was his pill. Hes the person in this race want to distinguish for our viewers, the polling is different and the issue is different to ban them, ban assault weapons and to make a mandatory buyback. Does vice President Biden support mandatory buyback of all assault rifles . He supports a voluntary buyback, agrees we should not mandatory, though. Yes. Youve heard him correct. Youve heard him address this many times, i think he actually did it on the network talking to anderson cooper. He said we should set up voluntary buyback. Theres no reason these should be on the street. If you look at the error, again, hes the only democrat in the case who has a tangible record of accomplishment on this. He took on twice high capacity ban, brady bill. Talk about somebody who can take uhhuh. Im so sorry. We have a delay here which makes it a little difficult, i pom guys for that. No problem. Do you believe he does think it should be voluntary, does he agree with the senator who just told me this did damage what beto orourke said, did damage to the fight on guns saying that clip will be played at Second Amendment rallies for years. Thats for voters to decide. Hes focused on making his case about taking guns passing sensible gun control, which is something people support and want. The vast majority of people in this country support and want meaningful gun reform because, you know, frankly we are the only advanced country in the world where these kinds of Mass Shootings happen regularly. Frankly theres gun violence every day in the streets of this country, in cities around the country, that is unacceptable. People are torn away from their families. Its something vice President Biden feels personally. He was very close with many of the sandy hook families, spoke to them in the wake of that terrible tragedy in 2012, 2014, excuse me. This is extremely important to him. Its something that will be a priority to him and frankly something hes gotten done in his career. Hes the only democrat in this race who can say that. Lets finally end on the issue of the iraq war. This is an issue of major disagreement between senator sanders and vice President Biden. Here is a little on what we heard on this front last night. With regard to iraq, the fact of the matter is that, you know, i should have never voted to give bush authority to the do what he said he was going to do. You talked about the big mistake in iraq and the surge. The truth is the big mistake, the huge mistake, and one of the big differences between you and me, i never believed what cheney and bush said about iraq. Youre right. Voted against the war in i q iraq. We know it allowed inspectors in there and allowed use of force. He said in 2003, quote, he is not opposed to a war to remove weapons of mass destruction from iraq. Are you concerned about this Going Forward for the campaign, this being a Sticking Point as senator sanders clearly will continue to point it out . No, not at all. I think joe biden was a statesman on the stage last night across the course of the debate in many moments. I think in owning up to the fact that he regrets that vote, which is something hes said for many, many years, i think it stands in stark contrast to the president that we currently have in the white house who can never exhibit any leadership or admit to any wrongdoing. Its something vice President Biden has spoken candidly about over the course of his career. He said that last night. He also said when he was in the white house with barack obama, barack obama turned to him and said, joe, you handle iraq, and you be responsible for getting those 150,000 troops home, and he did that. Again, when you look at the stage and look at the turbulence and chaos donald trump has created across the world, and you think about who you want with their hand on the Steering Wheel i think joe biden is the person with experience in foreign policy, to give people a sense of security and calm and stable leadership and i think you saw him articulate that on the debate stage last night.
