Attorney general spear heads the third and latest probe of just how the russia investigation all began. But thats not all. The president also gave barr complete authority to make public any sensitive or classified intelligence that he wants. Even while refusing, ironic, to let congress see any of the underlying intel of the Mueller Report. Our ivan perez our senior justice correspondent joins me to break this down. Irony aside for the moment about the white house calling for full transparency here. Absolutely. What do these new powers mean that bill barr got overnight . Exactly. This is extraordinary, as you said, for the attorney general who is a noted vocal skeptic of the origins of the russia investigation to now have the power to essentially go to the cia, to the director of National Intelligence, to all the other intelligence agencies that were working with the fbi at the beginning of this investigation and have them declassify, have them essentially make Public Information that he believes needs to be made public as part of his investigation of the investigation. Let me read a part of what the president s order said, it says, quote, the attorney general may declassify, downgrade or direct the declassification or down grading of information or intelligence that relates to the attorney generals review. This is a review as you know, poppy, that is directing for the Justice Department to do to look at how this investigation started. By the way, this is something that Rod Rosenstein had looked at and had resisted. This is why one reason why the president is a lot more a lot happier with bill barr as attorney general because he is getting a lot of what he wanted to be done about the russia investigation. The reason, you know, the president is happy is because youve heard from bar exactly how he feels about this investigation. Take a listen to him on capitol hill just a couple weeks ago. I think there was spying did occur, yes, i think spying did occur. And, of course, poppy, you know that people a lot of people reacted they strongly to that, including the fbi, saying that thats director of fbi, chris wray, who said that is not a word he would use, spying. Here is adam schiff, the chairman of the Intelligence Committee reacting to the news today. He said, quote, while trump stone walls the public from learning the truth about his obstruction of justice, trump and barr conspire to weaponize Law Enforcement and classified information against their political enemies. The coverup has entered a new and dangerous phase. This is unamerican. Clearly, poppy, i think we will hear a lot more about this in the coming weeks and months as this investigation at the Justice Department continues and we will see exactly what bill barr decides needs to be made public to expose what he believes were some shady, perhaps, you know, goings on at the Intelligence Agency since the beginning of this investigation. Theres already two states attorneys general looking into this in utah and connecticut as well. And the inspector general. Thats true, Michael Horowitz. Right. So this is like a fourth one. Evan, appreciate the reporting. Let me bring in former attorney for the nsa susan hennessy, good morning. So good to have your brain power on this this morning. Its not just adam schiff, the chair of the House Intel Committee who was saying that its dangerous for the attorney general to have this power, to do this. You also have the former director of National Intelligence, james clapper. Here he is. Theres already been so much information declassified already that particularly in the form of the Mueller Report and the previous indictments. I wonder what else is going to be declassified that risks jeopardizing sources and methods. Do you agree with those concerns or are they overblown . I think clapper is right that this actually is representing something quite dangerous and thats that ordinarily whenever we think about sources and methods and classified information and what information the United States government wants to protect, the concerns that were worried about are National Security concerns and not political concerns. One of the things thats so alarming is that the president has decided to shift this authority from the director of National Intelligence to the attorney general. The director of National Intelligence sits over an interagency process, he is the one who is able to see what the consequences of declassifying information might be for the National Security and intelligence equities of the United States. So the idea that the president would put this put this new authority with the attorney general, someone who is not best positioned to understand the consequences of dee classifying that decision, i think is an indication that the way the president and the attorney general are thinking about this is not about the protection of National Security, but the potential political benefits. So youre saying this should really be Authority Given to dan coats . Dan coats traditionally already has this authority. The dni sits over all of those other agencies. Right. There is a process that exists for interagency to review. The information we are talking about here is the most sensitive form of information. Reportedly the attorney general is interested in the cias human assets in russia. Thats the kind of information that if disclosed really could have life and death consequences for people. Because the Authority Given to the attorney general or the direction given to the attorney general here from the president is not only should these 16 agencis report to you on this and dig into this and make this a priority, you should feel free to dee classify this and use that power. I mentioned it with evan, youve got Michael Horowitz the igs report expected to be done potentially very soon in june, you have the u. S. Attorney in utah already looking into this, recently we saw the attorney general, bill barr, tap the u. S. Attorney in connecticut to do the same thing and now we have this, the president ordering barr to do this. Should we expect all of the supporting intel to come out at the same time, susan, here is the ironic part, that congress has no access to the supporting intel underlying the Mueller Report . Right. So its not exactly clear which investigations are going to be prioritized. Bill barr has not explained why he doesnt think that the inspector generals investigation is going to be sufficient. Theres Something Else thats really significant about this latest investigation, both the executive order allowing barr to dee classify information and this new inquiry by the u. S. Attorney in connecticut and thats that this is not a criminal investigation. I think its safe to say that if there was a criminal predicate, which is required to have a criminal investigation, bill barr would be inclined to do that. Weve seen him really be supportive of the president s position. So the mere fact that instead hes launching yet another a third and fourthsortof vague reviewed, not an actual investigation, i do think its a pretty strong indication that even after these reviews weve already seen there is no criminal predicate that would actually support continuing to investigate this further. Okay. Susan hennessy, thank you very much. Lets keep talking about this with my next guest, Patrick Healy is here with the new york times, their Political Editor and also a cnn political analyst. Good morning to you. Good morning, poppy. How did this thing get started and the man who was the former fbi general counsel at the time who signed off on this probe, james baker, took the rare step of publicly defending it when he explained it was this australian democrat who said loose lips of George Papadopoulos at a bar, talk you go about dirt on hrc, dozens of emails. Lets listen. We dont have it. He said, quote, it would have been a dereliction of our duty not to investigate this information. Is he wrong . Should the feds will looked the other way . No, the feds should not have looked the other way. What President Trump is saying is that even though the step by step process that started this investigation has been laid out over and over again, President Trump is trying to focus on this kind of broader conspiracy idea about a deep state within the government that was spying on him, that was starting him, that was treating him unfairly and now he has an attorney general who is willing to carry water on that argument, who is willing to use the language like spying, who is willing to sort of embrace some of these deeper conspiracy theories that the president is putting forward. So the original investigation has been validated over and over and over again, but right now it has become so much in President Trumps own interest, in his own mind to discredit, discredit, discredit. Now youre seeing things like this extraordinary power being given to an attorney general who he trusts so much to carry that water where he didnt with someone like jeff sessions. An attorney general who just this week in an interesting interview with the wall street journal made the claim that i am not protecting this president , says attorney general bill barr, i am protecting the presidency. I wonder, though, i just laid out the four different now investigations into the origins of the russia probe. What if they dont all have the same result . Thats a good question. At the end of the day where President Trump wants bill barr to end up is similar to what barr did with the Mueller Report when it first came out. Bob mueller submitted an executive summary that we now know he wanted or at least his team wanted to be put out there, but bill barr instead put out that letter, as we all remember, that fourpage letter that really framed the narrative in exactly the way that President Trump wanted, and now you have President Trump giving the attorney general these powers to declassify information. What the intelligence agencies are worried about is that the attorney general will selectively, will cherry pick documents. What is declassified. What is declassified to set a narrative thats a good point. To set a narrative just as he did in that first Opening Weekend when the Mueller Report came out. Even though there are these sort of four investigations that could lead to different places, whats in the interest now is that President Trump trusts this attorney general so much to set a narrative to choose declassification that might work in his interest. Let me quickly ask you before we go, flip the script here, though. Are democrats hurting their push for transparency on the Mueller Report if they fight this with barr . Does that make sense . It makes sense. I think at the end of the day the democrats are trying to find a way, its so hard not to get boxed in on impeachment, that theyre making the argument for transparency, sort of knowing that President Trump is never going to give them ultimately what they want. So they think that they have some running room there to create pressure and not look, lets say, twofaced about it. Well see. Good to have you, my friend. I appreciate it. The leading candidate is former foreign secretary boris johnson, someone who has a high profile here, someone here who is known very well to President Trump who the president has said in the past that he believes would make a fine Prime Minister. They are deeply aware of the pressure that she has been facing domestically, aware of the pressure she has been facing within her own party, where a solid branch of that party really wanted her to take a very strong line against the European Union, perhaps walk away without achieving any sort of deal whatsoever. Now, you know, some republicans basically say we would do more if we could, if we had the support of the house of representatives, but for now if democrats are going to block everything and take up so much time on the floor of the senate the best we will be able to do are nominees and theyre okay with that. This is very scary and this is not going away and im fearful this is going to be all over the 2020 election. Its a signal that anything goes here. Anything goes. I mean, look, trump always reacts when he is attacked by attacking in a way thats even lower in the gutter and his forces dont mind this. He likes to play this game and he was looking for a nickname for her, now its going to be crazy. All this is going to be supported by whatever they can come up with. But youre right, its a signal for where its going to go because this is going to be manipulated all over the place, no matter what people think is true, they are going to have to question it when they see something, especially online. And, in fact, a lot of people are saying this is a very crude example because its pretty obviously done this way, but theres so many people sharing it and then you have the president retweeting. That wasnt a doctored video, that was an edited video where they speeded her up, repeated things, made it look like she was stammering. That was an edited video. The idea that he sends it out to 60 million followers or something, you clearly are using technology to send a false message. A video that is educated to look like something that it was not. Yes. Posted on twitter by the president of the United States. We should not be surprised that the president of the United States this president is doing something no other president would ever do because he doesnt have the responsibility gene, he doesnt have a conscience. He attacks anyone who attacks him and he doesnt really think about t we shouldnt be surprised by it but i think it is a signal its going to get a worse and also a sign that hes desperate and upset with the way hes being attacked. The president is signaling his tariff regime with china is here to stay by baling out american farmers, who he says are being attacked by china and those retaliatory tariffs. The president promising 16 billion in aid and said that china, china with charges and tariffs was going to pay for it. That is not true. China is not paying for the farmer rescue, just likes mexico is not paying for the president s border wall. Trump does not have a Magic Bank Account with tariff revenue that he can write a check from, it comes from all the money thats in the treasury coffers, just like everything else. It doesnt work like that. The program the usda the Ag Department wanted to use began as a depression era emergency facili facility meant for economic disaster. The white house confirming the president s trade war is a disaster for farmers. Farmers will not be made whole by this. The bailout wont be enough to cover everything theyve lost because of the trade war. The Corn Growers Association said the last bailout amounted to a penny a bushl for corn. Farmers dont want bailouts, this he want access to global markets. Farmers are the Collateral Damage here and theres new evidence that American Consumers are paying the tariffs not china. The new york fed reported the latest increase in tariffs on china is costing the average American Household 831 a year. Something to think about here, in the greatest capitalist economy in the world, the president of the United States is picking the winners and losers. He is essentially affecting a transfer of wealth from consumers who ultimately pay those tariffs to farmers who are being hurt by his policies. Small farmers feeling it the most here. As Miguel Marquez who is in iowa today said so eloquently, if today you resolve this, it would still be months and years before farmers could figure out how to get back on their feet here. Thank you. Thank you for having me. How is it possible that you still have not seen a penny, you say, from the first 12 billion bailout for farmers . Well, you know, historically when subsidy payments go out to farmers around the country, black farmers seem to be able left out of the equation or the payments or a fraction of what they should be. Even the proposed payments that the president is talking about today, they are leaving out that millions of dollars would go to Foreign Countries such as brazil and Large Scale Companies like Smithfield Foods where we see these type of subsidies. This administration has failed small scale farmers, has failed black farmers like myself. Ive been reaching out to this administration to talk about the effects of tariffs to my farming operation and it has a rippling effect, its going to hurt the timber industry, truckers, all of these people will be affected. So anytime you lose a timber farm and you cant get a fair price for your crop, the president says this is going to be a great time to be a farmer. Thats the wrong message to send out to the American People where farmers like myself are suffering at the hands of this administration and the tariffs have hurt farmers. Let me im from minnesota and so much of our economy relies on farming as well, i will never forget a video about a month ago of a dairy farmer in tears, a young man in tears, because of what hes faced in terms of prices, et cetera. For you i was reading that your soybean crops from gone from 16. 80 a bushel down to 8. Thats the reality of what you are facing. If the bailout money were to come to you from the 12 billion or the new 16 billion package, lets hope it does come, is that what you want ultimately or do you want a fundamental trade change . Farmers want free trade. Farmers want a fair price for their commodity. When i harvest my crop, i simply want to load my truck up, take it to my local Grain Elevator and get a fair price for that crop. Im not interested in going to apply for additional moneys at usda that i will probably never get, going through the paper shuffle and going through the calls of speaking to numerous people about how to get these payments. Thats not what farmers need. We need to reopen these doors to places like china who had who was purchasing 90 of u. S. Soybeans and this administration has failed to open up new markets and thats whats hurting us here. You take away the biggest market and dont open up, you know, new doors for farmers. Let me ask you this finally, sir, obviously youve been a vocal critic of the president for a while on this front, you are a democrat, i believe you ran for Public Office at one point. Im interested, im sure you have got a lot of republican friends, sir, right, who are farmers who voted for the president. Well let me just finish the question. Im just interested in if those republican farmers are sticking with the president on this or if theyre telling you this is enough . They seem to be sticking with the president and i cant understand why. You know, what is it going to take for them to say, listen, we need some type of new leadership, we need something here. We need a person that can bring this country together and bring it together for small people, black, white, blue, green and brown. This administration has seemingly left out people like myself. When weve asked to meet with the president , the agriculture secretary, the agriculture secretary says he talks to black farmers every day during his official rounds and he doesnt turn down any invitations. He turned down my invitation and if hes watching this show today, my door is still open to talk about these tariffs because thats what america is supposed to be about. Even though i dont agree with him, we should be able to sit down at the table and come up with some amenable things that can help everybody, not jim sciutto some people, no the just large scale farmers and big companies, but people that look like me, too. It appears this morning Robert Mueller is willing to testify before congress, but house judiciary chair jerry nadler says the special counsel wants that testimony to be behind closed doors. Hes willing to make an opening statement, but he wants to testify in private and we are were saying he ought to we think its important for the American People to hear from him and to hear his answers to questions about the report. And its not just nadler calling for mueller to testify before his committee, house intel chair adam schiff wants the same thing. Let me bring in our Congressional Correspondent phil mattingly, he joins me now. So the reasoning here is that the mueller doesnt want to appear political at all. Yeah. Right . Doesnt want i mean, think of think about comey. Yeah, i think there is a lot of concern Robert Mueller is not new to washington, he has seen how hearings go, he has been through his share of hearings when he was the fbi director and understands that they quickly turn into political circuses and sideshows. I think thats what you heard jerry nadler the chairman of the Judiciary Committee last night first say publicly what we had reported a couple days ago that, mueller and his team were reticent about going up here because they didnt want him to become a political punching bag, political figure. He sass has not said anything over the course of the last couple years publicly. Given the number of questions that are in the 400page plus report in terms of what was his intention, particularly in the second section on obstruction, one of the big things democrats have said is it looks like he is has been playing out a roadmap for potential impeachment and for congress to take action. Nobody really knows. What were the conversations like with the attorney general. Democrats want those in public. They want the hearing public, they want the tv spectacle of it because they are concerned that this report and what it details has fallen by the wayside without that. Thats why you heard nadler say that he wants this in public. I have talked to democrats, they are counting on this being in public. What nadler said they have offered a Public Statement and going behind closed doors and perhaps release ago transcript. Everybody im talking to on capitol hill on the democratic side said thats not going to be enough. As you can expect the president is tweeting about this this morning saying doesnt understand why they would want bob mueller to come up, they want a do over. Disgraced Film ProducerHarvey Weinstein has agreed to pay 44 million in a settlement to resolve civil lawsuits over his alleged sexual misconduct. The settlement has nothing to to with his criminal case, however, and thats very important. National correspondent Brynn Gingras is with me. Otherwise, that could be seen as an admission. So nothing to do with the criminal case. But it will be interesting to see how these more than 80 people who have come forward, this money gets divvied up to who. So, that money, though this is also important its coming from insurance policies that not weinstein himself, according to his brother, Bob Weinsteins attorney, adam harris. Now, harris mentioned this deal in court to a bankruptcy judge in delaware. This settlement is in response to the new York Attorney generals civil lawsuit filed last year against harvey and Bob Weinstein and their former film studio, weinstein company, which the brothers sold a year ago. The a. G. Suit claimed egregious violations of new yorks civil rights, human rights and Business Laws and noted claims of victim sexual harassment, intimidation and other misconduct. Of course, weve reported on dozens of those accounts. According to a source, this is how the 44 million settlement would be divvied up 14 million to legal fees to Weinstein Associates who are named as defendants in that suit, and 30 million would go to alleged victims, creditors, and former employees of the weinstein company. Now, one of those victims named in that suit is an actress who accused wine sustaeinstein of ro occasions in 2010. Her lawyer said the settlement is positive for the victims involved and they can avoid the stress and trauma of full litigation. The details of the settlement still need to be approved by a judge at a hearing in june. Weinsteins spokesman and the Attorney Generals Office would not comment about this. But again, keep in mind, this does not have anything to do with the five criminal charges that weinsteins facing. Hes accused, of course, of raping a woman in a hotel room and forcibly performing oral sex on another woman in 2006, and that trial is coming up, september. That will be the trial here in new york . So, were expecting to see documents within the States Attorneys Office there in cook county that would maybe shed some light on exactly why there was this very surprise and sudden dismissal of all charges against Jussie Smollett, though smollett did relinquish his 10,000 bond, which went back to the city, but he did not admit any wrongdoing and has maintained his innocence throughout. But it was a surprise to a lot of people that this case was suddenly dismissed. What we have already received are some documents from the courts. And ill give you some examples of what are in those documents many of the things that we already know. For example, the court, you see the actual sealed stamp that the court put onto the document, so you couldnt even see the sealing order that the judge put forward, and thats because of a law, a newly enacted law in illinois that is basically to try to protect people who have been exonerated or who have had their charges dismissed, to keep them from not being able to get employment, for example. But the judge decided after media Companies Like cnn, the new york times, and others came forward and said, look, this is an exceptional case because he is a public figure, and the judge agreed that he brought a lot of the publicity on himself. He is the one that made this public, and so, now all the documents involving what the States Attorneys Office decided to do and how they decided to dismiss this case should be open to the public. Prosecutors, we learned from the courts, also didnt object to sealing those documents, but certainly, there is a lot of information that people are expecting to see as to how this all happened.
